  "body_es_text": "ARTÍCULO VIII\n\nDocumento N° 3715-2026\n\nEl máster Allan Pow Hing Cordero, director de Planificación, presenta el INFORME 359-PLA-RH-MPL-2026, referente a los resultados obtenidos de la actualización del informe que contienen el impacto económico estimado del Proyecto denominado “Impacto organizacional y presupuestario en el Poder Judicial a partir de la promulgación de la Ley 9458 -Ley de Bienestar de los Animales para 2027”.\n\n \n\n“(…)\n\n \n\nLe remito el informe suscrito por la Máster Lucía Zeledón Quirós, Jefa a.i. del Subproceso Modernización Penal, relacionado con los resultados obtenidos de la actualización del informe que contienen el impacto económico estimado del Proyecto denominado “Impacto organizacional y presupuestario en el Poder Judicial a partir de la promulgación de la Ley 9458 -Ley de Bienestar de los Animales para 2027”, informe elaborado por la Dirección de Planificación.\n\n \n\n(…)\n\n1 Antecedentes\n\n1.1. Desde el 2016 se han realizado estudios para analizar el impacto presupuestario de implementar la Ley de Bienestar Animal:\n\n \n\nOficio de la Secretaría General de la Corte 5060-16 de mayo de 2016 donde indica: “con el fin de que se rinda el informe correspondiente adjunto le remito, oficio AG-093-2016 de fecha 4 de mayo del año en curso, en que el Diputado Otto Guevara Guth, Jefe de Fracción del Movimiento Libertario, solicita un informe sobre el impacto económico para el Poder Judicial en caso de aprobarse la Ley de Bienestar Animal, expediente No.18298.”. La solicitud se atendió por parte de la Dirección de Planificación mediante informe 1092-PLA-2016 del 04 de julio de 2016, adicionado mediante oficio 1156-PLA-2016-B del 20 de julio de 2016.\n\n \n\nEse informe fue remitido al diputado Guevara Guth, en respuesta al oficio AG-093-2016 por parte de la Secretaría General de la Corte mediante oficio SP-194-16 del 21 de julio de 2016.\n\n \n\nEl 22 de mayo del 2017, se publicó en la Gaceta 95, la Ley 9458 que reforma la Ley 4573, Código Penal y la Ley 7451, Ley de Bienestar de los Animales.\n\n \n\nMediante el oficio 1142-PLA-2017 del 7 de julio de 2017, se realizó la siguiente petición al Director General del Organismo de Investigación Judicial: “En relación con la aprobación de la Ley 18.298, denominado Modificación de la Ley 7451, Ley de Bienestar de los animales del 16 de noviembre de 1994, y modificación de la Ley 4573, Código Penal del 4 de mayo de 1970, firmada por el Presidente de la República, el pasado 11 de junio del 2017, con instrucciones del señor Presidente Dr. Carlos Chinchilla Sandí, me permito solicitarle el detalle de los recursos solicitados de acuerdo a la técnica presupuestaria, indicando por partida, subpartida y línea el detalle de la cifra indicada”.\n\n \n\nLa solicitud de presupuesto del OIJ fue conocida por la Corte Plena, en la sesión 24-18 celebrada el 30 de mayo del 2018 donde acordó:\n\n \n\n“ ... En atención al oficio de la Secretaria General de la Corte No. 4922-18, del 14 de mayo de 2018, en el cual nos solicita referirnos a la solicitud que había realizado la Dirección General en el oficio No. 0567-DG-2017, sobre los requerimientos básicos por parte del Organismo de Investigación Judicial para la atención de la Ley No. 18.298, Ley de Bienestar de los Animales del 16 de noviembre de 1994, y se nos pide indicar si dicho oficio mantiene interés o si los recursos se están considerando dentro del presupuesto del 2019…”\n\n \n\n“… se acordó: Trasladar el oficio Nº 590-DG-2018 de la Dirección del Organismo de Investigación Judicial, a la Dirección de Planificación para que efectúe un estudio técnico de lo solicitado e informe lo que corresponda en la sesión del próximo lunes 4 de junio en curso. Se declara acuerdo firme.”.\n\n \n\n531-PLA-2018 relacionado con el impacto organizacional y presupuestario para el 2019, a partir de la Ley 9458 que reforma la Ley 4573, Código Penal y Ley 7451, Ley de Bienestar de los Animales 9458, presentado el 1 de Junio del 2018 a la Secretaría General de la Corte y aprobado en sesión de presupuesto de Corte Plena 25-18 del 04 de junio de 2018, artículo VI.\n\n \n\n558-PLA-RH-MI-2019, aprobado por el Consejo Superior en sesión 42-19 (Presupuesto 2020) del 09 de mayo de 2019, artículo I y por Corte Plena en sesión 22-19 celebrada el 6 de junio del 2019, artículo II.\n\n \n\nLa Dirección de Tecnología de Información y Comunicaciones, desarrolló e instaló a partir del año 2019 las funcionabilidades en el sistema SACEJ, que permite el registro de empresas representantes de interés difusos de los animales, además, se creó un reporte para poder ser consultado por otras oficinas.\n\n433-PLA-RH-MI-2021, actualización de costos del estudio de Impacto organizacional y presupuestario en el Poder Judicial a partir de la promulgación de la Ley 9458 -Ley de Bienestar de los Animales para 2022, aprobado por Consejo Superior en sesión 30-2021 celebrada el 16 abril del 2021, artículo XXIV y por Corte Plena en sesión 21-2021 del 1 de junio del 2021. \n\n \n\n275-PLA-RH-MI-2022, actualización de costos del estudio de Impacto organizacional y presupuestario en el Poder Judicial a partir de la promulgación de la Ley 9458 -Ley de Bienestar de los Animales para 2023, aprobado en sesión Extraordinaria (Presupuesto) del Consejo Superior 36-2022 celebrada el 29 de abril de 2022, artículo XVII y por Corte Plena en sesión del primero de junio 2022, artículo II.\n\n \n\n268-PLA-RH-MI(NPL)-2023, actualización de costos del estudio de Impacto organizacional y presupuestario en el Poder Judicial a partir de la promulgación de la Ley 9458 -Ley de Bienestar de los Animales para 2024, aprobado en sesión Extraordinaria (Presupuesto) del Consejo Superior 32-2023, celebrada el 19 de abril de 2023, artículo XXXVI y por Corte Plena en sesión 24-23 del 30 de mayo de 2023, artículo I.\n\n \n\n383-PLA-RH-MI(PL)-2024, actualización de costos del estudio de Impacto organizacional y presupuestario en el Poder Judicial a partir de la promulgación de la Ley 9458 -Ley de Bienestar de los Animales para 2025, aprobado en sesión Extraordinaria (Presupuesto) del Consejo Superior en sesión del 19 de abril de 2024, artículo XI y por Corte Plena en sesión 23-24 del 27 de mayo de 2024, artículo XXIV.\n\n \n\n405-PLA-RH-MPL-2025, actualización de costos del estudio de Impacto organizacional y presupuestario en el Poder Judicial a partir de la promulgación de la Ley 9458 -Ley de Bienestar de los Animales para 2025, aprobado en sesión Extraordinaria (Presupuesto) del Consejo Superior 35-2025, del 24 de abril del 2025, artículo XXIV y por Corte Plena en sesión 24-25 del 26 de mayo de 2025, artículo XXV.\n\n \n\nDesde la creación del módulo en el Sistema de Administración y Control Electrónico de Juzgamientos (SACEJ), de organizaciones representantes de intereses difusos de los animales, aprobado por el Consejo Superior en sesión 69-2017 del 26 de julio de 2017, artículo XXII, dónde se acordó.\n\n \n\n“1.)Tomar nota del oficio N° 3443-DE-2017, suscrito por la máster Ana Eugenia Romero Jenkins, Directora Ejecutiva. 2.) La Dirección Jurídica en coordinación con el Registro Judicial realizará una propuesta de Reglamento que regule las acciones que deben ejecutarse conforme a la legislación contra el maltrato animal. 3.) Solicitar a la Dirección de Tecnología de la Información que diseñe, con el apoyo del personal del Registro Judicial, un módulo en el Sistema de Administración y Control Electrónico de Juzgamientos (SACEJ) para mantener la lista de organizaciones inscritas. 4.) Deberá el licenciado Saúl Arce Brenes, Jefe del Registro Judicial, atender la gestión de la Asociación para el Bienestar y Amparo de los Animales (A.B.A.A.) por lo que llevará el control respectivo en algún medio electrónico, hasta tanto se cuente con el referido sistema.\n\n Las Direcciones Jurídica, Ejecutiva y de Tecnología de la Información, así como el Registro Judicial tomar nota para lo que corresponda.”.\n\n \n\nEn la actualidad se encuentra en funcionamiento mediante el sistema SACEJ, para ser consultado por los despachos judiciales competentes.\n\n \n\n2 Justificación\n\nLa Ley 9458 reformó la Ley 4573, Código Penal y Ley 7451, Ley de Bienestar de los Animales 9458 publicada en la Gaceta 95 el 22 de mayo del 2017.\n\n \n\nEsta reforma trajo consigo una serie de variantes en la tramitación e investigación de Crueldad contra los animales, al ser normado como delito.\n\n \n\nPese a que la Ley entró en vigencia desde el 2017 a la fecha no se han dado recursos para su implementación, sino que ha debido ser asumida con recurso ordinario de la Institución, inicialmente destinado a cubrir otras necesidades. \n\n \n\n3 Principales implicaciones de la Ley 9458 en el Poder Judicial\n\nDentro de las particularidades de la Ley, se identificó cambios que impactan en el Poder Judicial:\n\n \n\nEl artículo 2 adicionó una sección V al título IX \"Delitos contra la seguridad común\" de la Ley 4573, Código Penal, de 4 de mayo de 1970, los cuales son el artículo 279 bis, 279 ter, 279 ter, 279 quáter, 279 quinquies y 279 sexies, “Crueldad contra los animales” “Muerte del animal”, “Actividades exceptuadas”, “Peleas entre animales” y “Pena alternativa”, delitos que son competencia de las instancias judiciales.\n\nAsimismo, el artículo 3, adiciona un nuevo artículo, el 405 bis, “Maltrato de animales” en que se castiga con multa el “Maltrato animal”. \n\nEn los artículos 2 y 3 de la reforma de Ley 9458 en estudio, en su parte dispositiva final establecen: “Las organizaciones debidamente inscritas en el Registro Judicial podrán representar los intereses difusos de los animales afectados por las conductas descritas en esta norma”. Conclusiones\n\n4.1. La Ley 9458 “Bienestar de los Animales” entró en vigor en 2017 pero a la fecha no cuenta con contenido presupuestario para su implementación, sino que debió ser asumida con recursos ordinario de la Institución, inicialmente destinado a cubrir otras necesidades. \n\n \n\n4.2. Para 2027, la estimación del presupuesto necesario para la implementación de la Ley 9458 es de ₡625 137 449,89 que incluye recurso humano, equipo, mobiliario, pago de atención veterinaria. \n\n \n\n4.3. Los requerimientos para la implementación de la ley de bienestar animal se mantienen a la fecha. \n\n \n\n5. Recomendaciones\n\n \n\nAl Consejo Superior y Corte Plena\n\n5.1. Se declara este acuerdo firme.",
  "body_en_text": "ARTICLE VIII\n\nDocument No. 3715-2026\n\nMr. Allan Pow Hing Cordero, Director of Planning, presents REPORT 359-PLA-RH-MPL-2026, regarding the results obtained from the update of the report containing the estimated economic impact of the Project called “Organizational and budgetary impact on the Judicial Branch resulting from the enactment of Law 9458 -Animal Welfare Law for 2027.”\n\n“(...)\n\nI am forwarding the report signed by Ms. Lucía Zeledón Quirós, Acting Head of the Penal Modernization Subprocess, regarding the results obtained from the update of the report containing the estimated economic impact of the Project called “Organizational and budgetary impact on the Judicial Branch resulting from the enactment of Law 9458 -Animal Welfare Law for 2027,” a report prepared by the Planning Directorate.\n\n(...)\n\n1 Background\n\n1.1. Since 2016, studies have been conducted to analyze the budgetary impact of implementing the Animal Welfare Law:\n\nOfficial communication from the General Secretariat of the Court 5060-16 of May 2016 stating: “for the purpose of rendering the corresponding report, I am attaching official communication AG-093-2016 dated May 4 of the current year, in which Deputy Otto Guevara Guth, Head of the Libertarian Movement Caucus, requests a report on the economic impact for the Judicial Branch should the Animal Welfare Law, file No. 18298, be approved.” The request was addressed by the Planning Directorate through report 1092-PLA-2016 of July 4, 2016, supplemented by official communication 1156-PLA-2016-B of July 20, 2016.\n\nThis report was forwarded to Deputy Guevara Guth, in response to official communication AG-093-2016, by the General Secretariat of the Court via official communication SP-194-16 of July 21, 2016.\n\nOn May 22, 2017, Law 9458, which reforms Law 4573, the Penal Code, and Law 7451, the Animal Welfare Law, was published in Gazette 95.\n\nThrough official communication 1142-PLA-2017 of July 7, 2017, the following request was made to the Director General of the Judicial Investigation Agency (OIJ): “In relation to the approval of Law 18.298, called Amendment to Law 7451, Animal Welfare Law of November 16, 1994, and amendment to Law 4573, Penal Code of May 4, 1970, signed by the President of the Republic on June 11, 2017, with instructions from Mr. President Dr. Carlos Chinchilla Sandí, I must request the detail of the resources requested according to budgetary technique, indicating by program, subprogram, and line item the detail of the indicated amount.”\n\nThe OIJ’s budget request was considered by the Full Court, in session 24-18 held on May 30, 2018, where it resolved:\n\n“... In response to the General Secretariat of the Court’s official communication No. 4922-18, of May 14, 2018, in which we are asked to refer to the request that the General Directorate had made in official communication No. 0567-DG-2017, regarding the basic requirements of the Judicial Investigation Agency for addressing Law No. 18.298, Animal Welfare Law of November 16, 1994, and we are asked to indicate whether said communication remains of interest or if the resources are being considered within the 2019 budget…”\n\n“... it was resolved: To forward official communication No. 590-DG-2018 from the Directorate of the Judicial Investigation Agency to the Planning Directorate so that it may carry out a technical study of what was requested and report accordingly at the session on Monday, June 4. This resolution is declared final.”\n\n531-PLA-2018 related to the organizational and budgetary impact for 2019, arising from Law 9458 which reforms Law 4573, the Penal Code, and Law 7451, the Animal Welfare Law 9458, presented on June 1, 2018, to the General Secretariat of the Court and approved in the Full Court budget session 25-18 of June 4, 2018, article VI.\n\n558-PLA-RH-MI-2019, approved by the Superior Council in session 42-19 (2020 Budget) of May 9, 2019, article I, and by the Full Court in session 22-19 held on June 6, 2019, article II.\n\nThe Information and Communication Technology Directorate developed and installed, starting in 2019, functionalities in the SACEJ system allowing the registration of companies representing the diffuse interests (intereses difusos) of animals; additionally, a report was created so it could be consulted by other offices.\n\n433-PLA-RH-MI-2021, cost update of the study on the Organizational and budgetary impact on the Judicial Branch resulting from the enactment of Law 9458 -Animal Welfare Law for 2022, approved by the Superior Council in session 30-2021 held on April 16, 2021, article XXIV, and by the Full Court in session 21-2021 of June 1, 2021.\n\n275-PLA-RH-MI-2022, cost update of the study on the Organizational and budgetary impact on the Judicial Branch resulting from the enactment of Law 9458 -Animal Welfare Law for 2023, approved in the Extraordinary (Budget) Session of the Superior Council 36-2022 held on April 29, 2022, article XVII, and by the Full Court in the session of June 1, 2022, article II.\n\n268-PLA-RH-MI(NPL)-2023, cost update of the study on the Organizational and budgetary impact on the Judicial Branch resulting from the enactment of Law 9458 -Animal Welfare Law for 2024, approved in the Extraordinary (Budget) Session of the Superior Council 32-2023, held on April 19, 2023, article XXXVI, and by the Full Court in session 24-23 of May 30, 2023, article I.\n\n383-PLA-RH-MI(PL)-2024, cost update of the study on the Organizational and budgetary impact on the Judicial Branch resulting from the enactment of Law 9458 -Animal Welfare Law for 2025, approved in the Extraordinary (Budget) Session of the Superior Council in session of April 19, 2024, article XI, and by the Full Court in session 23-24 of May 27, 2024, article XXIV.\n\n405-PLA-RH-MPL-2025, cost update of the study on the Organizational and budgetary impact on the Judicial Branch resulting from the enactment of Law 9458 -Animal Welfare Law for 2025, approved in the Extraordinary (Budget) Session of the Superior Council 35-2025, of April 24, 2025, article XXIV, and by the Full Court in session 24-25 of May 26, 2025, article XXV.\n\nSince the creation of the module in the Electronic Judgment Administration and Control System (Sistema de Administración y Control Electrónico de Juzgamientos, SACEJ) for organizations representing the diffuse interests of animals, approved by the Superior Council in session 69-2017 of July 26, 2017, article XXII, where it was resolved:\n\n“1.) To take note of official communication No. 3443-DE-2017, signed by Ms. Ana Eugenia Romero Jenkins, Executive Director. 2.) The Legal Directorate, in coordination with the Judicial Registry, will prepare a Regulatory proposal governing the actions that must be executed in accordance with the legislation against animal mistreatment. 3.) To request the Information Technology Directorate to design, with the support of Judicial Registry personnel, a module in the Electronic Judgment Administration and Control System (SACEJ) to maintain the list of registered organizations. 4.) Mr. Saúl Arce Brenes, Head of the Judicial Registry, shall address the request of the Association for the Welfare and Protection of Animals (Asociación para el Bienestar y Amparo de los Animales, A.B.A.A.) and shall maintain the respective control in some electronic medium, until the referred system is available.\n\nThe Legal, Executive, and Information Technology Directorates, as well as the Judicial Registry, shall take note for their corresponding actions.”\n\nIt is currently operational through the SACEJ system, to be consulted by competent judicial offices.\n\n2 Justification\n\nLaw 9458 reformed Law 4573, the Penal Code, and Law 7451, the Animal Welfare Law 9458, published in Gazette 95 on May 22, 2017.\n\nThis reform brought with it a series of variations in the processing and investigation of Cruelty against animals, it being regulated as a crime.\n\nAlthough the Law entered into force in 2017, to date no resources have been provided for its implementation; rather, it has had to be assumed with the Institution’s ordinary resources, initially intended to cover other needs.\n\n3 Main implications of Law 9458 in the Judicial Branch\n\nAmong the particularities of the Law, changes were identified that impact the Judicial Branch:\n\nArticle 2 added a section V to Title IX “Crimes against common safety” of Law 4573, the Penal Code, of May 4, 1970, which are articles 279 bis, 279 ter, 279 ter, 279 quáter, 279 quinquies, and 279 sexies, “Cruelty against animals,” “Death of the animal,” “Excepted activities,” “Animal fights,” and “Alternative penalty,” crimes that fall under the jurisdiction of judicial authorities.\n\nLikewise, article 3 adds a new article, 405 bis, “Mistreatment of animals,” in which “Animal mistreatment” is punishable by a fine.\n\nArticles 2 and 3 of the Law 9458 reform under study, in their final operative part, establish: “Organizations duly registered in the Judicial Registry may represent the diffuse interests of animals affected by the conduct described in this law.” Therefore, the Judicial Registry must register those institutions representing the diffuse interests of animals, and a module must be created in the Registry System.\n\n3.1 Human resources needed at the OIJ for the implementation of Law 9458\n\nFor the year 2027, 21 positions are recommended, one more than those considered in report 405-PLA-RH-MI(NPL)-2025, cost update of the study on the Organizational and budgetary impact on the Judicial Branch resulting from the enactment of Law 9458 -Animal Welfare Law; therefore, the costs of the requirements are updated.\n\n4. Conclusions\n\n4.1. Law 9458 “Animal Welfare” entered into force in 2017, but to date it has no budgetary allocation for its implementation; rather, it had to be assumed with the Institution’s ordinary resources, initially intended to cover other needs.\n\n4.2. For 2027, the estimated budget necessary for the implementation of Law 9458 is ₡625,137,449.89, which includes human resources, equipment, furniture, and payment for veterinary care.\n\n4.3. The requirements for the implementation of the animal welfare law are maintained to date.\n\n5. Recommendations\n\nTo the Superior Council and the Full Court\n\n5.1.
