El Consejo Superior, en este artículo, acordó tomar nota del informe y remitirlo a la Comisión de Asuntos Ambientales para los fines correspondientes. No se adopta una decisión de fondo sobre las recomendaciones, sino que se limita a dar traslado del estudio.",

  "body_es_text": "ARTÍCULO XLVII\r\n\r\n\r\n\r\n\r\n\r\n\r\n\r\n\n\r\n\r\n\nARTÍCULO XLVII\n\r\n\r\n\nDocumento Nº 3912-13, 3900-14\n\r\n\r\n\nEn sesión Nº 36-13 del 16 de abril del año 2013,\r\nartículo LXXVII, se trasladó al Departamento de Personal, la solicitud de\r\naprobación de una plaza de gestor en materia ambiental, a efecto de que se\r\ndeterminara el perfil y la posible ubicación de la plaza, dentro de la\r\nestructura del Poder Judicial.\n\r\n\r\n\nEl máster Walter Jiménez Sorio, Auditor\r\nGeneral interino, en oficio Nº 406-28-AEE-2214 de 7 de abril de 2014, informó\r\nlo siguiente:\n\r\n\r\n\n“Para que se haga de\r\nconocimiento de la Comisión de Asuntos Ambientales, le remito el estudio\r\nefectuado por la Sección de Estudios Especiales del Despacho a mi cargo denominado “Evaluación para el mejoramiento y fortalecimiento de la implementación de la Política de Gestión Ambiental en el Poder Judicial”.\n\r\n\r\n\nDe acuerdo con los resultados\r\ndel estudio realizado se logró determinar como un aspecto susceptible de mejora\r\nen la gestión las Políticas ambientales en el Poder Judicial, la necesidad de\r\nque el Plan de Gestión Ambiental Institucional, cuente con un coordinador, con\r\nel fin de que planifique, organice, controle y de seguimiento a las actividades\r\nque se llevan a cabo en este Plan, aunado al cumplimiento de la normativa en\r\nmateria ambiental.\n\r\n\r\n\nEs importante señalar que en\r\ncumplimiento de la normativa vigente, los resultados del estudio fueron\r\npresentados a la citada Comisión, encargada de la implementación de las\r\nacciones de mejora emitidas en el informe, estableciéndose plazos de\r\ncumplimiento. \n\r\n\r\n\nNo omito indicar que con la\r\nimplementación de la recomendaciones emitidas se pretende minimizar el riesgo\r\nde que en el futuro de presenten las debilidades detectadas. Además, es\r\nrelevante señalar que de conformidad con lo establecido en la Ley General de Control Interno, esta Auditoría efectuará en su momento un seguimiento, para\r\nasegurarse de que las acciones establecidas por la instancia competente, se\r\nhayan implementado eficazmente y dentro de los plazos definidos en cada caso.”\n\r\n\r\n\n-0-\n\r\n\r\n\nDe la citada evaluación se transcriben las\r\nconclusiones y recomendaciones que literalmente dicen:\n\r\n\r\n\n\"CONCLUSIONES\r\nDEL ESTUDIO\n\r\n\r\n\nDe conformidad con la evaluación\r\nrealizada a la Política Ambiental en el Poder Judicial, se determinó que el\r\nPrograma de Gestión Ambiental en la Institución, no se esta cumpliendo, debido a que no dispone de una coordinador del Programa que lo administre y que realice la\r\nlabor operativa de coordinación, de control y de seguimiento en las diferentes\r\nactividades que se realizan tanto en este Plan, como de las tareas realizadas\r\npor la Comisión de Asuntos Ambientales. Derivado de lo anterior, no se está\r\ncumpliendo con los compromisos institucionales con el MINAE.\n\r\n\r\n\nRECOMENDACIONES\r\nDEL ESTUDIO\n\r\n\r\n\nA LA COMISIÓN DE ASUNTOS AMBIENTALES\n\r\n\r\n\n4.1 Solicitar al Departamento de Planificación\r\nel estudio para crear una plaza de Gestor en Materia Ambiental en el Poder\r\nJudicial, a fin de que planifique, coordine y evalúe la gestión del PGAI, como\r\napoyo técnico y operativo de la Comisión de Asuntos Ambientales. Esto con el propósito de lograr contar con el recurso idóneo que permitirá cumplir con los\r\ncompromisos adquiridos en el “Programa de Gestión Ambiental Institucional 2011-2015” y siguientes.\n\r\n\r\n\nLa plaza deberá realizar entre otras las\r\nsiguientes actividades:\n\r\n\r\n\n· \r\nPlanificar la gestión de cumplimiento del PGAI y los\r\nsubprogramas.\n\r\n\r\n\n· \r\nDar seguimiento al cumplimiento de los responsables de cada uno\r\nde los subprogramas. \n\r\n\r\n\n· \r\nGestionar las diferentes actividades del PGAI, para lo cual\r\ndeberá coordinar y mantener comunicación constante con las subcomisiones y las\r\nadministraciones regionales.\n\r\n\r\n\n· \r\nConocer mejores prácticas de las subcomisiones y de las\r\nadministraciones regionales e integrarlas a otras regiones y al resto de las\r\nsubcomisiones, o la Comisión.\n\r\n\r\n\n· \r\nEstablecer indicadores de consumo de electricidad, agua, emisión\r\nde gases, material reciclado, capacitaciones brindadas, papel consumido, entre\r\notras, tal como se señala en el PGAI.\n\r\n\r\n\n· \r\nElaborar un plan de la gestión integral de los residuos\r\ninstitucionales (papel, plástico, aguas residuales, material tecnológico, materias\r\npeligrosas, edificios amigables con la naturaleza)\n\r\n\r\n\n· \r\nCoordinar la integración de un plan de capacitación institucional\r\nque incluya los esfuerzos realizados por la Escuela Judicial en la formación de cursos en materia de derecho ambiental dirigido a funcionarios\r\ny funcionarios de diversas áreas, así como el Curso virtual PJ Verde\r\ndesarrollado por la Dirección de Gestión Humana, así como la participación\r\nciudadana y la sensibilización por medio de la divulgación. \n\r\n\r\n\n· \r\nPlanificar y coordinar el manejo de residuos generados en la Ciudad Judicial (Departamento de Ciencias Forenses, Departamento de Medicina Legal y el\r\nDepartamento de Artes Gráficas) y los de las oficinas de salud que existen en\r\nla institución.\n\r\n\r\n\n· \r\nCoordinar con la Proveeduría la elaboración de lineamientos con criterios de compras verdes a utilizarse en los procedimientos de adquisición\r\nde bienes en la Proveeduría Judicial así como en las diferentes\r\nadministraciones regionales.\n\r\n\r\n\n· \r\nCoordinación con el Departamento de Servicios Generales la\r\nelaboración de lineamientos sobre las remodelaciones, mejoras y nuevas\r\nconstrucciones, tomando en consideraciones materiales y diseños amigables con\r\nla naturaleza.\n\r\n\r\n\n· \r\nCoordinar con Salud Ocupacional la implementación de un plan para\r\nel manejo de Amenazas naturales y antrópicas.\n\r\n\r\n\n· \r\nCoordinar con los responsables del subprograma, la implementación\r\nde los planes de Biotopos (flora y fauna) existentes en la Institución.\n\r\n\r\n\n· \r\nMantener la normativa referente a los asuntos ambientales\r\nactualizada.\n\r\n\r\n\n· \r\nCoordinar con las Administraciones Regionales, la implementación\r\ndel Plan de Gestión Ambiental en otros Circuitos Judiciales de manera\r\nprogresiva.\n\r\n\r\n\n· \r\nCoordinar con el responsable del subprograma la emisión de gases\r\nde efecto invernadero (de fuentes móviles y/o fijas) \n\r\n\r\n\n· \r\nRecopilación de información sobre los subprogramas para llevar\r\ninformes, revisiones y controles y emitir los informes respectivos a MINAE y \r\notras instancias que lo requieran.\n\r\n\r\n\n· \r\nOtras \n\r\n\r\n\nPlazo de implementación: inmediato \n\r\n\r\n\n4.2 Solicitar al Consejo Superior, valorar la dotación de un recurso para nombrar un profesional que colabore\r\ncon la implementación, administración y seguimiento del PGAI, con lo cual se\r\nlograría cumplir con los compromisos institucionales ante el MINAE, mientras se\r\ntramita el estudio de la plaza de gestor ambiental.\n\r\n\r\n\nPlazo de implementación: inmediato \n\r\n\r\n\n4.3 Reactivar las reuniones de la Comisión de Asuntos Ambientales, a fin de darle continuidad a la gestión del PGAI y realizar\r\nlas siguientes actividades mientras se cuenta con una plaza de gestor\r\nambiental:\n\r\n\r\n\n· \r\nExponer a MINAE la problemática que enfrenta la institución,\r\ndebido a la ausencia de una plaza que gestione el PGAI, con el fin de solicitar\r\nuna prorroga a los compromisos adquiridos por el Poder Judicial, que requieren\r\ndel especialista ambiental para su cumplimiento.\n\r\n\r\n\n· \r\nDefinir formalmente responsables de los programas, con el\r\nobjetivo de que exista un mayor compromiso en el cumplimiento y vigilancia de\r\nlas actividades que se realizan en las áreas.\n\r\n\r\n\n· \r\nEstablecer la periodicidad con la cual los responsable por\r\nsubprograma, deben brindar informes sobre la gestión realizada, ante la Comisión de Asuntos Ambientales.\n\r\n\r\n\n· \r\nCoordinar con los responsables de los programas lo \r\ncorrespondiente a la elaboración, desarrollo, implementación, divulgación \r\nde los PGAI. \n\r\n\r\n\n· \r\nDefinir la estrategia de capacitación y sensibilización del PGAI,\r\nmediante el curso virtual PJverde, el cual ya se encuentra listo para su\r\naplicación.\n\r\n\r\n\n· \r\nElaborar y remitir los informes que solicite el MINAE.\n\r\n\r\n\nPlazo de implementación: inmediato”\n\r\n\r\n\n-0-\n\r\n\r\n\nSe acordó: Tomar nota del informe Nº 406-28-AEE-2214 de la Auditoría, sobre la   "body_en_text": "ARTICLE XLVII\n\nDocument No. 3912-13, 3900-14\n\nIn session No. 36-13 of April 16, 2013, article LXXVII, the request for approval of a position for an environmental manager (gestor en materia ambiental) was referred to the Personnel Department, in order to determine the profile and possible location of the position within the Judicial Branch structure.\n\nMaster Walter Jiménez Sorio, Acting Auditor General, in official communication No. 406-28-AEE-2214 of April 7, 2014, reported the following:\n\n\"For the information of the Environmental Affairs Commission (Comisión de Asuntos Ambientales), I am forwarding the study conducted by the Special Studies Section of my office entitled 'Evaluation for the improvement and strengthening of the implementation of the Environmental Management Policy in the Judicial Branch.'\n\nAccording to the results of the study conducted, a need for the Institutional Environmental Management Plan to have a coordinator was identified as an aspect susceptible to improvement in the management of environmental policies in the Judicial Branch, so that this person can plan, organize, control, and follow up on the activities carried out under this Plan, coupled with compliance with environmental regulations.\n\nIt is important to note that, in compliance with current regulations, the results of the study were presented to the aforementioned Commission, which is responsible for implementing the improvement actions issued in the report, with compliance deadlines being established.\n\nI must also state that the implementation of the issued recommendations is intended to minimize the risk of the detected weaknesses recurring in the future. Furthermore, it is relevant to point out that, in accordance with the provisions of the General Law of Internal Control, this Audit Office will conduct a follow-up in due course to ensure that the actions established by the competent entity have been implemented effectively and within the deadlines defined in each case.\"\n\n-0-\n\nFrom the cited evaluation, the conclusions and recommendations are transcribed, which literally state:\n\n\"STUDY CONCLUSIONS\n\nIn accordance with the evaluation carried out on the Environmental Policy in the Judicial Branch, it was determined that the Environmental Management Program in the Institution is not being complied with, because it lacks a Program coordinator to administer it and to carry out the operational work of coordination, control, and follow-up on the different activities carried out both in this Plan and in the tasks performed by the Environmental Affairs Commission. As a result of the foregoing, institutional commitments to MINAE are not being met.\n\nSTUDY RECOMMENDATIONS\n\nTO THE ENVIRONMENTAL AFFAIRS COMMISSION\n\n4.1 Request the Planning Department to conduct the study to create a position of Environmental Manager in the Judicial Branch, so that this person can plan, coordinate, and evaluate the management of the PGAI, as technical and operational support for the Environmental Affairs Commission. This is for the purpose of having the ideal resource that will allow compliance with the commitments acquired in the \"Institutional Environmental Management Program 2011-2015\" and subsequent programs.\n\nThe position shall carry out, among others, the following activities:\n\n· Plan the compliance management of the PGAI and the subprograms.\n\n· Follow up on compliance by those responsible for each of the subprograms.\n\n· Manage the different activities of the PGAI, for which they must coordinate and maintain constant communication with the subcommittees and regional administrations.\n\n· Learn about best practices from the subcommittees and regional administrations and integrate them into other regions and the rest of the subcommittees, or the Commission.\n\n· Establish indicators for electricity consumption, water, gas emissions, recycled material, training provided, paper consumed, among others, as indicated in the PGAI.\n\n· Develop a plan for the comprehensive management of institutional waste (paper, plastic, wastewater, technological material, hazardous materials, nature-friendly buildings)\n\n· Coordinate the integration of an institutional training plan that includes the efforts made by the Judicial School in developing courses on environmental law aimed at officials from various areas, as well as the PJ Verde virtual course developed by the Human Resources Directorate, along with citizen participation and awareness-raising through dissemination.\n\n· Plan and coordinate the management of waste generated in the Ciudad Judicial (Department of Forensic Sciences, Department of Legal Medicine, and the Department of Graphic Arts) and those from the health offices that exist in the institution.\n\n· Coordinate with the Procurements Office (Proveeduría) the development of guidelines with green purchasing criteria to be used in the procurement procedures for goods in the Judicial Procurements Office (Proveeduría Judicial) as well as in the different regional administrations.\n\n· Coordinate with the General Services Department (Departamento de Servicios Generales) the development of guidelines on renovations, improvements, and new constructions, taking into consideration nature-friendly materials and designs.\n\n· Coordinate with Occupational Health (Salud Ocupacional) the implementation of a plan for the management of natural and anthropic threats.\n\n· Coordinate with those responsible for the subprogram the implementation of the Biotope plans (flora and fauna) existing in the Institution.\n\n· Keep the regulations concerning environmental matters updated.\n\n· Coordinate with the Regional Administrations the progressive implementation of the Environmental Management Plan in other Judicial Circuits.\n\n· Coordinate with the person responsible for the subprogram on greenhouse gas emissions (from mobile and/or stationary sources)\n\n· Compile information on the subprograms to maintain reports, reviews, and controls and issue the respective reports to MINAE and other entities that require them.\n\n· Others\n\nImplementation deadline: immediate\n\n4.2 Request the Superior Council (Consejo Superior) to assess the provision of a resource to appoint a professional who can collaborate with the implementation, administration, and follow-up of the PGAI, which would make it possible to fulfill the institutional commitments to MINAE while the study for the environmental manager position is being processed.\n\nImplementation deadline: immediate\n\n4.3 Reactivate the meetings of the Environmental Affairs Commission, in order to give continuity to the management of the PGAI and carry out the following activities while a position for an environmental manager is available:\n\n· Explain to MINAE the problems the institution faces due to the absence of a position to manage the PGAI, in order to request an extension on the commitments acquired by the Judicial Branch that require the environmental specialist for their fulfillment.\n\n· Formally define those responsible for the programs, with the objective of achieving greater commitment in the compliance and oversight of the activities carried out in the areas.\n\n· Establish the frequency with which those responsible for each subprogram must provide reports on the management performed to the Environmental Affairs
