In environmental matters, it is my view that, if the Public Administration has already intervened, the matter falls within the jurisdiction of the administrative-litigation jurisdiction. Nevertheless, I do address the merits when other rights of the people affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free from contamination (Article 50 of the Political Constitution). That is the case here: the applicant alleges that the Municipalidad de Pococí and the Ministerio de Salud have not effectively addressed repeated complaints about the persistent accumulation of rainwater and wastewater in barrio Coopevigua 2 in Guápiles. According to the allegations, this situation causes foul odors, the proliferation of mosquitoes, flies, and other insects, and exposes community residents to the risk of contracting diseases, thereby endangering public health; for that reason, they have come before this Chamber. The situation described is an exception to my general position on this matter. I therefore consider it necessary for this Constitutional Court to examine the merits in order to verify or dismiss the applicant’s allegations. (…) NQC08/2026"
