I consider that in environmental matters where the Public Administration has already intervened, jurisdiction over and resolution of those matters belongs to the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do proceed to examine the merits of the matter when other rights of persons affected by a pollution source (foco de contaminación) are at stake, including health, quality of life, and the right to enjoy a healthy environment free from contamination (article 50 of the Constitución Política), as is the case here, in which the petitioner (recurrente) claims to have reported to the Municipalidad de Alajuela the contamination problem arising from a dump (botadero), which affects the right of the protected party (amparado) and neighboring residents to enjoy a healthy, ecologically balanced environment and a dignified standard of living — a problem that has not been resolved — in addition to the failure to address road infrastructure (infraestructura vial) and drainage (alcantarillado) problems on Calle Depósito La Guácima.\n\nVCG08/2026"
