SE ACUSA EL INCUMPLIMIENTO DE ÓRDENES SANITARIAS Y LA FALTA DE COORDINACIÓN ENTRE EL MINISTERIO DE SALUD, EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS Y LA MUNICIPALIDAD DE UPALA, PARA ATENDER LA PROBLEMÁTICA DE AGUAS RESIDUALES EN LA URBANIZACIÓN DON CHÚ DE UPALA. SE CONSIDERA NECESARIO GARANTIZAR LA PROTECCIÓN DE LA SALUD Y LA SALUBRIDAD PÚBLICA DE LAS PERSONAS HABITANTES DEL LUGAR. SE DECLARA CON LUGAR Y SE ORDENA BRINDAR UNA SOLUCIÓN INTEGRAL Y DEFINITIVA EN SEIS MESES. VCG07/2026\n\n“(…) VII.- Sobre el fondo. Después de analizar los\nelementos probatorios aportados, este Tribunal verifica la violación a los\nderechos fundamentales de los amparados. Lo anterior, porque en los informes\nrendidos por los representantes de las autoridades recurridas -que se tiene por\ndado bajo fe de juramento con las consecuencias, incluso penales, previstas en\nel artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para\nla resolución del asunto, ha sido debidamente acreditado que la Urbanización\nDon Chú es una Urbanización de Bien Social compuesta por 240 viviendas, ubicada\nen el Distrito primero del cantón de Upala, Alajuela. Mediante informe\nMS-DRRCH-URS-IT-0147-20 del 17 de diciembre de 2020, la Unidad de Rectoría de\nla Salud de la Región de Chorotega del Ministerio de Salud le comunicó al Área\nRectora de Salud de Upala lo siguiente: “(…) se concluye que las aguas\nresiduales en su mayoría aguas servidas provenientes de piletas de lavado,\nlavadora y duchas de las viviendas que conforma la Urbanización Don Chú son\ndescargadas a los caños públicos y desfogadas a la alcantarilla pluvial\nprovocando contaminación ambiental y riesgo a la salud pública. (…) Además, se\nperciben olores muy desagradables desde la acera y carretera (…)”. El 26 de\nfebrero de 2021, el Área de Salud de Upala emitió la orden sanitaria no.\nARS-U-OS-028-2021, en donde le ordenó al alcalde de la Municipalidad de Upala\nlo siguiente: “1. Presentar ante el Área Rectora de Salud de Upala un plan de\nacciones correctivas para la instalación y funcionamiento de un sistema de\ntratamiento de aguas residuales con capacidad optima, que brinde una solución\nintegral al problema de las aguas residuales que presenta la Urbanización Don\nChú, ubicada en el distrito primero del cantón de Upala. Dicho plan deberá\nadjuntar un cronograma de las actividades a realizar y el plazo de ejecución de\nestas, detallando fechas de inicio y final de cada actividad y el responsable\nde su ejecución. 2. El diseño, la instalación y el funcionamiento del sistema\nde tratamiento de aguas residuales deberá realizarse acatando la normativa\ntécnica vigente, contando con los respectivos permisos y autorizaciones de las\ninstituciones competentes, según sea el caso”. Fecha de notificación: 01 de\nmarzo de 2021; fecha de vencimiento: 27 de mayo de 2021. El 26 de febrero de\n2021, el Área de Salud de Upala emitió la orden sanitaria no.\nARS-U-OS-029-2021, en donde le ordenó al presidente del Concejo de la\nMunicipalidad de Upala lo siguiente: “1. Dicho plan deberá adjuntar un cronograma de las\nactividades a realizar y el plazo de ejecución de estas, detallando fechas de\ninicio y final de cada actividad y el responsable de su ejecución. 2. El\ndiseño, la instalación y el funcionamiento del sistema de tratamiento de aguas\nresiduales deberá realizarse acatando la normativa técnica vigente, contando\ncon los respectivos permisos y autorizaciones de las instituciones competentes,\nsegún sea el caso”. Fecha de notificación: 01 de marzo de 2021; fecha de\nvencimiento: 27 de mayo de 2021. Mediante oficio no. PRE-2021-00617 del 24 de\nmayo de 2021, el presidente ejecutivo del Instituto Costarricense de Acueductos\ny Alcantarillados le comunicó al Área de Salud de Upala y a la Municipalidad de\nUpala que en el año 2010 se presentó a la Municipalidad de Upala el documento\n“Plan Maestro para los Sistemas de Abastecimiento de Agua y Saneamiento de\nUpala, Alajuela”, que debía ser ejecutado por la Municipalidad, como ente\noperador público autorizado dentro del cantón en un plazo de 10 años; ese plazo\nfue superado y costaba en ese momento 4,5 millones de dólares. Ese mismo\ndocumento indica los pasos que debe seguir el municipio para comenzar el\nproyecto y el AyA asesoraría el proceso. Mediante oficio no. DAMU-0400-05-2021\ndel 26 de mayo de 2021, la alcaldesa de la Municipalidad de Upala le solicitó\nal Área Rectora de Salud de Upala una prórroga a la orden sanitaria\nARS-U-OS-030-2021 (sic). Mediante oficio MS-DRRSCH-DARSU-421-2021 del 08 de\njunio de 2021, el Área de Salud de Upala le comunicó a la alcaldesa de la\nMunicipalidad de Upala que “concede la prórroga por treinta días a partir del 28\nde mayo de 2021”. Lo anterior, le fue comunicado a la Municipalidad de Upala el\n10 de junio de 2021. El 09 de febrero de 2022, en el Área de Salud de Upala se\nrecibió nota sin número de oficio suscrito por el señor Gerardo Fonseca Obando\ny firmado por vecinos de la Urbanización Don Chú, manifestando el problema de\ncontaminación en los caños por aguas residuales, falta de mantenimiento por\nparte de la municipalidad y malos olores; para que se realizara lo necesario\npara eliminar el problema. Mediante oficio MS-DRRSCH-DARSU-057-2022 del 17 de\nfebrero de 2022, la directora del Área de Salud de Upala les comunicó a los\nvecinos denunciantes que trasladará la denuncia a la Municipalidad de Upala. El\n19 de junio de 2023, la Municipalidad de Upala le comunicó al Área Rectora de\nSalud Upala el oficio no. DAMU-0496-06-2021, en donde se indica lo siguiente:\n“(…) se requiere de una solución integral que contemple un sistema que\nrecolecte, conduzca y trate las aguas residuales, y no únicamente un sistema de\ntratamiento. Además, no solo se necesita esta solución integral en el barrio\nDon Chu sino en todo el centro urbano de Upala. Se visualizó que la conducción\nde las aguas residuales que, deberían ser pluviales, salen de lo interno de las\nviviendas hacia el sistema de conducción de las aguas llovidas, lo cual\nimposibilita a la Municipalidad realizar una intervención con presupuesto\npropio para revertir esta situación (…) Conforme al punto 2 en el oficio\nPRE-2021-00617 del 24 de mayo de 2021, el AyA explica el proceso de planeación,\nel cual conlleva una serie de fases para dar resultado a un Plan Maestro para\nun sistema de saneamiento de aguas residuales en el centro de Upala (…) 4.\nFinalmente, con el fin de cumplir con lo solicitado en la Orden sanitaria, se\nincluye un Plan de acción que incorpora medidas atinentes a propiciar una\nmejora en el tratamiento de las aguas residuales a lo interno de las viviendas\ncon su respectiva fecha de ejecución, pero también incorpora a solicitud de los\nhabitantes del Barrio Don Chu, un plan de intervención urbana que involucre la\nparticipación ciudadana y presupuesto municipal”. Mediante oficio técnico de\ninspección no. RCH-ARSU-ERS-IT-271-2024 del 19 de marzo de 2024, el Equipo\nRegulación de la Salud del Área Rectora de Salud de Upala le comunicó a la\ndirectora de esa Área de Salud, lo siguiente: “En fecha 18 de marzo de 2024 se\nconvoca a funcionarios del Área Rectora de Salud de Upala a participar en una\nreunión con funcionarios de la Municipalidad de Upala para tratar el tema. En\ndicha reunión se hizo un resumen de la problemática, se trató el tema del\ncumplimiento del plan de acción que en su momento entregó la Municipalidad de\nUpala en el Oficio DAMU-0496-06-2021, y los problemas que tiene la\nadministración en la construcción de una planta de tratamiento de aguas\nresiduales para la urbanización, ya que dicho problema existe básicamente en\ntodo el distrito central y no se cuenta con un presupuesto lo suficientemente\ngrande para la construcción de una planta de tratamiento. Además, se acordó lo\nsiguiente: 1. La Municipalidad conformará la comisión o equipo técnico para\ntratar el tema. 2. Conformada la comisión se actualizará el plan de acción. 3.\nLa Municipalidad solicitará al Ministerio de Salud prórroga para el\ncumplimiento del plan de acción actualizado. 4. Con la colaboración del\nMinisterio de Salud, se creará material informativo para distribuirlo a la\npoblación. 5. Se debe convocar a los encargados del tema en el Instituto\nCostarricense de Acueductos y Alcantarillados (AyA) para que brinden asesoría\ntécnica y cualquier colaboración pertinente. 6. Todo esto se realizará en el\ncorto plazo. 7. El Área Rectora de Salud Upala deberá brindar seguimiento a las\ngestiones y acciones realizadas por la comisión. Tanto la Municipalidad de\nUpala como el AyA cumplieron con las órdenes sanitarias ARS-U-OS 2021,\nARS-U-OS-029-2021 y ARS-U-OS-030-2021, ya que ambas instituciones presentaron\nante el Área Rectora de Salud de Upala lo ordenado en las mismas. Sin embargo,\nno se ha dado cumplimiento del plan de acción propuesto (…) 8. CONCLUSIÓN Aún no se cuenta con una\nsolución integral al problema de aguas residuales existente en la Urbanización\nDon Chú, por lo que las aguas residuales (principalmente grises) son desfogadas\nal cordón de caño sin ningún tratamiento. La Municipalidad de Upala ha\nrealizado algunas acciones establecidas en un plan de acción, sin embargo,\ndicho plan debe actualizarse, conformar la comisión o equipo técnico y\ncontinuar con las gestiones correspondientes y contando con la colaboración del\nAyA. 9. RECOMENDACIONES AL ÁREA RECTORA DE SALUD DE SALUD. La dirección de Área\nRectora de Salud Upala deberá brindar seguimiento al plan de acción actualizado\nque presente la Municipalidad de Upala, el cual deberá realizarse en un corto\nplazo con el fin de obtener una solución integral al problema de aguas\nresiduales de la Urbanización Don Chú (…)”.\n\n \n\nDe lo anterior, se denota que, de dicha reunión por\nparte del Ministerio de Salud, se evidencia que tanto la Municipalidad de\nUpala, como el ICAA cumplieron en parte con las órdenes sanitarias\nARS-U-OS-028-2021, ARS-U-OS-029-2021 y ARS-U-OS-030-2021, ya que ambas\ninstituciones presentaron ante el Área Rectora de Salud de Upala lo ordenado en\nlas mismas. Sin embargo, no se ha dado cumplimiento del plan de acción\npropuesto y así brindar una solución integral al problema de aguas residuales\nde la Urbanización Don Chú.\n\n \n\nPor otra parte, mediante oficio técnico de inspección\nno. RCH-ARSU-ERS-IT-029-2025 del 20 de enero de 2025, el Equipo Regulación de\nla Salud del Área Rectora de Salud de Upala le comunicó a la directora de esa\nÁrea de Salud, lo siguiente: “Brindar seguimiento al plan de acciones\ncorrectivas presentado por funcionarios de la Municipalidad en oficios\nDAMU-0496-06-2021 y DCU-OF-013-2024 (…) \nFecha de inspección: 15 de enero de 2025. 6. RESULTADOS DE LA INSPECCION\n(HALLAZGOS) (…) Según el expediente administrativo e información de los\nfuncionarios municipales se indica lo siguiente: 1. La Municipalidad conformó\nuna comisión o equipo técnico para tratar el tema, sin embargo, no se ha\ninformado oficialmente quienes lo conforman y las acciones realizadas. 2. No se\nha actualizado el plan de acción. 3. No se solicitó la prórroga al Ministerio\nde Salud para el cumplimiento del plan de acción actualizado. (…) 5. No se ha\nconvocado a los encargados del tema en el Instituto Costarricense de Acueductos\ny Alcantarillados (AyA) para que brinden asesoría técnica y cualquier\ncolaboración pertinente a la Municipalidad. En general no se ha cumplido con\nlos acuerdos tomados en la reunión del pasado 18 de marzo de 2024, por lo\ntanto, se incumple el plan de acciones correctivas presentado en los oficios\nDAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias\nARS-U-OS-028-2021 y ARS-U-OS-029-2021 (…) 8. CONCLUSIÓN Aún no se cuenta con\nuna solución integral al problema de aguas residuales existente en la\nUrbanización Don Chú, por lo que las aguas residuales (principalmente grises)\nson desfogadas al cordón de caño sin ningún tratamiento. De esta forma se\nincumple con el plan de acciones correctivas presentado en los oficios\nDAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias\nARS-U-OS-028-2021 y ARS-U-OS-029-2021. 9. RECOMENDACIONES AL ÁREA RECTORA DE\nSALUD DE SALUD. La dirección de Área Rectora de Salud Upala deberá hacer la\nrespectiva consulta ante niveles superiores del Ministerio de Salud para que se\ndeterminen las acciones a seguir en este caso, por el incumplimiento reiterado\ndel plan de acciones correctivas según las órdenes sanitarias ARS-U-OS-028-\n2021 y ARS-U-OS-029-2021”. Mediante oficio no. MS-DRRSCH-DARSU-0092-2025 del 26\nde febrero de 2025, el Área de Salud de Upala le comunicó a la alcaldesa de la\nMunicipalidad de Upala lo siguiente: “(…) En el seguimiento realizado por el\nequipo de regulación de la salud, se evidencia no se ha cumplido con los\nacuerdos tomados en la reunión del pasado 18 de marzo de 2024, por lo tanto, se\nincumple el plan de acciones correctivas presentado en los oficios\nDAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias\nARS-U-OS-028-2021 y ARS-U-OS-029-2021. A la actualidad, no se cuenta con una\nsolución integral al problema de aguas residuales existente en la Urbanización\nDon Chú, por lo que las aguas residuales (principalmente grises) son desfogadas\nal cordón de caño sin ningún tratamiento. De esta forma se incumple con el plan\nde acciones correctivas presentado en los oficios DAMU-0496-06-2021 y\nDCU-OF-013-2024, según las órdenes sanitarias ARS-U-OS-028-2021 y\nARS-U-OS-029-2021. Por lo anterior, se estará elevando el caso a niveles\nsuperiores para su respectiva valoración y lo que corresponda”. Lo anterior, le\nfue comunicado a la Municipalidad de Upala el 07 de marzo de 2025. Mediante\nCARTA-MS-DRRSCH-DARSU-0118-2025 del 18 de marzo de 2025, el Área Rectora de\nSalud de Upala le comunicó a la Dirección Regional de Chorotega del Ministerio\nde Salud lo siguiente: “Traslado informe técnico indicado en el asunto. Se\ntraslada para valoración y criterio sobre acciones a seguir, ya que desde el\n2021 que se giraron dichas ordenes sanitarias y a pesar de acercamientos,\nseguimiento y acuerdos, la municipalidad de Upala no ha cumplido en tiempo y\nforma, por lo que actualmente no se cuenta con una solución integral al\npreocupante problema de aguas residuales de la comunidad Don Chu. Agradecemos\nuna pronta intervención”. Mediante informe MS-DRRSCH-URS-IT-14-2025 (respuesta\na CARTA MS-DRRRSCH-DARSU-0018-20225) del 27 de marzo de 2025, los\nrepresentantes de la Unidad de Rectoría de la Salud de la Región Chorotega\nestablecieron lo siguiente: “(…): a. Hasta la fecha evidentemente se encuentra\nun incumplimiento al plan de acciones correctivas presentado por la\nMunicipalidad de Upala y además, un incumplimiento a los acuerdos tomados en la\nreunión presencial del 18 de marzo con la Municipalidad (…) El problema sobre\nla descarga ilegal de aguas residuales en la vía pública de la Urbanización Don\nChu en Upala no se ha resuelto, afectando la salud pública. 7. CONCLUSIÓN Y\nRECOMENDACIONES (…) se concluye que la ordenes sanitarias ARS-U-OS-028-2021 y\nARS-U-OS-029-2021 no se han cumplido a cabalidad, dejando sin resolver la\nproblemática de salud pública que representa la descarga de aguas residuales a\nla vía pública provenientes de la Urbanización Don Chú en Upala”. El 24 de\nabril 2025 se realiza reunión con la Licda. Laura Rodríguez, coordinadora del\nproceso de regulación de la Salud del nivel regional Chorotega y funcionarios\ndel Área Rectora de salud Upala y Municipalidad de Upala, donde nuevamente se\ninstruye en los temas de seguimiento y documentación de las acciones,\nimportancia de la comisión interinstitucional, la elaboración de un plan\nmaestro, aspectos legales y servidumbres y la coordinación de expedientes y\ncomunicaciones entre instituciones. Además, se llega al acuerdo que la\nMunicipalidad de Upala remitiría un informe detallado a más tardar 05 de junio\n2025, con la conformación oficial de la Comisión Interinstitucional de Aguas\nResiduales del cantón de Upala, con participación de representantes de la\nMunicipalidad (líder del proceso), A Y A, y Ministerio de Salud (nivel regional\ny local), y que incluyera las acciones concretas con respecto a dicha\nproblemática. Mediante oficio no. MU-ALM-OFIC-853-2025 del 04 de junio de 2025,\nla alcaldesa de la Municipalidad de Upala le solicitó al Área Rectora de Salud\nde Upala “prórroga de la orden sanitaria ARS-U-OS-028-2021, con el fin de\nactualizar el plan de acción y poder continuar con el proceso en tiempo y en\nforma”. Mediante oficio no. CARTA-MS-DRRSCH-DARSU-0224-2025 del 10 de junio de\n2025, el Área Rectora de Salud de Upala le comunicó a la alcaldesa de la\nMunicipalidad de Upala lo siguiente: “En atención a su solicitud, (…) le\ninformamos que no es posible otorgar una prórroga para una orden cuyo plazo ha\nvencido y por las siguientes razones (…) se explicó que la orden sanitaria\nARS-U-OS-028-2021 se considera cumplida en cuanto a la presentación del Plan de\nAcciones. Sin embargo, se dejó claro que las acciones ejecutadas han sido\nmínimas, y que la problemática de salud pública persiste, ya que no se han\nimplementado soluciones concretas (…) Dado lo anterior, la solicitud de\nprórroga no procede. No obstante, quedamos atentos a la presentación del\ninforme acordado en la reunión del 24 de mayo de 2025 solicitado por el nivel\nregional”. Mediante oficio no. MU-GJ-CL-18-2025 del 12 de junio de 2025, el\ngestor jurídico de la Municipalidad de Upala le comunicó a la coordinadora de\nDesarrollo Territorial de esa misma municipalidad lo siguiente: “Asunto:\nCriterio legal respecto referente a la orden sanitaria ARS-U-OS-028-2021 del\nMinisterio de Salud, a solicitud mediante oficio MU-CTE-OFIC-004-2025 (…) IV.\nRECOMENDACIÓN. Con fundamento en la normativa citada y conforme al principio de\nlegalidad, la Municipalidad de Upala tiene la obligación de cumplir aquellas\nordenes sanitarias interpuestas por el Ministerio de Salud que sean acordes con\nlas competencias Municipales, el marco jurídico costarricense establece que las\nMunicipalidades son responsables de construir y mantener la infraestructura\npluvial (aguas de lluvia), no de otras aguas residuales. como por ejemplo aguas\nnegras. El Ministerio de Salud y AyA son los entes competentes para regular,\nfiscalizar y sancionar descargas indebidas de aguas residuales. Los\npropietarios de las viviendas son responsables directos del manejo adecuado de\nsus aguas residuales como se ordena desde la Ley General de Salud y demás Decretos\ncitados. Si la Municipalidad ya ejecutó obras correctivas, puede demostrar que\nacató la orden sanitaria mediante la implementación de un plan de acción.\nejecución de las obras y seguimiento. Que la infraestructura cumple con su\npropósito (drenar aguas pluviales). pero que podría haber sido mal utilizada\npor terceros (vecinos conectando aguas negras). Que no tiene competencias ni\nfacultades coercitivas para sancionar a esos propietarios en temas sanitarios\n(lo cual es función del Ministerio de Salud). Aunque el Ministerio puede alegar\nque no se ha resuelto el problema sanitario, si la causa es externa (conexiones\nilegales). la Municipalidad no puede ser responsabilizada por omisión si, al no\ntener potestades sancionatorias en salud pública y no puede obligar a\npropietarios a hacer obras internas en sus viviendas, ni mucho menos intervenir\ncon fondos públicos en ellas. Se recomienda documentar todo lo ejecutado,\nadjuntar el plan de acción presentado originalmente, adjuntar los contratos de\nlicitación pública respecto a las obras, órdenes de servicio, fotografías de\nantes y después. informes técnicos del Departamento de Gestión Vial, adjuntando\ninformes técnicos (del ingeniero municipal o contratista) que indiquen que la\ninfraestructura pluvial funciona correctamente. Presentar un informe detallado\ncon cronograma de ejecución de las obras y fecha de finalización. Apartarse de\nresponsabilidades por hechos de terceros, señalar por escrito que el posible\nrebalse de otras aguas residuales (aguas negras) no es atribuible a defectos de\nla infraestructura pluvial, sino a acciones irregulares de los vecinos y que\nsea el Ministerio de Salud, conforme a sus potestades que tome acciones contra\nlos infractores Se reitera una vez más, que la Municipalidad no tiene competencia\nlegal para intervenir instalaciones sanitarias internas de viviendas. Solicitar\nel cierre por cumplimiento del procedimiento sanitario o archivo, debido a que\nla orden sanitaria fue acatada en su totalidad por parte de la Municipalidad,\nasí como solicitar el archivo del expediente administrativo o la modificación\nde la orden sanitaria, dirigiéndose formalmente al área respectiva del\nMinisterio de Salud”. Mediante MEMORANDO No. SG-GSP-RT-2025-00172 del 24 de\nnoviembre de 2025, el representante de la UEN Recolección y Tratamiento\nPeriféricos del Instituto Costarricense de Acueductos y Alcantarillados\nestableció lo siguiente: “Conclusiones Técnicas 1. El proyecto no se encuentra\ndentro del área de cobertura del AyA, específicamente de Sistemas Periféricos, ya\nque la Municipalidad de Upala es operador del servicio de agua potable en la\nzona. 2. Conforme al principio del ciclo del agua, el operador del\nabastecimiento debe asumir también las responsabilidades del saneamiento. 3. La\nMunicipalidad de Upala es la autoridad competente para aprobar el desarrollo\nurbano y exigir la solución de recolección y tratamiento de aguas residuales.\n4. El Ministerio de Salud regula, pero no opera sistemas de saneamiento. 5. El\nAyA colabora únicamente desde su rol rector y asesor, bajo el principio de\ncoordinación interinstitucional”.\n\nDe lo anterior, se reitera que se evidencia que tanto\nla Municipalidad de Upala, como el ICAA cumplieron en parte con las órdenes\nsanitarias ARS-U-OS-028-2021, ARS-U-OS-029-2021 y ARS-U-OS-030-2021, ya que\nambas instituciones presentaron ante el Área Rectora de Salud de Upala lo\nordenado en las mismas. Sin embargo, no se ha dado cumplimiento del plan de\nacción propuesto y así brindar una solución integral al problema de aguas\nresiduales de la Urbanización Don Chú. Es decir, las órdenes sanitarias ARS-U-OS-028-2021,\nARS-U-OS-029-2021 y ARS-U-OS-030-2021 siguen sin cumplirse en su totalidad.\nSobre el particular, se verifica que efectivamente existe un problema con las\naguas residuales de la Urbanización Don Chú, pues son descargadas a los caños\npúblicos y desfogadas a la alcantarilla pluvial, provocando contaminación\nambiental, malos olores y riesgo a la salud pública. Por ende, a pesar de que\ndesde el 2020 se tiene conocimiento de la situación, actualmente no se cuenta\ncon una solución integral al problema de aguas residuales existente en la\nUrbanización Don Chú, por lo que las aguas residuales (principalmente grises)\nson desfogadas al cordón de caño sin ningún tratamiento, constatándose el\nproblema de contaminación ambiental.\n\nAhora bien, este Tribunal considera que ha existido una\nfalta de coordinación entre las 3 autoridades recurridas que ha conlleva a que\nactualmente exista un problema de contaminación ambiental y la falta de una\nsolución integral al problema de aguas residuales existente en la Urbanización\nDon Chú.\n\nDicha situación será abordada en los próximos\nconsiderandos.\n\nVIII.- Sobre la actuación de la Municipalidad de Upala.\nSobre el particular, se denota que desde el 26 de febrero de 2021 el Área de\nSalud de Upala emitió 2 órdenes sanitarias en contra de la Municipalidad de\nUpala: la orden sanitaria no. ARS-U-OS-028-2021 al alcalde y la orden sanitaria\nno. ARS-U-OS-029-2021 al presidente del Concejo, en donde se les instauraba a\npresentar “un plan de acciones correctivas para la instalación y funcionamiento\nde un sistema de tratamiento de aguas residuales con capacidad optima, que\nbrinde una solución integral al problema de las aguas residuales que presenta\nla Urbanización Don Chú”, así como el “diseño, la instalación y el\nfuncionamiento del sistema de tratamiento de aguas residuales”. Sobre lo\nanterior, se comprueba que si bien es cierto la Municipalidad de Upala ha\nrealizado varias gestiones para solventar la situación indicada, lo cierto es\nque dichas ordenes sanitarias no han sido cumplidas en su totalidad, ya que se\nmantiene el problema de contaminación ambiental y la falta de una solución\nintegral al problema de aguas residuales existente en la Urbanización Don Chú.\nAsí, en uno de los últimos oficios emitidos por el Ministerio de Salud (informe\nMS-DRRSCH-URS-IT-14-2025 del 27 de marzo de 2025, se estableció que “Hasta la\nfecha evidentemente se encuentra un incumplimiento al plan de acciones\ncorrectivas presentado por la Municipalidad de Upala y además, un\nincumplimiento a los acuerdos tomados en la reunión presencial del 18 de marzo\ncon la Municipalidad (…) El problema sobre la descarga ilegal de aguas\nresiduales en la vía pública de la Urbanización Don Chu en Upala no se ha\nresuelto, afectando la salud pública. (…) se concluye que la ordenes sanitarias\nARS-U-OS-028-2021 y ARS-U-OS-029-2021 no se han cumplido a cabalidad, dejando\nsin resolver la problemática de salud pública que representa la descarga de\naguas residuales a la vía pública provenientes de la Urbanización Don Chú en\nUpala”. Así, queda claro que la Municipalidad de Upala no ha cumplido con las\nórdenes sanitarias en su totalidad.\n\nPor otra parte, la Municipalidad recurrida intenta\nalegar que no le corresponde resolver esa problemática y que se tenga por\ncumplida dichas órdenes. En cuanto a este punto, es menester indicar que dicha\npostura de la Municipalidad de Upala acaeció posterior a que el Ministerio de\nSalud no aprobara la prórroga de la orden sanitaria emitida, esto mediante\noficio no. CARTA-MS-DRRSCH-DARSU-0224-2025 del 10 de junio de 2025, en donde el\nÁrea Rectora de Salud de Upala le comunicó a la alcaldesa de la Municipalidad\nde Upala lo siguiente: “En atención a su solicitud, (…) le informamos que no es\nposible otorgar una prórroga para una orden cuyo plazo ha vencido y por las\nsiguientes razones (…) se considera cumplida en cuanto a la presentación del\nPlan de Acciones. Sin embargo, se dejó claro que las acciones ejecutadas han\nsido mínimas, y que la problemática de salud pública persiste, ya que no se han\nimplementado soluciones concretas (…) Dado lo anterior, la solicitud de\nprórroga no procede”. Por consiguiente, se constata que sí existen 2 órdenes\nsanitarias en contra de la Municipalidad de Upala, en donde el Ministerio de\nSalud, en cumplimiento de sus competencias normativas, le ha instado a dicha\nMunicipalidad a cumplir con una serie de puntos tendientes a solventar el\nproblema ambiental constatado. Por lo que no es de recibo la posición de dicha\nMunicipalidad de intentar suprimir sus responsabilidades normativas. Recordemos\nque este Tribunal ha mencionado que el artículo 169, de la Constitución\nPolítica, dispone el deber de las municipalidades del país de velar por los\nintereses de los habitantes de su jurisdicción, de ahí que, en reiterados\npronunciamientos, este Tribunal ha señalado que, dichas corporaciones se\nencuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en\nriesgo los derechos a la salud y a un medio ambiente sano y ecológicamente\nequilibrado de las personas que viven en su cantón (véase la Sentencia N°\n2008-11739 de las 12:12 horas del 25 de julio de 2008, reiterada en la N°\n2020-014753, de las 9:15 horas del 7 de agosto de 2020).\n\nNótese que, inclusive, en el último informe del Concejo\nMunicipal del 28 de mayo de 2026 se alega que “esta Presidencia impulsará las\nsiguientes acciones: a) Gestionar la convocatoria formal ante el Concejo\nMunicipal de la Comisión Técnica Especializada de Seguimiento a las Órdenes\nSanitarias del Sistema de Tratamiento de Aguas Residuales del Barrio Don Chú,\ncon el fin de que rinda un informe integral y actualizado respecto de: • estado\nactual de la problemática; • acciones ejecutadas; • acuerdos pendientes; •\nlimitaciones técnicas y administrativas existentes; • coordinación\ninterinstitucional desarrollada; • posibles rutas de solución técnica y\nadministrativa. b) Solicitar formalmente a la Administración Municipal un\ninforme actualizado sobre: • cumplimiento de planes de acción; • estado de las\ncoordinaciones efectuadas con el Ministerio de Salud y AyA •situación actual de\nlas órdenes sanitarias; • eventuales necesidades presupuestarias, técnicas o\nadministrativas; • posibilidades de articulación institucional futura. c)\nIncorporar el tema dentro de la agenda de una próxima sesión ordinaria del\nConcejo Municipal, con el propósito de que el órgano colegiado conozca\nformalmente la situación expuesta y valore eventuales mecanismos de seguimiento\ninstitucional dentro del marco competencial correspondiente. d) Promover la\nconformación o fortalecimiento de espacios de articulación y trabajo\ninterinstitucional entre Municipalidad de Upala, Ministerio de Salud, Instituto\nCostarricense de Acueductos y Alcantarillados, Administración Municipal y demás\ninstancias técnicas competentes, orientados a procurar coordinación efectiva,\nintercambio de información y análisis de alternativas viables para la atención\nintegral de la problemática denunciada. e) Dar seguimiento desde el Concejo\nMunicipal a las gestiones e informes que se generen en relación con este tema,\na efectos de mantener conocimiento actualizado sobre el avance institucional de\nlas acciones vinculadas a la situación expuesta”. No obstante, no se tiene por\ndemostrado que esas acciones se hayan ejecutado ante una problemática que la\nMunicipalidad conoce desde el 2021, lo cual confirma la omisión de esa\nMunicipalidad en cumplir con lo ordenado.\n\nAhora bien, si la Municipalidad estima que el Instituto\nCostarricense de Acueductos y Alcantarillados también tiene responsabilidad en\nel asunto, lo correspondiente es recordarle lo indicado en el considerando VI\nrespecto a la coordinación interinstitucional en materia ambiental.\nEspecíficamente en materia de tutela ambiental, la sentencia número\n2008-004790, subrayó el deber de coordinación entre las instituciones\nrelacionadas con el tema y la imposibilidad de hacer caso omiso a las\nadvertencias sobre el peligro de contaminación que emite una institución\nfacultada por ley para proteger el ambiente. De ese modo, en la sentencia nro.\n2020-018888 de las 09:15 horas del 2 de octubre de 2020, reiterada en la\nsentencia nro. 2025-023963 de las 09:15 horas del 1 de agosto de 2025, se\nindicó, en lo que interesa, lo siguiente:\n\n \n\n“Este Tribunal ha reconocido que las corporaciones\nlocales tienen, dentro del ámbito de sus competencias y obligaciones una alta\ncuota de responsabilidad en materia ambiental, sea mediante la aprobación\ndirecta de permisos o licencias para las cuales se exija el previo cumplimiento\nde requisitos que acrediten ante otras instancias del poder público el adecuado\nmanejo ambiental, como mediante inspecciones regulares y canalización de\nsituaciones de riesgo ante las instancias con mayor competencia de intervención.\nHa quedado establecido ya que a los gobiernos locales les alcanza la obligación\nde coordinación y prevención en materia ambiental dentro del ámbito de su\njurisdicción territorial, de donde resulta que ciertamente las municipalidades\nson actores importantes en la tarea de protección al ambiente. Como se indicó\nsupra, no solo ese cabildo, sino todas las demás autoridades recurridas,\ncuentan con amplias facultades de actuación, y si bien se encuentran sujetas a\nla legalidad y la razonabilidad, lo cierto es que teniendo en cuenta que se\ntrata de una amenaza al medio ambiente y a la salud pública, la legalidad y los\nformalismos se ven desplazados”.\n\nA partir de lo expuesto, se debe hacer énfasis respecto\na la obligación de coordinación y prevención en materia ambiental que posee el\nmunicipio accionado dentro del ámbito de su jurisdicción territorial, motivo\npor el cual no es de recibo los argumentos esgrimidos por esa Municipalidad en\nlos informes rendidos, toda vez que no ha realizado las acciones pertinentes\npara solventar la problemática ambiental en beneficio de los habitantes de la\nurbanización respectiva, a pesar de que ha sido debidamente comprobado el\nproblema ambiental mencionado. Adicionalmente, se reitera lo indicado respecto\na las obligaciones derivadas de lo contemplando en los artículos 169 y 170 de\nla Constitución Política respecto a que a las municipalidades les corresponde\nla administración de los servicios e intereses locales, con el fin de promover\nel desarrollo integral de los cantones en armonía con el desarrollo nacional;\nasí como también velar por los derechos de sus munícipes de manera que no puede\npermanecer inerte, cuando a los munícipes se les afectan derechos fundamentales\ncomo sucede en el caso concreto.\n\nDe esta forma, se denota una lesión a los derechos\nfundamentales de los amparados ante la omisión constatada de la Municipalidad\nde Upala en resolver el problema ambiental respectivo.\n\nIX.- Sobre la actuación del Instituto Costarricense de\nAcueductos y Alcantarillados. Al respecto, al igual que sucede con la\nMunicipalidad de Upala, se verifica que el 26 de febrero de 2021, el Área de\nSalud de Upala emitió la orden sanitaria no. ARS-U-OS-030-2021, en donde le\nordenó al presidente Ejecutivo del Instituto Costarricense de Acueductos y\nAlcantarillados lo siguiente: “1. Presentar ante el Área Rectora de Salud de\nUpala un plan de acciones correctivas para la instalación y funcionamiento de un\nsistema de tratamiento de aguas residuales con capacidad optima, que brinde una\nsolución integral al problema de las aguas residuales que presenta la\nUrbanización Don Chú, ubicada en el distrito primero del cantón de Upala. Dicho\nplan deberá adjuntar un cronograma de las actividades a realizar y el plazo de\nejecución de estas, detallando fechas de inicio y final de cada actividad y el\nresponsable de su ejecución. 2. El diseño, la instalación y el funcionamiento\ndel sistema de tratamiento de aguas residuales deberá realizarse acatando la\nnormativa técnica vigente, contando con los respectivos permisos y\nautorizaciones de las instituciones competentes, según sea el caso”. Es decir,\nel Área de Salud de Upala también le ordenó a dicho Instituto varias acciones tendientes\na solventar la problemática ambiental constatada, sin que, a la fecha, según lo\nindicado en los considerandos anteriores, se haya resuelto dicha situación.\nEsto, confirma también una omisión por parte del ICAA en cumplir con lo\nordenado por el Ministerio de Salud para solventar la problemática ambiental\nconstatada. Nótese que, inclusive, el ICAA afirma que “la solución para atender\nla problemática de saneamiento de aguas residuales en la Urbanización don Chú\nrequiere de un planteamiento integral, ya que además del tratamiento de las\naguas residuales que solicitó el Ministerio de Salud en la Orden Sanitaria\nARS-U-OS-030-2022, se debe resolver su recolección y disposición, cumplimiento\ncon la normativa y reglamentación técnica vigente en esa materia”. En otras\npalabras, admite que la problemática requiere de una solución integral, la\ncual, claramente, a la fecha no se ha logrado. Igualmente, resulta relevante\nrecordarle a dicho instituto recurrido su obligación de velar por la protección\na un ambiente sano y ecológicamente equilibrado lo que indudablemente incluye\nla debida recolección, tratamiento y disposición final de las aguas residuales.\nEn ese sentido, lo establece la propia Ley Constitutiva Instituto Costarricense\nAcueductos y Alcantarillados, Ley nro. 2726, específicamente en sus artículos 1\ny 2:\n\n“ARTICULO 1º.- Con el objeto de dirigir, fijar\npolíticas, establecer y aplicar normas, realizar y promover el planeamiento,\nfinanciamiento y desarrollo y de resolver todo lo relacionado con el suministro\nde agua potable y recolección y evacuación de aguas negras y residuos\nindustriales líquidos, lo mismo que el aspecto normativo de los sistemas de\nalcantarillado pluvial en áreas urbanas, para todo el territorio nacional se\ncrea el Instituto Costarricense de Acueductos y Alcantarillados, como\ninstitución autónoma del Estado.\n\nARTICULO 2º.- Corresponde al Instituto Costarricense de\nAcueductos y Alcantarillados:\n\na) Dirigir y vigilar todo lo concerniente para proveer\na los habitantes de la república de un servicio de agua potable, recolección y\nevacuación de aguas negras y residuos industriales líquidos y de aguas\npluviales en las áreas urbanas;\n\nb) Determinar la prioridad, conveniencia y viabilidad\nde los diferentes proyectos que se propongan para construir, reformar, ampliar,\nmodificar obras de acueductos y alcantarillados; las cuales no se podrán\nejecutar sin su aprobación;\n\nc) Promover la conservación de las cuencas\nhidrográficas y la protección ecológica, así como el control de la\ncontaminación de las aguas;\n\nd) Asesorar a los demás organismos del Estado y\ncoordinar las actividades públicas y privadas en todos los asuntos relativos al\nestablecimiento de acueductos y alcantarillados y control de la contaminación\nde los recursos de agua, siendo obligatoria, en todo caso, su consulta, e\ninexcusable el cumplimiento de sus recomendaciones;\n\ne) Elaborar todos los planos de las obras públicas\nrelacionadas con los fines de esta ley, así como aprobar todos los de las obras\nprivadas que se relacionen con los sistemas de acueductos y alcantarillados,\nsegún lo determinen los reglamentos respectivos;\n\nf) Aprovechar, utilizar, gobernar o vigilar, según sea\nel caso, todas las aguas de dominio público indispensables para el debido\ncumplimiento de las disposiciones de esta ley, en ejercicio de los derechos que\nel Estado tiene sobre ellas, conforme a la ley número 276 de 27 de agosto de\n1942, a cuyo efecto el Instituto se considerará el órgano sustitutivo de las\npotestades atribuidas en esa ley al Estado, ministerios y municipalidades;\n\ng) Administrar y operar directamente los sistemas de\nacueductos y alcantarillados en todo el país, los cuales se irán asumiendo\ntomando en cuenta la conveniencia y disponibilidad de recursos. Los sistemas\nque actualmente están administrados y operados por las corporaciones\nmunicipales podrán seguir a cargo de éstas, mientras suministren un servicio\neficiente.\n\nBajo ningún concepto podrá delegar la administración de\nlos sistemas de acueductos y alcantarillado sanitario del Área Metropolitana.\n\nTampoco podrá delegar la administración de los sistemas\nsobre los cuales exista responsabilidad financiera y mientras ésta corresponda\ndirectamente al Instituto.\n\nQueda facultada la institución para convenir con\norganismos locales, la administración de tales servicios o administrarlos a\ntravés de juntas administradoras de integración mixta entre el Instituto y las\nrespectivas comunidades, siempre que así conviniere para la mejor prestación de\nlos servicios y de acuerdo con los reglamentos respectivos.\n\nPor las mismas razones y con las mismas\ncaracterísticas, también podrán crearse juntas administradoras regionales que\ninvolucren a varias municipalidades;\n\nh) Hacer cumplir la Ley General de Agua Potable, para\ncuyo efecto el Instituto se considerará como el organismo sustituto de los\nministerios y municipalidades indicados en dicha ley;\n\ni) Construir, ampliar y reformar los sistemas de\nacueductos y alcantarillados en aquellos casos en que sea necesario y así lo\naconseje la mejor satisfacción de las necesidades nacionales; y\n\nj) Controlar la adecuada inversión de todos los\nrecursos que el Estado asigne para obras de acueductos y alcantarillado\nsanitario.\n\n(*)k) Se autoriza al Instituto Costarricense de\nAcueductos y Alcantarillados, para que formalice, mediante convenio\ninterinstitucional con las corporaciones municipales, la construcción,\nampliación y rehabilitación de obras para el suministro de agua potable y\nservicio de alcantarillado, con el fin de proporcionar esos servicios en\naquellas zonas en donde el Instituto Costarricense de Acueductos y\nAlcantarillados no tenga cobertura en determinadas zonas o que teniendo, no\npueda brindar el servicio por limitaciones constructivas del sistema, pero que\ntécnicamente existe disponibilidad del recurso hídrico.\n\nLos estudios previos y los planos de las obras\nconstructivas de los diferentes sistemas de agua potable y alcantarillado, que\nlleven a cabo las municipalidades, deben contar con la aprobación previa en sus\naspectos técnicos y de diseño por parte del Instituto Costarricense de\nAcueductos y Alcantarillados, para asegurar su incorporación a los sistemas que\nya tenga en operación el Instituto, una vez concluidas las obras, de\nconformidad con el inciso b).\n\nSe autoriza a las municipalidades para que elaboren,\npor sí mismas o terceros, los planos constructivos de los sistemas de acueducto\ny alcantarillado.\n\nUna vez recibida a satisfacción la obra que construye\nla corporación municipal, por parte del Instituto Costarricense de Acueductos y\nAlcantarillados, debe incorporarse en la tarifa del servicio el rubro\ncorrespondiente para efectuar el pago íntegro a favor de la corporación\nmunicipal, por la obra previamente aprobada por el Ay A, así como el costo de\nlas expropiaciones y constitución de servidumbres necesarias para la\nconstrucción y operación del sistema. Tanto la obra como los terrenos pasarán a\nformar parte del patrimonio del AyA. El modelo tarifario para el pago de la\nobra debe ser aprobado por la Autoridad Reguladora de los Servicios Públicos\n(Aresep).\n\n(*) (Así adicionado el inciso k) anterior por el\nartículo 1° de la Ley para permitir a las municipalidades la construcción de\nobra de acueducto y alcantarillado, N° 10595 del 11 de noviembre de 2024)”.\n\nDel análisis de la normativa supracitada, se comprueba\nel deber del Instituto Costarricense de Acueductos y Alcantarillados en ejercer\nde forma coordinada la materia de recolección, tratamiento y disposición final\nde las aguas residuales para asegurar así la eficacia y eficiencia respectiva\n(ver la sentencia no. 2025-034701 de las 09:20 horas del 24 de octubre de\n2025). Por ende, no se logra observar alguna acción dentro del ámbito de sus\ncompetencias para tratar de mitigar de forma coordinada con las diversas\ninstancias respectivas la recolección, el tratamiento y la disposición final de\nlas aguas residuales en la urbanización indicada, lo que representa un\nquebranto al derecho a un ambiente sano y ecológicamente equilibrado de los\namparados. Así, se echa de menos las\nactuaciones del ICAA en solventar la problemática ambiental indicada.\n\nAsimismo, tal y como se le indicó a la Municipalidad de\nUpala, si el ICAA estima que es la Municipalidad de Upala la obligada a\nresolver el problema, lo cierto es que la orden sanitaria también le fue\nemitida a ese Instituto. Por ende, también es menester recordarle sobre la\nobligación de coordinación interinstitucional en materia ambiental.\nEspecíficamente en materia de tutela ambiental, la sentencia número\n2008-004790, subrayó el deber de coordinación entre las instituciones\nrelacionadas con el tema y la imposibilidad de hacer caso omiso a las\nadvertencias sobre el peligro de contaminación que emite una institución\nfacultada por ley para proteger el ambiente.\n\nDe esta forma, se denota una lesión a los derechos\nfundamentales de los amparados ante la omisión constatada del Instituto\nCostarricense de Acueductos y Alcantarillados en resolver el problema ambiental\nrespectivo.\n\nX.- Sobre la actuación del Ministerio de Salud. Por\núltimo, en cuanto a este Ministerio, se reitera que ha actuado conforme a sus\ncompetencias, emitiendo las órdenes sanitarias respectivas y realizando\nacciones tendientes para su cumplimiento. Sin embargo, dichas órdenes\nsanitarias no han sido cumplidas en su totalidad y se echa de menos una\nactuación contundente de ese ministerio para obligar su cumplimiento. Así, se\nreitera que, según el oficio técnico de inspección no. RCH-ARSU-ERS-IT-029-2025\ndel 20 de enero de 2025, el Equipo Regulación de la Salud del Área Rectora de\nSalud de Upala estableció que se realizó una inspección el 15 de enero de 2025,\nen donde se constató que “La Municipalidad conformó una comisión o equipo\ntécnico para tratar el tema, sin embargo, no se ha informado oficialmente\nquienes lo conforman y las acciones realizadas. 2. No se ha actualizado el plan\nde acción. 3. No se solicitó la prórroga al Ministerio de Salud para el\ncumplimiento del plan de acción actualizado. (…) 5. No se ha convocado a los\nencargados del tema en el Instituto Costarricense de Acueductos y\nAlcantarillados (AyA) para que brinden asesoría técnica y cualquier\ncolaboración pertinente a la Municipalidad. En general no se ha cumplido con\nlos acuerdos tomados en la reunión del pasado 18 de marzo de 2024, por lo\ntanto, se incumple el plan de acciones correctivas presentado en los oficios\nDAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias\nARS-U-OS-028-2021 y ARS-U-OS-029-2021 (…) 8. CONCLUSIÓN Aún no se cuenta con\nuna solución integral al problema de aguas residuales existente en la\nUrbanización Don Chú, por lo que las aguas residuales (principalmente grises)\nson desfogadas al cordón de caño sin ningún tratamiento. De esta forma se\nincumple con el plan de acciones correctivas presentado en los oficios\nDAMU-0496-06-2021 y DCU-OF-013-2024, según las órdenes sanitarias\nARS-U-OS-028-2021 y ARS-U-OS-029-2021. 9. RECOMENDACIONES AL ÁREA RECTORA DE\nSALUD DE SALUD. La dirección de Área Rectora de Salud Upala deberá hacer la\nrespectiva consulta ante niveles superiores del Ministerio de Salud para que se\ndeterminen las acciones a seguir en este caso, por el incumplimiento reiterado\ndel plan de acciones correctivas según las órdenes sanitarias ARS-U-OS-028-\n2021 y ARS-U-OS-029-2021”. Posteriormente, mediante\nCARTA-MS-DRRSCH-DARSU-0118-2025 del 18 de marzo de 2025, el Área Rectora de\nSalud de Upala le comunicó a la Dirección Regional de Chorotega del Ministerio\nde Salud lo siguiente: “Traslado informe técnico indicado en el asunto. Se\ntraslada para valoración y criterio sobre acciones a seguir, ya que desde el\n2021 que se giraron dichas ordenes sanitarias y a pesar de acercamientos,\nseguimiento y acuerdos, la municipalidad de Upala no ha cumplido en tiempo y\nforma, por lo que actualmente no se cuenta con una solución integral al\npreocupante problema de aguas residuales de la comunidad Don Chu. Agradecemos\nuna pronta intervención”. Subsiguientemente, mediante informe\nMS-DRRSCH-URS-IT-14-2025 (respuesta a CARTA MS-DRRRSCH-DARSU-0018-20225) del 27\nde marzo de 2025, los representantes de la Unidad de Rectoría de la Salud de la\nRegión Chorotega establecieron lo siguiente: “(…): a. Hasta la fecha\nevidentemente se encuentra un incumplimiento al plan de acciones correctivas\npresentado por la Municipalidad de Upala y además, un incumplimiento a los\nacuerdos tomados en la reunión presencial del 18 de marzo con la Municipalidad\n(…) El problema sobre la descarga ilegal de aguas residuales en la vía pública\nde la Urbanización Don Chu en Upala no se ha resuelto, afectando la salud\npública. 7. CONCLUSIÓN Y RECOMENDACIONES (…) se concluye que la ordenes\nsanitarias ARS-U-OS-028-2021 y ARS-U-OS-029-2021 no se han cumplido a\ncabalidad, dejando sin resolver la problemática de salud pública que representa\nla descarga de aguas residuales a la vía pública provenientes de la\nUrbanización Don Chú en Upala”. Es decir, desde dichos documentos emitidos\ndesde hace más de 1 año se corroboró que las órdenes sanitarias no han sido\ncumplidas por lo que elevó la consulta ante niveles superiores del Ministerio\nde Salud para que se determinen las acciones a seguir en este caso, por el\nincumplimiento reiterado del plan de acciones correctivas según las órdenes\nsanitarias ARS-U-OS-028- 2021 y ARS-U-OS-029-2021. Sin embargo, no constata que\nse hayan establecido o determinado dichas acciones, lo que ha provocado que se\nmantenga el problema ambiental constatado, lo cual es aceptado por dicho\nMinisterio.\n\nIgualmente, se verifica que no se tiene por demostrado\nque la denuncia no. 023-2020, que conllevó a la emisión del informe\nMS-DRRCH-URS-IT-0147-20 del 17 de diciembre de 2020, que corroboró la\nproblemática ambiental y fue fundamento para la emisión de las órdenes\nsanitarias, haya sido debidamente resuelta. Además, tampoco se tiene por\ndemostrado que la denuncia del 09 de febrero de 2022, interpuesto por el señor\nGerardo Fonseca Obando y firmado por vecinos de la Urbanización Don Chú ante el\nÁrea de Salud de Upala también haya sido resulta. Nótese que si bien es cierto\nla denuncia no. 023-2020 conllevó a la emisión de las órdenes sanitarias, se\nreitera que las mismas no han sido cumplidas en su totalidad, manteniéndose el\nproblema denunciado en esa gestión del 2020.\n\nDe esa forma, esta Sala Constitucional considera que ha\nexistido una falta de diligencia del Ministerio de Salud en darle el debido\nseguimiento para el cumplimiento de las órdenes sanitarias emitidas, lo que ha\nconllevado que la problemática ambiental se mantenga, a pesar de que desde el\n2020 el Ministerio recurrido tuvo conocimiento de dicha situación. Ahora bien,\nnótese que las órdenes sanitarias en cuestión fueron notificadas el 01 de marzo\nde 2021, con fecha de vencimiento del 27 de mayo de 2021. Por ende, se constata\nque dichas órdenes sanitarias ya vencieron, sin embargo, no se ha verificado su\ncumplimiento. Así las cosas, se acredita que, aunque el Ministerio de Salud\ncuenta con una serie de herramientas legales con el fin de exigir el\ncumplimiento de lo ordenado en las órdenes sanitarias, en el sub lite no se han\nimplementado, por lo que se observa que la autoridad sanitaria ha sido omisa en\nsu proceder en el seguimiento de la problemática aquí planteada.\n\nPor consiguiente, se denota una lesión a los derechos\nfundamentales de los amparados ante la omisión constatada del Ministerio de\nSalud en llevar a cabo las acciones respectivas para que se resuelva el\nproblema ambiental respectivo.\n\nXI.- Conclusión. En virtud de lo expuesto, se verifica\nuna falta de coordinación adecuada entre el Ministerio de Salud, el Instituto\nCostarricense de Acueductos y Alcantarillados y la Municipalidad de Upala en\nrealizar las acciones pertinentes tendientes a solventar el problema ambiental\nconstatado con las aguas residuales de la Urbanización Don Chú. Por\nconsiguiente, el presente asunto se declara con lugar con las consecuencias que\nse disponen en la parte dispositiva. (…)”",

NON-COMPLIANCE WITH SANITARY ORDERS AND LACK OF COORDINATION AMONG THE MINISTRY OF HEALTH, THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, AND THE MUNICIPALITY OF UPALA TO ADDRESS THE WASTEWATER PROBLEM IN THE DON CHÚ RESIDENTIAL DEVELOPMENT IN UPALA ARE ALLEGED. IT IS DEEMED NECESSARY TO GUARANTEE THE PROTECTION OF HEALTH AND PUBLIC SANITATION OF THE RESIDENTS OF THE AREA. THE PETITION IS GRANTED AND THE PARTIES ARE ORDERED TO PROVIDE A COMPREHENSIVE AND DEFINITIVE SOLUTION WITHIN SIX MONTHS. VCG07/2026\n\n\"(…) VII.- On the merits. After analyzing the evidentiary elements submitted, this Tribunal finds that the fundamental rights of the protected parties (amparados) have been violated. This is so because the reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal ones, set forth in Article 44 of the Law governing this Jurisdiction—together with the evidence submitted for the resolution of the matter, have duly established that the Urbanización Don Chú is a social-welfare residential development (Urbanización de Bien Social) consisting of 240 homes, located in the first district of the canton of Upala, Alajuela. By means of report MS-DRRCH-URS-IT-0147-20 of December 17, 2020, the Health Authority Unit of the Chorotega Region of the Ministry of Health notified the Health Authority Area (Área Rectora de Salud) of Upala of the following: \"(…) it is concluded that the wastewater (aguas residuales)—mostly domestic wastewater (aguas servidas) from laundry sinks, washing machines, and showers in the homes that make up the Urbanización Don Chú—is discharged into public drainage channels (caños públicos) and drained into the storm drain (alcantarilla pluvial), causing environmental contamination and a risk to public health. (…) In addition, very unpleasant odors are perceived from the sidewalk and roadway (…)\". On February 26, 2021, the Health Area of Upala issued sanitary order (orden sanitaria) no. ARS-U-OS-028-2021, ordering the mayor of the Municipality of Upala as follows: \"1. To submit to the Health Authority Area of Upala a corrective action plan (plan de acciones correctivas) for the installation and operation of a wastewater treatment system with optimal capacity that provides a comprehensive solution to the wastewater problem in the Urbanización Don Chú, located in the first district of the canton of Upala. Said plan must include a schedule of the activities to be carried out and the timeframe for their implementation, specifying the start and end dates of each activity and the person responsible for its implementation. 2. The design, installation, and operation of the wastewater treatment system must be carried out in compliance with applicable technical regulations, and with the relevant permits and authorizations from the competent institutions, as applicable.\" Notification date: March 1, 2021; expiration date: May 27, 2021. By means of official communication no. PRE-2021-00617 of May 24, 2021, the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados notified the Health Area of Upala and the Municipality of Upala that in 2010 the document \"Master Plan (Plan Maestro) for the Water Supply and Sanitation Systems of Upala, Alajuela\" had been submitted to the Municipality of Upala, which was required to implement it as the authorized public operator within the canton within a period of 10 years; that deadline had passed and the project cost 4.5 million dollars at that time. That same document sets out the steps the municipality must follow in order to begin the project, and AyA would advise on the process. By means of official communication no. DAMU-0400-05-2021 of May 26, 2021, the mayor of the Municipality of Upala requested of the Health Authority Area of Upala an extension of sanitary order ARS-U-OS-030-2021 (sic). By means of official communication MS-DRRSCH-DARSU-421-2021 of June 8, 2021, the Health Area of Upala notified the mayor of the Municipality of Upala that \"a thirty-day extension is granted as of May 28, 2021.\" This was communicated to the Municipality of Upala on June 10, 2021. On February 9, 2022, the Health Area of Upala received an unnumbered note signed by Mr. Gerardo Fonseca Obando and by residents of the Urbanización Don Chú, reporting the problem of contamination in the drainage channels from wastewater, lack of maintenance by the municipality, and foul odors, and requesting that the necessary measures be taken to eliminate the problem. By means of official communication MS-DRRSCH-DARSU-057-2022 of February 17, 2022, the director of the Health Area of Upala notified the complaining residents that the complaint would be forwarded to the Municipality of Upala. On June 19, 2023, the Municipality of Upala sent to the Health Authority Area of Upala official communication no. DAMU-0496-06-2021, which states the following: \"(…) a comprehensive solution is required that encompasses a system to collect, convey, and treat wastewater, and not merely a treatment system alone. Moreover, this comprehensive solution is needed not only in the Don Chú neighborhood but throughout the entire urban center of Upala. It was observed that what should be stormwater flows from within the homes into the stormwater conveyance system, which makes it impossible for the Municipality to intervene with its own budget to reverse this situation (…) In accordance with point 2 in official communication PRE-2021-00617 of May 24, 2021, AyA explains the planning process, which involves a series of phases leading to a master plan for a wastewater sanitation system in the center of Upala (…) 4. Finally, in order to comply with what was requested in the sanitary order, an action plan is included that incorporates measures aimed at improving wastewater treatment within the homes, with their respective implementation dates; it also incorporates, at the request of the residents of the Don Chú neighborhood, an urban intervention plan involving citizen participation and municipal budget.\" By means of technical inspection report no. RCH-ARSU-ERS-IT-271-2024 of March 19, 2024, the Health Regulation Team of the Health Authority Area of Upala communicated the following to the director of that Health Area: \"On March 18, 2024, officials of the Health Authority Area of Upala were convened to attend a meeting with officials of the Municipality of Upala to address the matter. At that meeting, a summary of the problem was presented; compliance with the action plan submitted by the Municipality of Upala in official communication DAMU-0496-06-2021 was discussed, as were the difficulties faced by the administration in constructing a wastewater treatment plant (planta de tratamiento de aguas residuales) for the development, since the problem exists essentially throughout the entire central district and no budget large enough for the construction of a treatment plant is available. In addition, the following agreements were reached: 1. The Municipality will form a commission or technical team to address the matter. 2. Once the commission is formed, the action plan will be updated. 3. The Municipality will request from the Ministry of Health an extension for compliance with the updated action plan. 4. With the collaboration of the Ministry of Health, informational materials will be created for distribution to the population. 5. The persons responsible for this matter at the Instituto Costarricense de Acueductos y Alcantarillados (AyA) must be convened to provide technical advice and any relevant collaboration. 6. All of this will be carried out in the short term. 7. The Health Authority Area of Upala must follow up on the steps and actions taken by the commission. Both the Municipality of Upala and AyA complied with sanitary orders ARS-U-OS 2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021, since both institutions submitted to the Health Authority Area of Upala what was ordered therein. However, the proposed action plan has not been implemented (…) 8. CONCLUSION A comprehensive solution to the wastewater problem in the Urbanización Don Chú has not yet been achieved, and as a result wastewater (primarily greywater (aguas grises)) continues to be discharged into the roadside drainage channel (cordón de caño) without any treatment. The Municipality of Upala has carried out some of the actions set out in an action plan; however, said plan must be updated, the commission or technical team must be formed, and the corresponding steps must continue, with the collaboration of AyA. 9. RECOMMENDATIONS TO THE HEALTH AUTHORITY AREA. The director of the Health Authority Area of Upala must follow up on the updated action plan to be submitted by the Municipality of Upala, which must be completed in the short term in order to achieve a comprehensive solution to the wastewater problem in the Urbanización Don Chú (…)\".\n\nFrom the foregoing, it is evident that the meeting convened by the Ministry of Health shows that both the Municipality of Upala and ICAA partially complied with sanitary orders ARS-U-OS-028-2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021, since both institutions submitted to the Health Authority Area of Upala what was ordered therein. However, the proposed action plan has not been implemented so as to provide a comprehensive solution to the wastewater problem in the Urbanización Don Chú.\n\nFurthermore, by means of technical inspection report no. RCH-ARSU-ERS-IT-029-2025 of January 20, 2025, the Health Regulation Team of the Health Authority Area of Upala communicated the following to the director of that Health Area: \"Follow-up on the corrective action plan submitted by municipal officials in official communications DAMU-0496-06-2021 and DCU-OF-013-2024 (…) Inspection date: January 15, 2025. 6. INSPECTION RESULTS (FINDINGS) (…) According to the administrative file and information provided by municipal officials, the following is noted: 1. The Municipality formed a commission or technical team to address the matter; however, no official notification has been given of its membership or of the actions taken. 2. The action plan has not been updated. 3. An extension was not requested from the Ministry of Health for compliance with the updated action plan. (…) 5. The persons responsible for this matter at the Instituto Costarricense de Acueductos y Alcantarillados (AyA) have not been convened to provide technical advice and relevant collaboration to the Municipality. In general, the agreements reached at the meeting of March 18, 2024, have not been honored; therefore, the corrective action plan submitted in official communications DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021, has not been complied with (…) 8. CONCLUSION A comprehensive solution to the wastewater problem in the Urbanización Don Chú has not yet been achieved, and as a result wastewater (primarily greywater) continues to be discharged into the roadside drainage channel without any treatment. Accordingly, the corrective action plan submitted in official communications DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021, has not been complied with. 9. RECOMMENDATIONS TO THE HEALTH AUTHORITY AREA. The director of the Health Authority Area of Upala must consult with higher levels within the Ministry of Health to determine the actions to be taken in this case, in view of the repeated non-compliance with the corrective action plan under sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021.\" By means of official communication no. MS-DRRSCH-DARSU-0092-2025 of February 26, 2025, the Health Area of Upala notified the mayor of the Municipality of Upala as follows: \"(…) In the follow-up conducted by the health regulation team, it is evident that the agreements reached at the meeting of March 18, 2024, have not been honored; therefore, the corrective action plan submitted in official communications DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021, has not been complied with. At present, a comprehensive solution to the wastewater problem in the Urbanización Don Chú has not been achieved, and as a result wastewater (primarily greywater) continues to be discharged into the roadside drainage channel without any treatment. Accordingly, the corrective action plan submitted in official communications DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021, has not been complied with. For the foregoing reasons, the case will be referred to higher levels for their respective assessment and appropriate action.\" This was communicated to the Municipality of Upala on March 7, 2025. By means of CARTA-MS-DRRSCH-DARSU-0118-2025 of March 18, 2025, the Health Authority Area of Upala communicated the following to the Regional Directorate of Chorotega of the Ministry of Health: \"I am forwarding the technical report indicated in the subject line. This is being forwarded for assessment and guidance on the actions to be taken, since, from 2021 when said sanitary orders were issued, and despite outreach efforts, follow-up, and agreements reached, the Municipality of Upala has not complied in a timely and proper manner, and at present a comprehensive solution to the serious wastewater problem affecting the Don Chú community has not been achieved. We appreciate a prompt intervention.\" By means of report MS-DRRSCH-URS-IT-14-2025 (in response to CARTA MS-DRRRSCH-DARSU-0018-20225) of March 27, 2025, the representatives of the Health Authority Unit of the Chorotega Region established the following: \"(…): a. To date, there is an evident failure to comply with the corrective action plan submitted by the Municipality of Upala and, in addition, a failure to comply with the agreements reached at the in-person meeting of March 18 with the Municipality (…) The problem of the illegal discharge of wastewater onto the public roadway of the Urbanización Don Chú in Upala has not been resolved, affecting public health. 7. CONCLUSION AND RECOMMENDATIONS (…) it is concluded that sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 have not been fully complied with, leaving unresolved the public health problem represented by the discharge of wastewater onto the public roadway originating from the Urbanización Don Chú in Upala.\" On April 24, 2025, a meeting was held with Ms. Laura Rodríguez, coordinator of the health regulation process at the Chorotega regional level, and officials of the Health Authority Area of Upala and the Municipality of Upala, at which guidance was once again provided on the matters of follow-up and documentation of actions, the importance of the inter-institutional commission (Comisión Interinstitucional), the preparation of a master plan, legal aspects and easements (servidumbres), and the coordination of files and communications between institutions. In addition, an agreement was reached that the Municipality of Upala would submit a detailed report no later than June 5, 2025, containing the official composition of the Inter-institutional Wastewater Commission of the canton of Upala, with participation from representatives of the Municipality (as process leader), AyA, and the Ministry of Health (at the regional and local levels), and including specific actions with respect to the problem. By means of official communication no. MU-ALM-OFIC-853-2025 of June 4, 2025, the mayor of the Municipality of Upala requested of the Health Authority Area of Upala \"an extension of sanitary order ARS-U-OS-028-2021, in order to update the action plan and to be able to continue with the process in a timely and proper manner.\" By means of official communication no. CARTA-MS-DRRSCH-DARSU-0224-2025 of June 10, 2025, the Health Authority Area of Upala notified the mayor of the Municipality of Upala as follows: \"In response to your request, (…) we inform you that it is not possible to grant an extension for an order whose deadline has already expired, for the following reasons (…) it was explained that sanitary order ARS-U-OS-028-2021 is considered complied with as regards the submission of the Action Plan. However, it was made clear that the actions carried out have been minimal and that the public health problem persists, as no concrete solutions have been implemented (…) For the foregoing reasons, the request for an extension is not granted. Nonetheless, we remain attentive to the submission of the report agreed upon at the meeting of May 24, 2025, as requested by the regional level.\" By means of official communication no. MU-GJ-CL-18-2025 of June 12, 2025, the legal manager of the Municipality of Upala communicated the following to the Territorial Development coordinator of that same municipality: \"Subject: Legal opinion regarding sanitary order ARS-U-OS-028-2021 of the Ministry of Health, requested by official communication MU-CTE-OFIC-004-2025 (…) IV. RECOMMENDATION. Based on the cited regulations and in accordance with the principle of legality, the Municipality of Upala is obligated to comply with those sanitary orders issued by the Ministry of Health that are consistent with Municipal competencies. The Costa Rican legal framework establishes that Municipalities are responsible for building and maintaining stormwater infrastructure (infraestructura pluvial) (rainwater), and not for other types of wastewater, such as sewage (aguas negras). The Ministry of Health and AyA are the competent authorities to regulate, oversee, and penalize improper wastewater discharges. The owners of the homes are directly responsible for the proper management of their wastewater, as mandated under the General Health Law and the other Decrees cited. If the Municipality has already carried out corrective works, it can demonstrate that it complied with the sanitary order through implementation of an action plan. execution of the works and follow-up. That the infrastructure fulfills its purpose (draining stormwater). but may have been misused by third parties (residents connecting sewage). That it lacks the competence or coercive authority to sanction those property owners on health matters (which is a function of the Ministry of Health). Although the Ministry may argue that the sanitary problem has not been resolved, if the cause is external (illegal connections), the Municipality cannot be held responsible for omission if, lacking sanctioning authority in public health matters, it cannot compel property owners to carry out internal works in their homes, nor intervene with public funds therein. It is recommended that all work carried out be documented, attaching the originally submitted action plan, the public procurement contracts for the works, service orders, before-and-after photographs, technical reports from the Road Management Department, and technical reports (from the municipal engineer or contractor) indicating that the stormwater infrastructure is functioning correctly. To submit a detailed report with a schedule of the works and their completion date. To disclaim responsibility for acts of third parties, stating in writing that any possible overflow of other wastewater (sewage) is not attributable to defects in the stormwater infrastructure but rather to irregular actions by residents, and that it is the Ministry of Health, in accordance with its authority, that should take action against the offenders. It is reiterated once again that the Municipality does not have the legal competence to intervene in the internal sanitary installations of homes. To request closure on grounds of compliance with the sanitary procedure or filing of the case, on the basis that the sanitary order was fully complied with by the Municipality, as well as to request the filing of the administrative record or modification of the sanitary order by formally addressing the relevant area of the Ministry of Health.\" By means of MEMORANDUM No. SG-GSP-RT-2025-00172 of November 24, 2025, the representative of the UEN Recolección y Tratamiento Periféricos of the Instituto Costarricense de Acueductos y Alcantarillados established the following: \"Technical Conclusions 1. The project does not fall within AyA's service coverage area, specifically within Peripheral Systems, since the Municipality of Upala is the drinking water service operator in the area. 2. In accordance with the principle of the water cycle, the operator responsible for supply must also assume responsibility for sanitation. 3. The Municipality of Upala is the competent authority to approve urban development and to require solutions for wastewater collection and treatment. 4. The Ministry of Health regulates but does not operate sanitation systems. 5. AyA collaborates solely in its guiding and advisory role, under the principle of inter-institutional coordination.\"\n\nFrom the foregoing, it is reiterated that both the Municipality of Upala and ICAA are shown to have partially complied with sanitary orders ARS-U-OS-028-2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021, since both institutions submitted to the Health Authority Area of Upala what was ordered therein. However, the proposed action plan has not been implemented so as to provide a comprehensive solution to the wastewater problem in the Urbanización Don Chú. That is to say, sanitary orders ARS-U-OS-028-2021, ARS-U-OS-029-2021, and ARS-U-OS-030-2021 remain unfulfilled in their entirety. On this matter, it is confirmed that there is indeed a problem with the wastewater from the Urbanización Don Chú, as it is discharged into public drainage channels and drained into the storm drain, causing environmental contamination, foul odors, and a risk to public health. Therefore, despite the fact that the situation has been known since 2020, a comprehensive solution to the wastewater problem in the Urbanización Don Chú has not yet been achieved, and as a result wastewater (primarily greywater) continues to be discharged into the roadside drainage channel without any treatment, confirming the environmental contamination problem.\n\nThat said, this Tribunal considers that there has been a lack of coordination among the 3 respondent authorities, which has led to an ongoing environmental contamination problem and the absence of a comprehensive solution to the wastewater problem in the Urbanización Don Chú.\n\nThis situation will be addressed in the following considerandos.\n\nVIII.- On the conduct of the Municipality of Upala. On this matter, it is noted that since February 26, 2021, the Health Area of Upala issued 2 sanitary orders against the Municipality of Upala: sanitary order no. ARS-U-OS-028-2021 to the mayor and sanitary order no. ARS-U-OS-029-2021 to the president of the Municipal Council, ordering them to submit \"a corrective action plan for the installation and operation of a wastewater treatment system with optimal capacity that provides a comprehensive solution to the wastewater problem in the Urbanización Don Chú,\" as well as the \"design, installation, and operation of the wastewater treatment system.\" With regard to the foregoing, it is established that, while the Municipality of Upala has taken various steps to address the stated situation, those sanitary orders have not been fully complied with, since the environmental contamination problem persists and a comprehensive solution to the wastewater problem in the Urbanización Don Chú has not been achieved. Thus, in one of the latest official communications issued by the Ministry of Health (report MS-DRRSCH-URS-IT-14-2025 of March 27, 2025), it was established that \"To date, there is an evident failure to comply with the corrective action plan submitted by the Municipality of Upala and, in addition, a failure to comply with the agreements reached at the in-person meeting of March 18 with the Municipality (…) The problem of the illegal discharge of wastewater onto the public roadway of the Urbanización Don Chú in Upala has not been resolved, affecting public health. (…) it is concluded that sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 have not been fully complied with, leaving unresolved the public health problem represented by the discharge of wastewater onto the public roadway originating from the Urbanización Don Chú in Upala.\" It is thus clear that the Municipality of Upala has not fully complied with the sanitary orders.\n\nFurthermore, the respondent Municipality attempts to argue that it is not responsible for resolving the problem and that said orders should be deemed complied with. On this point, it is important to note that this position taken by the Municipality of Upala arose after the Ministry of Health refused to grant the extension of the sanitary order by means of official communication no. CARTA-MS-DRRSCH-DARSU-0224-2025 of June 10, 2025, in which the Health Authority Area of Upala notified the mayor of the Municipality of Upala as follows: \"In response to your request, (…) we inform you that it is not possible to grant an extension for an order whose deadline has already expired, for the following reasons (…) it is considered complied with as regards the submission of the Action Plan. However, it was made clear that the actions carried out have been minimal and that the public health problem persists, as no concrete solutions have been implemented (…) For the foregoing reasons, the request for an extension is not granted.\" Accordingly, it is confirmed that 2 sanitary orders do exist against the Municipality of Upala, under which the Ministry of Health, in the exercise of its regulatory competencies, has urged the Municipality to comply with a series of measures aimed at resolving the confirmed environmental problem. Therefore, the position of the Municipality in attempting to shed its regulatory responsibilities is not acceptable. It should be recalled that this Tribunal has stated that Article 169 of the Constitution establishes the duty of the country's municipalities to safeguard the interests of the residents within their jurisdiction, and that in repeated decisions this Tribunal has held that said corporations are obligated to eliminate any type of threat that puts at risk the rights to health and to a healthy and ecologically balanced environment of the persons living in their canton (see Ruling No. 2008-11739 of 12:12 hours on July 25, 2008, reaffirmed in No. 2020-014753, of 9:15 hours on August 7, 2020).\n\nNote that, notably, the most recent report of the Municipal Council (Concejo Municipal) of May 28, 2026 alleges that \"this Presidency will promote the following actions: a) Formally convene before the Municipal Council the Specialized Technical Commission for Follow-up on Sanitary Orders (Comisión Técnica Especializada de Seguimiento a las Órdenes Sanitarias) for the Wastewater Treatment System of Barrio Don Chú, so that it may submit a comprehensive and updated report regarding: • the current state of the problem; • actions taken; • pending agreements; • existing technical and administrative limitations; • inter-institutional coordination undertaken; • possible technical and administrative solutions. b) Formally request from the Municipal Administration an updated report on: • compliance with action plans; • status of coordination with the Ministerio de Salud and AyA; • current status of the sanitary orders (órdenes sanitarias); • any budgetary, technical, or administrative needs; • possibilities for future institutional coordination. c) Include the matter on the agenda of an upcoming regular session of the Municipal Council, so that the collegial body may formally be informed of the situation presented and may evaluate possible mechanisms for institutional oversight within the corresponding scope of authority. d) Promote the formation or strengthening of spaces for inter-institutional coordination and collaboration among the Municipalidad de Upala, Ministerio de Salud, Instituto Costarricense de Acueductos y Alcantarillados, Municipal Administration, and other competent technical bodies, aimed at achieving effective coordination, exchange of information, and analysis of viable alternatives for the comprehensive resolution of the reported problem. e) Follow up from the Municipal Council on the actions and reports generated in relation to this matter, in order to maintain updated knowledge of the institutional progress on actions linked to the situation described.\" Nevertheless, it has not been established that those actions were actually carried out, given a problem the Municipalidad has been aware of since 2021, which confirms that Municipalidad's failure to comply with what was ordered.\n\nNow, if the Municipalidad considers that the Instituto Costarricense de Acueductos y Alcantarillados also bears responsibility in this matter, the appropriate response is to remind it of what was stated in considerando VI regarding inter-institutional coordination in environmental matters. Specifically in the area of environmental protection (tutela ambiental), judgment number 2008-004790 underscored the duty of coordination among the institutions involved in the matter and the impossibility of ignoring warnings about the risk of contamination issued by an institution empowered by law to protect the environment. Thus, in judgment no. 2020-018888 of 09:15 hours of October 2, 2020, reiterated in judgment no. 2025-023963 of 09:15 hours of August 1, 2025, the following was stated, insofar as relevant:\n\n\"This Tribunal has recognized that local corporations (corporaciones locales) bear, within the scope of their powers and obligations, a high degree of responsibility in environmental matters, whether through the direct approval of permits or licenses for which prior compliance with requirements demonstrating proper environmental management before other public authorities is required, or through regular inspections and the channeling of risk situations to the bodies with greater intervention authority. It has already been established that local governments are subject to the obligation of coordination and prevention in environmental matters within their territorial jurisdiction, from which it follows that municipalities are indeed important actors in the task of environmental protection. As stated above, not only that local council (cabildo), but all the other respondent authorities, have broad powers to act, and while they are subject to legality and reasonableness, the fact remains that, given that this involves a threat to the environment and to public health, legality and procedural formalities give way.\"\n\nBased on the foregoing, emphasis must be placed on the duty of coordination and prevention in environmental matters that the respondent municipality holds within its territorial jurisdiction, which is why the arguments put forward by that Municipalidad in its filed reports cannot be accepted, since it has not taken the pertinent actions to address the environmental problem to the benefit of the residents of the respective residential development (Urbanización), despite the fact that the aforementioned environmental problem has been duly verified. Additionally, what was stated regarding the obligations arising from Articles 169 and 170 of the Constitución Política is reiterated — namely, that municipalities are responsible for the administration of local services and interests, with the aim of promoting the comprehensive development of the cantons (cantones) in harmony with national development, as well as for safeguarding the rights of their municipal residents (munícipes), such that they cannot remain idle when fundamental rights of those residents are affected, as occurs in this case.\n\nIn this way, a violation of the fundamental rights of the petitioners (amparados) is evidenced by the verified failure of the Municipalidad de Upala to resolve the respective environmental problem.\n\nIX.- On the Conduct of the Instituto Costarricense de Acueductos y Alcantarillados. In this regard, as with the Municipalidad de Upala, it is verified that on February 26, 2021, the Upala Health Area (Área de Salud de Upala) issued sanitary order no. ARS-U-OS-030-2021, ordering the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados as follows: \"1. Submit to the Área Rectora de Salud de Upala a corrective action plan for the installation and operation of a wastewater treatment system (sistema de tratamiento de aguas residuales) with optimal capacity, providing a comprehensive solution to the wastewater problem at Urbanización Don Chú, located in the first district of the canton (cantón) of Upala. Said plan must include a schedule of the activities to be carried out, specifying the start and end dates for each activity and the person responsible for its execution. 2. The design, installation, and operation of the wastewater treatment system must be carried out in compliance with applicable technical regulations and with the respective permits and authorizations from the competent institutions, as applicable.\" That is, the Área de Salud de Upala also ordered that Institute to take various actions aimed at resolving the verified environmental problem, without, as of this date, as indicated in the preceding sections, that situation having been resolved. This also confirms a failure on the part of ICAA to comply with what was ordered by the Ministerio de Salud to address the verified environmental problem. Note that ICAA itself affirms that \"the solution to address the wastewater sanitation problem in Urbanización Don Chú requires a comprehensive approach, since in addition to wastewater treatment requested by the Ministerio de Salud in Sanitary Order ARS-U-OS-030-2022, its collection and disposal must also be resolved, in compliance with the applicable technical regulations and standards.\" In other words, it acknowledges that the problem requires a comprehensive solution, which, clearly, has not yet been achieved. Likewise, it is relevant to remind that respondent institute of its obligation to ensure the protection of a healthy and ecologically balanced environment, which undoubtedly includes the proper collection, treatment, and final disposal of wastewater. In this regard, the Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados, Ley nro. 2726, itself establishes this in Articles 1 and 2:\n\n\"ARTICLE 1.– For the purpose of directing, establishing policies, setting and applying standards, carrying out and promoting the planning, financing, and development of, and resolving all matters related to, the supply of drinking water and the collection and disposal of sewage (aguas negras) and liquid industrial waste, as well as the regulatory aspects of storm drainage systems (sistemas de alcantarillado pluvial) in urban areas throughout the national territory, the Instituto Costarricense de Acueductos y Alcantarillados is hereby created as an autonomous State institution.\n\nARTICLE 2.– The Instituto Costarricense de Acueductos y Alcantarillados shall:\n\na) Direct and supervise all matters pertaining to the provision to the inhabitants of the republic of drinking water service, collection and disposal of sewage and liquid industrial waste, and stormwater (aguas pluviales) drainage in urban areas;\n\nb) Determine the priority, advisability, and feasibility of the various projects proposed for the construction, reform, expansion, or modification of aqueduct and sewage works, which may not be carried out without its approval;\n\nc) Promote the conservation of watersheds (cuencas hidrográficas) and ecological protection, as well as the control of water pollution;\n\nd) Advise other State bodies and coordinate public and private activities in all matters relating to the establishment of aqueducts and sewage systems and the control of water resource pollution, its consultation being mandatory in all cases and compliance with its recommendations being inexcusable;\n\ne) Prepare all plans for public works related to the purposes of this law, as well as approve all plans for private works related to aqueduct and sewage systems, as determined by the respective regulations;\n\nf) Harness, use, govern, or supervise, as the case may be, all public-domain waters indispensable for the proper fulfillment of the provisions of this law, in the exercise of the rights that the State holds over them, pursuant to law number 276 of August 27, 1942, to which end the Institute shall be considered the substitute body for the powers attributed to the State, ministries, and municipalities under that law;\n\ng) Directly administer and operate aqueduct and sewage systems throughout the country, which shall be assumed taking into account the advisability and availability of resources. Systems currently administered and operated by municipal corporations (corporaciones municipales) may continue under their management, provided they supply efficient service.\n\nUnder no circumstances may it delegate the administration of the aqueduct and sanitary sewage systems of the Metropolitan Area.\n\nNor may it delegate the administration of systems for which there is financial liability, so long as that liability rests directly with the Institute.\n\nThe institution is authorized to enter into agreements with local bodies for the administration of such services, or to administer them through joint administrative boards composed of representatives of the Institute and the respective communities, whenever this is conducive to better service delivery and in accordance with the respective regulations.\n\nFor the same reasons and under the same conditions, regional administrative boards involving multiple municipalities may also be created;\n\nh) Enforce the Ley General de Agua Potable, for which purpose the Institute shall be considered the substitute body for the ministries and municipalities referred to in that law;\n\ni) Build, expand, and reform aqueduct and sewage systems in cases where necessary and where better satisfaction of national needs so advises; and\n\nj) Control the proper investment of all resources assigned by the State for aqueduct and sanitary sewage works.\n\n(*)k) The Instituto Costarricense de Acueductos y Alcantarillados is hereby authorized to formalize, through inter-institutional agreements with municipal corporations, the construction, expansion, and rehabilitation of works for the supply of drinking water and sewage services, for the purpose of providing those services in areas where the Instituto Costarricense de Acueductos y Alcantarillados has no coverage, or where, despite having coverage, it is unable to provide the service due to constructive limitations of the system, but where the water resource is technically available.\n\nPrior studies and construction plans for the various drinking water and sewage systems carried out by municipalities must obtain prior approval from the Instituto Costarricense de Acueductos y Alcantarillados with respect to their technical and design aspects, in order to ensure their incorporation into the systems already operated by the Institute upon completion of the works, in accordance with subsection b).\n\nMunicipalities are authorized to prepare, on their own or through third parties, the construction plans for aqueduct and sewage systems.\n\nOnce the work constructed by the municipal corporation has been received to the satisfaction of the Instituto Costarricense de Acueductos y Alcantarillados, the corresponding item must be incorporated into the service tariff to effect full payment to the municipal corporation for the work previously approved by AyA, as well as the cost of expropriations and the creation of easements (servidumbres) necessary for the construction and operation of the system. Both the works and the land shall become part of AyA's assets. The tariff model for payment of the works must be approved by the Public Services Regulatory Authority (Autoridad Reguladora de los Servicios Públicos) (Aresep).\n\n(*) (Subsection k) above was thus added by Article 1° of the Ley para permitir a las municipalidades la construcción de obra de acueducto y alcantarillado, N° 10595 of November 11, 2024).\"\n\nFrom the analysis of the aforementioned regulations, the duty of the Instituto Costarricense de Acueductos y Alcantarillados to exercise, in a coordinated manner, its authority over the collection, treatment, and final disposal of wastewater so as to ensure the respective effectiveness and efficiency is confirmed (see judgment no. 2025-034701 of 09:20 hours of October 24, 2025). Accordingly, no action within the scope of its authority can be observed aimed at mitigating, in coordination with the various relevant bodies, the collection, treatment, and final disposal of wastewater in the said residential development, which constitutes a violation of the petitioners' right to a healthy and ecologically balanced environment. Thus, ICAA's actions to resolve the indicated environmental problem are conspicuously absent.\n\nLikewise, as was stated to the Municipalidad de Upala, if ICAA considers that it is the Municipalidad de Upala that is obligated to resolve the problem, the fact remains that the sanitary order was also issued to that Institute. Therefore, it is also necessary to remind it of the obligation of inter-institutional coordination in environmental matters. Specifically in the area of environmental protection, judgment number 2008-004790 underscored the duty of coordination among the institutions involved in the matter and the impossibility of ignoring warnings about the risk of contamination issued by an institution empowered by law to protect the environment.\n\nIn this way, a violation of the fundamental rights of the petitioners is evidenced by the verified failure of the Instituto Costarricense de Acueductos y Alcantarillados to resolve the respective environmental problem.\n\nX.- On the Conduct of the Ministerio de Salud. Finally, with respect to this Ministry, it is reiterated that it has acted in accordance with its competencies, issuing the respective sanitary orders and taking actions aimed at their compliance. However, those sanitary orders have not been fully complied with, and a decisive course of action by that Ministry to compel compliance is notably absent. Thus, it is reiterated that, according to technical inspection report no. RCH-ARSU-ERS-IT-029-2025 of January 20, 2025, the Health Regulation Team (Equipo Regulación de la Salud) of the Área Rectora de Salud de Upala established that an inspection was carried out on January 15, 2025, in which it was noted that \"The Municipalidad formed a commission or technical team to address the matter; however, it has not been officially reported who its members are or what actions have been taken. 2. The action plan has not been updated. 3. No extension was requested from the Ministerio de Salud for compliance with the updated action plan. (…) 5. The persons responsible for the matter at the Instituto Costarricense de Acueductos y Alcantarillados (AyA) have not been convened to provide technical advice and any relevant assistance to the Municipalidad. In general, the agreements reached at the meeting of March 18, 2024 have not been complied with; therefore, the corrective action plan submitted in official communications DAMU-0496-06-2021 and DCU-OF-013-2024 is being violated, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 (…) 8. CONCLUSION A comprehensive solution to the wastewater problem existing in Urbanización Don Chú has not yet been achieved, so wastewater (primarily gray water) is being discharged into the roadside channel without any treatment. This constitutes non-compliance with the corrective action plan submitted in official communications DAMU-0496-06-2021 and DCU-OF-013-2024, pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021. 9. RECOMMENDATIONS TO THE ÁREA RECTORA DE SALUD. The director of the Área Rectora de Salud Upala must submit the relevant inquiry to higher levels of the Ministerio de Salud so that the actions to be taken in this case may be determined, given the repeated non-compliance with the corrective action plan pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021.\" Subsequently, by means of CARTA-MS-DRRSCH-DARSU-0118-2025 of March 18, 2025, the Área Rectora de Salud de Upala informed the Dirección Regional de Chorotega of the Ministerio de Salud as follows: \"I hereby forward the technical report referenced in the subject line. It is transmitted for evaluation and guidance on the actions to be taken, since from 2021, when said sanitary orders were issued and despite meetings, follow-up, and agreements, the Municipalidad de Upala has not complied in a timely and proper manner, so that to date there is no comprehensive solution to the serious wastewater problem in the community of Don Chú. We request prompt intervention.\" Subsequently, by means of report MS-DRRSCH-URS-IT-14-2025 (in response to CARTA MS-DRRRSCH-DARSU-0018-20225) of March 27, 2025, representatives of the Health Governance Unit (Unidad de Rectoría de la Salud) of Región Chorotega established the following: \"(…): a. To date, there is evident non-compliance with the corrective action plan submitted by the Municipalidad de Upala and, moreover, non-compliance with the agreements reached at the in-person meeting of March 18 with the Municipalidad (…) The problem of the illegal discharge of wastewater into the public thoroughfare of Urbanización Don Chú in Upala has not been resolved, affecting public health. 7. CONCLUSION AND RECOMMENDATIONS (…) it is concluded that sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021 have not been fully complied with, leaving unresolved the public health problem represented by the discharge of wastewater into the public thoroughfare originating from Urbanización Don Chú in Upala.\" That is, those documents issued more than one year ago confirmed that the sanitary orders had not been complied with, leading to the inquiry being elevated to higher levels of the Ministerio de Salud for the determination of the actions to be taken in this case, given the repeated non-compliance with the corrective action plan pursuant to sanitary orders ARS-U-OS-028-2021 and ARS-U-OS-029-2021. However, it is not established that those actions were determined or implemented, which has caused the verified environmental problem to persist — a fact accepted by that Ministry.\n\nLikewise, it is verified that it has not been established that complaint no. 023-2020, which led to the issuance of report MS-DRRCH-URS-IT-0147-20 of December 17, 2020 — which corroborated the environmental problem and served as the basis for the issuance of the sanitary orders — has been duly resolved. Furthermore, it has also not been established that the complaint of February 9, 2022, filed by Mr. Gerardo Fonseca Obando and signed by residents of Urbanización Don Chú before the Área de Salud de Upala, has been resolved either. Note that while complaint no. 023-2020 did lead to the issuance of the sanitary orders, it is reiterated that those orders have not been fully complied with and the problem reported in that 2020 proceeding persists.\n\nIn this way, this Constitutional Chamber (Sala Constitucional) considers that there has been a lack of diligence on the part of the Ministerio de Salud in duly following up on compliance with the issued sanitary orders, which has caused the environmental problem to persist, despite the fact that the respondent Ministry became aware of the situation as early as 2020. Note that the sanitary orders in question were served on March 1, 2021, with an expiration date of May 27, 2021. Therefore, it is established that those sanitary orders have already expired; however, compliance has not been verified. This being so, it is confirmed that, although the Ministerio de Salud has at its disposal a series of legal tools to compel compliance with what was ordered in the sanitary orders, those tools have not been implemented in the case at hand (sub lite), and it is therefore observed that the health authority has been remiss in its conduct in following up on the problem raised herein.\n\nConsequently, a violation of the fundamental rights of the petitioners is evidenced by the verified failure of the Ministerio de Salud to carry out the respective actions to ensure that the environmental problem at issue is resolved.\n\nXI.- Conclusion. In light of the foregoing, a lack of adequate coordination is verified among the Ministerio de Salud, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidad de Upala in taking the pertinent actions aimed at resolving the verified environmental problem with wastewater from Urbanización Don Chú. Consequently, the present matter is declared with merit (con lugar), with the consequences set forth in the operative part (parte dispositiva). (…)\""
