Además, se ordena a la Dirección de Planificación valorar la creación del puesto, determinar su adscripción administrativa (posiblemente al Despacho de la Presidencia con adscripción funcional a la Comisión), y realizar el estudio de implementación del PGAI, solicitando una ampliación de plazo al MINAE para el cumplimiento de los informes semestrales atrasados, reconociendo las limitaciones presupuestarias y la posibilidad de redistribuir plazas existentes.",

  "body_es_text": "ARTÍCULO LXXV\r\n\r\n\r\n\r\n\r\n\r\n\r\n\r\n\n\r\n\r\n\nARTÍCULO LXXV\n\r\n\r\n\nDOCUMENTO\r\nNº 3912-13, 11945-14\n\r\n\r\n\nEn sesión Nº 36-13 del 16 de abril del año 2013,\r\nartículo LXXVII, se trasladó a la Dirección de Gestión Humana, la gestión planteada por la Comisión de Asuntos Ambientales, relacionada con la aprobación de\r\nuna plaza de gestor en materia ambiental, a efecto de que se determinara el\r\nperfil y la posible ubicación de la plaza, dentro de la estructura del Poder\r\nJudicial.\n\r\n\r\n\nMediante oficio Nº CP-79-14 del 12 de mayo de 2014, el\r\nmáster Francisco Arroyo Meléndez, Director de Gestión Humana, comunicó el acuerdo\r\ntomado por el Consejo de Personal en sesión Nº 6-2014 celebrada el 10 de abril\r\nde 2014, artículo VII, que literalmente dice:\n\r\n\r\n\n“(…)\n\r\n\r\n\n \n\r\n\r\n\n“Se\r\nconoce el Informe SAP-023-2014 de la Sección de Análisis de Puestos. \n\r\n\r\n\n \n\r\n\r\n\nLas\r\nconclusiones y recomendaciones del documento son las siguientes:\n\r\n\r\n\n \n\r\n\r\n\nCon\r\nla finalidad de que sea conocido por el Consejo de Personal, nos permitimos\r\ninformarle que el Consejo Superior en sesión Nº 36-13 celebrada el 16 de abril\r\ndel año en curso en su artículo LXXVII acordó: “Trasladar la comunicación\r\nanterior al Departamento de Personal a efecto de que determine tanto el\r\nperfil así como la posible ubicación de la plaza de gestor en materia ambiental\r\ndentro de la estructura del Poder Judicial.”. \n\r\n\r\n\n \n\r\n\r\n\nCon\r\nel fin de cumplir la disposición anterior se procedió a realizar la siguiente\r\ninvestigación con el fin de establecer el perfil del puesto correspondiente.\n\r\n\r\n\n \n\r\n\r\n\n6. CONCLUSIONES \n\r\n\r\n\n \n\r\n\r\n\nLa\r\ngestión ambiental es un tema de interés nacional de orden constitucional (Art.\r\n50 Constitución Política), razón por la cual toda institución debe contar e\r\nimplementar un sistema de gestión ambiental (Art. 28 Ley para la Gestión Integral de Residuos). De tal forma que toda institución por imperativo legal debe\r\ntener un Programa de Gestión Ambiental Institucional (PGAI) y un puesto de\r\nGestor Ambiental Institucional que garantice su implementación y sostenibilidad\r\n(Art. 27 y 28 del Reglamento General a la Ley para la Gestión Integral de Residuos, decreto ejecutivo N° 37567-S-MINAET-H).\n\r\n\r\n\n \n\r\n\r\n\nEl PGAI\r\nes un instrumento de planificación que parte de un diagnóstico que debe\r\ncontener todos los aspectos relacionados del quehacer institucional (eficiencia\r\nenergética, residuos y cambio climático, entre otros aspectos ambientales), con\r\nel propósito de establecer e implementar a corto, mediano y largo plazo,\r\nmedidas de prevención, mitigación, compensación o restauración de los impactos\r\nambientales. Este programa o plan como también se le ha denominado, es un\r\nproceso cíclico de planificación, implementación, revisión y mejora de los\r\nprocedimientos y acciones que realiza la institución (Art. 2 Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa\r\nRica, Decreto Ejecutivo Nº 36499-S-MINAET).\n\r\n\r\n\n \n\r\n\r\n\nEl Poder\r\nJudicial, desde el 8 de setiembre del 2009, cuenta con la Comisión de Asuntos Ambientales cumpliendo con el mandato legal correspondiente (Art. 7\r\nReglamento para la Elaboración de Programas de Gestión Ambiental Institucional\r\nen el Sector Público de Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET). Esta\r\ncomisión con el fin de impulsar al Poder Judicial en el tema ambiental ha\r\nelaborado un PGAI compuesto por nueve programas específicos (aguas residuales,\r\nagua de consumo, control de la flota vehicular, prevención y atención de\r\ndesastres naturales, eficiencia energética, gestión de los residuos sólidos\r\nordinarios, adquisición de bienes y servicios amigables con el ambiente,\r\nrevisión y actualización de la legislación ambiental vigente y participación\r\nciudadana y capacitación). \n\r\n\r\n\n \n\r\n\r\n\nDe\r\nacuerdo a lo que establece la normativa correspondiente (Art. 8 Reglamento para\r\n la Elaboración de Programas de Gestión Ambiental Institucional en el Sector\r\nPúblico de Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET), la Comisión Institucional tiene como funciones la realización de diagnósticos o evaluaciones\r\npara determinar el estado de la institución en tema de gestión ambiental,\r\ngestión de residuos, cambio climático y eficiencia energética, proponer una\r\npolítica ambiental institucional, elaborar e implementar el PGAI, remitir informes\r\nsolicitados por el MINAET y establecer indicadores cuantificables para el PGAI.\n\r\n\r\n\n \n\r\n\r\n\nSe\r\nconcluye que de acuerdo a la normativa vigente, es indubitable la necesidad de\r\ncontar con un puesto de Gestor Ambiental, con el fin de que proporcione el\r\nconocimiento técnico y especializado en la elaboración del PGAI, la elaboración\r\nde diagnósticos y el desarrollo de proyectos en temas ambientales, brindar los\r\ninformes de avance correspondientes del PGAI, así como de brindar\r\nrecomendaciones de prevención, mitigación, compensación y restauración del daño\r\nambiental a nivel Institucional, entre otras que establezca la Comisión de Asuntos Ambientales del Poder Judicial.\n\r\n\r\n\n \n\r\n\r\n\nDe la\r\ninformación recabada en diferentes instituciones se puede concluir que en\r\nmuchas no se cuenta con un puesto específico de Gestor Ambiental y las\r\nfunciones han sido asumidas por recargo por diferentes puestos de la\r\ninstitución (Asamblea Legislativa, Procuraduría General de la República, Tribunal Supremo de Elecciones, Instituto Nacional de Aprendizaje, Municipalidad\r\nde San José), sin embargo otras instituciones si cuentan con perfiles\r\nespecíficos y homólogos al Gestor Ambiental (Compañía Nacional de Fuerza y Luz,\r\nMunicipalidad de Alajuela, Municipalidad de Santa Ana, Municipalidad de la Unión y Municipalidad de Tibás).\n\r\n\r\n\n \n\r\n\r\n\nEn cuanto\r\na la ubicación de los puestos de Gestor Ambiental o las dependencias encargadas\r\nde ese tema en las instituciones consultadas, se tiene que pueden serlo de la\r\nsiguiente forma: a un determinado proceso o departamento (siendo este el de\r\nmenor nivel en la ubicación estructural y de relación de autoridad funcional)\r\ncomo lo es el caso de la Compañía Nacional de Fuerza y Luz y las Municipalidades de Alajuela, San José y Tibás; también a nivel de staff como en el caso de la Municipalidad de la Unión; adscrito a instancias superiores de la institución como sucede en\r\nel Instituto Nacional de Aprendizaje y la Municipalidad de Santa Ana o propiamente a una Comisión Institucional específica para el tema\r\nambiental (órgano colegiado conformado por puestos de diferentes\r\ndepartamentos), como sucede en el caso de la Asamblea Legislativa y el Tribunal Supremo de Elecciones. Por lo tanto se concluye que no\r\nexiste un patrón específico de adscripción organizacional, sino que los cargos\r\nhan sido ubicados de conformidad con la organización, necesidades y políticas\r\nde cada institución, pudiéndose ubicar el puesto de Gestor Ambiental en una\r\nDirección, Departamento, a nivel de staff o a una Comisión Institucional.\n\r\n\r\n\n \n\r\n\r\n\nEn el\r\ncaso del Poder Judicial y según criterio del presidente de la Comisión de Asuntos Ambientales, Magistrado Oscar Gonzalez Camacho, se podría considerar la\r\nadscripción del puesto de Gestor Ambiental en el Despacho de la Presidencia. Ahora bien, es opinión de este departamento que debería de darse una\r\nadscripción administrativa al Despacho de la Presidencia y una adscripción funcional con respecto a la Comisión de Asuntos Ambientales, con el fin de que se pueda empoderar adecuadamente al ocupante del puesto, que deberá de\r\ncoordinar con muchas instancias de la institución para el adecuado desarrollo\r\nde sus funciones. Ahora bien, se debe dejar claro sobre la conclusión\r\nanterior, que la misma es únicamente un criterio producto de la investigación\r\nrealizada, a sabiendas que no es este el departamento competente para la\r\ndecisión definitiva, que por competencias propias le corresponde al\r\nDepartamento de Planificación. \n\r\n\r\n\n \n\r\n\r\n\nSe logra\r\nconcluir de las consultas realizadas a diferentes instituciones, que existe una\r\nsimilitud en cuanto a las tareas o funciones que realizan los puestos de Gestor\r\nAmbiental, razón por la cual y considerando lo que indica la ley, la solicitud\r\nde la Comisión de Asuntos Ambientales, el DIGECA y la información proporcionada\r\npor el Lic. Mauricio Chacón Hernández, Perito Judicial que ha participado\r\nactivamente en la elaboración del PGAI del Poder Judicial, que las funciones\r\nque deben incluirse en el perfil correspondiente del puesto deben contener las\r\nsiguientes: labores de diagnóstico e investigación, establecer directrices,\r\nplanes, programas, proyectos y líneas de acción orientadas a la consolidación\r\nde las políticas públicas ambientales, cumplimiento de la normativa aplicable,\r\nelaboración de programas ambientales, evaluaciones de impacto ambiental,\r\nelaboración de indicadores de gestión, coordinación y verificación de la\r\nimplementación de proyectos ambientales, asesorar con criterios técnicos\r\nambientales diferentes dependencias de la institución, gestión e inventario de\r\nresiduos, gasto eléctrico, gasto de agua y gasto de combustible, realizar\r\nplanes para velar por la adecuada canalización de las aguas pluviales servidas,\r\nresiduales, negras y el tratamiento de las mismas, brindar criterios y análisis\r\ntécnico de cláusulas ambientales en contratación administrativa (compras\r\nverdes), diagnóstico y control de emisiones líquidas, sólidas, atmosféricas y\r\ntóxicos peligrosos, programas de reciclaje, inspecciones en sitio, representar\r\na la institución en temas ambientales, elaboración, implementación y\r\nseguimiento del PGAI así como su coordinación con el DIGECA, brindar\r\ncapacitación, hacer campañas de sensibilización e información y realizar la\r\nregencia ambiental de la institución (prevenir, controlar y mitigar los\r\nimpactos ambientales que genere la institución).\n\r\n\r\n\n \n\r\n\r\n\nEn cuanto a las carreras que se pueden\r\nconsiderar para esta clase de puesto, se debe indicar que se valoraron las\r\nsiguientes: Ingeniería en Gestión Ambiental de la Escuela de Ciencia Ambientales de la Facultad de Ciencias de la Tierra y el Mar de la Universidad Nacional, Bachillerato y Licenciatura en Ingeniería Ambiental de la Escuela de Química del Instituto Tecnológico de Costa Rica y el Bachillerato y Licenciatura\r\nen Salud Ambiental de la Escuela de Tecnologías en Salud de la Facultad de Medicina de la Universidad de Costa Rica; concluyéndose que las tres satisfacen\r\nlas necesidades de conocimiento que debe tener un profesional en Gestor\r\nAmbiental para el Poder Judicial. Ahora bien, considerando que este\r\nprofesional iniciará con un programa particular (gestión ambiental), el cual\r\ntiene asociado la elaboración, implementación y seguimiento del PGAI así como\r\nsu coordinación con el DIGECA, lo pertinente sería ubicar el cargo en la\r\ncategoría de clase ancha de Profesional 2 y clase angosta de Gestor Ambiental. \n\r\n\r\n\n \n\r\n\r\n\n7.\r\nRECOMENDACIONES \n\r\n\r\n\n \n\r\n\r\n\nProducto de las conclusiones\r\nanteriores se recomienda:\n\r\n\r\n\n \n\r\n\r\n\n7.1. Que el Departamento de Planificación valore la creación del\r\npuesto de Gestor Ambiental, no sólo para cumplir con el imperativo legal de que\r\ntoda institución debe contar con esta clase de puesto sino para impulsar la\r\npolítica ambiental institucional elaborada por la Comisión de Asuntos Ambientales del Poder Judicial.\n\r\n\r\n\n \n\r\n\r\n\n7.2. De crearse el puesto de Gestor Ambiental, se recomienda que sea\r\nla instancia administrativa competente y experta en la materia, es decir el\r\nDepartamento de Planificación, la encargada de determinar su adscripción dentro\r\nde la estructura organizacional del Poder Judicial.\n\r\n\r\n\n \n\r\n\r\n\n7.3. De crearse el puesto de Gestor Ambiental por parte del\r\nDepartamento de Planificación, se recomienda que la clasificación y valoración\r\ndel puesto lo sea en la clase ancha de Profesional 2, clase angosta Gestor\r\nAmbiental. \n\r\n\r\n\n \n\r\n\r\n\n7.4. Se recomienda la creación de la clase angosta de “Gestor\r\nAmbiental” tal y como se presenta en el anexo Nº 1 del presente informe. \n\r\n\r\n\n \n\r\n\r\n\nSe\r\nacordó: Acoger el informe en todos sus extremos, con la indicación\r\nde que en lo correspondiente se deberán hacer las coordinaciones con la Sección de Salud Ocupacional cuando eso sea pertinente.”\n\r\n\r\n\n- 0 -\n\r\n\r\n\n En nota de 13 de octubre en curso,\r\nsuscrita por la Magistrada Carmenmaría Escoto Fernández, en carácter de Presidenta interina de la Comisión de Asuntos Ambientales, comunicó:\n\r\n\r\n\n“Conforme lo acordado por la Comisión de Asuntos Ambientales del Poder Judicial, en sesión No. CAA-06-2014, celebrada el\r\npasado 7 de octubre del presente año, me permito externar ante ustedes la\r\npreocupación compartida por todas las personas que integramos dicha Comisión\r\nen relación con la imposibilidad de dar seguimiento al Plan de Gestión\r\nAmbiental Institucional.\n\r\n\r\n\nDe acuerdo con el “Reglamento\r\npara la elaboración de programas de gestión ambiental institucional en el\r\nsector público de Costa Rica”, en adelante el Reglamento, este instrumento\r\nse basa en “un proceso cíclico de planificación, implementación, revisión y\r\nmejora de los procedimientos y acciones que lleva a cabo una institución para\r\nrealizar su actividad; con el fin de garantizar el cumplimiento de sus\r\nobjetivos ambientales y por ende, promover un mejor desempeño ambiental en\r\ntodas las instituciones de la Administración Pública”, es por ello que al ser un proceso dinámico requiere de un constante desarrollo y evolución, lo cual actualmente no\r\nha sido posible realizarlo.\n\r\n\r\n\nEn el documento del Plan de\r\nGestión Ambiental Institucional (PGAI), aprobado por Corte Plena en sesión N°\r\n35-10 del 6 de diciembre de 2010, se recomendaba la creación de una plaza para\r\nsu seguimiento. Sin embargo, a la fecha a pesar de que el plan fue aprobado\r\nno se cuenta con dicha plaza. \n\r\n\r\n\nEl 8 de abril del año 2013, el \r\nexMagistrado Oscar González y la suscrita, presentamos ante el Consejo\r\nSuperior una solicitud para la creación de una plaza de gestor o gestora\r\nambiental. Esa petición fue conocida en la Sesión No. 36-13 del 16 de abril de ese mismo año, trasladándose la comunicación al\r\nDepartamento de Personal a efecto de que ellos determinarán el perfil así como\r\nuna posible ubicación de dicha plaza dentro de la estructura del Poder\r\nJudicial.\n\r\n\r\n\nDel seguimiento realizado por\r\nparte de la Comisión a dicho acuerdo, de la Dirección de Gestión Humana se nos indicó que el informe fue presentado recientemente ante\r\nustedes y está calendarizado para la sesión del próximo jueves.\n\r\n\r\n\nAl respecto, me gustaría\r\nrealizar las siguientes reflexiones de cara a la discusión que se dará sobre el\r\ntema en dicha sesión.\n\r\n\r\n\nEn conversación sostenida con la Directora de Planificación, la plaza solicitada no fue incluida dentro del presupuesto del\r\n2015 por razones de prioridad institucional, sin tomar en consideración que la Institución estableció como un eje transversal del planeamiento (estratégico y operativo), la\r\ntemática ambiental. Sin embargo recomienda hacer las gestiones\r\ncorrespondientes para que quede contemplada en el presupuesto del 2016 que\r\nprontamente será realizado.\n\r\n\r\n\nEs importante señalar que como\r\nmecanismo de control, el reglamento tiene previsto la presentación de informes\r\nsemestrales, siendo el responsable para dicha gestión ante el DIGECA el\r\njerarca de cada Institución. De igual forma anualmente se realiza al menos \r\nuna auditoría de seguimiento por parte de de dicha oficina para verificar que\r\nel plan se esté ejecutando de forma adecuada. A la fecha el Poder Judicial no\r\nha presentado los informes correspondientes al año 2013 y el del primer\r\nsemestre del 2014, dado que no se cuenta con una persona responsable de\r\noperativizar, controlar y reportar lo referente a los programas ambientales a\r\nlos que la institución está comprometida desde el momento en que se aprobó el\r\nPlan de Gestión Ambiental en 2010.\n\r\n\r\n\nLo anterior fue ratificado por la Auditoría Judicial en oficio Nº 406-28-AEE-2214, con fecha 7 de abril de 2014, conocido por\r\nel Consejo Superior en la sesión N° 34-14, donde concluye que el Programa de\r\nGestión Ambiental en la Institución, no se está cumpliendo, debido a que no\r\ndispone de una persona coordinadora del Programa que lo administre y que\r\nrealice la labor operativa de coordinación, de control y de seguimiento en las\r\ndiferentes actividades que se realizan tanto en este Plan, como de las tareas\r\nrealizadas por la Comisión de Asuntos Ambientales.\n\r\n\r\n\nEn el reglamento se señalan como\r\nsanciones al incumplimiento “los artículos 98, 99, 100 y 101 de la Ley Orgánica del Ambiente; 98, 99 y 100 de la Ley General de la Administración Pública y 54 y 57 de la Ley para la Gestión Integral de Residuos, sin perjuicio de otras sanciones derivadas de la legislación\r\nnacional”.\n\r\n\r\n\nEn lo que respecta a la plaza y\r\nrecomendaciones realizadas por la Dirección de Gestión Humana, nos parece oportuno señalar que durante el año 2011 el Poder Judicial pagó por concepto de\r\nregencia ambiental a una profesional externa contratada por horas un monto de $\r\n22160.00 (más de doce millones de colones). Dicha profesional asistía en\r\npromedio el equivalente a 3 días al mes para realizar trámites en nombre del\r\nPoder Judicial ante SETENA y estar presente durante las destrucciones de droga,\r\nque como frecuencia máxima llegó a ser de dos destrucciones por semana. \r\nLo anterior en un incinerador que fue donado al Organismo de Investigación\r\nJudicial el cual desde el inicio presentó problemas de operación y contaminación\r\n(como parte de los requisitos de operación de un incinerador está en análisis\r\nde emisiones, entre ellos, dioxinas y furanos los cuales constituyen compuestos\r\nquímicos altamente contaminantes y potencialmente cancerígenos. Estos\r\nanálisis se realizaron obteniéndose que las emisiones excedían en más de diez\r\nveces los valores permitidos).\n\r\n\r\n\nPara atender la situación a\r\npartir de entonces se renegoció un convenio con HOLCIM, sitio donde ya se había\r\ngenerado la cancelación inicial de un convenio por problemas con la\r\nmanipulación de la droga. Dicho convenio tiene vigencia de un año más\r\n(2015). Para ese mismo año, el OIJ tiene presupuesto para la adquisición\r\nde un nuevo incinerador por lo que deberá retomar el tema de las destrucciones\r\nde droga, continuando la dinámica de 2011. Es por ello que la creación de\r\nuna plaza para atender la materia ambiental permitiría cubrir estas funciones y\r\njustificaría aún más la necesidad del puesto.\n\r\n\r\n\nPor otra parte en cuanto al\r\nperfil señalado en el informe de Gestión Humana, muy respetuosamente\r\nquisiéramos realizar una observación basados en la experiencia del \r\nDepartamento de Ciencias Forenses respecto de la definición de perfiles y\r\nclases en cargos de áreas de ciencias básicas y naturales., en relación con los\r\nrequisitos académicos pueden estar dejando por fuera otras posibles formaciones\r\nque igualmente estarían en capacidad de ocupar el cargo, y se estaría cerrando\r\nel perfil a sólo tres áreas de formación base. Así que es posible la\r\ncontratación de un profesional en ciencias naturales (biólogo, químico u otro)\r\ncon un posgrado en gerencia o gestión ambiental (que actualmente ofrecen en el\r\npaís diversas universidades) tendría las calidades suficientes para cubrir el\r\nperfil de puesto y funciones. \n\r\n\r\n\nEs por lo anterior que les\r\ntransfiero los siguientes acuerdos tomados por la Comisión:\n\r\n\r\n\n “c. Solicitar al Consejo\r\nSuperior, valorar la dotación de un recurso para nombrar una persona\r\nprofesional que colabore con la implementación, administración y seguimiento\r\ndel PGAI correspondiente a los años 2014 y siguientes, con lo cual se lograría\r\ncumplir con los compromisos institucionales ante el MINAE, mientras se tramita\r\nel estudio de la plaza de gestor o gestora ambiental. La persona que se designe\r\ncomo parte del recurso humano solicitado, deberá cumplir todas las funciones\r\ncitadas en el punto b) de este acuerdo. Además, se acuerda reiterar a las\r\ny los integrantes del Consejo Superior que esta es una gestión que la Comisión de Asuntos Ambientales ha planteado con anterioridad ante la carencia de talento\r\nhumano especializado que se ocupe de esa labor, la cual es de interés\r\ninstitucional. Se dispone remitir copia de esta gestión a la Presidencia del Poder Judicial y a Gestión Humana, al estar elaborándose el perfil del puesto.”\n\r\n\r\n\n “d. Informar a la Presidencia del Poder Judicial, a las y los integrantes del Consejo Superior y a Auditoría\r\nJudicial, que con ocasión del informe de implementación, administración y\r\nseguimiento del PGAI correspondiente al año 2014, al no haber aún una persona\r\nexperta designada para su emisión, se convocó a la señora Magda Protty,\r\nrepresentante de DIGECA del MINAE, para exponerle la problemática que enfrenta\r\nla institución, debido a la ausencia de una plaza que gestione el PGAI, con el\r\nfin de solicitar una prórroga a los compromisos adquiridos por el Poder\r\nJudicial, que requieren de la persona especialista ambiental para su\r\ncumplimiento. Además, comunicarle los datos recopilados al respecto, por las\r\ndiferentes oficinas representadas por las y los integrantes de la Comisión de Asuntos Ambientales. En caso de que se conceda una ampliación del plazo, se\r\ncomunicará a la Presidencia del Poder Judicial y a las y los integrantes del\r\nConsejo Superior, para lo de su cargo.”\n\r\n\r\n\nDe lo anterior solicitamos muy\r\nrespetuosamente al Consejo Superior, acoger las recomendaciones de los acuerdos\r\nseñalados, así como las observaciones realizadas en cuanto al perfil y\r\nfunciones que podría desempeñar la persona contratada para esos efectos. \n\r\n\r\n\nQuedamos a disposición de\r\nustedes para atender cualquier consulta que puedan tener al respecto.”\n\r\n\r\n\n- 0 -\n\r\n\r\n\nSe acordó: 1.) Tener por rendido el informe de la Dirección de Gestión Humana y acoger las recomendaciones dirigidas a la Dirección de Planificación, por consiguiente: a) Que la Dirección de Planificación valore la creación del puesto de Gestor Ambiental, no sólo para\r\ncumplir con el imperativo legal de que toda institución debe contar con esta\r\nclase de puesto sino para impulsar la política ambiental institucional\r\nelaborada por la Comisión de Asuntos Ambientales del Poder Judicial. b) De\r\ncrearse el puesto de Gestor Ambiental, la instancia administrativa competente y\r\nexperta en la materia, es decir, la Dirección de Planificación, es la encargada de determinar su adscripción dentro de la\r\nestructura organizacional del Poder Judicial. c) De crearse el puesto de\r\nGestor Ambiental por parte de la citada Dirección la clasificación y valoración\r\ndel puesto será en la clase ancha de Profesional 2, clase angosta Gestor\r\nAmbiental. d) Crear la clase angosta de “Gestor Ambiental” tal y como se\r\npresenta en el anexo Nº 1 del presente informe. 2.) Acoger\r\nel acuerdo tomado por la Comisión de Asuntos Ambientales y trasladarlo a la Dirección de Planificación para que realice el estudio de implementación, administración y\r\nseguimiento del PGAI correspondiente a los años 2014 y siguientes y solicitar\r\nuna ampliación ante el MINAE para cumplir con los compromisos institucionales\r\nante ese Ministerio. 3.) En razón de que este Poder de la República está limitado presupuestariamente solicitar a la Dirección de Planificación la redistribución de plazas.\n\r\n\r\n\nSe acordó: 1.)\r\nTener por rendido el informe de la Dirección de Gestión Humana y acoger las recomendaciones dirigidas a la Dirección de Planificación, por consiguiente: a)\r\nQue la Dirección de Planificación valore la creación del puesto de Gestor o\r\nGestora Ambiental, no sólo para cumplir con el imperativo legal de que toda\r\ninstitución debe contar con esta clase de puesto sino para impulsar la política\r\nambiental institucional elaborada por la Comisión de Asuntos Ambientales del Poder Judicial, aprobada por Corte Plena en sesión Nº 14-08 del 5 de mayo del 2008,\r\nartículo VI. b) De crearse el puesto de Gestor o Gestora Ambiental, la\r\ninstancia administrativa competente y experta en la materia, es decir, la Dirección de Planificación, es la encargada de determinar su adscripción dentro de la\r\nestructura organizacional del Poder Judicial. c) Se debe agregar a las\r\ncarreras ya señaladas en el informe que se pueden considerar para esta clase de\r\npuesto, a profesionales en ciencias naturales, biólogos, químicos u otro, con\r\nestudios o experiencia en gestión ambiental. d) De crearse el puesto de\r\nGestor o Gestora Ambiental por parte de la citada Dirección, la clasificación y\r\nvaloración del puesto será en la clase ancha de Profesional 2, clase angosta\r\nGestor o Gestora Ambiental. e) Crear la clase angosta de \"Gestor o\r\nGestora Ambiental\" tal y como se presenta en el anexo Nº 1 del presente\r\ninforme. 2.) Acoger el acuerdo tomado por la Comisión de Asuntos Ambientales y trasladarlo a la Dirección de Planificación para que realice el estudio de implementación, administración y seguimiento del PGAI\r\ncorrespondiente a los años 2014 y siguientes y solicitar una ampliación del plazo ante el MINAE para cumplir con los compromisos\r\ninstitucionales ante ese Ministerio. 3.) En razón de que este Poder de la República está limitado presupuestariamente solicitar a la Dirección de Planificación que valore si existe posibilidad de que\r\nuna plaza ya existente pueda asumir estas funciones. 4.) Hacer este acuerdo\r\nde conocimiento de la Comisión de Asuntos Ambientales.",
  "body_en_text": "ARTICLE LXXV\n\nARTICLE LXXV\n\nDOCUMENT\nNº 3912-13, 11945-14\n\nIn session Nº 36-13 of April 16, 2013, article LXXVII, the matter raised by the Environmental Affairs Commission (Comisión de Asuntos Ambientales) regarding the approval of a position for an environmental manager was referred to the Human Resources Directorate (Dirección de Gestión Humana), so that the profile and possible placement of the position within the structure of the Judicial Branch (Poder Judicial) could be determined.\n\nBy official letter Nº CP-79-14 of May 12, 2014, Master Francisco Arroyo Meléndez, Director of Human Resources, communicated the agreement reached by the Personnel Council (Consejo de Personal) in session Nº 6-2014 held on April 10, 2014, article VII, which literally states:\n\n\"(…)\n\n\"Report SAP-023-2014 from the Job Analysis Section (Sección de Análisis de Puestos) is acknowledged.\n\nThe conclusions and recommendations of the document are as follows:\n\nIn order for it to be known by the Personnel Council, we inform you that the Superior Council (Consejo Superior) in session Nº 36-13 held on April 16 of this year, in its article LXXVII, agreed: 'Forward the previous communication to the Personnel Department so that it may determine both the profile and the possible placement of the environmental manager position within the structure of the Judicial Branch.'\n\nTo comply with the above provision, the following investigation was conducted to establish the corresponding job profile.\n\n6. CONCLUSIONS\n\nEnvironmental management (gestión ambiental) is an issue of national interest of constitutional order (Art. 50 Political Constitution), which is why every institution must have and implement an environmental management system (Art. 28 Law for Integrated Waste Management, Ley para la Gestión Integral de Residuos). Thus, every institution, by legal imperative, must have an Institutional Environmental Management Program (Programa de Gestión Ambiental Institucional, PGAI) and an Institutional Environmental Manager position that guarantees its implementation and sustainability (Art. 27 and 28 of the General Regulation to the Law for Integrated Waste Management, executive decree N° 37567-S-MINAET-H).\n\nThe PGAI is a planning instrument based on a diagnosis that must contain all aspects related to institutional activities (energy efficiency, waste, and climate change, among other environmental aspects), for the purpose of establishing and implementing short-, medium-, and long-term measures for the prevention, mitigation, compensation, or restoration of environmental impacts. This program, or plan as it has also been called, is a cyclical process of planning, implementation, review, and improvement of the procedures and actions carried out by the institution (Art. 2 Regulation for the Development of Institutional Environmental Management Programs in the Public Sector of Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET).\n\nThe Judicial Branch, since September 8, 2009, has had the Environmental Affairs Commission, complying with the corresponding legal mandate (Art. 7 Regulation for the Development of Institutional Environmental Management Programs in the Public Sector of Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET). This commission, in order to advance the Judicial Branch on environmental issues, has developed a PGAI composed of nine specific programs (wastewater, drinking water, vehicle fleet control, natural disaster prevention and response, energy efficiency, ordinary solid waste management, acquisition of environmentally friendly goods and services, review and updating of current environmental legislation, and citizen participation and training).\n\nAccording to the provisions of the corresponding regulations (Art. 8 Regulation for the Development of Institutional Environmental Management Programs in the Public Sector of Costa Rica, Decreto Ejecutivo Nº 36499-S-MINAET), the Institutional Commission's functions include conducting diagnoses or evaluations to determine the institution's status regarding environmental management, waste management, climate change, and energy efficiency; proposing an institutional environmental policy; developing and implementing the PGAI; submitting reports requested by MINAET; and establishing quantifiable indicators for the PGAI.\n\nIt is concluded that, in accordance with current regulations, the need for an Environmental Manager position is undeniable, in order to provide technical and specialized knowledge in the development of the PGAI, the preparation of diagnoses and the development of environmental projects, to provide the corresponding progress reports on the PGAI, as well as to provide recommendations for the prevention, mitigation, compensation, and restoration of environmental damage at the institutional level, among other functions established by the Environmental Affairs Commission of the Judicial Branch.\n\nFrom the information gathered from different institutions, it can be concluded that many do not have a specific Environmental Manager position, and the functions have been assumed as an additional duty (recargo) by different positions within the institution (Legislative Assembly, Attorney General's Office, Supreme Electoral Tribunal, National Learning Institute, Municipality of San José); however, other institutions do have specific and homologous profiles for the Environmental Manager (National Power and Light Company, Municipality of Alajuela, Municipality of Santa Ana, Municipality of La Unión, and Municipality of Tibás).\n\nRegarding the placement of Environmental Manager positions or the units responsible for this topic in the consulted institutions, they can be structured as follows: attached to a specific process or department (this being the lowest level in structural placement and functional authority relationship), as is the case with the National Power and Light Company and the Municipalities of Alajuela, San José, and Tibás; also at the staff level, as in the case of the Municipality of La Unión; attached to higher bodies of the institution, as occurs in the National Learning Institute and the Municipality of Santa Ana; or directly to a specific Institutional Commission for environmental matters (a collegiate body composed of positions from different departments), as occurs in the case of the Legislative Assembly and the Supreme Electoral Tribunal. Therefore, it is concluded that there is no specific pattern for organizational assignment; rather, the positions have been placed according to the organization, needs, and policies of each institution, meaning the Environmental Manager position could be placed in a Directorate, Department, at the staff level, or with an Institutional Commission.\n\nIn the case of the Judicial Branch, and according to the opinion of the president of the Environmental Affairs Commission, Magistrate Oscar Gonzalez Camacho, the assignment of the Environmental Manager position to the Office of the Presidency (Despacho de la Presidencia) could be considered. That being said, it is this department's opinion that there should be an administrative assignment to the Office of the Presidency and a functional assignment with respect to the Environmental Affairs Commission, so that the occupant of the position can be properly empowered, as they must coordinate with many bodies within the institution for the proper development of their functions. However, it must be made clear regarding the previous conclusion that it is solely an opinion resulting from the research conducted, knowing that this department is not the competent body for the final decision, which, by its own competencies, corresponds to the Planning Department (Departamento de Planificación).\n\nFrom the consultations made with different institutions, it can be concluded that there is a similarity regarding the tasks or functions performed by the Environmental Manager positions. For this reason, and considering what the law indicates, the request of the Environmental Affairs Commission, the DIGECA, and the information provided by Lic. Mauricio Chacón Hernández, a Judicial Expert who has actively participated in the development of the Judicial Branch's PGAI, the functions that must be included in the corresponding job profile should contain the following: diagnostic and research work; establishing directives, plans, programs, projects, and lines of action aimed at consolidating public environmental policies; compliance with applicable regulations; development of environmental programs; environmental impact assessments (evaluaciones de impacto ambiental); development of management indicators; coordination and verification of the implementation of environmental projects; advising different institutional departments with technical environmental criteria; waste management and inventory; electricity consumption, water consumption, and fuel consumption; developing plans to ensure the proper channeling of stormwater, serviced water, wastewater, and blackwater and their treatment; providing technical criteria and analysis of environmental clauses in administrative contracting (sustainable procurement); diagnosis and control of liquid, solid, atmospheric, and hazardous toxic emissions; recycling programs; on-site inspections; representing the institution on environmental issues; development, implementation, and follow-up of the PGAI, as well as its coordination with DIGECA; providing training; conducting awareness and information campaigns; and performing the institution's environmental management oversight (environmental regency, regencia ambiental) (preventing, controlling, and mitigating the environmental impacts generated by the institution).\n\nRegarding the degrees that can be considered for this class of position, it should be noted that the following were assessed: Environmental Management Engineering from the School of Environmental Sciences of the Faculty of Earth and Marine Sciences of the National University, a Bachelor's and Licentiate degree in Environmental Engineering from the School of Chemistry of the Technological Institute of Costa Rica, and a Bachelor's and Licentiate degree in Environmental Health from the School of Health Technologies of the Faculty of Medicine of the University of Costa Rica; concluding that all three meet the knowledge needs that a professional in Environmental Management must have for the Judicial Branch. That being said, considering that this professional will start with a particular program (environmental management), which is associated with the development, implementation, and follow-up of the PGAI, as well as its coordination with DIGECA, the appropriate action would be to classify the position in the broad job category of Professional 2 (Profesional 2) and the narrow job category of Environmental Manager (Gestor Ambiental).\n\n7. RECOMMENDATIONS\n\nAs a result of the foregoing conclusions, the following is recommended:\n\n7.1. That the Planning Department evaluate the creation of the Environmental Manager position, not only to comply with the legal imperative that every institution must have this class of position, but also to promote the institutional environmental policy developed by the Environmental Affairs Commission of the Judicial Branch.\n\n7.2. If the Environmental Manager position is created, it is recommended that the competent administrative body with expertise in the matter, that is, the Planning Department, be responsible for determining its assignment within the organizational structure of the Judicial Branch.\n\n7.3. If the Environmental Manager position is created by the Planning Department, it is recommended that the classification and evaluation of the position be in the broad job category of Professional 2, narrow job category Environmental Manager.\n\n7.4. The creation of the narrow job category of \"Environmental Manager\" is recommended, as presented in Annex 1 (Anexo Nº 1) of this report.\n\nIt was agreed: To accept the report in its entirety, with the indication that, where relevant, coordination should be carried out with the Occupational Health Section (Sección de Salud Ocupacional) when pertinent.\"\n\n- 0 -\n\nIn a note dated October 13 of the current year, signed by Magistrate Carmenmaría Escoto Fernández, as interim President of the Environmental Affairs Commission, she communicated:\n\n\"As agreed by the Environmental Affairs Commission of the Judicial Branch, in session No. CAA-06-2014, held on October 7 of this year, I would like to express to you the shared concern of all the members of this Commission regarding the impossibility of following up on the Institutional Environmental Management Plan (PGAI).\n\nAccording to the \"Regulation for the development of institutional environmental management programs in the public sector of Costa Rica\" (Reglamento para la elaboración de programas de gestión ambiental institucional en el sector público de Costa Rica), hereinafter the Regulation, this instrument is based on 'a cyclical process of planning, implementation, review, and improvement of the procedures and actions carried out by an institution to perform its activity; in order to guarantee the fulfillment of its environmental objectives and, therefore, promote better environmental performance in all Public Administration institutions.' Thus, being a dynamic process, it requires constant development and evolution, which has not been possible to carry out currently.\n\nIn the document of the Institutional Environmental Management Plan (PGAI), approved by the Full Court (Corte Plena) in session N° 35-10 of December 6, 2010, the creation of a position for its follow-up was recommended. However, to date, despite the plan having been approved, this position does not exist.\n\nOn April 8, 2013, former Magistrate Oscar González and the undersigned presented a request to the Superior Council for the creation of an environmental manager position. This petition was addressed in Session No. 36-13 of April 16 of that same year, and the communication was forwarded to the Personnel Department so that they could determine the profile and a possible placement of said position within the structure of the Judicial Branch.\n\nFrom the follow-up carried out by the Commission on said agreement, we were informed by the Human Resources Directorate that the report was recently presented to you and is scheduled for next Thursday's session.\n\nIn this regard, I would like to make the following reflections in view of the discussion that will take place on the topic in that session.\n\nIn a conversation held with the Planning Director (Directora de Planificación), the requested position was not included in the 2015 budget for reasons of institutional priority, without considering that the Institution established environmental matters as a cross-cutting axis of planning (strategic and operational). However, she recommends taking the corresponding steps to ensure it is included in the 2016 budget, which will soon be prepared.\n\nIt is important to note that, as a control mechanism, the regulation provides for the submission of semi-annual reports, with the head of each Institution being responsible for this activity before DIGECA. Similarly, at least one follow-up audit is conducted annually by that office to verify that the plan is being executed adequately. To date, the Judicial Branch has not submitted the corresponding reports for the year 2013 or the first half of 2014, given that there is no person responsible for operationalizing, controlling, and reporting on the environmental programs to which the institution has been committed since the Environmental Management Plan was approved in 2010.\n\nThe foregoing was ratified by the Judicial Audit (Auditoría Judicial) in official letter Nº 406-28-AEE-2214, dated April 7, 2014, known by the Superior Council in session N° 34-14, where it concluded that the Environmental Management Program in the Institution is not being fulfilled, due to the lack of a coordinator for the Program to administer it and perform the operational work of coordination, control, and follow-up on the different activities carried out under this Plan, as well as the tasks performed by the Environmental Affairs Commission.\n\nThe regulation indicates as sanctions for non-compliance \"articles 98, 99, 100, and 101 of the Organic Environmental Law (Ley Orgánica del Ambiente); 98, 99, and 100 of the General Public Administration Law (Ley General de la Administración Pública); and 54 and 57 of the Law for Integrated Waste Management (Ley para la Gestión Integral de Residuos), without prejudice to other sanctions derived from national legislation.\"\n\nRegarding the position and recommendations made by the Human Resources Directorate, it seems appropriate to point out that during 2011, the Judicial Branch paid an amount of $22,160.00 (more than twelve million colones) for environmental management oversight (environmental regency, regencia ambiental) to an external professional hired by the hour. This professional attended an average equivalent to 3 days per month to carry out procedures on behalf of the Judicial Branch before SETENA and to be present during drug destruction operations, which occurred as frequently as twice a week. The above took place in an incinerator that was donated to the Judicial Investigation Agency (Organismo de Investigación Judicial), which from the start presented operational and contamination problems (as part of the operating requirements for an incinerator, there is emission analysis, including for dioxins and furans, which are highly polluting and potentially carcinogenic chemical compounds. These analyses were conducted, finding that the emissions exceeded the permitted values by more than ten times).\n\nTo address the situation, a new agreement was subsequently renegotiated with HOLCIM, a site where an initial agreement had already been cancelled due to problems with the handling of drugs. This agreement is valid for one more year (2015). For that same year, the OIJ has a budget for the acquisition of a new incinerator, so it must resume the topic of drug destruction, continuing the 2011 dynamic. Therefore, the creation of a position to handle environmental matters would allow these functions to be covered and would further justify the need for the position.\n\nOn the other hand, regarding the profile indicated in the Human Resources report, we would very respectfully like to make an observation based on the experience of the Forensic Sciences Department (Departamento de Ciencias Forenses) regarding the definition of profiles and job classes in positions within basic and natural sciences areas. In relation to the academic requirements, other possible educational backgrounds that would equally be capable of filling the position could be excluded, thereby limiting the profile to only three areas of basic training. Thus, it is possible to hire a professional in natural sciences (biologist, chemist, or other) with a postgraduate degree in environmental management or administration (currently offered in the country by various universities), who would have sufficient qualifications to meet the job profile and functions.\n\nIt is for the above reasons that I transmit to you the following agreements reached by the Commission:\n\n\"c. Request the Superior Council to evaluate the provision of a resource to appoint a professional person to collaborate with the implementation, administration, and follow-up of the PGAI for the years 2014 and following, thereby achieving compliance with institutional commitments before MINAE, while the study for the environmental manager position is being processed. The person designated as part of the requested human resource must fulfill all the functions cited in point b) of this agreement. Furthermore, it is agreed to reiterate to the members of the Superior Council that this is a request that the Environmental Affairs Commission has previously raised due to the lack of specialized human talent to perform this work, which is of institutional interest. It is ordered that a copy of this request be sent to the Presidency of the Judicial Branch and to Human Resources, as the job profile is being developed.\"\n\n\"d. Inform the Presidency of the Judicial Branch, the members of the Superior Council, and the Judicial Audit, that on the occasion of the implementation, administration, and follow-up report for the PGAI for the year 2014, since there is not yet an expert designated for its issuance, Mrs. Magda Protty, representative of DIGECA of MINAE, was summoned to explain the problems the institution faces due to the absence of a position to manage the PGAI, in order to request an extension for the commitments acquired by the Judicial Branch, which require the environmental specialist for their fulfillment. Also, to communicate to her the data collected on the matter by the different offices represented by the members of the Environmental Affairs Commission. If an extension of the term is granted, the Presidency of the Judicial Branch and the members of the Superior Council will be informed, for their corresponding actions.\"\n\nFrom the foregoing, we respectfully request the Superior Council to accept the recommendations of the indicated agreements, as well as the observations made regarding the profile and functions that could be performed by the person hired for these purposes.\n\nWe remain at your disposal to address any questions you may have on this matter.\"\n\n- 0 -\n\nIt was agreed: 1.) To accept the report from the Human Resources Directorate as rendered and to adopt the recommendations directed to the Planning Directorate, therefore: a) That the Planning Directorate evaluate the creation of the Environmental Manager position, not only to comply with the legal imperative that every institution must have this class of position, but also to promote the institutional environmental policy developed by the Environmental Affairs Commission of the Judicial Branch. b) If the Environmental Manager position is created, the competent administrative body with expertise in the matter, that is, the Planning Directorate, is responsible for determining its assignment within the organizational structure of the Judicial Branch. c) If the Environmental Manager position is created by the cited Directorate, the classification and evaluation of the position shall be in the broad job category of Professional 2, narrow job category Environmental Manager. d) To create the narrow job category of “Environmental Manager” as presented in Annex 1 of this report. 2.) To adopt the agreement reached by the Environmental Affairs Commission and forward it to the Planning Directorate so that it may conduct the study for the implementation, administration, and follow-up of the PGAI for the years 2014 and following, and request an extension from MINAE to fulfill the institutional commitments before that Ministry. 3.) Given that this Branch of the Republic is budgetarily constrained, to request the Planning Directorate to carry out a redistribution of positions.\n\nIt was agreed: 1.) To accept the report from the Human Resources Directorate as rendered and to adopt the recommendations directed to the Planning Directorate, therefore: a) That the Planning Directorate evaluate the creation of the Environmental Manager position, not only to comply with the legal imperative that every institution must have this class of position, but also to promote the institutional environmental policy developed by the Environmental Affairs Commission of the Judicial Branch, approved by the Full Court in session Nº 14-08 of May 5, 2008, article VI. b) If the Environmental Manager position is created, the competent administrative body with expertise in the matter, that is, the Planning Directorate, is responsible for determining its assignment within the organizational structure of the Judicial Branch. c) To the degrees already indicated in the report that may be considered for this class of position, add professionals in natural sciences, biologists, chemists, or others, with studies or experience in environmental management. d) If the Environmental Manager position is created by the cited Directorate, the classification and evaluation of the position shall be in the broad job category of Professional 2, narrow job category Environmental Manager. e) To create the narrow job category of \"Environmental Manager\" as presented in Annex 1 of this report. 2.) To adopt the agreement reached by the Environmental Affairs Commission and forward it to the Planning Directorate so that it may conduct the study for the implementation, administration, and follow-up of the PGAI for the years 2014 and following, and request an extension of the term from MINAE to fulfill the institutional commitments before that Ministry. 3.) However, it is the opinion of this department that there should be an administrative assignment to the Office of the Presidency and a functional assignment with respect to the Environmental Affairs Commission, so that the occupant of the position can be adequately empowered, as they must coordinate with many entities of the institution for the proper development of their functions. Having said that, it must be made clear regarding the previous conclusion that it is solely a criterion resulting from the conducted research, knowing that this is not the department competent for the final decision, which, by its own competencies, corresponds to the Planning Department.\n\nFrom the consultations made to different institutions, it is possible to conclude that there is a similarity regarding the tasks or functions performed by the Environmental Manager positions, which is why, and considering what the law, the request of the Environmental Affairs Commission, the DIGECA, and the information provided by Lic. Mauricio Chacón Hernández, a Judicial Expert who has actively participated in the preparation of the Judicial Branch's PGAI, indicate, the functions that must be included in the corresponding job profile should contain the following: diagnostic and research work; establishing directives, plans, programs, projects, and lines of action aimed at consolidating public environmental policies, compliance with applicable regulations; preparation of environmental programs; environmental impact assessments; preparation of management indicators; coordination and verification of the implementation of environmental projects; advising different dependencies of the institution with technical environmental criteria; management and inventory of waste, electricity consumption, water consumption, and fuel consumption; creating plans to ensure the proper channeling of stormwater, wastewater, and sewage and their treatment; providing criteria and technical analysis of environmental clauses in administrative contracting (green purchasing); diagnosis and control of liquid, solid, atmospheric, and hazardous toxic emissions; recycling programs; on-site inspections; representing the institution on environmental matters; preparation, implementation, and monitoring of the PGAI as well as its coordination with DIGECA; providing training; carrying out awareness and information campaigns; and performing the environmental management (regencia ambiental) of the institution (preventing, controlling, and mitigating the environmental impacts generated by the institution).\n\nRegarding the degrees that can be considered for this class of position, it should be noted that the following were evaluated: Ingeniería en Gestión Ambiental from the School of Environmental Sciences of the Faculty of Earth and Marine Sciences of the Universidad Nacional, Bachelor's and Licentiate in Ingeniería Ambiental from the School of Chemistry of the Instituto Tecnológico de Costa Rica, and the Bachelor's and Licentiate in Salud Ambiental from the School of Health Technologies of the Faculty of Medicine of the Universidad de Costa Rica; concluding that all three satisfy the knowledge needs that an Environmental Manager professional must have for the Judicial Branch. However, considering that this professional will start with a particular program (environmental management), which involves the preparation, implementation, and monitoring of the PGAI as well as its coordination with DIGECA, the appropriate action would be to place the position in the broad class of Professional 2 and the narrow class of Environmental Manager (Gestor Ambiental).\n\n7. RECOMMENDATIONS\n\nAs a result of the previous conclusions, the following is recommended:\n\n7.1. That the Planning Department evaluate the creation of the Environmental Manager position, not only to comply with the legal imperative that every institution must have this class of position, but also to promote the institutional environmental policy prepared by the Judicial Branch's Environmental Affairs Commission.\n\n7.2. If the Environmental Manager position is created, it is recommended that the competent administrative body with expertise in the matter, i.e., the Planning Department, be responsible for determining its assignment within the organizational structure of the Judicial Branch.\n\n7.3. If the Environmental Manager position is created by the Planning Department, it is recommended that the classification and valuation of the position be in the broad class of Professional 2, narrow class Environmental Manager (Gestor Ambiental).\n\n7.4. The creation of the narrow class of \"Environmental Manager (Gestor Ambiental)\" is recommended, as presented in Anexo 1 of this report.\n\nIt was agreed: To accept the report in its entirety, with the indication that, where pertinent, coordination must be made with the Occupational Health Section (Sección de Salud Ocupacional) when appropriate.\"\n\n- 0 -\n\nIn a note dated October 13 of the current year, signed by Magistrate Carmenmaría Escoto Fernández, acting as interim President of the Environmental Affairs Commission, she communicated:\n\n\"In accordance with what was agreed by the Judicial Branch's Environmental Affairs Commission, in session No. CAA-06-2014, held on October 7 of this year, I hereby express to you the shared concern of all the persons who make up said Commission regarding the impossibility of following up on the Plan de Gestión Ambiental Institucional.\n\nAccording to the \"Regulation for the preparation of institutional environmental management programs in the public sector of Costa Rica\", hereinafter the Regulation, this instrument is based on \"a cyclical process of planning, implementation, review, and improvement of the procedures and actions that an institution carries out to perform its activity; in order to guarantee the fulfillment of its environmental objectives and therefore, promote better environmental performance in all Public Administration institutions.\" It is for this reason that, being a dynamic process, it requires constant development and evolution, which has not been possible to achieve currently.\n\nIn the document of the Institutional Environmental Management Plan (PGAI), approved by the Full Court in session No. 35-10 of December 6, 2010, the creation of a position for its follow-up was recommended. However, to date, despite the plan having been approved, said position is not available.\n\nOn April 8, 2013, former Magistrate Oscar González and the undersigned presented a request to the Superior Council for the creation of an environmental manager position. That petition was heard in Session No. 36-13 of April 16 of that same year, and the communication was referred to the Personnel Department so that they could determine the profile as well as a possible placement of said position within the structure of the Judicial Branch.\n\nFrom the follow-up carried out by the Commission on said agreement, the Human Resources Directorate indicated to us that the report was recently presented before you and is scheduled for next Thursday's session.\n\nIn this regard, I would like to make the following reflections in view of the discussion that will take place on the topic in that session.\n\nIn a conversation held with the Director of Planning, the requested position was not included in the 2015 budget for reasons of institutional priority, without considering that the Institution established environmental issues as a cross-cutting axis of planning (strategic and operational). However, she recommends making the appropriate arrangements so that it is included in the 2016 budget, which will soon be prepared.\n\nIt is important to point out that, as a control mechanism, the regulation provides for the submission of semi-annual reports, with the head of each Institution being responsible for this procedure before DIGECA. Likewise, at least one follow-up audit is conducted annually by said office to verify that the plan is being executed properly.\"\n\nTo date, the Judicial Branch has not submitted the reports corresponding to 2013 and the first semester of 2014, given that there is no person responsible for operationalizing, controlling, and reporting on the environmental programs to which the institution has been committed since the moment the Environmental Management Plan was approved in 2010.\n\nThe foregoing was ratified by the Judicial Audit Office in official letter Nº 406-28-AEE-2214, dated April 7, 2014, made known to the Superior Council in session N° 34-14, where it concludes that the Environmental Management Program in the Institution is not being complied with, due to the lack of a Program coordinator to administer it and to carry out the operational work of coordination, control, and monitoring of the different activities carried out both in this Plan and the tasks performed by the Environmental Affairs Commission.\n\nThe regulation indicates the following as sanctions for non-compliance: “*Articles 98, 99, 100, and 101 of the Organic Law of the Environment (Ley Orgánica del Ambiente); 98, 99, and 100 of the General Law of Public Administration (Ley General de la Administración Pública); and 54 and 57 of the Law for Integrated Waste Management (Ley para la Gestión Integral de Residuos), without prejudice to other sanctions derived from national legislation*.”\n\nRegarding the position and the recommendations made by the Human Resources Management Office (Dirección de Gestión Humana), it seems opportune to point out that during 2011, the Judicial Branch paid an external professional, hired by the hour, an amount of $22,160.00 (more than twelve million colones) for the concept of environmental supervision (regencia ambiental). Said professional attended an average equivalent to 3 days per month to carry out procedures on behalf of the Judicial Branch before SETENA and to be present during drug destructions, which at maximum frequency reached two destructions per week. The foregoing occurred in an incinerator that was donated to the Judicial Investigation Agency (Organismo de Investigación Judicial), which from the beginning presented problems of operation and contamination (part of the operational requirements for an incinerator includes emission analysis, among them, dioxins and furans, which constitute highly polluting and potentially carcinogenic chemical compounds. These analyses were carried out, finding that emissions exceeded the permitted values by more than ten times).\n\nTo address the situation, an agreement was subsequently renegotiated with HOLCIM, a site where an initial agreement had already been cancelled due to problems with drug handling. Said agreement has a validity of one more year (2015). For that same year, the OIJ has a budget for the acquisition of a new incinerator, so the issue of drug destructions will have to be resumed, continuing the dynamic of 2011. That is why the creation of a position to attend to environmental matters would allow these functions to be covered and would further justify the need for the post.\n\nOn the other hand, regarding the profile indicated in the Human Resources Management report, we would very respectfully like to make an observation based on the experience of the Department of Forensic Sciences with respect to defining profiles and classes in positions within basic and natural science areas. The academic requirements might be excluding other possible formations that would equally be capable of filling the position, and the profile would be closing itself to only three basic training areas. Thus, it is possible to hire a professional in natural sciences (biologist, chemist, or other) with a graduate degree in environmental management or administration (which various universities in the country currently offer) who would have sufficient qualifications to meet the position and functions profile.\n\nFor the above reasons, I transmit to you the following agreements reached by the Commission:\n\n   “*c.* *Request the Superior Council to assess the provision of a resource to appoint a professional person to collaborate with the implementation, administration, and monitoring of the Institutional Environmental Management Program (Programa de Gestión Ambiental Institucional, PGAI) corresponding to the years 2014 and following, with which institutional commitments before MINAE could be met, while the study of the position of environmental manager is processed. The person designated as part of the requested human resource must fulfill all the functions cited in point b) of this agreement. Furthermore, it is agreed to reiterate to the members of the Superior Council that this is a procedure that the Environmental Affairs Commission has previously raised given the lack of specialized human talent to handle this work, which is of institutional interest. It is ordered to send a copy of this procedure to the Presidency of the Judicial Branch and to Human Resources Management, as the position profile is being developed.*”\n\n   “*d.* *Inform the Presidency of the Judicial Branch, the members of the Superior Council, and the Judicial Audit Office, that on the occasion of the implementation, administration, and monitoring report of the PGAI corresponding to the year 2014, as there is still no designated expert to issue it, Ms. Magda Protty, representative of DIGECA of MINAE, was summoned to explain the problem facing the institution due to the absence of a position to manage the PGAI, in order to request an extension for the commitments acquired by the Judicial Branch that require an environmental specialist for their fulfillment. Furthermore, to communicate to her the data collected in this regard by the different offices represented by the members of the Environmental Affairs Commission. Should an extension of the deadline be granted, the Presidency of the Judicial Branch and the members of the Superior Council will be notified, for their respective actions.*”\n\nBased on the foregoing, we very respectfully request the Superior Council to accept the recommendations of the indicated agreements, as well as the observations made regarding the profile and functions that the person hired for these purposes could perform.\n\nWe remain at your disposal to respond to any questions you may have on this matter.”\n\n- 0 -\n\n**It was agreed: 1.)** To receive the report from the Human Resources Management Office and accept the recommendations addressed to the Planning Directorate (Dirección de Planificación); consequently: **a)** That the Planning Directorate evaluate the creation of the Environmental Manager (Gestor Ambiental) position, not only to comply with the legal imperative that every institution must have this type of position, but also to promote the institutional environmental policy developed by the Environmental Affairs Commission of the Judicial Branch. **b)** Should the position of Environmental Manager be created, the competent administrative body with expertise in the matter, that is, the Planning Directorate, is responsible for determining its placement within the organizational structure of the Judicial Branch. **c)** Should the position of Environmental Manager be created by the aforementioned Directorate, the classification and valuation of the position shall be in the broad class of Professional 2, narrow class Environmental Manager. **d)** Create the narrow class of “Environmental Manager” as presented in Annex No. 1 of this report. **2.)** Accept the agreement reached by the Environmental Affairs Commission and forward it to the Planning Directorate so that it can carry out the study of implementation, administration, and monitoring of the PGAI corresponding to the years 2014 and following, and request an extension from MINAE to comply with the institutional commitments before that Ministry. **3.)** Given that this Branch of the Republic is budgetarily constrained, request the Planning Directorate to carry out a redistribution of positions.\n\n**It was agreed:** **1.)** To receive the report from the Human Resources Management Office and accept the recommendations addressed to the Planning Directorate; consequently: **a)** That the Planning Directorate evaluate the creation of the position of Environmental Manager (Gestor o Gestora Ambiental), not only to comply with the legal imperative that every institution must have this type of position, but also to promote the institutional environmental policy developed by the Environmental Affairs Commission of the Judicial Branch, approved by the Full Court in session Nº 14-08 of May 5, 2008, article VI. **b)** Should the position of Environmental Manager be created, the competent administrative body with expertise in the matter, that is, the Planning Directorate, is responsible for determining its placement within the organizational structure of the Judicial Branch. **c)** Professionals in natural sciences, biologists, chemists, or others, with studies or experience in environmental management, must be added to the careers already indicated in the report that may be considered for this class of position. **d)** Should the position of Environmental Manager be created by the aforementioned Directorate, the classification and valuation of the position shall be in the broad class of Professional 2, narrow class Environmental Manager. **e)** Create the narrow class of “Environmental Manager” as presented in Annex No. 1 of this report. **2.)** Accept the agreement reached by the Environmental Affairs Commission and forward it to the Planning Directorate so that it can carry out the study of implementation, administration, and monitoring of the PGAI corresponding to the years 2014 and following, and request an extension of the deadline from MINAE to comply with the institutional commitments before that Ministry. **3.)** Given that this Branch of the Republic is budgetarily constrained, request the Planning Directorate to evaluate whether there is a possibility that an existing position could assume these functions. **4.)** Make this agreement known to the Environmental Affairs Commission.\n\n27 and 28 of the General Regulation to the Law for Integrated Waste Management, Executive Decree No. 37567-S-MINAET-H).</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>The Institutional Environmental Management Program (Programa de Gestión Ambiental Institucional, PGAI) is a planning instrument based on a diagnosis that must contain all aspects related to institutional activities (energy efficiency, waste, and climate change, among other environmental aspects), for the purpose of establishing and implementing short, medium, and long-term measures for the prevention, mitigation, compensation, or restoration of environmental impacts. This program or plan, as it has also been called, is a cyclical process of planning, implementation, review, and improvement of the procedures and actions carried out by the institution (Art. 2 of the Regulation for the Development of Institutional Environmental Management Programs in the Public Sector of Costa Rica, Executive Decree No. 36499-S-MINAET).</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>The Poder Judicial, since September 8, 2009, has had the Environmental Affairs Commission (Comisión de Asuntos Ambientales), complying with the corresponding legal mandate (Art. 7 of the Regulation for the Development of Institutional Environmental Management Programs in the Public Sector of Costa Rica, Executive Decree No. 36499-S-MINAET). This commission, in order to promote the Poder Judicial in environmental matters, has developed a PGAI composed of nine specific programs (wastewater, drinking water, vehicle fleet control, natural disaster prevention and response, energy efficiency, ordinary solid waste management (gestión de los residuos sólidos ordinarios), acquisition of environmentally friendly goods and services, review and updating of current environmental legislation, and citizen participation and training).</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>In accordance with the provisions of the corresponding regulations (Art. 8 of the Regulation for the Development of Institutional Environmental Management Programs in the Public Sector of Costa Rica, Executive Decree No. 36499-S-MINAET), the functions of the Institutional Commission include conducting diagnoses or evaluations to determine the status of the institution regarding environmental management, waste management, climate change, and energy efficiency; proposing an institutional environmental policy; developing and implementing the PGAI; submitting reports requested by the MINAET; and establishing quantifiable indicators for the PGAI.</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>It is concluded that, in accordance with current regulations, the need for an Environmental Manager (Gestor Ambiental) position is unquestionable, in order to provide technical and specialized knowledge in the development of the PGAI, the preparation of diagnoses, and the development of projects on environmental topics; to provide the corresponding progress reports on the PGAI; as well as to provide recommendations for the prevention, mitigation, compensation, and restoration of environmental damage at the Institutional level, among other tasks established by the Environmental Affairs Commission of the Poder Judicial.</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>From the information gathered at different institutions, it can be concluded that many do not have a specific Environmental Manager position, and the functions have been assumed as additional duties by different positions within the institution (Legislative Assembly, Attorney General's Office, Supreme Electoral Tribunal, National Learning Institute, Municipality of San José). However, other institutions do have specific and homologous profiles to the Environmental Manager (National Power and Light Company, Municipality of Alajuela, Municipality of Santa Ana, Municipality of La Unión, and Municipality of Tibás).</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>Regarding the placement of Environmental Manager positions or the units responsible for this topic in the consulted institutions, it is found that they can be assigned in the following ways: to a specific process or department (this being the lowest level in the structural placement and functional authority relationship), as is the case of the National Power and Light Company and the Municipalities of Alajuela, San José, and Tibás; also at the staff level, as in the case of the Municipality of La Unión; attached to higher bodies of the institution, as in the case of the National Learning Institute and the Municipality of Santa Ana; or properly to a specific Institutional Commission for environmental matters (a collegiate body composed of positions from different departments), as in the case of the Legislative Assembly and the Supreme Electoral Tribunal. Therefore, it is concluded that there is no specific pattern of organizational assignment; rather, the positions have been placed in accordance with the organization, needs, and policies of each institution, with the possibility of placing the Environmental Manager position in a Directorate, Department, at the staff level, or within an Institutional Commission.</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>In the case of the Poder Judicial, and according to the opinion of the president of the Environmental Affairs Commission, Magistrate Oscar Gonzalez Camacho, the assignment of the Environmental Manager position to the Office of the Presidency could be considered. However, it is the opinion of this department that there should be an administrative assignment to the Office of the Presidency and a functional assignment with respect to the Environmental Affairs Commission, so that the occupant of the position can be adequately empowered, as they will need to coordinate with many bodies of the institution for the proper performance of their duties. Nevertheless, it must be made clear regarding the previous conclusion that this is only an opinion resulting from the research conducted, knowing that this department is not competent for the final decision, which, by its own competencies, corresponds to the Department of Planning.</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>From the consultations made to different institutions, it can be concluded that there is a similarity regarding the tasks or functions performed by the Environmental Manager positions. For this reason, and considering what the law indicates, the request of the Environmental Affairs Commission, the DIGECA, and the information provided by Mr. Mauricio Chacón Hernández, a Judicial Expert who has actively participated in the development of the PGAI of the Poder Judicial, the functions that must be included in the corresponding job profile are the following: diagnostic and research work; establishing guidelines, plans, programs, projects, and lines of action aimed at consolidating public environmental policies; compliance with applicable regulations; development of environmental programs; environmental impact assessments (evaluaciones de impacto ambiental); development of management indicators; coordination and verification of the implementation of environmental projects; advising different institutional departments with technical environmental criteria; waste management and inventory, electrical consumption, water consumption, and fuel consumption; carrying out plans to ensure the proper channeling of stormwater, wastewater, sewage, and their treatment; providing criteria and technical analysis of environmental clauses in administrative contracting (green purchasing); diagnosis and control of liquid, solid, atmospheric, and hazardous toxic emissions; recycling programs; on-site inspections; representing the institution on environmental matters; development, implementation, and follow-up of the PGAI as well as its coordination with the DIGECA; providing training; conducting awareness and information campaigns; and performing the environmental management oversight (regencia ambiental) of the institution (preventing, controlling, and mitigating the environmental impacts generated by the institution).</i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i>&nbsp;</i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><a name=\"_Toc401065808\"><i><span lang=ES-TRAD>Regarding the degrees that can be considered for this class of position, it should be noted that the following were evaluated: Environmental Management Engineering from </span></i></a><i><span lang=ES-TRAD>the School</span></i><i><span lang=ES-TRAD> of Environmental Sciences of the Faculty of Earth and Marine Sciences of the Universidad Nacional, Bachelor's and Licentiate in Environmental Engineering from the School of Chemistry of the Instituto Tecnológico de Costa Rica, and the Bachelor's and Licentiate in Environmental Health from the School of Health Technologies of the Faculty of Medicine of the Universidad de Costa Rica. It is concluded that all three meet the knowledge needs that an Environmental Manager professional for the Poder Judicial should have. However, considering that this professional will begin with a particular program (environmental management), which is associated with the development, implementation, and follow-up of the PGAI, as well as its coordination with the DIGECA, it would be pertinent to classify the position in the broad class category of Professional 2 and the narrow class of Environmental Manager (Gestor Ambiental).</span></i><i><span lang=ES-TRAD> </span></i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i><span lang=ES-TRAD>&nbsp;</span></i></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><b><i>7. That the Department of Planning assess the creation of the Environmental Manager position, not only to comply with the legal imperative that every institution must have this class of position, but also to promote the institutional environmental policy developed by the Environmental Affairs Commission of the Poder Judicial.</span></i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i><span lang=ES-TRAD>&nbsp;</span></i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><a name=\"_Toc401065811\"><b><i><span lang=ES-TRAD>7.2.</span></i></b></a><i><span lang=ES-TRAD> If the Environmental Manager position is created, it is recommended that the competent and expert administrative body on the matter, that is, the Department of Planning, be responsible for determining its assignment within the organizational structure of the Poder Judicial.</span></i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i><span lang=ES-TRAD>&nbsp;</span></i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><a name=\"_Toc401065812\"><b><i><span lang=ES-TRAD>7.3.</span></i></b></a><i><span lang=ES-TRAD> If the Environmental Manager position is created by the Department of Planning, it is recommended that the classification and valuation of the position be in the broad class of Professional 2, narrow class Environmental Manager.</span></i><i><span lang=ES-TRAD> </span></i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><i><span lang=ES-TRAD>&nbsp;</span></i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><a name=\"_Toc401065813\"><b><i><span lang=ES-TRAD>7.4.</span></i></b></a><i><span lang=ES-TRAD> The creation of the narrow class of “Environmental Manager” is recommended, as presented in annex No. 1 of this report.</span></i><i><span lang=ES-TRAD>   </span></i></p>\n\n<p class=MsoHeader style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><span lang=ES-TRAD>&nbsp;</span></p>\n\n<p class=MsoNormal style='margin-top:0cm;margin-right:42.55pt;margin-bottom:0cm;margin-left:42.55pt;margin-bottom:.0001pt;text-indent:35.45pt'><b><i>It was agreed: </i></b><i>To accept the report in its entirety, with the indication that, correspondingly, coordination must be carried out with the Occupational Health Section when it is pertinent.\"</i></p>\n\n<p class=MsoNormal align=center style='text-align:center;line-height:200%'><span style='line-height:200%'>- 0 -</span></p>\n\n<p class=MsoNormal style='margin-top:6.0pt;line-height:200%'><span style='line-height:200%'>            In a note dated October 13 of the current year, signed by Magistrate Carmenmaría Escoto Fernández, in her capacity as Acting President of the Environmental Affairs Commission, she communicated:</span></p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>\"As agreed by the Environmental Affairs Commission of the Poder Judicial, in session No. CAA-06-2014, held on October 7 of this year, I wish to express to you the shared concern of all the members of said Commission regarding the impossibility of following up on the Institutional Environmental Management Plan (Plan de Gestión Ambiental Institucional).</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>According to the '<i>Regulation for the development of institutional environmental management programs in the public sector of Costa Rica'</i>, hereinafter the Regulation, this instrument is based on '<i>a cyclical process of planning, implementation, review, and improvement of the procedures and actions carried out by an institution to perform its activity; in order to guarantee compliance with its environmental objectives and, therefore, promote better environmental performance in all institutions of the Public Administration'</i>. For this reason, as it is a dynamic process, it requires constant development and evolution, which has not been possible to achieve at present.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>In the document of the Institutional Environmental Management Plan (PGAI), approved by the Corte Plena in session No. 35-10 of December 6, 2010, the creation of a position for its follow-up was recommended. However, to date, although the plan was approved, this position does not exist.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>On April 8, 2013, former Magistrate Oscar González and the undersigned submitted a request to the Consejo Superior for the creation of an environmental manager position. This petition was heard in Session No. 36-13 of April 16 of that same year, and the communication was forwarded to the Department of Personnel so that they could determine the profile as well as a possible placement of said position within the structure of the Poder Judicial.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>From the follow-up carried out by the Commission on said agreement, the Human Resources Department (Dirección de Gestión Humana) informed us that the report was recently presented to you and is scheduled for next Thursday's session.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>In this regard, I would like to make the following reflections in light of the discussion that will take place on the topic in said session.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>In a conversation held with the Director of Planning, the requested position was not included in the 2015 budget for reasons of institutional priority, without taking into consideration that the Institution established environmental matters as a cross-cutting axis of planning (strategic and operational). However, she recommends taking the corresponding steps so that it is included in the 2016 budget, which will soon be prepared.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>It is important to note that, as a control mechanism, the regulation provides for the submission of semi-annual reports, with the head of each Institution being responsible for such management before the DIGECA. Likewise, at least one follow-up audit is conducted annually by said office to verify that the plan is being properly executed. To date, the Poder Judicial has not submitted the reports corresponding to the year 2013 and the first half of 2014, given that there is no person responsible for operationalizing, controlling, and reporting on the environmental programs to which the institution has been committed since the approval of the Environmental Management Plan in 2010.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>The foregoing was ratified by the Judicial Audit in official letter No. 406-28-AEE-2214, dated April 7, 2014, heard by the Consejo Superior in session No. 34-14, where it concluded that the Environmental Management Program in the Institution is not being complied with, because it does not have a Program coordinator to manage it and to perform the operational work of coordination, control, and follow-up on the different activities carried out both in this Plan and in the tasks performed by the Environmental Affairs Commission.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>The regulation specifies the following as sanctions for non-compliance: \"<i>articles 98, 99, 100, and 101 of the Organic Environmental Law; 98, 99, and 100 of the General Law of Public Administration; and 54 and 57 of the Law for Integrated Waste Management, without prejudice to other sanctions derived from national legislation</i>.\"</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>Regarding the position and recommendations made by the Human Resources Department, it seems opportune to point out that during 2011, the Poder Judicial paid an amount of $22160.00 (more than twelve million colones) for environmental management oversight (regencia ambiental) provided by an external professional hired by the hour. Said professional assisted an average equivalent of 3 days per month to carry out formalities on behalf of the Poder Judicial before SETENA and to be present during drug destructions, which reached a maximum frequency of two destructions per week. The foregoing in an incinerator that was donated to the Judicial Investigation Agency, which from the beginning presented operating and contamination problems (as part of the operating requirements of an incinerator, emission analysis is required, including dioxins and furans, which are highly polluting and potentially carcinogenic chemical compounds. These analyses were carried out, finding that emissions exceeded the permitted values by more than ten times).</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>To address the situation, an agreement was subsequently renegotiated with HOLCIM, a site where an agreement had initially been canceled due to problems with drug handling. Said agreement is valid for one more year (2015). For that same year, the OIJ has a budget for the acquisition of a new incinerator, so it must resume the issue of drug destructions, continuing the 2011 dynamic. This is why the creation of a position to address environmental matters would allow covering these functions and would further justify the need for the position.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:28.25pt'>Furthermore, regarding the profile indicated in the Human Resources report, we would very respectfully like to make an observation based on the experience of the Department of Forensic Sciences regarding the definition of profiles and classes for positions in the basic and natural sciences areas. Regarding the academic requirements, they may be leaving out other possible educational backgrounds that would also be capable of filling the position, thus closing the profile to only three base areas of training. Therefore, it is possible to hire a professional in natural sciences (biologist, chemist, or other) with a postgraduate degree in environmental management or environmental management (which various universities in the country currently offer) who would have sufficient qualifications to meet the job profile and functions.</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:21.25pt'>For the foregoing reasons, I convey to you the following agreements adopted by the Commission:</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:59.2pt;margin-bottom:6.0pt;margin-left:63.8pt'><b>   \"<i>c.</i> </b><i>To request that the Consejo Superior assess the provision of a resource to appoint a professional to collaborate with the implementation, administration, and follow-up of the PGAI for the years 2014 and following, which would thereby achieve compliance with institutional commitments before the MINAE, while the study for the environmental manager position is being processed. The person designated as part of the requested human resource must fulfill all the functions cited in point b) of this agreement. Furthermore, it is agreed to reiterate to the members of the Consejo Superior that this is a management effort that the Environmental Affairs Commission has raised previously given the lack of specialized human talent to handle this work, which is of institutional interest. It is ordered to send a copy of this management effort to the Presidency of the Poder Judicial and to Human Resources, as the job profile is being developed</i>.\"</p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:59.2pt;margin-bottom:6.0pt;margin-left:63.8pt'><i>  \"<b>d.</b> To inform the Presidency of the Poder Judicial, the members of the Consejo Superior, and the Judicial Audit that, on the occasion of the PGAI implementation, administration, and follow-up report for the year 2014, as there is still no designated expert to issue it, Mrs. Magda Protty, representative of the DIGECA of the MINAE, was summoned to explain to her the problems the institution faces due to the absence of a position to manage the PGAI, in order to request an extension for the commitments acquired by the Poder Judicial, which require an environmental specialist for their fulfillment. Additionally, to communicate the data collected on the matter by the different offices represented by the members of the Environmental Affairs Commission. If an extension of the deadline is granted, it will be communicated to the Presidency of the Poder Judicial and the members of the Consejo Superior, for their corresponding actions.\"</i></p>\n\n<p class=MsoNormal style='margin-top:6.0pt;margin-right:42.55pt;margin-bottom:6.0pt;margin-left:42.55pt;text-indent:21.25pt'>From the foregoing, we very respectfully request that the Consejo Superior adopt the recommendations of the indicated agreements, as well as the observations made regarding the profile and functions that the person hired for these purposes could perform.</p>\n\nWe remain at your disposal to address any questions you may have in this regard.”\n\n- 0 -\n\n**It was agreed: 1.)** To consider the report of the Human Resources Management Office as rendered and to accept the recommendations directed to the Planning Office; consequently: **a)** That the Planning Office evaluate the creation of the Environmental Manager (Gestor Ambiental) position, not only to comply with the legal imperative that every institution must have this type of position, but also to promote the institutional environmental policy developed by the Environmental Affairs Commission (Comisión de Asuntos Ambientales) of the Judiciary. **b)** Should the Environmental Manager position be created, the competent administrative body with expertise in the matter, that is, the Planning Office, is responsible for determining its placement within the organizational structure of the Judiciary. **c)** Should the Environmental Manager position be created by the aforementioned Office, the classification and valuation of the position will be in the broad class of Professional 2, narrow class Environmental Manager. **d)** Create the narrow class of “Environmental Manager” as presented in Annex No. 1 of this report. **2.)** To accept the agreement reached by the Environmental Affairs Commission and forward it to the Planning Office so that it may carry out the study for the implementation, administration, and follow-up of the PGAI for the years 2014 and following, and to request an extension from MINAE to fulfill the institutional commitments before that Ministry. **3.)** Given that this Branch of the Republic is budgetarily constrained, to request the Planning Office to carry out a redistribution of positions.\n\n**It was agreed:** **1.)** To consider the report of the Human Resources Management Office as rendered and to accept the recommendations directed to the Planning Office; consequently: **a)** That the Planning Office evaluate the creation of the Environmental Manager position, not only to comply with the legal imperative that every institution must have this type of position, but also to promote the institutional environmental policy developed by the Environmental Affairs Commission of the Judiciary, approved by the Full Court in session No. 14-08 of May 5, 2008, article VI. **b)** Should the Environmental Manager position be created, the competent administrative body with expertise in the matter, that is, the Planning Office, is responsible for determining its placement within the organizational structure of the Judiciary. **c)** Professionals in natural sciences, biologists, chemists, or others with studies or experience in environmental management should be added to the careers already indicated in the report that may be considered for this class of position. **d)** Should the Environmental Manager position be created by the aforementioned Office, the classification and valuation of the position will be in the broad class of Professional 2, narrow class Environmental Manager. **e)** Create the narrow class of “Environmental Manager” as presented in Annex No. 1 of this report. **2.)** To accept the agreement reached by the Environmental Affairs Commission and forward it to the Planning Office so that it may carry out the study for the implementation, administration, and follow-up of the PGAI for the years 2014 and following, and to request an extension of the deadline from MINAE to fulfill the institutional commitments before that Ministry. **3.)** Given that this Branch of the Republic is budgetarily constrained, to request the Planning Office to evaluate whether there is a possibility that an existing position could assume these functions. **4.)** To make this agreement known to the Environmental Affairs Commission."
