SE OBLIGA SU CUMPLIMIENTO EN EL PLAZO DE DOS MESES. VCG07/2026\n\n“(…) III.- Sobre el caso concreto. En el sub lite, los\nrecurrentes manifiestan que el 7 de enero de 2022 se publicó en la Gaceta nro.\n3, Alcance nro. 3, la ley nro. 10086, denominada “Ley de Promoción y Regulación\nde Recursos Energéticos Distribuidos a partir de Fuentes Renovables”. Señalan\nque dicha ley desarrolla el artículo 50 de la Constitución Política,\ndirigiéndose al estímulo de la producción de energía eléctrica, como un medio\npara el aumento del potencial económico del país. Indican que dentro de la normativa\nen cuestión se establecieron las siguientes disposiciones transitorias:\n“TRANSITORIO I- La Aresep tendrá un plazo no superior a seis meses, contado a\npartir de la publicación de la presente ley, para aprobar y tener vigente las\ntarifas correspondientes a servicios auxiliares. TRANSITORIO II- La Aresep\ntendrá un plazo no superior a doce meses, contado a partir de la publicación de\nla presente ley, para fijar las tarifas y los instrumentos regulatorios que\nsean necesarios para la adecuada integración de los recursos energéticos\ndistribuidos que se interconecten a las redes del SEN”. Sin embargo, reclaman\nque pese a que el plazo señalado ha sido superado la autoridad recurrida no ha\ndictado las tarifas y regulaciones para el intercambio de servicios auxiliares.\nConsidera que lo anterior provoca una restricción o barrera de entrada al\nmercado lo que vulnera sus derechos fundamentales. Solicitan la intervención de\nla Sala.\n\nAl respecto, del análisis del informe rendido bajo\njuramento por parte de la autoridad recurrida -con las consecuencias, incluso\npenales, que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional-\nse desprende que la ley nro. 10086 representa un cambio de paradigma en la\narquitectura del Sistema Eléctrico Nacional, por tal razón su implementación\nexige que la ARESEP un ejercicio de ponderación técnica y jurídica. En ese\nsentido, dicha normativa contiene las siguientes disposiciones transitorias -reclamadas\npor los recurrentes-:\n\n“TRANSITORIO I- La Aresep tendrá un plazo no superior a\nseis meses, contado a partir de la publicación de la presente ley, para aprobar\ny tener vigente las tarifas correspondientes a servicios auxiliares.\n\nTRANSITORIO II- La Aresep tendrá un plazo no superior a\ndoce meses, contado a partir de la publicación de la presente ley, para fijar\nlas tarifas y los instrumentos regulatorios que sean necesarios para la\nadecuada integración de los recursos energéticos distribuidos que se\ninterconecten a las redes del SEN”.\n\nSin embargo, a pesar de que los plazos señalados en las\ndisposiciones transitorias han sido sobradamente superados, las tarifas y los\ninstrumentos regulatorios para la adecuada integración de los recursos\nenergéticos distribuidos que se interconecten a las redes del Sistema Eléctrico\nNacional se encuentran pendientes de elaboración por parte de la ARESEP.\n\nAhora bien, en el presente caso, los recurrentes alegan\nuna afectación ante la omisión por parte de la ARESEP en cumplir con las\ndisposiciones transitorias. Exponen que son presidentes y representantes\nlegales de las siguientes sociedades: Materiales Electromecánicos Padilla S.\nA., Alquiler de Equipo para la Construcción Alco S. A. y Hidromundo Tecnológico\nSociedad S. A. Fundamentan la interposición de este recurso de amparo en que la\nley nro. 10086 se trata de una disposición legal que desarrolla el artículo 50\nde la Constitución Política, dirigiéndose al estímulo de la producción de\nenergía eléctrica, como un medio para el aumento del potencial económico del\npaís. Explican que se busca integrar las capacidades económicas y empresariales\ndel sector privados, en dirección hacia el objetivo de creación de bienestar\npara la colectividad, por lo que se está ante la figura de la actividad de\nfomento del Estado dirigida a estimular la iniciativa de los particulares para\nobtener mínimos de seguridad jurídica y económica. Por lo anterior, son\nenfáticos en reclamar que ante la omisión de la ARESEP se les impide tomar\ndecisiones en materia de la producción y prestación de ese objeto, siendo total\nla incertidumbre económica y la parálisis empresarial. Expresamente indican:\n\n“Sin fijación de tarifa no puede operar el mercado y\nsin regulación no pueden pactarse transacciones, por dos motivos fundamentales:\nA. Porque de acuerdo con el texto de la ley, la relación contractual aplicable\na la negociación de servicios auxiliares se ejecuta por medio del contrato de\ncompraventa y para que este se perfeccione es necesario que las partes\nconvengan en cosa y precio, tal como lo exige el artículo 1049 del Código\nCivil. B. Porque cualquier compraventa de servicios auxiliares que se ejecute\ncon precio diverso al fijado o autorizado por la ARESEP, expone a los\ncontratantes a una multa en los términos del artículo 38 de la Ley número 7593;\no sea los particulares incurrirían en una conducta ilegítima”.\n\nEn virtud de lo expuesto, los recurrentes exponen que\nla omisión del ARESEP en cumplir las disposiciones establecidas en la ley nro.\n10086 lesiona los artículos 46 y 50 constitucionales, en detrimento del\ndesarrollo de las empresas que pretenden dedicarse a la producción de recursos\nenergéticos distribuidos basados en fuentes de energía renovables y de la\ntutela del ambiente.\n\nEl artículo 49 párrafo segundo de la Ley de la\nJurisdicción Constitucional permite analizar por la vía del amparo la omisión\ndel Poder Ejecutivo de reglamentar o hacer cumplir lo dispuesto por una norma,\ncuando dicha inactividad guarde relación con la tutela de un derecho\nfundamental. De ahí que resulta pertinente el análisis de fondo en esta vía\n(ver en ese sentido la sentencia nro. 2026-011637 de las 13:05 horas del 27 de\nmarzo de 2026).\n\nAsí las cosas, si bien del análisis del informe de la\nautoridad recurrida se observan las distintas acciones que se han ejecutado por\nparte del ARESEP para dar cumplimiento a las disposiciones transitorias de la\nley nro. 10086, no menos cierto es que ha transcurrido un plazo\ndesproporcionado, con el agravante de que persiste la incertidumbre y la\ninseguridad alegada por los recurrentes. Tómese en cuenta que desde el 7 de\njulio de 2022 venció el plazo señalado en el transitorio I y desde el 7 de\nenero de 2023 venció el plazo dispuesto en el transitorio II. Por tal razón, se advierte una inactividad\nsusceptible de control jurisdiccional por la vía del amparo, conforme a lo\ndispuesto en el párrafo segundo del artículo 49 de la Ley de la Jurisdicción\nConstitucional, en tanto persiste un incumplimiento parcial del mandato\nlegislativo contenido en la ley nro. 10086. Nótese que, esta normativa se\nencuentra dirigida a promover la incorporación progresiva de recursos energéticos\ndistribuidos basados en fuentes renovables, bajo condiciones de integración\neficiente, segura y sostenible dentro del Sistema Eléctrico Nacional, mediante\nla creación de instrumentos regulatorios y tarifarios destinados a viabilizar\nel acceso, instalación, conexión, interacción y control de este tipo de\ntecnologías. Bajo esa lógica, la ausencia de una implementación integral y\noportuna de los mecanismos regulatorios previstos en la ley trasciende el\námbito estrictamente técnico o tarifario, pues incide directamente sobre la\neficacia del modelo normativo diseñado por el legislador para favorecer\nesquemas de generación eléctrica ambientalmente sostenibles. Precisamente en\nmateria ambiental, el Estado no solo se encuentra obligado a reaccionar frente\na daños ya consumados, sino también a desplegar actuaciones oportunas y\neficaces orientadas a evitar, reducir o controlar riesgos de afectación,\nconforme a los principios preventivo y precautorio que informan el contenido\ndel artículo 50 de la Constitución Política. Dichos principios imponen a los poderes\npúblicos deberes de actuación anticipada frente a escenarios en los cuales la\nausencia o postergación de medidas estatales puede comprometer la consolidación\nde mecanismos dirigidos a favorecer modelos de desarrollo ambientalmente\nsostenibles, como ocurre en el presente asunto con la implementación del\nrégimen normativo orientado a promover la integración de recursos energéticos\ndistribuidos basados en fuentes renovables. Desde esa perspectiva, la\nimplementación efectiva del régimen previsto en la ley nro. 10086 constituye\nuna herramienta orientada a fortalecer procesos de transición energética,\ndescarbonización, diversificación de fuentes renovables y aprovechamiento\nracional de recursos energéticos, de manera que una postergación indefinida de\nlos instrumentos tarifarios y regulatorios necesarios para su operatividad\ntermina debilitando la eficacia de mecanismos legislativos creados precisamente\npara avanzar hacia modelos energéticos compatibles con sostenibilidad\nambiental. Tal situación, además, genera incertidumbre respecto de las\ncondiciones bajo las cuales los distintos actores económicos pueden desarrollar\nactividades vinculadas con generación distribuida renovable, con incidencia\ntambién sobre la libertad de empresa y comercio.\n\nFinalmente, respecto de las dificultades referidas por\nel regulador, llevan razón los recurrentes al manifestar que la ARESEP ostenta\npotestades para obligar a las entidades reguladas a suministrar información\noportuna, tal como lo establece el artículo 24 de la ARESEP:\n\n“Artículo 24.- Suministro de información\n\nA solicitud de la Autoridad Reguladora, las entidades\nreguladas suministrarán informes, reportes, datos, copias de archivos y\ncualquier otro medio electrónico o escrito donde se almacene información\nfinanciera, contable, económica, estadística y técnica relacionada con la\nprestación del servicio público que brindan. Para el cumplimiento exclusivo de\nsus funciones, la Autoridad Reguladora tendrá la potestad de inspeccionar y\nregistrar los libros legales y contables, comprobantes, informes, equipos y las\ninstalaciones de los prestadores”.\n\nDe la lectura de la norma transcrita se desprende que\nla ARESEP tiene las suficientes potestades para requerir e inspeccionar la\ninformación necesaria con el fin de emitir cualquier reglamento técnico.\n\nEn consecuencia, se declara con lugar el recurso con\nlas consecuencias que se indican en la parte dispositiva de este\npronunciamiento. (…)”",

COMPLIANCE ORDERED WITHIN A TWO-MONTH PERIOD. VCG07/2026\n\n\"(…) III.- On the Specific Case. In the sub lite, the appellants state that on January 7, 2022, law no. 10086, entitled \"Ley de Promoción y Regulación de Recursos Energéticos Distribuidos a partir de Fuentes Renovables,\" was published in Gaceta no. 3, Supplement no. 3. They state that this law implements Article 50 of the Political Constitution, aiming to stimulate the production of electric power as a means to increase the country's economic potential. They indicate that the legislation in question established the following transitional provisions: \"TRANSITORIO I – ARESEP shall have a period not exceeding six months, counted from the date of publication of this law, to approve and put into effect the tariffs corresponding to ancillary services (servicios auxiliares). TRANSITORIO II – ARESEP shall have a period not exceeding twelve months, counted from the date of publication of this law, to set the tariffs and regulatory instruments (instrumentos regulatorios) necessary for the adequate integration of the distributed energy resources that interconnect with the networks of the SEN.\" However, the appellants claim that, despite the expiration of the aforementioned deadlines, the respondent authority has not issued the tariffs and regulations for the exchange of ancillary services. They consider that this situation creates a restriction or barrier to market entry that violates their fundamental rights. They request the intervention of the Chamber.\n\nIn this regard, an analysis of the sworn report submitted by the respondent authority — with the consequences, including criminal ones, provided for in numeral 44 of the Ley de la Jurisdicción Constitucional — reveals that law no. 10086 represents a paradigm shift in the architecture of the National Electric System (Sistema Eléctrico Nacional), and that for this reason its implementation requires ARESEP to engage in a technical and legal balancing exercise. In that regard, this legislation contains the following transitional provisions — as claimed by the appellants —:\n\n\"TRANSITORIO I – ARESEP shall have a period not exceeding six months, counted from the date of publication of this law, to approve and put into effect the tariffs corresponding to ancillary services.\n\nTRANSITORIO II – ARESEP shall have a period not exceeding twelve months, counted from the date of publication of this law, to set the tariffs and regulatory instruments necessary for the adequate integration of the distributed energy resources that interconnect with the networks of the SEN.\"\n\nNevertheless, despite the fact that the deadlines set forth in the transitional provisions have been substantially exceeded, the tariffs and regulatory instruments for the adequate integration of the distributed energy resources that interconnect with the networks of the National Electric System remain pending elaboration by ARESEP.\n\nNow, in the present case, the appellants allege harm arising from ARESEP's failure to comply with the transitional provisions. They state that they are presidents and legal representatives of the following companies: Materiales Electromecánicos Padilla S. A., Alquiler de Equipo para la Construcción Alco S. A., and Hidromundo Tecnológico Sociedad S. A. They ground the filing of this writ of amparo (recurso de amparo) in the fact that law no. 10086 is a legal provision that implements Article 50 of the Political Constitution, aiming to stimulate the production of electric power as a means to increase the country's economic potential. They explain that the law seeks to integrate the economic and business capacities of the private sector toward the goal of creating well-being for the community as a whole, and that what is at stake is the figure of state promotional activity (actividad de fomento del Estado) directed at stimulating private initiative in order to attain minimum levels of legal and economic certainty. For this reason, they emphatically claim that ARESEP's failure to act prevents them from making decisions regarding the production and provision of the subject matter of the law, resulting in total economic uncertainty and business paralysis. They expressly state:\n\n\"Without a tariff, the market cannot operate, and without regulation, transactions cannot be agreed upon, for two fundamental reasons: A. Because, pursuant to the text of the law, the contractual relationship applicable to the negotiation of ancillary services is executed by means of a purchase-and-sale agreement, and for this agreement to be perfected the parties must agree on the subject matter and price, as required by Article 1049 of the Código Civil. B. Because any purchase-and-sale of ancillary services carried out at a price other than that set or authorized by ARESEP exposes the contracting parties to a fine under the terms of Article 38 of Ley número 7593; that is, the private parties would be engaging in unlawful conduct.\"\n\nIn light of the foregoing, the appellants argue that ARESEP's failure to comply with the provisions established in law no. 10086 violates constitutional Articles 46 and 50, to the detriment of the development of the companies that seek to engage in the production of distributed energy resources based on renewable energy sources and of environmental protection.\n\nThe second paragraph of Article 49 of the Ley de la Jurisdicción Constitucional allows the failure of the Executive Branch to regulate or enforce the provisions of a statute to be reviewed by way of the writ of amparo when such inaction is related to the protection of a fundamental right. Therefore, a substantive analysis on this ground is appropriate (see, in this regard, judgment no. 2026-011637 of 13:05 hours on March 27, 2026).\n\nThat being said, while an analysis of the report submitted by the respondent authority reveals the various steps taken by ARESEP to comply with the transitional provisions of law no. 10086, it is equally true that a disproportionate period of time has elapsed, with the aggravating factor that the uncertainty and legal insecurity alleged by the appellants persist. It should be noted that the deadline set forth in TRANSITORIO I expired on July 7, 2022, and the deadline set forth in TRANSITORIO II expired on January 7, 2023. For this reason, a failure to act susceptible to judicial review by way of the writ of amparo is identified, pursuant to the second paragraph of Article 49 of the Ley de la Jurisdicción Constitucional, insofar as there remains a partial failure to comply with the legislative mandate contained in law no. 10086. It should be noted that this legislation is aimed at promoting the progressive incorporation of distributed energy resources based on renewable sources, under conditions of efficient, safe, and sustainable integration within the National Electric System, through the creation of regulatory and tariff instruments designed to enable the access, installation, connection, interaction, and control of this type of technology. Under this logic, the absence of full and timely implementation of the regulatory mechanisms provided for in the law goes beyond the strictly technical or tariff sphere, as it directly affects the efficacy of the normative model designed by the legislature to favor environmentally sustainable electricity generation schemes. Precisely in environmental matters, the State is not only obligated to respond to damages already sustained, but also to deploy timely and effective actions aimed at preventing, reducing, or controlling risks of harm, in accordance with the preventive and precautionary principles that inform the content of Article 50 of the Political Constitution. These principles impose on public authorities duties of anticipatory action in scenarios where the absence or deferral of state measures may compromise the consolidation of mechanisms aimed at favoring environmentally sustainable development models, as occurs in the present matter with the implementation of the regulatory regime oriented toward promoting the integration of distributed energy resources based on renewable sources. From this perspective, the effective implementation of the regime provided for in law no. 10086 constitutes a tool aimed at strengthening energy transition processes, decarbonization, diversification of renewable sources, and the rational use of energy resources, such that an indefinite postponement of the tariff and regulatory instruments necessary for its operation ultimately weakens the efficacy of legislative mechanisms created precisely to advance toward energy models compatible with environmental sustainability. This situation, moreover, generates uncertainty regarding the conditions under which the various economic actors may develop activities linked to renewable distributed generation, with an impact as well on freedom of enterprise and commerce.\n\nFinally, regarding the difficulties cited by the regulator, the appellants are correct in pointing out that ARESEP holds the authority to compel regulated entities to provide timely information, as established in Article 24 of the ARESEP [law]:\n\n\"Article 24.- Supply of Information\n\nAt the request of the Regulatory Authority, regulated entities shall provide reports, data, copies of files, and any other electronic or written medium containing financial, accounting, economic, statistical, and technical information related to the provision of the public service they render. For the exclusive fulfillment of its functions, the Regulatory Authority shall have the authority to inspect and examine the legal and accounting books, vouchers, reports, equipment, and facilities of the service providers.\"\n\nFrom a reading of the quoted provision, it is clear that ARESEP has sufficient authority to request and inspect the information necessary for the purpose of issuing any technical regulation.\n\nConsequently, the writ of amparo is granted, with the consequences set forth in the operative part of this ruling.
