SE DECLARA CON LUGAR Y SE ORDENA QUE, EN EL PLAZO DE DOCE MESES, SE SOLUCIONE EL PROBLEMA EN EL CONDOMINIO Y, EN EL PLAZO DE DOS AÑOS SE SOLUCIONE EL PROBLEMA EN LA COMUNIDAD DE SAN FELIPE DE ALAJUELITA. VCG07/2026\n\n“(…) III.- Sobre el caso concreto. En el sub examine,\nel recurrente indica que es vecino del Condominio La Verbena. Señala que ese\ncondominio sufre problemas de manejo de aguas residuales desde hace años.\nAfirma que acudió a las instancias accionadas. Sin embargo, tal problema no ha\nsido solucionado.\n\nAnalizados los autos, la Sala tuvo por probado que, en\nfecha no determinada, vecinos del Condominio La Verbena denunciaron ante los\naccionados un problema de manejo de aguas residuales. En informe técnico del 9\nde enero de 2025, elaborado en respuesta a la carta MS-DRRSCS-ARSAL-1335-2025\ndel Ministerio de Salud, el ICAA indicó: “V. Conclusiones La zona norte de San\nFelipe de Alajuelita cuenta actualmente con un sistema de alcantarillado de\naguas residuales que solo tiene la capacidad de dar el servicio de recolección\nde aguas residuales y no su tratamiento respectivo. Debido a la condiciones\ntopográficas de la zona, las aguas vierten naturalmente al margen Oeste del río\nTiribí, por lo que la solución técnica óptima es la de realizar interconexiones\ncon el colector Tiribí que se ubica sobre la margen Este de dicho río. Las\ninterconexiones cuentan con diseño pero para poder darse su ejecución es\nnecesario poder inscribir varias servidumbres a nombre del AyA. En las márgenes\ndel río Tiribí en San Felipe de Alajuelita y Hatillo de San José, existen\ncondiciones sociales que dificultan e imposibilitan las labores de campo para\nel registro de servidumbres y la ejecución del proyecto. La criminalidad,\nviolencia y la invasión de terrenos por medio de precarios son las mayores\ndificultades que se han encontrado a la hora de realizar los trabajos en la\nzona. A pesar de que el PMAAMSJ se encuentra activo y que el AyA labora\nconstantemente para ejecutar las obras pendientes del proyecto, debido a las\ndificultades encontradas en la zona y la complejidad de su solución, las obras\ncorrespondientes no se encuentran asignadas a ningún paquete de obras y no se\nprevé su solución ni a corto ni mediano plazo. VI. Recomendaciones Reiniciar un\nproceso de acercamiento con las instituciones involucradas para determinar un\nprograma de actividades que solucione la problemática en la zona. Si para la\nproblemática de la zona de servidumbres no se vislumbra que tenga un panorama\nfavorable en cuanto a su solución a corto plazo, se debe evaluar una solución\nque reduzca el área beneficiada pero que logre dar los servicios de recolección\na la mayoría de la población de la zona norte de San Felipe de Alajuelita”.\nMediante oficio DRyT-OMSR-2025-00715 del 9 de octubre de 2025, el ICAA indicó\nal Área Rectora de Salud de Alajuelita: “En atención a denuncia presentada a la\nContraloría de Servicio del AyA (GESTION REP.CS Nº 3458 2025), se requiere\ninformar que el AyA ha venido realizando múltiples labores para mitigar la\nproblemática de las aguas residuales en el Condominio La Verbena, ubicado en\nSan Felipe de Alajuelita. Sin embargo, actualmente, la problemática que se da\nen el lugar requiere de inversiones para reparar las tuberías, rehabilitar el\ndesfogue, mantenimiento de áreas verdes, para tener acceso para poder dar un\nadecuado mantenimiento. Estas labores son responsabilidad de los Condóminos y\nel AyA no puede destinar recursos para resolver una problemática de carácter\nprivado, ya que estaría haciendo un mal uso de los fondos públicos. Por lo anterior\ndescrito y dado que el Ministerio de Salud es el ente gubernamental responsable\nde velar por el correcto uso y vertido de las aguas a los sistemas\ncorrespondientes, se le traslada el caso para que analice la situación y se\ngestione las acciones necesarias, conforme a sus competencias”. Mediante\ninforme técnico IT-MS-DRRSCS-033- 2026 del 18 de febrero de 2026, el Ministerio\nde Salud constató la filtración de aguas residuales en el Condominio la\nVerbena. Según informe técnico IT-DRRSCS-URS-0211-2026 del 24 de abril de 2026\ndel Ministerio de Salud: “En los registros de proyectos de construcción de\nsistemas de tratamiento de aguas residuales que se llevan en la Región Central\nSur, no se tiene ninguna evidencia de que haya un sistema de tratamiento de\naguas aprobado en el sitio. Se debe acotar que la primera versión del\nReglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales,\ndecreto N° 39887-S-MINAE, fue le decreto Nº 31545-S-MINAE del 9 de octubre de\n2003, antes de esa fecha no se tiene certeza de que hubiese alguna norma\nrespecto a STAR por parte del Ministerio de Salud”. De conformidad con el\noficio MS-DSA-UGSA-0452-2026 del 30 de abril de 2026 de la Unidad de Gestión de\nSalud Ambiental del Ministerio de Salud: “CONCLUSIONES • Se constatan obstrucciones\nen las cajas de registro y sistema existente, generando desbordamientos de\naguas residuales en distintos sectores, afectando la salud pública y el\nambiente. • Se evidencia ausencia de tratamiento de aguas residuales en el\nsitio; a pesar de que se señala la existencia de un sistema de tratamiento, no\nfue posible verificarlo debido a que el área está totalmente inaccesible.\nAdemás, no existen trámites ni registros oficiales sobre la instalación u\noperación de una planta de tratamiento u otro sistema, por lo que las aguas\nresiduales se vierten sin tratamiento al cuerpo de agua colindante. • Hay una\nresponsabilidad institucional por parte del Instituto Costarricense de\nAcueductos y Alcantarillados (AyA), entidad que ha intervenido previamente en la\nzona. El agua potable es suministrada por dicho ente y los vecinos indican y\npresentan evidencia de que AyA realiza el cobro por concepto de alcantarillado\nsanitario, sin que exista evidencia de un sistema efectivo de tratamiento\nasociado en el sitio. • Se determina la existencia de construcciones\nirregulares en el sitio, sin los permisos municipales correspondientes; se\nobservan ampliaciones de viviendas, construcciones sobre aceras y otras\nprácticas, que agravan las condiciones del entorno y reflejan un incumplimiento\nde la normativa urbanística vigente. • Se observó acumulación significativa de\ndesechos sólidos en sector noroeste del condominio, afectando la Salud Pública\ny contribuyendo a la degradación ambiental. RECOMENDACIONES Se recomienda\nsolicitar a la Dirección Regional Rectoría de Salud Central Sur y al Área\nRectora de Salud de Alajuelita, lo siguiente: • Emitir acto administrativo al\nInstituto Costarricense de Acueductos y Alcantarillados (AyA), para que, en un\nplazo de 10 días hábiles: Ejecute acciones para eliminar obstrucciones y\ndesbordamientos de aguas residuales, en las cajas de registro y sistema\ncolector existente. • Garantice la operación adecuada del sistema de\nrecolección existente. • Presente un plan técnico de mantenimiento preventivo y\ncorrectivo, para evitar afectaciones futuras. • Solicitar mediante oficio al\nAyA la presentación de un plan remedial, con plazos establecidos, responsables\ny acciones concretas, para brindar una solución oportuna al tratamiento a las\naguas residuales generadas en el sitio, partiendo del hecho de que es la\nentidad que suministra el agua potable en la zona y se cobra el servicio de\nalcantarillado sanitario en el lugar. Evaluar una posibilidad de interconexión\na sistemas existentes (ej. colector Tiribí) • Realizar las coordinaciones\nnecesarias con la Municipalidad de Alajuelita para la limpieza y eliminación de\nacumulaciones de residuos sólidos en el sitio. • Remitir mediante oficio, el\ncaso a la Municipalidad de Alajuelita, con relación a las construcciones ilegales\npresentes en el sitio, a fin de que se definan las acciones a realizar con\nrespecto al tema”. Mediante órdenes sanitarias 049-2026 y 050-2026 del 11 de\nmayo de 2026, el Ministerio de Salud ordenó al ICAA: “• Ejecutar acciones para\neliminar obstrucciones y desbordamientos de aguas residuales, en las cajas de\nregistro y sistema colector existente. • Garantizar la operación adecuada del\nsistema de recolección existente. • Presentar un plan técnico de mantenimiento\npreventivo y correctivo, para evitar afectaciones futuras ante el Área Rectora\nde Salud de Alajuelita”. Por informe técnico DRyT-OMSR-2026-00246 de mayo de\n2026, el ICAA concluyó: “…6. Conclusiones 1. El Condominio La Verbena fue\nconstruido con una red de alcantarillado sanitario y una planta de tratamiento,\nlas cuales son propiedad de los condóminos. 2. Según la información que se\ncuenta, la planta de tratamiento y la red de alcantarillado sanitario no recibe\nmantenimiento y esto provoca que las aguas residuales se derramen al medio\nambiente sin tratamiento. 3. Dado a que la planta de tratamiento y la red de\nalcantarillado sanitario, son un bien privado, propiedad de los condóminos, el\nAyA no brinda recursos para su mantenimiento. 4. En su rol de rectoría el AyA\nha venido informando al Ministerio de Salud de los casos donde se detecta\nproblemas relacionados con la descarga de aguas residuales en este Condominio.\n5. Aun cuando el AyA desarrolle obras que eviten la necesidad que el Condominio\nLa Verbena tenga una planta de tratamiento, y que dichas obras faciliten la\nconexión de sus aguas residuales. La operación, el resguardo y el mantenimiento\nde la red interna del Condominio La Verbena, seguirá siendo responsabilidad de\nlos condóminos, por ser un bien privado”. Mediante informe GG-2026-01065 del 12\nde mayo de 2026, el ICAA concluyó: “Conclusiones • La iniciativa Saneamiento:\nManejo Integral de las aguas residuales en las urbanizaciones de San Felipe de\nAlajuelita forma parte de la cartera institucional de iniciativas identificadas\npara atender necesidades en los sistemas de agua potable y saneamiento. •\nActualmente se encuentra en la posición 57 de un total de 176 iniciativas,\nsegún la priorización institucional vigente. • La iniciativa esta (sic) por ser\natendida, siendo que forma parte del Plan de Trabajo de Trabajo para el año\n2026 propuesto por la Dirección de Diseño de Saneamiento. Se cuenta con un\nexpediente de la situación de aguas residuales en el sector que data del año\n2009. • En la actualidad se visualiza que la problemática principal de derrames\nen el condominio se debe al vertido indebido de aguas residuales en el sistema\nde alcantarillado pluvial, el cual se encuentra obstruido y que es administrado\npor la Municipalidad. • La futura solución de aguas residuales en el sector de\nSan Felipe contemplará la construcción de redes, extensions (sic) de ramal e\ninterconexiones que puedan realizarse y sean requeridas siempre y cuando sean\nplanteados en zona publica (sic). • El caso de interés presenta limitantes en\ncuanto a la construcción de obras que permitan brindar una solución integral,\nesto debido a la figura legal de condominio en la que se encuentran agrupados\nlos vecinos de La Verbena, con lo cual muchas de las modificaciones que sean\nrequeridas a lo interno para llevar el aguas (sic) hasta un único punto de\nreunion (sic) deberán ser ejecutadas por los mismos condóminos”.\n\nA partir de los hechos expuestos, la Sala estima como\nincontrovertido que los vecinos del condominio La Verbena sufren por el mal\nmanejo de aguas residuales desde hace años, lo que ha sido de conocimiento de\nlas autoridades accionadas, sin que a la fecha hayan realizado acciones\nsuficientes para solucionarlo. En ese tanto, se declara con lugar el recurso.\n\nEn cuanto a las consecuencias jurídicas de este fallo,\ndesde el punto de vista jurídico y tomando como base los informes rendidos, esa\nproblemática debe ser dividida en dos esferas. De un lado está el manejo de las\naguas residuales a lo interno del condominio. De otro, el manejo y tratamiento\nadecuado a lo externo de él.\n\nCon respecto al primer punto, existe controversia entre\nlas partes en cuanto al sujeto que debe asumir la responsabilidad por el\nmantenimiento del alcantarillado condominal y la solución los problemas que él\nocasiona. En ese sentido, el ICAA sostiene – en resumen- que se trata de\npropiedad privada, por lo que no puede invertir recursos públicos en tal\nalcantarillado. Asimismo, apunta que no ha recibido tal alcantarillado, debido\na que adolece de deficiencias técnicas que imposibilitan esa recepción. Por su parte,\nel Ministerio de Salud alega, entre otras cosas, que el ICAA habría cobrado en\nalguna oportunidad el servicio de alcantarillado a los vecinos, por lo que\npodría asumir esa responsabilidad.\n\nAtinente a tal extremo, este Tribunal determina que no\ncorresponde a esta jurisdicción resolver sobre la naturaleza jurídica del\nalcantarillado condominal -público o privado- por tratarse de un tema de\nlegalidad. A los efectos de esta Sala, la relevancia constitucional del caso\nradica en que se solucione el problema de salud pública detectado y que es\nincontrovertido. En ese tanto, se ordena a las instancias recurridas que\nefectúen entre ellas las coordinaciones necesarias y dispongan lo pertinente\npara remediar la problemática señalada, ya sea mediante el dictado de órdenes\nsanitarias, la intervención directa u otra vía, siempre que la decisión esté\najustada a Derecho y respete el ámbito de competencias de las instancias\nencargadas.\n\nIV.- Con respecto al tratamiento y manejo de las aguas\nresiduales a lo externo del condominio La Verbena, la Sala nota que el ICAA\ninformó lo siguiente:\n\n“Actualmente, la atención a la problemática del sector\nfue registrada bajo la iniciativa denominada “Manejo Integral de las aguas\nresiduales en las urbanizaciones de San Felipe de Alajuelita” con la cual se\npretende realizar las obras que sean necesarias para recolectar las aguas\nresiduales de varios desarrollos en el sector de San Felipe, que incluyen al\ncondominio de interés social La Verbena, para trasegar sus aguas hasta el\ncolector Tiribí en funcionamiento. Esta iniciativa será atendida por la Dirección\nde Saneamiento durante el segundo semestre del presente año, siendo que fue\nprogramada dentro del Plan de Trabajo 2026, por lo que se esperaría estar\natendiendo el proyecto ya inscrito ante Mideplan a partir del segundo semestre\ndel 2027”.\n\nTal afirmación se extrae también del informe\ntécnico GG-2026-01065, elaborado con ocasión de este proceso. Vista tal\nmanifestación y con el propósito de garantizar la salud pública y el\nrestablecimiento de los derechos de la parte accionante, este Tribunal gira la\norden respectiva. (…)”",

VCG07/2026\n\n\"(…) III.- On the specific case. In the sub examine, the petitioner (recurrente) states that he is a resident of Condominio La Verbena. He notes that the condominium has suffered from wastewater management problems for years. He affirms that he approached the respondents (accionados). However, the problem has not been resolved.\n\nHaving analyzed the case file, the Court found as proven that, on a date not determined, residents of Condominio La Verbena reported a wastewater management problem to the respondents. In a technical report dated January 9, 2025, prepared in response to letter MS-DRRSCS-ARSAL-1335-2025 from the Ministerio de Salud, ICAA stated: \"V. Conclusions. The northern area of San Felipe de Alajuelita currently has a wastewater sewer system (alcantarillado) that is only capable of providing wastewater collection services, and not the corresponding treatment. Due to the topographic conditions of the area, the water naturally drains to the western bank of the Tiribí River, such that the optimal technical solution is to carry out interconnections with the Tiribí collector, which is located on the eastern bank of that river. The interconnections have been designed, but for their execution it is necessary to register several easements (servidumbres) in the name of AyA. On the banks of the Tiribí River in San Felipe de Alajuelita and Hatillo de San José, social conditions exist that hinder and prevent fieldwork for the registration of easements and the execution of the project. Crime, violence, and the invasion of land through informal settlements (precarios) are the greatest difficulties encountered when carrying out work in the area. Although the PMAAMSJ is active and AyA works continuously to execute the pending works of the project, due to the difficulties encountered in the area and the complexity of its solution, the corresponding works have not been assigned to any works package and no solution is foreseen in either the short or medium term. VI. Recommendations. Restart an outreach process with the institutions involved to determine a program of activities that resolves the problem in the area. If the easement area problem does not appear to have a favorable outlook for a short-term solution, an alternative solution should be evaluated that reduces the area served but succeeds in providing collection services to the majority of the population in the northern area of San Felipe de Alajuelita.\"\n\nBy means of official communication DRyT-OMSR-2025-00715 dated October 9, 2025, ICAA informed the Área Rectora de Salud de Alajuelita: \"In response to a complaint filed with the Contraloría de Servicio del AyA (GESTION REP.CS Nº 3458 2025), it is necessary to report that AyA has been carrying out multiple efforts to mitigate the wastewater problem at Condominio La Verbena, located in San Felipe de Alajuelita. However, the problem currently occurring at the site requires investments to repair the pipes, rehabilitate the discharge point, and maintain the green areas, in order to have access to provide adequate maintenance. These tasks are the responsibility of the condominium owners (condóminos) and AyA cannot allocate public resources to resolve a problem of a private nature, as doing so would constitute a misuse of public funds. For the reasons described above, and given that the Ministerio de Salud is the governmental entity responsible for ensuring the proper use and discharge of waters into the corresponding systems, the case is hereby referred to that ministry for it to analyze the situation and manage the necessary actions within its areas of competence.\"\n\nBy means of technical report IT-MS-DRRSCS-033-2026 dated February 18, 2026, the Ministerio de Salud confirmed the seepage of wastewater at Condominio La Verbena. According to technical report IT-DRRSCS-URS-0211-2026 dated April 24, 2026, from the Ministerio de Salud: \"In the records of wastewater treatment system construction projects kept in the Región Central Sur, there is no evidence of any approved water treatment system at the site. It should be noted that the first version of the Regulation on Approval of Wastewater Treatment Systems, decreto N° 39887-S-MINAE, was decreto Nº 31545-S-MINAE dated October 9, 2003; prior to that date there is no certainty that the Ministerio de Salud had any regulation regarding STAR.\"\n\nPursuant to official communication MS-DSA-UGSA-0452-2026 dated April 30, 2026, from the Environmental Health Management Unit of the Ministerio de Salud: \"CONCLUSIONS • Blockages are confirmed in the inspection chambers (cajas de registro) and the existing system, generating wastewater overflows in various sectors, affecting public health and the environment. • The absence of wastewater treatment at the site is evidenced; despite indications of the existence of a treatment system, it could not be verified because the area is completely inaccessible. Furthermore, there are no official procedures or records regarding the installation or operation of a treatment plant (planta de tratamiento) or any other system, and as a result wastewater is discharged untreated into the adjacent body of water. • There is institutional responsibility on the part of the Instituto Costarricense de Acueductos y Alcantarillados (AyA), an entity that has previously intervened in the area. Drinking water is supplied by that entity and residents indicate and provide evidence that AyA charges for the sanitary sewer service (alcantarillado sanitario), without any evidence of an effective associated treatment system at the site. • The existence of irregular construction at the site is noted, without the corresponding municipal permits; extensions of dwellings, constructions on sidewalks, and other practices are observed, all of which worsen the conditions of the surroundings and reflect a failure to comply with applicable urban planning regulations. • A significant accumulation of solid waste was observed in the northwest sector of the condominium, affecting Public Health and contributing to environmental degradation. RECOMMENDATIONS It is recommended to request the following from the Dirección Regional Rectoría de Salud Central Sur and the Área Rectora de Salud de Alajuelita: • Issue an administrative act to the Instituto Costarricense de Acueductos y Alcantarillados (AyA), requiring it, within 10 working days, to: Execute actions to eliminate blockages and wastewater overflows in the inspection chambers and the existing collector system (sistema colector). • Ensure the adequate operation of the existing collection system. • Submit a technical preventive and corrective maintenance plan to avoid future impacts. • Formally request that AyA submit a remedial plan, with established timelines, responsible parties, and concrete actions, to provide a timely solution for the treatment of wastewater generated at the site, on the basis that it is the entity that supplies drinking water in the area and charges for the sanitary sewer service there. Evaluate the possibility of interconnection with existing systems (e.g., Tiribí collector). • Carry out the necessary coordination with the Municipalidad de Alajuelita for the cleaning and elimination of solid waste accumulations at the site. • Formally refer the case to the Municipalidad de Alajuelita regarding the illegal constructions present at the site, so that the actions to be taken on the matter may be determined.\"\n\nBy means of sanitary orders (órdenes sanitarias) 049-2026 and 050-2026 dated May 11, 2026, the Ministerio de Salud ordered ICAA to: \"• Execute actions to eliminate blockages and wastewater overflows in the inspection chambers and the existing collector system. • Ensure the adequate operation of the existing collection system. • Submit a technical preventive and corrective maintenance plan to avoid future impacts to the Área Rectora de Salud de Alajuelita.\"\n\nBy means of technical report DRyT-OMSR-2026-00246 dated May 2026, ICAA concluded: \"…6. Conclusions 1. Condominio La Verbena was built with a sanitary sewer network and a treatment plant, both of which are the property of the condominium owners. 2. Based on available information, the treatment plant and the sanitary sewer network receive no maintenance, which causes wastewater to spill into the environment without treatment. 3. Given that the treatment plant and the sanitary sewer network are private property belonging to the condominium owners, AyA does not provide resources for their maintenance. 4. In its regulatory oversight (rectoría) role, AyA has been informing the Ministerio de Salud of cases where problems related to wastewater discharge at this condominium are detected. 5. Even if AyA were to develop works that eliminate the need for Condominio La Verbena to have a treatment plant and that facilitate the connection of its wastewater, the operation, safeguarding, and maintenance of the internal network of Condominio La Verbena will remain the responsibility of the condominium owners, as it is private property.\"\n\nBy means of report GG-2026-01065 dated May 12, 2026, ICAA concluded: \"Conclusions • The initiative Saneamiento: Manejo Integral de las aguas residuales en las urbanizaciones de San Felipe de Alajuelita forms part of the institutional portfolio of initiatives identified to address needs in drinking water and sanitation (saneamiento) systems. • It currently holds position 57 out of a total of 176 initiatives, according to the current institutional prioritization. • The initiative is about to be addressed, as it forms part of the 2026 Work Plan proposed by the Sanitation Design Directorate. A case file on the wastewater situation in the sector dating back to 2009 is available. • At present, it is understood that the main cause of spills in the condominium is the improper discharge of wastewater into the stormwater drainage system (alcantarillado pluvial), which is blocked and administered by the Municipalidad. • The future wastewater solution in the San Felipe sector will contemplate the construction of networks, branch extensions, and interconnections that can be carried out and are required, provided they are planned in public areas. • The case of interest presents limitations regarding the construction of works that would allow for a comprehensive solution, due to the legal condominium structure under which the residents of La Verbena are organized, meaning that many of the modifications required internally to convey the water to a single collection point will have to be executed by the condominium owners themselves.\"\n\nFrom the facts set out above, the Court considers it undisputed that the residents of Condominio La Verbena have suffered from poor wastewater management for years, a fact that has been known to the respondent authorities, without their having taken sufficient action to resolve it to date. Accordingly, the appeal is granted.\n\nRegarding the legal consequences of this ruling, from a legal standpoint and based on the reports submitted, the problem must be divided into two spheres. On one hand, there is the management of wastewater within the condominium. On the other, the adequate management and treatment of wastewater outside of it.\n\nRegarding the first point, there is a dispute between the parties as to who must bear responsibility for maintaining the condominium sewer system and resolving the problems it causes. In that regard, ICAA maintains — in summary — that it is private property and therefore public resources cannot be invested in such a sewer system. It also notes that it has not taken over that sewer system, as it has technical deficiencies that prevent such a takeover. For its part, the Ministerio de Salud argues, among other things, that ICAA has at some point charged residents for the sewer service and could therefore assume that responsibility.\n\nOn this point, this Court determines that it does not fall within the jurisdiction of this forum to rule on the legal nature of the condominium sewer system — whether public or private — as this is a matter of legality. For the purposes of this Court, the constitutional relevance of the case lies in the fact that the detected public health problem, which is undisputed, must be resolved. Accordingly, the respondent authorities are ordered to carry out the necessary coordination among themselves and to take the appropriate steps to remedy the identified problem, whether through the issuance of sanitary orders, direct intervention, or other means, provided that the decision is consistent with the law and respects the areas of competence of the authorities involved.\n\nIV.- Regarding the treatment and management of wastewater outside Condominio La Verbena, the Court notes that ICAA reported the following:\n\n\"Currently, the response to the problem in the sector has been recorded under the initiative named 'Manejo Integral de las aguas residuales en las urbanizaciones de San Felipe de Alajuelita,' through which the necessary works are to be carried out to collect wastewater from several developments in the San Felipe sector — including the social-interest condominium La Verbena — and convey it to the operational Tiribí collector. This initiative will be addressed by the Sanitation Directorate during the second half of this year, having been programmed within the 2026 Work Plan, and it is expected that work on the project already registered with Mideplan will begin in the second half of 2027.\"\n\nThis statement is also drawn from technical report GG-2026-01065, prepared in the course of these proceedings. In view of this statement and with the aim of guaranteeing public health and the restoration of the rights of the petitioning party (accionante), this Court issues the corresponding order. (…)\""
