SE CUESTIONA LA CORTA DE ÁRBOLES Y LOS MOVIMIENTOS DE TIERRA EN\nEL PARQUE PÚBLICO DE MONTEZUMA PARA HABILITAR UNA CALLE POR PARTE DEL CONCEJO\nMUNICIPAL DE DISTRITO DE CÓBANO. SE DECLARA SIN LUGAR PORQUE EL PROYECTO CUENTA\nCON VIABILIDAD AMBIENTAL OTORGADA POR SETENA Y LAS DISCONFORMIDADES SOBRE SU\nSUSTENTO DEBEN VENTILARSE EN LA VÍA ORDINARIA DE LEGALIDAD. NQC08/2026.\n\n(…)\nIII.- Antecedente de relevancia. En sentencia nro. 2021000176 de las 9:15 horas\ndel 8 de enero de 2021 se resolvió:\n\n“V.-\nSobre el caso concreto. La recurrente aduce que el Concejo Municipal de\nDistrito de Cóbano pretende construir una calle nueva atravesando el parque\ninfantil de Montezuma.\n\nEn\nun primer orden de ideas, es menester indicar que, de los elementos que constan\nen autos, se aprecia que las partes procesales indican que el proyecto de esa\nnueva calle obedece al cumplimiento de lo ordenado por la Sala en la sentencia\nn.° 2020-8437 de las 9:20 horas del 8 de mayo de 2020 (expediente n.°\n20-3867-007-CO). Sin embargo, es preciso dejar en claro que en tal sentencia,\neste tribunal ordenó la solución al problema de paso que se presenta en el\ncentro de Montezuma, de modo que se garantice el libre paso de vehículos de\nemergencia, mas no se impuso una forma específica en que el Concejo Municipal\nde Distrito de Cóbano debía solventar la problemática. En este sentido, la\nparte dispositiva de ese fallo estableció lo siguiente: “Se declara con lugar\nel recurso. Se ordena a Cynthia María Rodríguez Quesada, en su condición de\nIntendente del Concejo Municipal de Distrito de Cóbano de Puntarenas, o a quien\nen su lugar ocupe el cargo, que gire las órdenes pertinentes y lleve a cabo\ntodas las actuaciones requeridas dentro del ámbito de sus competencias para que\nen el plazo de seis meses, contado a partir de la notificación de esta\nsentencia, se solucione el problema de paso al centro de Montezuma, de modo que\nse garantice el libre paso de vehículos de emergencia. En el ínterin, deberá\nadoptar las medidas viales temporales necesarias para asegurar, en el plazo\nmáximo de tres días contado a partir de la notificación de este\npronunciamiento, el tránsito de los vehículos de emergencia por la calle que da\nacceso al centro de la comunidad. (…)” (énfasis agregado).\n\nAhora\nbien, la recurrente aduce que el proyecto de esa nueva calle en el parque de\nMontezuma implicará la corta de árboles y la disminución del área de\nesparcimiento comunal. Acusa que el Concejo Municipal de Distrito de Cóbano en\nningún momento ha participado a la población en la toma de decisiones al\nrespecto.\n\nSin\nembargo, sobre un agravio similar, en sentencia n.° 2017-1163 de las 9:40 horas\ndel 27 de enero de 2017, esta Sala indicó lo siguiente:\n\n“V.-\nSobre la participación ciudadana en el caso concreto (redacción del Magistrado\nSalazar Alvarado). Además, los amparados acusan que los recurridos no han\ngarantizado la participación ciudadana en el proceso de extracción de agua del\nmanto acuífero de Sardinal, ni tampoco se les ha brindado información sobre los\nacuerdos y convenios firmados. En relación con este punto, como en otras\nocasiones lo ha manifestado el Magistrado Jinesta Lobo, la mayoría de la Sala\nconsidera que la participación ciudadana directa en los asuntos públicos o el\nmanejo de la cosa pública, es un evidente principio constitucional (artículo 9°\nde la Constitución) que debe ser actuado por el ordenamiento jurídico\nconstitucional e infraconstitucional. La participación ciudadana, como\nprincipio general del Derecho Constitucional, se proyecta en el terreno\npolítico o de gobierno y el meramente administrativo, para la toma de\ndecisiones fundamentales. En la dimensión política o de gobierno, el tema se\ndesarrolla a través de instrumentos como la regulación de los procesos de\nelección popular, el referéndum legislativo y la iniciativa popular en la\nformación de la ley. En el plano estrictamente administrativo, el principio de\nparticipación de los administrados debe ser desarrollado de manera paulatina y\nsegún la materia y sector, por cuanto, no toda decisión administrativa\nfundamental, debe estar, necesariamente, precedida, de participación ciudadana,\npuesto que de ser así se ralentizaría la gestión administrativa que debe ser,\npor aplicación de los principios constitucionales de eficacia y eficiencia,\nfluida y dinámica. Nuestra Constitución política, no enuncia ni señala los\nmecanismos de participación de los administrados en la adopción de las\ndecisiones administrativas fundamentales, esto es, no se ocupa de tal extremo.\nEl ordenamiento infraconstitucional, esencialmente, legal será el que vaya\ndeterminando aquellos sectores y materias donde debe haber una mayor\nparticipación (v. gr. en materia de elaboración de reglamentos, ambiental, de protección\ndel consumidor, de planificación urbana, regulación y fijación de tarifas en\nservicios de interés general, realización de consultas populares a nivel\nmunicipal como cabildos abiertos y referendos, etc.). Habrá situaciones en las\nque el legislador ordinario ha configurado tal participación como un verdadero,\nacabado y perfecto derecho, plenamente exigible, en determinadas circunstancias\ny bajo ciertos presupuestos y condiciones que habrá que verificar. En tales\ncasos, determinar si se ha quebrantado o no tal derecho de configuración\nlegislativa es una cuestión de legalidad que se debe discutir ante la\njurisdicción ordinaria o común y no en esta jurisdicción constitucional. En\ndefinitiva, lo que contemplan la Constitución vigente y los instrumentos internacionales\nen materia de derechos humanos, es un principio de participación, que por\nrazones obvias no alcanza el carácter preceptivo y exigible de un derecho\nfundamental o humano. No resulta posible extraer del texto fundamental y de los\ninstrumentos de Derechos Humanos un supuesto derecho a la participación que\nrija de manera incondicional para la adopción de cualquier o toda decisión\nadministrativa fundamental que justifique acoger todo amparo siempre que se\nalegue que se violó el mismo. Es el legislador ordinario el que paulatinamente,\nva configurando y desarrollando tal derecho de participación en ciertas\nmaterias y en determinados sectores del ordenamiento jurídico\ninfraconstitucional, por lo que, reitero, no le corresponde a la jurisdicción\nconstitucional, por ser una cuestión de legalidad ordinaria, establecer cuándo\nse ha infringido un derecho de configuración legal. En razón de lo expuesto, no\nresulta posible hablar, desde una perspectiva constitucional o convencional, de\nun derecho perfecto a la participación, debiendo, en su lugar, hacerse\nreferencia al principio constitucional de la participación ciudadana en la toma\nde decisiones fundamentales, sean políticas o administrativas.” (énfasis\nagregado).\n\nAsí\nlas cosas, respecto a este extremo, procede la desestimatoria de este recurso.\n\nVI.-\nLa tutelada también alega que el Concejo Municipal de Distrito de Cóbano\nsustentó el proyecto de la calle que pasará por el parque de Montezuma en el\nPlan Regulador Integral Cabuya Montezuma; sin embargo, tal plan carece de\nviabilidad ambiental. Reclama que el proyecto también se sustenta en la\nresolución n.° 327-2010- SETENA; empero esta corresponde a otro plan regulador,\nespecíficamente al Plan Regulador Centro Turístico Montezuma Cabuya, que tiene\nuna diferente zonificación al Plan Regulador Integral Cabuya Montezuma. Además,\nacusa que en esa resolución no se aprobó la apertura de una calle nueva dentro\ndel parque infantil.\n\nEmpero,\nen caso de existir alguna disconformidad respecto al sustento que justifica el\nproyecto de la calle por el parque de Montezuma, deberá ser alegada en la vía\nordinaria de legalidad, donde, en vía plenaria, se podrá determinar si se\nincluyó o no en alguno de los dos planes reguladores indicados, bajo qué\ncondiciones técnicas y legales específicas y si cumple con las disposiciones\ncorrespondientes a la zona donde se ubica. En este sentido, “recuérdese que el\nproceso de amparo es de carácter eminentemente sumario —es decir, breve y\nsencillo— y su tramitación no es compatible con la práctica de diligencias\nprobatorias lentas y complejas, o con la necesidad de entrar previamente a\nexaminar —con carácter declarativo— si los derechos de rango infra constitucional\nque las partes citan como parte del elenco fáctico del recurso de amparo o del\ninforme de ley, según sea el caso, existen en realidad. De allí que esta vía no\nsea apta para hacer amplias investigaciones en materia ambiental, puesto que\néstas harían necesario abrir el proceso a pruebas” (sentencia n.° 2017-3417 de\nlas 9:05 horas del 3 de marzo de 2017).\n\nAunado\na lo anterior, respecto al derecho a un ambiente sano y ecológicamente\nequilibrado, no constan elementos en autos que permitan acreditar una lesión de\nrelevancia constitucional residenciable en la vía sumaria del amparo. En esta\nlínea, según el informe rendido por el Director del Área de Conservación\nTempisque del Sistema Nacional de Áreas de Conservación (SINAC), se descarta\nque el área del parque de Montezuma califique como bosque, área silvestre\nprotegida o de protección hídrica. Además, se verifica que, mediante oficio n.º\nINT-2020-156, recibido el 6 de julio de 2020, el Concejo Municipal de Distrito\nde Cóbano solicitó al Área de Conservación Tempisque-SINAC la autorización para\nla corta de ocho árboles ubicados en el parque de la comunidad a efectos de\nhabilitar la calle que atravesará ese sector. Luego, mediante resolución n.°\n26-2020 de las 15:00 horas del 16 de julio de 2020 (notificada al Concejo\nMunicipal de Distrito de Cóbano el 24 de julio de 2020), la Oficina Subregional\nde Cóbano del Área de Conservación Tempisque del SINAC, posterior a la\ninspección in situ efectuada el 9 de julio de 2020, autorizó a tal concejo la\ntala de los árboles. Asimismo, se colige que el Concejo Municipal de Distrito\nde Cóbano está tramitando el permiso correspondiente ante el SETENA para las\nobras de habilitación de la calle aludida; sin embargo, los trámites se han\nvisto retrasados por un problema de pago, debido a lo cual el proyecto no se ha\niniciado en espera de la resolución de este inconveniente y el respectivo\npronunciamiento de la SETENA. En consonancia con ello, se aprecia en autos que,\nel 22 de julio de 2020, a la recurrente se le notificó el acuerdo tomado por el\nConcejo Municipal de Distrito de Cóbano en la sesión ordinaria n.° 11-20 del 14\nde julio de 2020, donde, en respuesta a una gestión planteada ante el concejo\nmunicipal de distrito contra la apertura de la referida calle, se indicó lo\nsiguiente: “De una manera responsable desde la administración se están llevando\nlas gestiones necesarias para la apertura de la calle, entre otros tramites\n(sic.) ya ha sido enviada la solicitud de autorización para la corta de los\nárboles, por otro lado se está (sic.) llevando a cabo la (sic.) gestiones para\ndar cumplimiento a lo solicitado por la Secretaría Técnica Nacional, por lo que\nuna vez se obtenga visto bueno por parte de estas dos instituciones este\nConcejo Municipal deberá dar marcha a la materialización de la calle (…)Es\nimportante destacar y reiterar que no se realizara (sic.) la corta de ningún\nárbol sin contar con las autorizaciones y visto bueno por parte de las\ninstituciones correspondientes”. Asimismo, en acuerdo adoptado en la sesión\nordinaria n.° 14-20 del 4 de agosto de 2020 (notificado el 6 de agosto de\n2020), el Concejo Municipal de Distrito de Cóbano reiteró a la accionante que\nlas obras para la habilitación de la aludida calle “serán puestas en marcha\ncuando se obtenga tanto la autorización de corta por parte del Sistema Nacional\nde Áreas de Conservación, y la viabilidad de la calle por parte de SETENA, de\nlo cual la recurrente tiene pleno conocimiento siendo que le fue notificado\njunto con el acuerdo de respuesta a la solicitud de no apertura de la calle de\nMontezuma”. Además, no sobra indicar que la parte recurrente no alega haber\ninterpuesto gestión alguna ante la SETENA acusando la presunta inviabilidad\nambiental del proyecto de la calle en el parque de Montezuma.\n\nAsí\nlas cosas, se impone la desestimatoria de este recurso en lo concerniente a\neste extremo, no sin antes advertir al Concejo Municipal de Distrito de Cóbano\nque, antes de comenzar la ejecución de las obras de la calle en el Parque de\nMontezuma, deberá haber recibido las autorizaciones correspondientes.\n\nVII.-Por\notro lado, la amparada acusa que el proyecto de construcción de la nueva calle\nque pasará por el parque de Montezuma no cuenta con la aprobación del Concejo\nMunicipal de Puntarenas, ni la del Ministerio de Obras Públicas y Transportes,\nlo que contraviene el artículo 15 de la Ley de Administración Vial.\n\nNo\nobstante, es menester indicar que no es resorte de esta Sala determinar el\ncumplimiento de requisitos dispuestos en la normativa infraconstitucional. En\nesta línea, este Tribunal Constitucional no es un contralor de la legalidad de\nlas actuaciones o resoluciones de la autoridad recurrida. Así las cosas,\ncualquier inconformidad al respecto, deberá alegarla la recurrente, si a bien\nlo tiene, ante la vía de legalidad ordinaria, donde también deberá plantear las\ndisconformidades de mera legalidad que esgrime respecto a la resolución\nadministrativa n.° 26-2020, mediante la que la Oficina Subregional de Cóbano\ndel Área de Conservación Tempisque autorizó al Concejo Municipal de Distrito de\nCóbano para talar los árboles del parque público de Montezuma.\n\nEn\nmérito de las consideraciones expuestas, se impone declarar sin lugar el\nrecurso en lo que a este agravio atañe.\n\nVIII.-\nVoto salvado del Magistrado Rueda en relación con la participación ciudadana.\nTal como lo consigné en la sentencia n.° 2017-1163 de las 9:40 horas del 27 de\nenero de 2017, a diferencia de la mayoría, estimo que el ordinal 9 de la\nConstitución Política no solo recoge un principio de rango constitucional, sino\nque la participación ciudadana debe ser considerada como un derecho\nfundamental, con todas las garantías y protección que ello implica. Conforme\nesta línea, en la aludida sentencia indiqué lo siguiente:\n\n“A.-\nSobre la relevancia constitucional del derecho a la participación ciudadana y\nsu impulso mediante la jurisprudencia de esta Sala. En la sentencia número\n2013-017305 de las 11:32 horas del 20 de diciembre de 2013, este Tribunal tuvo\nla oportunidad de analizar un recurso de amparo en el que se potenciaba la\nparticipación ciudadana como derecho fundamental. En esa oportunidad, se\nexplicó lo siguiente: “El derecho a la participación ciudadana en la toma de\ndecisiones se ha convertido en uno de los pilares fundamentales sobre los que\ndescansa el sistema democrático. En nuestro país, el legislador constitucional\nrecogió este derecho en el artículo 9 de la Constitución Política al disponer\nque el Gobierno de la República sea popular, representativo, participativo,\nalternativo y responsable. Este mandato de la Ley Fundamental ha orientado un\nposterior desarrollo normativo constitucional e infraconstitucional. Así, se ha\nestablecido una serie de mecanismos que buscan que el derecho al gobierno\nparticipativo pueda ser aplicado en forma efectiva, y no quede únicamente en el\npapel, tales como el referéndum para la aprobación o derogación de leyes y\nreformas parciales a la Constitución, o la iniciativa popular en la formación\nde leyes (véase, entre otras, la sentencia número 2005-05649 de las 14:39 horas\ndel 11 de mayo del 2005). El derecho al gobierno participativo, elevado a rango\nconstitucional mediante la reforma propiciada por Ley N° 8364 de 01 de julio de\n2003, publicada en La Gaceta N° 146 de 31 de julio de 2003, no solo significa\nun reconocimiento del más alto rango normativo a la función del control\npolítico, sino que, además, constituye una revalorización del papel del\nciudadano en los procesos de toma de decisión. Por voluntad del legislador\nconstituyente, que esta Sala no debe ni puede desconocer, el derecho al\ngobierno participativo se erige como pilar fundamental de nuestro régimen\ndemocrático -cuestión erróneamente desconocida por el voto de minoría, que le\nbaja la categoría a la participación ciudadana de derecho a principio general,\nen clara contraposición a la línea jurisprudencial de esta Sala como más\nadelante se demuestra-, lo que resulta conteste con un sistema político basado\nen la tolerancia, el pluralismo y el respeto a la libertad. Este derecho al\ngobierno participativo, también denominado derecho a la participación\nciudadana, se encuentre cobijado en varios instrumentos internacionales de\nderechos humanos. De este modo, el artículo 21 de la Declaración Universal de\nlos Derechos Humanos de 1948 dispone que \"toda persona tiene derecho a\nparticipar en el gobierno de su país, directamente o por medio de\nrepresentantes libremente escogidos\". Concordante con lo anterior, el\nnumeral 25 del Pacto Internacional de Derechos Civiles y Políticos reconoce\nexpresamente el derecho de los ciudadanos: “(…) de participar en la dirección\nde los asuntos públicos, directamente o por medio de representantes libremente\nelegidos”. En igual sentido, la Carta Democrática Interamericana señala en su\nartículo 5° que: “La democracia representativa se refuerza y profundiza con la\nparticipación permanente, ética y responsable de la ciudadanía en un marco de\nlegalidad conforme al respectivo orden constitucional”. De manera más\nvehemente, el numeral 6 de dicha Carta estatuye que: “La participación de la\nciudadanía en las decisiones relativas a su propio desarrollo es un derecho y\nuna responsabilidad. Es también una condición necesaria para el pleno y\nefectivo ejercicio de la democracia. Promover y fomentar diversas formas de participación\nfortalece la democracia”. Este reconocimiento convencional y constitucional al\nmencionado derecho representa un aspecto fundamental del modelo democrático de\neste siglo, en el que el control ciudadano, la transparencia y la rendición de\ncuentas destacan como factores inherentes al sistema republicano, lo que a su\nvez dota la toma de decisiones políticas de mucha mayor legitimidad, aspecto\nclave cuando de verdadera gobernabilidad se trata. Precisamente, uno de los\nmecanismos ideados para cumplir lo dispuesto en el artículo 9 constitucional es\nla audiencia pública, que constituye en un medio a través del cual las personas\ninteresadas pueden hacer valer sus derechos, participando activamente en temas\nde relevancia nacional o local, y poniendo en conocimiento de la Administración\ntodas aquellas anomalías o disconformidades en relación con el proyecto que se\npretenda desarrollar. Así las cosas, la audiencia pública es un instrumento\ntípico de una democracia madura, mediante el cual se fomente la participación\nactiva del ciudadano en la toma de decisiones públicas. Por su significado, la\naudiencia debe efectuarse de tal forma que garantice la mayor participación de\nlas personas que puedan verse afectadas, de ahí que cualquier acción u omisión\nque evite lo anterior, implica una abierta vulneración a los derechos\nfundamentales de los participantes (véase, entre otras, la sentencia número\n2009-018223). En cuanto al carácter participativo de la audiencia pública, la\npropia Constitución Política obliga a ello, pues con la reforma vigente desde\nel 31 de julio de 2003 al numeral 9 de la Ley Fundamental quedó estatuido que\nel Gobierno de la República tiene que ser, entre otros aspectos, participativo,\nlo que implica que el gobierno de turno es un articulador de lo establecido por\ndeliberación popular. En otras palabras, en la democracia actual, los\nciudadanos gozan, por mandato constitucional, ya no solo del derecho al voto\npara ejercer su derecho al gobierno participativo, sino de cantidad de\ninstrumentos de diversa naturaleza para coadyuvar en la toma de decisiones\npolíticas, lo que propicia que puedan ejercer influencia directa en las grandes\ndecisiones públicas. Este derecho fundamental de participación ciudadana\nestablece que el pueblo debe estar habilitado para manifestarse por igual en\npuntos de vista tanto mayoritarios como minoritarios. Así, serán importantes\ntanto los mecanismos de participación nacionales como el referéndum o\nplebiscito, como los locales. Durante la audiencia pública se les deben otorgar\na los participantes todas las facilidades para que se encuentren informados y\npuedan hacerse escuchar, todo dentro de lo razonable, pues tampoco puede\nconvertirse la audiencia en un obstáculo o un recurso para impedir que se dé\noportuna resolución a determinada gestión (…)”. Así las cosas, estimamos\nnecesario consignar esta nota con el fin de reiterar la relevancia\nconstitucional del numeral 9 de la Constitución Política, no solo como\nprincipio general sino como un claro y legítimo derecho fundamental, como lo hemos\nhecho en anteriores ocasiones.”\n\n Ahora bien, en el sub lite, la\nrecurrente acusa que no se dio la debida participación ciudadana en relación\ncon la habilitación de una nueva calle en el parque de Montezuma y las\nimplicaciones ambientales que ello conlleva (verbigracia, la corta de árboles).\nPor su parte, las autoridades recurridas del Concejo Municipal de Distrito de\nCóbano aducen que el proyecto de esa calle estaba incluido en el plan regulador\nexpuesto a la ciudadanía en la audiencia pública celebrada el 22 de junio de\n2012; pese a ello, lo cierto es que no aportan los elementos probatorios\nidóneos a los efectos de comprobar este hecho. Advierta la corporación\naccionada que, de acuerdo con la doctrina de la carga dinámica de la prueba,\naquella parte que esté en mejores condiciones de agregar prueba al proceso se\nencuentra aun más obligada a hacerlo (ver sentencias n.os 2018008396 de las\n12:40 horas del 25 de mayo de 2018, 2017015028 de las 9:15 horas del 22 de\nsetiembre de 2017 y 2013014504 de las\n9:05 horas del 1º de noviembre de 2013). En la especie, tal carga recae en la\nrecurrida, puesto que ella es responsable de resguardar el derecho a la\nparticipación de los habitantes del cantón en la tramitación del referido plan\nregulador, en virtud de lo cual recae sobre ella la obligación de contar y\naportar los medios probatorios que acrediten el respeto al gobierno\nparticipativo, cobijado en los artículos 9 de la Constitución Política y 5 del\nCódigo Municipal. En mérito de lo expuesto, estimo procedente la estimatoria de\neste recurso por la lesión al derecho fundamental a la participación ciudadana.\n(…)\n\nPor\ntanto:\n\nSe\ndeclara sin lugar el recurso. Tomen nota Favio José López Chacón y Ana Silvia\nLobo Prada, por su orden Intendente y Viceintendente, ambos del Concejo\nMunicipal del Distrito de Cóbano de la advertencia indicada en el considerando\nVI in fine de esta sentencia. El Magistrado Rueda Leal salva el voto y declara\ncon lugar el recurso por la vulneración al derecho fundamental a la\nparticipación ciudadana”.\n\nAdemás,\nen sentencia nro. 2025025664 de las 9:20 horas del 14 de agosto de 2026, se\nindicó:\n\n“V.-\nSobre el caso concreto: En el sub iudice, la recurrente reclama: 1) que, el 17\nde enero de 2025, un rótulo fue colocado contiguo al parque Montezuma, en el\nque se indicó la ejecución de un proyecto para la habilitación de calle\npública; empero, reclamara que esa obra no tiene un sentido lógico por su\nubicación y realizarla implica la destrucción del único parque donde existe\ndensidad boscosa; además, la autoridad accionada debe realizar una evaluación\nambiental y la información debe ser compartida con la población afectada, para\nasí determinar la necesidad de destruir una zona ambiental; y, 2) arguye que la\nsociedad que representa es concesionaria de un terreno, donde se ha invertido\nuna gran suma para la construcción de un hotel; empero, está ubicada en suelos\narenosos y, la excavación a realizarse para la construcción de la calle implica\nla desestabilización para el terreno en el que se está construyendo el hotel.\n\nAl\nrespecto, la Sala tiene por acreditado que, en el artículo VIII, inciso c, de\nla sesión ordinaria nro. 9-20 del 30 de junio de 2020, el Concejo Municipal de\nDistrito de Cóbano acordó autorizar a la Intendencia a tramitar ante el\nMINAE-SINAC la corta de ocho árboles ubicados “en los alrededores del parque de\nla comunidad de Montezuma exactamente por donde pasa la calle diseñada y\naprobada en el plan regulador Cabuya- Montezuma y que se habilitara (sic.) con\nel finde descongestionar el centro de la comunidad”. Posteriormente, mediante\noficio INT-2020-156, recibido el 6 de julio de 2020, el Concejo Municipal de\nDistrito de Cóbano solicitó al Área de Conservación Tempisque-SINAC la\nautorización para la corta de ocho árboles ubicados en el parque de la comunidad\nen el parque de la comunidad, a efectos de habilitar la calle que pasará por\nese sector. Asimismo, en resolución n.° 26-2020 de las 15:00 horas del 16 de\njulio de 2020 (notificado al Concejo Municipal de Distrito de Cóbano el 24 de\njulio de 2020), la Oficina Subregional de Cóbano del Área de Conservación\nTempisque del SINAC, posterior a la inspección in situ efectuada el 9 de julio\nde 2020, autorizó a tal concejo municipal de distrito para talar los árboles\nque había solicitado mediante oficio INT-2020-156. De igual forma, mediante\noficio n.° INT-2020-316 del 18 de setiembre de 2020, el Concejo Municipal de\nDistrito de Cóbano solicitó al SINAC la ampliación del plazo de vigencia del\npermiso para la corta de los árboles ubicados en el Parque de Montezuma debido\na que el trámite para la autorización por parte de SETENA se encontraba\nparalizado, ya que se habían presentado problemas con el pago del formulario\nD1. Según el Área de Conservación Tempisque-SINAC, el área cubierta por el\nparque de Montezuma no califica como bosque, ni es un área silvestre protegida\no de protección hídrica.\n\nPor\nsu parte, la Sala tiene por demostrado que, mediante resolución nro.\n0631-2021-SETENA del 22 de abril de 2021, la Secretaría Técnica Ambiental\nresolvió la solicitud del Concejo Municipal de Distrito de Cóbano para la\n“Habilitación Calle Pública Contiguo al Parque de Montezuma”. En tal documento\nse dispuso: “PRIMERO: Aprobar el Documento de Evaluación Ambiental D1\nDeclaración Jurada de Compromisos Ambientales sometido a evaluación ambiental\npor el proyectista. SEGUNDO: Comunicar\nal interesado que, de conformidad con los artículos 17,18 y 19 de la Ley\nOrgánica del Ambiente, se ha cumplido con el procedimiento de evaluación\nambiental del proyecto \"Habilitación Calle Pública Contiguo al Parque de\nMontezuma\", con expediente administrativo D1- 0625-2020-SETENA, según se\ndescribe a continuación. TERCERO: De acuerdo al Decreto N°\n31849-MINAE-S-MOPT-MAG-MEIC, la vigencia de esta viabilidad será por un período\nde CINCO AÑOS para el inicio de las obras. En caso de no iniciarse las obras en\nel tiempo establecido, se procederá a aplicar lo establecido en la legislación\nvigente. CUARTO: Se le ordena al señor\nFAVIO JOSE LOPEZ CHACON documento de identificación número 05-0351-0926 en\ncalidad de representante legal de la sociedad CONCEJO MUNICIPAL DE DISTRITO DE\nCOBANO con cédula jurídica 3-007-078297, expediente número D1-0625-2020-SETENA:\n(…) QUINTO: Con base en las características ambientales del AP y su interacción\ncon las actividades que realizará el proyecto, se establece una periodicidad de\npresentación de informes regenciales para periodos de cada SEIS MESES durante\nla fase constructiva y un informe final consolidado. Lo anterior de conformidad con lo establecido\nen el Acuerdo de Plenaria CP-036-2011-SETENA del 28 de febrero del 2011. Los\nInformes ambientales deberán ser presentados en un plazo máximo de 10 días\nposteriores a la finalización del periodo que cubren. En el momento de iniciar\nactividades se inicia el periodo del primer informe de regencia ambiental. Para\nla elaboración de estos informes, de acuerdo al formato establecido por esta\nSecretaría, será responsabilidad del regente ambiental realizar el número de\nvisitas necesarias, dependiendo de las características del proyecto. Con base\nen estos informes y al programa de monitoreo, la SETENA podrá ajustar el monto\nde garantía y dictar medidas al interesado su compromiso por cumplir con todas\nlas de acatamiento obligatorio para\nmantener al proyecto, obra o actividad dentro de un margen de impacto ambiental\ncontrolado. El responsable y el propietario deberán brindar apoyo a las labores\nde la SETENA, en las inspecciones que esta efectúe. Recordar que el otorgamiento de la Viabilidad\nAmbiental es un paso dentro del proceso de Evaluación de Impacto Ambiental y\nque luego de otorgada ésta, inicia la etapa de gestión ambiental que debe\nrealizar esta Secretaría, por medio del Departamento de Auditoría y Seguimiento\nAmbiental (ASA), lo anterior de conformidad con el acuerdo de la Comisión\nPlenaria, No. 015-2014, del 26 de agosto de 2014. SEXTO: Cumplir con lo establecido en la\nResolución N° 1834-2016-SETENA, \"Rotulación de Proyectos con Viabilidad\nAmbiental\", del 29 de septiembre del 2016. \nSÉTIMO: Advertir al desarrollador que si se llegare a verificar el\nincumplimiento de las obligaciones ambientales adquiridas, de conformidad con\nel artículo 14 del Decreto Ejecutivo 31849, o de comprobarse falsedad o\nmanipulación de la información aportada, por el carácter de Declaración Jurada\nque tiene el instrumento presentado, esta Secretaría podrá proceder conforme a\nlo señalado en el artículo 15 de ese mismo Decreto, dejando sin efecto la\nViabilidad (Licencia) Ambiental otorgada mediante este documento, debiendo\npresentar la documentación correspondiente, independientemente de la facultad\nde presentar las denuncias penales correspondientes por cualquier delito\ncometido, o de aplicar cualesquiera de las sanciones de las enumeradas en el\nartículo 99 de la Ley Orgánica del Ambiente. \nOCTAVO: Recordar recomendaciones/prevenciones, que se desprenden de los\nestudios técnicos complementarios y lo descrito en el CONSIDERANDO TERCERO\nanterior. NOVENO: Recordar al\ndesarrollador que de acuerdo al Artículo 11 del Decreto Ejecutivo N° 31849-\nMINAE-S-MOPT-MAG-MEIC-Alcance del trámite de EIA ante la SETENA, el\ncumplimiento del procedimiento de EIA, no lo exime del trámite a cumplir ante\notras autoridades de la Administración, de conformidad con las competencias y\nnormativa vigentes, ni de cumplir con sus obligaciones o responsabilidades que\nde su gestión deriven. DÉCIMO: Contra\nesta resolución cabe interponer dentro del plazo de tres días hábiles, contados\na partir del día hábil siguiente a la notificación, los recursos ordinarios de\nrevocatoria ante la SETENA, y el de apelación ante el Ministro de Ambiente y\nEnergía, de conformidad con los artículos 342 y siguientes de la Ley General de\nAdministración Pública N° 6227, y 87 de la Ley Orgánica del Ambiente N°\n7554. DÉCIMO PRIMERO: Toda documentación\nque sea presentada ante la SETENA deberá indicar claramente el número de\nexpediente, el número de resolución y el nombre completo del proyecto. También\nse deberá indicar una dirección de correo electrónico, para recibir\nnotificaciones de parte de esta Secretaría. \nDÉCIMO SEGUNDO: El expediente completo, así como los documentos que la\nSETENA ha emitido durante el proceso de Evaluación estarán a disposición del\ndesarrollador en la dirección web”.\n\nAsí,\ndebido a la viabilidad ambiental antedicha, fue que, el 15 de enero de 2025, el\nConcejo Municipal de Distrito de Cóbano colocó un letrero en las inmediaciones\ndel parque de Montezuma, en el que se lee: “PROYECTO HABILITACIÓN CALLE PÚBLICA\nCONTIGUO AL PARQUE DE MONTEZUMA DESARROLLADOR: CONCEJO MUNICIPAL DE DISTRITO DE\nCÓBANO ÁREA DEL PROYECTO 704 m EXPEDIENTE NÚMETO D1-0625-2020-SETENA RESULUCIÓN\nDE VIABILIDAD AMBIENTAL N° 0631-2021-SETENA 22 DE ABRIL DEL 2021”.\n\nAsí\nlas cosas, lo correspondientes es declarar sin lugar este extremo del recurso.\nEn este sentido, la parte accionante sostiene que esa viabilidad otorgada es\nimprocedente, pues corresponde a otro plan regulador. Empero, tal y como ya se\ndispuso en la supracitada sentencia nro. 2021000176 de las 9:15 horas del 8 de\nenero de 2021, en caso de existir alguna disconformidad respecto al sustento\nque justifica el proyecto de la calle por el parque de Montezuma, deberá ser\nalegada en la vía ordinaria de legalidad, donde se podrá determinar si se\nincluyó o no en alguno de los dos planes reguladores indicados, bajo qué\ncondiciones técnicas y legales específicas y si cumple con las disposiciones\ncorrespondientes a la zona donde se ubica.\n\nAdemás,\nrespecto al derecho a un ambiente sano y ecológicamente equilibrado, no constan\nelementos en autos que permitan acreditar una lesión de relevancia\nconstitucional residenciable en la vía sumaria del amparo. Así, como se indicó\nen sentencia 2021000176 de las 9:15 horas del 8 de enero de 2021, se descartó\nque el área del parque de Montezuma califique como bosque, área silvestre\nprotegida o de protección hídrica. Además, se verifica que mediante resolución\nnro. 0631-2021-SETENA del 22 de abril de 2021, la Secretaría Técnica Ambiental\nemitió la viabilidad ambiental respectiva.\n\nY,\npor último, no está de más señalar que la parte recurrente no alega haber\ninterpuesto gestión alguna ante la Setena acusando la presunta inviabilidad\nambiental del proyecto de la calle en el parque de Montezuma.\n\nVI.-\nPor otra parte, la accionante reclama que la sociedad que representa es\nconcesionaria de un terreno, donde se ha invertido una gran suma para la\nconstrucción de un hotel; empero, está ubicada en suelos arenosos y, la\nexcavación a realizarse para la construcción de la calle implica la\ndesestabilización para el terreno en el que se está construyendo el hotel.\n\nAl\nrespecto, en primer lugar, no se verifica que la parte amparada haya formulada\ngestión alguna para denunciar tal situación ante la autoridad accionada.\nAdemás, del informe rendido, con las responsabilidades y solemnidades que ello\nconlleva, se desprende que: “No lleva en razón al indicar que paga derechos,\nsiendo de conocimiento de conformidad a la Ley 6043 sobre Zona Marítimo\nTerrestre y su Reglamento que el pago del canon por concesión corresponde al\nmomento de ser aprobado el trámite por este Concejo Municipal de Distrito para\nel respectivo otorgamiento por parte del Instituto Costarricense de Turismo y\nal día de hoy el proceso de solicitud de concesión se encuentra detenido por\nparte de sociedad Las Brisas de las Delicias de Cóbano S. A., expediente\n3963-2020, siendo que no ha ajustado el plano presentado en el trámite,\nasimismo, si ha permanecido en la parcela solicitada en concesión de previo a\nentrada en vigencia del Plan Regulador Integral Cabuya Montezuma según\npublicación de la Gaceta 184 del día miércoles 14 de setiembre del año 2016, y\nde previo a esta fecha ha pagado algún impuestos, corresponde al representante\nlegal de la sociedad apersonarse a este Concejo Municipal de Distrito a\nrealizar el trámite correspondiente. \nExisten intereses propios de la recurrente respecto al terreno\nsolicitado en concesión por su representada porque no ha ajustado los retiros\ncorrespondientes de las construcciones de conformidad al plano aportado en la\nsolicitud de concesión y el Plan Regulador Integral Cabuya Montezuma y no por\nun tema ambiental siendo que el proyecto que aquí recurre cuanta con la\nrespectiva viabilidad ambiental y estudios correspondientes, como consta en la\nprueba que aquí se adjunta. No es cierto\nque su representada se coloca en estado de indefensión siendo que cuenta con la\nposibilidad de ajustar las construcciones de conformidad a la Ley 9242 para la\nregulación de las construcciones existentes en la Zona Restringida de la Zona\nMarítimo Terrestre, que la misma recurrente no ha gestionado al no querer\najustar los retiros de la parcela solicitada en concesión”.\n\nAsí\nlas cosas, a priori, la Sala no cuenta con elemento alguno que permita\nverificar conculcación alguna a los derechos fundamentales de la sociedad\namparada. En consecuencia, se desestima este extremo del amparo. (…)\n\nPor\ntanto:\n\nSe\ndeclara sin lugar el recurso. El magistrado Rueda Leal consigna nota”.\n\nIV.-\nSOBRE EL CASO EN CONCRETO. Vistos los reclamos del accionante, lo\ncorrespondiente es declarar sin lugar el recurso.\n\nTal\ny como se desprende de los precedentes transcritos, en caso de existir alguna\ndisconformidad respecto al sustento que justifica el proyecto de la calle por\nel parque de Montezuma, deberá ser alegada en la vía ordinaria de legalidad,\ndonde se podrá determinar si se incluyó o no en alguno de los dos planes\nreguladores indicados, bajo qué condiciones técnicas y legales específicas y si\ncumple con las disposiciones correspondientes a la zona donde se ubica.\n\nAdemás,\nrespecto al derecho a un ambiente sano y ecológicamente equilibrado, no constan\nelementos en autos que permitan acreditar una lesión de relevancia\nconstitucional residenciable en la vía sumaria del amparo. THE TREE FELLING (corta de árboles) AND EARTHWORKS (movimientos de tierra) IN THE MONTEZUMA PUBLIC PARK TO OPEN A ROAD BY THE DISTRICT MUNICIPAL COUNCIL OF CÓBANO ARE CHALLENGED. DISMISSED BECAUSE THE PROJECT HAS ENVIRONMENTAL FEASIBILITY (viabilidad ambiental) GRANTED BY SETENA AND DISAGREEMENTS REGARDING ITS BASIS MUST BE LITIGATED THROUGH THE ORDINARY LEGALITY JURISDICTION (vía ordinaria de legalidad). NQC08/2026.\n\n(…)\nIII.- Relevant Background. In judgment no. 2021000176 of 9:15 a.m. on January 8, 2021, the following was decided:\n\n\"V.-\nOn the specific case. The appellant argues that the District Municipal Council of Cóbano intends to build a new road through the children's park (parque infantil) of Montezuma.\n\nAs a preliminary matter, it should be noted that, based on the elements in the record, the parties indicate that the project for the new road is aimed at complying with the order issued by this Court in judgment no. 2020-8437 of 9:20 a.m. on May 8, 2020 (expediente n.° 20-3867-007-CO). However, it must be made clear that in that judgment, this Court ordered a solution to the right-of-way problem in the center of Montezuma so as to guarantee the free passage of emergency vehicles, but it did not prescribe a specific method by which the District Municipal Council of Cóbano should resolve the issue. In this regard, the operative part of that ruling established the following: 'The appeal is granted. Cynthia María Rodríguez Quesada, in her capacity as District Intendant of the District Municipal Council of Cóbano of Puntarenas, or whoever holds the position in her place, is ordered to issue the relevant instructions and carry out all actions required within the scope of her authority so that, within six months from the notification of this judgment, the right-of-way problem to the center of Montezuma is resolved, thereby guaranteeing the free passage of emergency vehicles. In the interim, she shall adopt the temporary road measures necessary to ensure, within a maximum of three days from the notification of this ruling, the transit of emergency vehicles along the road providing access to the center of the community. (…)' (emphasis added).\n\nNow, the appellant argues that the project for the new road through the Montezuma park will involve tree felling and a reduction of the communal recreation area. She claims that the District Municipal Council of Cóbano has at no point involved the public in the decision-making process in this regard.\n\nHowever, on a similar grievance, in judgment no. 2017-1163 of 9:40 a.m. on January 27, 2017, this Court stated the following:\n\n'V.-\nOn citizen participation in the specific case (drafted by Justice Salazar Alvarado). Furthermore, the protected parties claim that the respondents have not guaranteed citizen participation in the water extraction process from the aquifer (manto acuífero) of Sardinal, nor have they been provided with information about the agreements and conventions signed. In this regard, as Justice Jinesta Lobo has expressed on other occasions, the majority of the Court considers that direct citizen participation in public affairs or the management of public matters is a clear constitutional principle (Article 9 of the Constitution) that must be given effect by both the constitutional and sub-constitutional legal order. Citizen participation, as a general principle of Constitutional Law, extends into the political or governmental sphere as well as the purely administrative sphere, for the making of fundamental decisions. In the political or governmental dimension, the matter is developed through instruments such as the regulation of popular election processes, the legislative referendum, and the popular initiative in the formation of law. In the strictly administrative realm, the principle of participation by those administered must be developed gradually and according to the subject matter and sector, since not every fundamental administrative decision must necessarily be preceded by citizen participation, as that would slow down administrative management which, by application of the constitutional principles of effectiveness and efficiency, must be fluid and dynamic. Our Political Constitution neither enumerates nor specifies the mechanisms for participation by those administered in the adoption of fundamental administrative decisions; that is, it does not address that matter. The sub-constitutional legal order will be what progressively determines those sectors and subject matters where greater participation is required (e.g., in the areas of regulatory drafting, environmental matters, consumer protection, urban planning, regulation and rate-setting for public services, and conducting popular consultations at the municipal level such as open town councils and referenda, etc.). There will be situations in which the ordinary legislature has configured such participation as a true, complete, and perfected right, fully enforceable in certain circumstances and under certain requirements and conditions that must be verified. In such cases, determining whether this legislatively configured right has been violated is a matter of legality to be argued before the ordinary jurisdiction, not before this constitutional jurisdiction. In sum, what the current Constitution and international human rights instruments provide for is a principle of participation which, for obvious reasons, does not attain the mandatory and enforceable character of a fundamental or human right. It is not possible to derive from the fundamental text and from human rights instruments an alleged right to participation that applies unconditionally to the adoption of any or all fundamental administrative decisions, such that every amparo (constitutional rights protection action) alleging its violation would be granted. It is the ordinary legislature that gradually shapes and develops this right of participation in certain subject matters and in specific sectors of the sub-constitutional legal order; accordingly, I reiterate, it is not for the constitutional jurisdiction—as this is a matter of ordinary legality—to determine when a legislatively configured right has been violated. In light of the foregoing, it is not possible to speak, from a constitutional or conventional perspective, of a perfect right to participation; instead, reference must be made to the constitutional principle of citizen participation in fundamental decision-making, whether political or administrative.' (emphasis added).\n\nThat being so, the dismissal of this appeal on this point is warranted.\n\nVI.-\nThe protected party also claims that the District Municipal Council of Cóbano based the road project through the Montezuma park on the Plan Regulador Integral Cabuya Montezuma; however, that plan lacks environmental feasibility. She claims that the project is also based on resolution no. 327-2010-SETENA; however, that resolution corresponds to a different regulatory plan (plan regulador), specifically the Plan Regulador Centro Turístico Montezuma Cabuya, which has a different zoning from the Plan Regulador Integral Cabuya Montezuma. Furthermore, she argues that that resolution did not approve the opening of a new road within the children's park.\n\nHowever, should any disagreement exist regarding the basis justifying the road project through the Montezuma park, it must be argued before the ordinary legality jurisdiction, where, in plenary proceedings, it will be determined whether or not it was included in either of the two regulatory plans mentioned, under what specific technical and legal conditions, and whether it complies with the regulations applicable to the zone in which it is located. In this regard, 'it should be recalled that the amparo process is eminently summary in nature—that is, brief and simple—and its processing is incompatible with the conduct of slow and complex evidentiary proceedings, or with the need to first examine—by way of declaration—whether the sub-constitutional rights that the parties cite as part of the factual background of the amparo appeal or the statutory report, as the case may be, actually exist. This is why this forum is not suitable for conducting broad investigations in environmental matters, as such investigations would require opening the proceedings to evidence' (judgment no. 2017-3417 of 9:05 a.m. on March 3, 2017).\n\nFurthermore, regarding the right to a healthy and ecologically balanced environment, there is no evidence in the record that would establish a constitutional-level violation cognizable through the summary amparo process. In this regard, according to the report submitted by the Director of the Tempisque Conservation Area of SINAC, it is confirmed that the Montezuma park area does not qualify as a forest (bosque), a protected wildlife area (área silvestre protegida), or a water protection area (área de protección hídrica). Furthermore, it is established that, by official letter no. INT-2020-156, received on July 6, 2020, the District Municipal Council of Cóbano requested authorization from the Tempisque Conservation Area-SINAC for the tree felling of eight trees located in the community park in order to open the road that will pass through that area. Subsequently, by resolution no. 26-2020 of 3:00 p.m. on July 16, 2020 (notified to the District Municipal Council of Cóbano on July 24, 2020), the Cóbano Sub-regional Office of the Tempisque Conservation Area of SINAC, following the on-site inspection carried out on July 9, 2020, authorized the council to fell the trees. Likewise, it follows that the District Municipal Council of Cóbano is processing the corresponding permit before SETENA for the road opening works; however, the proceedings have been delayed due to a payment issue, as a result of which the project has not commenced, pending resolution of this problem and the corresponding ruling from SETENA. In keeping with this, the record reflects that, on July 22, 2020, the appellant was notified of the agreement adopted by the District Municipal Council of Cóbano at ordinary session no. 11-20 of July 14, 2020, in which, in response to a petition filed before the district municipal council opposing the opening of the said road, the following was stated: 'In a responsible manner, the administration is carrying out the necessary procedures for the opening of the road; among other steps, the request for authorization for the tree felling has already been submitted; on the other hand, steps are being taken to comply with what has been requested by the Secretaría Técnica Nacional, so that once approval is obtained from these two institutions this Municipal Council must proceed with the materialization of the road (…) It is important to emphasize and reiterate that no tree felling will take place without the authorizations and approval from the corresponding institutions'. Likewise, in an agreement adopted at ordinary session no. 14-20 of August 4, 2020 (notified on August 6, 2020), the District Municipal Council of Cóbano reiterated to the petitioner that the road opening works 'will be set in motion once both the tree felling authorization from the Sistema Nacional de Áreas de Conservación and the road feasibility approval from SETENA are obtained, of which the appellant is fully aware, as she was notified together with the response agreement to the request for non-opening of the Montezuma road'. Furthermore, it should be noted that the appellant does not claim to have filed any petition before SETENA alleging the alleged environmental infeasibility of the road project in the Montezuma park.\n\nThat being so, the dismissal of this appeal is warranted on this point, but not before warning the District Municipal Council of Cóbano that, before commencing the execution of the road works in the Montezuma park, it must have received the corresponding authorizations.\n\nVII.-\nOn another point, the protected party claims that the construction project for the new road through the Montezuma park does not have the approval of the Municipal Council of Puntarenas, nor that of the Ministry of Public Works and Transportation, which contravenes Article 15 of the Ley de Administración Vial.\n\nNevertheless, it should be noted that it is not within this Court's purview to determine compliance with requirements established in sub-constitutional regulations. In this regard, this Constitutional Court is not a reviewer of the legality of the acts or resolutions of the respondent authority. That being so, any disagreement in this regard must be raised by the appellant, if she sees fit, before the ordinary legality jurisdiction, where she must also raise the purely legality-based objections she advances regarding administrative resolution no. 26-2020, by which the Cóbano Sub-regional Office of the Tempisque Conservation Area authorized the District Municipal Council of Cóbano to fell the trees in the Montezuma public park.\n\nIn light of the foregoing considerations, the dismissal of the appeal is warranted with respect to this grievance.\n\nVIII.-\nDissenting vote of Justice Rueda regarding citizen participation. As I stated in judgment no. 2017-1163 of 9:40 a.m. on January 27, 2017, unlike the majority, I consider that Article 9 of the Political Constitution not only enshrines a constitutional-level principle, but that citizen participation must be regarded as a fundamental right, with all the guarantees and protections that this entails. In accordance with this position, in that judgment I stated the following:\n\n'A.-\nOn the constitutional relevance of the right to citizen participation and its promotion through the jurisprudence of this Court. In judgment no. 2013-017305 of 11:32 a.m. on December 20, 2013, this Court had the opportunity to analyze an amparo appeal in which citizen participation was advanced as a fundamental right. On that occasion, the following was explained: 'The right to citizen participation in decision-making has become one of the fundamental pillars upon which the democratic system rests. In our country, the constitutional legislature enshrined this right in Article 9 of the Political Constitution by providing that the Government of the Republic shall be popular, representative, participatory, alternating, and accountable. This mandate of the Fundamental Law has guided subsequent constitutional and sub-constitutional regulatory development. Thus, a series of mechanisms has been established to ensure that the right to participatory government can be applied effectively and does not remain merely on paper, such as the referendum for the approval or repeal of laws and partial constitutional amendments, or the popular initiative in the formation of laws (see, among others, judgment no. 2005-05649 of 2:39 p.m. on May 11, 2005). The right to participatory government, elevated to constitutional rank through the amendment enacted by Ley N° 8364 of July 1, 2003, published in La Gaceta N° 146 of July 31, 2003, not only represents a recognition at the highest normative level of the function of political oversight, but also constitutes a revaluation of the role of the citizen in decision-making processes. By the will of the constituent legislature—which this Court must not and cannot disregard—the right to participatory government stands as a fundamental pillar of our democratic system—a matter erroneously disregarded by the dissenting opinion, which reduces citizen participation from a right to a general principle, in clear contradiction to the jurisprudential line of this Court as will be shown below—which is consistent with a political system based on tolerance, pluralism, and respect for freedom. This right to participatory government, also referred to as the right to citizen participation, is enshrined in various international human rights instruments. Thus, Article 21 of the Universal Declaration of Human Rights of 1948 provides that 'everyone has the right to take part in the government of his country, directly or through freely chosen representatives'. Consistently with the foregoing, Article 25 of the International Covenant on Civil and Political Rights expressly recognizes the right of citizens '(…) to take part in the conduct of public affairs, directly or through freely chosen representatives'. In the same vein, the Inter-American Democratic Charter states in its Article 5 that: 'Representative democracy is strengthened and deepened by the permanent, ethical, and responsible participation of citizens within a framework of legality in accordance with the respective constitutional order'. More emphatically, Article 6 of that Charter provides that: 'The participation of citizens in decisions relating to their own development is a right and a responsibility. It is also a necessary condition for the full and effective exercise of democracy. Promoting and fostering various forms of participation strengthens democracy'. This conventional and constitutional recognition of the aforementioned right represents a fundamental aspect of the democratic model of this century, in which citizen oversight, transparency, and accountability stand out as inherent factors of the republican system, which in turn endows political decision-making with far greater legitimacy—a key aspect when it comes to true governance. Precisely, one of the mechanisms devised to fulfill the mandate of constitutional Article 9 is the public hearing (audiencia pública), which constitutes a means through which interested persons can assert their rights, actively participating in matters of national or local relevance, and bringing to the Administration's attention all anomalies or objections regarding the project to be developed. That being so, the public hearing is a typical instrument of a mature democracy, by which the active participation of citizens in public decision-making is fostered. Given its significance, the hearing must be conducted in a manner that guarantees the broadest possible participation of those who may be affected; hence, any action or omission that prevents this constitutes an open violation of the participants' fundamental rights (see, among others, judgment no. 2009-018223). As regards the participatory nature of the public hearing, the Political Constitution itself requires it, since with the amendment to Article 9 of the Fundamental Law in force since July 31, 2003, it was established that the Government of the Republic must be, among other things, participatory, which implies that the government in office is an articulator of what is established through popular deliberation. In other words, in today's democracy, citizens enjoy, by constitutional mandate, not only the right to vote in order to exercise their right to participatory government, but also a variety of instruments of diverse nature to assist in political decision-making, which allows them to exercise direct influence over major public decisions. This fundamental right of citizen participation establishes that the people must be empowered to express themselves equally on both majority and minority viewpoints. Thus, both national participation mechanisms such as the referendum or plebiscite, and local ones, will be important. During the public hearing, participants must be afforded all necessary means to be informed and to make themselves heard, all within reason, as the hearing cannot itself become an obstacle or a tool to prevent the timely resolution of a given matter (…)'. That being so, we deem it necessary to place on record this note in order to reiterate the constitutional relevance of Article 9 of the Political Constitution, not only as a general principle but as a clear and legitimate fundamental right, as we have done on previous occasions.'\n\nNow, in the case at hand, the appellant claims that proper citizen participation was not afforded in connection with the opening of a new road in the Montezuma park and the environmental implications this entails (for example, the tree felling). For their part, the respondent authorities of the District Municipal Council of Cóbano argue that the road project was included in the regulatory plan presented to the public at the public hearing held on June 22, 2012; nonetheless, the fact is that they do not provide the appropriate evidentiary elements to prove this. The respondent body is advised that, in accordance with the doctrine of the dynamic burden of proof (carga dinámica de la prueba), the party that is in the best position to add evidence to the proceedings is all the more obligated to do so (see judgments nos. 2018008396 of 12:40 p.m. on May 25, 2018, 2017015028 of 9:15 a.m. on September 22, 2017, and 2013014504 of 9:05 a.m. on November 1, 2013). In this case, such burden falls on the respondent, since it is responsible for safeguarding the right to participation of the inhabitants of the canton in the processing of the said regulatory plan, and therefore it bears the obligation to possess and provide the evidentiary means that establish compliance with the participatory government mandate enshrined in Articles 9 of the Political Constitution and 5 of the Código Municipal. In light of the foregoing, I consider the granting of this appeal to be appropriate due to the violation of the fundamental right to citizen participation. (…)\n\nPor tanto:\n\nThe appeal is dismissed. Favio José López Chacón and Ana Silvia Lobo Prada, in their respective capacities as District Intendant and Deputy District Intendant of the District Municipal Council of Cóbano, are hereby advised of the warning set forth in considerando VI in fine of this judgment. Justice Rueda Leal dissents and would grant the appeal for violation of the fundamental right to citizen participation.\"\n\nAdditionally, in judgment no. 2025025664 of 9:20 a.m. on August 14, 2026, the following was stated:\n\n\"V.-\nOn the specific case: In the matter before the Court, the appellant claims: 1) that, on January 17, 2025, a sign was placed adjacent to the Montezuma park indicating the execution of a project for the opening of a public road; however, she contends that this project makes no logical sense given its location and that carrying it out implies the destruction of the only park where there is forest density (densidad boscosa); furthermore, the respondent authority must conduct an environmental assessment (evaluación ambiental) and the information must be shared with the affected population in order to determine the necessity of destroying an environmental zone; and 2) she argues that the company she represents holds a concession over a plot of land on which a large sum has been invested for the construction of a hotel; however, it is located on sandy soil and the excavation to be carried out for the road construction implies the destabilization of the terrain on which the hotel is being built.\n\nIn this regard, the Court finds it established that, in Article VIII, paragraph c, of ordinary session no. 9-20 of June 30, 2020, the District Municipal Council of Cóbano agreed to authorize the District Intendancy to process before MINAE-SINAC the tree felling of eight trees located 'in the surroundings of the Montezuma community park, exactly where the road designed and approved in the Plan Regulador Cabuya-Montezuma passes and which will be opened (sic.) in order to decongest the center of the community'. Subsequently, by official letter INT-2020-156, received on July 6, 2020, the District Municipal Council of Cóbano requested authorization from the Tempisque Conservation Area-SINAC for the tree felling of eight trees located in the community park, in order to open the road that will pass through that area. Likewise, by resolution no. 26-2020 of 3:00 p.m. on July 16, 2020 (notified to the District Municipal Council of Cóbano on July 24, 2020), the Cóbano Sub-regional Office of the Tempisque Conservation Area of SINAC, following the on-site inspection carried out on July 9, 2020, authorized the district municipal council to fell the trees it had requested by official letter INT-2020-156. Likewise, by official letter no. INT-2020-316 of September 18, 2020, the District Municipal Council of Cóbano requested from SINAC an extension of the validity period of the permit for the tree felling of the trees located in the Montezuma park, given that the authorization process before SETENA had been stalled due to problems with payment of form D1. According to the Tempisque Conservation Area-SINAC, the area covered by the Montezuma park does not qualify as a forest, nor is it a protected wildlife area or a water protection area.\n\nFor its part, the Constitutional Chamber (Sala) finds it proven that, through resolution no. 0631-2021-SETENA of April 22, 2021, the Secretaría Técnica Ambiental resolved the request filed by the Concejo Municipal de Distrito de Cóbano for the \"Habilitación Calle Pública Contiguo al Parque de Montezuma.\" That document provided: \"FIRST: To approve the Environmental Assessment Document D1 — Sworn Declaration of Environmental Commitments (Declaración Jurada de Compromisos Ambientales) submitted for environmental review by the project developer. SECOND: To notify the interested party that, in accordance with Articles 17, 18, and Art. 19 of the Ley Orgánica del Ambiente, the environmental impact assessment (evaluación de impacto ambiental, EIA) procedure for the project 'Habilitación Calle Pública Contiguo al Parque de Montezuma,' under administrative case file (expediente) D1-0625-2020-SETENA, has been completed, as described below. THIRD: Pursuant to Decreto N° 31849-MINAE-S-MOPT-MAG-MEIC, this environmental viability (viabilidad ambiental) shall remain in force for a period of FIVE YEARS from the commencement of works. Should works not begin within the established timeframe, the provisions of applicable legislation shall be applied. FOURTH: Mr. FAVIO JOSE LOPEZ CHACON, identification number 05-0351-0926, acting as legal representative of CONCEJO MUNICIPAL DE DISTRITO DE COBANO, with corporate tax identification number 3-007-078297, case file number D1-0625-2020-SETENA, is hereby ordered to: (…) FIFTH: Based on the environmental characteristics of the project area (AP) and its interaction with the activities to be carried out by the project, a schedule is established for the submission of environmental stewardship reports (informes regenciales) every SIX MONTHS during the construction phase, plus a final consolidated report. The foregoing is in accordance with the provisions of Plenary Agreement CP-036-2011-SETENA of February 28, 2011. Environmental reports must be submitted no later than 10 days after the end of the period they cover. Upon commencement of activities, the period for the first environmental stewardship (regencia ambiental) report begins. For the preparation of these reports, in accordance with the format established by this Secretariat, the environmental steward (regente ambiental) shall be responsible for conducting as many site visits as necessary, depending on the characteristics of the project. Based on these reports and the monitoring program, SETENA may adjust the bond amount and issue mandatory measures to the interested party regarding its obligation to comply with all requirements needed to keep the project, work, or activity within a controlled environmental impact margin. The responsible party and the owner must support SETENA in any inspections it carries out. It is noted that the granting of Environmental Viability is one step within the environmental impact assessment process, and that once it is granted, the environmental management phase begins, which must be carried out by this Secretariat through the Departamento de Auditoría y Seguimiento Ambiental (ASA), in accordance with the agreement of the Plenary Commission, No. 015-2014, of August 26, 2014. SIXTH: Comply with the provisions of Resolution No. 1834-2016-SETENA, 'Rotulación de Proyectos con Viabilidad Ambiental,' of September 29, 2016. SEVENTH: The developer is warned that, should non-compliance with the acquired environmental obligations be verified in accordance with Article 14 of Decreto Ejecutivo 31849, or should the information submitted be found false or manipulated — given the sworn declaration nature of the instrument filed — this Secretariat may proceed as provided in Article 15 of that same Decree, revoking the Environmental Viability (License) [Viabilidad (Licencia) Ambiental] granted by this document and requiring submission of the corresponding documentation, independently of the authority to file the corresponding criminal complaints for any offense committed, or to apply any of the penalties enumerated in Article 99 of the Ley Orgánica del Ambiente. EIGHTH: Take note of the recommendations and precautions arising from the supplementary technical studies and as described in CONSIDERANDO TERCERO above. NINTH: The developer is reminded that, pursuant to Art. 11 of Decreto Ejecutivo N° 31849-MINAE-S-MOPT-MAG-MEIC — concerning the scope of the EIA procedure before SETENA — compliance with the EIA procedure does not exempt the developer from the procedures required before other administrative authorities, in accordance with their respective jurisdictions and applicable regulations, nor from fulfilling any obligations or responsibilities arising from its activities. TENTH: Against this resolution, ordinary remedies of reconsideration (revocatoria) before SETENA and appeal (apelación) before the Minister of Environment and Energy may be filed within three business days, counted from the business day following notification, in accordance with Articles 342 and following of the Ley General de Administración Pública N° 6227, and Article 87 of the Ley Orgánica del Ambiente N° 7554. ELEVENTH: All documentation submitted to SETENA must clearly indicate the case file number, the resolution number, and the full name of the project. An email address must also be provided for receiving notifications from this Secretariat. TWELFTH: The complete case file, as well as the documents issued by SETENA during the assessment process, will be available to the developer at the web address provided.\"\n\nThus, as a result of the aforementioned environmental viability, on January 15, 2025, the Concejo Municipal de Distrito de Cóbano placed a sign near the Parque de Montezuma, which reads: \"PUBLIC ROAD ENABLEMENT PROJECT ADJACENT TO THE PARQUE DE MONTEZUMA — DEVELOPER: CONCEJO MUNICIPAL DE DISTRITO DE CÓBANO — PROJECT AREA: 704 m — CASE FILE NUMBER: D1-0625-2020-SETENA — ENVIRONMENTAL VIABILITY RESOLUTION No. 0631-2021-SETENA — APRIL 22, 2021.\"\n\nThat being the case, the appropriate ruling is to deny this ground of the constitutional remedy (amparo). In this regard, the petitioning party (parte accionante) contends that the environmental viability granted is improper, as it corresponds to a different zoning plan (plan regulador). However, as already established in the aforementioned judgment (sentencia) no. 2021000176 of 9:15 a.m. on January 8, 2021, should any objection exist regarding the basis that justifies the road project through the Parque de Montezuma, it must be raised through the ordinary legality proceedings, where it may be determined whether or not it was included in either of the two indicated zoning plans, under what specific technical and legal conditions, and whether it complies with the provisions applicable to the area in which it is located.\n\nFurthermore, with respect to the right to a healthy and ecologically balanced environment, the record contains no elements that would establish a constitutional violation cognizable through the summary amparo proceeding. As noted in judgment 2021000176 of 9:15 a.m. on January 8, 2021, it was ruled out that the Parque de Montezuma area qualifies as a forest (bosque), a protected wildlife area (área silvestre protegida), or a hydrological protection zone (protección hídrica). Additionally, it is confirmed that through resolution no. 0631-2021-SETENA of April 22, 2021, the Secretaría Técnica Ambiental issued the corresponding environmental viability.\n\nAnd, lastly, it bears noting that the appellant (parte recurrente) does not allege having filed any complaint before SETENA challenging the alleged environmental non-viability of the road project in the Parque de Montezuma.\n\nVI.-\nOn another matter, the petitioner claims that the company she represents holds a concession over a parcel of land where a substantial sum has been invested in the construction of a hotel; however, the land is situated on sandy soil, and the excavation required for the road construction implies destabilization of the ground on which the hotel is being built.\n\nIn this regard, first, there is no indication that the protected party (parte amparada) filed any complaint regarding this situation before the respondent authority. Furthermore, the report submitted, with all the responsibilities and formalities this entails, states: \"The claim that she pays fees is unfounded; it is well established, pursuant to Ley 6043 sobre Zona Marítimo Terrestre and its Regulations, that the concession fee (canon por concesión) becomes payable upon approval of the process by this Concejo Municipal de Distrito for the respective granting by the Instituto Costarricense de Turismo, and as of today, the concession application process is stalled on the part of the company Las Brisas de las Delicias de Cóbano S.A., case file 3963-2020, as it has not adjusted the site plan submitted in the process; likewise, if the company has been on the parcel requested in concession prior to the entry into force of the Plan Regulador Integral Cabuya Montezuma pursuant to publication in Gaceta 184 of Wednesday, September 14, 2016, and prior to that date has paid any taxes, it is for the legal representative of the company to appear before this Concejo Municipal de Distrito to carry out the corresponding process. There are interests of the appellant's own company with respect to the land requested in concession, because it has not adjusted the required setbacks (retiros) of the constructions in accordance with the site plan submitted in the concession application and the Plan Regulador Integral Cabuya Montezuma — and not for any environmental reason — given that the project challenged here has the corresponding environmental viability and supporting studies, as evidenced by the documentation attached herein. It is not true that the appellant's company is left in a state of defenselessness, as it has the option of adjusting its constructions pursuant to Ley 9242 for the regulation of existing constructions in the Restricted Zone of the Zona Marítimo Terrestre, which the appellant herself has not pursued, as she does not wish to adjust the setbacks on the parcel requested in concession.\"\n\nThat being the case, at first glance, the Chamber has no element that would allow it to verify any infringement of the fundamental rights of the protected company. Consequently, this ground of the amparo is dismissed. (…)\n\nTherefore:\n\nThe constitutional remedy is denied. Justice Rueda Leal enters a separate note.\n\nIV.-\nON THE SPECIFIC CASE.
