  "body_en_text": "V.- DISSENTING OPINION (VOTO SALVADO) OF JUSTICE GARRO VARGAS ON THE ENFORCEMENT OF THE JUDGMENT.\n\nI file this dissent with respect to the enforcement of the judgment (ejecución de la sentencia), so that, in accordance with art. 56 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional, LJC), enforcement may be referred (residenciada) to the Enforcement Division of the Administrative and Civil Treasury Court (Tribunal Contencioso Administrativo y Civil de Hacienda).\n\nThe enforcement of orders issued by the Sala Constitucional falls, as a general rule, under the supervision of that same jurisdiction. However, that provision contemplates exceptional circumstances in which, by determination of this Court, enforcement of the judgment may be referred to the administrative-contentious jurisdiction (jurisdicción contencioso-administrativa):\n\n\"Art. 56. The enforcement of judgments falls within the competence of the Sala Constitucional, except with respect to the liquidation and satisfaction of indemnifications and monetary liabilities, or in other respects that the Sala itself deems appropriate, in which case enforcement shall proceed through the administrative-contentious jurisdiction by the judgment-enforcement procedure set forth in the statute governing that jurisdiction.\" (Emphasis not in the original.)\n\nIt should be recalled that the bill originally under discussion for the LJC provided as follows:\n\n\"Art. 56. Emphasis not in the original.)\n\nFrom the foregoing, it is clear that the LJC itself authorizes this Sala to assess and decide whether it is appropriate to refer to the administrative-contentious jurisdiction all or some of the matters relating to the enforcement of the judgment.\n\nIn this specific case, in view of the order to finalize and implement the project aimed at strengthening the operating zone of Mata de Plátano in order to increase the water capacity of the system, I consider that the appropriate course of action is to refer the enforcement phase of the matter to the administrative-contentious jurisdiction. This is due to the absence of suitable mechanisms provided for by the rules governing this constitutional jurisdiction to follow up on the orders set forth in this judgment, which involve matters of considerable technical complexity.\n\nBy contrast, the provisions of the Code of Administrative Litigation Procedure (Código Procesal Contencioso-Administrativo) on enforcement (art. 155 et seq.) offer clear advantages, such as the possibility of requesting timetables, imposing fines, establishing liability, overseeing compliance stages, etc. Therefore, in accordance with the provisions of art. 56 of the LJC, I consider that the enforcement phase should be carried out before the Enforcement Division of the Administrative and Civil Treasury Court, under the judgment-enforcement rules of that Code.
