  "body_es_text": "2026029790. AMBIENTE. MUNICIPALIDAD. SE\nCUESTIONA LA AUSENCIA DE UNA SOLUCIÓN DEFINITIVA AL MANEJO DE AGUAS RESIDUALES\nEN EL SECTOR DE PLAYA MANUEL ANTONIO. LA SALA DETERMINA QUE LA MUNICIPALIDAD DE\nQUEPOS INCUMPLIÓ SU DEBER DE ARTICULAR Y RESOLVER LA NECESIDAD DE\nINFRAESTRUCTURA SANITARIA Y DECLARA PARCIALMENTE CON LUGAR EL AMPARO. ORDENA\nDEFINIR EN SEIS MESES SI PROCEDE O NO LA CONSTRUCCIÓN DE UNA PLANTA DE\nTRATAMIENTO Y COORDINAR LAS ACCIONES NECESARIAS PARA SU ATENCIÓN. NQC08/2026\n\n(…) IV.- Sobre la actuación del\nMinisterio de Salud. Después de analizar los elementos probatorios aportados,\neste Tribunal verifica que no ha existido violación a los derechos\nfundamentales del recurrente en cuanto a este Ministerio. Lo anterior, porque\nen los informes rendidos por los representantes de las autoridades recurridas\n-que se tiene por dado bajo fe de juramento con las consecuencias, incluso\npenales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la\nprueba aportada para la resolución del asunto, ha sido debidamente acreditado\nque los puntos que describe el recurrente en el presente recurso de amparado\nreferente a la playa Manuel Antonio corresponden a: • De la entrada principal\ndel PNMA (Playa Nacional Manuel Antonio) a la antigua entrada del parque,\nbordeando contiguo al Hotel San Bada. • En el costado noroeste de Mar y Sombra.\n• En la laguna artificial brazo de quebrada contiguo a Kachá. En los registros\nde la base de datos del Área Rectora de Salud de Quepos consta que desde el\n2020 se han presentado las siguientes denuncias relacionadas a una disposición\ninadecuada de agua residuales en los tres puntos señalados por el recurrente en\nManuel Antonio. Dichas denuncias se indican a continuación: “• Para el año\n2020: se tienen registradas la recepción de 5 denuncias, de las cuales las 5 no\nfue comprobado la disposición inadecuada de aguas residuales en los sitios. •\nPara el año 2021: no se tienen registros que se hayan interpuesto formalmente\ndenuncias relacionadas al tema en cuestión. • Para el año 2022: se tiene\nregistrado la recepción de 3 denuncias, en donde se logra evidenciar que en uno\nde los casos existía una disposición inadecuada de aguas residuales, por lo que\nse notifica la orden sanitaria correspondiente y posteriormente realiza el\nseguimiento se da misma y se comprueba su cumplimiento. Con respecto a las\notras 2 denuncias, no fue posible evidenciar lo denunciado. • Para el año 2023:\nno se tienen registros que se hayan interpuesto formalmente denuncias\nrelacionadas al tema en cuestión. • Para el año 2024: no se tienen registros\nque se hayan interpuesto formalmente denuncias relacionadas al tema en\ncuestión. • Para el año 2025: se tienen registradas la recepción de 2\ndenuncias, de las cuales fue evidenciada la problemática y se procedió a\nnotificar la orden sanitaria correspondiente para que la no conformidad\nidentificada fuese corregida a la brevedad posible. Además, según inspecciones\nde oficio realizadas por este ministerio en la zona, se realizó la notificación\nde 3 órdenes sanitarias adicionales para que dos establecimientos de la zona y\nel propio PNMA realizara la corrección de la disposición inadecuada de aguas\nresiduales que se estaban presentando en su momento. • Para el año 2026:\nactualmente se tiene registrado únicamente una denuncia por el tema de aguas\nresiduales en la zona, la cual corresponde al PNMA, sin embargo, la misma ya\nfue atendida y no se comprobó lo denunciado”. Además, dicha Área de Salud ha\nrealizado hasta el momento 3 inspecciones a un grupo de establecimientos\nubicados frente a playa Espadilla, en los cuales se ha evidenciado una\ndisposición inadecuada de aguas residuales y por ende se realizó la\nnotificación de la orden sanitaria correspondiente para que sea subsanada la no\nconformidad identificada. Igualmente, mediante orden sanitaria N°\nMS-DRRSPC-DARSQ-OS-260-2024 emitida el 25 de octubre de 2024 al establecimiento\nLas Delicias, por manejo inadecuado de aguas residuales provenientes de la pila\ndel bar, las cuales eran dirigidas al cordón y caño frente al establecimiento.\nPor ende, se realizó el acta de inspección N° MS-DRRSPC-DARSQ-AI-028-2025, en\nla cual se consignó que las aguas residuales provenientes de la pila del bar se\ndirigían directamente al tanque séptico y que el establecimiento cumplía con lo\nindicado en la orden sanitaria N° MS-DRRSPC-DARSQ-OS-260- 2024. Por ello, se\ndispuso el cierre del caso. Mediante orden sanitaria N°\nMS-DRRSPC-DARSQ-OS-079-2025, emitida y notificada el 26 de marzo de 2025 al\nestablecimiento Baldi’s Fresh, orden que fue dictada con ocasión de\ninspecciones físico-sanitarias realizadas el 17, 18 y 20 de marzo de 2025, en\ndonde se comprobó un mal manejo de aguas residuales, según informe técnico N°\nMS-DRRSPC-DARSQ-IT-125-2025. Por ende, en dicha orden sanitaria se ordenó la\npresentación de un plan remedial para solucionar la situación, así como la\ndefinición de una alternativa técnicamente admisible para la disposición del\nefluente del sistema de tratamiento. Sin embargo, posteriormente el\nrepresentante legal del establecimiento renunció al permiso sanitario de\nfuncionamiento, circunstancia que dejó sin efecto la orden sanitaria\npreviamente notificada, al desaparecer el supuesto de operación del\nestablecimiento bajo el cual se había emitido la medida. Mediante orden sanitaria\nN° MS-DRRSPC-DARSQ-OS-0197-2025, emitida y notificada el 18 de julio de 2025 al\nestablecimiento Restaurante Donde Alex 2, orden que fue dictada con ocasión de\ninspecciones físico-sanitarias realizadas el 04 de julio de 2025. Así, se\ndispuso que el establecimiento debía disponer sanitariamente, dentro de su\npropiedad, las aguas residuales del restaurante, mediante un sistema de\ntratamiento aprobado por el Ministerio de Salud, de forma tal que se evitara su\nsalida al ambiente. De ese modo, su cumplimiento fue verificado mediante acta\nde inspección N° MS-DRRSPC-DARSQ-AI-0614-2025, en la cual se dejó constancia de\nque las aguas residuales del restaurante no salían al ambiente, razón por la\ncual se dispuso el cierre del caso. Mediante orden sanitaria N° MS-DRRSPC-DARSQ-OS-0250-2025,\nemitida el 26 de agosto de 2025 al establecimiento Hotel Milenium, orden que\nfue dictada con ocasión de inspecciones físico-sanitarias realizadas el 22 de\nagosto de 2025, en la que se constató disposición inadecuada de aguas residuales\nprovenientes de lavandería, servicios sanitarios, duchas y lavatorios de las\nhabitaciones 101, 102 y 103, así como deficiencias en la conducción de aguas\npluviales y acumulación de agua en techos. Por ende, se ordenó suspender el uso\nde dichas habitaciones hasta corregir el problema y obtener autorización del\nMinisterio de Salud, colocar canoas y bajantes, realizar mejoras para evitar\nacumulación de aguas pluviales, presentar plan remedial y definir una\nalternativa técnicamente admisible para la disposición final del efluente. Así,\nel 01 de julio de 2026, el Área Rectora de Salud realizó la inspección\nrespectiva, en la cual verificó que el Hotel Milenium se encontraba operando\nsin permiso sanitario de funcionamiento vigente desde el 22 de abril de 2026.\nPor consiguiente, el Área Rectora de Salud dictó y notificó la orden sanitaria\nN° MS-DRRSPC-DARSQ-OS-0151-2026, mediante la cual ordenó la clausura inmediata\ndel establecimiento hasta que cuente con el respectivo permiso sanitario de\nfuncionamiento vigente, orden que actualmente está vigente. Mediante orden\nsanitaria N° MS-DRRSPC-DARSQ-OS-0328-2025, emitida el 07 de noviembre de 2025\nal Parque Nacional Manuel Antonio, orden que fue dictada con ocasión de\ninspecciones físico-sanitarias realizadas el 06 de noviembre de 2025, en la\ncual se comprobaron deficiencias asociadas con la disposición de aguas\nresiduales provenientes de la casa de guardaparques, la batería sanitaria N°4 y\nlas duchas ubicadas en la batería sanitaria N°3. Por ende, se ordenó la clausura\ninmediata de las instalaciones de la casa de guardaparques, la clausura\ninmediata de la batería sanitaria N°4, la suspensión inmediata del uso de las\nduchas ubicadas en la batería sanitaria N°3, la presentación de un plan\nremedial con cronograma y la adecuación inmediata del aforo de visitantes según\nla capacidad sanitaria instalada. Al respecto, el Sistema Nacional de Áreas de\nConservación presentó el plan remedial correspondiente, bajo consecutivo\nCARTA-SINAC-SE-SE-1628-2025, el cual fue revisado por el Área Rectora de Salud\nde Quepos y aprobado mediante CARTA-MS-DRRSPC-DARSQ-367-2025 del 26 de\nnoviembre de 2025. De ese modo, se tuvo por conforme el proceder y los plazos\npropuestos para las mejoras y reparaciones del sistema de tratamiento de aguas\nresiduales de la casa de funcionarios y de las baterías sanitarias indicadas\ndel Parque Nacional, fijándose como fecha máxima de cumplimiento el 13 de\nfebrero de 2026. Posteriormente, si bien la ejecución ha presentado retrasos,\nla Administración del Parque continúa trabajando en el cumplimiento de la orden\nsanitaria y el proyecto constructivo del sistema de tratamiento de aguas\nresiduales de la casa de funcionarios y de las baterías sanitarias indicadas\ndel Parque Nacional fue revisado en la plataforma APC, constando para el\nMinisterio de Salud el resultado de “subsanación aceptada”. Esta indicación se\nformula estrictamente dentro del ámbito técnico de revisión correspondiente al\nMinisterio de Salud.\n\nAhora bien, posterior a la interposición\ndel presente recurso, el 13 de enero de 2026, el recurrente interpuso una\ndenuncia ante el Ministerio de Salud y el Sistema Nacional de Áreas de\nConservación del MINAE respecto a la situación descrita en el presente recurso\nde amparo. Así, el 14 de enero de 2026, ante la denuncia presentada por el\nrecurrente el 13 de enero de 2026 ante la Municipalidad de Quepos y el Área\nRectora de Quepos, la Municipalidad recurrida y el Área Rectora de Salud\nrecurrida llevaron a cabo una inspección en el lugar, a efectos de constatar\nlas condiciones sanitarias imperantes, atendiendo la situación.\n\nAsimismo, posterior a la notificación de\nla resolución de curso, según las actas de inspección N°\nMS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026 y\nMS-DRRSPC-DARSQ-AI-086-202, el 05 de febrero de 2026 el Área Rectora de Salud\nde Quepos realizó una inspección en los 3 sitios indicados por el recurrente y\nno comprobó los malos olores descritos. Por último, no se tuvo por demostrado\nque, previo a la interposición del presente recurso, el recurrente haya\ninterpuesto una denuncia ante el Área Rectora de Salud de Quepos respecto a la\nsituación indicada en escrito de interposición.\n\nEn este sentido, es relevante reiterar\nque, previo a la interposición del presente recurso, el recurrente no había\ninterpuesto una denuncia ante el Área Rectora de Salud de Quepos respecto a la\nsituación indicada en el amparo, por lo que no es posible atribuirle alguna\nomisión a dicho Ministerio.\n\nAl respecto, mediante sentencia no.\n2023-29457 de las 12:50 horas del 10 de noviembre de 2023, dictada dentro del\nexpediente no. 23-012835-0007-CO, este Tribunal estableció sobre la necesidad\nde interponer una denuncia en temas ambientales, al indicar “que, para que se\npueda ventilar una lesión o amenaza a los derechos ambientales, en la\ngeneralidad o en lo particular, tendríamos que estar ante el escenario de que\nla persona afectada haya presentado una denuncia y que, durante su trámite, se\nhaya determinado una amenaza o que\nefectivamente se esté dañando al medio ambiente, y aun así, las autoridades\nadministrativas recurridas no hayan tomado ningún tipo de medida al respecto,\nlesionando así el derecho constitucional consagrado en el artículo 50 de la\nCarta Magna”. Ahora bien, en esa misma sentencia también se estableció que “el\nTribunal Constitucional sí ha entrado a conocer recursos donde se demostró una\nviolación a un ambiente sano y ecológicamente equilibrado sin la necesidad de\nla interposición de una denuncia previa; ello, bajo dos supuestos de excepción,\na saber: 1) cuando se trate de un caso de gran envergadura y; 2) cuando de los\nautos se pueda derivar que las autoridades competentes han tenido conocimiento\nde la situación acusada, que está amenazando u ocasionando una daño al medio\nambiente, no han tomado ningún tipo de medida al respecto”.\n\nSobre el particular, tal y como se\nestableció anteriormente, es menester reafirmar que se denota que desde el 2020\nse han interpuesto múltiples denuncias (ninguna por parte del recurrente) ante\nel Área de Salud recurrido respecto a la disposición inadecuada de agua\nresiduales en los tres puntos señalados por el recurrente, sin embargo, se\ncomprueba que esas denuncias han sido atendidas por el Ministerio recurrido,\nrealizando las inspecciones correspondientes, descartando la situación alegada\ny emitiendo las órdenes sanitarias cuando se ha considerado, a las cuales le ha\ndado el seguimiento respectivo. De ese modo, este Tribunal considera que dicha\nÁrea de Salud les ha dado el seguimiento oportuno a las denuncias planteadas\npor los administrados. Igualmente, al tener conocimiento de la situación\nalegado del recurrente por medio del amparo, el 14 de enero de 2026, la\nMunicipalidad recurrida y el Área Rectora de Salud recurrida llevaron a cabo\nuna inspección en el lugar, a efectos de constatar las condiciones sanitarias\nimperantes. Asimismo, se realizó una nueva inspección el día 05 de febrero de\n2026 en el sitio denunciado, para corroborar que no existe tal afectación\ndenunciada. Es decir, el Ministerio de Salud ha sido diligente ante el\nconocimiento de denuncias en el lugar señalado por el recurrente, denuncias que\nen ningún momento han sido interpuestas por el recurrente, ya que, se reitera\nque, previo a la interposición del presente recurso, el recurrente no había\ninterpuesto una denuncia ante el Área Rectora de Salud de Quepos respecto a la\nsituación indicada en el amparo.\n\nPor último, respecto a la denuncia\ninterpuesta por el recurrente el 13 de enero de 2026 ante el Ministerio de\nSalud, se reafirma que dicha gestión fue interpuesta posterior a la\npresentación del presente amparo, por lo que cualquier reclamo respecto a esa\ndenuncia deviene prematuro.\n\nPor consiguiente, respecto a este\nMinisterio, se descarta lesión a los derechos fundamentales del recurrente. \n\nV.- Sobre la actuación de la\nMunicipalidad de Quepos. Respecto a este Corporación Municipalidad se tiene por\ndemostrado que existe una iniciativa por parte de la Municipalidad de Quepos y\nel SINAC de colaborar interinstitucionalmente con la construcción de una planta\nde tratamiento en la zona indicada, razón por la que se invitó al Instituto\nCostarricense de Acueductos y Alcantarillados, institución rectora en el tema,\nquienes para tal labor tiene la capacidad de realizar los estudios técnicos de\nviabilidad de construcción de dicha planta y la determinación del sitio más\nidóneo para ubicarla, tomando en consideración que se trata de una zona\nambientalmente frágil y con características topográficas y de constitución del\nsuelo particulares que deben tomarse en consideración.\n\nAhora bien, posterior a la interposición\ndel presente recurso, el 13 de enero de 2026, el recurrente interpone una\ngestión ante la Municipalidad de Quepos respecto al manejo de aguas residuales\nen Playa Espadilla. Así, el 14 de enero de 2026, ante una solicitud verbal, la\nUnidad de Gestión Ambiental de la Municipalidad de Quepos, en conjunto con la\nUnidad de Zona Marítimo Terrestre, la Policía Municipal, el ingeniero de la\nUnidad de Desarrollo e Infraestructura, y una funcionaria del Ministerio de\nSalud, realizaron una inspección en el sitio. Así, producto de dicha\ninspección, la Municipalidad recurrida realizó varias acciones al detectar que\nen apariencia al menos dos negocios que desfogaban aguas residuales al cordón y\ncaño en el área de inspección, por lo que se procede a presentar formal\ndenuncia ante el Ministerio de Salud ese mismo día con el fin de que se\ndetermine lo descrito por parte de la autoridad competente. Sin embargo, dicha\ngestión fue rechazada por parte del Ministerio de Salud, indicando que los\ndenunciados debían estar individualizados. Mediante oficio\nMQ-CM-PM-007-26-2025-2026 del 19 de enero de 2026, la presidente del Concejo\ntrasladó la gestión del recurrente a la alcaldía, identificada como Oficio:\nCPE-1060-2-2026. Mediante oficio MO-ALC-143-2026 del 02 de febrero de 2026, la\nalcaldía de la Municipalidad de Quepos, como parte de la junta administradora\ndel Parque Nacional Manuel Antonio, le envió un oficio al Instituto\nCostarricense de Acueductos y Alcantarillados con el fin de realizar mesa de\ntrabajo interinstitucional enfocada en abordar el tema a la mayor brevedad en\nla búsqueda de soluciones permanentes a largo plazo. El 03 de febrero de 2026,\nla gerencia general del Instituto Costarricense de Acueductos y Alcantarillados\nle comunicó a la Municipalidad de Quepos lo siguiente: “En atención a lo\nremitido bajo el asunto \" oficio MQ-ALC-143-2026\", me permito dejar\nconstancia formal de su recepción en esta dependencia el día 03/02/2026. Este\nacuse se emite en estricto apego a lo dispuesto en el artículo 27 de la\nConstitución Política, que reconoce el derecho de petición y la pronta\nresolución de las gestiones planteadas ante la Administración Pública; así como\na la Ley N.° 9097 de Regulación del Derecho de Petición y a la Ley N° 8220 de\nProtección al Ciudadano del Exceso de Requisitos y Trámites Administrativos,\nque imponen a las instituciones públicas el deber de dar respuesta oportuna,\nrazonable y motivada a las solicitudes de los administrados. Se procederá a dar\nel trámite correspondiente conforme a la normativa vigente, comunicándole\noportunamente el curso de la gestión. Sin otro particular, agradezco su\natención y reitero nuestro compromiso con la transparencia, la eficiencia y la\nmejora continua en la atención a los usuarios y administrados”.\n\nAsimismo, posterior a la notificación de\nla resolución de curso, mediante oficio MQ-UGA-023-2026 del 06 de febrero de\n2026, el biólogo Warren Umaña Cascante de la Municipalidad de Quepos le\nsolicitó al Ministerio de Salud que considere adaptar su metodología de\natención de denuncias debido a las particularidades del caso y manifiesta la\ndisponibilidad por parte de la Municipalidad de colaborar en la atención del\npresente caso. Mediante oficio MO-ALC-142-2026 del 06 de febrero de 2026, la\nalcaldía de la Municipalidad de Quepos remitió la respuesta del recurrente al\nConcejo para ser conocido en sesión ordinaria por parte dicho Concejo, ya que\nahí realizó la gestión del recurrente. Mediante oficio no. MQ-UZMT-24-2026 del\n09 de febrero de 2026, el jefe de la Unidad de Zona Marítimo Terrestre de la\nMunicipalidad de Quepos le comunicó al alcalde lo siguiente: “4- Por otro lado,\na raíz de reuniones de las que esta Unidad ha participado con el Ministerio de\nAmbiente, se ha coordinado interinstitucionalmente para llevar a cabo una mesa\nde trabajo entre el MINAE, AyA y Municipalidad de Quepos, para determinar\nmedidas de largo plazo como la construcción de un sistema de alcantarillado y\nuna planta de tratamiento para brindar el servicio en Manuel Antonio. Esta\nalternativa requiere de la expertiz principalmente de AyA, por lo cual,\nmediante oficio MQ-ALC-143-2026 del 02 de febrero del 2026, desde su despacho\nde alcaldía y con la colaboración de esta Unidad de Zona Marítimo terrestre se\nha solicitado a Presidencia Ejecutiva de AyA una visita al Cantón de Quepos\npara llevar a cabo una mesa de trabajo entre instituciones. 5- Finalmente,\nrespecto al financiamiento para la construcción de un proyecto de\nalcantarillado sanitario en Playa Espadilla, es técnicamente imposible definir\nmontos o vías de financiamiento a un proyecto sobre el cual no tenemos\ndefinidos planos constructivos, ni siquiera la viabilidad técnica. No existe\ncerteza de ubicación de una posible planta de tratamiento específicamente para\neste sector, ya que definir esto corresponde a criterios altamente técnicos. 6-\nAhora bien, la Municipalidad de Quepos tiene conocimiento que el AyA compró un\nterreno de 1.8 hectáreas (Finca No. 236382) para la instalación de una planta\nde tratamiento para la ciudad de Quepos y tiene conocimiento que existen los\nplanos constructivos para el alcantarillado sanitario de toda la ciudad de\nQuepos, sin embargo, se desconoce si este sistema ya diseñado es capaz de\nrecibir las aguas servidas de Manuel Antonio o si el AyA considera otra alternativa\npara brindar el servicio en el sector de interés del denunciante. Para este\nproyecto de alcantarillado de la ciudad de Quepos junto a proyectos en Jacó y\nGolfito, el AyA contaba con financiamiento de un préstamo entre Costa Rica y el\nBanco KFW Frankfurt am Main, aprobado por la Asamblea Legislativa en 2019. Sin\nembargo, el Ministerio de Hacienda el 16 de agosto de 2023 comunicó al\nInstituto Costarricense de Acueductos y Alcantarillados (AyA) la cancelación\ndel programa y la eliminación del presupuesto y financiamiento de los proyectos\na esas comunidades. Es claro que, por el costo tan elevado de este tipo de\nproyectos, a la Municipalidad de Quepos le representa una dificultad financiera\ndirigir recursos de su presupuesto Municipal para cubrir por sí sola una obra\nde esta envergadura, por lo cual requiere del concurso de otras instituciones y\ndel Gobierno Central”. Por último, no se tuvo por demostrado que, previo a la\ninterposición del presente recurso, el recurrente haya interpuesto una denuncia\nante la Municipalidad de Quepos respecto a la situación indicada en escrito de\ninterposición.\n\nDe esa forma, al igual que se señaló en\nel considerando anterior, es relevante reiterar que, previo a la interposición\ndel presente recurso, el recurrente no había interpuesto una denuncia ante la\nMunicipalidad de Quepos respecto a la situación indicada en el amparo, por lo\nque no es posible atribuirle alguna omisión a dicha corporación municipal\nrespecto a alguna denuncia del recurrente. Por consiguiente, respecto a la\ndenuncia interpuesta por el recurrente el 13 de enero de 2026 ante la\nMunicipalidad recurrida, se reafirma que dicha gestión fue interpuesta\nposterior a la presentación del presente amparo, por lo que cualquier reclamo\nrespecto a esa denuncia deviene prematuro. Por ende, respecto a este punto se\ndeclara sin lugar el recurso en contra de la Municipalidad de Quepos.\n\nSin embargo, a pesar de las acciones de\nla Municipalidad recurrida, este Tribunal sí constata una omisión por parte de\nesa corporación municipal en cuanto a sus obligaciones Al respecto, ha quedado\ndebidamente demostrado que, antes incluso de que el recurrente formulara\ngestión administrativa formal, la Municipalidad recurrida ya había activado\nmecanismos de inspección coordinación interinstitucional y denuncia ante las\nautoridades competentes, por lo que actualmente existe una iniciativa por parte\nde la Municipalidad de Quepos y el SINAC de colaborar interinstitucionalmente\ncon la construcción de una planta de tratamiento en la zona indicada, razón por\nla que se invitó al Instituto Costarricense de Acueductos y Alcantarillados,\ninstitución rectora en el tema, quienes para tal labor tiene la capacidad de\nrealizar los estudios técnicos de viabilidad de construcción de dicha planta y\nla determinación del sitio más idóneo para ubicarla, tomando en consideración\nque se trata de una zona ambientalmente frágil y con características\ntopográficas y de constitución del suelo particulares que deben tomarse en\nconsideración. Así, si bien es cierto, previo a la interposición del presente\nrecurso, no se había interpuesto la denuncia respectiva, lo cierto es que la\nMunicipalidad de Quepos tenía conocimiento antes de cualquier denuncia sobre la\nposible necesidad de construcción de una planta de tratamiento en la zona\nindicada. En este sentido, es menester reiterar lo indicado en el considerando\nanterior, respecto a que “el Tribunal Constitucional sí ha entrado a conocer\nrecursos donde se demostró una violación a un ambiente sano y ecológicamente\nequilibrado sin la necesidad de la interposición de una denuncia previa; ello,\nbajo dos supuestos de excepción, a saber: 1) cuando se trate de un caso de gran\nenvergadura y; 2) cuando de los autos se pueda derivar que las autoridades\ncompetentes han tenido conocimiento de la situación acusada, que está\namenazando u ocasionando una daño al medio ambiente, no han tomado ningún tipo\nde medida al respecto”. Así, se denota que la Municipalidad sí tenía\nconocimiento antes de cualquier denuncia sobre la posible necesidad de\nconstrucción de una planta de tratamiento en la zona indicada. Sobre el\nparticular, nótese que el recurrente alega que “se ha notado la urgente\nnecesidad de una planta de tratamiento en todas sus funciones, ya que en varios\npuntos por ejemplo de playa Espadilla como Parque Manuel Antonio se percibe\nmalos olores tipo sépticas (…) ambientalistas de la zona han comentado la situación\nen Concejo Quepos; sin embargo, la administración no ha abordado la\nproblemática ambiental como algo prioritario”. Al respecto, la Municipalidad\nrecurrida no niega dicha situación ni niega tener conocimiento de lo indicado,\npero en el informe rendido bajo juramento únicamente se limita a informar que\n“(…) falta a la verdad el recurrente al indicar que existe un dinero destinado\na la construcción de una planta y que no se ha podido ejecutar por falta de\ninterés del gobierno local y que los terrenos son de dominio Municipal, lo que\nsi es cierto es que existe una iniciativa por parte de la Municipalidad y el\nSINAC de colaborar interinstitucionalmente con la construcción de una planta de\ntratamiento, sin embargo precisamente por tal razón se ha invitado a la\ninstitución rectora en el tema que es AyA, quienes para tal labor tiene la\ncapacidad de realizar los estudios técnicos de viabilidad de construcción de\ndicha plante y la determinación del sitio más idóneo para ubicarla, tomando en\nconsideración que estamos en una zona ambientalmente frágil y con\ncaracterísticas topográficas y de constitución del suelo particulares que deben\ntomarse en consideración (…) En el presente caso, el recurrente no acredita la\nexistencia de una omisión ilegitima, arbitraria. o negligente por parte de la\nMunicipalidad de Quepos. Por el contrario, ha quedado debidamente demostrado\nque antes incluso de que el recurrente formulara gestión administrativa formal,\nla Municipalidad ya había activado mecanismos de inspección coordinación interinstitucional\ny denuncia ante las autoridades competentes. Considera esta representación de\nmanera respetuosa que no procede el amparo cuando la Administración se\nencuentra actuando dentro de un margen razonable de diligencia, aun cuando la\nsolución definitiva a la problemática denunciada sea compleja o requiera\nactuaciones progresivas y de largo plazo (…) La propia gestión municipal\ndemuestra que la viabilidad técnica, ambiental y territorial del proyecto aún\nse encuentra en análisis, lo cual es plenamente razonable y constitucionalmente\nválido”.\n\nEs decir, la propia Municipalidad acepta\nque el problema denunciado requiere de una solución, no obstante, no consta que\nla Municipalidad de Quepos haya resuelto sobre la necesidad o no de construir\nuna planta de tratamiento en Playa Manuel Antonio, denotándose una omisión por\nparte de la Municipalidad respecto a sus obligaciones. Asimismo, nótese que,\ncon conocimiento de la situación por medio del amparo, la Municipalidad\nrecurrida ha realizado las siguientes actuaciones: “realizó inspección en sitio\nel 14 de enero de 2026 (…) • Se coordinó la inspección con múltiples\ndependencias municipales y con el Ministerio de Salud, autoridad rectora en\nmateria de saneamiento ambiental. • Se presentó denuncia formal ante el\nMinisterio de Salud al detectarse aparentes irregularidades, demostrando\nvoluntad activa de corrección. • Se gestionaron acciones posteriores para\nsuperar las limitaciones técnicas señaladas por el Ministerio de Salud. • Se\npromovió una mesa de trabajo interinstitucional con AyA, institución competente\npara estudios técnicos, diseño y eventual ejecución de una planta de\ntratamiento”. Es decir, a pesar de confirmarse que la Municipalidad sí tenía\nconocimiento sobre la necesidad o no de una planta de tratamiento en Playa\nManuel Antonio, lo cierto es que a la fecha únicamente ha promovido una mesa de\ntrabajo institucional sin resolver la cuestión de fondo.\n\nEn este sentido, es importante traer a\ncolación lo indicado en la sentencia no. 2026-026822 de las 09:25 horas del 17\nde julio de 2026, en donde se estableció, en lo que interesa, lo siguiente: “No\ndebe perderse de vista que la Municipalidad de Limón como administradora de los\nintereses y servicios locales (artículo 169 de la Constitución Política), e\ninstancia ante la cual se planteó la denuncia de 17 de julio de 2025, no puede\ndesentenderse de los problemas expuestos, y debe actuar como articulador de la intervención\ncoordinada de la Administración, pues como se ha visto, la solución definitiva\nhace necesaria la integración de esfuerzos y la actuación de diversas\ndependencias. Esta Sala Constitucional, en la sentencia No. 2020-010630 de las\n09:15 horas de 12 de junio de 2020, explicó: “(…) COMPETENCIA MUNICIPAL Y\nOBLIGACIÓN DE COORDINACIÓN INTERINSTITUCIONAL. Competencia municipal y\nobligación de coordinación interinstitucional. El artículo 169, de la\nConstitución Política, dispone que \"La administración de los intereses y\nservicios locales en cada cantón, estará a cargo del Gobierno Municipal\n(...)\". Esta norma ha sido desarrollada por el legislador ordinario, en\natención a ello, el artículo 3, del Código Municipal, Ley N° 7794 de 30 de\nabril de 1998, dispone que: \"El gobierno y la administración de los\nintereses y servicios cantonales estarán a cargo del gobierno municipal\".\nEn este mismo sentido, se ha expresado la Sala Constitucional en su\njurisprudencia. Verbigracia, en Sentencia N° 5445-99, de las 14:30 horas del 14\nde julio de 1999, se dispuso lo siguiente: \"VI.- DE LAS ATRIBUCIONES DE\nLAS MUNICIPALIDADES EN RAZÓN DE LA MATERIA (CONCEPTO DE \"LO LOCAL\").\nPor disposición constitucional expresa -artículo 169-, hay una asignación de\nfunciones o atribuciones en favor de los gobiernos locales en razón de la\nmateria a \"lo local\", sea, \"la administración de los servicios e\nintereses\" de la localidad a la que está circunscrita, para lo cual se la\ndota de autonomía (\") De manera que sus potestades son genéricas, en tanto\nno hay una enumeración detallada de sus cometidos propios, sino una simple\nenunciación del ámbito de su competencia; pero no por ello no determinable, a\nlo que hizo referencia este Tribunal en sentencia número 6469-97, de las\ndieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y\nsiete, en los siguientes términos: \" (...) lo local tiene tal connotación\nque definir sus alcances por el legislador o el juez, debe conducir al\nmantenimiento de la integridad de los intereses y servicios locales, de manera\nque ni siquiera podría el legislador dictar normativa que tienda a desmembrar\nel Municipio (elemento territorial), si no lo hace observando los\nprocedimientos previamente establecidos en la Constitución Política; ni tampoco\npromulgar aquella que coloque a sus habitantes (población) en claras\ncondiciones de inferioridad con relación al resto del país; ni la que afecte la\nesencia misma de lo local (gobierno), de manera que se convierta a la\nCorporación en un simple contenedor vacío del que subsista solo la nominación,\npero desactivando todo el régimen tal y como fue concebido por la Asamblea\nNacional Constituyente. En otro giro, habrá cometidos que por su naturaleza son\nmunicipales -locales- y no pueden ser substraídos de ese ámbito de competencia\npara convertirlos en servicios o intereses nacionales, porque hacerlo\nimplicaría desarticular a la Municipalidad, o mejor aún, vaciarla de contenido\nconstitucional, y por ello, no es posible de antemano dictar los límites\ninfranqueables de lo local, sino que para desentrañar lo que corresponde o no\nal gobierno comunal, deberá extraerse del examen que se haga en cada caso\nconcreto (...)\". De lo anterior, resalta el hecho de que, por voluntad\nexpresa de nuestra Carta Fundamental, se asigna una competencia específica a\nlos gobiernos locales, atribución que además es exclusiva de éstos; es decir,\nse trata de una competencia originaria de la municipalidad y sólo mediante una\nley de nacionalización o de regionalización es que puede ser desplazada, total\no parcialmente\". En consecuencia, si un grupo de munícipes, en su\ncircunscripción territorial, sufren inundaciones con riesgo para sus vidas y\ngraves daños patrimoniales, psicológicos, calidad de vida y bienestar general,\nesto se enmarca dentro del concepto de \"intereses y servicios\nlocales\" del numera 169, constitucional, problemas cuyas causas tienen que\nser identificadas con precisión y, más aun, las soluciones, a fin de\nimplementarlas a la mayor brevedad posible; para lo cual corresponde a la\nMunicipalidad coordinar con las instituciones de nivel nacional con competencia\npara actuar sobre el problema. En efecto, la Sala ya ha desarrollado la\nobligación municipal de coordinar con otras instituciones estatales en aras de\natender los \"intereses\" y prestar cumplidamente los \"servicios\nlocales\". En la citada Sentencia N° 5445-99, la Sala manifestó:\n\"(...) se refieren a la obligación de coordinación que debe existir entre\nlos gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo,\npara llevar a cabo las funciones que le han sido encomendadas, lo que debe ser\nanalizado a partir de la naturaleza misma de la autonomía municipal. Es en\nvirtud de lo dispuesto en el artículo 170 constitucional, que las\nmunicipalidades (entes corporativos locales) gozan de autonomía funcional,\nadministrativa y financiera en la administración de los intereses y servicios\nlocales (artículo 169 de la Constitución Política) (...) No puede, entonces,\ncrearse un conflicto por antagonismo o protagonismo entre la materia que\nintegra el fin general de \"los intereses y servicios locales\" de los\nintereses y servicios públicos \"nacionales\" o \"estatales\",\nintrínsecamente distintos unos de otros, pero que en realidad están llamados a\ncoexistir (...) Definida la competencia material de la municipalidad en una\ncircunscripción territorial determinada, queda claro que habrá cometidos que\npor su naturaleza son exclusivamente municipales, a la par de otros que pueden\nser reputados nacionales o estatales; por ello es esencial definir la forma de\ncooparticipación de atribuciones que resulta inevitable, puesto que la\ncapacidad pública de las municipalidades es local, y la del Estado y los demás\nentes, nacional; de donde resulta que el territorio municipal es\nsimultáneamente estatal e institucional, en la medida en que lo exijan las\ncircunstancias. Es decir, las municipalidades pueden compartir sus competencias\ncon la Administración Pública en general, relación que debe desenvolverse en\nlos términos como está definida en la ley (artículo 5 del Código Municipal\nanterior, artículo 7 del nuevo Código), que establece la obligación de\n\"coordinación\" entre la municipalidades y las instituciones públicas\nque concurran en el desempeño de sus competencias, para evitar duplicaciones de\nesfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria\nes compatible con la autonomía municipal por ser su expresión. En otros\ntérminos, la municipalidad está llamada a entrar en relaciones de cooperación\ncon otros entes públicos, y viceversa, dado el carácter concurrente o\ncoincidente - en muchos casos-, de intereses en torno a un asunto concreto. En\nla doctrina, la coordinación es definida a partir de la existencia de varios\ncentros independientes de acción, cada uno con cometidos y poderes de decisión\npropios, y eventualmente discrepantes; pese a ello, debe existir una comunidad\nde fines por materia, pero por concurrencia, en cuanto sea común el objeto\nreceptor de los resultados finales de la actividad y de los actos de cada\nuno\". De manera que la coordinación es la ordenación de las relaciones\nentre estas diversas actividades independientes, que se hace cargo de esa\nconcurrencia en un mismo objeto o entidad, para hacerla útil a un plan público\nglobal, sin suprimir la independencia recíproca de los sujetos agentes. Como no\nhay una relación de jerarquía de las instituciones descentralizadas, ni del\nEstado mismo en relación con las municipalidades, no es posible la imposición a\néstas de determinadas conductas, con lo cual surge el imprescindible \"concierto\"\ninterinstitucional, en sentido estricto, en cuanto los centros autónomos e\nindependientes de acción se ponen de acuerdo sobre ese esquema preventivo y\nglobal, en el que cada uno cumple un papel con vista en una misión confiada a\nlos otros\". Adviértase, por lo demás, que las Municipalidades están\nobligadas, por imperativo del ordinal 50, de la Constitución Política, a\nprodigarse en la protección del ambiente (Sentencia N° 2006-7994 de las 8:57\nhoras de 2 de junio de 2006) (…)” (sic) (reiterado en la sentencia No.\n2026-05217 de las 09:34 horas de 13 de febrero de 2026) (el énfasis no\npertenece al original).\n\nDe ese modo, de lo indicado, es\nobligación de la Municipalidad recurrida coordinar para buscar una solución\nante la posible necesidad o no de la construcción de una planta de tratamiento.\nAsí las cosas, se reafirma que la Municipalidad sí tenía conocimiento sobre la\nnecesidad o no de construir una planta de tratamiento en Playa Manuel Antonio,\nlo cierto es que a la fecha únicamente ha promovido una mesa de trabajo\ninstitucional sin resolver la cuestión de fondo. Por ende, ante la falta de\nsolución ante un problema que puede afectar al ambiente y al derecho a un\nambiente sano y equilibrado los administrados de ese cantón, se denota una\nomisión por parte de la Corporación Municipal y, por lo tanto, una lesión a los\nderechos fundamentales. En este sentido, se declara con lugar el recurso\núnicamente en cuanto a este punto y en contra de la Municipalidad de Quepos.\n\nVI.- Sobre la actuación del Sistema\nNacional de Áreas de Conservación del MINAE. Sobre el particular, se tiene por\ndemostrado que, en octubre de 2025, ocurrió un sismo que afectó la\ninfraestructura interna del sistema de tratamiento del Parque Nacional Manuel\nAntonio, lo cual generó, por parte del SINAC, mecanismos de emergencia\ninstitucional, como la declaratoria de emergencia nacional. Asimismo, se\ncoordinó con el Área Rectora de Salud de Quepos, lo que conllevó a la orden\nsanitaria N° MS-DRRSPC-DARSQ-OS-0328-2025, emitida el 07 de noviembre de 2025.\nAsí, la Administración del Parque continúa trabajando en el cumplimiento de la\norden sanitaria y el proyecto constructivo del sistema de tratamiento de aguas\nresiduales de la casa de funcionarios y de las baterías sanitarias indicadas\ndel Parque Nacional fue revisado en la plataforma APC, constando para el\nMinisterio de Salud el resultado de “subsanación aceptada”. Sin embargo, esta\nsituación no relación causal alguna con el tema denunciado en el presente recurso\nde amparo por el recurrente. Lo anterior, pues, desde el punto de vista técnico\ny material, estas instalaciones internas se ubican a 1.2 kilómetros de\ndistancia de la entrada principal y de la quebrada en mención, por lo tanto, es\nimprobable la contaminación de estos sistemas hacia el sector denunciado.\nAdemás, ambos sistemas presentaban sistemas de drenajes independientes y no\ntenían efluentes dirigidos a esos cuerpos de agua.\n\nAhora bien, posterior a la interposición\ndel presente recurso de amparo, el 13 de enero de 2026, el recurrente interpuso\nuna denuncia ante el Sistema Nacional de Áreas de Conservación del MINAE\nrespecto a la situación descrita en el presente recurso de amparo. Así, la\ngestión fue registrada en el sistema SITADA bajo el número 59948-2026. El 19 de\nenero de 2026, el Sistema Nacional de Áreas de Conservación del MINAE realizó\nla inspección de campo en el lugar denunciado por el recurrente. Así, de la\nprueba técnica aportada por la Administración del Parque Nacional Manuel\nAntonio, se demuestra que los hechos denunciados no se originan dentro del área\nprotegida, sino en zonas externas a la misma, siendo que las corrientes\nmencionadas ingresan al parque únicamente en su tramo final, por lo que\ncualquier eventual contaminación se genera aguas arriba, fuera de la\njurisdicción del SINAC. Igualmente, en el acta N° 3765, se indica que “se logra\nobservar la quebrada La Camaronera, emanando un olor desagradable, más no se\nlogra observar el motivo del mal olor; por lo que, caminando sobre el borde de\nla quebrada llegamos a un punto, donde se logra identificar dos alcantarillas\nque dan al borde de la quebrada, llevando aguas residuales a la quebrada. Se\ntoman fotos y puntos GPS y se remite la denuncia al Ministerio de Salud, ya que\nes a quien le corresponde estos temas”. De ese modo, en la inspección se\ndetectaron indicios de afectación sin poder establecerse con certeza su origen.\nPor ende, el 21 de enero de 2026 se procedió a remitir el caso al Ministerio de\nSalud para su atención conforme a sus competencias. El 22 de junio de 2026,\nprevio a la notificación de la resolución de ampliación de curso a esa\ninstitución, mediante el Oficio CARTA-SINAC-ACOPAC-DR-DRFVS-OSRAP-0154-2026, el\nSINAC procedió a noticiarle al recurrente las acciones realizadas respecto a su\ndenuncia. Por último, el Área Rectora de Salud de Quepos, en coordinación con\nel Sistema Nacional de Áreas de Conservación del MINAE, ha realizado\nverificaciones técnicas en la Playa Nacional Manuel Antonio, mediante pruebas\nde fluoresceína y evaluaciones, que han descartan que los sistemas de\ntratamiento del Parque sean fuente de contaminación, confirmando que estos\noperan adecuadamente. Así, los sistemas de tratamiento del Parque y la planta\nde tratamiento ubicada en la entrada principal tienen como disposición final\nsistemas de drenajes, los cuales han demostrado estar plenamente funcionales y\nque no están afectando este cauce. El personal de la Playa Nacional Manuel Antonio\nrealiza patrullajes de rutina constantes en los sectores mencionados. Durante\ndichos recorridos de control, se constata que el cauce ingresa al Parque, pero\nno se evidencia la existencia de descargas o afluentes irregulares provenientes\nde otras propiedades colindantes.\n\nAl respecto, se constata que el Sistema\nNacional de Áreas de Conservación del MINAE procedió a tramitar la denuncia\ninterpuesta por el recurrente, la cual, se reitera, se presentó posterior a la\ninterposición del presente recurso, realizando la inspección, remitiendo la\ndenuncia al Ministerio de Salud y notificar al recurrente lo referente al\nmismo. Asimismo, ha coordinado con el Área Rectora de Salud de Quepos. De ese\nmodo, se reitera que, en forma conjunta, ha realizado verificaciones técnicas\nen la Playa Nacional Manuel Antonio, mediante pruebas de fluoresceína y\nevaluaciones, que han descartan que los sistemas de tratamiento del Parque sean\nfuente de contaminación, confirmando que estos operan adecuadamente. Así, los\nsistemas de tratamiento del Parque y la planta de tratamiento ubicada en la\nentrada principal tienen como disposición final sistemas de drenajes, los\ncuales han demostrado estar plenamente funcionales y que no están afectando\neste cauce. Por último, también se reitera que el personal de la Playa Nacional\nManuel Antonio realiza patrullajes de rutina constantes en los sectores\nmencionados. Durante dichos recorridos de control, se constata que el cauce\ningresa al Parque, pero no se evidencia la existencia de descargas o afluentes\nirregulares provenientes de otras propiedades colindantes.\n\nPor consiguiente, se denota que el\nSistema Nacional de Áreas de Conservación ha actuado conforme a sus\ncompetencias y ha tramitado la denuncia del recurrente. En todo caso, se\nreafirma que dicha denuncia fue interpuesta posterior a la presentación del presente\namparo, por lo que cualquier reclamo respecto a esa denuncia deviene prematuro.\n\nPor consiguiente, respecto al SINAC, se\ndescarta lesión a los derechos fundamentales del recurrente. \n\nVII.- Sobre la actuación del Instituto\nCostarricense de Acueductos y Alcantarillados. Al respecto, el 14 de enero de\n2026, ante la denuncia presentada por el recurrente el 13 de enero de 2026 ante\nla Municipalidad de Quepos y el Área Rectora de Quepos, la Municipalidad\nrecurrida y el Área Rectora de Salud recurrida llevaron a cabo una inspección\nen el lugar, a efectos de constatar las condiciones sanitarias imperantes. Por\nconsiguiente, ante la inexistencia de un sistema colectivo de alcantarillado\nsanitario, la normativa vigente impone la obligación de que las aguas\nresiduales sean tratadas mediante sistemas individuales adecuados. En el caso\nde las viviendas, ello implica el uso de tanques sépticos, mientras que, para\nestablecimientos comerciales, tales como hoteles, restaurantes y otros que\ngeneran aguas residuales de tipo especial, es obligatorio contar con sistemas\nde tratamiento específicos —incluidas plantas de tratamiento— debidamente\naprobados, supervisados y fiscalizados por el Ministerio de Salud y la\nMunicipalidad correspondiente. Así, se constató en sitio la existencia de\ndescargas de aguas residuales sin tratamiento hacia la playa y el mar en las\ninmediaciones del Parque Nacional Manuel Antonio. Por lo que, se comprueba que,\na raíz de denuncias de vecinos de la zona, el propio Ministerio de Salud ha\ndebido intervenir en atención de situaciones que evidencian deficiencias en el\nmanejo de aguas residuales. Asimismo, según las actas de inspección N°\nMS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026 y\nMS-DRRSPC-DARSQ-AI-086-202, el 05 de febrero de 2026 el Área Rectora de Salud\nde Quepos realizó una inspección en los 3 sitios indicados por el recurrente y\nno comprobó los malos olores descritos. Posteriormente, la Municipalidad de\nQuepos promovió la conformación de una mesa de trabajo interinstitucional, con\nla participación del Instituto Costarricense de Acueductos y Alcantarillados y\nde otros actores estratégicos con potencial de contribuir técnica y\nfinancieramente a la solución de la problemática de las aguas residuales, tales\ncomo el Sistema Nacional de Áreas de Conservación (SINAC) y el Instituto de\nDesarrollo Rural (INDER). En marzo de 2026, como resultado de la coordinación\nanteriormente, las instituciones involucradas efectuaron una visita técnica\nconjunta en la zona de Manuel Antonio, con la finalidad de analizar la\nviabilidad de desarrollar un proyecto integral de saneamiento. Así, en dicho\nproceso, la Municipalidad de Quepos, el SINAC y el INDER han coincidido en la\nnecesidad de promover la formulación y eventual construcción de un sistema de\nalcantarillado sanitario (AS) y una planta de tratamiento de aguas residuales\n(PTAR), como solución estructural a la problemática. Por ende, el INDER ha\nmanifestado su disposición de aportar aproximadamente tres mil millones de\ncolones (US$ 6,2 millones), sin perjuicio de que el Instituto Costarricense de\nAcueductos y Alcantarillados, como órgano técnico especializado, debe realizar\nlas valoraciones correspondientes para determinar la solución más idónea desde\nel punto de vista técnico, económico y ambiental. Por consiguiente, en caso de\nque se determine la necesidad de formular un proyecto para la zona de Manuel\nAntonio, Quepos, este deberá cumplir con todas las fases establecidas con las\nnormas técnicas, lineamientos y procedimientos que ha establecido el Ministerio\nde Planificación Nacional y Política Económica (MIDEPLAN), esto debido a su\ngran inversión económica, razón por la cual, se visualizaría como una solución\na largo plazo. De ese modo, en el marco de la mesa interinstitucional, se ha\nidentificado como alternativa para acelerar la ejecución de un eventual\nproyecto la suscripción de un convenio de cooperación entre el AyA, el SINAC,\nla Municipalidad de Quepos y el INDER, mediante el cual el AyA aportaría los\ndiseños técnicos, el INDER asumiría la licitación y ejecución de las obras, y,\nuna vez concluidas, los activos serían transferidos al AyA para su operación.\nAl respecto, cualquier intervención deberá contemplar soluciones de alta\ntecnología —particularmente en lo relativo a la PTAR—que permitan el\ntratamiento integral de contaminantes, considerando la sensibilidad ambiental\nde la zona costera y del área protegida. Adicionalmente, se ha recomendado, de\nmanera preliminar, la formulación de un proyecto de saneamiento independiente\npara la zona de Manuel Antonio, sin incorporar incrementos de caudal al\nproyecto existente para Quepos, en aras de garantizar una solución técnicamente\nadecuada. Finalmente, se impone la necesidad de definir con claridad el esquema\nde financiamiento del proyecto, en el entendido de que el aporte anunciado por\nel INDER podría resultar insuficiente para cubrir la totalidad de las obras\nrequeridas, debiendo explorarse alternativas complementarias y considerar la\nposibilidad de esquemas de financiamiento plurianual, de conformidad con la\nnormativa aplicable. Por último, no se tuvo por demostrado que a la fecha el\nrecurrente haya interpuesto una denuncia ante el Instituto Costarricense de\nAcueductos y Alcantarillados respecto a la situación indicada en escrito de\ninterposición.\n\nDe esta forma, se denota que el\nInstituto Costarricense de Acueductos y Alcantarillados no ha recibido denuncia\nalguna del recurrente respecto a la situación indicada en el presente recurso\nde amparo, por lo que no es posible establecer alguna omisión por parte de esa\ninstitución.\n\nAhora bien, el Instituto Costarricense\nde Acueductos y Alcantarillados se encuentra realizando un proceso de\ncoordinación con la Municipalidad de Quepos, el SINAC y el INDER para\ndesarrollar un proyecto integral de saneamiento. Así, esas instituciones han\ncoincidido en la necesidad de promover la formulación y eventual construcción\nde un sistema de alcantarillado sanitario (AS) y una planta de tratamiento de\naguas residuales (PTAR). Por consiguiente, en caso de que se determine la\nnecesidad de formular un proyecto para la zona de Manuel Antonio Quepos, este\ndeberá cumplir con todas las fases establecidas con las normas técnicas,\nlineamientos y procedimientos que ha establecido el Ministerio de Planificación\nNacional y Política Económica (MIDEPLAN), esto debido a su gran inversión\neconómica, razón por la cual, se visualizaría como una solución a largo plazo.\nDe ese modo, en el marco de la mesa interinstitucional, se ha identificado como\nalternativa para acelerar la ejecución de un eventual proyecto la suscripción\nde un convenio de cooperación entre el AyA, el SINAC, la Municipalidad de\nQuepos y el INDER, mediante el cual el AyA aportaría los diseños técnicos, el\nINDER asumiría la licitación y ejecución de las obras, y, una vez concluidas,\nlos activos serían transferidos al AyA para su operación. Por ende, actualmente\ndichas instituciones se encuentran realizando las coordinaciones respectivas,\ncomo sería un eventual proyecto la suscripción de un convenio de cooperación\nentre el AyA, el SINAC, la Municipalidad de Quepos y el INDER. De esa forma,\naunque si bien es cierto en la Playa Manuel Antonio no existe un sistema\ncolectivo de alcantarillado sanitario, según lo indicado bajo juramento por el\nrepresentante del Instituto Costarricense de Acueductos y Alcantarillados, la\nnormativa vigente impone la obligación de que las aguas residuales sean\ntratadas mediante sistemas individuales adecuados, situación que, como se\nevidencia en los considerandos anteriores, ha sido atendida por el Área Rectora\nde Salud de Quepos al intervenir en atención de situaciones que evidencian\ndeficiencias en el manejo de aguas residuales, realizando las inspecciones\ndebidas, emitiendo las órdenes sanitarias correspondientes y velando por su\ncumplimiento.\n\nEn todo caso, respecto a la actuación\ndel ICAA, se reitera que actualmente no existe aprobado algún proyecto de\nsaneamiento, ni aprobada la construcción de un sistema de alcantarillado y una\nplanta de tratamiento, sino que se encuentra en etapa de coordinación, en donde\nactualmente es técnicamente imposible definir montos o vías de financiamiento a\nun proyecto sobre el cual no se tienen definidos planos constructivos, ni\nsiquiera la viabilidad técnica. Por ende, tal y como se indicó anteriormente,\nno existe certeza respecto a la ubicación de una posible planta de tratamiento\nespecíficamente para este sector, ya que definir esto corresponde a criterios\naltamente técnicos, los cuales se encuentran en trámite de coordinación en la\nmesa institucional mencionada. Por ende, excedente las competencias de este\nTribunal ordenar la eventual construcción de un proyecto que no ha sido\naprobado, que se encuentra en proceso de definición de criterios técnicos, que\na la fecha ni siquiera cuenta con viabilidad técnica y se encuentra en fases\niniciales. Asimismo, nótese que estas actuaciones de coordinación en la mesa\ninterinstitucional se han realizado desde este año, por lo que no se denota\nalgún atraso injustificado ni ha transcurrido un plazo desproporcionado por\nparte del ICAA, por lo que también se descarta lesión alguna a los derechos\nfundamentales del recurrente en ese sentido.\n\nPor consiguiente, respecto al ICAA, se\ndescarta lesión a los derechos fundamentales del recurrente. \n\nVIII.- Conclusión. Según lo indicado en\nel considerando V, sí se denota una lesión a los derechos fundamentales del\nrecurrente por parte de la Municipalidad de Quepos ante la falta de solución\nsobre la necesidad o no de la construcción de una planta de tratamiento en\nPlaya Manuel Antonio. Por consiguiente, se establece que se declara\nparcialmente con lugar el recurso únicamente por lo señalado ante la\nMunicipalidad de Quepos.\n\nEn cuanto a todo lo demás, lo que\ncorresponde es declarar sin lugar el recurso en todos sus extremos. Ahora bien,\nes importante recordarles a las autoridades recurridas que deberán continuar\ntramitando las denuncias presentadas por el recurrente las cuales deberán ser\natendidas y resueltas en un plazo razonable. Además, en cuanto al Ministerio de\nSalud, el SINAC y el ICAA se les recuerda su deber de continuar coordinando con\nla Municipalidad de Quepos para desarrollar en un plazo razonable un proyecto integral\nde saneamiento o la construcción de un sistema de alcantarillado y una planta\nde tratamiento en el lugar denunciado, según los criterios técnicos aplicables.\n(…)",
  "body_en_text": "2026029790. ENVIRONMENT. MUNICIPALITY. THE ABSENCE OF A DEFINITIVE SOLUTION FOR WASTEWATER MANAGEMENT IN THE PLAYA MANUEL ANTONIO AREA IS CHALLENGED. THE CHAMBER FINDS THAT THE MUNICIPALITY OF QUEPOS FAILED TO FULFILL ITS DUTY TO COORDINATE AND RESOLVE THE NEED FOR SANITARY INFRASTRUCTURE AND DECLARES THE AMPARO PARTIALLY WITH MERIT. IT ORDERS THE MUNICIPALITY TO DETERMINE WITHIN SIX MONTHS WHETHER CONSTRUCTION OF A TREATMENT PLANT IS APPROPRIATE AND TO COORDINATE THE ACTIONS NECESSARY TO ADDRESS THE ISSUE. NQC08/2026\n\n(…) IV.- Regarding the actions of the Ministry of Health. After analyzing the evidence submitted, this Court finds that the complainant’s fundamental rights were not violated with respect to this Ministry. This is because the reports submitted by the representatives of the challenged authorities—which are deemed to have been made under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter duly establish that the locations described by the complainant in this amparo application concerning Playa Manuel Antonio are: • From the main entrance to PNMA (Playa Nacional Manuel Antonio) to the park’s former entrance, along the area next to Hotel San Bada. • On the northwest side of Mar y Sombra. • At the artificial lagoon, an arm of the creek next to Kachá. The records in the Quepos Health Area’s database show that, since 2020, the following complaints have been filed concerning the improper disposal of wastewater at the three locations identified by the complainant in Manuel Antonio. The complaints are listed below: “• For 2020: receipt of 5 complaints is recorded; improper disposal of wastewater at the sites was not confirmed in any of the 5. • For 2021: there are no records of formal complaints having been filed concerning the matter at issue. • For 2022: receipt of 3 complaints is recorded. In one case, improper disposal of wastewater was found, so the corresponding health order was issued and later followed up on, and compliance was confirmed. The matters alleged in the other 2 complaints could not be substantiated. • For 2023: there are no records of formal complaints having been filed concerning the matter at issue. • For 2024: there are no records of formal complaints having been filed concerning the matter at issue. • For 2025: receipt of 2 complaints is recorded; the problem was confirmed in both, and the corresponding health order was issued so that the identified noncompliance would be corrected as soon as possible. In addition, following inspections conducted on the Ministry’s own initiative in the area, 3 additional health orders were issued requiring two establishments in the area and PNMA itself to correct the improper wastewater disposal occurring at that time. • For 2026: currently, only one complaint concerning wastewater in the area is recorded. It concerns PNMA; however, it has already been addressed, and the reported matter was not confirmed.” In addition, the Health Area has so far conducted 3 inspections of a group of establishments across from Playa Espadilla, where improper wastewater disposal was found; accordingly, the corresponding health order was issued so that the identified noncompliance would be remedied. Likewise, health order No. MS-DRRSPC-DARSQ-OS-260-2024 was issued to the establishment Las Delicias on 25 October 2024 for improper management of wastewater from the bar’s sink, which was being discharged into the curb and gutter in front of the establishment. Accordingly, inspection report No. MS-DRRSPC-DARSQ-AI-028-2025 was prepared, recording that wastewater from the bar’s sink was being directed straight to the septic tank and that the establishment was complying with health order No. MS-DRRSPC-DARSQ-OS-260- 2024. The case was therefore closed. By health order No. MS-DRRSPC-DARSQ-OS-079-2025, issued and served on 26 March 2025 on the establishment Baldi’s Fresh, following physical and sanitary inspections conducted on 17, 18, and 20 March 2025, improper wastewater management was confirmed, as stated in technical report No. MS-DRRSPC-DARSQ-IT-125-2025. Accordingly, that health order required submission of a remedial plan to resolve the situation and definition of a technically acceptable alternative for disposing of the treatment system’s effluent. However, the establishment’s legal representative later relinquished its operating health permit. This rendered the previously served health order ineffective because the premise that the establishment was operating, on which the measure had been based, no longer applied. By health order No. MS-DRRSPC-DARSQ-OS-0197-2025, issued and served on 18 July 2025 on the establishment Restaurante Donde Alex 2, following physical and sanitary inspections conducted on 04 July 2025, the establishment was required to dispose of the restaurant’s wastewater in a sanitary manner within its property, through a treatment system approved by the Ministry of Health, so as to prevent its release into the environment. Compliance was verified in inspection report No. MS-DRRSPC-DARSQ-AI-0614-2025, which recorded that the restaurant’s wastewater was not being released into the environment, and the case was therefore closed. By health order No. MS-DRRSPC-DARSQ-OS-0250-2025, issued on 26 August 2025 to the establishment Hotel Milenium following physical and sanitary inspections conducted on 22 August 2025, improper disposal of wastewater from the laundry, toilets, showers, and sinks in rooms 101, 102, and 103 was confirmed, as were deficiencies in stormwater conveyance and water accumulation on roofs. Accordingly, the order required suspension of use of those rooms until the problem was corrected and authorization obtained from the Ministry of Health; installation of gutters and downspouts; improvements to prevent stormwater accumulation; submission of a remedial plan; and definition of a technically acceptable alternative for final effluent disposal. On 01 July 2026, the Health Area conducted the corresponding inspection and verified that Hotel Milenium had been operating without a valid operating health permit since 22 April 2026. Consequently, the Health Area issued and served health order No. MS-DRRSPC-DARSQ-OS-0151-2026, ordering the establishment’s immediate closure until it has the corresponding valid operating health permit. That order is currently in force. By health order No. MS-DRRSPC-DARSQ-OS-0328-2025, issued on 07 November 2025 to Parque Nacional Manuel Antonio following physical and sanitary inspections conducted on 06 November 2025, deficiencies were found in the disposal of wastewater from the park rangers’ house, restroom block No. 4, and the showers in restroom block No. 3. Accordingly, the order required the immediate closure of the park rangers’ house facilities and restroom block No. 4; immediate suspension of use of the showers in restroom block No. 3; submission of a remedial plan with a schedule; and immediate adjustment of the visitor capacity limit to match the installed sanitary capacity. In this regard, the Sistema Nacional de Áreas de Conservación submitted the corresponding remedial plan under tracking number CARTA-SINAC-SE-SE-1628-2025. The Quepos Health Area reviewed and approved it by letter CARTA-MS-DRRSPC-DARSQ-367-2025 dated 26 November 2025. The proposed measures and timeframes for improvements and repairs to the wastewater treatment system at the staff house and the specified restroom blocks in the National Park were thus accepted, with 13 February 2026 set as the latest compliance date. Although implementation has since been delayed, the Park Administration continues working to comply with the health order. The construction project for the wastewater treatment system at the staff house and the specified restroom blocks in the National Park was reviewed on the APC platform, and the Ministry of Health recorded the result as “correction accepted.” This statement is made strictly within the Ministry of Health’s technical review remit.\n\nAfter this amparo application was filed, on 13 January 2026, the complainant filed a complaint with the Ministry of Health and the Sistema Nacional de Áreas de Conservación of MINAE concerning the situation described in the application. On 14 January 2026, in response to the complaint the complainant had filed on 13 January 2026 with the Municipality of Quepos and the Quepos Health Area, the challenged Municipality and challenged Health Area conducted an on-site inspection to assess the prevailing sanitary conditions and address the situation.\n\nIn addition, after notice of the order admitting the application, according to inspection reports No. MS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026, and MS-DRRSPC-DARSQ-AI-086-202, the Quepos Health Area inspected the 3 sites identified by the complainant on 05 February 2026 and did not confirm the bad odors described. Lastly, it was not established that, before this amparo application was filed, the complainant had filed a complaint with the Quepos Health Area concerning the situation described in the application.\n\nIn this regard, it bears repeating that, before this amparo application was filed, the complainant had not filed a complaint with the Quepos Health Area concerning the situation described in the amparo. It is therefore not possible to attribute any omission to that Ministry.\n\nIn this regard, in judgment No. 2023-29457, issued at 12:50 on 10 November 2023 in case file No. 23-012835-0007-CO, this Court addressed the need to file a complaint in environmental matters, stating “that, for an injury or threat to environmental rights to be heard, whether generally or in a particular case, the situation would have to be one in which the affected person filed a complaint and, during its processing, a threat was identified or actual harm to the environment was found, yet the challenged administrative authorities took no action in response, thereby violating the constitutional right enshrined in Article 50 of the Carta Magna.” That same judgment also held that “the Constitutional Court has heard applications in which a violation of the right to a healthy and ecologically balanced environment was established without the need for a prior complaint, under two exceptions: 1) where the case is of great magnitude; and 2) where the record shows that the competent authorities knew of the alleged situation, which is threatening or causing environmental harm, and took no action in response.”\n\nOn this point, as established above, it bears reaffirming that since 2020 multiple complaints have been filed with the challenged Health Area—none by the complainant—concerning improper wastewater disposal at the three locations identified by the complainant. However, those complaints were addressed by the challenged Ministry, which conducted the corresponding inspections, ruled out the alleged situation, and issued health orders where considered appropriate, with the corresponding follow-up. This Court therefore considers that the Health Area gave timely follow-up to the complaints submitted by members of the public. Likewise, after learning of the complainant’s alleged situation through the amparo, on 14 January 2026, the challenged Municipality and challenged Health Area conducted an on-site inspection to assess the prevailing sanitary conditions. Another inspection was also conducted at the reported site on 05 February 2026 to verify that the alleged harm did not exist. In other words, the Ministry of Health acted diligently upon learning of complaints concerning the location identified by the complainant. The complainant did not file any of those complaints, as bears repeating: before this amparo application was filed, the complainant had not filed a complaint with the Quepos Health Area concerning the situation described in the amparo.\n\nLastly, as to the complaint the complainant filed with the Ministry of Health on 13 January 2026, it is reaffirmed that it was filed after this amparo application was submitted. Any claim concerning that complaint is therefore premature.\n\nConsequently, no violation of the complainant’s fundamental rights is found with respect to this Ministry.\n\nV.- Regarding the actions of the Municipality of Quepos. With respect to this Municipal Corporation, it is established that the Municipality of Quepos and SINAC have an initiative to collaborate interinstitutionally on construction of a treatment plant in the area identified. For this reason, they invited the Instituto Costarricense de Acueductos y Alcantarillados, the lead institution on this matter, which has the capacity to conduct technical studies on the feasibility of building the plant and to determine the most suitable site, taking into account that the area is environmentally fragile and has particular topographical and soil composition characteristics that must be considered.\n\nAfter this amparo application was filed, on 13 January 2026, the complainant submitted a request to the Municipality of Quepos concerning wastewater management at Playa Espadilla. On 14 January 2026, following a verbal request, the Environmental Management Unit of the Municipality of Quepos, together with the Maritime-Terrestrial Zone Unit, the Municipal Police, the engineer from the Development and Infrastructure Unit, and an official from the Ministry of Health, conducted an on-site inspection. As a result of that inspection, the challenged Municipality took several actions after finding that apparently at least two businesses were discharging wastewater into the curb and gutter in the inspection area. It therefore filed a formal complaint with the Ministry of Health that same day so the competent authority could determine whether the reported conditions existed. However, the Ministry of Health rejected the complaint, stating that the persons complained of had to be individually identified. By letter MQ-CM-PM-007-26-2025-2026 dated 19 January 2026, the President of the Council forwarded the complainant’s request to the mayor’s office, identified as Letter: CPE-1060-2-2026. By letter MO-ALC-143-2026 dated 02 February 2026, the mayor’s office of the Municipality of Quepos, as part of the board administering Parque Nacional Manuel Antonio, sent a letter to the Instituto Costarricense de Acueductos y Alcantarillados to arrange an interinstitutional working meeting focused on addressing the matter as soon as possible and seeking permanent long-term solutions. On 03 February 2026, the general management of the Instituto Costarricense de Acueductos y Alcantarillados informed the Municipality of Quepos as follows: “Regarding the material submitted under the subject ‘letter MQ-ALC-143-2026,’ I hereby formally acknowledge receipt by this office on 03/02/2026. This acknowledgment is issued in strict compliance with Article 27 of the Political Constitution, which recognizes the right to petition and to prompt resolution of requests submitted to the Public Administration, as well as Law No. 9097 on the Regulation of the Right to Petition and Law No. 8220 on Protection of Citizens from Excessive Requirements and Administrative Procedures, which require public institutions to provide timely, reasonable, and reasoned responses to requests from members of the public. The matter will be processed in accordance with the applicable regulations, and you will be informed in due course of its progress. With nothing further, I thank you for your attention and reiterate our commitment to transparency, efficiency, and continuous improvement in serving users and members of the public.”\n\nIn addition, after notice of the order admitting the application, by letter MQ-UGA-023-2026 dated 06 February 2026, Warren Umaña Cascante, a biologist with the Municipality of Quepos, asked the Ministry of Health to consider adapting its complaint-handling method in light of the particular circumstances of the case and stated that the Municipality was available to assist with addressing it. By letter MO-ALC-142-2026 dated 06 February 2026, the mayor’s office of the Municipality of Quepos forwarded the complainant’s response to the Council for consideration at an ordinary meeting, since the complainant had submitted the request to that Council. By letter No. MQ-UZMT-24-2026 dated 09 February 2026, the head of the Municipality of Quepos Maritime-Terrestrial Zone Unit informed the mayor as follows: “4- In addition, following meetings in which this Unit has participated with the Ministry of Environment, interinstitutional coordination has taken place to hold a working meeting among MINAE, AyA, and the Municipality of Quepos to determine long-term measures, such as construction of a sewer system and treatment plant to provide service in Manuel Antonio. This alternative requires expertise primarily from AyA. Accordingly, by letter MQ-ALC-143-2026 dated 02 February 2026, your mayor’s office, with the assistance of this Maritime-Terrestrial Zone Unit, requested that AyA’s Executive Presidency visit the Quepos Canton to hold a working meeting among the institutions. 5- Lastly, with respect to financing for construction of a sanitary sewer project at Playa Espadilla, it is technically impossible to define amounts or financing mechanisms for a project for which construction plans have not been prepared and technical feasibility has not even been established. The location of a possible treatment plant specifically for this area is uncertain, since determining that requires highly technical criteria. 6- The Municipality of Quepos is aware that AyA purchased a 1.8-hectare property (Finca No. 236382) for installation of a treatment plant for the city of Quepos and that construction plans exist for sanitary sewers throughout the city. However, it is unknown whether that already designed system can receive wastewater from Manuel Antonio or whether AyA is considering another alternative for providing service in the area of interest to the complainant. AyA had financing for this sewer project for the city of Quepos, together with projects in Jacó and Golfito, through a loan between Costa Rica and Banco KFW Frankfurt am Main, approved by the Legislative Assembly in 2019. However, on 16 August 2023, the Ministry of Finance informed the Instituto Costarricense de Acueductos y Alcantarillados (AyA) that the program was canceled and the budget and financing for projects in those communities eliminated. Given the very high cost of this type of project, it is clear that allocating resources from its municipal budget to cover a project of this scale on its own presents a financial difficulty for the Municipality of Quepos. It therefore requires the participation of other institutions and the Central Government.” Lastly, it was not established that, before this amparo application was filed, the complainant had filed a complaint with the Municipality of Quepos concerning the situation described in the application.\n\nAs noted in the preceding section, it bears repeating that, before this amparo application was filed, the complainant had not filed a complaint with the Municipality of Quepos concerning the situation described in the amparo. It is therefore not possible to attribute to that Municipal Corporation any omission regarding a complaint by the complainant. Consequently, as to the complaint the complainant filed with the challenged Municipality on 13 January 2026, it is reaffirmed that the request was submitted after this amparo application was filed. Any claim concerning that complaint is therefore premature. Accordingly, on this point, the amparo application against the Municipality of Quepos is denied.\n\nHowever, despite the actions taken by the challenged Municipality, this Court does find an omission by that Municipal Corporation with respect to its obligations. It has been duly established that, even before the complainant submitted a formal administrative request, the challenged Municipality had already activated inspection mechanisms, interinstitutional coordination, and a complaint to the competent authorities. There is therefore currently an initiative by the Municipality of Quepos and SINAC to collaborate interinstitutionally on construction of a treatment plant in the area identified. For this reason, they invited the Instituto Costarricense de Acueductos y Alcantarillados, the lead institution on this matter, which has the capacity to conduct technical studies on the feasibility of building the plant and determine the most suitable site, taking into account that the area is environmentally fragile and has particular topographical and soil composition characteristics that must be considered. Thus, although the corresponding complaint had not been filed before this amparo application, the fact remains that the Municipality of Quepos knew of the possible need to build a treatment plant in the area before any complaint was filed. In this regard, it bears repeating what was stated in the preceding section: “the Constitutional Court has heard applications in which a violation of the right to a healthy and ecologically balanced environment was established without the need for a prior complaint, under two exceptions: 1) where the case is of great magnitude; and 2) where the record shows that the competent authorities knew of the alleged situation, which is threatening or causing environmental harm, and took no action in response.” Thus, it is clear that the Municipality knew of the possible need to build a treatment plant in the area before any complaint was filed. In this regard, the complainant alleges that “the urgent need for a treatment plant performing all its functions has become apparent, since bad septic-like odors can be perceived at various points, for example, at Playa Espadilla and Parque Manuel Antonio (…) environmentalists in the area have discussed the situation at the Quepos Council; however, the administration has not treated the environmental problem as a priority.” The challenged Municipality does not deny that situation or deny that it knew of what was described. In its report under oath, however, it merely states that “(…) the complainant is not telling the truth in stating that there is money earmarked for construction of a plant that has not been used because of a lack of interest by the local government, or that the land is municipally owned. What is true is that the Municipality and SINAC have an initiative to collaborate interinstitutionally on construction of a treatment plant. For that reason, they have invited the lead institution on this matter, AyA, which has the capacity to conduct technical studies on the feasibility of building the plant and determine the most suitable site, taking into account that we are in an environmentally fragile area with particular topographical and soil composition characteristics that must be considered (…) In this case, the complainant has not established that the Municipality of Quepos acted unlawfully, arbitrarily, or negligently by omission. On the contrary, it has been duly established that, even before the complainant submitted a formal administrative request, the Municipality had already activated inspection mechanisms, interinstitutional coordination, and a complaint to the competent authorities. This representative respectfully submits that an amparo proceeding is not appropriate where the Administration is acting with a reasonable degree of diligence, even if the definitive solution to the reported problem is complex or requires progressive, long-term action (…) The municipal filing itself shows that the project’s technical, environmental, and territorial feasibility remains under review, which is entirely reasonable and constitutionally valid.”\n\nIn other words, the Municipality itself acknowledges that the reported problem requires a solution. However, there is no record that the Municipality of Quepos has determined whether it is necessary to build a treatment plant at Playa Manuel Antonio. This reveals an omission by the Municipality with respect to its obligations. It should also be noted that, after learning of the situation through the amparo, the challenged Municipality took the following actions: “conducted an on-site inspection on 14 January 2026 (…) • Coordinated the inspection with several municipal departments and the Ministry of Health, the lead authority on environmental sanitation. • Filed a formal complaint with the Ministry of Health after apparent irregularities were detected, demonstrating an active willingness to remedy them. • Took follow-up action to overcome the technical limitations identified by the Ministry of Health. • Promoted an interinstitutional working meeting with AyA, the institution competent to conduct technical studies and design and potentially execute a treatment plant.” In other words, although it is confirmed that the Municipality knew of the possible need for a treatment plant at Playa Manuel Antonio, to date it has only promoted an interinstitutional working meeting and has not resolved the underlying issue.\n\nIn this regard, it is important to recall what was stated in judgment No. 2026-026822, issued at 09:25 on 17 July 2026, which included the following: “It must be borne in mind that the Municipality of Limón, as administrator of local interests and services (Article 169 of the Political Constitution), and the authority before which the complaint of 17 July 2025 was filed, cannot disregard the problems raised. It must act as the coordinator of the Administration’s coordinated intervention, since, as has been seen, a definitive solution requires combined efforts and action by various departments. In judgment No. 2020-010630, issued at 09:15 on 12 June 2020, this Constitutional Chamber (Sala Constitucional) explained: ‘(…) MUNICIPAL AUTHORITY AND DUTY OF INTERINSTITUTIONAL COORDINATION. Municipal authority and duty of interinstitutional coordination. Article 169 of the Political Constitution provides that “The administration of local interests and services in each canton shall be the responsibility of the Municipal Government (…)”. The ordinary legislature has developed this provision. Accordingly, Article 3 of the Municipal Code, Law No. 7794 of 30 April 1998, provides: “The government and administration of cantonal interests and services shall be the responsibility of the municipal government.” The Constitutional Chamber has likewise expressed this view in its case law. For example, in Judgment No. 5445-99, issued at 14:30 on 14 July 1999, it held as follows: “VI.- MUNICIPAL POWERS BY SUBJECT MATTER (THE CONCEPT OF ‘LOCAL MATTERS’). The Constitution expressly assigns functions or powers to local governments, by subject matter, in relation to ‘local matters’, namely, the ‘administration of the services and interests’ of the locality within their jurisdiction, for which they are granted autonomy. (…) Their powers are therefore general, because their specific responsibilities are not set out in detail; rather, their area of authority is simply stated. That does not mean, however, that it cannot be determined. This Court addressed the matter in Judgment No. 6469-97, issued at 16:20 on 8 October 1997, as follows: ‘(…) “local matters” has such significance that their scope, as defined by the legislature or the judge, must preserve the integrity of local interests and services. The legislature could not even enact rules that tend to dismember the Municipality (the territorial element) without following the procedures established in the Political Constitution; nor could it enact rules that place its inhabitants (the population) in clearly inferior conditions compared with the rest of the country; nor rules that affect the very essence of local matters (government), reducing the Municipal Corporation to a mere empty shell, with only its name remaining while the entire system as conceived by the National Constituent Assembly is disabled. Put another way, there are responsibilities that are municipal—local—by their nature and cannot be removed from that sphere of authority and converted into national services or interests, because doing so would disarticulate the Municipality, or, better yet, deprive it of its constitutional substance. It is therefore impossible to define in advance the inviolable limits of local matters. To determine what falls within the authority of the communal government in each case, the specific circumstances must be examined (…)’. It follows that, by express choice in our Fundamental Charter, local governments are assigned specific powers that are also exclusive to them; that is, these are powers originating in the Municipality and may be displaced, in whole or in part, only by a law that nationalizes or regionalizes them.” Consequently, if a group of residents in their territorial jurisdiction suffer flooding that threatens their lives and causes serious harm to property, psychological well-being, quality of life, and general welfare, this falls within the concept of ‘local interests and services’ in constitutional Article 169. The causes of such problems must be precisely identified and, even more importantly, solutions must be found so they can be implemented as soon as possible. To that end, the Municipality must coordinate with national-level institutions that have authority to address the problem. The Chamber has indeed developed the municipal duty to coordinate with other State institutions to attend to ‘interests’ and duly provide ‘local services’. In the cited Judgment No. 5445-99, the Chamber stated: ‘(…) this concerns the duty of coordination among local governments, decentralized institutions, and the Executive Branch in carrying out their assigned functions, which must be analyzed in light of the nature of municipal autonomy. Under constitutional Article 170, municipalities (local corporate entities) have functional, administrative, and financial autonomy in administering local interests and services (Article 169 of the Political Constitution) (…) A conflict cannot therefore be created through antagonism or rivalry between matters that form part of the general purpose of “local interests and services” and “national” or “State” public interests and services. They are intrinsically distinct, but in reality are meant to coexist (…) Once the Municipality’s authority by subject matter within a specified territorial jurisdiction has been defined, it is clear that some responsibilities are municipal in nature and exclusive to the Municipality, while others may be regarded as national or State responsibilities. It is therefore essential to define how powers that must inevitably be shared will be exercised, since municipalities have public authority at the local level, while the State and other entities have it at the national level. Municipal territory is thus simultaneously State and institutional territory, as circumstances require. In other words, municipalities may share their powers with the Public Administration generally, and that relationship must operate on the terms established by law (Article 5 of the former Municipal Code, Article 7 of the new Code), which provides for a duty of “coordination” between municipalities and public institutions that jointly exercise their powers, to avoid duplicating efforts and creating contradictions. This is especially so because only voluntary coordination is compatible with municipal autonomy, as an expression of that autonomy. In other words, a municipality is called upon to cooperate with other public entities, and vice versa, because in many cases their interests concerning a specific matter are concurrent or overlapping. In legal scholarship, coordination is defined by reference to the existence of several independent centers of action, each with its own responsibilities and decision-making powers, which may differ. Despite this, there must be a shared purpose within a given subject area, through the concurrence of activities directed toward the same object and the final results of the acts of each center.” Coordination therefore means organizing the relationships among these various independent activities, accounting for their concurrence in the same object or entity so they can contribute to a global public plan, without eliminating the agents’ reciprocal independence. Since there is no hierarchical relationship between decentralized institutions, or between the State itself and municipalities, the imposition of specific conduct on municipalities is not possible. This gives rise to the indispensable interinstitutional “agreement” in the strict sense: autonomous and independent centers of action agree on a preventive, overall framework in which each fulfills a role in a mission entrusted to the others.” It should also be noted that Municipalities are bound, by virtue of constitutional Article 50, to devote themselves to environmental protection (Judgment No. 2006-7994, issued at 8:57 on 2 June 2006) (…)’” (sic) (reiterated in Judgment No. 2026-05217, issued at 09:34 on 13 February 2026) (emphasis not in the original).\n\nAccordingly, the challenged Municipality has a duty to coordinate in seeking a solution to whether a treatment plant needs to be built. The Municipality knew of the possible need to build a treatment plant at Playa Manuel Antonio, but to date it has only promoted an interinstitutional working meeting and has not resolved the underlying issue. Therefore, given the absence of a solution to a problem that may affect the environment and the cantonal residents’ right to a healthy and balanced environment, an omission by the Municipal Corporation, and thus a violation of fundamental rights, is apparent. The amparo is granted solely on this point and against the Municipality of Quepos.\n\nVI.- Regarding the actions of the Sistema Nacional de Áreas de Conservación of MINAE. It is established that, in October 2025, an earthquake affected the internal infrastructure of the treatment system at Parque Nacional Manuel Antonio, prompting SINAC to activate institutional emergency mechanisms, including declaration of a national emergency. Coordination with the Quepos Health Area also led to health order No. MS-DRRSPC-DARSQ-OS-0328-2025, issued on 07 November 2025. The Park Administration continues working to comply with the health order, and the construction project for the wastewater treatment system at the staff house and the specified restroom blocks in the National Park was reviewed on the APC platform, with the Ministry of Health recording the result as “correction accepted.” However, this situation has no causal connection to the matter raised by the complainant in this amparo application. From a technical and material standpoint, these internal facilities are 1.2 kilometers from the main entrance and the creek mentioned. Contamination from these systems reaching the reported area is therefore unlikely. In addition, both systems had independent drainage systems and no effluent was directed to those bodies of water.\n\nAfter the filing of this amparo application, on 13 January 2026, the applicant filed a complaint with MINAE’s National System of Conservation Areas regarding the situation described in this amparo application. The complaint was registered in the SITADA system under number 59948-2026. On 19 January 2026, MINAE’s National System of Conservation Areas conducted a field inspection at the location identified by the applicant. The technical evidence submitted by the Manuel Antonio National Park Administration shows that the reported events did not originate within the protected area, but in areas outside it, and that the mentioned streams enter the park only in their final stretch. Accordingly, any possible pollution originates upstream, outside SINAC’s jurisdiction. The report also states in inspection record No. 3765 that “the La Camaronera stream can be seen emitting an unpleasant odor, but the cause of the bad smell cannot be seen; walking along the edge of the stream, we reached a point where we identified two drainage pipes discharging wastewater into the stream. Photographs and GPS points were recorded, and the complaint was referred to the Ministry of Health, as that is the authority responsible for these matters.” Thus, the inspection detected indications of harm, but its source could not be established with certainty. Accordingly, on 21 January 2026, the case was referred to the Ministry of Health for action within its authority. On 22 June 2026, before the resolution expanding the proceedings to that institution was notified, SINAC informed the applicant of the actions taken regarding the complaint by means of Official Letter CARTA-SINAC-ACOPAC-DR-DRFVS-OSRAP-0154-2026. Finally, the Quepos Health Area, in coordination with MINAE’s National System of Conservation Areas, has conducted technical checks at Playa Nacional Manuel Antonio using fluorescein tests and assessments. These have ruled out the Park’s treatment systems as a source of pollution and confirmed that they are operating properly. The Park’s treatment systems and the treatment plant at the main entrance discharge into drainage systems, which have been shown to be fully functional and not to be affecting this watercourse. Staff at Playa Nacional Manuel Antonio conduct regular patrols in the sectors mentioned. During these monitoring patrols, they confirm that the watercourse enters the Park, but have found no evidence of discharges or irregular inflows from neighboring properties.\n\nIn this regard, it is established that MINAE’s National System of Conservation Areas processed the complaint filed by the applicant—which, it bears repeating, was filed after this amparo proceeding was initiated—by conducting an inspection, referring the complaint to the Ministry of Health, and notifying the applicant about it. It has also coordinated with the Quepos Health Area. Thus, it bears repeating that together they conducted technical checks at Playa Nacional Manuel Antonio using fluorescein tests and assessments. These ruled out the Park’s treatment systems as a source of pollution and confirmed that they are operating properly. The Park’s treatment systems and the treatment plant at the main entrance discharge into drainage systems, which have been shown to be fully functional and not to be affecting this watercourse. Finally, it also bears repeating that staff at Playa Nacional Manuel Antonio conduct regular patrols in the sectors mentioned. During these monitoring patrols, they confirm that the watercourse enters the Park, but have found no evidence of discharges or irregular inflows from neighboring properties.\n\nAccordingly, it is clear that the National System of Conservation Areas has acted within its authority and processed the applicant’s complaint. In any event, it is reaffirmed that the complaint was filed after this amparo application was submitted, and therefore any claim concerning that complaint is premature.\n\nAccordingly, as to SINAC, no violation of the applicant’s fundamental rights is found.\n\nVII.— Regarding the actions of the Costa Rican Institute of Aqueducts and Sewers. On 14 January 2026, in response to the complaint the applicant filed on 13 January 2026 with the Quepos Municipality and the Quepos Health Area, the respondent Municipality and respondent Health Area conducted an inspection of the site to establish the prevailing sanitary conditions. Since there is no collective sanitary sewer system, the regulations in force require wastewater to be treated through appropriate individual systems. For residences, this means using septic tanks; commercial establishments such as hotels, restaurants, and others that generate special-category wastewater must have specific treatment systems—including treatment plants—duly approved, supervised, and monitored by the Ministry of Health and the relevant Municipality. The inspection confirmed the presence of untreated wastewater discharges into the beach and sea near Manuel Antonio National Park. This establishes that, in response to complaints from local residents, the Ministry of Health itself has had to intervene in situations that show deficiencies in wastewater management. Furthermore, according to inspection records Nos. MS-DRRSPC-DARSQ-AI-084-2026, MS-DRRSPC-DARSQ-AI-085-2026, and MS-DRRSPC-DARSQ-AI-086-202, on 05 February 2026, the Quepos Health Area inspected the 3 sites identified by the applicant and did not confirm the bad odors described. Subsequently, the Quepos Municipality promoted the formation of an interinstitutional working group, including the Costa Rican Institute of Aqueducts and Sewers and other strategic actors with the potential to contribute technically and financially to resolving the wastewater problem, such as the National System of Conservation Areas (SINAC) and the Rural Development Institute (INDER). In March 2026, as a result of the foregoing coordination, the institutions involved conducted a joint technical visit to the Manuel Antonio area to assess the feasibility of developing an integrated sanitation project. In that process, the Quepos Municipality, SINAC, and INDER agreed on the need to promote the development and eventual construction of a sanitary sewer system (AS) and a wastewater treatment plant (PTAR) as a structural solution to the problem. INDER has therefore expressed its willingness to contribute approximately three billion colones (US$ 6,2 million), without prejudice to the Costa Rican Institute of Aqueducts and Sewers, as the specialized technical body, conducting the relevant assessments to determine the most suitable solution from a technical, economic, and environmental standpoint. Accordingly, if it is determined that a project must be developed for the Manuel Antonio, Quepos area, it must comply with all phases established under the technical standards, guidelines, and procedures set by the Ministry of National Planning and Economic Policy (MIDEPLAN), given the substantial investment involved; for that reason, it is viewed as a long-term solution. Within the framework of the interinstitutional working group, one option identified to accelerate implementation of a potential project is to enter into a cooperation agreement among AyA, SINAC, the Quepos Municipality, and INDER. Under that agreement, AyA would provide the technical designs, INDER would undertake the tendering and execution of the works, and, once completed, the assets would be transferred to AyA for operation. Any intervention must include high-technology solutions—particularly for the PTAR—that allow for comprehensive treatment of pollutants, taking into account the environmental sensitivity of the coastal area and the protected area. In addition, as a preliminary recommendation, a separate sanitation project should be developed for the Manuel Antonio area, without adding flow to the existing Quepos project, to ensure a technically appropriate solution. Finally, the project’s funding structure must be clearly defined, given that INDER’s announced contribution may be insufficient to cover all the required works; complementary alternatives must therefore be explored, including the possibility of multi-year financing arrangements, in accordance with the applicable regulations. Finally, it was not established that, as of the date in question, the applicant had filed a complaint with the Costa Rican Institute of Aqueducts and Sewers regarding the situation described in the filing.\n\nIt is therefore clear that the Costa Rican Institute of Aqueducts and Sewers has received no complaint from the applicant regarding the situation described in this amparo application, so no omission by that institution can be established.\n\nThe Costa Rican Institute of Aqueducts and Sewers is currently coordinating with the Quepos Municipality, SINAC, and INDER to develop an integrated sanitation project. These institutions have agreed on the need to promote the development and eventual construction of a sanitary sewer system (AS) and a wastewater treatment plant (PTAR). Accordingly, if it is determined that a project must be developed for the Manuel Antonio, Quepos area, it must comply with all phases established under the technical standards, guidelines, and procedures set by the Ministry of National Planning and Economic Policy (MIDEPLAN), given the substantial investment involved; for that reason, it is viewed as a long-term solution. Within the framework of the interinstitutional working group, one option identified to accelerate implementation of a potential project is to enter into a cooperation agreement among AyA, SINAC, the Quepos Municipality, and INDER. Under that agreement, AyA would provide the technical designs, INDER would undertake the tendering and execution of the works, and, once completed, the assets would be transferred to AyA for operation. Accordingly, these institutions are currently coordinating the relevant matters, including a potential project involving a cooperation agreement among AyA, SINAC, the Quepos Municipality, and INDER. Thus, although there is no collective sanitary sewer system at Playa Manuel Antonio, according to the sworn statement of the representative of the Costa Rican Institute of Aqueducts and Sewers, the regulations in force require wastewater to be treated through appropriate individual systems. As shown in the preceding reasons, the Quepos Health Area has addressed this by intervening in situations that show deficiencies in wastewater management, conducting the required inspections, issuing the corresponding sanitary orders, and ensuring compliance with them.\n\nIn any event, as to the actions of ICAA, it bears repeating that no sanitation project has currently been approved, nor has construction of a sewer system and treatment plant been approved. The matter remains at the coordination stage, where it is currently technically impossible to determine the amounts or funding routes for a project for which construction plans have not been defined and whose technical feasibility has not even been established. As stated above, there is therefore no certainty regarding the location of a possible treatment plant specifically for this sector, since determining that is a matter of highly technical criteria currently being coordinated by the aforementioned interinstitutional working group. Accordingly, it exceeds this Court’s authority to order the eventual construction of a project that has not been approved, remains under consideration of technical criteria, has not yet been found technically feasible, and is at an initial stage. Moreover, these coordination efforts within the interinstitutional working group have been underway since this year; there is no indication of unjustified delay or that an unreasonable period has elapsed on the part of ICAA. A violation of the applicant’s fundamental rights on that basis is therefore also ruled out.\n\nAccordingly, as to ICAA, no violation of the applicant’s fundamental rights is found.\n\nVIII.— Conclusion. As stated in Reason V, the Quepos Municipality has violated the applicant’s fundamental rights by failing to resolve whether a treatment plant needs to be built at Playa Manuel Antonio. Accordingly, the amparo application is granted in part, solely with respect to the matter identified concerning the Quepos Municipality.\n\nAs to all other matters, the application must be dismissed in its entirety. The respondent authorities are reminded that they must continue processing the complaints filed by the applicant and address and resolve them within a reasonable period. The Ministry of Health, SINAC, and ICAA are also reminded of their duty to continue coordinating with the Quepos Municipality to develop, within a reasonable period, an integrated sanitation project or to build a sewer system and treatment plant at the location identified in the complaint, in accordance with the applicable technical criteria.
