  "body_es_text": "ARTÍCULO 21 Y 50 DE LA CONSTITUCIÓN POLÍTICA. \n\n(…)\nIV.- Sobre el derecho a la salud y a un ambiente sano y ecológicamente\nequilibrado. El artículo 21, de la Constitución Política, reconoce la\ninviolabilidad de la vida humana, disposición de la cual esta Sala ha derivado\nel derecho fundamental a la salud. Por su parte, el artículo 50,\nConstitucional, reconoce el derecho de toda persona a disfrutar de un ambiente\nsano y ecológicamente equilibrado e impone al Estado el deber de garantizarlo,\ndefenderlo y preservarlo. La protección constitucional del ambiente comprende\nno solo la conservación de los recursos naturales, sino también el derecho de\nlas personas a desarrollar su vida en condiciones de salubridad, libres de\ncontaminación, malos olores, acumulaciones de aguas residuales y otras fuentes\nde riesgo que puedan afectar su integridad o su salud.\n\nEn\nesta materia, las autoridades públicas deben actuar conforme a los principios\npreventivo y precautorio. No es indispensable esperar que se produzca una\nenfermedad o un daño irreversible para intervenir, pues basta la existencia de\nun riesgo comprobable para la salud o el ambiente para que surja el deber de\nadoptar medidas oportunas y eficaces.\n\nLa\nSala ha reiterado que las municipalidades y las autoridades rectoras en salud\ndeben ejercer, dentro de sus respectivas competencias, las potestades de\ninspección, mantenimiento de la infraestructura pública, emisión y ejecución de\nórdenes sanitarias y coordinación interinstitucional necesarias para resolver\nlos problemas derivados de la disposición inadecuada de aguas residuales. Así\nse desprende, entre otros, de los antecedentes jurisprudenciales N°\n2019-011274, N° 2019-022487, N° 2024-002523 y N° 2025-006950. Esta última\nresolución reiteró que el manejo inadecuado de aguas residuales que afecta los\ncuerpos de agua o una comunidad puede constituir una lesión del derecho a un\nambiente sano y ecológicamente equilibrado. En esa oportunidad, textualmente se\nindicó lo siguiente:\n\n“…VII.-\nSOBRE EL FONDO. En el sub lite, la Sala estima que existen suficientes\nelementos de convicción para acoger el presente recurso de amparo. Como puede\napreciarse del elenco de hechos probados, ciertamente las autoridades\naccionadas han realizado algunas acciones tendentes a solucionar la\nproblemática aludida por la parte recurrente, en torno a la inadecuada\ndisposición de aguas residuales y negras en un cuerpo de agua que recorre el\nbarrio Veinte de Noviembre, en Puntarenas. Asimismo, se observa que los\nrecurridos aceptan que existen constantes conductas de los vecinos, quienes\nllevan residuos sólidos a la pista de aterrizaje de Chacarita, provocando una\ngrave contaminación en dicho lugar. Según lo indicado bajo juramento por el\nAlcalde de Puntarenas, en inspección realizada recientemente, el día 29 de\nenero de 2025, se comprobó que el problema de contaminación por residuos\nsólidos persiste en esta zona, por lo cual la Municipalidad de Puntarenas\ninició con la limpieza y recolección de los residuos sólidos acumulados en la\nzona de la pista de aterrizaje y áreas aledañas al canal pluvial a partir del\n30 de enero de 2025. Aclara que se coordinarán limpiezas periódicas con la\nmaquinaria municipal a partir del presente año 2025. Además, agrega que una\ngran mayoría de las construcciones ubicadas al sur del canal pluvial\nconstituyen invasiones del terreno propiedad de la Dirección General de\nAviación Civil. Existe un proyecto a futuro (2025-2030) para la construcción\ndel alcantarillado sanitario en la Gran Puntarenas, cuya fase inicial de diseño\nfue adjudicada por parte del AyA al consorcio IDOM-INNCIVE, el cual tiene como\nobjetivo principal resolver los problemas relacionados con el manejo y la\ndisposición de las aguas residuales de la población. Sin embargo, no se logra\nverificar que, a la fecha, se hayan tomado medidas provisionales para evitar\nque se continúe dando una situación de contaminación en la comunidad Veinte de\nNoviembre. La Sala aprecia, de la prueba fotográfica aportada al expediente,\nque en efecto muchas de las viviendas que están en esa localidad tienen\ntuberías que descargan en el estero o humedal que recorre dicha comunidad. Es\ndecir, sí hay una situación de contaminación grave pues se vierten aguas\nresiduales y negras en dicho cuerpo de agua, sin un adecuado tratamiento ni una\ndisposición final planificada. Los vecinos han generado un problema ambiental\nmuy grave que no ha sido atendido de manera diligente ni responsable por parte\nde las autoridades accionadas, especialmente la Municipalidad de Puntarenas.\nDebe recordarse que el municipio accionado es el encargado de velar por la\nprotección de los intereses locales, siendo por supuesto su deber desplegar una\nconducta de vigilancia constante en escenarios donde se esté provocando\ncontaminación ambiental de alto impacto, como la que se denuncia aquí. Es claro\nque estos ríos, humedales, esteros y demás cuerpos de agua que recorren el\ncantón de Puntarenas, desembocan finalmente en el océano Pacífico, donde\nafectan de manera importante los ecosistemas existentes en esa zona, generando\ndesequilibrio ambiental, afectación turística, problemas pesqueros, y en\ntérminos globales, una preocupante conducta pasiva que lesiona gravemente el\nordinal 50 de la Constitución Política. De ahí que este Tribunal esté llamado a\nintervenir en este nuevo caso, como lo ha hecho en varios pronunciamientos\nanteriores, con el objeto que la Municipalidad de Puntarenas se encargue de\nsancionar y corregir las conductas que producen contaminación directa en los\ncuerpos de agua de ese cantón, como lo es el presente caso…” (Sentencia N°\n2025-006950 de las nueve horas veinte minutos del siete de marzo de dos mil\nveinticinco).\n\nLa\ncompetencia de una autoridad no excluye la de la otra.   "body_en_text": "ARTICLES 21 AND 50 OF THE POLITICAL CONSTITUTION.\n\n(…)\n\nIV.- On the right to health and to a healthy and ecologically balanced environment. Article 21 of the Political Constitution recognizes the inviolability of human life, a provision from which this Chamber has derived the fundamental right to health. Article 50 of the Constitution, in turn, recognizes everyone’s right to enjoy a healthy and ecologically balanced environment and imposes on the State the duty to guarantee, defend, and preserve it. Constitutional environmental protection encompasses not only the conservation of natural resources, but also people’s right to live in sanitary conditions, free from pollution, foul odors, accumulations of wastewater, and other sources of risk that may affect their physical integrity or health.\n\nIn this area, public authorities must act in accordance with the preventive and precautionary principles. It is not necessary to wait for an illness or irreversible damage to occur before intervening, since the existence of a demonstrable risk to health or the environment is enough to trigger the duty to adopt timely and effective measures.\n\nThe Chamber has repeatedly held that municipalities and the health authorities must, within their respective areas of competence, exercise the powers of inspection, maintenance of public infrastructure, issuance and enforcement of health orders, and interinstitutional coordination needed to resolve problems arising from the improper disposal of wastewater. This follows, among other authorities, from precedents Nos. 2019-011274, 2019-022487, 2024-002523, and 2025-006950. The latter ruling reiterated that improper management of wastewater affecting bodies of water or a community may constitute a violation of the right to a healthy and ecologically balanced environment. On that occasion, it stated the following verbatim:\n\n“…VII.- ON THE MERITS. In this case, the Chamber considers that there is sufficient evidence to grant the present amparo application. As can be seen from the findings of fact, the respondent authorities have indeed taken certain steps to address the problem identified by the applicant concerning the improper disposal of wastewater and sewage into a body of water that runs through the Veinte de Noviembre neighborhood in Puntarenas. It is also apparent that the respondents acknowledge that residents repeatedly bring solid waste to the Chacarita landing strip, causing serious pollution there. According to the sworn statement of the Mayor of Puntarenas, a recent inspection on 29 January 2025 confirmed that the solid-waste pollution problem persists in this area. Accordingly, the Municipality of Puntarenas began cleaning up and collecting the solid waste accumulated in the landing-strip area and areas adjoining the stormwater channel on 30 January 2025. The Mayor clarified that periodic cleanups using municipal machinery would be coordinated beginning in the current year, 2025. The Mayor further stated that a large majority of the buildings located south of the stormwater channel encroach on land owned by the Dirección General de Aviación Civil. A future project (2025–2030) provides for construction of a sanitary sewer system in Greater Puntarenas. Its initial design phase was awarded by AyA to the IDOM-INNCIVE consortium, with the principal objective of resolving problems related to the management and disposal of the population’s wastewater. However, it has not been established that provisional measures have been taken to prevent pollution from continuing in the Veinte de Noviembre community. The Chamber notes from the photographic evidence submitted to the case file that many homes in that locality do indeed have pipes discharging into the estuary or wetland that runs through the community. In other words, serious pollution is occurring because wastewater and sewage are being discharged into that body of water without adequate treatment or planned final disposal. The residents have created a very serious environmental problem that the respondent authorities, especially the Municipality of Puntarenas, have not addressed diligently or responsibly. It should be recalled that the respondent municipality is responsible for safeguarding local interests and therefore has a duty to maintain constant oversight in situations where high-impact environmental pollution is occurring, such as that reported here. It is clear that these rivers, wetlands, estuaries, and other bodies of water running through the canton of Puntarenas ultimately flow into the Pacific Ocean, where they significantly affect existing ecosystems in that area, causing environmental imbalance, harming tourism, creating problems for fisheries, and, more broadly, reflecting a troubling passivity that seriously violates Article 50 of the Political Constitution. Accordingly, this Court must intervene in this new case, as it has in several previous rulings, so that the Municipality of Puntarenas will take responsibility for sanctioning and correcting conduct that causes direct pollution of the canton’s bodies of water, as in the present case…” (Judgment No. 2025-006950, issued at 9:20 a.m. on 7 March 2025).\n\nOne authority’s competence does not exclude that of another. The municipality is responsible, within its legal powers, for public infrastructure, stormwater drainage, roadside ditches, and road conditions. The Ministerio de Salud must exercise health-sector oversight, inspect properties, identify sources of pollution, issue the relevant health orders, and verify compliance. When a problem involves both public infrastructure and private wastewater discharges, both authorities are required to coordinate their actions; it is not constitutionally permissible for them to shift responsibility to each other.
