SE CONSIDERA QUE LA FALTA DE UNA SOLUCIÓN DEFINITIVA AL PROBLEMA VULNERA EL DERECHO FUNDAMENTAL AL AGUA POTABLE Y A LA PRESTACIÓN EFICIENTE DEL SERVICIO PÚBLICO. SE DECLARA CON LUGAR EL RECURSO Y SE ORDENA CONCLUIR EL PROYECTO DE MEJORAS AL ACUEDUCTO EN EL PLAZO DE DIEZ MESES. VCG08/2026\n\n“(…) III.- Sobre el derecho fundamental al agua\npotable. Este Tribunal ha reconocido, en su jurisprudencia, que el derecho a la\nsalud y a la vida, son derechos fundamentales del ser humano que dependen del\nacceso al agua potable y que los órganos competentes tienen la responsabilidad\nineludible de velar para que la sociedad, como un todo, no los vea mermados. En\nefecto, la Sala ha dispuesto anteriormente que, como parte del Derecho de la\nConstitución, existe un derecho fundamental al suministro de agua potable. Así,\nen la sentencia No. 2003-004654 de las 15:44 horas del 27 de mayo de 2003, se\ndispuso lo siguiente:\n\n“V.- La Sala reconoce, como parte del Derecho de la\nConstitución, un derecho fundamental al agua potable, derivado de los derechos\nfundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y\nla vivienda digna, entre otros, tal como ha sido reconocido también en\ninstrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica:\nasí, figura explícitamente en la Convención sobre la Eliminación de todas las\nformas de discriminación contra la mujer (art. 14) y la Convención sobre los\nDerechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional\nsobre Población y el Desarrollo de El Cairo (principio 2), y se declara en\notros numerosos del Derecho Internacional Humanitario. En nuestro Sistema\nInteramericano de Derechos Humanos, el país se encuentra particularmente\nobligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo\nAdicional a la Convención Americana sobre Derechos Humanos en Materia de\nDerechos Económicos, Sociales y Culturales (\"Protocolo de San\nSalvador\" de 1988), el cual dispone que:\n\n‘Artículo 11. Derecho a un medio ambiente sano 1. Toda\npersona tiene derecho a vivir en un medio ambiente sano y a contar con\nservicios públicos básicos’.\n\nAdemás, recientemente, el Comité de Derechos\nEconómicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un\nderecho humano que, además de ser imprescindible para llevar una vida\nsaludable, es un requisito para la realización de todos los demás derechos\nhumanos.\n\nVI.- Del anterior marco normativo se deriva una serie\nde derechos fundamentales ligados a la obligación del Estado de brindar los\nservicios públicos básicos, que implican, por una parte, que no puede privarse\nilegítimamente de ellos a las personas, pero que, como en el caso del agua\npotable, no puede sostenerse la titularidad de un derecho exigible por\ncualquier individuo para que el Estado le suministre el servicio público de\nagua potable, en forma inmediata y dondequiera que sea, sino que, en la forma\nprevista en el mismo Protocolo de San Salvador, esta clase de derechos obligan\na los Estados a adoptar medidas, conforme lo dispone el artículo primero del\nmismo Protocolo:\n\nLos Estados Partes en el presente Protocolo Adicional a\nla Convención Americana sobre Derechos Humanos se comprometen a adoptar las\nmedidas necesarias tanto de orden interno como mediante la cooperación entre\nlos Estados, especialmente económica y técnica, hasta el máximo de los recursos\ndisponibles y tomando en cuenta su grado de desarrollo, a fin de lograr\nprogresivamente, y de conformidad con la legislación interna, la plena\nefectividad de los derechos que se reconocen en el presente Protocolo’ .\n\nDe esto tampoco puede interpretarse que ese derecho\nfundamental a los servicios públicos no tenga exigibilidad concreta; por el\ncontrario, cuando razonablemente el Estado deba brindarlos, los titulares del\nderecho pueden exigirlo y no pueden las administraciones públicas o, en su\ncaso, los particulares que los presten en su lugar, escudarse en presuntas\ncarencias de recursos, que ha sido la secular excusa pública para justificar el\nincumplimiento de sus cometidos”.\n\nDe lo anterior, se colige que el denominado derecho\nfundamental al agua, debe concederse a todas las personas, lo que implica que\ntodos los individuos tengan la posibilidad de acceder, en condiciones de\nigualdad, a los servicios de agua potable, toda vez que la misma resulta\nesencial para la vida y la salud humana (sentencia No. 2026-022312 de las 09:30\nhoras del 19 de junio de 2026).\n\n IV.- Sobre el\ncaso concreto. En el presente asunto, en atención al reclamo planteado por el\nrecurrente en cuanto al desavituallamiento y contaminación del agua potable en\nla comunidad de Lámparas en San Antonio de Alajuelita, la autoridad recurrida\ndel ICAA, en el informe que se tiene dado bajo fe de juramento, con oportuno\napercibimiento de las consecuencias, incluso penales, previstas en el artículo\n44 de la ley que rige esta jurisdicción, así como de la prueba documental\naportada para la resolución de este amparo, refiere que la zona de operación\ndonde se ubica el Sistema de Lámparas, en San Antonio de Alajuelita, presenta\nuna condición de vulnerabilidad debido a que el abastecimiento de agua proviene\ndirectamente de una toma cuya infraestructura de tratamiento preliminar\nconsiste solo en un desarenador. En consecuencia, ante eventos que afecten la\ncalidad del agua cruda, pueden generarse condiciones de alta turbiedad u\nobstrucciones en la línea de conducción que incidan temporalmente en la\nprestación del servicio. En ese contexto, entre el 21 y el 22 de junio de 2026,\nse registraron afectaciones ocasionadas por obstrucciones en la línea de\nconducción por el exceso de sedimentos arrastrados con las primeras lluvias. La\nsituación fue atendida y se retornó a la continuidad del servicio en la zona\nluego de los mantenimientos correctivos. Además, se ejecutaron labores de\nmantenimiento preventivo en la rejilla de la captación con el fin de disminuir\nel riesgo de incidentes similares en el corto plazo. Dice que, como resultado\nde dichas acciones, se restablecieron las condiciones normales de presión y,\ndesde el 22 de junio de 2026 el sistema ha mantenido la continuidad en la\nprestación del servicio. Aparte de lo anterior, el ICAA está llevando a cabo en\nla zona un proyecto para contar con la Planta Potabilizadora de Lámparas con un\ncaudal nominal de 10 l/s que ayudará aún más a minimizar las afectaciones. Se\nconstata que se trata del proyecto Mejoras al Acueducto de Lámparas de\nAlajuelita No. 2023LY-000021-0021400001, cuya descripción es diseño y\nconstrucción de una planta potabilizadora del tipo modular portátil, un tanque\nde almacenamiento de 250 m3, un tanque elevado de 100 m3, dos edificios (bodega\ny laboratorio), un cuarto de equipos, un edificio tipo container para oficina y\ncomedor del operador y un sistema para el manejo de lodos, por un monto de\n¢2.674.641.382,45, que cuenta con orden de inicio y se espera esté finalizado\nen abril de 2027.\n\n La\nanterior problemática que acusa el recurrente ha sido de conocimiento por parte\nde esta Sala en al menos dos ocasiones. En el recurso de amparo que se tramitó\nen el expediente No. 16-004301-0007-CO, donde se argumentó:\n\n“La recurrente, vecina de Alajuelita, considera violado\nsu derecho a recibir un servicio público de agua potable de forma continua,\nello por cuanto aduce que, desde que el AYA asumió la administración del\nacueducto, el agua llega solo un rato en las horas de la madrugada cada tres\ndías, y a veces llega hasta contaminada”.\n\nEse asunto se declaró con lugar por sentencia No.\n2016-006038 de las 09:05 horas del 06 de mayo de 2016 y se ordenó lo siguiente:\n\n“Por tanto: Se declara CON LUGAR el recurso. En\nconsecuencia, se ordena JOSE ALBERTO MOYA SEGURA, en su calidad de Gerente\nGeneral del Instituto Costarricense de Acueductos y Alcantarillados, o a quien\nen su lugar ocupe dicho cargo, continuar con la ejecución del plan de mejoras\nen el acueducto que abastece a la comunidad de Lámparas de Alajuelita, dentro\ndel menor plazo posible. Lo anterior, bajo apercibimiento de que podría\nincurrir en el delito tipificado en el artículo 71 de la Ley de la Jurisdicción\nConstitucional, el cual dispone que se impondrá prisión de tres meses a dos\naños, o de veinte a sesenta días multa, a quien recibiere una orden que deba\ncumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no\nla hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de\nAcueductos y Alcantarillados al pago de las costas, daños y perjuicios causados\ncon los hechos que sirven de base a esta declaratoria, los que se liquidarán en\nejecución de sentencia de lo contencioso administrativo. Notifíquese en forma\npersonal a JOSE ALBERTO MOYA SEGURA, en su calidad de Gerente General del\nInstituto Costarricense de Acueductos y Alcantarillados, o a quien en su lugar\nocupe dicho cargo. La Magistrada Hernández López pone nota”.\n\n Lo\nanterior con sustento en lo siguiente:\n\n“III.- Sobre el fondo. Tal como se observa la\nrecurrente acusa una serie de problemas con la prestación del servicio de agua\npotable en la comunidad donde reside, indica problemas de desabastecimiento y\nhasta de contaminación del agua que recibe. Al respecto, en su informe, el\nGerente del Instituto Costarricense de Acueductos y Alcantarillados hace una\nexplicación amplia de todos los problemas que se presentan con la prestación\ndel servicio de agua potable en la comunidad de Lámparas de Alajuelita, aceptando\nla existencia de dichos problemas e indicando en resumen que “El problema de\ndesabastecimiento es heredado de la antigua ASADA y obedece a una\ninfraestructura de más de 30 años, el AYA está resolviendo según el plan que se\nha venido indicando al comité de vecinos.” Pero indica que, como se ha actuado\nconforme a las posibilidades materiales, no se puede considerar que ha habido\nen este caso violación alguna de derechos fundamentales. De lo anterior, esta\nSala no sólo comprueba que la recurrente lleva razón en sus aseveraciones, sino\nque leído el informe se observa la gravedad del problema pues el acueducto\npresenta problemas operativos, alta vulnerabilidad a la contaminación,\ndesigualdades de presión que ocasiona desigualdad en la distribución,\nantigüedad de los tanques de almacenamiento, sistema poco adecuado para la\npotabilización y desinfección del agua. Si bien es cierto el Instituto\nrecurrido explica que empezó a operar el acueducto a partir del primero de\nsetiembre del 2015 y desde esa fecha ha venido realizando mejoras, reparaciones\ny planificando las obras de infraestructura, es lo cierto que ello no enerva el\nhecho de que, en efecto, la prestación del servicio de agua potable en dicha\ncomunidad no sólo es deficiente, sino hasta pone en peligro la salud de las\npersonas por los problemas de contaminación. Ha debido el Instituto recurrido,\nde todas formas, proceder a supervisar mejor la prestación de dicho servicio,\nsiendo el ente rector en esta materia. La jurisprudencia que menciona el\nrecurrido, donde esta Sala ha exonerado de responsabilidad en caso de\nimposibilidad material de prestación del servicio, se refieren a cuando el\nservicio se presta por primera vez a un usuario, pero no a una situación\nsostenida y generalizada de desabastecimiento como en este caso. Así entonces,\nse constata la violación a los derechos fundamentales alegados. En conclusión,\ndado que se constatan los problemas de desabastecimiento en el servicio público\nde agua potable que el Instituto recurrido presta en la comunidad de Lámparas\nde Alajuelita y dado además que se constata la contaminación del agua potable,\npese a que el problema presentado pueda ser heredado de prestadores anteriores\ndel servicio, se constata la violación al derecho fundamental a la prestación\neficiente de servicios públicos, al derecho fundamental al agua y amenaza al\nderecho a la salud, razones por las cuales se impone la estimatoria de este\nrecurso. Procediendo no sólo la condenatoria en daños y perjuicios, sino\nademás, ordenando al recurrido la continuación en la implementación del plan de\nmejoras, dentro del menor plazo posible”.\n\nTambién el recurso de amparo que se tramitó en el\nexpediente No. 18-002952-0007-CO, donde se acusó:\n\n“Objeto del recurso. La recurrente es vecina de\nLámparas de Alajuelita, lugar donde la prestación del servicio público de agua\npotable no solo es deficiente, sino que, pone en peligro la salud de los\nabonados, por problemas de contaminación. Asegura que el acueducto presenta\nproblemas operativos, alta vulnerabilidad a la contaminación y sistemas poco\nadecuados para la potabilización y desinfección del agua. Alega que sufren\ncortes del suministro por semanas y, actualmente, llevan 4 días sin agua.\nSolicita que se declare con lugar el recurso”.\n\n Se\ndeclaró parcialmente con lugar por sentencia No. 2018-006604 de las 09:30 horas\ndel 27 de abril de 2028 y se ordenó:\n\n“Por tanto: Se declara PARCIALMENTE CON LUGAR,\núnicamente por la falta de potabilidad del agua. En consecuencia, se ordena a\nYAMILETTE ASTORGA ESPELETA, es su calidad de Presidenta Ejecutiva del Instituto\nCostarricense de Acueductos y Alcantarillados, o a quien ocupe dicho cargo,\nproceder de inmediato a coordinar acciones a efectos de lograr la\npotabilización del agua y su adecuación a los estándares reglamentarios y\nlegales sobre la Calidad del Agua, dentro del plazo máximo de SEIS meses,\ncontados a partir de la notificación de esta resolución. Debiendo entretanto\ntomar acciones inmediatas para que la comunidad de Lámparas de Alajuelita,\nreciba agua potable, sea mediante cisternas u otras medidas. Todo lo anterior,\nbajo apercibimiento de que podría incurrir en el delito tipificado en el\nartículo 71 de la Ley de la Jurisdicción Constitucional, el cual dispone que se\nimpondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a\nquien recibiere una orden que deba cumplir o hacer cumplir, dictada en un\nrecurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el\ndelito no esté más gravemente penado. Se condena al Instituto Costarricense de\nAcueductos y Alcantarillados al pago de las costas, daños y perjuicios causados\ncon los hechos que sirven de base a esta declaratoria, los que se liquidarán en\nejecución de sentencia de lo contencioso administrativo. Notifíquese de forma personal a YAMILETTE\nASTORGA ESPELETA, es su calidad de Presidenta Ejecutiva del Instituto\nCostarricense de Acueductos y Alcantarillados, o a quien ocupe dicho cargo”.\n\n \nDecisión que se tomó con sustento en lo siguiente:\n\n“IV.- Sobre el fondo. Este asunto ha sido tramitado\ncomo un amparo nuevo, únicamente para examinar los alegatos de la recurrente\nreferidos al desabastecimiento de agua potable por semanas y a la contaminación\ndel agua, ocurridas a la fecha de presentación de la gestión, en enero del\n2018. Tómese en cuenta que, todo lo demás, referente a la calidad en la\nprestación del servicio de agua potable en la comunidad de Lámparas de\nAlajuelita, ya fueron resueltos en amparo anterior mediante resolución número\n2016-06038, expediente donde se reiteró la orden dada de continuar con el plan\nde mejoras del acueducto, bajo apercibimiento de ordenar la apertura de un\nprocedimiento disciplinario en contra del Gerente General del Instituto\nCostarricense de Acueductos y Alcantarillados, y de la remisión del caso al\nMinisterio Público para el trámite del delito de desobediencia. Así entonces,\nse procede al examen de los alegatos de desabastecimiento y contaminación del\nagua potable, ocurridos en enero del 2018. 1) Sobre el alegato de\ndesabastecimiento en enero del 2018: Al respecto, debe primero recordarse que,\nesta Sala ha establecido en reiterada jurisprudencia que el acceso al agua\npotable se configura un derecho básico para los administrados, siendo que, en\nrelación con los problemas de abastecimiento, ha establecido que, en el tanto\nlas autoridades recurridas demuestren que se ha actuado dentro de sus\nposibilidades materiales a fin de lograr un adecuado abastecimiento, no\nquebranta los derechos fundamentales de las personas si este se ofrece con\nalgunas irregularidades de caudal u horario de suministro (véase al respecto\nlas sentencias Nº 2009-12511 de las 17:59 horas del 11 de agosto del 2009, Nº\n2010-015448 de las 12:15 hora del 17 de setiembre de 2010 y Nº 2014-004918 de las\n14:30 horas del 09 de abril de 2014). En el caso que nos ocupa, de la prueba\naportada en autos, así como, de los informes rendidos bajo juramento, con\noportuno apercibimiento de las consecuencias previstas en el artículo 44, de la\nLey de la Jurisdicción Constitucional, esta Sala no puede tener por acreditado\nlo alegato por la recurrente, referido al desabastecimiento cuando indica que\npasan semanas contiguas sin agua y que al 12 de enero del 2018 llevaba cuatro\ndías sin agua en absoluto. Indican los recurridos que, “posterior a esta\nreunión [18 de diciembre del 2017] se ha logrado regularizar el servicio de la\nfamilia afectada y se han realizado mejoras para hacer una limpieza regular de\nlas tuberías, a través de la instalación de dos desfogues… que el único\nelemento extraño en el sistema ha sido arena, producto de los fenómenos\nnaturales que han afectado el país en los últimos meses… únicamente una familia\nde apellido Picado tenía problemas de abastecimiento en el acueducto, situación\nque ha sido solventada a la fecha.” Además, se agrega en el informe que, “… la\ninterrupción del servicio en Barrio Lámparas de Alajuelita, no se ha presentado\npor periodos prolongados de tiempo, a excepción del periodo inmediato posterior\na la tormenta Nate, sin embargo, durante este tiempo el servicio de agua\npotable se suplió mediante cisternas del AYA.” Siendo que, con claridad se\nindica en el informe que: “ No se puede indicar que el sistema estuviera sin\nservicio cuatro días consecutivos, hay reportes del 03, 10 y 12 de enero del\n2018, pero ninguno de ellos corresponde a la recurrente…” Así entonces, en\ncuanto a este alegato procede la desestimatoria del recurso, pues no logra\nprobarse como cierto el desabastecimiento continuo, ni tampoco que la\nrecurrente hubiere presentado reclamo alguno. 2) Sobre el alegato de\ncontaminación del agua: Ante la prueba para mejor resolver, ordenada por el\nMagistrado Instructor, se determina que, según prueba realizada por el AYA, con\nocasión de este recurso, el nivel de pH no cumple con el Reglamento para la\nCalidad del Agua Potable. Además, la calidad fisioquímica del agua superficial\nes muy variable, las concentraciones de aluminio y la suma de concentraciones\n(de hierro y manganeso), los niveles de color aparente, olor, pH, turbiedad, la\ndensidad de coliformes fecales y E. Coli no cumplen con el Reglamento para la\nCalidad del Agua Potable. Además, se incumple el artículo 18 del reglamento\npues no se debe introducir agua superficial sin tratamiento convencional en un\nsistema de abastecimiento. Por lo que el Riesgo Muy Alto (RMA) y el agua no\napta para ingesta, por lo que se recomienda implementar un sistema de\npotabilización adecuado. Todo lo cual resulta evidente, en una violación de\nderechos fundamentales, referidos a una amenaza al derecho a la salud y a la\nvida, una violación a la prestación eficiente de servicios públicos y al\nderecho al agua. Así entonces, en cuanto a este aspecto, procede la estimatoria\nde este recurso, con las consecuencias que se indican en la parte dispositiva\nde esta resolución. En conclusión, dado que no logra probarse un\ndesabastecimiento del agua potable, en los términos alegados por la recurrente,\ndurante enero del 2018, se desestima el recurso en cuanto a este aspecto. Sin\nembargo, dado que los mismos recurridos indican que, en efecto, la calidad del\nagua incumple con la normativa reglamentaria al respecto, encontrándose que no\nes apta para la ingesta, se admite el recurso en cuanto a este alegato, con las\nconsecuencias que se indican en la parte dispositiva de esta resolución”.\n\n Lo\nanterior denota que más de un decenio después, la comunidad de Las Lámparas\ncontinúa con los mismos problemas, a saber: la discontinuidad y contaminación\ndel agua que reciben. Aunque ahora se indica unas fechas puntuales de la\nafectación, es lo cierto que más bien se aprecia una problemática sistémica que\nse reitera. Aparte de que las acciones tomadas no constituyen más que\nsoluciones paliativas, pues el problema de fondo persiste. De tal forma, esa\nsituación constituye una vulneración del derecho de acceso al agua de las\npersonas de la localidad, en los términos señalados en el considerando supra.\nEllo, sin que hasta el momento se haya dado una solución definitiva a la\nproblemática aceptada por la autoridad recurrida, a pesar de que desde la sentencia\nemitida el 06 de mayo de 2016 se ordenó continuar con la ejecución del plan de\nmejoras en el acueducto. Incluso nótese que se hace referencia al mencionado\nproyecto en forma residual. Así, en la especie, el Tribunal constata que lleva\nrazón el recurrente en su reclamo.\n\nV.- Conclusión. Por consiguiente, se declara con lugar\nel recurso con la finalidad de ordenar a la autoridad recurrida del ICAA que se\nconcluya el proyecto Mejoras al Acueducto de Lámparas de Alajuelita No.\n2023LY-000021-0021400001, el cual se acepta que ayudará aún más a minimizar las\nafectaciones. (…)”",

IT IS ALLEGED THAT THE COMMUNITY OF LÁMPARAS DE ALAJUELITA SUFFERS RECURRING DRINKING WATER SUPPLY SHORTAGES AND DETERIORATION IN DRINKING WATER QUALITY. IT IS HELD THAT THE LACK OF A DEFINITIVE SOLUTION TO THE PROBLEM VIOLATES THE FUNDAMENTAL RIGHT TO DRINKING WATER AND TO EFFICIENT PUBLIC SERVICE DELIVERY. THE PETITION IS GRANTED AND THE AUTHORITY IS ORDERED TO COMPLETE THE WATER SYSTEM IMPROVEMENT PROJECT WITHIN TEN MONTHS. VCG08/2026\n\n\"(…) III.- On the Fundamental Right to Drinking Water. This Tribunal has recognized, in its jurisprudence, that the rights to health and to life are fundamental human rights that depend on access to drinking water, and that the competent authorities have an unavoidable responsibility to ensure that society as a whole does not see those rights diminished. Indeed, the Constitutional Chamber (Sala) has previously held that, as part of constitutional law, there exists a fundamental right to the supply of drinking water. Thus, in judgment No. 2003-004654 of 15:44 hours of May 27, 2003, the following was stated:\n\n\"V.- The Sala recognizes, as part of constitutional law, a fundamental right to drinking water, derived from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others, as has also been recognized in international human rights instruments applicable in Costa Rica: it appears explicitly in the Convention on the Elimination of All Forms of Discrimination Against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also set forth in the International Conference on Population and Development of Cairo (principle 2), and is declared in numerous other instruments of International Humanitarian Law. Within our Inter-American Human Rights System, the country is particularly bound in this matter by the provisions of article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (\"Protocolo de San Salvador\" of 1988), which provides that:\n\n'Article 11. Right to a Healthy Environment. 1. Everyone shall have the right to live in a healthy environment and to have access to basic public services.'\n\nFurthermore, recently, the UN Committee on Economic, Cultural and Social Rights reiterated that access to water is a human right that, in addition to being indispensable for leading a healthy life, is a prerequisite for the realization of all other human rights.\n\nVI.- From the foregoing normative framework, a series of fundamental rights flow, linked to the State's obligation to provide basic public services. These rights imply, on the one hand, that persons cannot be unlawfully deprived of such services; but, as in the case of drinking water, they cannot sustain the existence of an individually enforceable right whereby any person may demand that the State supply the public drinking water service immediately and wherever they may be. Rather, as provided in the Protocolo de San Salvador itself, this class of rights obligates States to adopt measures, as set forth in article 1 of that same Protocol:\n\n'The States Parties to this Additional Protocol to the American Convention on Human Rights undertake to adopt the necessary measures, both domestically and through international cooperation, especially economic and technical, to the maximum extent of their available resources and taking into account their level of development, with a view to achieving progressively, and in accordance with domestic legislation, the full effectiveness of the rights recognized in this Protocol.'\n\nNor may this be interpreted as meaning that the fundamental right to public services has no concrete enforceability; on the contrary, when it is reasonable to expect the State to provide them, the holders of the right may demand them, and public administrations — or, where applicable, private parties providing such services in their place — may not shield themselves behind alleged resource shortfalls, which have been the perennial public excuse for justifying the failure to fulfill their obligations.\"\n\nFrom the foregoing, it follows that the so-called fundamental right to water must be guaranteed to all persons, which means that every individual must have the possibility of accessing drinking water services on equal terms, given that water is essential to human life and health (judgment No. 2026-022312 of 09:30 hours of June 19, 2026).\n\nIV.- On the Specific Case. In the present matter, in response to the appellant's claim regarding the water supply shortage (desabastecimiento) and contamination of drinking water in the community of Lámparas in San Antonio de Alajuelita, the respondent authority, ICAA, stated in its sworn report — submitted under oath, with timely notice of the consequences, including criminal penalties, set forth in article 44 of the law governing this jurisdiction — and based on the documentary evidence submitted for the resolution of this amparo petition (recurso de amparo), that the operating area encompassing the Lámparas Water System, in San Antonio de Alajuelita, is in a condition of vulnerability because the water supply is drawn directly from an intake (captación) whose preliminary treatment infrastructure consists solely of a sand trap (desarenador). Consequently, events affecting the quality of the raw water may give rise to conditions of high turbidity (turbiedad) or blockages in the conveyance line that temporarily affect service delivery. In that context, between June 21 and 22, 2026, disruptions were recorded caused by blockages in the conveyance line due to excess sediment carried by the first rains. The situation was addressed and continuity of service was restored to the area following corrective maintenance. In addition, preventive maintenance was carried out on the intake screen in order to reduce the risk of similar incidents in the short term. It is stated that, as a result of those actions, normal pressure conditions were restored and that, since June 22, 2026, the system has maintained continuity in service delivery. Beyond the foregoing, ICAA is currently executing a project in the area to install the Planta Potabilizadora de Lámparas, a water treatment plant with a nominal flow rate (caudal) of 10 l/s, which will further help minimize disruptions. It is established that this is the project known as Mejoras al Acueducto de Lámparas de Alajuelita No. 2023LY-000021-0021400001, described as the design and construction of a modular portable water purification plant (planta potabilizadora), a 250 m3 storage tank, a 100 m3 elevated tank, two buildings (a warehouse and a laboratory), an equipment room, a container-type building for the operator's office and dining area, and a sludge management system, at a cost of ¢2.674.641.382,45, for which a start order has been issued and which is expected to be completed in April 2027.\n\nThe problem described by the appellant has come before this Sala on at least two prior occasions. In the amparo proceeding filed under case No. 16-004301-0007-CO, it was argued:\n\n\"The appellant, a resident of Alajuelita, considers her right to receive a continuous public drinking water service to have been violated, on the grounds that, since AYA assumed administration of the water system (acueducto), water arrives only briefly in the early morning hours every three days, and sometimes arrives contaminated.\"\n\nThat matter was granted by judgment No. 2016-006038 of 09:05 hours of May 06, 2016, with the following order:\n\n\"Por tanto: The petition is declared GRANTED. Accordingly, JOSE ALBERTO MOYA SEGURA, in his capacity as General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that position, is ordered to continue the execution of the improvement plan for the water system serving the community of Lámparas de Alajuelita, within the shortest possible time. This is issued with the warning that he could incur the offense defined in article 71 of the Ley de la Jurisdicción Constitucional, which provides that a prison term of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that he must comply with or cause to be complied with, issued in an amparo proceeding, and fails to comply with or enforce it, provided the offense is not more severely punishable under another provision. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed in administrative contentious enforcement proceedings. Personal notice shall be served on JOSE ALBERTO MOYA SEGURA, in his capacity as General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that position. Justice Hernández López appends a concurring note.\"\n\nThe foregoing was based on the following reasoning:\n\n\"III.- On the Merits. As can be observed, the appellant alleges a series of problems with the delivery of drinking water service in the community where she resides, citing problems of water shortage and even contamination of the water she receives. In this regard, in its report, the General Manager of the Instituto Costarricense de Acueductos y Alcantarillados provides a detailed explanation of all the problems arising in the delivery of drinking water service to the community of Lámparas de Alajuelita, acknowledging the existence of said problems and summarizing that 'The water shortage problem was inherited from the former community water management association (ASADA) and is attributable to infrastructure more than 30 years old; AYA is resolving it according to the plan that has been communicated to the neighborhood committee.' It is nevertheless argued that, since action has been taken within material constraints, no violation of fundamental rights can be said to have occurred in this case. From this, the Sala not only confirms that the appellant is correct in her assertions, but also, upon reading the report, observes the seriousness of the problem: the water system presents operational problems, high vulnerability to contamination, pressure imbalances causing unequal distribution, aging storage tanks, and an inadequate water purification (potabilización) and disinfection system. Although the respondent institute explains that it began operating the water system as of September 1, 2015, and has since been making improvements, repairs, and planning infrastructure works, the fact remains that this does not negate the reality that the delivery of the drinking water service to that community is not only deficient but also endangers the health of the population due to contamination problems. The respondent institute should, in any event, have ensured better supervision of service delivery, as it is the governing body in this area. The jurisprudence cited by the respondent, in which this Sala has absolved liability in cases of material impossibility of service delivery, refers to situations where the service is being provided to a user for the first time, and not to a sustained and widespread water shortage such as the one in this case. Accordingly, the violation of the fundamental rights alleged is confirmed. In conclusion, given that the water shortage in the public drinking water service provided by the respondent institute to the community of Lámparas de Alajuelita is confirmed, and given that the contamination of the drinking water is likewise confirmed, notwithstanding that the problem may have been inherited from prior service providers, a violation of the fundamental right to efficient public service delivery and the fundamental right to water is confirmed, along with a threat to the right to health — all of which compel the granting of this petition. Not only shall the award of damages and losses be made, but additionally the respondent is ordered to continue implementing the improvement plan within the shortest possible time.\"\n\nAlso pertinent is the amparo proceeding filed under case No. 18-002952-0007-CO, in which it was alleged:\n\n\"Subject of the petition. The appellant is a resident of Lámparas de Alajuelita, a place where the delivery of the public drinking water service is not only deficient but also endangers the health of service subscribers (abonados) due to contamination problems. She asserts that the water system presents operational problems, high vulnerability to contamination, and systems ill-suited for water purification and disinfection. She alleges that they suffer supply interruptions lasting weeks and that, at the time of filing, they had been without water for 4 days. She requests that the petition be granted.\"\n\nThat matter was declared partially granted by judgment No. 2018-006604 of 09:30 hours of April 27, 2028, with the following order:\n\n\"Por tanto: The petition is declared PARTIALLY GRANTED, solely on grounds of the lack of potability of the water. Accordingly, YAMILETTE ASTORGA ESPELETA, in her capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that position, is ordered to proceed immediately to coordinate actions to achieve the purification of the water and its compliance with regulatory and legal standards on Water Quality, within a maximum period of SIX months, counted from the notification of this ruling. In the meantime, immediate action must be taken to ensure that the community of Lámparas de Alajuelita receives drinking water, whether by means of water tankers (cisternas) or other measures. All of the foregoing is issued with the warning that she could incur the offense defined in article 71 of the Ley de la Jurisdicción Constitucional, which provides that a prison term of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that she must comply with or cause to be complied with, issued in an amparo proceeding, and fails to comply with or enforce it, provided the offense is not more severely punishable under another provision. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed in administrative contentious enforcement proceedings. Personal notice shall be served on YAMILETTE ASTORGA ESPELETA, in her capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that position.\"\n\nThat ruling was premised on the following:\n\n\"IV.- On the Merits. This matter has been processed as a new amparo petition, solely to examine the appellant's allegations of drinking water supply shortages lasting weeks and water contamination, which occurred as of the date of filing in January 2018. It should be noted that all other issues relating to the quality of drinking water service delivery in the community of Lámparas de Alajuelita were already resolved in a prior amparo proceeding by ruling No. 2016-06038, in which the order to continue with the water system improvement plan was reiterated, with the warning that a disciplinary proceeding could be initiated against the General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, and that the case could be referred to the Public Prosecutor for processing of the offense of contempt of court. Accordingly, the Court proceeds to examine the allegations of water shortage and contamination that occurred in January 2018. 1) On the allegation of water shortage in January 2018: In this regard, it must first be recalled that this Sala has established in consistent jurisprudence that access to drinking water constitutes a basic right for individuals, and that, with respect to supply problems, it has held that, to the extent that the respondent authorities demonstrate that action has been taken within their material constraints in order to achieve adequate supply, fundamental rights are not violated if the service is provided with some irregularities in flow rate or supply schedule (see, in this regard, judgments No. 2009-12511 of 17:59 hours of August 11, 2009, No. 2010-015448 of 12:15 hours of September 17, 2010, and No. 2014-004918 of 14:30 hours of April 09, 2014). In the present case, based on the evidence submitted in the record, as well as the sworn reports filed with timely notice of the consequences provided in article 44 of the Ley de la Jurisdicción Constitucional, the Sala cannot accept as proven the appellant's allegation that consecutive weeks pass without water and that, as of January 12, 2018, she had been without water for four consecutive days. The respondents state that \"following that meeting [December 18, 2017], service for the affected household was regularized and improvements were made to carry out regular cleaning of the pipes through the installation of two flushing valves… that the only foreign element in the system has been sand, a result of the natural phenomena that have affected the country in recent months… only one household with the surname Picado had supply problems in the water system, a situation that has been resolved as of this date.\" The report further adds that \"…the interruption of service in Barrio Lámparas de Alajuelita has not occurred for prolonged periods, with the exception of the period immediately following Tropical Storm Nate; however, during that time the drinking water service was supplied by AYA water tankers.\" The report clearly states: \"It cannot be said that the system was without service for four consecutive days; there are reports from January 3, 10, and 12, 2018, but none of them correspond to the appellant…\" Accordingly, with respect to this allegation, the petition must be denied, as the continuous water shortage is not proven, nor is it shown that the appellant filed any complaint. 2) On the allegation of water contamination: Based on evidence ordered by the Reporting Justice for the better resolution of the case, it is established that, according to testing conducted by AYA in connection with this petition, the pH level does not comply with the Reglamento para la Calidad del Agua Potable. Furthermore, the physicochemical quality of the surface water is highly variable; the concentrations of aluminum and the combined concentrations of iron and manganese, the levels of apparent color, odor, pH, turbidity, the density of fecal coliforms, and E. coli do not comply with the Reglamento para la Calidad del Agua Potable. Additionally, article 18 of the regulation is violated, since surface water without conventional treatment must not be introduced into a supply system. The risk level is therefore Very High (RMA) and the water is unfit for consumption; accordingly, the implementation of an adequate water purification system is recommended. All of this is manifestly a violation of fundamental rights, pertaining to a threat to the rights to health and to life, a violation of the right to efficient public service delivery, and a violation of the right to water. Accordingly, with respect to this aspect, the petition is granted, with the consequences set out in the operative part (parte dispositiva) of this ruling. In conclusion, given that a water shortage, in the terms alleged by the appellant for January 2018, cannot be proven, the petition is denied in that regard. However, given that the respondents themselves acknowledge that the water quality does not comply with the applicable regulatory standards and that the water is unfit for consumption, the petition is granted in respect of this allegation, with the consequences set out in the operative part of this ruling.\"\n\nThe foregoing makes clear that more than a decade later, the community of Las Lámparas continues to face the same problems: discontinuity and contamination of the water they receive. Although specific dates are now cited for the disruptions, what is in fact apparent is a systemic problem that recurs repeatedly. Moreover, the actions taken amount to nothing more than palliative measures, as the underlying problem persists. This situation accordingly constitutes a violation of the right of the community's residents to access water, in the terms set out in the foregoing recital. No definitive solution has yet been provided to the problem acknowledged by the respondent authority, despite the fact that since the judgment issued on May 06, 2016, an order was given to continue executing the water system improvement plan. It is also notable that the aforementioned project is referred to only in passing. Thus, in this matter, the Tribunal finds that the appellant's claim is well-founded.\n\nV.- Conclusion. Accordingly, the petition is granted for the purpose of ordering the respondent authority, ICAA, to complete the project known as Mejoras al Acueducto de Lámparas de Alajuelita No. 2023LY-000021-0021400001, which is acknowledged to further help minimize disruptions. (…)\""
