Causas que motivan la intervención\n\nLa poda o corta de árboles podrá originarse exclusivamente bajo los siguientes criterios técnicos:\n\nRiesgo inminente: Árboles que representen un peligro para el personal o personas usuarias por caída de ramas secas, enfermas o inestabilidad estructural.\n\nAfectación a infraestructura: Riesgo de daños potenciales a edificios, aceras, equipos o vehículos.\n\nSeguridad y vigilancia: Obstrucción de visibilidad de cámaras de seguridad, cuando no sea posible su reubicación. \n\nAfectación a servicios públicos: Interferencia con tendido eléctrico o suministro de agua.\n\nInfraestructura institucional: En caso de afectación a infraestructura crítica, debe solicitarse criterio técnico a Servicios Generales previo a cualquier intervención.\n\nMantenimiento: Labores preventivas y de ornato de las instalaciones.\n\n \n\n2. Poda vs. Corta\n\n \n\nPoda: es la acción de eliminar una o varias ramas u otras partes de un árbol que se mantiene vivo y en pie, realizada según criterio técnico con el fin de atender una o varias de las causas indicadas en el punto 1.\n\nCorta (Tala): consiste en la acción de eliminar totalmente el árbol en pie mediante el corte en su tronco cuando, según criterio técnico, es la única opción para atender una o varias de las causas indicadas en el punto 1. \n\n \n\n Aunado a lo anterior, es fundamental considerar: \n\n La Administración Regional es responsable de buscar un criterio técnico idóneo e independiente que justifique técnicamente la necesidad de poda o en última instancia, la corta, asegurando que se cumplan los procedimientos legales correspondientes.\n\n Para asegurar que el criterio sea válido y suficiente, debe considerar los siguientes aspectos:\n\nEl criterio debe ser emitido por un experto (ingeniero forestal o profesional afín con competencia técnica en arbolado, debidamente incorporado a su respectivo colegio profesional, que evalúe el estado fitosanitario, su valor ecológico y ambiental así como su estabilidad estructural y el riesgo real que representa). \n\nEn caso de que se deba cortar el árbol, el documento debe justificar técnicamente por qué la poda no es suficiente y por qué la corta es la única medida adecuada para mitigar el riesgo (ej. muerte progresiva del sistema radicular, agentes patógenos, peligro inminente de caída sobre personas o infraestructura crítica). Asimismo, debe establecer medidas de compensación ambiental (por ej. siembra de nuevos árboles de especies nativas). \n\n Este criterio servirá como el respaldo técnico necesario para realizar cualquier trámite posterior, incluyendo las gestiones ante las autoridades ambientales correspondientes (como el SINAC o las municipalidades, según sea el caso).\n\n En caso de que el árbol afecte la visibilidad de cámaras de seguridad, el criterio debe ser validado o complementado por el Departamento de Seguridad, quienes deben certificar que no existe posibilidad técnica de reubicar los dispositivos.\n\n Si la afectación es a infraestructura institucional, debe consultarse con el Departamento de Servicios Generales para que confirmen que la estructura se ve comprometida y respalden la necesidad de la intervención.\n\n Si el árbol se encuentra en una ruta nacional, el CONAVI es la autoridad que debe autorizar la intervención, y ellos cuentan con su propio cuerpo de ingenieros forestales para realizar la evaluación técnica. Fuera de rutas nacionales, es la propia institución la responsable de obtener este criterio técnico independiente antes de proceder.\n\n \n\n3. Al respecto, la Ley Forestal N°7575 indica lo siguiente:\n\n \n\n“ARTICULO 33.- Areas de protección.- Se declaran áreas de protección las siguientes: a) Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal; b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado; c) Una zona de cincuenta metros medida horizontalmente en las riberas de los lagos y embalses naturales y en los lagos o embalses artificiales construidos por el Estado y sus instituciones. Se exceptúan los lagos y embalses artificiales privados; d) Las áreas de recarga y los acuíferos de los manantiales, cuyos límites serán determinados por los órganos competentes establecidos en el reglamento de esta ley.\n\n \n\nARTICULO 34.- Prohibición para talar en áreas protegidas Se prohíbe la corta o eliminación de árboles en las áreas de protección descritas en el artículo anterior, excepto en proyectos declarados por el Poder Ejecutivo como de conveniencia nacional (…).” \n\n \n\nPermisos Externos:\n\nMunicipalidad de la zona: Para árboles en caminos o propiedad municipal.\n\nCONAVI: Para árboles en rutas nacionales.\n\nProveedor eléctrico: Cuando el árbol afecte el tendido eléctrico.\n\nSINAC: La poda no requiere permiso, siempre que no afecte la salud del árbol y se mantenga al menos el 50% de la copa.\n\n \n\n En caso de que la intervención sea sobre un árbol bajo protección ambiental, la Administración deberá gestionar los permisos especiales ante las autoridades competentes.\n\n \n\n \n\n \n\n \n\nAERJ/WKA/MAV/ESR\n\n \n\nRef. 5838-2026\n\n \n\n \n\n \n\nPoder Judicial: fortaleza de nuestra Democracia",

Grounds for intervention\n\nTree pruning or felling may be undertaken exclusively on the following technical grounds:\n\nImminent risk: Trees that pose a danger to staff or members of the public because of falling dry or diseased branches, or structural instability.\n\nImpact on infrastructure: Risk of potential damage to buildings, sidewalks, equipment, or vehicles.\n\nSafety and surveillance: Obstruction of the visibility of security cameras where relocating them is not possible.\n\nImpact on public services: Interference with power lines or the water supply.\n\nInstitutional infrastructure: In the event of an impact on critical infrastructure, a technical opinion must be requested from General Services before any intervention.\n\nMaintenance: Preventive work and landscaping at the facilities.\n\n\n2. Pruning vs. felling\n\nPruning: The removal of one or more branches or other parts of a tree that remains alive and standing, carried out in accordance with technical judgment to address one or more of the grounds indicated in section 1.\n\nFelling (Tala): The complete removal of a standing tree by cutting its trunk when, according to technical judgment, this is the only option for addressing one or more of the grounds indicated in section 1.\n\n\nIn addition to the above, it is essential to consider:\n\n The Regional Administration is responsible for obtaining an appropriate and independent technical opinion that technically justifies the need for pruning or, as a last resort, felling, while ensuring compliance with the applicable legal procedures.\n\n To ensure that the opinion is valid and sufficient, it must address the following:\n\nThe opinion must be issued by an expert (a forestry engineer or related professional with technical expertise in trees, duly registered with the relevant professional association, who evaluates the tree’s phytosanitary condition, ecological and environmental value, structural stability, and the actual risk it poses).\n\nIf the tree must be felled, the document must technically explain why pruning is insufficient and why felling is the only appropriate measure to mitigate the risk (e.g., progressive death of the root system, pathogens, imminent danger of falling onto people or critical infrastructure). It must also establish environmental compensation measures (e.g., planting new trees of native species).\n\n This opinion will serve as the necessary technical support for any subsequent procedure, including dealings with the relevant environmental authorities (such as SINAC or the municipalities, as applicable).\n\n If the tree obstructs the visibility of security cameras, the opinion must be validated or supplemented by the Security Department, which must certify that there is no technical possibility of relocating the devices.\n\n If institutional infrastructure is affected, the General Services Department must be consulted so that it can confirm that the structure is compromised and support the need for intervention.\n\n If the tree is located on a national highway, CONAVI is the authority that must authorize the intervention, and it has its own forestry engineering corps to conduct the technical assessment. Outside national highways, the institution itself is responsible for obtaining this independent technical opinion before proceeding.\n\n\n3. In this regard, Ley Forestal N°7575 provides as follows:\n\n“ARTICLE 33.—Protection areas.—The following are declared protection areas: a) Areas bordering permanent springs, defined as a radius of one hundred meters measured horizontally; b) A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides of the banks of rivers, streams, or brooks, if the terrain is flat, and fifty horizontal meters if the terrain is uneven; c) An area of fifty meters measured horizontally along the banks of natural lakes and reservoirs and artificial lakes or reservoirs built by the State and its institutions. Private artificial lakes and reservoirs are excluded; d) Recharge areas and the aquifers of springs, whose boundaries shall be determined by the competent bodies established in the regulations to this law.\n\nARTICLE 34.—Prohibition on felling in protected areas.
