En tales supuestos, la Administración no está obligada a mantener indefinidamente una determinada regulación, pero sí debe demostrar, mediante fundamentos objetivos y verificables, que la modificación introducida resulta compatible con el nivel de protección ambiental que el ordenamiento constitucional exige preservar.\n\nPrecisamente por ello esta Sala dispuso, como prueba para mejor resolver, la remisión de los estudios o criterios técnicos que sirvieran de fundamento para la decisión cuestionada. La documentación aportada demuestra que existieron criterios técnicos favorables a la implementación gradual del sistema de monitoreo satelital; sin embargo, no acredita que la decisión posterior de derogar el régimen transitorio hubiera estado precedida por una nueva evaluación técnica que analizara las consecuencias ambientales, regulatorias o de fiscalización derivadas de esa modificación. La motivación consignada en el propio Acuerdo AJDIP-162-2024 se refiere principalmente a la inexistencia de consenso con el sector regulado, a la conveniencia de continuar el proceso de elaboración normativa y a razones de oportunidad administrativa. Sin desconocer la relevancia institucional de tales circunstancias, la Sala estima que ellas no sustituyen la necesidad de acreditar, mediante elementos técnicos especializados, que la modificación del régimen de monitoreo satelital mantiene un nivel equivalente de protección del recurso pesquero y del ambiente.\n\nEn consecuencia, esta Sala no concluye que la derogatoria del Transitorio II resulte contrario a la Constitución Política por el solo hecho de modificar el régimen reglamentario vigente, sino porque la Administración no logró demostrar, mediante una motivación técnica suficiente, que dicha modificación preservaba el nivel de protección ambiental exigido por el artículo 50 de la Constitución Política. LA SALA ORDENA A INCOPESCA\nMOTIVAR TÉCNICAMENTE LA MEDIDA O ADOPTAR UN NUEVO ACUERDO COMPATIBLE CON LOS\nPRINCIPIOS DE PREVENCIÓN, PROGRESIVIDAD Y NO REGRESIÓN AMBIENTAL, EN EL PLAZO\nDE SEIS MESES. NQC08/2026\n\n(…)\nV.- Sobre la discrecionalidad técnica de la Administración y el alcance del\ncontrol constitucional. El Instituto Costarricense de Pesca y Acuicultura\nsostiene que la decisión impugnada constituye una manifestación de la\ndiscrecionalidad técnica atribuida por la Ley de Pesca y Acuicultura para\nregular el aprovechamiento sostenible de los recursos hidrobiológicos. Al\nrespecto, esta Sala ha reconocido que determinadas materias de alta complejidad\ncientífica corresponden primariamente a la Administración activa, la cual\ndispone de un margen de apreciación técnica para seleccionar las medidas\nregulatorias que estime más adecuadas al cumplimiento del interés público. Sin\nembargo, esa discrecionalidad no constituye una potestad arbitraria ni exime a\nla Administración del deber de motivar suficientemente sus decisiones.\nParticularmente cuando el acto administrativo incide sobre la protección de\nderechos fundamentales o modifica instrumentos previamente establecidos para la\ntutela del ambiente, la motivación adquiere una intensidad reforzada. Ello\nsupone que la Administración debe exteriorizar las razones técnicas,\ncientíficas, ambientales o especializadas que justifican la decisión adoptada,\nde manera que sea posible verificar su racionalidad, proporcionalidad y conformidad\ncon el orden constitucional.\n\nEn\nconsecuencia, el control que corresponde ejercer a esta Sala no consiste en\nsustituir el criterio técnico de la Administración por el propio del Tribunal\nConstitucional. La función de esta jurisdicción consiste, más bien, en\nverificar que la decisión administrativa haya sido adoptada dentro del marco\ncompetencial correspondiente, que se encuentre suficientemente motivada y que\nla valoración técnica invocada resulte objetivamente verificable, razonable y\ncompatible con el contenido esencial del derecho fundamental cuya tutela se\nreclama. Precisamente desde esa perspectiva deberá analizarse la prueba\nincorporada mediante la resolución para mejor resolver, a efectos de determinar\nsi el acuerdo administrativo impugnado encuentra sustento en estudios técnicos\nsuficientes o si, por el contrario, la modificación del régimen de monitoreo\nsatelital respondió a consideraciones ajenas a la protección reforzada que\nexige el artículo 50 de la Constitución Política.\n\nVI.-\nSobre las competencias constitucional y legalmente atribuidas a las autoridades\nrecurridas. Como cuestión previa, resulta indispensable delimitar el ámbito de\ncompetencias de cada una de las autoridades recurridas, pues el control\nconstitucional únicamente puede recaer sobre actuaciones u omisiones\natribuibles al órgano competente. La Ley de Pesca y Acuicultura, Ley N° 8436,\nasí como la Ley de Creación del Instituto Costarricense de Pesca y Acuicultura,\natribuyen a dicho ente la rectoría técnica en materia de ordenamiento,\nadministración, conservación, seguimiento, control y aprovechamiento sostenible\nde los recursos hidrobiológicos. Dentro de esas competencias se encuentra la\nfacultad de establecer los mecanismos técnicos necesarios para el seguimiento y\nvigilancia de las embarcaciones pesqueras, incluyendo la utilización de\ntecnologías destinadas a fortalecer la fiscalización de la actividad pesquera.\nConsecuentemente, la decisión relativa a determinar cuáles embarcaciones deben\nincorporarse al Sistema de Monitoreo Satelital constituye una competencia\npropia del INCOPESCA. Por su parte, el Ministerio de Obras Públicas y\nTransportes ejerce competencias vinculadas con la autoridad marítima, la\ncertificación de navegabilidad y la autorización de zarpes, conforme a la Ley\nGeneral de Puertos, los Reglamentos sobre Certificación de Embarcaciones y\ndemás normativa especial. De los informes rendidos bajo juramento se desprende\nque dicho Ministerio no posee potestad normativa para imponer obligaciones\nrelacionadas con el monitoreo satelital de embarcaciones pesqueras y que su\nactuación se encuentra limitada por el principio de legalidad contenido en el\nartículo 11, de la Ley General de la Administración Pública. En igual sentido,\nel Servicio Nacional de Guardacostas ejerce funciones eminentemente policiales,\npreventivas y operativas dentro del espacio marítimo nacional. Aunque participa\nactivamente en la fiscalización pesquera mediante mecanismos de coordinación\ninstitucional con el INCOPESCA y posee acceso operativo al Sistema de Monitoreo\nSatelital, ello no lo convierte en autoridad reguladora del régimen jurídico\naplicable a las distintas categorías de embarcaciones. En consecuencia, la\ndecisión administrativa impugnada resulta jurídicamente atribuible únicamente\nal Instituto Costarricense de Pesca y Acuicultura. Por ello, el análisis\nconstitucional deberá concentrarse fundamentalmente sobre la actuación\ndesarrollada por esa institución, sin perjuicio de examinar posteriormente si\nexiste alguna consecuencia indirecta respecto de las demás autoridades\nrecurridas.\n\nVII.-\nSobre la prueba para mejor resolver ordenada por esta Sala. Mediante resolución\nde las 16:51 horas del 25 de mayo de 2026, esta Sala estimó necesario\nsolicitar, como prueba para mejor resolver, los estudios o criterios técnicos\nque sirvieron de fundamento a la decisión cuestionada. La finalidad de dicha\ndiligencia probatoria era determinar si la derogatoria del Transitorio II del\nAcuerdo AJDIP-076-2022 obedeció a una valoración técnica especializada capaz de\njustificar constitucionalmente la modificación del régimen de monitoreo\nsatelital. No se trataba, por consiguiente, de verificar la existencia formal\ndel acuerdo administrativo, circunstancia que nunca estuvo en discusión, sino\nde constatar si el ejercicio de la potestad reglamentaria había estado\nprecedido de una motivación técnica suficiente. La respuesta brindada por las\nautoridades recurridas permite arribar a las siguientes conclusiones.\n\nEl\nMinisterio de Obras Públicas y Transportes manifestó expresamente que no\nelaboró estudios técnicos sobre el particular, al tratarse de una materia ajena\na sus competencias legales. El Servicio Nacional de Guardacostas informó\nigualmente que no emitió criterio técnico alguno relacionado con la exclusión\nde la flota turística y deportiva del sistema obligatorio de monitoreo\nsatelital. Ambas respuestas resultan coherentes con la distribución de\ncompetencias prevista en el ordenamiento jurídico y descartan que dichas\ninstituciones hubieran participado técnicamente en la adopción de la decisión\ncuestionada. En consecuencia, el análisis de la prueba debe concentrarse\nexclusivamente sobre la documentación aportada por el Instituto Costarricense\nde Pesca y Acuicultura.\n\nVIII.-\nValoración de la documentación aportada por el INCOPESCA. En cumplimiento de la\nprevención formulada por esta Sala, el INCOPESCA remitió copia de diversos\nacuerdos de Junta Directiva relacionados con la evolución normativa del Sistema\nde Monitoreo Satelital, así como el oficio INCOPESCA-PE-DOPA-126-2022. La Sala\nobserva que dicha documentación permite reconstruir el proceso administrativo\nmediante el cual fue implementándose progresivamente el sistema de seguimiento\nsatelital. Asimismo evidencia que, desde el año 2020, la política institucional\nhabía estado orientada hacia una ampliación gradual del universo de\nembarcaciones sujetas al monitoreo tecnológico. La documentación remitida por\nel Instituto Costarricense de Pesca y Acuicultura incorpora el oficio\nINCOPESCA-PE-DOPA-126-2022, elaborado por la Dirección de Ordenamiento Pesquero\ny Acuícola con participación de la Asesoría Jurídica, el cual contiene\napreciaciones técnicas relativas a la utilidad del sistema de monitoreo\nsatelital para fortalecer el seguimiento, control y vigilancia de la actividad\npesquera, combatir la pesca ilegal, no declarada y no reglamentada, y favorecer\nel aprovechamiento sostenible de los recursos hidrobiológicos. Sin embargo,\ndicho criterio fue emitido con ocasión de una solicitud de prórroga para la\nimplementación gradual del sistema y concluye recomendando únicamente la\nampliación del plazo para la instalación de las balizas satelitales. No\ncontiene una evaluación técnica dirigida a justificar la posterior derogatoria del\nTransitorio II acordada mediante el AJDIP-162-2024, ni desarrolla un análisis\ncientífico o especializado que explique por qué la exclusión de la flota\nturística y deportiva del régimen obligatorio de monitoreo satelital resulta\ncompatible con el nivel de protección ambiental previamente alcanzado.\n\nIX.-\nAnálisis de la documentación técnica aportada por el INCOPESCA. En cumplimiento\nde la prevención formulada por esta Sala, el Instituto Costarricense de Pesca y\nAcuicultura remitió copia de diversos acuerdos adoptados por su Junta Directiva\nen relación con la implementación del Reglamento para el Seguimiento, Control y\nVigilancia de Embarcaciones Pesqueras, así como el oficio\nINCOPESCA-PE-DOPA-126-2022, elaborado por la Dirección de Ordenamiento Pesquero\ny Acuícola con participación de la Asesoría Jurídica. El examen integral de esa\ndocumentación permite establecer que la Administración sí incorporó dentro del\nexpediente administrativo un criterio de carácter técnico-administrativo\nrelacionado con la implementación del sistema de monitoreo satelital. En\nefecto, el citado oficio desarrolla diversas consideraciones acerca de la\nutilidad del Sistema de Seguimiento, Control y Vigilancia de Embarcaciones\nPesqueras como instrumento destinado a fortalecer las labores de fiscalización\nde la actividad pesquera, combatir la pesca ilegal, no declarada y no\nreglamentada, mejorar la coordinación interinstitucional y favorecer el\naprovechamiento sostenible de los recursos hidrobiológicos. Asimismo, reconoce\nla importancia del monitoreo satelital como mecanismo tecnológico para\nfortalecer la gestión pesquera nacional y armonizarla con los compromisos\nregionales asumidos por el Estado costarricense. No obstante, la Sala advierte\nque dicho criterio técnico fue emitido dentro de un contexto administrativo\nclaramente delimitado. Su objeto consistía en valorar la solicitud formulada\npor representantes del sector de pesca turística y deportiva para ampliar el\nplazo previsto para la implementación obligatoria del sistema de monitoreo\nsatelital. Como resultado de esa valoración, el criterio técnico concluyó\nrecomendando la concesión de una prórroga temporal, con el propósito de\npermitir la adecuada implementación operativa del sistema y facilitar la\nadaptación progresiva del sector regulado.\n\nConsecuentemente,\nel contenido del oficio evidencia que el órgano técnico del propio INCOPESCA\nconsideró conveniente mantener la implementación del sistema de monitoreo\nsatelital, recomendando únicamente diferir temporalmente su entrada en vigencia\nrespecto de determinado grupo de embarcaciones. En ese sentido, la\ndocumentación remitida demuestra la existencia de un criterio técnico favorable\nal sistema de monitoreo satelital, pero no constituye, por sí misma, un\nfundamento técnico que justifique la decisión posteriormente adoptada mediante\nel Acuerdo AJDIP-162-2024.\n\nX.-\nSobre la correspondencia entre el criterio técnico aportado y la decisión\nadministrativa impugnada. Precisamente porque el oficio\nINCOPESCA-PE-DOPA-126-2022 contiene apreciaciones técnicas relevantes,\ncorresponde determinar si existe una relación de congruencia entre ese criterio\nespecializado y la decisión administrativa cuya constitucionalidad se cuestiona\nen este proceso. Al respecto, la Sala observa que el objeto del presente\nrecurso no consiste en revisar la legalidad de la prórroga recomendada durante\nel año 2022, sino la decisión adoptada posteriormente por la Junta Directiva\ndel INCOPESCA mediante el Acuerdo AJDIP-162-2024, mediante la cual se derogó el\nTransitorio II del Acuerdo AJDIP-076-2022 y se eliminó la entrada en vigencia\ndel régimen que preveía incorporar obligatoriamente a la flota turística y\ndeportiva de mediana escala al sistema de monitoreo satelital. Desde esa\nperspectiva, el criterio técnico aportado y el acto administrativo impugnado no\nposeen identidad material. Mientras el oficio PE-DOPA-126-2022 parte de la\npremisa de que el monitoreo satelital constituye un instrumento adecuado para\nfortalecer la fiscalización pesquera y recomienda únicamente ampliar el plazo\npara su implementación, el Acuerdo AJDIP-162-2024 adopta una decisión distinta,\nconsistente en derogar el régimen transitorio que establecía esa futura\nincorporación obligatoria. La Sala no desconoce que la Administración puede\nmodificar las decisiones previamente adoptadas ni que la potestad reglamentaria\ncomprende la facultad de revisar los instrumentos normativos cuando ello\nresulte necesario para la adecuada satisfacción del interés público. Sin\nembargo, cuando la Administración modifica el sentido de una política pública\npreviamente sustentada en criterios técnicos, corresponde exteriorizar las\nrazones objetivas que justifican ese cambio de orientación.\n\nEn\nel presente asunto, la documentación aportada no permite identificar un\nestudio, informe técnico, evaluación científica o criterio especializado\nposterior al oficio PE-DOPA-126-2022 que explique cuáles circunstancias\ntécnicas llevaron a sustituir la recomendación inicial de implementación\ngradual por la posterior derogatoria del régimen transitorio. Existe, por\nconsiguiente, una ruptura entre el criterio técnico incorporado al expediente y\nla decisión finalmente adoptada por la Junta Directiva, sin que esa transición\naparezca respaldada mediante una motivación técnica suficientemente explicita.\n\nXI.-\nSobre la motivación técnica reforzada de los actos administrativos con\nincidencia ambiental. Esta Sala ha reconocido reiteradamente que la\nAdministración dispone de un margen de discrecionalidad técnica para regular\nmaterias complejas cuya definición requiere conocimientos científicos o\nespecializados. Sin embargo, la existencia de discrecionalidad técnica no\nexcluye el deber constitucional de motivación. Por el contrario, cuando el\nejercicio de esa potestad incide sobre mecanismos diseñados para la protección\ndel ambiente, la exigencia de motivación adquiere un contenido reforzado,\nderivado del artículo 50 de la Constitución Política y de los principios de\nobjetivación de la tutela ambiental, prevención y progresividad. En tales\nsupuestos, la Administración no está obligada a mantener indefinidamente una\ndeterminada regulación, pero sí debe demostrar, mediante fundamentos objetivos\ny verificables, que la modificación introducida resulta compatible con el nivel\nde protección ambiental que el ordenamiento constitucional exige preservar.\n\nPrecisamente\npor ello esta Sala dispuso, como prueba para mejor resolver, la remisión de los\nestudios o criterios técnicos que sirvieran de fundamento para la decisión\ncuestionada. La documentación aportada demuestra que existieron criterios\ntécnicos favorables a la implementación gradual del sistema de monitoreo\nsatelital; sin embargo, no acredita que la decisión posterior de derogar el\nrégimen transitorio hubiera estado precedida por una nueva evaluación técnica\nque analizara las consecuencias ambientales, regulatorias o de fiscalización\nderivadas de esa modificación. La motivación consignada en el propio Acuerdo\nAJDIP-162-2024 se refiere principalmente a la inexistencia de consenso con el\nsector regulado, a la conveniencia de continuar el proceso de elaboración\nnormativa y a razones de oportunidad administrativa. Sin desconocer la\nrelevancia institucional de tales circunstancias, la Sala estima que ellas no\nsustituyen la necesidad de acreditar, mediante elementos técnicos\nespecializados, que la modificación del régimen de monitoreo satelital mantiene\nun nivel equivalente de protección del recurso pesquero y del ambiente.\n\nXII.-\nAplicación de los principios de progresividad y no regresión al caso concreto.\nLa Sala estima que el presente asunto no debe resolverse a partir de la premisa\nde que toda modificación del régimen jurídico aplicable al monitoreo satelital\nconstituye, por sí misma, una regresión ambiental constitucionalmente\nprohibida. Como se indicó anteriormente, el principio de no regresión no impide\na la Administración revisar, modificar o sustituir instrumentos regulatorios\ncuando ello responda a razones objetivas, técnicamente justificadas y\ncompatibles con el deber estatal de protección ambiental. El problema\nconstitucional del presente caso radica en un aspecto distinto. El expediente\nadministrativo evidencia que el propio órgano técnico del INCOPESCA había considerado\nconveniente la implementación progresiva del sistema de monitoreo satelital\nrespecto de la flota turística y deportiva, recomendando únicamente ampliar el\nplazo para hacer efectiva esa obligación. Posteriormente, la Junta Directiva\nadoptó una decisión regulatoria diferente al derogar el régimen transitorio\ncorrespondiente. No obstante, la Administración no acreditó que entre una y\notra decisión hubiera mediado una nueva valoración técnica que explicara las\nrazones científicas, ambientales, pesqueras o regulatorias que justificaban\nabandonar el esquema inicialmente recomendado. En consecuencia, esta Sala no\nconcluye que la derogatoria del Transitorio II resulte contrario a la\nConstitución Política por el solo hecho de modificar el régimen reglamentario\nvigente, sino porque la Administración no logró demostrar, mediante una\nmotivación técnica suficiente, que dicha modificación preservaba el nivel de\nprotección ambiental exigido por el artículo 50 de la Constitución Política.\nEsa insuficiencia de motivación impide a esta jurisdicción verificar que el\nejercicio de la potestad reglamentaria se desarrolló dentro de los parámetros\nde objetividad, razonabilidad y protección reforzada que deben regir toda\nactuación administrativa con incidencia directa sobre el ambiente.\n\nSe\nadvierte que el cumplimiento de esta sentencia no implica que el Instituto deba\nadoptar una determinada solución regulatoria, correspondiéndole, en el\nejercicio de las competencias que el ordenamiento jurídico le atribuye, definir\nel régimen aplicable al seguimiento, control y vigilancia de las embarcaciones\nde pesca turística y deportiva de mediana escala, siempre que la decisión que\nfinalmente adopte se encuentre debidamente sustentada en criterios técnicos\nobjetivos, suficientes y verificables, conforme a los parámetros desarrollados\nen esta sentencia.\n\nXIII.-\nSobre la situación jurídica del Ministerio de Obras Públicas y Transportes y\ndel Servicio Nacional de Guardacostas. Respecto de estas autoridades, el\nrecurso no puede prosperar. Ambas instituciones acreditaron que la decisión\ncuestionada no fue emitida dentro del ámbito de sus competencias. Asimismo demostraron que carecen de potestad\nnormativa para imponer, modificar o derogar el régimen jurídico del monitoreo\nsatelital de embarcaciones pesqueras. THE CONSTITUTIONAL CHAMBER ORDERS INCOPESCA TO PROVIDE A TECHNICAL JUSTIFICATION FOR THE MEASURE OR TO ADOPT A NEW RESOLUTION COMPATIBLE WITH THE PRINCIPLES OF PREVENTION, PROGRESSIVITY, AND ENVIRONMENTAL NON-REGRESSION, WITHIN SIX MONTHS. NQC08/2026\n\n(…)\n\nV.- On the technical discretion (discrecionalidad técnica) of the Administration and the scope of constitutional review. The Instituto Costarricense de Pesca y Acuicultura argues that the challenged decision constitutes an exercise of the technical discretion conferred upon it by the Ley de Pesca y Acuicultura to regulate the sustainable use of hydrobiological resources (recursos hidrobiológicos). In this regard, this Chamber has recognized that certain matters of high scientific complexity fall primarily within the domain of the active Administration, which enjoys a margin of technical appreciation when selecting the regulatory measures it deems most appropriate to serve the public interest. However, such discretion does not constitute an arbitrary power, nor does it exempt the Administration from its duty to provide adequate reasoning (motivación) for its decisions. Particularly when an administrative act affects the protection of fundamental rights or modifies instruments previously established for environmental protection, the duty to state reasons takes on heightened intensity. This means that the Administration must make explicit the technical, scientific, environmental, or specialized grounds that justify the decision taken, in a manner that allows verification of its rationality, proportionality, and conformity with the constitutional order.\n\nAccordingly, the review that this Chamber is called upon to conduct does not consist of substituting the Administration's technical judgment with that of the Constitutional Court. Rather, the function of this jurisdiction is to verify that the administrative decision was adopted within the corresponding competential framework, that it is adequately reasoned, and that the technical assessment invoked is objectively verifiable, reasonable, and compatible with the essential content of the fundamental right whose protection is sought. It is precisely from this perspective that the evidence incorporated through the resolution for better adjudication (prueba para mejor resolver) must be analyzed, in order to determine whether the challenged administrative resolution rests on sufficient technical studies or whether, on the contrary, the modification of the satellite monitoring (monitoreo satelital) regime responded to considerations foreign to the heightened protection required by Article 50 of the Constitución Política.\n\nVI.- On the constitutional and legally assigned competences of the respondent authorities. As a preliminary matter, it is essential to delineate the scope of competence of each of the respondent authorities, since constitutional review may only bear upon acts or omissions attributable to the competent body. The Ley de Pesca y Acuicultura, Ley N° 8436, as well as the Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, vest that body with technical leadership in the management, administration, conservation, monitoring, control, and sustainable use of hydrobiological resources. Within those competences is the power to establish the technical mechanisms necessary for the monitoring and surveillance of fishing vessels, including the use of technologies designed to strengthen enforcement oversight (fiscalización) of fishing activity. Consequently, the decision regarding which vessels must be incorporated into the Satellite Monitoring System falls within the exclusive competence of INCOPESCA. The Ministerio de Obras Públicas y Transportes, for its part, exercises competences related to maritime authority, seaworthiness certification, and the granting of departure clearances (zarpes), pursuant to the Ley General de Puertos, the Reglamentos sobre Certificación de Embarcaciones, and other special regulations. The sworn statements submitted reveal that said Ministry holds no regulatory authority to impose obligations related to satellite monitoring of fishing vessels and that its actions are constrained by the principle of legality (principio de legalidad) set forth in Article 11 of the Ley General de la Administración Pública. Similarly, the Servicio Nacional de Guardacostas exercises functions that are essentially law-enforcement, preventive, and operational in nature within the national maritime space. Although it actively participates in fisheries enforcement through institutional coordination mechanisms with INCOPESCA and has operational access to the Satellite Monitoring System, this does not make it the regulatory authority of the legal regime applicable to the various categories of vessels. Consequently, the challenged administrative decision is legally attributable exclusively to the Instituto Costarricense de Pesca y Acuicultura. Therefore, the constitutional analysis must focus primarily on the conduct of that institution, without prejudice to subsequently examining whether there are any indirect consequences with respect to the other respondent authorities.\n\nVII.- On the evidence for better adjudication ordered by this Chamber. By resolution issued at 4:51 p.m. on May 25, 2026, this Chamber found it necessary to request, as evidence for better adjudication, the studies or technical criteria that served as the basis for the challenged decision. The purpose of that evidentiary measure was to determine whether the repeal of Transitorio II of Acuerdo AJDIP-076-2022 was grounded in a specialized technical assessment capable of constitutionally justifying the modification of the satellite monitoring regime. The issue was therefore not one of verifying the formal existence of the administrative resolution—a matter that was never in dispute—but of ascertaining whether the exercise of the regulatory power (potestad reglamentaria) had been preceded by adequate technical reasoning. The responses provided by the respondent authorities lead to the following conclusions.\n\nThe Ministerio de Obras Públicas y Transportes expressly stated that it had not produced technical studies on the matter, as it falls outside its legal competence. The Servicio Nacional de Guardacostas likewise reported that it had not issued any technical opinion related to the exclusion of the tourist and sport fishing fleet from the mandatory satellite monitoring system. Both responses are consistent with the distribution of competences established by the legal order (ordenamiento jurídico) and rule out any technical participation by those institutions in the adoption of the challenged decision. Consequently, the evidentiary analysis must focus exclusively on the documentation submitted by the Instituto Costarricense de Pesca y Acuicultura.\n\nVIII.- Assessment of the documentation submitted by INCOPESCA. In compliance with the request made by this Chamber, INCOPESCA submitted copies of various Board of Directors (Junta Directiva) resolutions related to the regulatory evolution of the Satellite Monitoring System, as well as memorandum INCOPESCA-PE-DOPA-126-2022. The Chamber observes that this documentation allows for a reconstruction of the administrative process through which the satellite tracking system was progressively implemented. It also demonstrates that, since 2020, institutional policy had been oriented toward the gradual expansion of the universe of vessels subject to technological monitoring. The documentation submitted by the Instituto Costarricense de Pesca y Acuicultura includes memorandum INCOPESCA-PE-DOPA-126-2022, prepared by the Dirección de Ordenamiento Pesquero y Acuícola with the participation of the Legal Advisory Division (Asesoría Jurídica), which contains technical assessments concerning the utility of the satellite monitoring system for strengthening the monitoring, control, and surveillance of fishing activity, combating illegal, unreported, and unregulated fishing (pesca ilegal, no declarada y no reglamentada), and promoting the sustainable use of hydrobiological resources. However, that opinion was issued in connection with a request for an extension of the deadline for the gradual implementation of the system and concludes by recommending only an extension of the deadline for the installation of satellite beacons (balizas satelitales). It does not contain a technical assessment directed at justifying the subsequent repeal of Transitorio II adopted through Acuerdo AJDIP-162-2024, nor does it develop a scientific or specialized analysis explaining why the exclusion of the tourist and sport fishing fleet from the mandatory satellite monitoring regime is compatible with the level of environmental protection previously achieved.\n\nIX.- Analysis of the technical documentation submitted by INCOPESCA. In compliance with the request made by this Chamber, the Instituto Costarricense de Pesca y Acuicultura submitted copies of various resolutions adopted by its Board of Directors in connection with the implementation of the Reglamento para el Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras, as well as memorandum INCOPESCA-PE-DOPA-126-2022, prepared by the Dirección de Ordenamiento Pesquero y Acuícola with the participation of the Legal Advisory Division. A comprehensive review of that documentation establishes that the Administration did incorporate into the administrative file (expediente administrativo) a technical-administrative opinion relating to the implementation of the satellite monitoring system. Indeed, the aforementioned memorandum develops various considerations regarding the utility of the Sistema de Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras as an instrument designed to strengthen enforcement of fishing activity, combat illegal, unreported, and unregulated fishing, improve inter-institutional coordination, and promote the sustainable use of hydrobiological resources. It likewise acknowledges the importance of satellite monitoring as a technological mechanism to strengthen national fisheries management and align it with the regional commitments assumed by the Costa Rican State. Nevertheless, the Chamber notes that this technical opinion was issued within a clearly defined administrative context. Its purpose was to assess a request submitted by representatives of the tourist and sport fishing sector to extend the deadline established for the mandatory implementation of the satellite monitoring system. As a result of that assessment, the technical opinion concluded by recommending the granting of a temporary extension, with the purpose of allowing the adequate operational implementation of the system and facilitating the progressive adaptation of the regulated sector.\n\nAccordingly, the content of the memorandum demonstrates that INCOPESCA's own technical body considered it appropriate to maintain the implementation of the satellite monitoring system, recommending only a temporary deferral of its entry into force with respect to a particular group of vessels. In this sense, the submitted documentation establishes the existence of a technical opinion favorable to the satellite monitoring system, but does not, in and of itself, constitute a technical basis justifying the decision subsequently adopted through Acuerdo AJDIP-162-2024.\n\nX.- On the correspondence between the technical opinion submitted and the challenged administrative decision. Precisely because memorandum INCOPESCA-PE-DOPA-126-2022 contains relevant technical assessments, it is necessary to determine whether there is a relationship of congruence between that specialized opinion and the administrative decision whose constitutionality is challenged in these proceedings. In this regard, the Chamber observes that the subject matter of the present appeal is not the review of the legality of the extension recommended in 2022, but rather the decision subsequently adopted by INCOPESCA's Board of Directors through Acuerdo AJDIP-162-2024, which repealed Transitorio II of Acuerdo AJDIP-076-2022 and eliminated the entry into force of the regime that had provided for the mandatory incorporation of the medium-scale tourist and sport fishing fleet into the satellite monitoring system. From this perspective, the submitted technical opinion and the challenged administrative act do not share material identity. While memorandum PE-DOPA-126-2022 proceeds from the premise that satellite monitoring constitutes an appropriate instrument for strengthening fisheries enforcement and recommends only extending the deadline for its implementation, Acuerdo AJDIP-162-2024 adopts a different decision, consisting of repealing the transitional regime that had established that future mandatory incorporation. The Chamber does not deny that the Administration may modify previously adopted decisions, nor that the regulatory power includes the authority to revise regulatory instruments when necessary for the adequate satisfaction of the public interest. However, when the Administration alters the direction of a public policy that was previously grounded in technical criteria, it must make explicit the objective reasons that justify that change in orientation.\n\nIn the present matter, the documentation submitted does not allow for the identification of any study, technical report, scientific evaluation, or specialized opinion issued after memorandum PE-DOPA-126-2022 that would explain which technical circumstances led to replacing the initial recommendation of gradual implementation with the subsequent repeal of the transitional regime. There is, accordingly, a break between the technical opinion incorporated into the administrative file and the decision ultimately adopted by the Board of Directors, without that transition being supported by a sufficiently explicit technical justification.\n\nXI.- On the heightened technical justification of administrative acts with environmental implications. This Chamber has repeatedly recognized that the Administration enjoys a margin of technical discretion to regulate complex matters whose definition requires scientific or specialized knowledge. However, the existence of technical discretion does not eliminate the constitutional duty to state reasons. On the contrary, when the exercise of that power affects mechanisms designed for environmental protection, the requirement of reasoning takes on heightened content, derived from Article 50 of the Constitución Política and from the principles of objectivization of environmental protection, prevention (prevención), and progressivity (progresividad). In such cases, the Administration is not required to maintain a particular regulation indefinitely, but it must demonstrate, through objective and verifiable grounds, that the modification introduced is compatible with the level of environmental protection that the constitutional order requires to be preserved.\n\nIt is precisely for this reason that this Chamber ordered, as evidence for better adjudication, the submission of the studies or technical criteria that had served as the basis for the challenged decision. The documentation submitted demonstrates that technical criteria existed that were favorable to the gradual implementation of the satellite monitoring system; however, it does not establish that the subsequent decision to repeal the transitional regime had been preceded by a new technical assessment examining the environmental, regulatory, or enforcement consequences arising from that modification. The reasoning set forth in Acuerdo AJDIP-162-2024 itself refers primarily to the absence of consensus with the regulated sector, to the advisability of continuing the normative drafting process, and to reasons of administrative expediency. Without dismissing the institutional relevance of such circumstances, the Chamber finds that they do not substitute for the need to demonstrate, through specialized technical elements, that the modification of the satellite monitoring regime maintains an equivalent level of protection of the fisheries resource and the environment.\n\nXII.- Application of the principles of progressivity and non-regression (no regresión) to the specific case. The Chamber finds that the present matter should not be resolved on the premise that any modification of the legal regime applicable to satellite monitoring constitutes, in itself, a constitutionally prohibited environmental regression. As noted above, the principle of non-regression does not prevent the Administration from reviewing, modifying, or replacing regulatory instruments when doing so responds to objective, technically justified reasons that are compatible with the State's duty of environmental protection. The constitutional problem in the present case lies in a different aspect. The administrative file demonstrates that INCOPESCA's own technical body had considered it appropriate to progressively implement the satellite monitoring system with respect to the tourist and sport fishing fleet, recommending only an extension of the deadline for making that obligation effective. Subsequently, the Board of Directors adopted a different regulatory decision by repealing the corresponding transitional regime. Nevertheless, the Administration did not demonstrate that between one and the other decision there had been a new technical assessment explaining the scientific, environmental, fisheries, or regulatory reasons justifying the abandonment of the initially recommended framework. Accordingly, this Chamber does not conclude that the repeal of Transitorio II is contrary to the Constitución Política merely because it modifies the existing regulatory regime, but rather because the Administration failed to demonstrate, through adequate technical justification, that said modification preserved the level of environmental protection required by Article 50 of the Constitución Política. That insufficiency of reasoning prevents this jurisdiction from verifying that the exercise of the regulatory power was carried out within the parameters of objectivity, reasonableness, and heightened protection that must govern every administrative action with a direct impact on the environment.\n\nIt is noted that compliance with this judgment does not require the Institute to adopt any particular regulatory solution. It falls within the Institute's discretion, in the exercise of the competences conferred upon it by the legal order, to define the regime applicable to the monitoring, control, and surveillance of medium-scale tourist and sport fishing vessels, provided that the decision ultimately adopted is duly grounded in objective, sufficient, and verifiable technical criteria, in accordance with the parameters developed in this judgment.\n\nXIII.- On the legal situation of the Ministerio de Obras Públicas y Transportes and the Servicio Nacional de Guardacostas. With respect to these authorities, the appeal cannot succeed. Both institutions established that the challenged decision was not issued within the scope of their competences. They likewise demonstrated that they lack regulatory authority to impose, modify, or repeal the legal regime governing satellite monitoring of fishing vessels. The Ministerio de Obras Públicas y Transportes acts in conformity with the principle of legality by limiting the requirements for seaworthiness certification and the granting of departure clearances to those expressly provided for by the legal order. Similarly, the Servicio Nacional de Guardacostas carries out maritime surveillance and operational coordination functions with INCOPESCA, without holding competence to define the content of the challenged regulatory regime. Consequently, no constitutional injury attributable to those authorities is established. (…)"
