De la relación de los artículos 21 y 50 de la\nConstitución Política, se desprenden el derecho de las personas a la vida, la\nsalud y a un ambiente sano y ecológicamente equilibrado, los cuales se encuentran\níntimamente ligados, toda vez, que la vida como valor supremo de la\nConstitución Política, implica una especial protección, pues sin vida, poca\nutilidad tendría la protección de los demás derechos fundamentales. Así las\ncosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto\nfísico, mental y de entorno, y es precisamente ahí donde surge la importancia\nen proteger el ambiente y los recursos naturales, a fin de procurar el\nbienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se\nlogra, a través de la protección y conservación de la calidad y cantidad de los\nrecursos hídricos, para que ésta sea potable para el consumo humano y de esta\nforma proteger la salud de las personas, ya que, al tratarse de un recurso\nnecesario para la higiene, alimento y bebida, su contaminación puede producir\ngraves perjuicios en la salud pública. En ese sentido, la protección y\nconservación a la que se hace referencia debe ser brindada por el Estado, a\ntravés de los órganos que designe al efecto, los cuales deberán adoptar las\nmedidas necesarias para garantizar el acceso de ese recurso a todas las\npersonas, así como velar por el cumplimiento de éstas. From the relationship between Articles 21 and 50 of the\nPolitical Constitution arise people’s rights to life, health, and a healthy and\necologically balanced environment, which are closely linked, since life, as the\nsupreme value of the Political Constitution, entails special protection;\nwithout life, protection of the other fundamental rights would have little\npurpose. Accordingly, life must be protected in all its aspects: physical,\nmental, and environmental. It is precisely here that the importance of\nprotecting the environment and natural resources arises, in order to promote\npeople’s well-being. Among other things, that well-being is achieved by\nprotecting and preserving the quality and quantity of water resources so that\nthe water is potable for human consumption, thereby protecting people’s\nhealth. Because water is a resource necessary for hygiene, food, and drink, its\ncontamination can cause serious harm to public health. In this regard, the\nState must provide the protection and preservation referred to, through the\nbodies it designates for that purpose. Those bodies must adopt the measures\nnecessary to guarantee everyone access to this resource and ensure compliance\nwith those measures. In this vein, the right to water arises, and this\nConstitutional Court may protect it through an amparo proceeding (judgment No.\n2007-005482 of 14:39 on 24 April 2007, reiterated in judgment No.\n2021-005089 of 09:15 on 12 March 2021 and judgment No. 2025-002839 of 09:20\non 31 January 2025).
