La evolución del Derecho Ambiental ha conducido a reconocer que la\nprotección efectiva del ambiente exige una actuación anticipada del Estado\nfrente a riesgos que podrían comprometer el equilibrio de los ecosistemas. Por\nello, esta Sala ha incorporado de manera constante los principios de prevención\ny precaución como parámetros interpretativos del artículo 50\nconstitucional. El principio de\nprevención obliga a las autoridades públicas a adoptar medidas destinadas a\nevitar la producción de daños cuando existe suficiente conocimiento acerca de\nlos riesgos asociados a determinada actividad. Por su parte, el principio\nprecautorio autoriza e incluso exige la intervención estatal cuando, aun\nexistiendo incertidumbre científica, puedan producirse daños graves o\nirreversibles al ambiente. A estos principios se suman los de progresividad y\nno regresión ambiental, ampliamente desarrollados tanto por el Derecho\nInternacional de los Derechos Humanos como por la jurisprudencia constitucional\ncostarricense. Esta Sala ha señalado que el principio de progresividad impone\nal Estado el deber de fortalecer gradualmente los niveles de protección\nambiental alcanzados, mediante el perfeccionamiento constante de los\ninstrumentos jurídicos, administrativos y técnicos destinados a garantizar el\ndisfrute efectivo del derecho fundamental al ambiente. Como manifestación\ncomplementaria de dicho principio, la prohibición de regresión ambiental impide\nque las autoridades públicas reduzcan, sin una justificación objetiva,\nsuficiente y constitucionalmente razonable, el grado de protección previamente\nalcanzado.\n\nNo\nobstante, la Sala también ha reconocido que el principio de no regresión no\nposee carácter absoluto.   "body_en_text": "ARTICLE 50 OF THE POLITICAL CONSTITUTION.\n\n(…) IV.-\nOn the principles of prevention, precaution, progressivity, and environmental non-regression. The evolution of Environmental Law (Derecho Ambiental) has led to the recognition that effective protection of the environment requires the State to act in advance in the face of risks that could compromise the balance of ecosystems. For this reason, this Sala has consistently incorporated the prevention principle (principio de prevención) and the precautionary principle (principio precautorio) as interpretive parameters of Article 50 of the Constitution. The prevention principle obliges public authorities to adopt measures aimed at preventing the occurrence of harm when there is sufficient knowledge about the risks associated with a given activity. For its part, the precautionary principle authorizes and even requires State intervention when, even in the presence of scientific uncertainty, serious or irreversible harm to the environment may occur. To these principles are added those of progressivity (progresividad) and environmental non-regression (no regresión ambiental), extensively developed by both International Human Rights Law (Derecho Internacional de los Derechos Humanos) and Costa Rican constitutional jurisprudence (jurisprudencia constitucional costarricense). The Sala has indicated that the progressivity principle imposes on the State a duty to gradually strengthen the levels of environmental protection achieved, through the constant improvement of the legal, administrative, and technical instruments designed to guarantee the effective enjoyment of the fundamental right to a healthy environment. As a complementary expression of that principle, the prohibition of environmental non-regression prevents public authorities from reducing, without objective, sufficient, and constitutionally reasonable justification, the degree of protection previously achieved.\n\nNevertheless, the Sala has also recognized that the non-regression principle does not have an absolute character. The Administration retains a margin of regulatory discretion (configuración normativa) to modify public policies, reorganize regulatory instruments, or replace administrative mechanisms, provided that such decisions are grounded in objective, technically demonstrable reasons that are compatible with the constitutional duty of environmental protection. Therefore, not every regulatory modification constitutes in itself a constitutionally prohibited regression. What is determinative is verifying whether the challenged measure effectively produces an unjustified reduction in the existing level of protection, or whether, on the contrary, it reflects a reasonable technical redefinition that maintains—or even strengthens—the effectiveness of the environmental protection system (tutela ambiental). Consequently, when a constitutional challenge is raised against an administrative decision that modifies a previously established environmental protection instrument, the review conducted by this jurisdiction must be directed at determining whether the Administration demonstrated, through objective and verifiable grounds, that the modification is compatible with the heightened duty of protection imposed by Article 50 of the Political Constitution.
