"summary_en": "The Constitutional Chamber (Sala Constitucional) granted an amparo action filed against the Abangares Regional Health Authority for failing to timely and effectively respond to two formal environmental complaints filed in January and May 2026 concerning constant sawdust emissions, chemical odors, and excessive industrial noise from an adjacent carpentry and furniture workshop. The Court found that noise measurements had not been conducted—equipment calibration was requested from LACOMET only after the amparo was filed—and no effective response had been delivered to the petitioner. Reiterating Ruling 2008-18443, the Court held that the State has an objective duty to act diligently in protecting the rights to life, health, and a healthy and ecologically balanced environment under Article 50 of the Constitution. The Ministry of Health was ordered to conduct inspections, technical measurements, and adopt sanitary measures within one month.",

Although the Abangares Regional Health Authority claims to have addressed five confidential complaints against establishments [Name 002] and [Name 003] and to have served sanitary orders on both establishments, the follow-up on those orders remains pending. Likewise, noise measurements have not been conducted, with the justification that the equipment requires calibration—a request that was only submitted to LACOMET on June 5, 2026, that is, after the filing of this amparo petition.\n\nIn this regard, as this Court held in Ruling No. 2008-18443, the State has the objective obligation to act diligently in protecting its inhabitants' rights to life and physical integrity, which includes timely and effectively responding to environmental complaints that may compromise people's health. Constitutional jurisdiction intervention is viable precisely in the face of proven State inertia in responding to the demands that the country's inhabitants make in the exercise of their rights.\n\nIn the specific case, the reported situation directly and continuously affects the petitioner's and her family's right to a healthy and ecologically balanced environment, protected by Article 50 of the Political Constitution, as well as their rights to health and life. For the reasons stated, the appropriate course of action is to grant this amparo proceeding, as indicated in the operative portion of this ruling.",

SE ALEGA LA OMISIÓN DEL MINISTERIO DE SALUD DE ATENDER OPORTUNAMENTE DENUNCIAS POR CONTAMINACIÓN AMBIENTAL PROVOCADA POR UN TALLER DE CARPINTERÍA Y MUEBLERÍA, QUE GENERA EMISIONES DE ASERRÍN, OLORES QUÍMICOS Y RUIDO EXCESIVO, CON AFECTACIÓN A LA SALUD Y AL AMBIENTE SANO. SE CONSIDERA QUE EL ESTADO TIENE EL DEBER DE ACTUAR DE MANERA DILIGENTE Y OPORTUNA EN LA ATENCIÓN DE DENUNCIAS AMBIENTALES PARA PROTEGER LOS DERECHOS A LA SALUD, A LA VIDA Y A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO. SE DECLARA CON LUGAR EL RECURSO. SE ORDENA, EN EL PLAZO DE UN MES, REALIZAR LAS INSPECCIONES Y MEDICIONES TÉCNICAS, ADOPTAR LAS MEDIDAS SANITARIAS CORRESPONDIENTES Y NOTIFICAR A LA AMPARADA LAS RESOLUCIONES EMITIDAS. VCG08/2026\n\n“(…) "body_en_text": "025783-26. ENVIRONMENT. THE MINISTRY OF HEALTH IS ALLEGED TO HAVE FAILED TO TIMELY ADDRESS COMPLAINTS OF ENVIRONMENTAL CONTAMINATION CAUSED BY A CARPENTRY AND FURNITURE WORKSHOP THAT GENERATES EMISSIONS OF SAWDUST (aserrín), CHEMICAL ODORS, AND EXCESSIVE NOISE, ADVERSELY AFFECTING HEALTH AND THE RIGHT TO A HEALTHY ENVIRONMENT. THE STATE IS FOUND TO HAVE A DUTY TO ACT DILIGENTLY AND PROMPTLY IN ADDRESSING ENVIRONMENTAL COMPLAINTS IN ORDER TO PROTECT THE RIGHTS TO HEALTH, LIFE, AND A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. THE PETITION IS GRANTED. THE RESPONDENT AUTHORITY IS ORDERED, WITHIN ONE MONTH, TO CONDUCT THE RELEVANT INSPECTIONS AND TECHNICAL MEASUREMENTS, TO ADOPT THE CORRESPONDING SANITARY MEASURES, AND TO NOTIFY THE PETITIONER OF THE RESOLUTIONS ISSUED. VCG08/2026\n\n\"(…) VII.- ON THE SPECIFIC CASE. After analyzing the evidentiary elements submitted, this Tribunal finds that the fundamental rights of the petitioner (amparada) have been infringed. From the reports submitted by the representatives of the respondent authorities (autoridades recurridas)—which are deemed to have been given under oath, with the consequences, including criminal consequences, set forth in article 44 of the Law governing this Jurisdiction—and from the evidence submitted for resolution of the matter, it has been duly established that the petitioner filed two formal complaints with the Regional Health Authority (Área Rectora de Salud) of Abangares, on January 20 and May 14, 2026, in which she reported on the health effects suffered by herself and her family as a result of the operation of an adjacent carpentry and furniture workshop, which continuously generates emissions of sawdust, chemical odors, and excessive industrial noise.\n\nNotwithstanding the foregoing, as of the date of resolution of this petition, the respondent authority has not provided an effective response to those complaints. While the Área Rectora de Salud of Abangares claims to have handled five confidential complaints against the establishments [Nombre 002] and [Nombre 003], and to have served sanitary orders (órdenes sanitarias) on both establishments, the fact remains that follow-up on those orders is still pending. Likewise, noise measurements have not been carried out, on the grounds that the equipment required for that purpose needs calibration—a process that was only requested from LACOMET on June 5, 2026, that is, after the filing of this amparo petition (recurso de amparo).\n\nThe justification offered by the respondent authority regarding its inability to link the petitioner's complaints to those processed in administrative proceedings (sede administrativa), due to the confidential nature of those proceedings and the absence of an exact address in the filing, is not constitutionally acceptable. It should be noted that the case file contains all the necessary evidence, on the basis of which the respondent authority was fully capable of preparing the report requested by this Constitutional Tribunal.\n\nIn this regard, as this Tribunal has held in judgment No. 2008-18443, the State has an objective obligation to act diligently in protecting the rights to life and physical integrity of its inhabitants, which includes addressing in a timely and effective manner any environmental complaints that may compromise the health of individuals. The intervention of constitutional jurisdiction is precisely warranted where the State's proven inaction fails to attend to the demands made by residents of the country in the exercise of their rights.\n\nIn the present case, the situation reported directly and continuously affects the right of the petitioner and her family to a healthy and ecologically balanced environment, protected by article 50 of the Constitución Política, as well as their rights to health and to life. For the foregoing reasons, the appropriate course of action is to grant the present amparo proceeding, as set forth in the operative section (parte dispositiva) of this judgment. (…)\""
