En este sentido, el Instituto recurrido procedió conforme la normativa cuando suspendió el servicio por falta de pago del mes anterior; sin embargo, la fuente pública fue instalada a más de 50 metros de la propiedad, con lo que se lesionan sus derechos fundamentales. En virtud de lo anterior, corresponde la estimatoria de este recurso de amparo\"\n\nTales consideraciones son aplicables al caso en estudio, dado que este Tribunal no encuentra razones para variar el criterio vertido en las sentencias parcialmente trascritas, ni motivos que lo hagan valorar de manera distinta la situación planteada, dado que en el presente asunto al igual que los precedentes de cita la fuente pública se instaló a una distancia superior de los cincuenta metros que esta jurisdicción ha establecido como razonables. SE RECLAMA LA AFECTACIÓN AL ACCESO AL AGUA POTABLE DE UNA FAMILIA EN CONDICIÓN DE VULNERABILIDAD TRAS LA SUSPENSIÓN DEL SERVICIO Y LA REUBICACIÓN DE LA FUENTE PÚBLICA A UNA DISTANCIA SUPERIOR A LA PERMITIDA. SE CONSIDERA VULNERADO EL DERECHO FUNDAMENTAL DE ACCESO AL AGUA POTABLE AL NO GARANTIZARSE UNA FUENTE PÚBLICA DENTRO DEL RADIO RAZONABLE ESTABLECIDO POR LA JURISPRUDENCIA CONSTITUCIONAL. SE DECLARA PARCIALMENTE CON LUGAR Y SE ORDENA INSTALAR UNA FUENTE PÚBLICA A UN MÁXIMO DE CINCUENTA METROS DE LA VIVIENDA DE FORMA INMEDIATA. VCG07/2026\n\n“(...) IV.- Sobre la suspensión del suministro de agua\npotable por morosidad. Respecto tema enunciado esta Sala se ha pronunciado en\nreiteradas oportunidades y en sentencia No. 2020-003446 de las 09:30 horas del\n21 de febrero del 2020, indicó lo siguiente:\n\n“La posición de este Tribunal Constitucional en cuanto\na recursos de amparo en los que se cuestiona la suspensión del suministro de\nagua potable, ha sido reiterada en el sentido de admitir que las instituciones\nadministradoras de los acueductos públicos pueden suspender el servicio a sus\nabonados, siempre y cuando los usuarios se encuentren en mora en el pago de las\ntarifas establecidas, pues los requisitos legales y reglamentarios que debe\nreunir el posible consumidor no pueden soslayarse si son razonables. A pesar de\nlo anterior, este Tribunal ha establecido la necesidad de que, si va a proceder\na cortar el suministro regular, el A y A o la Asociación Administradora deje a\ndisposición del interesado una fuente pública a corta distancia, donde pueda\nabastecerse del vital líquido, pues al estar de por medio el derecho a la\nsalud, derivado del artículo 21 de la Constitución Política, el servicio de\nagua potable debe de estar al alcance de toda persona” (el énfasis no\ncorresponde al original).\n\nPor otra parte, también ha aclarado que la suspensión\nprocede por la falta de pago del último importe mensual. En sentencia No.\n2016-012075 de las 09:30 horas del 26 de agosto del 2016, lo indicó así en los\nsiguientes términos:\n\n“Esta Sala también ha indicado, de forma reiterada, que\nla suspensión, únicamente, procede por la falta de pago oportuno del último\nimporte mensual, por cuanto los meses anteriores que se adeuden deberán ser\ncobrados, separadamente, por la vía correspondiente. Así, por ejemplo, en\nsentencia número 2003-06565 de las 15:29 hrs. de 8 de julio de 2003, se indicó:\n“Este Tribunal se ha referido a otra condición para que la suspensión del\nservicio de agua sea constitucionalmente legítimo, indicando que no puede privarse\nal administrado de éste si se ha cancelado el último recibo vencido, toda vez\nque no procede por esa vía exigir la obligación total o parcial del monto\nadeudado” (el énfasis no corresponde al original).\n\nAhora, en el presente caso el recurrente alega que la\nsuspensión del servicio de agua potable obedeció a la existencia de deudas\nmunicipales asociadas al inmueble y a que tal circunstancia habría impedido\ngestionar un arreglo de pago, este extremo no encuentra respaldo en los\nelementos probatorios que constan en el expediente.\n\nDe conformidad con lo informado bajo juramento por las\nautoridades recurridas, con las consecuencias, incluso penales, previstas en el\nartículo 44 de la Ley de Jurisdicción Constitucional, se tiene acreditado que\nla suspensión del servicio fue ordenada debido a la morosidad existente\nespecíficamente respecto del servicio de agua potable, cuya deuda se mantiene\ndesde el período 2018, y no por la falta de cancelación de otros tributos\nmunicipales. Asimismo, se acreditó que la Municipalidad de Alajuela permite a\nla persona legitimada para actuar en representación de la sucesión cancelar\nexclusivamente las sumas adeudadas por concepto de agua potable mediante la\nconfección de recibos especiales, sin exigir como condición previa el pago de\nlos demás tributos pendientes. De igual forma, la autoridad recurrida señaló\nque no consta gestión alguna promovida por el albacea o por una persona\nlegalmente facultada para representar la sucesión tendente a formalizar un\narreglo de pago o a regularizar la deuda correspondiente al servicio de agua\npotable. De esta forma no puede atribuirse a la Administración la imposibilidad\nalegada por el recurrente para gestionar una solución de pago, ni tenerse por\nacreditado que la suspensión del servicio obedeciera a un condicionamiento\nindebido vinculado a otras obligaciones tributarias del inmueble.\n\nAsí las cosas, en mérito de las consideraciones\nexpuestas y al igual que en las sentencias de cita se estima que la desconexión\ndel servicio se hizo basado en las potestades que tiene el municipio recurrido,\nen su momento por morosidad. Si bien existe un derecho fundamental de acceso al\nagua potable, este no es gratuito, por lo que la autoridad recurrida cuenta con\nla potestad de suspender el servicio, en caso de que los administrados no\ncancelen los montos que se adeuden por este concepto. Nótese que la parte\nrecurrente no aduce que se cancelara el último recibo vencido y se le denegara\nel restablecimiento del servicio.\n\nV.- Sobre la distancia de fuente pública de agua. Se\ntiene acreditado que la fuente pública que se instaló con ocasión de la\nsuspensión del servicio y fue instalada a una distancia de 60 metros de la\nvivienda. Al respecto, cabe señalar que este Tribunal, en la sentencia No.\n2020-017717 de las 09:20 horas de 18 de setiembre de 2020, indicó lo siguiente:\n\n“(…) Bajo similares condiciones a los hechos aquí en\nestudio, esta Sala mediante resolución 2019021906, lo siguiente (sic):\n\n“Ahora, tomando en consideración el precedente de cita,\nsi bien resulta razonable la suspensión del servicio de agua por la existencia\nde una deuda, tal hecho debe ir acompañado de la instalación de una fuente\npública a no más de 50 metros; lo anterior para resguardar el derecho del\ntutelado del acceso al agua potable. Al respecto, la Sala, mediante sentencia\nn.º 2018-004812 de las 9:30 horas de 23 de marzo de 2018, resolvió:\n\n“V. Sin demérito de lo anterior, este Tribunal ha\nestablecido la necesidad de que si va a proceder a suspender el suministro\nregular, la empresa o ente encargado debe dejar a disposición del interesado\nuna fuente pública a 50 metros, donde pueda abastecerse del vital líquido, pues\nal estar de por medio el derecho a la Salud, derivado del artículo 21 de la\nConstitución Política, el servicio de agua potable debe de estar al alcance de\ntoda persona (sentencia 2003-01185 de las nueve horas con cuarenta minutos del\ncatorce de febrero del dos mil tres). En otras palabras, cuando por falta de\npago se interrumpe el suministro de agua potable a consumidores domésticos, es\nnecesario que el usuario tenga una fuente de aprovisionamiento gratuita, que es\nla fuente pública y accesible de manera que con una diligencia razonable de su\nparte, pueda aprovisionarse para sus actividades mínimas (en ese sentido véase\nla sentencia N° 2017-16420 de las 09:15 hrs. del 13 de octubre de 2017)” (…)”\n(el énfasis no corresponde al original).\n\nPosteriormente, esta Sala mediante sentencia No.\n2022-004589 de las 09:15 horas del 25 de febrero de 2022, en lo conducente\ndispuso:\n\n“VII.- Ahora bien, en lo atinente a la fuente pública,\nel 21 de enero de 2022 se instaló una fuente pública a la par de la vivienda\ndonde reside la amparada. Posteriormente, el 28 de enero de 2022, funcionarios\nde la Municipalidad de Oreamuno efectuaron una inspección, y determinaron la\nexistencia de una toma ilegal, por lo que se retiró la conexión de agua y se\nreubicó la fuente pública a 76 metros de distancia. Contrario a lo afirmado por\nla recurrente, en un inicio se instaló la fuente pública a la par del inmueble\ndonde reside, y luego de reubicó a 76 metros de distancia. Aunque no hay\nelementos de juicio que permitan concluir que los hechos ocurrieron como la\namparada adujo, lo cierto es que la fuente pública fue reubicada en claro\nincumplimiento con la regla jurisprudencial de este Tribunal en la materia: la\nfuente pública debe ubicarse a no más de 50 metros de distancia. Así las cosas,\nen cuanto a este punto en particular, también debe intervenir esta Sala\nConstitucional” (el énfasis no corresponde al original).\n\nLuego, mediante resolución No. 2022-005659 de las 09:20\nhoras del 11 de marzo de 2022, este Tribunal resolvió lo siguiente:\n\n“[S]e verifica que el servicio de agua potable de la\nrecurrente fue suspendido a las 9:54 horas del 14 de febrero del 2022, debido a\nla falta de pago de la factura del mes de enero de 2022. Que desde el 15 de\nenero de 2022 los recurridos procedieron, como corresponde, a instalar una\nfuente pública en el NIS 5287128 a una distancia de 50 metros al Sur y 15\nmetros al Oeste de la propiedad de la recurrente. En este sentido, el Instituto\nrecurrido procedió conforme la normativa cuando suspendió el servicio por falta\nde pago del mes anterior; sin embargo, la fuente pública fue instalada a más de\n50 metros de la propiedad, con lo que se lesionan sus derechos fundamentales.\nEn virtud de lo anterior, corresponde la estimatoria de este recurso de amparo”\n(el énfasis no corresponde al original).\n\nTales consideraciones son aplicables al caso en\nestudio, dado que este Tribunal no encuentra razones para variar el criterio\nvertido en las sentencias parcialmente trascritas, ni motivos que lo hagan\nvalorar de manera distinta la situación planteada, dado que en el presente\nasunto al igual que los precedentes de cita la fuente pública se instaló a una\ndistancia superior de los cincuenta metros que esta jurisdicción ha establecido\ncomo razonables. En mérito de lo expuesto, se acredita la vulneración de derechos\nfundamentales sobre este particular y, por consiguiente, se acoge el recurso\ncon las consecuencias que se establecen en la parte dispositiva de esta\nsentencia. A CLAIM IS BROUGHT ALLEGING THE IMPAIRMENT OF ACCESS TO POTABLE WATER FOR A FAMILY IN A VULNERABLE SITUATION FOLLOWING THE SUSPENSION OF SERVICE AND THE RELOCATION OF THE PUBLIC SOURCE TO A DISTANCE GREATER THAN THAT PERMITTED. THE FUNDAMENTAL RIGHT OF ACCESS TO POTABLE WATER IS FOUND TO HAVE BEEN VIOLATED BECAUSE A PUBLIC SOURCE WITHIN THE REASONABLE RADIUS ESTABLISHED BY CONSTITUTIONAL CASE LAW WAS NOT GUARANTEED. THE APPEAL IS PARTIALLY GRANTED AND THE IMMEDIATE INSTALLATION OF A PUBLIC SOURCE AT A MAXIMUM OF FIFTY METERS FROM THE DWELLING IS ORDERED. VCG07/2026\n\n\"(...) IV.- On the suspension of the potable water supply on grounds of non-payment. This Court has repeatedly addressed this issue and, in judgment No. 2020-003446 of 09:30 hours on February 21, 2020, stated the following:\n\n\"The position of this Constitutional Tribunal regarding amparo appeals that challenge the suspension of the potable water supply has been consistently reiterated in the sense of acknowledging that the institutions that administer public water systems (acueductos públicos) may suspend service to their subscribers, provided that the users are in arrears in the payment of the established rates, since the legal and regulatory requirements that a prospective consumer must meet cannot be disregarded if they are reasonable. Notwithstanding the foregoing, this Tribunal has established the necessity that, if regular supply is to be cut, A y A or the Administering Association must make a public source available to the interested party at a short distance, where the person may obtain the vital liquid, since, given that the right to health — derived from Article 21 of the Political Constitution — is at stake, the potable water service must be within the reach of every person\" (emphasis not in the original).\n\nFurthermore, this Court has also clarified that suspension is permissible only for failure to pay the most recent monthly amount due. In judgment No. 2016-012075 of 09:30 hours on August 26, 2016, it stated the following in these terms:\n\n\"This Court has also repeatedly indicated that suspension is permissible only for failure to make timely payment of the most recent monthly amount due, since prior months that are owed must be collected separately through the appropriate channel. Thus, for example, in judgment No. 2003-06565 of 15:29 hours on July 8, 2003, it was stated: 'This Tribunal has referred to another condition for the suspension of water service to be constitutionally legitimate, indicating that a subscriber may not be deprived of service if the most recent overdue bill has been paid, since it is not permissible through that avenue to demand payment of the total or partial outstanding balance'\" (emphasis not in the original).\n\nNow, in the present case the appellant alleges that the suspension of the potable water service was the result of municipal debts associated with the property and that this circumstance had prevented the arrangement of a payment plan; however, this contention finds no support in the evidentiary materials on record in the case file (expediente).\n\nIn accordance with what was reported under oath by the respondent authorities — with the consequences, including criminal consequences, provided for in Article 44 of the Law of Constitutional Jurisdiction — it is established that the suspension of service was ordered on account of the delinquency specifically concerning the potable water service, a debt that has remained outstanding since the 2018 billing period, and not on account of failure to pay other municipal taxes. It is likewise established that the Municipalidad de Alajuela permits the person authorized to act on behalf of the estate (sucesión) to pay exclusively the amounts owed for potable water service by means of special payment receipts, without requiring prior payment of the other outstanding taxes as a condition. The respondent authority also noted that no application whatsoever initiated by the estate administrator (albacea) or by a person legally authorized to represent the estate seeking to formalize a payment arrangement or to regularize the debt corresponding to the potable water service appears on record. Accordingly, the impossibility alleged by the appellant of arranging a payment solution cannot be attributed to the Administration, nor can it be considered established that the suspension of service resulted from an improper condition tied to other tax obligations on the property.\n\nThat being so, in light of the foregoing considerations and consistent with the judgments cited, it is held that the disconnection of service was carried out based on the powers held by the respondent municipality, at the time on grounds of delinquency. Although there is a fundamental right of access to potable water, this right is not free of charge, and therefore the respondent authority holds the power to suspend service should subscribers fail to pay the amounts owed for that service. It is noteworthy that the appellant does not allege that the most recent overdue bill was paid and that restoration of service was then denied.\n\nV.- On the distance of the public water source. It is established that the public source installed upon suspension of service was placed at a distance of 60 meters from the dwelling. In this regard, it should be noted that this Tribunal, in judgment No. 2020-017717 of 09:20 hours on September 18, 2020, stated the following:\n\n\"(...) Under conditions similar to the facts under examination here, this Court, by way of resolution 2019021906, [held] the following (sic):\n\n\"'Now, taking into account the foregoing precedent, while the suspension of water service on account of an outstanding debt is reasonable, such action must be accompanied by the installation of a public source no more than 50 meters away; this is required in order to safeguard the protected party's right of access to potable water. In this regard, the Court, by way of judgment No. 2018-004812 of 9:30 hours on March 23, 2018, held:\n\n\"'V. Notwithstanding the foregoing, this Tribunal has established the necessity that if regular supply is to be suspended, the company or entity in charge must make a public source available to the interested party at 50 meters, where the person may obtain the vital liquid, since, given that the right to Health — derived from Article 21 of the Political Constitution — is at stake, the potable water service must be within the reach of every person (judgment 2003-01185 of nine hours forty minutes on February fourteenth, two thousand and three). In other words, when the potable water supply to domestic consumers is interrupted for failure to pay, it is necessary for the user to have a free provisioning source — namely, the public source — that is accessible in such a way that, through a reasonable degree of diligence on their part, they may obtain the minimum supply needed for their basic activities (see in that regard judgment No. 2017-16420 of 09:15 hours on October 13, 2017)'\" (...)\"\n(emphasis not in the original).\n\nSubsequently, this Court, by way of judgment No. 2022-004589 of 09:15 hours on February 25, 2022, ordered the following in the relevant part:\n\n\"VII.- Now, with respect to the public source, on January 21, 2022, a public source was installed next to the dwelling where the protected party resides. Subsequently, on January 28, 2022, officials of the Municipalidad de Oreamuno conducted an inspection and determined the existence of an illegal connection, as a result of which the water connection was removed and the public source was relocated to a distance of 76 meters. Contrary to what the appellant maintained, the public source was initially installed next to the property where she resides, and was thereafter relocated to 76 meters away. Although there are no grounds for concluding that the events occurred as the protected party alleged, what is certain is that the public source was relocated in clear violation of this Tribunal's case-law rule on the matter: the public source must be located no more than 50 meters away. That being so, with respect to this particular point, the Constitutional Court must also intervene\" (emphasis not in the original).\n\nSubsequently, by way of resolution No. 2022-005659 of 09:20 hours on March 11, 2022, this Tribunal held the following:\n\n\"[I]t is verified that the appellant's potable water service was suspended at 9:54 hours on February 14, 2022, on account of failure to pay the January 2022 invoice. That as of January 15, 2022, the respondents proceeded, as required, to install a public source at NIS 5287128 at a distance of 50 meters to the South and 15 meters to the West of the appellant's property. In this regard, the respondent Institute acted in accordance with the applicable rules when it suspended service for failure to pay the prior month's bill; however, the public source was installed more than 50 meters from the property, thereby infringing the appellant's fundamental rights. In view of the foregoing, this amparo appeal must be granted\" (emphasis not in the original).\n\nThese considerations are applicable to the case under examination, given that this Tribunal finds no reasons to depart from the position set out in the judgments partially transcribed above, nor grounds for viewing the situation presented in a different light, since in the present matter — as in the precedents cited — the public source was installed at a distance greater than the fifty meters that this jurisdiction has established as reasonable. In light of the foregoing, the violation of fundamental rights on this particular point is established and, consequently, the appeal is granted with the consequences set forth in the operative part (parte dispositiva) of this judgment.
