En primera instancia, es posible constatar que la Gerencia General del ICAA ordenó la prohibición de la alimentación a la colonia de gatos que habita en sus instalaciones, así como la reubicación de dichos animales en otros espacios a través de la adopción de estos; cuando el órgano técnico especializado en materia de fiscalización de bienestar animal en el caso de especies domésticas -SENASA-, informó bajo juramento que, en el marco de un programa de CCL, estas medidas son contrarias a lo exigido en cuanto al control de poblaciones con mecanismos humanitarios y a la legislación vigente en materia de bienestar animal.\n\nPor último, se demuestra que, según el informe rendido por las autoridades del SENASA, el método CCL (Captura–Castración–Retorno) es la única forma de control de poblaciones permitida en el ordenamiento jurídico costarricense, según el reglamento número 31626, así como la única que cumple el principio de no regresividad en bienestar animal; por ello, las medidas implementadas por el ICAA de prohibición de alimentación dentro del plantel, reubicación de animales, suspensión de atención veterinaria y retiro de acceso a áreas básicas de descanso, es contrario a un programa de control de poblaciones humanitario y a la legislación vigente en materia de bienestar animal.\n\nAsí las cosas, se verifica la transgresión contra los ordinales 21 y 50 de la Constitución Política, pues se comprueba que se menoscabó, no solamente el derecho a la salud de los trabajadores del Plantel La Uruca por la falta de acción para controlar la actividad de los mapaches en la zona; sino, también, la protección al bienestar animal y, por tanto, el derecho a un medio ambiente sano y ecológicamente equilibrado.",

SE ACUSA QUE EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS PROHIBIÓ LA ALIMENTACIÓN DE UNA COLONIA DE GATOS FERALES Y OMITIÓ ADOPTAR MEDIDAS INTEGRALES PARA EL MANEJO DE GATOS Y MAPACHES EN EL PLANTEL LA URUCA. SE CONSIDERA QUE EXISTIÓ UNA OMISIÓN EN LA PROTECCIÓN DEL BIENESTAR ANIMAL Y DE LA SALUD DE LAS PERSONAS TRABAJADORAS. SE DECLARA CON LUGAR Y SE ORDENA LA ELABORACIÓN DE UN PLAN INTERINSTITUCIONAL EN EL PLAZO DE SEIS MESES. VCG07/2026\n\n“(…) IV.- PRECEDENTES JURISPRUDENCIALES DE RELEVANCIA.\nEn ocasiones anteriores, este Tribunal se ha referido a la protección\nconstitucional que se brinda al bienestar de los animales y a las limitaciones\nconstitucionalmente legítimas al deber de protección del bienestar animal. De\nesta forma, la resolución nro. 13553-2016 de las 11:30 horas del 21 de\nsetiembre de 2016 determinó lo siguiente:\n\n“III.- La protección constitucional al bienestar de los\nanimales. Si bien es cierto, nuestro texto constitucional no tiene una\nnormativa expresa que tutele el bienestar animal, como la tienen países como\nAlemania y Suiza, en su desarrollo jurisprudencial, la Sala Constitucional ha\ndeterminado que la prohibición del maltrato animal, tiene asidero\nconstitucional en el ordenamiento costarricense, derivado de los artículos 28 y\n50 de la Constitución Política. La Sala ha determinado que los seres humanos no\nsólo tenemos un deber moral de actuación con respecto a las demás personas,\nsino también en relación con el entorno natural que nos rodea. En ese sentido,\nse ha considerado que el maltrato a los animales vulnera la moral, las buenas\ncostumbres y el orden público, y que además forma parte del derecho a un\nambiente sano y equilibrado. Sobre ello pueden consultarse al respecto las\nsentencias 1993-3705, 1995-5893 y sin duda la más emblemática, la 2012-4620.\n\nEn ésta última decisión se establece que la inclusión\nde los animales dentro del concepto de ambiente se hace con base en el papel\nque estos juegan en el desarrollo de la vida humana y que los hace merecedores\nde protección y un trato digno. Así, la fauna silvestre o salvaje, aquella que\nvive sin intervención inmediata del hombre para su desarrollo o alimentación,\nes protegida en virtud del mantenimiento de la biodiversidad y el equilibrio\nnatural de las especies. Por su parte, la fauna domesticada o en proceso de\ndomesticación se debe proteger del padecimiento, maltrato y crueldad sin\njustificación legítima, porque ello refleja una racionalidad ética que atiende\na una concienciación de la especie humana respecto del modo justo y digno con\nel que debe interactuar con la naturaleza. Por otra parte, se establece que:\n\n“la superioridad racional –moral- del hombre no puede\nsignificar la ausencia de límites para causar sufrimiento, dolor o angustia a\nseres sintientes no humanos”.... “En este contexto, precisamente, el maltrato a\nlos animales constituye un acto contrario a la dignidad toda vez que el\nejercicio de esta última comporta un deber moral de actuación tanto con\nrespecto a los demás seres humanos como en relación con el entorno natural que\nlo rodea. De ahí que se coliga con facilidad que el maltrato a los animales vulnera\nla moral, las buenas costumbres y el orden público, por lo que su prohibición y\nprevención deviene un asunto de relevancia constitucional.” (sentencia\n2012-04620)\n\nEsta línea jurisprudencial sostenida por Tribunal es\nconteste con la de otros Tribunales Constitucionales, como el de Colombia, que\nha hecho un amplio desarrollo del fundamento constitucional a la prohibición al\nmaltrato animal, entre otras, en sus sentencias C-666-10, C-083-14 y C-095-16.\nLa Corte Constitucional Colombiana señala que la noción del bienestar animal\ncomporta un límite y una obligación de los seres humanos de actuar con respeto\na los animales por tratarse de seres sintientes que forman parte del contexto\nen que se desarrolla la vida de las personas. Ese Tribunal consideró que la\nprotección a los animales se concreta a partir de dos perspectivas:\n\n“(…) la de fauna protegida en virtud del mantenimiento\nde la biodiversidad y el equilibrio natural de las especies; y la de fauna a la\ncual se debe proteger del padecimiento, maltrato y crueldad sin justificación\nlegítima, protección esta última que refleja un contenido de moral política y\nconciencia de la responsabilidad que deben tener los seres humanos respecto de\nlos otros seres sintientes”. (sentencia C-095-16 Tribunal Constitucional)\n\nSeñala ese Tribunal que un deber de rango\nconstitucional para el Estado, comporta obligaciones concretas de las\ndiferentes ramas públicas de restringir el apoyo, el patrocinio o participación\npositiva en actos que impliquen el maltrato animal, de tal forma que no podrá\nasumir un papel neutro en el desarrollo de la protección que corresponde\notorgarse a los animales. Asimismo, teniendo como fundamento a la dignidad\nhumana, la protección animal impone cargas de respeto de los seres humanos con\nlos seres sintientes. A pesar de la existencia del deber de protección al\nbienestar animal, la Corte colombiana avaló unos límites legítimos, entre los\ncuales se encuentran: (i) los hábitos alimenticios de los seres humanos, (ii)\nla investigación y experimentación médica y, (iii) la cultura. En cuyo caso, el\noperador jurídico deberá armonizar en cada caso concreto, cuando haya tensión\nentre el bienestar animal y los límites al deber de protección. Por lo tanto,\ndel interés superior de protección del medio ambiente y a la fauna, surge un\ndeber de resguardo de los animales contra el padecimiento, el maltrato y la\ncrueldad. De la relación entre la naturaleza y los seres humanos se puede\ninferir el estatus moral de la vida animal y el reconocimiento de la capacidad\nde sufrimientos a los mismos, por ello se entiende que son seres sintientes que\nconllevan a una serie de obligaciones para los seres humanos, de cuidado y\nprotección. De este deber constitucional que surgen obligaciones de cuidado y\nprohibiciones de maltrato y crueldad contra los animales, a menos que éste de\npor medio de alguno de los límites señalados.\n\n IV.-\nLimitaciones constitucionalmente legítimas al deber de protección del bienestar\nanimal. La doctrina señala que el deber de protección animal, tiene unos\nlímites legítimos, entre los cuales se encuentran al menos: (i) los hábitos\nalimenticios de los seres humanos, (ii) la investigación y experimentación\nmédica y, (iii) la cultura. En esos casos, el operador jurídico deberá intentar\nuna armonización caso por caso, cuando haya tensión entre la obligación de\nbuscar el bienestar animal y los límites al deber de protección. Sobre este\ntema, la sentencia C-666-10 del Tribunal Constitucional ha señalado:\n\n“El principio de bienestar animal cede ante las\ncostumbres alimenticias de la especie humana, al admitirse el sacrificio de\nanimales para el consumo humano. Sin embargo, el sacrificio animal en estos\ncasos debe ajustarse a parámetros establecidos con el objetivo de eliminar\ncualquier práctica que implique sufrimiento evitable para el animal y, así\nmismo, la crueldad en los procedimientos de sacrificio, demostrando que,\nincluso en estos casos, el deber constitucional resulta plenamente aplicable a\nla relación que los humanos mantengan con los animales. (iii) Investigación y\nexperimentación médica. La ley 84 de\n1989 consagra un capítulo especial para regular aquellas condiciones que son\nnecesarias para la realización de experimentos con animales. En este sentido se\nincluyen normas que prohíben la realización de los mismos cuando como fruto de\nsu práctica se cause maltrato, cuando éstos no sean puestos bajo anestesia\n–artículo 24-, cuando se realice experimentación con animales vivos como medio\nde ilustración en conferencias de facultades con carreras relacionadas con el\nestudio animal –artículo 25-; así como normas que exigen la existencia de un\ncomité de ética siempre que se realice un experimento con animales –artículo\n26-.”\n\n“A partir de la Constitución de 1991, la cultura no es\nasunto secundario, ni puede constituir un privilegio del que disfruten\nsolamente algunos colombianos, sino que ella ha de extenderse a todos, bajo el\nentendido de que por constituir uno de los fundamentos de la nacionalidad su\npromoción, desarrollo y difusión es asunto que ha de gozar de la especial\natención del Estado”. De allí el énfasis de la Carta por obligar a las\nautoridades públicas a asumir un papel protagónico en la creación de medios de\nexpresión artística que permitan a los colombianos identificarse como nación a\npartir del reconocimiento de sus características culturales. Por lo tanto, “no\npuede existir ninguna duda, sobre el claro mandato constitucional de que el\nEstado defina y lleve a cabo una política cultural que eleve el nivel artístico\ne intelectual de todos los colombianos, política ésta en la cual serán pilares\nesenciales el fomento de actividades encaminadas a la obtención de tales\nfines”. Los compromisos del Estado colombiano no sólo se derivan de la\nConstitución, sino, además, de los contraídos en el plano internacional, dentro\nde los cuales se cuentan los derivados del Pacto Internacional de Derechos\nEconómicos, Sociales y Culturales de 1.966, en cuyo artículo 15 se reconoce el\nderecho de todas las personas a participar en la vida cultural y a beneficiarse\nde los progresos de la ciencia y sus aplicaciones, y el deber correlativo de\nlos Estados de tomar las medidas necesarias para la conservación, el desarrollo\ny la difusión de la ciencia y la cultura. Este precepto reitera lo dispuesto en\nlos artículos 27 de la Declaración Universal de los Derechos Humanos de 1.948,\ny XIII de la Declaración Americana de los Derechos y Deberes del Hombre,\nigualmente vinculantes para Colombia. Hasta aquí se ha expuesto la forma de\nproteger y promocionar el bien constitucional de la cultura. Sin embargo, la\ncultura resulta ser un término abstracto cuya protección y promoción se hace a\ntravés de la protección y promoción de distintas manifestaciones, prácticas y\nusos que la sociedad identifica como manifestaciones culturales. Resulta\nimportante resaltar que la noción de \"cultura nacional\" se expresa a\ntravés de “aquellas tradiciones y cánones corrientemente aceptados como\n‘colombianos’, esto es, los que involucran las prácticas y los valores que\nprevalecen en el territorio nacional”, sin que lo anterior signifique que ésta\nprime o incluso anule las “manifestaciones culturales” minoritarias existentes\nen el territorio colombiano, pues de los artículos como el 7º y el 70 de la\nConstitución se deduce que todas las manifestaciones culturales se encuentran\nen pie de igualdad ante el ordenamiento jurídico colombiano. Y es precisamente\nla existencia de diferentes culturas –y, por consiguiente, las diferentes manifestaciones\nde ésta-, así como de diferentes derechos fundamentales, bienes\nconstitucionales, principios fundamentales, entre otros, que las expresiones\nculturales, al igual que otros elementos de protección constitucional, no\ntienen un valor absoluto en el ordenamiento colombiano y su interpretación, con\nmiras a concretar la garantía de su protección y desarrollo, debe hacerse en\narmonía con todos los elementos que integran el panorama constitucional\nprevisto por la Constitución de 1991.”\n\n“No todas las actividades del quehacer humano que\nexpresan una visión personal del mundo, que interpretan la realidad o la\nmodifican a través de la imaginación, independientemente de que en su ejecución\nse acudan al auxilio de recursos plásticos, lingüísticos, corporales o sonoros,\npueden considerarse por parte del legislador como expresiones artísticas y\nculturales del Estado. En efecto, es preciso recordar que conforme al preámbulo\ny a los artículos 1, 2, 4 y 13 de la Constitución Política, esta Corporación ha\nreconocido que el criterio jurídico de razonabilidad -en tanto límite a la\npotestad de configuración normativas- implica la exclusión de toda decisión que\néste adopte y que resulte manifiestamente absurda, injustificada o insensata,\nvale decir, que se aparte por completo de los designios de la recta razón, lo\nque ocurriría, por ejemplo, al pretenderse categorizar como expresiones\nartísticas y culturales del Estado, comportamientos humanos que única y\nexclusivamente manifiesten actos de violencia o de perversión (v.gr. la\npornografía, el voyerismo y el sadismo), que además de considerarse lesivos de\nlos valores fundamentales de la sociedad, desconocen principios y derechos\nfundamentales como los de la dignidad humana y la prohibición de tratos crueles.”\n\nSobre este tema específico, en la sentencia 2012-4620\nde esta Sala, también reconoce el autoconsumo humano y la cultura como límites\nlegítimos a la protección animal. En lo que interesa se señaló:\n\n“Ahora bien, como se indicó, la protección a la salud\nanimal se define en última instancia en función del mismo hombre. Por\nconsiguiente, es válido limitar la extensión de espectro de protección a los\nanimales en consideración a otros bienes jurídicamente relevantes para el ser\nhumano. En particular, el sacrificio de animales destinados al consumo y\naprovechamiento humanos es un evidente límite al deber de protección animal,\ntoda vez que los productos derivados de los animales constituyen elementos esenciales\nde la dieta y vestimenta humanas. Igualmente, se debe hacer mención a la\ninvestigación y experimentación médica con animales, por cuanto ello constituye\nun elemento fundamental para el desarrollo de medicamentos y tratamientos en\nbeneficio de la salud humana. Del mismo modo, las tradiciones del pueblo\ncostarricense, cuya protección se infiere del artículo 89 de la Constitución\nPolítica, son objeto de tutela por tratarse de valores propios del acervo\ncultural de la nación.”\n\n \n\nDe igual manera, en el ámbito internacional existe una\ntendencia de expansión del alcance del deber de proteger bienestar animal.\nEntre los Convenios y Declaraciones relevantes están:\n\nLa Declaración Universal de los Derechos de los\nAnimales. En ella se consagra el derecho a la existencia de los animales, al\nrespeto, a la prohibición de exterminio, explotación o crueldad y a la\nobligación de cuidado y protección por parte de los hombres (arts. 1 a 3).\n\nConvenio sobre la Diversidad Biológica. Se persigue la adopción de estrategias y\npolíticas para la conservación y aprovechamiento sostenible de la\nbiodiversidad, la utilización sostenible de ésta requiere tenerse en cuenta en\nla toma de decisiones de los proceso nacionales se obliga a los Estados Partes\na reconstruir las especies amenazadas y proteger las que están en vía de\nextinción.\n\nLa Declaración de Estocolmo sobre el Medio Ambiente\nHumano menciona que el medio ambiente humano, el natural y el artificial son\nesenciales para el bienestar y goce de los derechos humanos fundamentales de\nlos seres humanos, incluyendo dentro del objeto de protección a la fauna, de la\nsiguiente manera:\n\n“Principio 2. Los recursos naturales de la Tierra,\nincluidos el aire, el agua, la tierra, la flora y la fauna y especialmente\nmuestras representativas de los ecosistemas naturales, deben preservarse en\nbeneficio de las generaciones presentes y futuras mediante una cuidadosa\nplanificación y ordenación, según convenga”.\n\nPor su parte, la Observación General No. 14 del Comité\nde Derechos Económicos, Sociales y Culturales reconoció que el medio ambiente\nconstituye una forma de realización necesaria de la vida del hombre en el\nplaneta. Así:\n\n“(...) la referencia que en el párrafo 1 del artículo\n12 del Pacto se hace al \"más alto nivel posible de salud física y\nmental\" no se limita al derecho a la atención de la salud. Por el\ncontrario, el historial de la elaboración y la redacción expresa del párrafo 2\ndel artículo 12 reconoce que el derecho a la salud abarca una amplia gama de\nfactores socioeconómicos que promueven las condiciones merced a las cuales las\npersonas pueden llevar una vida sana, y hace ese derecho extensivo a los factores\ndeterminantes básicos de la salud, como la alimentación y la nutrición, la\nvivienda, el acceso a agua limpia potable y a condiciones sanitarias adecuadas,\ncondiciones de trabajo seguras y sanas y un medio ambiente sano.”\n\nTambién el Convenio de Ramsar pretende el resguardo de\nlos humedales como ecosistemas productivos y diversos que proporcionan entre\notros, agua potable, en virtud de este Convenio los Estados partes se\ncomprometen a:\n\ntrabajar en pro del uso racional de todos los humedales\nde su territorio;\n\ndesignar humedales idóneos para la lista de Humedales\nde Importancia Internacional (la \"Lista de Ramsar\") y garantizar su\nmanejo eficaz;\n\ncooperar en el plano internacional en materia de\nhumedales transfronterizos, sistemas de humedales compartidos y especies\ncompartidas.\n\nDe conformidad con las normas precedentes, la\njurisprudencia constitucional ha establecido que, que el medio ambiente es un\nderecho constitucional fundamental para el ser humano, pues sin éste, la vida\nperdería vigencia.”\n\nEn el mismo sentido, otros Tribunales en nuestro medio\nhan reconocido la obligación del Estado de proteger a los animales por su\nimportancia dentro del ecosistema, la prohibición sobre el maltrato de estas\nespecies, así como su reconocimiento como seres sintientes, reiterando lo\ndispuesto por esta Sala en anteriores ocasiones. Así, la resolución nro.\n01754-2021 de las 14:06 horas del 12 de octubre de 2021 de la Sala Primera de\nCasación de la Corte Suprema de Justicia, determinó lo siguiente:\n\n“IX. De previo al conocimiento del agravio, considera\nesta Cámara oportuno hacer el siguiente análisis. Como bien reseñó el Tribunal\nen la sentencia en estudio, a nivel mundial, se puede encontrar el sistema\njurídico ha venido evolucionando en lo que respecta a la naturaleza y el\nbienestar de los animales para establecer, de diversas formas, la\nresponsabilidad de los seres humanos de promover, procurar y ejecutar la\nprotección del ambiente, y dentro de ella a los animales. Así, se evidencia,\npor ejemplo, en diversos instrumentos internacionales tales como, los Convenios\nEuropeos para la Protección de los Animales, la Declaración Universal de los\nDerechos de los Animales, el Convenio sobre la Diversidad Biológica, la\nDeclaración de Estocolmo sobre el Medio Ambiente Humano. En igual sentido, la\nCorte Interamericana de Derechos Humanos mediante la Opinión Consultiva\nOC-23-17 de 15 de noviembre 2017, refiriéndose a las obligaciones de respeto y\ngarantía de los derechos humanos establecidos en la Convención Americana de\nDerechos Humanos, dispuso: “62. Esta Corte considera importante resaltar que el\nderecho al medio ambiente sano como derecho autónomo, a diferencia de otros\nderechos, protege los componentes del medio ambiente, tales como bosques, ríos,\nmares y otros, como intereses jurídicos en sí mismos, aún en ausencia de\ncerteza o evidencia sobre el riesgo a las personas individuales. Se trata de\nproteger la naturaleza y el medio ambiente no solamente por su conexidad con\nuna utilidad para el ser humano o por los efectos que su degradación podría\ncausar en otros derechos de las personas, como la salud, la vida o la\nintegridad personal, sino por su importancia para los demás organismos vivos\ncon quienes se comparte el planeta, también merecedores de protección en sí\nmismos. En este sentido, la Corte advierte una tendencia a reconocer personería\njurídica y, por ende, derechos a la naturaleza no solo en sentencias judiciales\nsino incluso en ordenamientos constitucionales.” (El destacado está agregado). En consonancia con lo anterior, diversos\npaíses alrededor del mundo han emitido normativa en la que se contempla y\nreconoce a los animales como seres sintientes o personas no humanas (México,\nFrancia y Portugal), y algunos han reconocido explícitamente en sus constituciones\nel derecho a la protección, (Alemania y Luxemburgo), y de la dignidad de estos\n(Suiza). En ese contexto, el papel que\ndesempeñan las instancias jurisdiccionales resulta determinante para que esa\nprotección sea efectiva, debiendo decantarse las personas juzgadoras por la\nbúsqueda de una verdadera justicia ecológica. \nEn esa línea se han emitido sentencias reconociendo derechos a entidades\nnaturales como los ríos Whanganui (Nueva Zelanda), Ganges (India) y Atrato (Colombia),\ny de animales como es el caso de la orangutana Sandra (Argentina). Costa Rica no ha sido excepción en este\nreconocimiento, prueba de ello es que se han emitido diversas normas con\nvocación protectora, tales como Ley de Conservación de Vida Silvestre, No.7317;\nla Ley de Bienestar de los Animales No. 7451, la Ley General del Servicio de\nSalud Animal No. 8495 y el sistema sancionatorio regulado en el Código Penal\nNo. 4573. Y, en el ámbito judicial, la\nSala Constitucional, también ha trazado una línea jurisprudencial que se\norienta a superar los razonamientos antropocentristas en línea con la Corte IDH\nsupra transcrita; con una evidente firmeza en la protección del ambiente y de\nlos animales que esta Sala comparte. En\nese sentido, la resolución 13553-2016 de las once horas y treinta minutos del\nveintiuno de setiembre de dos mil dieciséis, emitida incluso antes de la Ley de\nBienestar Animal, señaló: “III.- La protección constitucional al bienestar de\nlos animales. Si bien es cierto, nuestro texto constitucional no tiene una\nnormativa expresa que tutele el bienestar animal, como la tienen países como\nAlemania y Suiza, en su desarrollo jurisprudencial, la Sala Constitucional ha\ndeterminado que la prohibición del maltrato animal tiene asidero constitucional\nen el ordenamiento costarricense, derivado de los artículos 28 y 50 de la\nConstitución Política. La Sala ha determinado que los seres humanos no sólo\ntenemos un deber moral de actuación con respecto a las demás personas, sino\ntambién en relación con el entorno natural que nos rodea. En ese sentido, se ha\nconsiderado que el maltrato a los animales vulnera la moral, las buenas\ncostumbres y el orden público, y que además forma parte del derecho a un\nambiente sano y equilibrado. Sobre ello pueden consultarse al respecto las\nsentencias 1993-3705, 1995-5893 y sin duda la más emblemática, la 2012-4620. En\nésta última decisión se establece que la inclusión de los animales dentro del\nconcepto de ambiente se hace con base en el papel que estos juegan en el\ndesarrollo de la vida humana y que los hace merecedores de protección y un\ntrato digno. Así, la fauna silvestre o salvaje, aquella que vive sin\nintervención inmediata del hombre para su desarrollo o alimentación, es\nprotegida en virtud del mantenimiento de la biodiversidad y el equilibrio\nnatural de las especies. Por su parte, la fauna domesticada o en proceso de\ndomesticación se debe proteger del padecimiento, maltrato y crueldad sin\njustificación legítima, porque ello refleja una racionalidad ética que atiende\na una concienciación de la especie humana respecto del modo justo y digno con\nel que debe interactuar con la naturaleza. Por otra parte, se establece que:\n“la superioridad racional –moral- del hombre no puede significar la ausencia de\nlímites para causar sufrimiento, dolor o angustia a seres sintientes no\nhumanos” .... “En este contexto, precisamente, el maltrato a los animales\nconstituye un acto contrario a la dignidad toda vez que el ejercicio de esta\núltima comporta un deber moral de actuación tanto con respecto a los demás\nseres humanos como en relación con el entorno natural que lo rodea. De ahí que\nse coliga con facilidad que el maltrato a los animales vulnera la moral, las\nbuenas costumbres y el orden público, por lo que su prohibición y prevención\ndeviene un asunto de relevancia constitucional.” (sentencia 2012-04620) Esta\nlínea jurisprudencial sostenida por Tribunal es conteste con la de otros\nTribunales Constitucionales, como el de Colombia, que ha hecho un amplio\ndesarrollo del fundamento constitucional a la prohibición al maltrato animal,\nentre otras, en sus sentencias C-666-10, C-083-14 y C-095-16. La Corte\nConstitucional Colombiana señala que la noción del bienestar animal comporta un\nlímite y una obligación de los seres humanos de actuar con respeto a los\nanimales por tratarse de seres sintientes que forman parte del contexto en que\nse desarrolla la vida de las personas. Ese Tribunal consideró que la protección\na los animales se concreta a partir de dos perspectivas: “(…) la de fauna\nprotegida en virtud del mantenimiento de la biodiversidad y el equilibrio\nnatural de las especies; y la de fauna a la cual se debe proteger del\npadecimiento, maltrato y crueldad sin justificación legítima, protección esta\núltima que refleja un contenido de moral política y conciencia de la\nresponsabilidad que deben tener los seres humanos respecto de los otros seres\nsintientes”. (sentencia C-095-16 Tribunal Constitucional) Señala ese Tribunal\nque un deber de rango constitucional para el Estado comporta obligaciones\nconcretas de las diferentes ramas públicas de restringir el apoyo, el\npatrocinio o participación positiva en actos que impliquen el maltrato animal,\nde tal forma que no podrá asumir un papel neutro en el desarrollo de la\nprotección que corresponde otorgarse a los animales. Asimismo, teniendo como fundamento\na la dignidad humana, la protección animal impone cargas de respeto de los\nseres humanos con los seres sintientes. A pesar de la existencia del deber de\nprotección al bienestar animal, la Corte colombiana avaló unos límites\nlegítimos, entre los cuales se encuentran: (i) los hábitos alimenticios de los\nseres humanos, (ii) la investigación y experimentación médica y, (iii) la\ncultura. En cuyo caso, el operador jurídico deberá armonizar en cada caso\nconcreto, cuando haya tensión entre el bienestar animal y los límites al deber\nde protección. Por lo tanto, del interés superior de protección del medio\nambiente y a la fauna, surge un deber de resguardo de los animales contra el\npadecimiento, el maltrato y la crueldad. De la relación entre la naturaleza y\nlos seres humanos se puede inferir el estatus moral de la vida animal y el\nreconocimiento de la capacidad de sufrimientos a los mismos, por ello se\nentiende que son seres sintientes que conllevan a una serie de obligaciones\npara los seres humanos, de cuidado y protección. De este deber constitucional\nque surgen obligaciones de cuidado y prohibiciones de maltrato y crueldad\ncontra los animales, a menos que éste de por medio de alguno de los límites\nseñalados.” Con base en lo anterior,\nadicionó el órgano constitucional, se evidencia que existe un mandato en el\námbito constitucional y legal para regular la protección animal, posición que\nreconoce y reafirma esta Cámara.”\n\nV.- SOBRE EL PRINCIPIO DE COORDINACIÓN\nINTERADMINISTRATIVA. Uno de los principios rectores de la organización\nadministrativa lo constituye la coordinación que debe mediar entre todos los\nentes y órganos públicos al ejercer sus competencias y prestar los servicios\nque el ordenamiento jurídico les ha asignado. La coordinación, en cuanto\nasegura la eficiencia y eficacia administrativas, es un principio\nconstitucional virtual o implícito que permea el entero ordenamiento jurídico\nadministrativo y obliga a todos los entes públicos. La coordinación puede ser\ninterorgánica -entre los diversos órganos que conforman un ente público no\nsujetos a una relación de jerarquía- o intersubjetiva, esto es, entre los entes\npúblicos, cada uno con personalidad jurídica, presupuesto propio, autonomía y\ncompetencias específicas. La autonomía administrativa o de otro grado de cuya\ntitularidad gozan los entes públicos los obliga a coordinar sus acciones,\npuesto que, no pueden estar sometidos recíprocamente a relaciones de jerarquía\npor su naturaleza interorgánica. La coordinación administrativa tiene por\npropósito evitar las duplicidades y omisiones en el ejercicio de las funciones\nadministrativas de cada ente público, esto es, que sean desempeñadas de forma\nracional y ordenada. La coordinación se logra a través del establecimiento de\nniveles o canales fluidos y permanentes de información entre los entes\npúblicos, todo lo cual se puede lograr a través de reuniones, informes o la\ncreación de instancias formales de coordinación.\n\nVI.- EN CUANTO A LA COLONIA DE GATOS. Después de\nanalizar los elementos probatorios aportados, este Tribunal comprueba la lesión\na los derechos fundamentales. Del informe rendido por los representantes de la\nautoridad recurrida -que se tiene dado bajo fe de juramento con las\nconsecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige\nesta Jurisdicción- y del elenco probatorio, se tiene por acreditado que los\namparados [Nombre 010], cédula de identidad [Valor 010], [Nombre 004], cédula\nde identidad [Valor 004], [Nombre 005], cédula de identidad [Valor 005], y\n[Nombre 003], cédula de identidad [Valor 003], son todos funcionarios de la\nautoridad accionada. Además, se verifica que el 10 de diciembre de 2021, Gisela\nVico Pesch, funcionaria de la Asociación Nacional Protectora de Animales\n(ANPA), envió un correo electrónico a funcionarios del Instituto recurrido,\nindicando lo siguiente: “(…) Tras la visita efectuada el día de hoy al plantel\ndel AyA, en La Uruca, nos gustaría solicitarle su apoyo en la gestión del\npréstamo del espacio para llevar a cabo el programa de c (…) colaboradores del\nAyA plantel La Uruca (Carlos Segura) y el programa de Bandera Azul Ecológica de\nla Dirección Ambiental del AyA. Las necesidades del lugar son: espacio cómodo,\namplio, con buena iluminación, electricidad, con acceso a agua y\npreferiblemente que sea fresco. En la visita vimos que la escuela de fontanería\npodría ser el lugar idóneo, tanto el aula grande, como la que está contigua.\nque nos manifestaron es algo más pequeña, pero pue (…) El espacio sería\nutilizado los días viernes 17, sábado 18 y domingo 19 de diciembre para\nresguardar, de forma segura, todo el equipo para las capturas. El día lunes 22\nse estarían efectuando las capturas y ese mismo día, de ser posible, se\nestarían realizando las castraciones, en ese espacio. Los felinos capturados\ndeberán permanecer allí ese día, y serán liberados el día martes 22 de\ndiciembre. Si ese mismo día se puede coordinar la devolución del equipo del\nprograma a ANPA, sería el último día del préstamo del espacio. de lo contrario,\nsería hasta que se pueda coor (…) Esperamos que sea posible el préstamo de este\nlugar, para llevar a cabo tan importante programa, que favorece no solo la\nsalud pública y de los colaboradores que trabajan en (…)”. Luego, se constata\nque el 9 de junio de 2022, María del Mar Solano Arce, funcionaria del ICAA,\nenvió un correo electrónico a otros funcionarios de esta autoridad recurrida,\nindicando lo siguiente: “(…) Como algunos de ustedes ya saben, el año pasado se\nllevó a cabo una actividad de castración de los gatos del Plantel durante la\ncual gracias a la generosa colaboración económica c (…) profesionales de la\nAsociación Nacional de Protección Animal (ANPA) se logró castrar la totalidad\nde la colonia de gatos del Plantel. Como parte de esta actividad, se realizó\ntambién una charla educativa por parte de ANPA en la cual también estuvieron\npresentes algunos funcionarios del plantel. En esta charla la es (…) pudimos\naprender que estas colonias se establecen en sitios que históricamente durante\nlargos periodos de tiempo han sido \"boladeros\" de gatos, donde las\npersonas de las comunida (…) Infelizmente el Plantel es uno de esos sitios, por\nlo que sin importar si les dan comida o no el problema va a persistir mientras\npersonas sin escrúpulos le pasen el problema a otros en (…) Ahora bien, por\notro lado la experta nos explicó que mientras exista una colonia establecida en\nel lugar, esto evita la llegada de más animales ya que ello defienden su territorio\ny así no (…) mantener la colonia ahí evita la llegada de más gatos mientras que\ndeshacerse de ella provocaría una nueva colonización en poco tiempo por el\nproblema del abandono en el sitio men (…) Por último, quisiera mencionar que\ndurante la charla también se nos explicaron varias técnicas que se pueden hacer\npara lograr una sana convivencia con los gatos y lograr que los siti (…)\nacostumbren a estar en ciertos sitios mientras que se les puede restringir el\nacceso a otros por medio de barreras físicas, como el caso del tanque que se\nmenciona. (…)” (sic). Acto seguido, se comprueba que el 3 de marzo de 2023, a\ntravés del reporte denominado “Actividad de Apoyo a Plantel Uruca / Programa de\nBienestar Animal ANPA-UEN-GA”, la autoridad del Instituto accionado hizo constar\nque el 24 de febrero de 2023 llevaron a cabo una actividad en donde se realizó\nuna charla de ANPA, se expusieron los resultados de la implementación del\nprograma Castra-Libera y se hizo un recorrido a sitios que han presentado un\nproblema por residuos de animales silvestres en el plantel. Posteriormente, se\nconcluye que el 27 de noviembre de 2024, Larissa Seravalli Suárez, funcionaria\nde la Gerencia General del ICAA, envió un correo electrónico al personal de\ndicha autoridad, comunicando lo siguiente: “(…) 6. La Administración del\nPlantel, deberá realizar las gestiones pertinentes con la entidad competente\n(SENASA, ANPA, SINAC, etc) para que se realice una inspección en el sitio y se\nplantee una estrategia para reubicar a estos los animales en espacios controlados,\ncomo los refugios, centros de rescate, entre otros. PLAZO: 15-enero-2025. 7. ?Asimismo\nestá prohibida la colocación de comederos y bebederos para\nanimales dentro de las instalaciones del Plantel, así como alimentar animales dentro o fuera del plantel dentro de\nlas jornadas laborales, ya que estas actividades no forman parte de las\nfunciones ordinarias de los trabajadores del AyA; así las cosas, es responsabilidad de la Administración del Plantel fiscalizar el\ncumplimiento de esta instrucción,\ny deberá informar a la Administración Superior sobre la desobediencia de las\nmismas por parte de algún funcionario. PLAZO: Inmediato. 8. Con relación a la\nadopción de gatos, el plazo acordado con la Dirección Ambiental se mantiene.\n(…)” (sic). Más adelante, se tiene que el 9 de diciembre de 2024, la Asociación\nNacional Protectora de Animales (ANPA) emitió un documento denominado\n“Comunicado oficial sobre la gestión ética y humanitaria de la colonia de gatos\nen el plantel del AyA en La Uruca”, dirigido a dicha autoridad recurrida,\nrecomendando que no se den en adopción los felinos y sugiriendo dar continuidad\nal trabajo en el lugar. Después, se deduce que el 11 de diciembre de 2024,\nSulmericcia Hernández Rodríguez, funcionaria de la autoridad del ICAA, envió un\ncorreo electrónico a la Gerencia General del Instituto, comunicando lo\nsiguiente: “(…) Favor mantener los comederos de los animales en la periferia\ndel Plantel. La recomendación de ANPA es mantener los comedores en los lugares\nque se habían establecido para ese fin, no fuera de los planteles, ese cambio\nde ubicación ha provocado que dos de los especímenes se vean deteriorados, al\nser mayores y salir del perímetro de malla a tomar agua ni comer, tomar en\nconsideración de que si se enferman o mueren cómo puede afectar eso la imagen\ndel AyA, además de que va en contra de lo recomendado, se solicita replantear\nesta instrucción. * Durante la jornada laboral no es posible alimentar a los\nanimales, por cuanto no forma parte de las funciones propias del cargo de los\ntrabajadores de la Institución; pero fuera de la jornada, podrán alimentarlos,\nsi así lo tienen a bien, tomando en consideración las recomendaciones brindadas\npor ANPA * Todos los tiempos de alimentación no interfieren con la jornada\nlaboral. La alimentación la realizan en la hora de almuerzo y al final de la\njornada, la alimentación de la mañana se realiza antes de la hora de ingreso *\n• Con relación al punto anterior, la comida para estos animales no puede estar\ndentro de las instalaciones del Plantel para no atraer animales. No obstante,\npueden mantenerlos dentro de los vehículos automotores personales de los\nfuncionarios. * Las personas que responsablemente ha asumido el manejo y\ncontrol de la colonia de gatos no cuentan con automóviles donde guardar el\nalimento, y en caso de contar con un vehículo las temperaturas que alcanzan los\nautos al estar al sol deterioran los alimentos, para almacenaje del alimento\ncuentan con recipiente hermético y se encuentra ubicado dentro de una oficina\ndonde ningún animal tiene acceso. Se solicita replantear esta instrucción. * •\nEn el fuero personal de los trabajadores (es decir cuando concluyan su jornada\nlaboral) y del propio peculio pueden realizar las gestiones atinentes al\nPrograma CCL; sin embargo, para tales efectos no pueden hacer uso de activos\ninstitucionales o tiempo laboral, ya que esto no corresponde a labores\nordinarias de los funcionarios de la Institución. Las personas involucradas no\nutilizan activos ni tiempo laboral (el periodo de almuerzo no se incluye como\ntiempo laboral) * Con relación a las instalaciones, ya se están llevando a cabo\ninspecciones para hacer las mejoras que correspondan a fin de evitar que estos\nanimales ingresen al (…)” (sic). Seguidamente, se tiene por verificado que el\n13 de diciembre de 2024, Larissa Seravalli Suárez, funcionaria de la Gerencia\nGeneral del ICAA, respondió al correo electrónico citado supra de la siguiente\nmanera: “(…) En atención a su correo del 11 de diciembre de 2024, debemos\nindicarle que la Gerencia General mantiene lo instruido en el correo de la\nmisma fecha que antecede al suyo. Así las cosas, se le solicita respetuosamente\nproceder conforme. No se omite indicar que la desatención a estas instrucciones\npuede conllevar sanciones disciplinarias para los funcionarios responsables, de\nconformidad con los artículos 41 del Reglamento Autónomo de Servicio del\nInstituto Costarricense de Acueductos y Alcantarillados, 107, 108, 109 y 211 de\nla Ley General de Administración Pública y demás normativa concordante. (…)”. Ulteriormente,\nse constata que el 27 de febrero de 2025, ingresó una denuncia al Área Rectora\nde Salud de Carmen Merced Uruca, alegando una problemática en el Plantel del\nICAA con motivo de condiciones adversas de seguridad, higiene y malos olores,\ndebido a excremento y orines de gatos y mapaches. Luego, se verifica que el 8\nde abril de 2025, las autoridades sanitarias se apersonaron al sitio de los\nhechos denunciados a realizar una inspección, cuyos resultados se hicieron\nconstar en las actas número CMU-AI-38-2025 y CMU-AI-39-2025. Más adelante, se\ntiene por comprobado que el 20 de mayo de 2025, ingresó otra denuncia contra\nlas autoridades del ICAA, acusando la presencia de animales domésticos y\nsilvestres en las instalaciones del plantel citado. Seguidamente, se comprueba\nque el 7 de agosto de 2025, la autoridad de salud notificó al Instituto\naccionado las siguientes órdenes sanitarias: A) orden No.\nMS-DRRSCS-DARSCMU-IT-0548-2025 del 24 de abril de 2025, que evidenció que\nexiste acumulación de heces de origen animal en un techo cerca de las oficinas\nadministrativas, lo que incumple los artículos 39, 148 y 164 de la ley 5395; y\nB) orden No. MS-DRRSCS-DARSCMUOS-117-2025 del 3 de julio de 2025, que ordena al\nICAA, en el plazo máximo de 60 días hábiles, lo siguiente: “3.1 Eliminar de\nforma definitiva y permanente la acumulación de heces de animales presentes en\nel inmueble, principalmente aquellas observadas al momento de la inspección.\n3.2 Realizar una limpieza profunda y una desinfección del área afectada. 3.3 Implementar\nmedidas preventivas que eviten nuevamente la acumulación de heces. 3.4\nDocumentar mediante evidencias el cumplimiento de las medidas implementadas,\ndichas evidencias deberán estar disponibles en sitio para poder dar\ncumplimiento al presente punto.”. Luego, se acredita que el 20 de noviembre de\n2025, bajo hoja de visita número 0379513, las autoridades de SENASA\ndocumentaron los hallazgos encontraron durante una inspección realizada en el\nPlantel La Uruca en la misma fecha, determinando lo siguiente: “Se realiza\nvisita de inspección por presencia de gatos en el plantel. Se hace un\nrecorrido. Visitamos zona alrededor del comedor de colaboradores, entrada al\nplantel, área perimetral del tanque y área de rebombeo. No se percibe olor a\nheces u orina en las áreas mencionadas. En un parqueo se observan debajo de los\nvehículos 5 gatos, uno de ellos con salida de saliva de su boca. Se evidenció\npresencia de alimento en un área de entrada al plantel. Indica el guarda que\nvecinos externos ponen alimento cerca de la entrada. Se toman fotos. Cerca de\nla sala comedor vimos una litera con arena en uso”. Acto seguido, se tiene por\ndemostrado que, según el informe rendido por las autoridades del SENASA, como\nalgunas personas de la parte amparada proveen alimentación, control veterinario\ny colaboraron con el proceso de esterilización de la colonia de los gatos\nferales que habita en los alrededores del Plantel del ICAA, esto tiene, como\nresultado, obligaciones de bienestar y responsabilidad solidaria sobre estos animales.\nDespués, se concluye que, según el informe rendido por las autoridades del\nSENASA, el hecho de que esta población haya sido sometida a castración y reciba\ndesparasitación interna y externa, significa que no representan un riesgo\nsanitario para la salud pública ni un riesgo biológico. Por último, se\ndemuestra que, según el informe rendido por las autoridades del SENASA, el\nmétodo CCL (Captura–Castración–Retorno) es la única forma de control de\npoblaciones permitida en el ordenamiento jurídico costarricense, según el\nreglamento número 31626, así como la única que cumple el principio de no\nregresividad en bienestar animal; por ello, las medidas implementadas por el\nICAA de prohibición de alimentación dentro del plantel, reubicación de\nanimales, suspensión de atención veterinaria y retiro de acceso a áreas básicas\nde descanso, es contrario a un programa de control de poblaciones humanitario y\na la legislación vigente en materia de bienestar animal.\n\nAsí las cosas, se concluye la existencia de una\ntransgresión contra la protección constitucional al bienestar de los animales,\nestablecida vía jurisprudencial por este Tribunal, por parte de las autoridades\nrecurridas. En primera instancia, es posible constatar que la Gerencia General\ndel ICAA ordenó la prohibición de la alimentación a la colonia de gatos que\nhabita en sus instalaciones, así como la reubicación de dichos animales en\notros espacios a través de la adopción de estos; cuando el órgano técnico especializado\nen materia de fiscalización de bienestar animal en el caso de especies\ndomésticas -SENASA-, informó bajo juramento que, en el marco de un programa de\nCCL, estas medidas son contrarias a lo exigido en cuanto al control de\npoblaciones con mecanismos humanitarios y a la legislación vigente en materia\nde bienestar animal.\n\nBajo esta tesitura, merece la pena destacar que, aunque\nla representación del ICAA alega que lo desarrollado entre algunos de sus\nfuncionarios con ANPA no representa un programa institucional de carácter\noficial; lo cierto es que es evidente que hubo una aceptación por parte de las\nautoridades para que se fomentasen las actividades de captura, castración,\ncontrol veterinario, desparasitación, charlas y alimentación. Así, emitir una\norden de prohibición de cualquier actividad en este sentido conlleva una actuación\ncontraria a los estándares exigidos técnicamente en materia de bienestar\nanimal, según lo expuesto por SENASA, y limita la única metodología admitida en\nel ordenamiento jurídico costarricense para el control de especies.\n\nEn lo que respecta al problema de los desechos de estos\nanimales en el Plantel La Uruca -lo que comprende tanto a gatos como a\nmapaches-, se verifica que el Área Rectora de Salud de Carmen-Merced-Uruca\nemitió la orden sanitaria número MS-DRRSCS-DARSCMUOS-117-2025 en fecha 3 de\njulio de 2025, ordenando al ICAA eliminar la acumulación de heces de animales\npresentes en el inmueble, realizar una limpieza del área afectada e implementar\nmedidas preventivas que eviten la acumulación de estos desechos. También, es\nimportante considerar que, como lo informó SENASA, el hecho de que esta\npoblación haya sido sometida a castración y reciba desparasitación interna y\nexterna, significa que no representan un riesgo sanitario para la salud pública\nni un riesgo biológico. Por ello, pese a que intenten justificar la adopción o\nrelocalización de los gatos con motivo del problema bajo cuestión, en realidad\nlo procedente, para el Instituto accionado, es ejercer otro tipo de medidas de\nmitigación y limpieza para que los desechos de estos animales no ensucien el\nárea de trabajo respectiva.\n\nAhora bien, no escapa a la atención de esta Sala que la\nsituación expuesta por la parte recurrente apareja un grado de complejidad\nsignificativo, en el que deben considerarse aristas de protección al bienestar\nanimal, pero también de resguardo de la higiene del entorno de trabajo y de\nsalud ocupacional. Siendo así, a pesar de que las autoridades del SENASA son\nmuy claras en cuanto a la metodología que el ICAA debe seguir para proteger el\nbienestar de la colonia de gatos presente en el Plantel La Uruca, así como que\nse evidencia que realizaron una inspección en sitio y documentaron los\nhallazgos; no se desprende de la prueba en autos que hayan trabajado en\ncoordinación con el Instituto accionado para solventar la cuestión por la cual\nse acude en el presente amparo, lo cual representa una omisión en el ejercicio\nde sus funciones. Bajo este panorama, considerando que el caso que nos ocupa es\nun claro ejemplo de un supuesto en que es necesario aplicar el principio\nconstitucional de coordinación interadministrativa, que rige la relación entre\nlas distintas instituciones del Estado, con la finalidad de dar solución a la\nviolación a derechos fundamentales formulada en el presente recurso, es que lo\ncorrespondiente es ordenar a las autoridades del ICAA y del SENASA que\nplanifiquen y ejecuten una solución en conjunto para el asunto de la colonia de\ngatos en el Plantel La Uruca.\n\nPor ello, lo procedente es estimar este extremo del\nrecurso, en los términos que se expone en la parte dispositiva.\n\nVII.- EN CUANTO AL ESCRITO DEL 26 DE FEBRERO DE 2025.\nEn cuanto a este extremo del recurso -por la presunta violación del derecho a\nun procedimiento pronto y cumplido-, debe aclararse que, a partir de la\nsentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala\nha remitido a la jurisdicción contencioso administrativa -con algunas\nexcepciones-, aquellos asuntos en los que se discute si la administración\npública ha cumplido o no los plazos pautados por la Ley General de la\nAdministración Pública (artículos 261 y 325) o las leyes sectoriales para los\nprocedimientos administrativos especiales, para resolver por acto final un\nprocedimiento administrativo -instruido de oficio o a instancia de parte- o\nconocer de los recursos administrativos procedentes. Precisamente, en este\ncaso, se plantea un supuesto de excepción, pues se está ante una gestión\nadministrativa presentada por un grupo de los tutelados del presente amparo, en\nel que solicitan que se dé una solución a una situación que, en su criterio,\natenta contra el bienestar animal y contra la salud de los trabajadores del\nPlantel La Uruca, lo que se traduce en una petición para que se resuelva una\ndenuncia ambiental. Aclarado el punto, se entra a resolver la situación\nconcreta planteada en este recurso.\n\nDespués de analizar los elementos probatorios\naportados, este Tribunal verifica la lesión al derecho de procedimiento pronto\ny cumplido en sede administrativa. Del informe rendido por los representantes\nde la autoridad recurrida -que se tiene dado bajo fe de juramento con las\nconsecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige\nesta Jurisdicción- y del elenco probatorio, se tiene por acreditado que el 26\nde febrero de 2025, la presidencia ejecutiva de la autoridad recurrida recibió\nun documento físico presentado por un grupo de funcionarios de esta, explicando\nla problemática expuesta en el presente amparo sobre la colonia de gatos\nferales, la colonia de mapaches y las disposiciones del ICAA que, bajo su\ncriterio, atentan contra el bienestar de los animales; solicitando lo\nsiguiente: “1.- Que se permita colocar alimentos a los gatos en lugares\nespecíficos que no afecten las labores del Plantel, como se ha venido haciendo\ndesde hace muchos años, una vez alimentados se quitarían los platos. 2.- Que se\nrealicen los trabajos necesarios en la infraestructura del Plantel, para\nimpedir que los mapaches ingresen al cielo raso de las oficinas. 3.- Que se\natienda la situación de los mapaches con seriedad y responsabilidad, pero sobre\ntodo con empatía hacia ellos como animales silvestres que son.”. Acto seguido,\nse comprueba que el 26 de junio de 2026, a través de correo electrónico, el\npersonal del Instituto recurrido dio respuesta a la solicitud del 26 de febrero\nde 2026, indicando lo siguiente: A) que están cumpliendo lo exigido a través de\nla orden sanitaria número MS-DRRSCS-DARSCMU-OS-117-2025 del 3 de julio de 2025\ndel Ministerio de Salud; B) que están adoptando las siguientes acciones\ncorrectivas: “5. Realización de limpieza profunda de las áreas afectadas por\nheces de animales y desinfección de las oficinas comprometidas (Informe\nGG-CSA2025-03092). 6. Elaboración e implementación del Programa de Salud\nOcupacional del Plantel (Informe SO La Uruca, SG-GSGAM-2025-00388). 7. Gestión\nde mejoras en la infraestructura del Tanque La Uruca para evitar el ingreso de\nanimales, con evidencia fotográfica aportada al Ministerio de Salud (Memorando\nUEN-PyD-GAM-2025-00316). 8. Contacto con empresa especializada en manejo de\nfauna silvestre para una valoración técnica de la infraestructura y orientación\nsobre cierre de accesos y materiales adecuados.”; C) que contrataron asesoría\ntécnica especializada en fauna silvestre para i) implementar una modalidad de\nalimentación para los gatos ferales, que sea compatible con las exigencias\nsanitarias y ii) emplear un adecuado manejo de la colonia de mapaches, que sea\nrespetuoso de la legislación vigente en materia de bienestar animal; y D) que\nya están implementando mejoras en infraestructura en el tanque de agua y, pronto,\niniciarán con las reparaciones respectivas en el plantel.\n\nAsí las cosas, se concluye que existió una violación\ndel artículo 41 constitucional. Se determina que la denuncia presentada por la\nparte amparada el 26 de febrero de 2025, no fue atendida sino hasta el 26 de\njunio de 2026; esto es, 1 año y 4 meses después de entregada la gestión a la\nautoridad recurrida, lo cual excede desproporcionadamente el plazo de dos meses\nprevisto en el numeral 261 inciso 1 de la Ley General de la Administración\nPública, que determina que “El procedimiento administrativo deberá concluirse,\npor acto final, dentro de los dos meses posteriores a su iniciación o, en su\ncaso, posteriores a la presentación de la demanda o petición del administrado,\nsalvo disposición en contrario de esta Ley.” En razón de esas consideraciones,\ny siendo que la atención de la gestión de la parte tutelada se brindó con\nmotivo de la notificación a la autoridad accionada de la resolución que dio\ncurso al presente amparo -sea el 19 de junio de 2026-, lo procedente es\ndeclarar con lugar este extremo el recurso en los términos indicados por el\nartículo 52 de la Ley de la Jurisdicción Constitucional.\n\nVIII.- EN CUANTO A LA INSTALACIÓN DE CÁMARAS. Después\nde analizar los elementos probatorios aportados, este Tribunal descarta la\nlesión a los derechos fundamentales de la parte amparada. De la información\ndisponible en el elenco probatorio, únicamente se tiene por acreditado que, en\nmarzo de 2025, la autoridad recurrida instaló cámaras de seguridad dentro de\nlas instalaciones del Plantel La Uruca.\n\nEn primera instancia, resulta relevante hacer la\naclaración de que, en anteriores ocasiones, este Tribunal se ha referido al\nasunto de la instalación de cámaras de seguridad o de vigilancia en los centros\nde trabajo. Como ejemplo de ello, la resolución número 2013-013842 de las 9:15\nhoras del 18 de octubre de 2013 dispuso lo siguiente:\n\n“(…) En ese sentido, recuérdese que los precedentes de\neste Tribunal han permitido la instalación de este tipo de tecnología dentro de\ninstalaciones públicas, siempre y cuando tengan como fin el resguardo de los\nbienes institucionales y, en general, devengan en un medio adecuado para que la\nAdministración cumpla con sus fines, teniendo en cuenta que dichas cámaras no\npodrán ser ubicadas en lugares que comprometan la intimidad o pudor de las\npersonas…'.\n\nTal y como puede observarse pese la inexistencia de\nnormas regulen o establezcan criterios para el desarrollo de la captación de\ndatos mediante cámaras de seguridad, este Tribunal ha conocido y establecido\nalgunos límites con relación al uso de cámaras de seguridad en defensa del\nDerecho de Intimidad de particulares. De jurisprudencia de esta Sala, podría\ninferirse, que por regla general los dispositivos de vigilancia privada, a\ntravés de circuitos cerrados de televisión, podrían instalarse para la protección\nde ámbitos privados, sin invasión a zonas públicas o zonas privadas de otro\nrecintos fuera de la propiedad, lo anterior como ejercicio del derecho de\npropiedad, sin embargo, en algunos casos, en los cuales amerite, podrían\nhacerse excepciones, para que los campos de visión invadan espacios públicos\ncomo por ejemplo el perímetro del inmueble vigilado. Ahora bien en cuanto a la\nvigilancia en recintos públicos, se puede indicar que resulta aceptable la\ncolocación de cámaras de seguridad siempre y cuando el objetivo primordial sea\nel resguardo de la seguridad de personas y bienes (objeto lícito), dicha\ncolocación sea informado a los trabajadores de dicho recinto (información), no\nsean colocadas en lugares donde se desarrollen actividades privadas, como servicios\nsanitarios (resguardo de la intimidad), su acceso sea regulado, la grabación de\ndatos no se mantenga ad perpetuam, etc., entre otros que se pudieran\nestablecer. (…)”.\n\nEn ese sentido, merece la pena aclarar que la\ninstalación de cámaras en el lugar de trabajo, por sí sola, no implica una\ntransgresión al derecho a la imagen y a la intimidad. Según se extrae del\nprecedente citado supra, para que exista una violación a los derechos\nfundamentales, estos dispositivos deben estar dirigidos a un lugar dentro del\ncentro laboral que comprometa la dignidad o la intimidad de las personas, tales\ncomo los servicios sanitarios. Caso contrario, la instalación de estos\nartefactos tecnológicos será permitida para resguardar los bienes\ninstitucionales, que forman parte de la Hacienda Pública.\n\nEn el caso que nos ocupa, los alegatos de la parte\nrecurrente son genéricos, pues no exponen detalles de algún incidente concreto\nque, en su consideración, haya acaecido con ocasión de la instalación de las\ncámaras de seguridad en la institución recurrida. De igual manera, tampoco\nmanifiestan, concretamente, que estos artefactos se encuentren presentes en\nlugares que comprometan el derecho a la intimidad de las personas, lo que\nimplica que no es competencia de esta Sala emitir alguna valoración sobre esto.\nPor ende, lo procedente es declarar sin lugar este extremo del recurso.\n\nIX.- EN CUANTO AL MANEJO DE LA COLONIA DE MAPACHES.\nDespués de analizar los elementos probatorios aportados, este Tribunal constata\nla lesión a los derechos fundamentales de los amparados. Del informe rendido\nbajo fe de juramento y del elenco probatorio, se tiene por acreditado que la\nautoridad del ICAA es propietaria de un terreno que colinda al oeste con el\nPlantel La Uruca que, previamente, se utilizaba para el sembrado de café y\ncontaba con árboles de poró, donde ahora se construyó un tanque de almacenamiento\nde agua potable. Acto seguido, se concluye que hay presencia de una colonia de\nmapaches que quedó atrapada en el desarrollo constructivo del lugar citado\nsupra y que ingresa a las instalaciones del plantel, habiendo ocasionado\nincidentes por su acceso al cielorraso y a las oficinas. Posteriormente, se\ntiene que el 27 de febrero de 2025, ingresó una denuncia al Área Rectora de\nSalud de Carmen Merced Uruca, alegando una problemática en el Plantel del ICAA\ncon motivo de condiciones adversas de seguridad, higiene y malos olores, debido\na excremento y orines de gatos y mapaches. Luego, se deduce que, en febrero y\nmarzo de 2025, el personal de Salud Ocupacional del ICAA colocó, dentro del\nplantel de trabajo, carteles con la frase “Prohibido alimentar a los animales”\ny la silueta de un gato y un mapache. Ulteriormente, se tiene que, desde la\nsemana del 17 de marzo de 2025, el Instituto accionado contrató una empresa\npara cortar árboles dentro del Plantel y, así, evitar que los mapaches se\nalimenten de estos y aniden. Después, se tiene que el 8 de abril de 2025, las\nautoridades sanitarias se apersonaron al sitio de los hechos denunciados a\nrealizar una inspección, cuyos resultados se hicieron constar en las actas\nnúmero CMU-AI-38-2025 y CMU-AI-39-2025. Se acredita que a las 15:13 horas del\n10 de abril de 2025, la Dirección de Salud Ocupacional de la autoridad\nrecurrida del ICAA recibió el informe llamado “Atención de memorando\nPRE-J-2025-01402 Asunto: Recurso de Amparo. Informe sobre las acciones tomadas\npara la alimentación de gatos en el Plantel de la Uruca”, que emitió las\nsiguientes recomendaciones: “• A partir de lo expuesto en el apartado B de este\ncapítulo (Sustento científico-sanitario de la condición descrita) es muy\nrelevante la verdadera toma de conciencia del riesgo probable de\nmaterialización de una enfermedad en una o varias personas, lo cual, no solo\ntraería consigo la afectación en sí mismo de la persona sino el incumplimiento\nlegal a la normativa indicada en el apartado A de este capítulo (Sustento\nnormativo de la condición descrita. • Mantener el monitoreo constante de las\ninstalaciones coordinando mejoras en infraestructura que impidan el ingreso de\nanimales. • Intervenir el tema de aguas residuales, problemas en tuberías,\ncajas de registro, estado de servicios sanitarios para contribuir aún más con\nel tema de la salubridad del Plantel Carlos Segura.”. Posteriormente, se\ncomprueba que el 20 de mayo de 2025, ingresó otra denuncia contra las\nautoridades del ICAA, acusando la presencia de animales domésticos y silvestres\nen las instalaciones del plantel citado. Acto seguido, se demuestra que el 7 de\nagosto de 2025, la autoridad de salud notificó al Instituto accionado las\nsiguientes órdenes sanitarias: A) orden No. MS-DRRSCS-DARSCMU-IT-0548-2025 del\n24 de abril de 2025, que evidenció que existe acumulación de heces de origen\nanimal en un techo cerca de las oficinas administrativas, lo que incumple los\nartículos 39, 148 y 164 de la ley 5395; y B) orden No.\nMS-DRRSCS-DARSCMUOS-117-2025 del 3 de julio de 2025, que ordena al ICAA, en el\nplazo máximo de 60 días hábiles, lo siguiente: “3.1 Eliminar de forma\ndefinitiva y permanente la acumulación de heces de animales presentes en el\ninmueble, principalmente aquellas observadas al momento de la inspección. 3.2\nRealizar una limpieza profunda y una desinfección del área afectada. 3.3\nImplementar medidas preventivas que eviten nuevamente la acumulación de heces.\n3.4 Documentar mediante evidencias el cumplimiento de las medidas\nimplementadas, dichas evidencias deberán estar disponibles en sitio para poder\ndar cumplimiento al presente punto.”. Por último, se tiene que el 5 de febrero\nde 2026, a través del oficio número CARTA-SINAC-ACC-OSJ-0191-2026, las\nautoridades del SINAC manifestaron lo siguiente: A) que el artículo 93 de la\nLey de Conservación de la Vida Silvestre indica que será sancionado quien\ndestruya los nidos de la fauna silvestre sin autorización del Sistema Nacional\nde Áreas de Conservación; B) que tres factores que atraen a los mapaches son el\nalimento, el refugio y el agua, por lo que emite una serie de recomendaciones\npara evitar la visita de estos animales silvestres y solucionar la\nproblemática; C) que una de las indicaciones dadas al ICAA es cerrar los huecos\ny lugares donde los mapache puedan ingresar, lo que implica brindar un adecuado\nmantenimiento del techo, las tapias y el cielorraso, corrigiendo la existencia\nde cualquier grieta; y D) que existen técnicas para alejar a los mapaches que\nno les causan daño, tales como i) la combinación de pimienta roja, con\ncarbolina, naftalina o cloro en las áreas donde estos duermen, provocando que\nse vayan por su sensibilidad a los olores fuertes; y ii) la colocación de\nextensiones con bombillos, radios con sonidos fuertes, o cualquier otro\nartefacto que incomode su permanencia.\n\nAsí las cosas, se verifica la transgresión contra los\nordinales 21 y 50 de la Constitución Política, pues se comprueba que se\nmenoscabó, no solamente el derecho a la salud de los trabajadores del Plantel\nLa Uruca por la falta de acción para controlar la actividad de los mapaches en\nla zona; sino, también, la protección al bienestar animal y, por tanto, el\nderecho a un medio ambiente sano y ecológicamente equilibrado.\n\nSobre el primer punto en examen, se verifica que, en\nefecto, en el Plantel La Uruca de las autoridades del ICAA, hay presencia de\nuna colonia de mapaches que quedó atrapada en el desarrollo constructivo de la\nfinca colindante -lugar en el que se edificó un tanque de abastecimiento de\nagua- y que ingresa a las instalaciones del plantel, ocasionando incidentes por\nsu acceso al cielorraso y a las oficinas. Como ejemplo de ello, se cuenta con\nlas órdenes sanitarias número MS-DRRSCS-DARSCMU-IT-0548-2025 del 24 de abril de\n2025 y número MS-DRRSCS-DARSCMUOS-117-2025 del 3 de julio de 2025, las cuales\nevidenciaron la existencia de heces de origen animal en un techo de las\noficinas administrativas y, acto seguido, ordenaron la eliminación de los\ndesechos, la limpieza del área afectada y la implementación de medidas\npreventivas que eviten la acumulación de estos. Bajo este panorama, se\nevidencia que esta especie ocasionó una problemática a nivel de salud que\nderivó en una afectación los derechos fundamentales a las personas trabajadoras\ndel lugar citado, haciendo incurrir a las autoridades del ICAA en una omisión\nen el caso bajo estudio, por no haber dado una atención pronta a la\ncontaminación de esta colonia de una especie silvestre.\n\nAñadido a lo anterior, también se evidencia que las\nautoridades del ICAA transgredieron la protección constitucional a un medio\nambiente sano y ecológicamente equilibrado, así como al bienestar de los\nanimales, por cuanto el Instituto accionado admitió -en su informe rendido bajo\nfe de juramento- que la semana del 17 de marzo de 2025 contrató una empresa\npara cortar árboles dentro del Plantel, con la exclusiva finalidad de evitar\nque los mapaches se alimenten y habiten en estos. De conformidad con el oficio\nCARTA-SINAC-ACC-OSJ-0191-2026 del 5 de febrero de 2026, las autoridades del\nSINAC hicieron constar que estas acciones, además de implicar una actuación en\ncontravención directa contra el artículo 93 de la Ley de Conservación de la\nVida Silvestre, por haber resultado en la destrucción de nidos de fauna\nsilvestre sin autorización del Sistema Nacional de Áreas de Conservación;\ntambién son contrarias a las soluciones recomendadas por el órgano técnico al\nrespecto del manejo de las colonias de especies silvestres, dentro de lo que se\ncontemplan medidas de carácter menos agresivo, tales como las reparaciones en\ninfraestructura para evitar el ingreso de mapaches, la colocación de productos\nque alejen a estos animales por su sensibilidad a olores fuertes y la ubicación\nde artefactos con luz o sonido fuerte para incomodar su permanencia.\n\nAl igual que con el caso de la colonia de gatos, este\nTribunal estima pertinente manifestar a las autoridades recurridas que el\nprincipio constitucional de coordinación interadministrativa debe ser un\nprecepto fundamental que se mantenga en las actuaciones que brinden una\nsolución a la presente violación de derechos fundamentales, por tratarse de un\ncaso con un grado de complejidad significativo, en el que deben considerarse\naristas de protección al bienestar animal, pero asuntos de salud ocupacional en\nel entorno laboral. Así las cosas, en el informe rendido bajo fe de juramento,\nlas autoridades del SINAC indicaron que, durante el año 2025, atendieron\nsolicitudes relacionadas con la presencia de los mapaches en el Plantel La\nUruca, inclusive retirando animales y liberándolos en su hábitat natural; no\nobstante, no especifican en qué fechas y bajo qué circunstancias llevaron a\ncabo estas actuaciones. Ante este panorama, lo correspondiente es ordenar a las\nautoridades del ICAA y del SINAC que planifiquen y ejecuten una solución en\nconjunto para el asunto de la colonia de mapaches en el lugar en el que se\nacusan los hechos de este recurso.\n\n \n\nEn consecuencia, se declara con lugar este extremo del\nrecurso, en los términos que se indican en la parte dispositiva de la\nsentencia.\n\nX.- EN CUANTO A LA MUNICIPALIDAD DE SAN JOSÉ. Por otra\nparte, y, sin perjuicio de lo anterior, no se observan acciones u omisiones por\nparte de la autoridad municipal que ameriten la intervención de la Sala. Esto\nobedece a que, aunque existen criterios controvertidos en cuanto a las\nactuaciones que le correspondería efectuar al ente local, entre la\nMunicipalidad recurrida y el SENASA, al respecto de una colonia de animales que\ncareciese de dueño; lo cierto es que el propio Servicio Nacional de Salud Animal\nmanifiesta en su informe que, dadas las circunstancias de que algunas personas\nde la parte amparada proveyeron alimentación, control veterinario y colaboraron\ncon el proceso de esterilización de la colonia de los gatos ferales que habita\nen los alrededores del Plantel del ICAA, lo que tiene como resultado una\nobligación de responsabilidad solidaria sobre estos animales. En razón de lo\nanterior, procede desestimar el recurso contra la Municipalidad de San José.\n\nXI.- EN CUANTO AL ÁREA RECTORA DE SALUD CARMEN MERCED\nURUCA. Con motivo de que el área de salud recurrida dio respuesta a las\ndenuncias interpuestas contra la situación que es objeto del presente amparo,\nemitiendo las órdenes sanitarias respectivas en los casos que, bajo su criterio\ntécnico, así lo ameritaban, tampoco se observan acciones u omisiones que pongan\nen menoscabo los derechos fundamentales de los amparados por parte de este\nórgano. IT IS ALLEGED THAT THE COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS) PROHIBITED THE FEEDING OF A FERAL CAT (GATOS FERALES) COLONY AND FAILED TO ADOPT COMPREHENSIVE MEASURES FOR THE MANAGEMENT OF CATS AND RACCOONS AT THE PLANTEL LA URUCA FACILITY. IT IS FOUND THAT THERE WAS A FAILURE TO PROTECT ANIMAL WELFARE (BIENESTAR ANIMAL) AND THE HEALTH OF WORKERS. THE PETITION IS GRANTED AND THE DEVELOPMENT OF AN INTER-INSTITUTIONAL PLAN IS ORDERED WITHIN SIX MONTHS. VCG07/2026\n\n\"(…) IV.- RELEVANT JURISPRUDENTIAL PRECEDENTS.\nOn previous occasions, this Tribunal has addressed the constitutional protection afforded to animal welfare and the constitutionally legitimate limits on the duty to protect animal welfare. In this regard, resolution no. 13553-2016, issued at 11:30 a.m. on September 21, 2016, determined the following:\n\n\"III.- Constitutional protection of animal welfare. Although it is true that our constitutional text does not contain express provisions protecting animal welfare, as do countries such as Germany and Switzerland, the Constitutional Chamber (Sala Constitucional), through its jurisprudential development, has determined that the prohibition of animal mistreatment (maltrato animal) has constitutional grounding in the Costa Rican legal order, derived from Articles 28 and 50 of the Constitución Política. The Chamber has determined that human beings not only have a moral duty to act with respect to other people, but also in relation to the natural environment that surrounds us. In that sense, it has been held that animal mistreatment violates morality, public decency (buenas costumbres), and public order, and that it is moreover part of the right to a healthy and balanced environment. Reference may be made in this regard to rulings 1993-3705, 1995-5893, and undoubtedly the most emblematic, 2012-4620.\n\nIn that last decision, it is established that the inclusion of animals within the concept of the environment is based on the role they play in the development of human life, which makes them deserving of protection and dignified treatment. Thus, wildlife (fauna silvestre)—those animals that live without the immediate intervention of humans for their development or sustenance—are protected by virtue of the maintenance of biodiversity and the natural balance of species. For their part, domesticated fauna (fauna domesticada) or fauna in the process of domestication must be protected from suffering, mistreatment, and cruelty without legitimate justification, because this reflects an ethical rationality that attends to a growing awareness within the human species regarding the just and dignified manner in which it must interact with nature. Furthermore, it is established that:\n\n\"the rational—moral—superiority of mankind cannot mean an absence of limits on causing suffering, pain, or anguish to non-human sentient beings (seres sintientes)\".... \"In this context, precisely, animal mistreatment constitutes an act contrary to dignity, since the exercise of the latter entails a moral duty of action both with respect to other human beings and in relation to the natural environment that surrounds one. Hence it follows readily that animal mistreatment violates morality, public decency, and public order, and that its prohibition and prevention therefore becomes a matter of constitutional relevance.\" (ruling 2012-04620)\n\nThis jurisprudential line maintained by the Tribunal is consistent with that of other Constitutional Tribunals, such as that of Colombia, which has extensively developed the constitutional basis for the prohibition of animal mistreatment, including in its rulings C-666-10, C-083-14, and C-095-16. The Colombian Constitutional Court (Corte Constitucional Colombiana) indicates that the notion of animal welfare entails a limit and an obligation on human beings to act with respect toward animals, as they are sentient beings that form part of the context in which the lives of persons unfold. That Tribunal held that the protection of animals is realized from two perspectives:\n\n\"(…) that of fauna protected by virtue of the maintenance of biodiversity and the natural balance of species; and that of fauna which must be protected from suffering, mistreatment, and cruelty without legitimate justification, which latter protection reflects a content of political morality and awareness of the responsibility that human beings must have toward other sentient beings.\" (ruling C-095-16, Constitutional Tribunal)\n\nThat Tribunal indicates that a duty of constitutional rank for the State entails concrete obligations on the various branches of government to restrict support, sponsorship, or positive participation in acts involving animal mistreatment, in such a way that the State may not assume a neutral role in the development of the protection that must be afforded to animals. Likewise, grounded in human dignity, animal protection imposes obligations of respect on human beings toward sentient beings. Notwithstanding the existence of the duty to protect animal welfare, the Colombian Court endorsed certain legitimate limits, among which are: (i) the dietary habits of human beings, (ii) medical research and experimentation, and (iii) culture. In such cases, the legal practitioner (operador jurídico) must seek a harmonization in each specific case whenever there is tension between animal welfare and the limits on the duty of protection. Therefore, from the overriding interest in protecting the environment and fauna, there arises a duty to shield animals from suffering, mistreatment, and cruelty. From the relationship between nature and human beings, the moral status of animal life and the recognition of their capacity for suffering may be inferred; accordingly, they are understood to be sentient beings that give rise to a series of obligations on human beings of care and protection. From this constitutional duty arise obligations of care and prohibitions on mistreatment and cruelty toward animals, unless one of the indicated limits is involved.\n\nIV.-\nConstitutionally Legitimate Limits on the Duty to Protect Animal Welfare. Doctrine indicates that the duty of animal protection has certain legitimate limits, which include at least: (i) the dietary habits of human beings, (ii) medical research and experimentation, and (iii) culture. In such cases, the legal practitioner must seek a case-by-case harmonization whenever there is tension between the obligation to pursue animal welfare and the limits on the duty of protection. On this subject, ruling C-666-10 of the Constitutional Tribunal has stated:\n\n\"The principle of animal welfare yields to the dietary customs of the human species, in that the slaughter of animals for human consumption is permitted. However, the slaughter of animals in such cases must conform to established parameters aimed at eliminating any practice that entails avoidable suffering for the animal and, likewise, cruelty in slaughter procedures, demonstrating that, even in these cases, the constitutional duty is fully applicable to the relationship that humans maintain with animals. (iii) Medical research and experimentation. Law 84 of 1989 establishes a special chapter to regulate the conditions necessary for conducting experiments with animals. In this regard, it includes rules prohibiting the performance of such experiments when they result in mistreatment, when the animals are not placed under anesthesia—article 24—when live-animal experimentation is carried out as a means of illustration in lectures at faculties offering programs related to animal studies—article 25—; as well as rules requiring the existence of an ethics committee whenever an experiment is conducted with animals—article 26—.\"\n\n\"From the Constitution of 1991 onward, culture is not a secondary matter, nor can it constitute a privilege enjoyed only by some Colombians; rather, it must extend to all, on the understanding that, as one of the foundations of nationhood, its promotion, development, and dissemination is a matter that must enjoy the special attention of the State.\" Hence the Constitution's emphasis on obliging public authorities to assume a leading role in creating means of artistic expression that enable Colombians to identify as a nation through the recognition of their cultural characteristics. Therefore, \"there can be no doubt whatsoever about the clear constitutional mandate for the State to define and carry out a cultural policy that raises the artistic and intellectual level of all Colombians, a policy in which the promotion of activities aimed at achieving such ends will be essential pillars.\" The commitments of the Colombian State are derived not only from the Constitution, but also from those undertaken at the international level, among which are those arising from the International Covenant on Economic, Social and Cultural Rights of 1966, whose article 15 recognizes the right of all persons to participate in cultural life and to benefit from scientific progress and its applications, and the correlative duty of States to take the necessary measures for the conservation, development, and dissemination of science and culture. This provision reiterates what is established in articles 27 of the Universal Declaration of Human Rights of 1948, and XIII of the American Declaration of the Rights and Duties of Man, equally binding on Colombia. Up to this point, the manner of protecting and promoting the constitutional good of culture has been set forth. However, culture proves to be an abstract term whose protection and promotion is achieved through the protection and promotion of various manifestations, practices, and usages that society identifies as cultural expressions. It is important to emphasize that the notion of \"national culture\" is expressed through \"those traditions and canons commonly accepted as 'Colombian,' that is, those involving the practices and values that prevail in the national territory,\" without this meaning that the former prevails over or even nullifies the minority \"cultural expressions\" existing in Colombian territory, since from articles such as 7 and 70 of the Constitution it follows that all cultural expressions stand on equal footing before the Colombian legal order. And it is precisely the existence of different cultures—and, consequently, their different expressions—as well as different fundamental rights, constitutional goods, fundamental principles, and so forth, that cultural expressions, like other elements of constitutional protection, do not have an absolute value in the Colombian legal order, and their interpretation, with a view to concretizing the guarantee of their protection and development, must be made in harmony with all the elements that make up the constitutional landscape set out in the Constitution of 1991.\"\n\n\"Not all activities of human endeavor that express a personal vision of the world, that interpret reality or modify it through imagination, regardless of whether in their execution they resort to plastic, linguistic, bodily, or sound resources, can be considered by the legislator as artistic and cultural expressions of the State. Indeed, it must be recalled that, in accordance with the preamble and articles 1, 2, 4, and 13 of the Constitution, this Court has recognized that the legal criterion of reasonableness—as a limit on the power of normative configuration—entails the exclusion of any decision adopted by it that proves manifestly absurd, unjustified, or senseless, that is, one that departs entirely from the dictates of right reason, which would occur, for example, were one to attempt to categorize as artistic and cultural expressions of the State those human behaviors that solely and exclusively manifest acts of violence or perversion (e.g., pornography, voyeurism, and sadism), which, in addition to being considered injurious to the fundamental values of society, disregard fundamental principles and rights such as human dignity and the prohibition of cruel treatment.\"\n\nOn this specific subject, ruling 2012-4620 of this Chamber also recognizes human self-consumption and culture as legitimate limits on animal protection. In the relevant part, it stated:\n\n\"Now, as noted, the protection of animal health is ultimately defined in terms of the human being himself. Consequently, it is valid to limit the extent of the protective spectrum afforded to animals in consideration of other legally relevant interests of human beings. In particular, the slaughter of animals destined for human consumption and use is an evident limit on the duty of animal protection, insofar as animal-derived products constitute essential elements of the human diet and clothing. Likewise, reference must be made to medical research and experimentation with animals, as this constitutes a fundamental element for the development of medications and treatments for the benefit of human health. Similarly, the traditions of the Costa Rican people (pueblo costarricense), whose protection is inferred from article 89 of the Constitución Política, are the subject of protection as values belonging to the cultural heritage (acervo cultural) of the nation.\"\n\n \n\nIn like manner, at the international level there is a trend toward expanding the scope of the duty to protect animal welfare. Among the relevant Conventions and Declarations are:\n\nThe Universal Declaration of Animal Rights (Declaración Universal de los Derechos de los Animales). It enshrines the right to existence, to respect, to the prohibition of extermination, exploitation, or cruelty, and the obligation of care and protection on the part of human beings (arts. 1 to 3).\n\nConvention on Biological Diversity (Convenio sobre la Diversidad Biológica). It seeks the adoption of strategies and policies for the conservation and sustainable use of biodiversity; its sustainable use must be taken into account in national decision-making processes, and States Parties are obligated to restore threatened species and protect those facing extinction.\n\nThe Stockholm Declaration on the Human Environment (Declaración de Estocolmo sobre el Medio Ambiente Humano) states that the human, natural, and artificial environment are essential for the well-being and enjoyment of the fundamental human rights of human beings, including fauna within the scope of protection as follows:\n\n\"Principle 2. The natural resources of the Earth, including the air, water, land, flora and fauna and especially representative samples of natural ecosystems, must be safeguarded for the benefit of present and future generations through careful planning or management, as appropriate.\"\n\nFor its part, General Comment No. 14 of the Committee on Economic, Social and Cultural Rights recognized that the environment constitutes a necessary means for the realization of human life on the planet. Specifically:\n\n\"(...) the reference in article 12, paragraph 1, of the Covenant to 'the highest attainable standard of physical and mental health' is not confined to the right to health care. On the contrary, the travaux préparatoires and the express wording of article 12, paragraph 2, acknowledge that the right to health embraces a wide range of socioeconomic factors that promote conditions in which people can lead a healthy life, and extends to the underlying determinants of health, such as food and nutrition, housing, access to safe and potable water and adequate sanitation, safe and healthy working conditions, and a healthy environment.\"\n\nAlso, the Ramsar Convention (Convenio de Ramsar) seeks to safeguard wetlands as productive and diverse ecosystems that provide, among other benefits, drinking water; pursuant to this Convention, States Parties undertake to:\n\nwork toward the wise use of all wetlands within their territory;\n\ndesignate suitable wetlands for the List of Wetlands of International Importance (the \"Ramsar List\") and ensure their effective management;\n\ncooperate at the international level regarding transboundary wetlands, shared wetland systems, and shared species.\n\nIn accordance with the foregoing rules, constitutional jurisprudence has established that the environment is a fundamental constitutional right for human beings, since without it, life would lose its validity.\"\n\nIn the same vein, other Tribunals in our jurisdiction have recognized the State's obligation to protect animals on account of their importance within the ecosystem, the prohibition on the mistreatment of these species, as well as their recognition as sentient beings, reiterating what this Chamber has held on previous occasions. Thus, resolution no. 01754-2021, issued at 14:06 hours on October 12, 2021, by the First Chamber of Cassation (Sala Primera de Casación) of the Supreme Court of Justice (Corte Suprema de Justicia), determined the following:\n\n\"IX. Prior to addressing the grievance, this Chamber considers it timely to make the following analysis. As the Tribunal aptly noted in the ruling under study, at the global level, the legal system has been evolving with respect to the nature and welfare of animals so as to establish, in various ways, the responsibility of human beings to promote, pursue, and execute the protection of the environment, and within it, animals. This is evidenced, for example, in various international instruments such as the European Conventions for the Protection of Animals, the Universal Declaration of Animal Rights, the Convention on Biological Diversity, and the Stockholm Declaration on the Human Environment. In the same vein, the Inter-American Court of Human Rights (Corte Interamericana de Derechos Humanos), through Advisory Opinion OC-23-17 of November 15, 2017, referring to the obligations of respect and guarantee of human rights established in the American Convention on Human Rights (Convención Americana de Derechos Humanos), stated: '62. This Court considers it important to emphasize that the right to a healthy environment as an autonomous right, unlike other rights, protects the components of the environment, such as forests, rivers, seas, and others, as legal interests in themselves, even in the absence of certainty or evidence of risk to specific individuals. The point is to protect nature and the environment not only because of their connection to usefulness for human beings or because of the effects that their degradation could have on other rights of persons, such as health, life, or personal integrity, but because of their importance for other living organisms with whom we share the planet, which are equally deserving of protection in themselves. In this sense, the Court notes a trend toward recognizing legal personhood and, therefore, rights for nature not only in judicial rulings but even in constitutional systems.' (Emphasis added). In keeping with the foregoing, various countries around the world have enacted legislation in which animals are contemplated and recognized as sentient beings or non-human persons (Mexico, France, and Portugal), and some have explicitly recognized in their constitutions the right to protection (Germany and Luxembourg) and to dignity (Switzerland) for these beings. In that context, the role played by jurisdictional bodies is decisive in making that protection effective, and adjudicators must lean toward the pursuit of true ecological justice. Along these lines, rulings have been issued recognizing rights for natural entities such as the Whanganui (New Zealand), Ganges (India), and Atrato (Colombia) rivers, and for animals such as the orangutan Sandra (Argentina). Costa Rica has not been an exception in this recognition, as evidenced by the various protective statutes enacted, such as the Wildlife Conservation Law (Ley de Conservación de Vida Silvestre), No. 7317; the Animal Welfare Law (Ley de Bienestar de los Animales), No. 7451; the General Animal Health Services Law (Ley General del Servicio de Salud Animal), No. 8495; and the sanctioning system regulated by the Penal Code (Código Penal), No. 4573. And in the judicial sphere, the Constitutional Chamber has likewise traced a jurisprudential line oriented toward transcending anthropocentric reasoning, in keeping with the Inter-American Court of Human Rights as quoted above, with an evident firmness in the protection of the environment and of animals that this Chamber shares. In that regard, resolution 13553-2016, issued at eleven-thirty a.m. on September twenty-one, two thousand sixteen, even before the Animal Welfare Law was enacted, stated: 'III.- Constitutional protection of animal welfare. Based on the foregoing, the constitutional body further stated, it is evident that there exists a mandate at the constitutional and legal level to regulate animal protection, a position that this Chamber recognizes and reaffirms.\"\n\nV.- ON THE PRINCIPLE OF INTER-ADMINISTRATIVE COORDINATION (COORDINACIÓN INTERADMINISTRATIVA). One of the governing principles of administrative organization is the coordination that must exist among all public entities and bodies in the exercise of their competencies and in the provision of the services assigned to them by the legal order. Coordination, insofar as it ensures administrative efficiency and effectiveness, is a virtual or implicit constitutional principle that permeates the entire administrative legal order and is binding on all public entities. Coordination may be inter-organ (coordinación interorgánica)—among the various bodies that make up a public entity not subject to a hierarchical relationship among themselves—or inter-entity (coordinación intersubjetiva), that is, among public entities, each with its own legal personality, budget, autonomy, and specific competencies. The administrative autonomy or other degree thereof enjoyed by public entities obligates them to coordinate their actions, since they cannot be mutually subjected to hierarchical relationships by reason of their inter-entity nature. The purpose of administrative coordination is to avoid duplication and omissions in the exercise of the administrative functions of each public entity, that is, to ensure that those functions are carried out in a rational and orderly manner. Coordination is achieved through the establishment of fluid and permanent levels or channels of information among public entities, all of which can be accomplished through meetings, reports, or the creation of formal coordination bodies.\n\nVI.- REGARDING THE CAT COLONY. After analyzing the evidentiary elements submitted, this Court finds a violation of fundamental rights. From the report submitted by the representatives of the respondent authority — which is deemed to have been given under oath, with the consequences, including criminal ones, provided for in Article 44 of the Law governing this Jurisdiction — and from the body of evidence (elenco probatorio), it is established that the protected parties (amparados) [Nombre 010], national identity card (cédula de identidad) [Valor 010], [Nombre 004], national identity card [Valor 004], [Nombre 005], national identity card [Valor 005], and [Nombre 003], national identity card [Valor 003], are all employees of the respondent authority. Furthermore, it is verified that on December 10, 2021, Gisela Vico Pesch, an employee of the Asociación Nacional Protectora de Animales (ANPA), sent an email to employees of the respondent Institute, stating the following: \"(…) Following the visit made today to the AyA facility in La Uruca, we would like to request your support in arranging the loan of a space to carry out the c (…) employees of the AyA facility La Uruca (Carlos Segura) and the Bandera Azul Ecológica program of AyA's Environmental Directorate. The space requirements are: comfortable, spacious, with good lighting, electricity, access to water, and preferably cool. During the visit, we saw that the plumbing school could be the ideal location — both the large classroom and the adjacent one, which we were told is somewhat smaller, but cou (…) The space would be used on Friday the 17th, Saturday the 18th, and Sunday the 19th of December to safely store all the equipment for the trapping operations. On Monday the 22nd, the trappings would take place and, if possible, the neutering procedures would also be performed that same day in that space. The trapped felines must remain there that day and will be released on Tuesday the 22nd of December. If the return of the program's equipment to ANPA can be coordinated that same day, that would be the last day of the space loan; otherwise, it would be until it can be coor (…) We hope it will be possible to loan this space to carry out such an important program, which benefits not only public health and the employees who work in (…).\" (sic). It is then established that on June 9, 2022, María del Mar Solano Arce, an ICAA employee, sent an email to other employees of that respondent authority, stating the following: \"(…) As some of you already know, last year a neutering activity was carried out for the cats at the Facility, during which, thanks to the generous financial contribution of (…) professionals from the Asociación Nacional de Protección Animal (ANPA), it was possible to neuter the entirety of the feral cat colony (colonia de gatos ferales) at the Facility. As part of this activity, ANPA also gave an educational talk, which some facility employees attended. During this talk, the ex (…) we learned that these colonies establish themselves in sites that have historically, over long periods of time, been 'dumping grounds' for cats, where people from the surrounding communities (…) Unfortunately, the Facility is one of those sites, so regardless of whether they are fed or not, the problem will persist as long as unscrupulous individuals keep passing the problem on to others (…) On the other hand, the expert explained to us that as long as an established colony exists in the place, this prevents the arrival of more animals, since they defend their territory and thus do not (…) keeping the colony there prevents the arrival of more cats, while removing it would lead to a new colonization in a short time due to the abandonment problem at the aforementioned site (…) Finally, I would like to mention that during the talk we were also taught various techniques that can be employed to achieve a harmonious coexistence with cats and to get the sit (…) accustomed to being in certain areas while access to others can be restricted through physical barriers, such as the case of the tank mentioned. (…)\" (sic). Next, it is verified that on March 3, 2023, through the report entitled \"Actividad de Apoyo a Plantel Uruca / Programa de Bienestar Animal ANPA-UEN-GA,\" the authority of the respondent Institute recorded that on February 24, 2023, they carried out an activity in which ANPA gave a talk, the results of the implementation of the Castra-Libera program were presented, and a walkthrough was conducted of sites that had exhibited problems with wild animal waste at the facility. Subsequently, it is established that on November 27, 2024, Larissa Seravalli Suárez, an employee of ICAA's General Management, sent an email to that authority's staff, communicating the following: \"(…) 6. The Facility Administration must carry out the relevant steps with the competent entity (SENASA, ANPA, SINAC, etc.) so that an inspection of the site is performed and a strategy is proposed to relocate these animals to controlled spaces, such as shelters, rescue centers, and the like. DEADLINE: January 15, 2025. 7. Likewise, the placement of food and water dispensers for animals within the Facility premises is prohibited, as is feeding animals inside or outside the facility during working hours, as these activities do not form part of the ordinary functions of AyA workers; accordingly, it is the responsibility of the Facility Administration to supervise compliance with this instruction and to report to Senior Management any non-compliance on the part of any employee. DEADLINE: Immediate. 8. Regarding cat adoption, the deadline agreed upon with the Environmental Directorate remains in effect. (…)\" (sic). Subsequently, it is established that on December 9, 2024, the Asociación Nacional Protectora de Animales (ANPA) issued a document entitled \"Comunicado oficial sobre la gestión ética y humanitaria de la colonia de gatos en el plantel del AyA en La Uruca,\" addressed to that respondent authority, recommending that the felines not be offered for adoption and suggesting that the work at the site be continued. Thereafter, it is inferred that on December 11, 2024, Sulmericcia Hernández Rodríguez, an ICAA employee, sent an email to the Institute's General Management, communicating the following: \"(…) Please keep the animal feeders on the perimeter of the Facility. ANPA's recommendation is to keep the feeders in the locations that had been established for that purpose — not outside the facilities — as this change in location has caused two of the specimens to deteriorate, since they are older and cross the mesh perimeter to drink water or eat. Please consider how the Institution's public image could be affected if they become ill or die, in addition to the fact that this goes against the recommendations made; a reconsideration of this instruction is requested. * During working hours, it is not possible to feed the animals, as this does not form part of employees' ordinary job duties; however, outside of working hours, employees may feed them if they so choose, taking into account the recommendations provided by ANPA. * All feeding times are outside working hours. Feeding takes place during the lunch break and at the end of the workday; morning feeding is done before the start of the workday. * • Regarding the preceding point, food for these animals cannot be kept inside the Facility premises so as not to attract animals. However, it may be kept inside employees' personal vehicles. * The individuals who have responsibly assumed the management and care of the feral cat colony do not have vehicles in which to store the food, and in the event that they do have a vehicle, temperatures inside cars parked in the sun cause food to spoil; for food storage, they use an airtight container kept inside an office where no animal has access. A reconsideration of this instruction is requested. * • In their personal time (i.e., once their working hours have concluded) and at their own expense, employees may carry out activities related to the CCL Program; however, they may not use institutional assets or working time for such purposes, as this does not correspond to the ordinary duties of the Institution's employees. The individuals involved do not use institutional assets or working time (the lunch break is not included as working time). * Regarding the facilities, inspections are already being carried out to make the appropriate improvements to prevent these animals from entering the (…)\" (sic). Immediately thereafter, it is verified that on December 13, 2024, Larissa Seravalli Suárez, an employee of ICAA's General Management, replied to the email cited above as follows: \"(…) In response to your email of December 11, 2024, we must inform you that General Management maintains the instructions set out in the email of the same date preceding yours. Accordingly, you are respectfully requested to proceed accordingly. It should not go unmentioned that failure to comply with these instructions may result in disciplinary sanctions for the responsible employees, in accordance with Articles 41 of the Reglamento Autónomo de Servicio del Instituto Costarricense de Acueductos y Alcantarillados, 107, 108, 109, and 211 of the Ley General de Administración Pública and other applicable regulations. (…).\" Subsequently, it is established that on February 27, 2025, a complaint was filed with the Área Rectora de Salud de Carmen Merced Uruca, alleging problems at the ICAA Facility stemming from adverse safety and hygiene conditions and foul odors caused by cat and raccoon feces and urine. It is then verified that on April 8, 2025, health authorities attended the reported site to conduct an inspection, the results of which were recorded in reports number CMU-AI-38-2025 and CMU-AI-39-2025. Furthermore, it is established that on May 20, 2025, another complaint was filed against the ICAA authorities, reporting the presence of domestic and wild animals at the aforementioned facility premises. It is then verified that on August 7, 2025, the health authority notified the respondent Institute of the following sanitary orders (órdenes sanitarias): A) order No. MS-DRRSCS-DARSCMU-IT-0548-2025 of April 24, 2025, which found that there is an accumulation of feces of animal origin on a roof near the administrative offices, in violation of Articles 39, 148, and 164 of ley 5395; and B) order No. MS-DRRSCS-DARSCMUOS-117-2025 of July 3, 2025, which orders ICAA, within a maximum period of 60 business days, to do the following: \"3.1 Definitively and permanently eliminate the accumulation of animal feces present on the premises, particularly those observed at the time of the inspection. 3.2 Perform a thorough cleaning and disinfection of the affected area. 3.3 Implement preventive measures to prevent the renewed accumulation of feces. 3.4 Document through evidence the compliance with the measures implemented; said evidence must be available on site to enable compliance with this point.\" It is then established that on November 20, 2025, under visit sheet number 0379513, SENASA authorities documented the findings from an inspection conducted at Plantel La Uruca on the same date, determining the following: \"An inspection visit is conducted due to the presence of cats at the facility. A walkthrough is performed. We visit the area around the employees' cafeteria, the facility entrance, the perimeter area of the tank, and the repumping area. No odor of feces or urine is detected in the aforementioned areas. In a parking area, 5 cats are observed under vehicles, one of them with saliva coming from its mouth. The presence of food was observed at an area at the facility entrance. The security guard states that outside neighbors place food near the entrance. Photos are taken. Near the cafeteria area, we observed a litter box with sand in use.\" Next, it is established that, according to the report submitted by SENASA authorities, since some members of the protected party provide food and veterinary care and collaborated with the sterilization process of the feral cat colony living around the ICAA Facility, this results in animal welfare (bienestar animal) obligations and joint responsibility (responsabilidad solidaria) over these animals. It is then concluded that, according to the report submitted by SENASA authorities, the fact that this population has been subjected to neutering and receives internal and external antiparasitic treatment (desparasitación) means that they do not represent a public health risk or a biological hazard. Finally, it is established that, according to the report submitted by SENASA authorities, the CCL method (Captura–Castración–Retorno) is the only form of population control permitted under Costa Rican law, pursuant to regulation number 31626, as well as the only one that complies with the non-regression principle (principio de no regresividad) in animal welfare; therefore, the measures implemented by ICAA — prohibiting feeding within the facility, relocating animals, suspending veterinary care, and removing access to basic resting areas — are contrary to a humane population control program and to current legislation on animal welfare.\n\nAccordingly, the existence of a violation of the constitutional protection of animal welfare, established through the case law of this Court, by the respondent authorities is concluded. In the first instance, it is possible to establish that ICAA's General Management ordered a prohibition on feeding the feral cat colony living at its facilities, as well as the relocation of those animals to other spaces through adoption; when the technical body specialized in the oversight of animal welfare for domestic species — SENASA — reported under oath that, in the framework of a CCL program, these measures are contrary to what is required regarding population control through humane mechanisms and to current legislation on animal welfare.\n\nIn this regard, it is worth noting that, although ICAA's legal representation argues that what was developed between some of its employees and ANPA does not constitute an official institutional program, the truth is that it is evident that the authorities accepted the promotion of trapping, neutering, veterinary care, antiparasitic treatment, educational talks, and feeding activities. Thus, issuing an order prohibiting any activity in this regard constitutes conduct contrary to the technical standards required in the area of animal welfare, as stated by SENASA, and restricts the only methodology permitted under Costa Rican law for species population control.\n\nRegarding the problem of waste from these animals at Plantel La Uruca — which encompasses both cats and raccoons — it is verified that the Área Rectora de Salud de Carmen-Merced-Uruca issued sanitary order number MS-DRRSCS-DARSCMUOS-117-2025 on July 3, 2025, ordering ICAA to permanently eliminate the accumulation of animal feces on the premises, to clean the affected area, and to implement preventive measures to prevent the accumulation of such waste. It is also important to consider that, as reported by SENASA, the fact that this population has been subjected to neutering and receives internal and external antiparasitic treatment means that they do not represent a public health risk or a biological hazard. Therefore, despite attempts to justify the adoption or relocation of the cats on account of the problem in question, what is actually required of the respondent Institute is to employ other types of mitigation and cleaning measures to prevent the waste from these animals from contaminating the respective work area.\n\nThat said, this Court does not overlook the fact that the situation described by the petitioning party involves a significant degree of complexity, in which considerations of animal welfare protection must be balanced with safeguarding workplace hygiene and occupational health. As such, even though SENASA authorities are very clear regarding the methodology that ICAA must follow to protect the welfare of the feral cat colony at Plantel La Uruca, and even though they conducted an on-site inspection and documented the findings, it does not follow from the evidence in the record that they worked in coordination with the respondent Institute to resolve the issue that gave rise to this amparo petition (recurso de amparo), which constitutes an omission in the exercise of their duties. In light of this situation, and considering that the case before us is a clear example of an instance in which it is necessary to apply the constitutional principle of inter-institutional coordination (coordinación interadministrativa), which governs the relationship among the various State institutions, with the aim of resolving the violation of fundamental rights raised in this petition, the appropriate course of action is to order the ICAA and SENASA authorities to jointly plan and implement a solution to the issue of the feral cat colony at Plantel La Uruca.\n\nTherefore, the appropriate course of action is to uphold this aspect of the petition on the terms set forth in the operative section.\n\nVII.- REGARDING THE DOCUMENT OF FEBRUARY 26, 2025. With respect to this aspect of the petition — concerning the alleged violation of the right to a prompt and effective proceeding (procedimiento pronto y cumplido) — it must be clarified that, beginning with decision No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Court has referred to the administrative contentious jurisdiction — with some exceptions — those matters in which it is disputed whether the public administration has or has not complied with the deadlines established by the Ley General de la Administración Pública (Articles 261 and 325) or by sectoral laws for special administrative proceedings, in order to resolve, by means of a final administrative act (acto final), an administrative proceeding — initiated ex officio or at the request of a party — or to address applicable administrative appeals. Precisely, an exceptional case is presented here, as we are dealing with an administrative submission made by a group of the protected individuals in this amparo petition, in which they request that a solution be provided to a situation that, in their view, threatens animal welfare and the health of the workers at Plantel La Uruca, which amounts to a request for resolution of an environmental complaint. With this point clarified, the Court proceeds to resolve the specific situation raised in this petition.\n\nAfter analyzing the evidentiary elements submitted, this Court verifies the violation of the right to a prompt and effective proceeding in the administrative venue (sede administrativa). From the report submitted by the representatives of the respondent authority — deemed to have been given under oath, with the consequences, including criminal ones, provided for in Article 44 of the Law governing this Jurisdiction — and from the body of evidence, it is established that on February 26, 2025, the Executive Presidency (presidencia ejecutiva) of the respondent authority received a physical document submitted by a group of its employees, explaining the issue set forth in this amparo petition regarding the feral cat colony, the raccoon colony, and ICAA's directives that, in their view, threaten animal welfare; and requesting the following: \"1. That the placement of food for the cats in specific locations that do not interfere with the Facility's operations be permitted, as has been done for many years, with the dishes removed once feeding is complete. 2. That the necessary work be carried out on the Facility's infrastructure to prevent raccoons from entering the ceiling space above the administrative offices. 3. That the situation of the raccoons be addressed seriously and responsibly, but above all with empathy toward them as the wild animals that they are.\" Next, it is verified that on June 26, 2026, via email, staff of the respondent Institute responded to the request of February 26, 2026 [sic], stating the following: A) that they are complying with what is required under sanitary order number MS-DRRSCS-DARSCMU-OS-117-2025 of July 3, 2025, of the Ministry of Health; B) that they are adopting the following corrective actions: \"5. Thorough cleaning of the areas affected by animal feces and disinfection of the compromised offices (Informe GG-CSA2025-03092). 6. Development and implementation of the Occupational Health Program for the Facility (Informe SO La Uruca, SG-GSGAM-2025-00388). 7. Management of infrastructure improvements at the Tanque La Uruca to prevent animal entry, with photographic evidence submitted to the Ministry of Health (Memorando UEN-PyD-GAM-2025-00316). 8. Contact with a company specializing in wildlife management for a technical assessment of the infrastructure and guidance on access closures and appropriate materials.\"; C) that they retained specialized technical consultants in wildlife to i) implement a feeding arrangement for the feral cats that is compatible with sanitary requirements, and ii) properly manage the raccoon colony in a manner consistent with current legislation on animal welfare; and D) that infrastructure improvements at the water tank are already being implemented and that the corresponding repairs at the facility will commence shortly.\n\nAccordingly, it is concluded that a violation of Article 41 of the Constitution occurred. It is determined that the complaint submitted by the protected party on February 26, 2025, was not addressed until June 26, 2026 — that is, 1 year and 4 months after the submission was delivered to the respondent authority — which disproportionately exceeds the two-month period established in Article 261, paragraph 1, of the Ley General de la Administración Pública, which provides that \"The administrative proceeding must be concluded, by final administrative act, within the two months following its initiation or, where applicable, following the submission of the request or petition by the administered party, unless this Law provides otherwise.\" For these reasons, and given that the protected party's submission was addressed as a result of notification to the respondent authority of the decision that admitted the present amparo petition for processing — that is, on June 19, 2026 — the appropriate course of action is to uphold this aspect of the petition on the terms indicated by Article 52 of the Ley de la Jurisdicción Constitucional.\n\nVIII.- REGARDING THE INSTALLATION OF CAMERAS. After analyzing the evidentiary elements submitted, this Court finds no violation of the fundamental rights of the protected party. From the information available in the body of evidence, it is only established that in March 2025, the respondent authority installed security cameras within the premises of Plantel La Uruca.\n\nIn the first instance, it is relevant to clarify that on previous occasions this Court has addressed the matter of the installation of security or surveillance cameras in the workplace. As an example, decision number 2013-013842 of 9:15 a.m. on October 18, 2013 provided the following:\n\n\"(…) In that regard, it should be recalled that the precedents of this Court have permitted the installation of this type of technology within public facilities, provided that its purpose is the safeguarding of institutional assets and, in general, that it constitutes an appropriate means for the Administration to fulfill its objectives, bearing in mind that such cameras may not be placed in locations that would compromise the privacy or modesty of persons…'\n\nAs can be observed, notwithstanding the absence of rules governing or establishing criteria for the collection of data through security cameras, this Court has addressed and established certain limits regarding the use of security cameras in defense of individuals' Right to Privacy. From this Court's case law, it could be inferred that, as a general rule, private surveillance devices operating through closed-circuit television systems may be installed to protect private spaces without encroaching on public areas or the private areas of other premises outside the property — the foregoing as an exercise of the right to property — however, in some cases where warranted, exceptions could be made to allow fields of view to extend into public spaces, such as the perimeter of the monitored property. Regarding surveillance in public premises, it may be stated that the placement of security cameras is acceptable provided that the primary objective is the protection of the safety of persons and property (lawful purpose), that said placement is disclosed to the workers at the premises (notification), that cameras are not placed in locations where private activities take place, such as restrooms (protection of privacy), that access to them is regulated, that data recordings are not retained indefinitely, and that other conditions that may be established are observed. (…).\"\n\nIn this regard, it is worth clarifying that the installation of cameras in the workplace does not, in and of itself, constitute a violation of the right to one's image and privacy. As derived from the precedent cited above, for a violation of fundamental rights to exist, these devices must be directed at a location within the workplace that compromises the dignity or privacy of individuals, such as restrooms. Otherwise, the installation of such technological devices will be permitted for the purpose of safeguarding institutional assets that form part of the public treasury (Hacienda Pública).\n\nIn the case before us, the petitioning party's allegations are generic, as they do not set out the details of any specific incident that, in their view, occurred in connection with the installation of security cameras at the respondent institution. Likewise, they do not specifically allege that these devices are present in locations that compromise individuals' right to privacy, which means that it falls outside the competence of this Court to issue any assessment in this regard. Therefore, the appropriate course of action is to dismiss this aspect of the petition.\n\nIX.- REGARDING THE MANAGEMENT OF THE RACCOON COLONY.\n\nAfter analyzing the evidentiary elements submitted, this Tribunal finds a violation of the fundamental rights (derechos fundamentales) of the protected parties (amparados). From the report submitted under oath (informe rendido bajo fe de juramento) and the evidentiary record, it is established as proven that the ICAA authority owns a parcel of land that borders to the west the Plantel La Uruca—previously used for coffee cultivation and containing poró trees—where a drinking-water storage tank has now been built. It is further concluded that there is a raccoon colony (colonia de mapaches) that became trapped within the construction development at the above-mentioned location and enters the facility (plantel) premises, having caused incidents due to its access to the dropped ceiling (cielorraso) and offices. Subsequently, it is established that on February 27, 2025, a complaint was filed with the Área Rectora de Salud de Carmen Merced Uruca, alleging a problem at the ICAA's Plantel involving adverse safety, hygiene, and odor conditions caused by the feces and urine of cats and raccoons. It is further established that in February and March 2025, ICAA's Occupational Health (Salud Ocupacional) personnel posted signs inside the workplace facility reading \"Prohibido alimentar a los animales\" [Feeding animals is prohibited], bearing the silhouette of a cat and a raccoon. It is additionally established that, starting the week of March 17, 2025, the respondent Institution hired a company to cut trees within the Plantel in order to prevent raccoons from feeding on and nesting in them. It is further established that on April 8, 2025, health authorities visited the site of the reported incidents to conduct an inspection, the results of which were recorded in reports number CMU-AI-38-2025 and CMU-AI-39-2025. It is established that at 15:13 hours on April 10, 2025, the Occupational Health Directorate of the respondent ICAA authority received the report titled \"Atención de memorando PRE-J-2025-01402 Asunto: Recurso de Amparo. Informe sobre las acciones tomadas para la alimentación de gatos en el Plantel de la Uruca,\" which issued the following recommendations: \"• Based on what is set forth in section B of this chapter (Scientific and sanitary basis for the described condition), it is highly relevant to genuinely acknowledge the probable risk of an illness materializing in one or more persons, which would not only affect those individuals in itself but would also constitute a legal breach of the regulations cited in section A of this chapter (Regulatory basis for the described condition). • Maintain constant monitoring of the facilities, coordinating infrastructure improvements to prevent animals from entering. • Address the issue of wastewater, problems with pipes, inspection chambers, and the condition of sanitary facilities, so as to further contribute to the healthfulness of the Plantel Carlos Segura.\" It is subsequently verified that on May 20, 2025, another complaint was filed against the ICAA authorities, reporting the presence of domestic and wild animals at the above-mentioned facility. It is further demonstrated that on August 7, 2025, the health authority notified the respondent Institution of the following sanitary orders (órdenes sanitarias): A) order No. MS-DRRSCS-DARSCMU-IT-0548-2025 of April 24, 2025, which found an accumulation of animal-origin feces (heces de origen animal) on a roof near the administrative offices, in breach of Articles 39, 148, and 164 of ley 5395; and B) order No. MS-DRRSCS-DARSCMUOS-117-2025 of July 3, 2025, which orders the ICAA, within a maximum period of 60 business days, to: \"3.1 Permanently and definitively eliminate the accumulation of animal feces present on the premises, particularly those observed at the time of the inspection. 3.2 Carry out a thorough cleaning and disinfection of the affected area. 3.3 Implement preventive measures to prevent the re-accumulation of feces. 3.4 Document compliance with the implemented measures through evidence; said evidence must be available on-site in order to demonstrate compliance with this requirement.\" Finally, it is established that on February 5, 2026, through official communication number CARTA-SINAC-ACC-OSJ-0191-2026, SINAC authorities stated the following: A) that Article 93 of the Ley de Conservación de la Vida Silvestre provides that anyone who destroys wildlife nests without authorization from the Sistema Nacional de Áreas de Conservación shall be subject to sanctions; B) that three factors attracting raccoons are food, shelter, and water, and accordingly SINAC issued a series of recommendations to prevent these wild animals from visiting and to resolve the problem; C) that one of the directives given to the ICAA is to seal openings and places where raccoons may enter, which entails providing adequate maintenance of the roof, boundary walls, and dropped ceiling, correcting the existence of any cracks; and D) that there exist techniques to deter raccoons that cause them no harm, such as i) combining red pepper with carbolina, naphthalene, or bleach in the areas where they sleep, prompting them to leave due to their sensitivity to strong odors; and ii) placing extensions with light bulbs, radios with loud sounds, or any other device that makes their presence uncomfortable.\n\nIn light of the foregoing, the violation of Articles 21 and 50 of the Constitución Política is confirmed, as it is established that not only the right to health (derecho a la salud) of workers at the Plantel La Uruca was undermined due to the failure to act to control the raccoon activity in the area, but also that the protection of animal welfare (bienestar animal) was infringed, and therefore, the right to a healthy and ecologically balanced environment (medio ambiente sano y ecológicamente equilibrado).\n\nRegarding the first issue under examination, it is confirmed that, indeed, at the ICAA authorities' Plantel La Uruca, there is a raccoon colony that became trapped within the construction development on the adjoining property—where a water supply tank was built—and that enters the facility premises, causing incidents due to its access to the dropped ceiling and offices. As an example, sanitary orders number MS-DRRSCS-DARSCMU-IT-0548-2025 of April 24, 2025, and number MS-DRRSCS-DARSCMUOS-117-2025 of July 3, 2025, confirmed the presence of animal-origin feces on a roof of the administrative offices and subsequently ordered the elimination of the waste, the cleaning of the affected area, and the implementation of preventive measures to prevent its accumulation. In light of this, it is evident that this species caused a health-related problem that resulted in a violation of the fundamental rights of workers at the mentioned location, constituting an omission by the ICAA authorities in the case under review, due to their failure to promptly address the contamination caused by this colony of a wild species.\n\nIn addition to the foregoing, it is also evident that the ICAA authorities violated the constitutional protection of a healthy and ecologically balanced environment, as well as animal welfare, insofar as the respondent Institution admitted—in its sworn report—that during the week of March 17, 2025, it hired a company to cut trees within the Plantel, with the sole purpose of preventing raccoons from feeding on and inhabiting them. In accordance with official communication CARTA-SINAC-ACC-OSJ-0191-2026 of February 5, 2026, SINAC authorities placed on record that these actions, in addition to constituting conduct in direct contravention of Article 93 of the Ley de Conservación de la Vida Silvestre—having resulted in the destruction of wildlife nests without authorization from the Sistema Nacional de Áreas de Conservación—are also contrary to the solutions recommended by the technical body with respect to the management of wild-species colonies, which include less aggressive measures such as infrastructure repairs to prevent raccoons from entering, the application of products that deter these animals by exploiting their sensitivity to strong odors, and the placement of devices emitting bright light or loud sounds to make their presence uncomfortable.\n\nAs with the case of the cat colony (colonia de gatos), this Tribunal deems it appropriate to notify the respondent authorities that the constitutional principle of inter-administrative coordination (coordinación interadministrativa) must serve as a fundamental precept to be upheld in the actions taken to resolve the present violation of fundamental rights, given that this is a case of significant complexity that requires consideration of both animal welfare protection and occupational health (salud ocupacional) matters in the workplace environment. In light of the foregoing, the sworn report submitted by SINAC authorities indicates that during 2025 they handled requests related to the presence of raccoons at the Plantel La Uruca, including removing animals and releasing them into their natural habitat (hábitat natural); however, they do not specify the dates on which or the circumstances under which these actions were carried out. Given this situation, the appropriate course of action is to order the ICAA and SINAC authorities to jointly plan and implement a solution to the raccoon colony issue at the location where the events giving rise to this constitutional remedy (recurso de amparo) are reported to have occurred.\n\nConsequently, this aspect of the constitutional remedy is granted, in the terms set forth in the operative section (parte dispositiva) of the judgment.\n\nX.- REGARDING THE MUNICIPALIDAD DE SAN JOSÉ. Furthermore, and without prejudice to the foregoing, no actions or omissions on the part of the municipal authority are observed that would warrant intervention by this Court. This is because, although there are disputed criteria regarding the actions that the local entity (ente local) should carry out—as between the respondent Municipalidad and SENASA—with respect to a colony of ownerless animals, the fact remains that the Servicio Nacional de Salud Animal itself states in its report that, given the circumstances in which some of the protected parties provided food, veterinary care, and assistance with the sterilization (esterilización) process of the feral cat colony (colonia de gatos ferales) inhabiting the surroundings of the ICAA's Plantel La Uruca, this results in a joint and several liability obligation (responsabilidad solidaria) over these animals. For the foregoing reasons, the constitutional remedy filed against the Municipalidad de San José is dismissed.\n\nXI.- REGARDING THE ÁREA RECTORA DE SALUD CARMEN MERCED URUCA. Given that the respondent health area responded to the complaints filed concerning the situation that is the subject of this constitutional protection action (amparo), issuing the corresponding sanitary orders in those cases that, in its technical judgment, so warranted, no actions or omissions on the part of this body are observed that undermine the fundamental rights of the protected parties. Therefore, the constitutional remedy filed against this institution is dismissed.\n(…)"
