SE DECLARA SIN LUGAR PORQUE LA MEDIDA SE FUNDAMENTÓ EN CRITERIOS TÉCNICOS Y CIENTÍFICOS, AL TRATARSE DE FAUNA SILVESTRE CUYA ALIMENTACIÓN ARTIFICIAL, PUEDE AFECTAR SU CONSERVACIÓN Y EL EQUILIBRIO ECOSISTÉMICO. VCG08/2026\n\n“(…) III.- PRECEDENTES JURISPRUDENCIALES DE RELEVANCIA.\nEn ocasiones anteriores, este Tribunal se ha referido a la protección\nconstitucional que se brinda al bienestar de los animales y a las limitaciones\nconstitucionalmente legítimas al deber de protección del bienestar animal. De\nesta forma, la resolución nro. 13553-2016 de las 11:30 horas del 21 de\nsetiembre de 2016 determinó lo siguiente:\n\n“III.- La protección constitucional al bienestar de los\nanimales. Si bien es cierto, nuestro texto constitucional no tiene una\nnormativa expresa que tutele el bienestar animal, como la tienen países como\nAlemania y Suiza, en su desarrollo jurisprudencial, la Sala Constitucional ha\ndeterminado que la prohibición del maltrato animal, tiene asidero\nconstitucional en el ordenamiento costarricense, derivado de los artículos 28 y\n50 de la Constitución Política. La Sala ha determinado que los seres humanos no\nsólo tenemos un deber moral de actuación con respecto a las demás personas,\nsino también en relación con el entorno natural que nos rodea. En ese sentido,\nse ha considerado que el maltrato a los animales vulnera la moral, las buenas\ncostumbres y el orden público, y que además forma parte del derecho a un\nambiente sano y equilibrado. Sobre ello pueden consultarse al respecto las\nsentencias 1993-3705, 1995-5893 y sin duda la más emblemática, la 2012-4620.\n\nEn ésta última decisión se establece que la inclusión\nde los animales dentro del concepto de ambiente se hace con base en el papel\nque estos juegan en el desarrollo de la vida humana y que los hace merecedores\nde protección y un trato digno. Así, la fauna silvestre o salvaje, aquella que\nvive sin intervención inmediata del hombre para su desarrollo o alimentación,\nes protegida en virtud del mantenimiento de la biodiversidad y el equilibrio\nnatural de las especies. Por su parte, la fauna domesticada o en proceso de\ndomesticación se debe proteger del padecimiento, maltrato y crueldad sin\njustificación legítima, porque ello refleja una racionalidad ética que atiende\na una concienciación de la especie humana respecto del modo justo y digno con\nel que debe interactuar con la naturaleza. Por otra parte, se establece que:\n\n“la superioridad racional –moral- del hombre no puede\nsignificar la ausencia de límites para causar sufrimiento, dolor o angustia a\nseres sintientes no humanos”.... “En este contexto, precisamente, el maltrato a\nlos animales constituye un acto contrario a la dignidad toda vez que el\nejercicio de esta última comporta un deber moral de actuación tanto con\nrespecto a los demás seres humanos como en relación con el entorno natural que\nlo rodea. De ahí que se coliga con facilidad que el maltrato a los animales vulnera\nla moral, las buenas costumbres y el orden público, por lo que su prohibición y\nprevención deviene un asunto de relevancia constitucional.” (sentencia\n2012-04620)\n\nEsta línea jurisprudencial sostenida por Tribunal es\nconteste con la de otros Tribunales Constitucionales, como el de Colombia, que\nha hecho un amplio desarrollo del fundamento constitucional a la prohibición al\nmaltrato animal, entre otras, en sus sentencias C-666-10, C-083-14 y C-095-16.\nLa Corte Constitucional Colombiana señala que la noción del bienestar animal\ncomporta un límite y una obligación de los seres humanos de actuar con respeto\na los animales por tratarse de seres sintientes que forman parte del contexto\nen que se desarrolla la vida de las personas. Ese Tribunal consideró que la\nprotección a los animales se concreta a partir de dos perspectivas:\n\n“(…) la de fauna protegida en virtud del mantenimiento\nde la biodiversidad y el equilibrio natural de las especies; y la de fauna a la\ncual se debe proteger del padecimiento, maltrato y crueldad sin justificación\nlegítima, protección esta última que refleja un contenido de moral política y\nconciencia de la responsabilidad que deben tener los seres humanos respecto de\nlos otros seres sintientes”. (sentencia C-095-16 Tribunal Constitucional)\n\nSeñala ese Tribunal que un deber de rango\nconstitucional para el Estado, comporta obligaciones concretas de las\ndiferentes ramas públicas de restringir el apoyo, el patrocinio o participación\npositiva en actos que impliquen el maltrato animal, de tal forma que no podrá\nasumir un papel neutro en el desarrollo de la protección que corresponde\notorgarse a los animales. Asimismo, teniendo como fundamento a la dignidad\nhumana, la protección animal impone cargas de respeto de los seres humanos con\nlos seres sintientes. A pesar de la existencia del deber de protección al\nbienestar animal, la Corte colombiana avaló unos límites legítimos, entre los\ncuales se encuentran: (i) los hábitos alimenticios de los seres humanos, (ii)\nla investigación y experimentación médica y, (iii) la cultura. En cuyo caso, el\noperador jurídico deberá armonizar en cada caso concreto, cuando haya tensión\nentre el bienestar animal y los límites al deber de protección. Por lo tanto,\ndel interés superior de protección del medio ambiente y a la fauna, surge un\ndeber de resguardo de los animales contra el padecimiento, el maltrato y la\ncrueldad. De la relación entre la naturaleza y los seres humanos se puede\ninferir el estatus moral de la vida animal y el reconocimiento de la capacidad\nde sufrimientos a los mismos, por ello se entiende que son seres sintientes que\nconllevan a una serie de obligaciones para los seres humanos, de cuidado y\nprotección. De este deber constitucional que surgen obligaciones de cuidado y\nprohibiciones de maltrato y crueldad contra los animales, a menos que éste de\npor medio de alguno de los límites señalados.\n\n IV.-\nLimitaciones constitucionalmente legítimas al deber de protección del bienestar\nanimal. La doctrina señala que el deber de protección animal, tiene unos\nlímites legítimos, entre los cuales se encuentran al menos: (i) los hábitos\nalimenticios de los seres humanos, (ii) la investigación y experimentación\nmédica y, (iii) la cultura. En esos casos, el operador jurídico deberá intentar\nuna armonización caso por caso, cuando haya tensión entre la obligación de\nbuscar el bienestar animal y los límites al deber de protección. Sobre este\ntema, la sentencia C-666-10 del Tribunal Constitucional ha señalado:\n\n“El principio de bienestar animal cede ante las\ncostumbres alimenticias de la especie humana, al admitirse el sacrificio de\nanimales para el consumo humano. Sin embargo, el sacrificio animal en estos\ncasos debe ajustarse a parámetros establecidos con el objetivo de eliminar\ncualquier práctica que implique sufrimiento evitable para el animal y, así\nmismo, la crueldad en los procedimientos de sacrificio, demostrando que,\nincluso en estos casos, el deber constitucional resulta plenamente aplicable a\nla relación que los humanos mantengan con los animales. (iii) Investigación y\nexperimentación médica. La ley 84 de\n1989 consagra un capítulo especial para regular aquellas condiciones que son\nnecesarias para la realización de experimentos con animales. En este sentido se\nincluyen normas que prohíben la realización de los mismos cuando como fruto de\nsu práctica se cause maltrato, cuando éstos no sean puestos bajo anestesia\n–artículo 24-, cuando se realice experimentación con animales vivos como medio\nde ilustración en conferencias de facultades con carreras relacionadas con el\nestudio animal –artículo 25-; así como normas que exigen la existencia de un\ncomité de ética siempre que se realice un experimento con animales –artículo\n26-.”\n\n“A partir de la Constitución de 1991, la cultura no es\nasunto secundario, ni puede constituir un privilegio del que disfruten\nsolamente algunos colombianos, sino que ella ha de extenderse a todos, bajo el\nentendido de que por constituir uno de los fundamentos de la nacionalidad su\npromoción, desarrollo y difusión es asunto que ha de gozar de la especial\natención del Estado”. De allí el énfasis de la Carta por obligar a las\nautoridades públicas a asumir un papel protagónico en la creación de medios de\nexpresión artística que permitan a los colombianos identificarse como nación a\npartir del reconocimiento de sus características culturales. Por lo tanto, “no\npuede existir ninguna duda, sobre el claro mandato constitucional de que el\nEstado defina y lleve a cabo una política cultural que eleve el nivel artístico\ne intelectual de todos los colombianos, política ésta en la cual serán pilares\nesenciales el fomento de actividades encaminadas a la obtención de tales\nfines”. Los compromisos del Estado colombiano no sólo se derivan de la\nConstitución, sino, además, de los contraídos en el plano internacional, dentro\nde los cuales se cuentan los derivados del Pacto Internacional de Derechos\nEconómicos, Sociales y Culturales de 1.966, en cuyo artículo 15 se reconoce el\nderecho de todas las personas a participar en la vida cultural y a beneficiarse\nde los progresos de la ciencia y sus aplicaciones, y el deber correlativo de\nlos Estados de tomar las medidas necesarias para la conservación, el desarrollo\ny la difusión de la ciencia y la cultura. Este precepto reitera lo dispuesto en\nlos artículos 27 de la Declaración Universal de los Derechos Humanos de 1.948,\ny XIII de la Declaración Americana de los Derechos y Deberes del Hombre,\nigualmente vinculantes para Colombia. Hasta aquí se ha expuesto la forma de\nproteger y promocionar el bien constitucional de la cultura. Sin embargo, la\ncultura resulta ser un término abstracto cuya protección y promoción se hace a\ntravés de la protección y promoción de distintas manifestaciones, prácticas y\nusos que la sociedad identifica como manifestaciones culturales. Resulta\nimportante resaltar que la noción de \"cultura nacional\" se expresa a\ntravés de “aquellas tradiciones y cánones corrientemente aceptados como\n‘colombianos’, esto es, los que involucran las prácticas y los valores que\nprevalecen en el territorio nacional”, sin que lo anterior signifique que ésta\nprime o incluso anule las “manifestaciones culturales” minoritarias existentes\nen el territorio colombiano, pues de los artículos como el 7º y el 70 de la\nConstitución se deduce que todas las manifestaciones culturales se encuentran\nen pie de igualdad ante el ordenamiento jurídico colombiano. Y es precisamente\nla existencia de diferentes culturas –y, por consiguiente, las diferentes manifestaciones\nde ésta-, así como de diferentes derechos fundamentales, bienes\nconstitucionales, principios fundamentales, entre otros, que las expresiones\nculturales, al igual que otros elementos de protección constitucional, no\ntienen un valor absoluto en el ordenamiento colombiano y su interpretación, con\nmiras a concretar la garantía de su protección y desarrollo, debe hacerse en\narmonía con todos los elementos que integran el panorama constitucional\nprevisto por la Constitución de 1991.”\n\n“No todas las actividades del quehacer humano que\nexpresan una visión personal del mundo, que interpretan la realidad o la\nmodifican a través de la imaginación, independientemente de que en su ejecución\nse acudan al auxilio de recursos plásticos, lingüísticos, corporales o sonoros,\npueden considerarse por parte del legislador como expresiones artísticas y\nculturales del Estado. En efecto, es preciso recordar que conforme al preámbulo\ny a los artículos 1, 2, 4 y 13 de la Constitución Política, esta Corporación ha\nreconocido que el criterio jurídico de razonabilidad -en tanto límite a la\npotestad de configuración normativas- implica la exclusión de toda decisión que\néste adopte y que resulte manifiestamente absurda, injustificada o insensata,\nvale decir, que se aparte por completo de los designios de la recta razón, lo\nque ocurriría, por ejemplo, al pretenderse categorizar como expresiones\nartísticas y culturales del Estado, comportamientos humanos que única y\nexclusivamente manifiesten actos de violencia o de perversión (v.gr. la\npornografía, el voyerismo y el sadismo), que además de considerarse lesivos de\nlos valores fundamentales de la sociedad, desconocen principios y derechos\nfundamentales como los de la dignidad humana y la prohibición de tratos crueles.”\n\nSobre este tema específico, en la sentencia 2012-4620\nde esta Sala, también reconoce el autoconsumo humano y la cultura como límites\nlegítimos a la protección animal. En lo que interesa se señaló:\n\n“Ahora bien, como se indicó, la protección a la salud\nanimal se define en última instancia en función del mismo hombre. Por\nconsiguiente, es válido limitar la extensión de espectro de protección a los\nanimales en consideración a otros bienes jurídicamente relevantes para el ser\nhumano. En particular, el sacrificio de animales destinados al consumo y\naprovechamiento humanos es un evidente límite al deber de protección animal,\ntoda vez que los productos derivados de los animales constituyen elementos esenciales\nde la dieta y vestimenta humanas. Igualmente, se debe hacer mención a la\ninvestigación y experimentación médica con animales, por cuanto ello constituye\nun elemento fundamental para el desarrollo de medicamentos y tratamientos en\nbeneficio de la salud humana. Del mismo modo, las tradiciones del pueblo\ncostarricense, cuya protección se infiere del artículo 89 de la Constitución\nPolítica, son objeto de tutela por tratarse de valores propios del acervo\ncultural de la nación.”\n\nDe igual manera, en el ámbito internacional existe una\ntendencia de expansión del alcance del deber de proteger bienestar animal.\nEntre los Convenios y Declaraciones relevantes están:\n\nLa Declaración Universal de los Derechos de los\nAnimales. En ella se consagra el derecho a la existencia de los animales, al\nrespeto, a la prohibición de exterminio, explotación o crueldad y a la\nobligación de cuidado y protección por parte de los hombres (arts. 1 a 3).\n\nConvenio sobre la Diversidad Biológica. Se persigue la adopción de estrategias y\npolíticas para la conservación y aprovechamiento sostenible de la\nbiodiversidad, la utilización sostenible de ésta requiere tenerse en cuenta en\nla toma de decisiones de los proceso nacionales se obliga a los Estados Partes\na reconstruir las especies amenazadas y proteger las que están en vía de\nextinción.\n\nLa Declaración de Estocolmo sobre el Medio Ambiente\nHumano menciona que el medio ambiente humano, el natural y el artificial son\nesenciales para el bienestar y goce de los derechos humanos fundamentales de\nlos seres humanos, incluyendo dentro del objeto de protección a la fauna, de la\nsiguiente manera:\n\n“Principio 2. Los recursos naturales de la Tierra,\nincluidos el aire, el agua, la tierra, la flora y la fauna y especialmente\nmuestras representativas de los ecosistemas naturales, deben preservarse en\nbeneficio de las generaciones presentes y futuras mediante una cuidadosa\nplanificación y ordenación, según convenga”.\n\nPor su parte, la Observación General No. 14 del Comité\nde Derechos Económicos, Sociales y Culturales reconoció que el medio ambiente\nconstituye una forma de realización necesaria de la vida del hombre en el\nplaneta. Así:\n\n“(...) la referencia que en el párrafo 1 del artículo\n12 del Pacto se hace al \"más alto nivel posible de salud física y\nmental\" no se limita al derecho a la atención de la salud. Por el\ncontrario, el historial de la elaboración y la redacción expresa del párrafo 2\ndel artículo 12 reconoce que el derecho a la salud abarca una amplia gama de\nfactores socioeconómicos que promueven las condiciones merced a las cuales las\npersonas pueden llevar una vida sana, y hace ese derecho extensivo a los factores\ndeterminantes básicos de la salud, como la alimentación y la nutrición, la\nvivienda, el acceso a agua limpia potable y a condiciones sanitarias adecuadas,\ncondiciones de trabajo seguras y sanas y un medio ambiente sano.”\n\nTambién el Convenio de Ramsar pretende el resguardo de\nlos humedales como ecosistemas productivos y diversos que proporcionan entre\notros, agua potable, en virtud de este Convenio los Estados partes se\ncomprometen a:\n\ntrabajar en pro del uso racional de todos los humedales\nde su territorio;\n\ndesignar humedales idóneos para la lista de Humedales\nde Importancia Internacional (la \"Lista de Ramsar\") y garantizar su\nmanejo eficaz;\n\ncooperar en el plano internacional en materia de\nhumedales transfronterizos, sistemas de humedales compartidos y especies\ncompartidas.\n\nDe conformidad con las normas precedentes, la\njurisprudencia constitucional ha establecido que, que el medio ambiente es un\nderecho constitucional fundamental para el ser humano, pues sin éste, la vida\nperdería vigencia.”\n\nEn el mismo sentido, otros Tribunales en nuestro medio\nhan reconocido la obligación del Estado de proteger a los animales por su\nimportancia dentro del ecosistema, la prohibición sobre el maltrato de estas\nespecies, así como su reconocimiento como seres sintientes, reiterando lo\ndispuesto por esta Sala en anteriores ocasiones. Así, la resolución nro.\n01754-2021 de las 14:06 horas del 12 de octubre de 2021 de la Sala Primera de\nCasación de la Corte Suprema de Justicia, determinó lo siguiente:\n\n“IX. De previo al conocimiento del agravio, considera\nesta Cámara oportuno hacer el siguiente análisis. Como bien reseñó el Tribunal\nen la sentencia en estudio, a nivel mundial, se puede encontrar el sistema\njurídico ha venido evolucionando en lo que respecta a la naturaleza y el\nbienestar de los animales para establecer, de diversas formas, la\nresponsabilidad de los seres humanos de promover, procurar y ejecutar la\nprotección del ambiente, y dentro de ella a los animales. Así, se evidencia,\npor ejemplo, en diversos instrumentos internacionales tales como, los Convenios\nEuropeos para la Protección de los Animales, la Declaración Universal de los\nDerechos de los Animales, el Convenio sobre la Diversidad Biológica, la\nDeclaración de Estocolmo sobre el Medio Ambiente Humano. En igual sentido, la\nCorte Interamericana de Derechos Humanos mediante la Opinión Consultiva\nOC-23-17 de 15 de noviembre 2017, refiriéndose a las obligaciones de respeto y\ngarantía de los derechos humanos establecidos en la Convención Americana de\nDerechos Humanos, dispuso: “62. Esta Corte considera importante resaltar que el\nderecho al medio ambiente sano como derecho autónomo, a diferencia de otros\nderechos, protege los componentes del medio ambiente, tales como bosques, ríos,\nmares y otros, como intereses jurídicos en sí mismos, aún en ausencia de\ncerteza o evidencia sobre el riesgo a las personas individuales. Se trata de\nproteger la naturaleza y el medio ambiente no solamente por su conexidad con\nuna utilidad para el ser humano o por los efectos que su degradación podría\ncausar en otros derechos de las personas, como la salud, la vida o la\nintegridad personal, sino por su importancia para los demás organismos vivos\ncon quienes se comparte el planeta, también merecedores de protección en sí\nmismos. En este sentido, la Corte advierte una tendencia a reconocer personería\njurídica y, por ende, derechos a la naturaleza no solo en sentencias judiciales\nsino incluso en ordenamientos constitucionales.” (El destacado está agregado). En consonancia con lo anterior, diversos\npaíses alrededor del mundo han emitido normativa en la que se contempla y\nreconoce a los animales como seres sintientes o personas no humanas (México,\nFrancia y Portugal), y algunos han reconocido explícitamente en sus constituciones\nel derecho a la protección, (Alemania y Luxemburgo), y de la dignidad de estos\n(Suiza). En ese contexto, el papel que\ndesempeñan las instancias jurisdiccionales resulta determinante para que esa\nprotección sea efectiva, debiendo decantarse las personas juzgadoras por la\nbúsqueda de una verdadera justicia ecológica. \nEn esa línea se han emitido sentencias reconociendo derechos a entidades\nnaturales como los ríos Whanganui (Nueva Zelanda), Ganges (India) y Atrato (Colombia),\ny de animales como es el caso de la orangutana Sandra (Argentina). Costa Rica no ha sido excepción en este\nreconocimiento, prueba de ello es que se han emitido diversas normas con\nvocación protectora, tales como Ley de Conservación de Vida Silvestre, No.7317;\nla Ley de Bienestar de los Animales No. 7451, la Ley General del Servicio de\nSalud Animal No. 8495 y el sistema sancionatorio regulado en el Código Penal\nNo. 4573. Y, en el ámbito judicial, la\nSala Constitucional, también ha trazado una línea jurisprudencial que se\norienta a superar los razonamientos antropocentristas en línea con la Corte IDH\nsupra transcrita; con una evidente firmeza en la protección del ambiente y de\nlos animales que esta Sala comparte. En\nese sentido, la resolución 13553-2016 de las once horas y treinta minutos del\nveintiuno de setiembre de dos mil dieciséis, emitida incluso antes de la Ley de\nBienestar Animal, señaló: “III.- La protección constitucional al bienestar de\nlos animales. Si bien es cierto, nuestro texto constitucional no tiene una\nnormativa expresa que tutele el bienestar animal, como la tienen países como\nAlemania y Suiza, en su desarrollo jurisprudencial, la Sala Constitucional ha\ndeterminado que la prohibición del maltrato animal tiene asidero constitucional\nen el ordenamiento costarricense, derivado de los artículos 28 y 50 de la\nConstitución Política. La Sala ha determinado que los seres humanos no sólo\ntenemos un deber moral de actuación con respecto a las demás personas, sino\ntambién en relación con el entorno natural que nos rodea. En ese sentido, se ha\nconsiderado que el maltrato a los animales vulnera la moral, las buenas\ncostumbres y el orden público, y que además forma parte del derecho a un\nambiente sano y equilibrado. Sobre ello pueden consultarse al respecto las\nsentencias 1993-3705, 1995-5893 y sin duda la más emblemática, la 2012-4620. En\nésta última decisión se establece que la inclusión de los animales dentro del\nconcepto de ambiente se hace con base en el papel que estos juegan en el\ndesarrollo de la vida humana y que los hace merecedores de protección y un\ntrato digno. Así, la fauna silvestre o salvaje, aquella que vive sin\nintervención inmediata del hombre para su desarrollo o alimentación, es\nprotegida en virtud del mantenimiento de la biodiversidad y el equilibrio\nnatural de las especies. Por su parte, la fauna domesticada o en proceso de\ndomesticación se debe proteger del padecimiento, maltrato y crueldad sin\njustificación legítima, porque ello refleja una racionalidad ética que atiende\na una concienciación de la especie humana respecto del modo justo y digno con\nel que debe interactuar con la naturaleza. Por otra parte, se establece que:\n“la superioridad racional –moral- del hombre no puede significar la ausencia de\nlímites para causar sufrimiento, dolor o angustia a seres sintientes no\nhumanos” .... “En este contexto, precisamente, el maltrato a los animales\nconstituye un acto contrario a la dignidad toda vez que el ejercicio de esta\núltima comporta un deber moral de actuación tanto con respecto a los demás\nseres humanos como en relación con el entorno natural que lo rodea. De ahí que\nse coliga con facilidad que el maltrato a los animales vulnera la moral, las\nbuenas costumbres y el orden público, por lo que su prohibición y prevención\ndeviene un asunto de relevancia constitucional.” (sentencia 2012-04620) Esta\nlínea jurisprudencial sostenida por Tribunal es conteste con la de otros\nTribunales Constitucionales, como el de Colombia, que ha hecho un amplio\ndesarrollo del fundamento constitucional a la prohibición al maltrato animal,\nentre otras, en sus sentencias C-666-10, C-083-14 y C-095-16. La Corte\nConstitucional Colombiana señala que la noción del bienestar animal comporta un\nlímite y una obligación de los seres humanos de actuar con respeto a los\nanimales por tratarse de seres sintientes que forman parte del contexto en que\nse desarrolla la vida de las personas. Ese Tribunal consideró que la protección\na los animales se concreta a partir de dos perspectivas: “(…) la de fauna\nprotegida en virtud del mantenimiento de la biodiversidad y el equilibrio\nnatural de las especies; y la de fauna a la cual se debe proteger del\npadecimiento, maltrato y crueldad sin justificación legítima, protección esta\núltima que refleja un contenido de moral política y conciencia de la\nresponsabilidad que deben tener los seres humanos respecto de los otros seres\nsintientes”. (sentencia C-095-16 Tribunal Constitucional) Señala ese Tribunal\nque un deber de rango constitucional para el Estado comporta obligaciones\nconcretas de las diferentes ramas públicas de restringir el apoyo, el\npatrocinio o participación positiva en actos que impliquen el maltrato animal,\nde tal forma que no podrá asumir un papel neutro en el desarrollo de la\nprotección que corresponde otorgarse a los animales. Asimismo, teniendo como fundamento\na la dignidad humana, la protección animal impone cargas de respeto de los\nseres humanos con los seres sintientes. A pesar de la existencia del deber de\nprotección al bienestar animal, la Corte colombiana avaló unos límites\nlegítimos, entre los cuales se encuentran: (i) los hábitos alimenticios de los\nseres humanos, (ii) la investigación y experimentación médica y, (iii) la\ncultura. En cuyo caso, el operador jurídico deberá armonizar en cada caso\nconcreto, cuando haya tensión entre el bienestar animal y los límites al deber\nde protección. Por lo tanto, del interés superior de protección del medio\nambiente y a la fauna, surge un deber de resguardo de los animales contra el\npadecimiento, el maltrato y la crueldad. De la relación entre la naturaleza y\nlos seres humanos se puede inferir el estatus moral de la vida animal y el\nreconocimiento de la capacidad de sufrimientos a los mismos, por ello se\nentiende que son seres sintientes que conllevan a una serie de obligaciones\npara los seres humanos, de cuidado y protección. De este deber constitucional\nque surgen obligaciones de cuidado y prohibiciones de maltrato y crueldad\ncontra los animales, a menos que éste de por medio de alguno de los límites\nseñalados.” Con base en lo anterior,\nadicionó el órgano constitucional, se evidencia que existe un mandato en el\námbito constitucional y legal para regular la protección animal, posición que\nreconoce y reafirma esta Cámara.”\n\nIV.- SOBRE EL CASO CONCRETO. En el sub lite, la parte\nrecurrente acusa que, el 27 de octubre de 2025, el Sistema Nacional de Áreas de\nConservación prohibió en forma general la alimentación de los patos domésticos\ndel lago artificial de Campo Real, Alajuela. Señala que ese lago es una obra\nartificial construida por la empresa desarrolladora y, desde hace más de dos\ndécadas, en ese espacio coexisten patos domésticos de la especie Cairina\nmoschata domesticus, introducidos originalmente en el proyecto y dependientes\nde las personas residentes para su sustento. Alega que el SINAC incurrió en un\nerror manifiesto al clasificar de forma genérica a la fauna del lago como\nsilvestre, ignorando que esos animales domésticos han perdido cualquier\ncapacidad de forrajeo o supervivencia autónoma. Reclama que la orden de\nprohibición de alimento constituye, en la práctica, una amenaza directa a la\nvida de los patos domésticos, al generar riesgo de muerte por inanición,\nlipidosis hepática y caquexia. Agrega que esa situación también afecta la salud\nemocional de la comunidad, integrada por aproximadamente tres mil habitantes,\nquienes se ven obligados a presenciar el sufrimiento de los animales. Solicita\nque se ordene al SINAC permitir el suministro de alimentos y atención a la población\nde patos domésticos del lago artificial de Campo Real, así como realizar una\ninspección en sitio para distinguir técnicamente entre fauna silvestre y fauna\ndoméstica, de modo que se tutele de forma diferenciada y razonable a cada\nespecie, según su naturaleza biológica.\n\nEn este sentido, se tiene por acreditado que, el 14 de\noctubre de 2025, en atención a una solicitud por parte de la administración del\ncondominio Campo Real, con el fin de analizar una posible sobrepoblación de\npatos identificados como piches (Dendrocygna autumnalis), ubicados en un lago\nartificial de ese condominio, funcionarios de la Oficina Subregional de\nAlajuela, Área de Conservación Central, realizaron una visita de campo. En tal\nocasión, además de la especie antedicha, también se identificó una población\nimportante de patos identificados como (Cairina moschata).\n\nAsimismo, se constata que las especies de patos\nDendrocygna autumnalis y Cairina moschata son de origen silvestre. Y, en la\ninvestigación de campo del 14 de octubre de 2025, se determinó que los\nhabitantes del condominio estilan suministrar alimento a ambas especies de\npatos.\n\nEn consecuencia, por las características de los patos\nque cohabitan en el condominio y debido al hecho de que, pese a ser especies\nsilvestres, los habitantes de ese lugar los alimentan, es que mediante orden\nadministrativa nro. SINAC-ACC-OA-of-236-2025 del 27 de octubre de 2025, se le\nordenó al residencial Campo Real, Alajuela lo siguiente: “Abstenerse de\nalimentar y manipular a la fauna silvestre que se ubique en el lago artificial\nubicado en el condominio Campo Real. Esto incluye todas las especies de patos,\notras aves u otros organismos silvestres. por cuanto dicho acto genera un daño\nambiental y además infringe la legislación nacional en materia de vida\nsilvestre. Al alimentar la fauna silvestre se estimula el abandono de sus\nhábitats naturales y la pérdida de conductas propias de la especie, como la\nreacción a alejarse de los seres humanos. Esto a su vez, provoca el\nhacinamiento y estrés de individuos, variaciones en su dieta v hasta\nenfermedades a las cuales la especie no ha sido expuesta en su entorno natural.\nAsí mismo, se instruye a implementar acciones para informar a los usuarios del\ncondominio que no está permitido alimentar ni manipular a la fauna silvestre y\nsensibilizar sobre los daños ecológicos asociados, caso omiso se establecerán\nlas responsabilidades legales correspondientes”.\n\nConsta en autos además que, por informe “MONITOREO DE\nAVIFAUNA LAGO CONDOMINIO HORIZONTAL CAMPO REAL”, elaborado en noviembre de 2025\npor el biólogo Giovanni Delgado Herrera, contratado por el condominio Campo\nReal, se consignó: “Todas especies registradas en el monitoreo fueron\nsilvestres, ninguna doméstica, por lo que es prohibido alimentarlas, según La\nLey de Conservación de Vida Silvestre. Por lo anterior, se debe de acatar lo\ndispuesto en la Orden Administrativa N°236-2025 girada por el Área de Conservación\nCentral Oficina Subregional de Alajuela. \n· Se observó que el alimentar a las aves, ha generado algún tipo de\ndependencia, al punto que las aves y especialmente los patos reales, se acercan\na los residentes para ser alimentados. ·\nSe recomienda colocar rótulos en la circunferencia y alrededores del lago.\nreferentes a la prohibición de alimentar a las aves y cualquier otra especie. ·\nSe le debe de dar capacitación a los residentes, sobre la avifauna presente en\nel lugar y la importancia de no alimentarla. . · Se recomienda que, para los\nresidentes, como a los nuevos inquilinos, en su contrato o reglas del\ncondominio, se les indique la prohibición de alimentar a la fauna silvestre. Se\nsugiere establecer una multa, ante el incumplimiento de la norma. · Al ser especies silvestres las que se\nalimentan de los desechos de comida, les pueden provocar efectos y\nenfermedades, que pueden afectar su población y la población de otras especies.\n· Los patos de la especie Dendrocygna autumnalis-Pijije Común (Piche, Quichichi,\nPichichi), no permanecen todo el día en el lago, lo que indica que tienen otras\nzonas de descanso y alimentación. La presencia de ellos posiblemente se deba a\nque los residentes los alimentan, al punto que no se observaron en el agua,\nsino en tierra, buscando comida o descansando. · El alimentar a las aves, puede\ngenerar una dependencia que hace puedan llegar a perder su instinto de buscar\nalimento por si solas y que no visiten otros sitios y con ello la afectación de\notros ecosistemas, migraciones locales, latitudinales, así como las cadenas\ntróficas. · Se observó que el mismo\nlago, provee de alimento a las especies que ahi se encuentran, ya que el lago\ntiene peces, posiblemente algunos crustáceos, insectos acuáticos, anfibios y\nreptiles, además de zacate en sus alrededores. Lo anterior indica que no es\nnecesario alimentar con nada extra a las aves, el lago y sus alrededores por si\nsolos las pueden alimentar, incluso a los patos reales Cairina moschata. Lo\nanterior significa que los patos y las otras especies, no se van a morir si no\nson alimentados por los inquilinos. · El dejar desechos de comida en el lugar\nva a provocar que al lago lleguen vectores como roedores, insectos (moscas-\nzancudos) y malos olores, que puede afectar a la fauna del lugar e incluso a\nlos residentes”.\n\nAsimismo, mediante informe del 20 de marzo de 2026,\nrealizado por la empresa privada InnoBiosphera, contratada por el condominio\nCampo Real, se consignó: “5.2 Aspectos Positivos ? La avifauna no parece estar afectando la\ninfraestructura del condominio ? El\nestado visual de la avifauna es bueno, su plumaje es brillante y sin muestras\nde agresiones recientes ? Los patos\ncriollos no presentaban lesiones o comportamientos anormales/estereotipados de\nhacinamiento, falta de recurso alimenticio, ni de cautiverio. Sin embargo, esto\nno implica que sean autosuficientes; tal como documentan Meneses De Souza Silva\n(2026)y Sánchez Ulate (2026), los individuos presentan una clara dependencia\ndel alimento de origen antrópico, lo cual no fue evidente durante nuestra visita\nde campo ? Se observaron individuos\nforrajeando alimento dentro del lago ?\nNo se encontró ningún cadáver durante la visita \n? El lago presenta un buen flujo de agua y oxigenación constante gracias\na la fuente presente”.\n\nFinalmente, por oficio\nCARTA-SINAC-ACC-DR-DRFVS-OSA-0288-2026 del 4 de junio de 2026, suscrito por el\njefe de la Oficina de Alajuela DE LA Reserva de Biosfera Cordillera Volcánica\nCentral del Área de Conservación Central del SINAC, se consignó: “Que el 14 de\noctubre del 2025, en atención a una solicitud por parte de la administración\ndel Condominio Campo Real, con el fin de analizar una posible sobre población\nde patos identificados como piches (Dendrocygna autumnalis), ubicados en un\nlago artificial en dicho condominio, funcionarios de la Oficina Subregional de\nAlajuela, Área de Conservación Central, realizaron una visita de campo con el\nfin de valorar la situación. En el lugar además de la especie de pato indicada\nen el párrafo anterior se observó el día de la inspección una población\nimportante de otro pato identificado como (Cairina moschata), ambas especies\nson de origen silvestre por lo que se encuentran reguladas por la Ley de\nConservación de la Vida Silvestre 7317, sus reformas y reglamento. Que en las\n“Disposiciones Generales” el artículo 1 “Ámbito de Aplicación” del reglamento a\nla Ley de Conservación de la Vida Silvestre establece que; “Los individuos de\nespecies exóticas ornamentales se excluyen de la aplicación de la LCVS y este\nreglamento por tratarse de especies de compañía, decorativas o domésticas. Los\nlistados de especies exóticas ornamentales serán elaborados por SINAC, SENASA y\nSFE, y serán de acceso público a través de las páginas web institucionales\ncorrespondientes”. Que mediante el oficio SENASA-DG-R00032-2024, emitido por la\nDirección del Servicio Nacional de Salud Animal, a las trece horas con veinte\nminutos del dieciocho de junio del dos mil veinticuatro, se oficializó la lista\nde los nombres científicos para aquellos animales considerados como especies\nexóticas ornamentales que se excluirían de la aplicación de la Ley de\nConservación de la Vida Silvestre, misma que no incluye la especie de pato\nCairina moschata, por lo que la misma mantiene su condición de especie de vida\nsilvestre independientemente del hábitat donde se encuentre y por lo tanto es\nregulada por la ley 7317 y su reglamento. (…) Que según lo informado por las\npersonas que representan la administración del condominio y que participaron en\nla visita de campo se estila el suministro de alimento a ambas especies. Dicha\nactividad es sancionada según así lo establece el artículo 116 de la Ley de\nConservación de la Vida Silvestre el cual textualmente indica lo siguiente;\n“Será sancionado con multa de un quince por ciento (15%) hasta un treinta por\nciento (30%) de un (1) salario base, quien, sin autorización de Sistema\nNacional de Áreas de Conservación, suministre alimentos o sustancias no\nautorizadas a la fauna silvestre”. Por lo anteriormente indicado y en apego a\nlo que establece la legislación vigente que regula el tema se notificó en el\nsitio el 27 de octubre del 2025 la orden administrativa\nSINAC-ACC-OA-of-236-2025, dirigida al señor Christian Gómez Monge, en calidad\nde administrador del condominio, donde se le ordenaba abstenerse a alimentar y\nmanipular la fauna silvestre que se encuentra presente en el lago\nartificial. Que la acción implementada\npor los funcionarios que atendieron la solicitud se fundamenta en lo\nestablecido en el artículo Artículo 219.- Procedencia de las órdenes\nadministrativas. El SINAC, en el ejercicio de sus funciones de supervisión,\ncontrol y protección, se encuentra facultado por ley y por los principios\npreventivo, precautorio y el de tutela administrativa efectiva, para emitir\nórdenes administrativas, con el objetivo de hacer o no hacer determinada\nconducta contraria a la legislación nacional o internacional, o que genere\nimpacto negativo a la vida silvestre. La orden puede consistir en paralizar,\nprevenir, eliminar, realizar, omitir, restaurar o corregir. Posterior a esto en dos ocasiones se han\nprogramado reuniones donde se invitaron a los condóminos; la primera el\n16-12-2025 y una segunda reunión el 19 de febrero del 2026, para informarles\nsobre el origen de las dos especies de patos presentes en el lago artificial y\npor qué no se deben de alimentar especies de animales silvestres. De igual forma la administración del\ncondominio primeramente contrató al biólogo Giovanni Delgado Herrera, quien\nrealizó un monitoreo de la avifauna presente en el lugar y se determinó la\npresencia de Cairina moschata y define su estatus como una especie residente\ncatalogada como silvestre para Costa Rica y en el mes de marzo del año en curso\ncontrataron a “InnoBiosphera, Soluciones ecológicas con innovación y confianza,\nservicios de biología” con el objetivo de que se realizara primeramente un\nreconocimiento de la zona, con el fin de la toma de datos sobre la avifauna\nacuática presente y reconocer posibles fuentes de alimentación natural para la\nvida silvestre en las instalaciones del condominio. En este estudio se determina que el estado\nvisual de la avifauna es bueno, su plumaje es brillante y sin muestras de\nagresiones recientes. Además, los patos no presentaban lesiones o comportamientos\nanormales/esteriotipados de hacinamiento, o falta de recurso alimenticio, ni de\ncautiverio, que se observan individuos forrajeando alimento dentro del lago y\nno se observó ningún pato muerto durante el tiempo de la visita. En el apartado\nde próximos pasos a seguir en dicho estudio los profesionales recomiendan\nsembrar plantas acuáticas que mejoren la calidad del agua y de refugio para los\nalevines de la especie de pez que se encuentra en el lago y que sirven como\nfuente de alimento para los patos. En los anexos se suministra un listado de\nespecies de plantas nativas que se pueden sembrar en las zonas verdes, así como\nplantas acuáticas que se pueden introducir en lago con el fin de mejorar el\nsitio y que algunas de ellas sirvan como fuente de alimento natural para los\npatos”.\n\nDesde este panorama, lo correspondiente es declarar sin\nlugar el recurso.\n\nAsí, nótese que las especies de patos son de origen\nsilvestre. Además, se recuerda que mediante el oficio SENASA-DG-R00032-2024,\nemitido por la Dirección del Servicio Nacional de Salud Animal, a las 13:20\nhoras del 18 de junio de 2024, se oficializó la lista de los nombres\ncientíficos para aquellos animales considerados como especies exóticas\nornamentales que se excluirían de la aplicación de la Ley de Conservación de la\nVida Silvestre, misma que no incluye las especies de pato antedichas. Por ende,\nlas especies en cuestión son consideradas de origen silvestre y se encuentran\ntuteladas por lo dispuesto en la Ley de Conservación de la Vida Silvestre, las\ncual establece: “Artículo 116.-Será sancionado con multa de un quince por\nciento (15%) hasta un treinta por ciento (30%) de un (1) salario base, quien,\nsin autorización del Sistema Nacional de Áreas de Conservación, suministre\nalimentos o sustancias no autorizadas a la fauna silvestre”.\n\nEs precisamente, por tales circunstancias que se emitió\nla orden administrativa nro. SINAC-ACC-OA-of-236-2025 del 27 de octubre de\n2025, lo que a priori, no resulta irrazonable ni arbitrario.\n\nY, en todo caso, se destaca que en los informes de\nnoviembre de 2025 y marzo de 2026, costeados por el propio residencial, se\ndeterminó que los patos se encuentran en buen estado y, más bien, el hecho de\nser alimentados por los habitantes del residencial podría ser dañino, así, en\ntales insumos se señaló expresamente: “· Al ser especies silvestres las que se\nalimentan de los desechos de comida, les pueden provocar efectos y\nenfermedades, que pueden afectar su población y la población de otras especies.\n· (…) El alimentar a las aves, puede generar una dependencia que hace puedan\nllegar a perder su instinto de buscar alimento por si solas y que no visiten\notros sitios y con ello la afectación de otros ecosistemas, migraciones\nlocales, latitudinales, así como las cadenas tróficas. · Se observó que el mismo lago, provee de\nalimento a las especies que ahi se encuentran, ya que el lago tiene peces,\nposiblemente algunos crustáceos, insectos acuáticos, anfibios y reptiles, además\nde zacate en sus alrededores. Lo anterior indica que no es necesario alimentar\ncon nada extra a las aves, el lago y sus alrededores por si solos las pueden\nalimentar, incluso a los patos reales Cairina moschata. Lo anterior significa\nque los patos y las otras especies, no se van a morir si no son alimentados por\nlos inquilinos. · El dejar desechos de comida en el lugar va a provocar que al\nlago lleguen vectores como roedores, insectos (moscas- zancudos) y malos\nolores, que puede afectar a la fauna del lugar e incluso a los residentes”.\n\nAsí las cosas, la Sala no se observa situación alguna\nque, a priori, se traduzca en un perjuicio al bienestar de los animales ni en\nalgún incumplimiento de las obligaciones del SINAC relativas al deber de\nprotección del bienestar animal. Ergo, lo correspondiente es desestimar el\namparo. (…)”",
  "body_en_text": "028836-26. ENVIRONMENT. THE PROHIBITION IMPOSED BY SINAC ON FEEDING THE DUCKS AT THE ARTIFICIAL LAKE OF CAMPO REAL, ALAJUELA IS CHALLENGED. DISMISSED BECAUSE THE MEASURE WAS GROUNDED IN TECHNICAL AND SCIENTIFIC CRITERIA, AS THE ANIMALS INVOLVED ARE WILDLIFE (fauna silvestre) WHOSE ARTIFICIAL FEEDING MAY AFFECT THEIR CONSERVATION AND THE ECOSYSTEMIC BALANCE (equilibrio ecosistémico). VCG08/2026\n\n\"(…) III.- RELEVANT JURISPRUDENTIAL PRECEDENTS.\n\nOn prior occasions, this Tribunal has addressed the constitutional protection afforded to animal welfare (bienestar animal) and the constitutionally legitimate limitations on the duty to protect it. In this regard, ruling no. 13553-2016, issued at 11:30 a.m. on September 21, 2016, determined the following:\n\n\"III.- Constitutional protection of animal welfare. Although our constitutional text does not contain an express provision protecting animal welfare, as do countries such as Germany and Switzerland, through its jurisprudential development the Sala Constitucional has determined that the prohibition of animal cruelty (maltrato animal) has constitutional grounding in the Costa Rican legal order, derived from Articles 28 and 50 of the Constitución Política. The Sala Constitucional has determined that human beings have not only a moral duty of conduct toward other persons, but also toward the natural environment that surrounds us. In that sense, it has been held that animal cruelty violates morality, public decency, and public order, and that it is also part of the right to a healthy and balanced environment. On this matter, see rulings 1993-3705, 1995-5893 and, undoubtedly the most emblematic, 2012-4620.\n\nIn that last decision, it is established that the inclusion of animals within the concept of environment is based on the role they play in the development of human life, which makes them deserving of protection and dignified treatment. Thus, wild fauna or wildlife—those species that live without the immediate intervention of humans for their development or feeding—are protected by virtue of the maintenance of biodiversity (biodiversidad) and the natural balance of species. For their part, domesticated fauna (fauna domesticada) or fauna in the process of domestication must be protected from suffering, cruelty, and mistreatment without legitimate justification, because this reflects an ethical rationality that addresses an awareness of the human species regarding the just and dignified manner in which it must interact with nature. Furthermore, it is established that:\n\n'the rational–moral superiority of the human being cannot mean the absence of limits on causing suffering, pain, or anguish to non-human sentient beings (seres sintientes)'.... 'In this context, precisely, animal cruelty constitutes an act contrary to dignity, since the exercise of dignity entails a moral duty of conduct both toward other human beings and toward the natural environment that surrounds one. Hence it follows readily that animal cruelty violates morality, public decency, and public order, and that its prohibition and prevention becomes a matter of constitutional relevance.' (ruling 2012-04620)\n\nThis jurisprudential line sustained by this Tribunal is consistent with that of other Constitutional Tribunals, such as that of Colombia, which has extensively developed the constitutional basis for the prohibition of animal cruelty, including in its rulings C-666-10, C-083-14, and C-095-16. The Colombian Constitutional Court holds that the notion of animal welfare entails a limit and an obligation on human beings to act with respect toward animals because they are sentient beings that form part of the context in which people's lives unfold. That Tribunal considered that the protection of animals is realized from two perspectives:\n\n'(…) that of fauna protected by virtue of the maintenance of biodiversity and the natural balance of species; and that of fauna which must be protected from suffering, cruelty, and mistreatment without legitimate justification, this latter protection reflecting a content of political morality and awareness of the responsibility that human beings must have toward other sentient beings.' (ruling C-095-16, Constitutional Tribunal)\n\nThat Tribunal indicates that a constitutional-level duty for the State entails concrete obligations on the different branches of government to restrict support, sponsorship, or positive participation in acts involving animal cruelty, in such a way that the State may not assume a neutral role in the development of the protection that must be afforded to animals. Likewise, grounded in human dignity, animal protection imposes obligations of respect by human beings toward sentient beings. Despite the existence of the duty to protect animal welfare, the Colombian Court endorsed certain legitimate limits, which include: (i) the dietary habits of human beings, (ii) medical research and experimentation, and (iii) culture. In those cases, the legal decision-maker must seek to harmonize, on a case-by-case basis, instances of tension between animal welfare and the limits on the duty of protection. Therefore, from the overriding interest in protecting the environment and fauna, there arises a duty to safeguard animals from suffering, cruelty, and mistreatment. From the relationship between nature and human beings, the moral status of animal life and the recognition of animals' capacity for suffering can be inferred; for this reason they are understood to be sentient beings that give rise to a series of obligations for human beings regarding care and protection. From this constitutional duty there arise obligations of care and prohibitions of cruelty and mistreatment toward animals, unless one of the noted limits is in play.\n\nIV.-\nConstitutionally Legitimate Limitations on the Duty to Protect Animal Welfare. Legal scholars indicate that the duty of animal protection has certain legitimate limits, which include at least: (i) the dietary habits of human beings, (ii) medical research and experimentation, and (iii) culture. In those cases, the legal decision-maker must seek to harmonize matters on a case-by-case basis when there is tension between the obligation to pursue animal welfare and the limits on the duty of protection. On this subject, ruling C-666-10 of the Constitutional Tribunal has stated:\n\n'The principle of animal welfare yields to the dietary customs of the human species, by allowing the slaughter of animals for human consumption. However, the slaughter of animals in those cases must conform to established parameters aimed at eliminating any practice that involves avoidable suffering for the animal and, likewise, cruelty in slaughter procedures—demonstrating that, even in these cases, the constitutional duty fully applies to the relationship that humans maintain with animals. (iii) Medical Research and Experimentation. Law 84 of 1989 establishes a special chapter to regulate the conditions necessary for conducting experiments on animals. In this regard, it includes provisions that prohibit carrying out such experiments when their conduct causes cruelty, when the animals are not placed under anesthesia—Article 24—, when experimentation is conducted on live animals as an illustrative means in lectures at faculties with programs related to the study of animals—Article 25—; as well as provisions requiring the existence of an ethics committee whenever an experiment is conducted on animals—Article 26—.'\n\n'From the 1991 Constitution onward, culture is not a secondary matter, nor may it constitute a privilege enjoyed only by some Colombians; rather, it must be extended to all, under the understanding that, as one of the foundations of nationhood, its promotion, development, and dissemination must enjoy the special attention of the State.' Hence the Constitution's emphasis on obligating public authorities to assume a leading role in creating means of artistic expression that allow Colombians to identify as a nation from the recognition of their cultural characteristics. Therefore, 'there can be no doubt about the clear constitutional mandate that the State define and carry out a cultural policy that raises the artistic and intellectual level of all Colombians, a policy in which the promotion of activities aimed at achieving such ends will be essential pillars.' The commitments of the Colombian State derive not only from the Constitution but also from those undertaken in the international sphere, among which are those arising from the International Covenant on Economic, Social and Cultural Rights of 1966, whose Article 15 recognizes the right of all persons to participate in cultural life and to benefit from scientific progress and its applications, and the correlative duty of States to take the measures necessary for the conservation, development, and dissemination of science and culture. This provision reiterates what is set forth in Articles 27 of the Universal Declaration of Human Rights of 1948 and XIII of the American Declaration of the Rights and Duties of Man, equally binding for Colombia. Up to this point, the manner of protecting and promoting the constitutional good of culture has been set out. However, culture proves to be an abstract term whose protection and promotion is achieved through the protection and promotion of various manifestations, practices, and usages that society identifies as cultural expressions. It is important to emphasize that the notion of 'national culture' is expressed through 'those traditions and canons commonly accepted as \"Colombian,\" that is, those involving the practices and values that prevail in the national territory,' without this meaning that it overrides or even nullifies the minority 'cultural manifestations' existing in Colombian territory, for from articles such as 7 and 70 of the Constitution it is inferred that all cultural manifestations stand on equal footing before the Colombian legal order. And it is precisely the existence of different cultures—and, consequently, different manifestations thereof—as well as of different fundamental rights, constitutional goods, and fundamental principles, among others, that cultural expressions, like other elements of constitutional protection, do not have an absolute value in the Colombian legal order, and their interpretation, with a view to making their protection and development concrete, must be undertaken in harmony with all the elements that make up the constitutional framework envisaged by the 1991 Constitution.'\n\n'Not all activities of human endeavor that express a personal view of the world, that interpret reality or modify it through imagination—regardless of whether in their execution they resort to the assistance of plastic, linguistic, corporeal, or sound resources—can be considered by the legislature as artistic and cultural expressions of the State. Indeed, it is necessary to recall that, in accordance with the preamble and Articles 1, 2, 4, and 13 of the Constitución Política, this Court has recognized that the legal criterion of reasonableness—as a limit on the power of regulatory configuration—implies the exclusion of any decision it adopts that proves manifestly absurd, unjustified, or irrational, that is, that departs entirely from the dictates of right reason, which would occur, for example, when one seeks to categorize as artistic and cultural expressions of the State human behaviors that solely and exclusively manifest acts of violence or perversion (e.g., pornography, voyeurism, and sadism), which, in addition to being considered harmful to the fundamental values of society, disregard fundamental principles and rights such as human dignity and the prohibition of cruel treatment.'\n\nOn this specific subject, in ruling 2012-4620 of this Sala Constitucional, human self-consumption and culture are also recognized as legitimate limits on animal protection. In the relevant part, it was stated:\n\n'Now, as noted, the protection of animal health is ultimately defined in terms of human beings themselves. Consequently, it is valid to limit the extent of the spectrum of animal protection in consideration of other legally relevant goods for human beings. In particular, the slaughter of animals destined for human consumption and use is an evident limit on the duty of animal protection, inasmuch as animal products constitute essential elements of the human diet and clothing. Likewise, mention must be made of medical research and experimentation with animals, as this constitutes a fundamental element for the development of medicines and treatments for the benefit of human health. Similarly, the traditions of the Costa Rican people, whose protection is inferred from Article 89 of the Constitución Política, are subject to protection as values intrinsic to the cultural heritage of the nation.'\n\nLikewise, at the international level, there is a trend toward expanding the scope of the duty to protect animal welfare. Among the relevant conventions and declarations are:\n\nThe Universal Declaration of Animal Rights. It enshrines animals' right to existence, to respect, to freedom from extermination, exploitation, or cruelty, and the obligation of human beings to provide care and protection (arts. 1 to 3).\n\nThe Convention on Biological Diversity. It pursues the adoption of strategies and policies for the conservation and sustainable use of biodiversity; the sustainable use of biodiversity requires that it be taken into account in national decision-making processes. States Parties are obligated to restore threatened species and protect those on the path to extinction.\n\nThe Stockholm Declaration on the Human Environment states that the human environment, both natural and artificial, is essential for the well-being and enjoyment of the fundamental human rights of human beings, including fauna within the scope of protection as follows:\n\n'Principle 2. The natural resources of the Earth, including air, water, land, flora and fauna and especially representative samples of natural ecosystems, must be safeguarded for the benefit of present and future generations through careful planning and management, as appropriate.'\n\nFor its part, General Comment No. 14 of the Committee on Economic, Social and Cultural Rights recognized that the environment constitutes a necessary form of realization of human life on the planet. Thus:\n\n'(...) the reference in paragraph 1 of article 12 of the Covenant to \"the highest attainable standard of physical and mental health\" is not limited to the right to health care. On the contrary, the drafting history and the express wording of paragraph 2 of article 12 acknowledge that the right to health embraces a wide range of socio-economic factors that promote conditions in which people can lead a healthy life, and extends to the underlying determinants of health, such as food and nutrition, housing, access to safe and potable water and adequate sanitation, safe and healthy working conditions, and a healthy environment.'\n\nThe Ramsar Convention also seeks the protection of wetlands (humedales) as productive and diverse ecosystems that provide, among other things, drinking water. By virtue of this Convention, States Parties commit to:\n\nworking toward the wise use of all wetlands within their territory;\n\ndesignating suitable wetlands for inclusion in the List of Wetlands of International Importance (the 'Ramsar List') and ensuring their effective management;\n\ncooperating internationally in matters of transboundary wetlands, shared wetland systems, and shared species.\n\nIn accordance with the foregoing norms, constitutional jurisprudence has established that the environment is a fundamental constitutional right for human beings, since without it, life would lose its validity.\"\n\nIn the same vein, other Tribunals within our legal system have recognized the State's obligation to protect animals because of their importance within the ecosystem, the prohibition on mistreatment of these species, as well as their recognition as sentient beings, reaffirming what this Sala Constitucional has held on prior occasions. Thus, ruling no. 01754-2021, issued at 14:06 on October 12, 2021, by the Sala Primera de Casación of the Corte Suprema de Justicia, determined the following:\n\n\"IX. Prior to addressing the grievance, this Chamber considers it appropriate to conduct the following analysis. As the Tribunal rightly summarized in the ruling under study, at a global level, the legal system can be seen to have been evolving with respect to the nature and welfare of animals to establish, in various ways, the responsibility of human beings to promote, pursue, and carry out the protection of the environment, and within it, animals. This is evidenced, for example, in various international instruments such as the European Conventions for the Protection of Animals, the Universal Declaration of Animal Rights, the Convention on Biological Diversity, and the Stockholm Declaration on the Human Environment. In the same vein, the Inter-American Court of Human Rights, through Advisory Opinion OC-23-17 of November 15, 2017, referring to the obligations of respect and guarantee of human rights established in the American Convention on Human Rights, provided: '62. This Court considers it important to highlight that the right to a healthy environment as an autonomous right, unlike other rights, protects the components of the environment, such as forests, rivers, seas and others, as legal interests in themselves, even in the absence of certainty or evidence regarding the risk to individual persons. The aim is to protect nature and the environment not only because of their connection to a utility for human beings or because of the effects that their degradation could cause on other rights of persons, such as health, life, or personal integrity, but because of their importance for the other living organisms with whom the planet is shared, also deserving of protection in themselves. In this regard, the Court notes a trend toward recognizing legal personhood and, therefore, rights to nature not only in judicial rulings but even in constitutional legal orders.' (Emphasis added). In line with the foregoing, various countries around the world have enacted legislation that contemplates and recognizes animals as sentient beings or non-human persons (Mexico, France, and Portugal), and some have explicitly recognized in their constitutions the right to protection (Germany and Luxembourg), and the dignity of animals (Switzerland). In that context, the role played by judicial bodies is decisive in making that protection effective, and judges must orient themselves toward the pursuit of true ecological justice.\nAlong these lines, rulings have been issued recognizing rights to natural entities such as the Whanganui (New Zealand), Ganges (India), and Atrato (Colombia) rivers, and to animals such as the orangutan Sandra (Argentina). Costa Rica has not been an exception in this recognition; proof of this is that various protective provisions have been enacted, such as the Wildlife Conservation Law, No. 7317; the Animal Welfare Law, No. 7451; the General Animal Health Service Law, No. 8495; and the sanctioning system regulated in the Penal Code, No. 4573. And, in the judicial sphere, the Sala Constitucional has also charted a jurisprudential line oriented toward overcoming anthropocentric reasoning, in line with the Inter-American Court of Human Rights as quoted above, with a clear firmness in the protection of the environment and of animals that this Chamber shares.\nIn this regard, ruling 13553-2016, issued at eleven-thirty a.m. on September 21, two thousand and sixteen, issued even before the Animal Welfare Law, stated: 'III.- Constitutional protection of animal welfare. Based on the foregoing, the constitutional body added, it is clear that there exists a mandate in the constitutional and legal sphere to regulate animal protection, a position that this Chamber recognizes and reaffirms.\"\n\nIV.- ON THE SPECIFIC CASE. In the case at hand, the petitioning party alleges that, on October 27, 2025, SINAC issued a general prohibition on feeding the domestic ducks (patos domésticos) at the artificial lake of Campo Real, Alajuela. It states that this lake is an artificial structure built by the developer company and that, for more than two decades, domestic ducks of the species Cairina moschata domesticus have coexisted in that space, having been originally introduced into the project and being dependent on the residents for their sustenance. It argues that SINAC committed a manifest error by generically classifying the lake's fauna as wildlife, ignoring that these domestic animals have lost any capacity for autonomous foraging (forrajeo) or survival. It claims that the prohibition order on providing food constitutes, in practice, a direct threat to the life of the domestic ducks, generating a risk of death by starvation, hepatic lipidosis (lipidosis hepática), and cachexia (caquexia). It adds that this situation also affects the emotional health of the community, made up of approximately three thousand residents, who are compelled to witness the animals' suffering. It requests that SINAC be ordered to permit the supply of food and care to the domestic duck population of the artificial lake of Campo Real, and to conduct an on-site inspection to technically distinguish between wildlife and domestic fauna (fauna doméstica), so that each species may be protected in a differentiated and reasonable manner, according to its biological nature.\n\nIn this regard, it is established as proven that, on October 14, 2025, in response to a request from the administration of the Campo Real condominium—with the aim of analyzing a possible overpopulation of ducks identified as piches (Dendrocygna autumnalis) located at an artificial lake within that condominium—officials from the Alajuela Sub-regional Office, Área de Conservación Central, conducted a field visit. On that occasion, in addition to the aforementioned species, a significant population of ducks identified as Cairina moschata was also observed.\n\nIt is likewise established that the duck species Dendrocygna autumnalis and Cairina moschata are of wildlife origin. And, in the field investigation of October 14, 2025, it was determined that the condominium's residents customarily provide food to both duck species.\n\nConsequently, given the characteristics of the ducks that cohabit in the condominium and the fact that, despite being wild species, the residents of that location feed them, administrative order (orden administrativa) nro. SINAC-ACC-OA-of-236-2025 of October 27, 2025 was issued to residencial Campo Real, Alajuela, ordering the following: \"Refrain from feeding and handling the wildlife (fauna silvestre) located in the artificial lake situated in condominio Campo Real. This includes all duck species, other birds, or other wild organisms, since such conduct causes environmental harm and also violates national legislation on wildlife (vida silvestre). Feeding wildlife encourages these animals to abandon their natural habitats and to lose species-typical behaviors, such as the instinct to move away from humans. This, in turn, causes overcrowding (hacinamiento) and stress among individuals, changes in their diet, and even diseases to which the species has not previously been exposed in its natural environment. Likewise, the condominium is instructed to take steps to inform residents that feeding or handling wildlife is not permitted and to raise awareness about the associated ecological harms; failure to comply will result in the corresponding legal liability.\"\n\nThe record further reflects that the report entitled \"MONITOREO DE AVIFAUNA LAGO CONDOMINIO HORIZONTAL CAMPO REAL,\" prepared in November 2025 by biologist Giovanni Delgado Herrera, contracted by condominio Campo Real, stated: \"All species recorded during the monitoring were wild, none domestic, and therefore feeding them is prohibited under the Wildlife Conservation Act (Ley de Conservación de Vida Silvestre). Accordingly, compliance with administrative order N°236-2025 issued by the Área de Conservación Central, Alajuela Subregional Office, is required.\n· It was observed that feeding the birds has generated some degree of dependency, to the point that the birds—and especially the Muscovy ducks (patos reales)—approach residents to be fed.\n· It is recommended that signs be posted around the perimeter of the lake and its surroundings indicating the prohibition on feeding birds and any other species.\n· Residents should be given training on the avifauna (avifauna) present at the site and the importance of not feeding it.\n· It is recommended that the prohibition on feeding wildlife be included in the contracts or condominium rules provided to both current residents and new tenants. Establishing a fine for non-compliance is also suggested.\n· Because these are wild species that feed on food scraps, such feeding can cause harmful effects and diseases that may affect their population and the populations of other species.\n· The ducks of the species Dendrocygna autumnalis—Pijije Común (Piche, Quichichi, Pichichi)—do not remain in the lake all day, which indicates that they have other resting and feeding areas. Their presence is likely due to residents feeding them, to the point that they were not observed in the water but on land, foraging for food or resting.\n· Feeding birds can create a dependency that may cause them to lose their instinct to find food on their own and to stop visiting other sites, thereby affecting other ecosystems, local and latitudinal migrations, and food chains (cadenas tróficas).\n· It was observed that the lake itself provides food for the species found there, as it contains fish, possibly some crustaceans, aquatic insects, amphibians, and reptiles, as well as grass around its banks. This indicates that no supplemental feeding of the birds is necessary; the lake and its surroundings can feed them on their own, including the Muscovy ducks Cairina moschata. This means that the ducks and other species will not starve if they are not fed by the residents.\n· Leaving food scraps at the site will attract disease vectors (vectores) such as rodents and insects (flies and mosquitoes) and will cause foul odors, which can harm the wildlife at the location and even the residents.\"\n\nFurthermore, a report dated March 20, 2026, prepared by the private firm InnoBiosphera, contracted by condominio Campo Real, stated: \"5.2 Positive Aspects ? The avifauna does not appear to be affecting the condominium's infrastructure ? The birds are in good visual condition, with bright plumage and no signs of recent injuries ? The Criollo ducks (patos criollos) showed no lesions or abnormal/stereotyped behaviors indicative of overcrowding, lack of food resources, or captivity. However, this does not imply that they are self-sufficient; as documented by Meneses De Souza Silva (2026) and Sánchez Ulate (2026), the individuals show a clear dependency on food of anthropogenic origin, which was not evident during our field visit ? Individuals were observed foraging for food inside the lake ? No carcasses were found during the visit ? The lake has good water flow and constant oxygenation thanks to the fountain present.\"\n\nFinally, by official communication CARTA-SINAC-ACC-DR-DRFVS-OSA-0288-2026 of June 4, 2026, signed by the head of the Alajuela Office of the Reserva de Biosfera Cordillera Volcánica Central of the Área de Conservación Central of SINAC, it was stated: \"That on October 14, 2025, in response to a request from the administration of Condominio Campo Real, in order to assess a possible overpopulation of ducks identified as piches (Dendrocygna autumnalis) located in an artificial lake in the condominium, officials from the Alajuela Subregional Office, Área de Conservación Central, conducted a field visit to evaluate the situation. At the location, in addition to the duck species mentioned in the preceding paragraph, a significant population of another duck identified as (Cairina moschata) was observed on the day of the inspection; both species are of wild origin and are therefore regulated by the Wildlife Conservation Act 7317, its amendments, and its regulations. That in the 'General Provisions,' Article 1, 'Scope of Application,' of the Wildlife Conservation Act regulations establishes: 'Individuals of exotic ornamental species (especies exóticas ornamentales) are excluded from the application of the LCVS and these regulations, as they are companion, decorative, or domestic species. The lists of exotic ornamental species shall be prepared by SINAC, SENASA, and SFE, and shall be publicly accessible through the respective institutional websites.' That by official communication SENASA-DG-R00032-2024, issued by the Directorate of the National Animal Health Service at thirteen hours and twenty minutes on June 18, 2024, the list of scientific names of animals considered exotic ornamental species—which would be excluded from the application of the Wildlife Conservation Act—was made official; this list does not include the duck species Cairina moschata, which therefore retains its status as a wild species regardless of the habitat in which it is found and is accordingly regulated by ley 7317 and its regulations. (…) That, according to information provided by the persons representing the condominium administration who participated in the field visit, it is customary to supply food to both species. This activity is sanctioned pursuant to Article 116 of the Wildlife Conservation Act, which expressly states: 'A fine of fifteen percent (15%) to thirty percent (30%) of one (1) base salary shall be imposed on any person who, without authorization from the Sistema Nacional de Áreas de Conservación, supplies food or unauthorized substances to wildlife.' For the foregoing reasons, and in accordance with the applicable legislation governing this matter, administrative order SINAC-ACC-OA-of-236-2025 was served on-site on October 27, 2025, addressed to Mr. Christian Gómez Monge, in his capacity as condominium manager, ordering him to refrain from feeding and handling the wildlife present in the artificial lake. The action taken by the officials who responded to the request is grounded in the provisions of Article 219.— Basis for Administrative Orders. SINAC, in the exercise of its supervisory, control, and protection functions, is empowered by law and by the preventive, precautionary, and effective administrative-guardianship principles to issue administrative orders for the purpose of requiring or prohibiting specific conduct that is contrary to national or international legislation or that generates a negative impact on wildlife. Such an order may consist of halting, preventing, eliminating, performing, omitting, restoring, or correcting conduct. Subsequently, two meetings were scheduled to which condominium residents (condóminos) were invited: the first on December 16, 2025, and a second on February 19, 2026, to inform them about the origin of the two duck species present in the artificial lake and why wild animal species should not be fed. Likewise, the condominium administration first contracted biologist Giovanni Delgado Herrera, who conducted a monitoring of the avifauna present at the site and determined the presence of Cairina moschata, classifying its status as a resident species categorized as wild in Costa Rica; and in March of the current year they contracted 'InnoBiosphera, Soluciones ecológicas con innovación y confianza, servicios de biología' with the objective of first conducting a site survey in order to collect data on the aquatic avifauna present and to identify possible natural food sources for wildlife within the condominium facilities. This study determined that the birds are in good visual condition, with bright plumage and no signs of recent injuries. Furthermore, the ducks showed no lesions or abnormal/stereotyped behaviors indicative of overcrowding, lack of food resources, or captivity; individuals were observed foraging for food inside the lake, and no dead duck was observed during the time of the visit. In the section on next steps in that study, the professionals recommend planting aquatic plants that improve water quality and provide shelter for the fish fry (alevines) of the fish species found in the lake, which serve as a food source for the ducks. The annexes provide a list of native plant species that can be planted in the green areas, as well as aquatic plants that can be introduced into the lake in order to improve the site, some of which may serve as a natural food source for the ducks.\"\n\nGiven this context, the appropriate ruling is to deny the writ.\n\nThus, it should be noted that the duck species are of wild origin. Furthermore, it is recalled that by official communication SENASA-DG-R00032-2024, issued by the Directorate of the National Animal Health Service at 13:20 hours on June 18, 2024, the list of scientific names of animals considered exotic ornamental species—which would be excluded from the application of the Wildlife Conservation Act—was made official; this list does not include the aforementioned duck species. Therefore, the species in question are considered to be of wild origin and are protected under the provisions of the Wildlife Conservation Act, which establishes: \"Article 116.— A fine of fifteen percent (15%) to thirty percent (30%) of one (1) base salary shall be imposed on any person who, without authorization from the Sistema Nacional de Áreas de Conservación, supplies food or unauthorized substances to wildlife.\"\n\nIt is precisely on account of these circumstances that administrative order nro. SINAC-ACC-OA-of-236-2025 of October 27, 2025 was issued, which, on its face, is neither unreasonable nor arbitrary.\n\nIn any event, it is also noteworthy that the reports from November 2025 and March 2026, funded by the residencial itself, determined that the ducks are in good condition and that, in fact, being fed by the condominium residents could be harmful. Those documents expressly stated: \"· Because these are wild species that feed on food scraps, such feeding can cause harmful effects and diseases that may affect their population and the populations of other species. · (…) Feeding birds can create a dependency that may cause them to lose their instinct to find food on their own and to stop visiting other sites, thereby affecting other ecosystems, local and latitudinal migrations, and food chains. · It was observed that the lake itself provides food for the species found there, as it contains fish, possibly some crustaceans, aquatic insects, amphibians, and reptiles, as well as grass around its banks. This indicates that no supplemental feeding of the birds is necessary; the lake and its surroundings can feed them on their own, including the Muscovy ducks Cairina moschata. This means that the ducks and other species will not starve if they are not fed by the residents. · Leaving food scraps at the site will attract disease vectors such as rodents and insects (flies and mosquitoes) and will cause foul odors, which can harm the wildlife at the location and even the residents.\"\n\nAccordingly, the Chamber finds no situation that, on its face, would constitute harm to the animals' welfare or any failure by SINAC to fulfill its obligations regarding the duty to protect animal welfare. Therefore, the amparo (constitutional rights action) must be dismissed. (…)\""
