LA SALA DETERMINA QUE EXISTEN LIMITACIONES TÉCNICAS Y DE\nINFRAESTRUCTURA QUE IMPIDEN LA PRESTACIÓN DEL SERVICIO, CONSIDERA DEBIDAMENTE\nMOTIVADA LA DECISIÓN DEL ICAA Y DECLARA SIN LUGAR EL AMPARO. NQC08/2026\n\n(…) IV.- Sobre el caso concreto.\nDel informe rendido por las autoridades recurridas del ICAA, dado bajo la\nsolemnidad del juramento, con oportuno apercibimiento de las consecuencias\nprevistas en el artículo 44 de la Ley de la Jurisdicción Constitucional, así\ncomo de la documentación aportada para la resolución de este amparo, se\nacredita que el 07 de noviembre de 2025, mediante correo electrónico, la\nOficina Cantonal de Tilarán notificó al recurrente el documento\nSIGDD-2025-00103545-1-2-NAP para el inmueble del plano catastro G-1444029-2010,\nen el cual se le informaba que para el sistema de agua potable la capacidad\nhidráulica era insuficiente por falta de infraestructura frente a la propiedad.\nAsimismo, el 17 de noviembre de 2025 se le remitió por la misma vía la copia\ndel oficio GSP-RCHO-2025-01879 y recalcó que ya iba adjunto a la disponibilidad\nnotificada anteriormente. \n\nEn cuanto a los impedimentos para\nbrindarle el servicio de agua potable, las representantes del ICAA exponen lo\nsiguiente: De acuerdo con el informe GSP-RCHO-2025-01879, el ICAA emite\ncriterio técnico e indica que el sistema CH-A-22-Tilarán, se encuentra en\ncategoría III y por consiguiente presenta un desfase del -5% < Déficit /\nSuperávit < 10%; además de una limitación en la capacidad de almacenamiento\nde -83,6%, un aumento considerable en las solicitudes de disponibilidades, por\nlo que conforme a la normativa del Reglamento de Prestación de Servicios se\nrecomienda aprobar un único servicio vivienda unifamiliar en inmuebles que no\ncuenten con ningún servicio instalado y que exista infraestructura frente a la\npropiedad, limitar la aprobación de extensiones de ramales, disponibilidad de\nagua potable para fraccionamientos simples, disponibilidad de agua potable para\nfraccionamientos excepcionales para uso residencial, desarrollos urbanísticos u\notras actividades que aumenten la demanda al área de cobertura del sistema,\nhasta tanto se logren gestionar acciones concretas para salir de la zona\ndeficitaria.\n\nAhora bien, la Sala ha determinado\nque no constituye una lesión a los derechos de una persona que se niegue el\nservicio de agua potable cuando existen impedimentos técnicos que lo\njustifiquen:\n\n“II.-Sobre el caso concreto.\nEntre la prueba aportada, se aprecia una certificación de no disponibilidad de\nagua del 15 de julio de 2021, mediante la que el AyA le notificó al accionante\nel rechazo de su solicitud de disponibilidad de agua potable para la\nindividualización de servicios para un apartamento ubicado en el inmueble de su\npropiedad. La denegatoria se sustentó en la falta de factibilidad técnica\ndebido a la insuficiencia de capacidad hídrica e hidráulica en el sistema de\nabastecimiento de la zona, por lo que no se tiene disponibilidad del servicio\nde agua potable para nuevos proyectos de desarrollo.\n\nAsí las cosas, se acredita que el\nsub lite no versa sobre una denegatoria arbitraria del servicio de agua\npotable, pues esta se fundamentó en la falta de factibilidad técnica. En esta\nlínea, adviértase que este Tribunal Constitucional no es un contralor de la\nlegalidad de las actuaciones o resoluciones de la autoridad recurrida y tampoco\npuede reemplazar a la Administración activa en la gestión de sus competencias,\nde modo que no le corresponde usurpar las atribuciones que le han sido\nlegalmente conferidas a otras dependencias, órganos o entes, como el AyA.\nTampoco este Tribunal funge como mediador ante una determinada persona física o\njurídica -ya sea de derecho público o privado-, para interceder a fin de que se\nle conceda lo que la parte recurrente pretende, en este caso, que se le instale\nun nuevo medidor para el apartamento que construyó para su hija. Ahora bien, si\nlo que ocurre es que el recurrente está inconforme con las razones que\njustificaron la denegatoria del nuevo medidor por parte del AyA, deberá\nplantear sus agravios y pretensiones ante la vía ordinaria de legalidad, para\nque allí se determine lo que en derecho corresponde”. (Sentencia nro.\n2021018977 de las 11:50 horas de 24 de agosto de 2021).\n\nEntretanto, en el sub lite la Sala no\nobserva motivos para cambiar el criterio transcrito. En efecto, no se estima\nque la denegatoria sea irrazonable ni antojadiza cuando se basa en una\njustificación técnica como es, en este caso, la deficiente capacidad hidráulica\ndel acueducto. La discusión del tema de fondo puede ser planteada en la vía de\nlegalidad\n\nSe reitera que, en supuestos por\nel presente, esta Sala ha considerado que, si bien, existe un derecho\nfundamental al agua potable, su ejercicio no es indiscriminado, de forma que\nexista una obligación de los entes que prestan ese servicio de brindarlo en\ncualquier condición y oportunidad. En concreto, esta Sala ha reconocido que el\nICAA, las municipalidades o bien las asociaciones administradoras de acueductos\ny alcantarillados pueden denegar la disponibilidad de agua potable si existen\nrazones técnicas que así lo justifiquen. Supuesto que acontece en autos, pues\nlas autoridades recurridas del ICAA son claras en exponer los impedimentos\ntécnicos que subsisten e impiden su prestación.\n\nEn el caso concreto, no se\nacreditó actuación omisiva, negligente o arbitraria por parte del instituto\nrecurrido. Por el contrario, se demostró que se ajustó al ordenamiento jurídico\ny a los límites técnicos que condicionan la prestación del servicio público de\nagua potable. La denegatoria del servicio, entonces, obedece a una causa\nobjetiva y razonable derivada de la falta de factibilidad técnica, lo cual\nexcluye cualquier violación a los derechos invocados por el recurrente.\n\nPor lo demás, en cuanto al\ncriterio de ingeniería GSP-RCHO-2025-01879, fundamento técnico de la\ndenegatoria, que en forma residual acusa que se le negado, se tiene que\nconstituye un agravio rechazado por las recurridas. Contrariamente a lo\nreclamado por el recurrente, informan que el 17 de noviembre de 2025 se le\nremitió por correo nuevamente la copia de tal documento y se le recalcó que ya\niba adjunto a la disponibilidad notificada el 07 del mismo mes y año. En ese\ncontexto, no habiendo prueba en contrario, se tiene que no lleva razón el\ntutelado en el reclamo de la referida documentación, pues le fue enviada por el\nICCA hace más de ocho meses.\n\nV.- Conclusión. Es claro que en\nel caso del ICAA existe una imposibilidad técnica y/o material, es decir, no se\ncumplen parámetros objetivos idóneos para la prestación del servicio de agua\npotable. Bajo este orden de circunstancias el recurso de amparo deviene\nimprocedente en todos sus extremos y así debe declararse. (…)",
  "body_en_text": "2026029841. PUBLIC SERVICES. THE DENIAL OF WATER SERVICE AVAILABILITY FOR A DWELLING IN TILARÁN IS CHALLENGED. THE CHAMBER DETERMINES THAT TECHNICAL AND INFRASTRUCTURE LIMITATIONS PREVENT THE SERVICE FROM BEING PROVIDED, FINDS THE ICAA’S DECISION TO BE DULY REASONED, AND DECLARES THE AMPARO WITHOUT MERIT. NQC08/2026\n\n(…) IV.—The specific case.\n\nThe report submitted by the respondent authorities of the ICAA, under oath and with due warning of the consequences set out in Article 44 of the Ley de la Jurisdicción Constitucional, together with the documentation submitted for resolution of this amparo, establishes that on 07 November 2025, by email, the Tilarán Cantonal Office notified the applicant of document SIGDD-2025-00103545-1-2-NAP for the property on cadastral plan G-1444029-2010. The document advised that the potable water system had insufficient hydraulic capacity because there was no infrastructure in front of the property. Likewise, on 17 November 2025, a copy of official letter GSP-RCHO-2025-01879 was sent to the applicant by the same means, and it was reiterated that this had already been attached to the availability notice sent earlier.\n\nAs to the obstacles to providing potable water service, the ICAA representatives state as follows: According to report GSP-RCHO-2025-01879, the ICAA issues a technical opinion indicating that system CH-A-22-Tilarán is in Category III and consequently has a variance of -5% < Deficit / Surplus < 10%, as well as a storage capacity limitation of -83,6% and a considerable increase in availability requests. Therefore, under the regulations of the Reglamento de Prestación de Servicios, approval is recommended for only one service for a single-family dwelling on properties with no service installed, provided infrastructure exists in front of the property. Approval of branch-line extensions, potable water availability for simple subdivisions (fraccionamientos simples), potable water availability for exceptional subdivisions for residential use, urban developments, or other activities that increase demand in the system’s coverage area is to be limited until concrete measures can be implemented to move out of the deficit zone.\n\nThe Chamber has determined that denying potable water service when justified by technical obstacles does not constitute an infringement of a person’s rights:\n\n“II.—The specific case.\n\nAmong the evidence submitted, there is a certificate of water unavailability dated 15 July 2021, by which AyA notified the applicant that it had rejected his request for potable water availability to establish separate services for an apartment located on his property. The denial was based on the lack of technical feasibility because of insufficient water and hydraulic capacity in the area’s supply system; accordingly, potable water service was unavailable for new development projects.\n\nAccordingly, it is established that the matter before the Court does not concern an arbitrary denial of potable water service, since the denial was based on a lack of technical feasibility. In this regard, note that this Constitutional Court is not a reviewer of the legality of the actions or decisions of the respondent authority, nor may it replace the active Administration in the exercise of its powers. It therefore may not usurp the powers legally conferred on other offices, bodies, or entities, such as AyA. Nor does this Court act as a mediator with a particular natural or legal person—whether governed by public or private law—to intercede so that the applicant may obtain what he seeks: in this case, installation of a new meter for the apartment he built for his daughter. If, however, the applicant disagrees with the reasons that justified AyA’s denial of the new meter, he must present his grievances and claims through the ordinary legality process, where the matter will be determined as the law requires.” (Judgment No. 2021018977, at 11:50 on 24 August 2021.)\n\nMeanwhile, in the matter before the Court, the Chamber sees no reason to depart from the quoted criterion. Indeed, the denial is not considered unreasonable or arbitrary when it is based on technical grounds, in this case the inadequate hydraulic capacity of the aqueduct. The underlying issue may be raised through the legality process.\n\nIt is reiterated that, in cases such as this, the Chamber has held that although there is a fundamental right to potable water, its exercise is not unrestricted, such that entities providing that service are not required to provide it under every condition and on every occasion. Specifically, the Chamber has recognized that the ICAA, municipalities, or associations administering aqueduct and sewer systems may deny potable water availability when technical reasons justify doing so. That is the situation here, since the respondent authorities of the ICAA clearly describe the technical obstacles that remain and prevent the service from being provided.\n\nIn this specific case, no omission, negligence, or arbitrary conduct by the respondent institute was established. On the contrary, it was shown to have acted in accordance with the legal system and the technical limits governing provision of the public potable water service. The denial of service therefore stems from an objective and reasonable cause arising from the lack of technical feasibility, which rules out any violation of the rights invoked by the applicant.\n\nFurthermore, as to engineering opinion GSP-RCHO-2025-01879, the technical basis for the denial, which he alleges in the alternative was withheld from him, this is a grievance rejected by the respondents. Contrary to the applicant’s claim, they report that a copy of the document was sent to him again by email on 17 November 2025, and they reiterated that it had already been attached to the availability notice sent on the 07th of the same month and year. In that context, absent evidence to the contrary, the applicant’s claim regarding that document is unfounded, since it was sent to him by the ICAA more than eight months ago.\n\nV.—Conclusion. It is clear that, in the case of the ICAA, a technical and/or material impossibility exists; that is, the objective parameters suitable for providing potable water service are not met. In these circumstances, the amparo proceeding is inadmissible in all respects, and it must be so declared. (…)"
