SE DENUNCIA LA INACCIÓN INSTITUCIONAL FRENTE A LA\nCONTAMINACIÓN DEL RÍO CIRUELAS Y LA OCUPACIÓN ILEGAL DEL PRECARIO EL ERIZO EN\nZONA DE PROTECCIÓN, SE DECLARA CON LUGAR Y ORDENA AL MINAE, MUNICIPALIDAD DE\nALAJUELA Y MINISTERIO DE SALUD DELIMITAR EL ÁREA PROTEGIDA EN SEIS MESES Y\nADOPTAR UNA SOLUCIÓN INTEGRAL DEFINITIVA EN DOCE MESES. NQC08/2026\n\n(…) V.-\nLa coordinación de las instituciones públicas en la protección integral al\nambiente. Existe una obligación para el Estado -como un todo- de tomar las\nmedidas necesarias para proteger el ambiente, a fin de evitar grados de\ncontaminación, deforestación, extinción de flora y fauna, uso desmedido o\ninadecuado de los recursos naturales, que pongan en peligro la salud de los\nadministrados. En esta tarea, por institución pública se entiende tanto a la\nAdministración Central -Ministerios, como el Ministerio del Ambiente y Energía\ny el Ministerio de Salud-, que, en razón de la materia, tienen una amplia\nparticipación y responsabilidad en lo que respecta a la conservación y\npreservación del ambiente; los cuales actúan, la mayoría de las veces, a través\nde sus dependencias especializadas en la materia. Del mismo modo, en esta tarea\ntienen gran responsabilidad las municipalidades en lo que respecta a su\njurisdicción territorial. Debido a la diversidad de actores que pueden\nintervenir, podría pensarse que esta múltiple responsabilidad provocaría un\ncaos en la gestión administrativa. Por ello, a fin de evitar la coexistencia\nsimultánea de esferas de poder de diferente origen y esencia, la duplicación de\nlos esfuerzos nacionales y locales, así como la confusión de derechos y\nobligaciones entre las diversas partes involucradas, se hace necesario\nestablecer una serie de relaciones de coordinación entre las diversas\ndependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre\néstas con las municipalidades, a fin de poder llevar a cabo las funciones que\nles han sido encomendadas. Esta Sala se ha referido ya al principio de\ncoordinación de las dependencias públicas con las municipalidades en la\nrealización de fines comunes, al señalar mediante sentencia No. 1999-005445 de\nlas 14:30 horas del 14 de julio de 1999, que:\n\n\"La\ncoordinación es la ordenación de las relaciones entre estas diversas\nactividades independientes, que se hace cargo de esa concurrencia en un mismo\nobjeto o entidad, para hacerla útil a un plan público global, sin suprimir la\nindependencia recíproca de los sujetos agentes. Como no hay una relación de\njerarquía de las instituciones descentralizadas, ni del Estado mismo en\nrelación con las municipalidades, no es posible la imposición a éstas de\ndeterminadas conductas, con lo cual surge el imprescindible «concierto»\ninterinstitucional, en sentido estricto, en cuanto los centros autónomos e\nindependientes de acción se ponen de acuerdo sobre ese esquema preventivo y\nglobal, en el que cada uno cumple un papel con vista en una misión confiada a\nlos otros. Así, las relaciones de las municipalidades con los otros entes\npúblicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como\nresultado formas pactadas de coordinación, con exclusión de cualquier forma\nimperativa en detrimento de su autonomía, que permita sujetar a los entes\ncorporativos a un esquema de coordinación sin su voluntad o contra ella; pero\nque sí admite la necesaria subordinación de estos entes al Estado y en interés\nde éste (a través de la «tutela administrativa» del Estado, y específicamente,\nen la función de control la legalidad que a éste compete, con potestades de\nvigilancia general sobre todo el sector\".\n\nVI.-\nAntecedente. Por medio de la sentencia No. 2007-010251 de las 13:15 horas del\n20 de julio de 2007, este Tribunal se pronunció acerca del problema relacionado\ncon la contaminación en el río Ciruelas, por parte del precario El Erizo. En\ndicha oportunidad, se indicó lo que de seguido se transcribe:\n\n“IV.-\nDel elenco de hechos probados se desprende que desde el año dos mil cinco, el\nrecurrente presentó ante la Municipalidad de Alajuela y el Ministerio de\nAmbiente y Energía una denuncia debido a la deforestación y contaminación que\nprovoca un asentamiento informal al margen del río Ciruelas en Alajuela. Ante\ndicha denuncia el Ministerio recurrido ha realizado inspecciones, con el\npropósito de constatar las infracciones denunciadas, recomendando en dichas\ninspecciones coordinar con la Municipalidad de Alajuela para intervenir\nconjuntamente –situación que nunca se dio-, por otra parte y con ocasión del\nrecurso de amparo interpuesto y ante la medida cautelar ordenada, nuevamente el\nMinisterio recurrido realizó inspección el veintiuno de junio del presente año,\nen el informe de esta nueva inspección no se puede constatar todos los hechos\nalegados por el denunciante, con excepción de los desechos encontrados al\nmargen izquierdo del río Ciruelas contiguo al asentamiento en precario llamado\nel Erizo, por otra parte, resuelve el Ministro recurrido que coordinará con la\nMunicipalidad de Alajuela, el Ministerio de Vivienda y Asentamiento Humanos y\nel Ministerio de Salud con el propósito de intervenir conjuntamente para la\nsolución de dicha situación. Ante las situaciones indicadas, considera la Sala\nque dichas actuaciones de las autoridades recurridas se han prolongado por un\ntiempo excesivo, sin que se hubieran adoptado medidas lo suficientemente\nefectivas para acabar con el problema denunciado antes de la presentación del\namparo. Se constata que las autoridades recurridas se ha realizado algunas\ngestiones, ante la denuncia interpuesta por el recurrente, sin embargo, ello no\nfue suficiente para acabar el problema, pues su resolución se ha prolongado por\nmuchos años, produciéndose el mismo problema una y otra vez, lo cual demuestra\nque el Ministerio de Ambiente y Energía así como la Municipalidad de Alajuela\nno han actuado con la rigurosidad necesaria para acabar con el problema que\naquejaba al recurrente en forma oportuna. Además, no fue sino con posterioridad\na la presentación de este recurso y luego de muchos que las autoridades del\nMinisterio de Ambiente y Energía y la Municipalidad de Alajuela procedieron\nordenar la coordinación interinstitucional que amerita la solución del asunto\nventilado en este recurso de amparo. Así las cosas, estima la Sala que el\nrecurso debe acogerse, toda vez que la actuación de las autoridades recurridas\nno fueron lo suficientemente diligentes”.\n\nVII.-\nSobre el caso concreto. En reiteradas oportunidades, esta Sala ha sostenido que\nel derecho a la salud -derivado del derecho a la vida-, así como el derecho a\nun ambiente ecológicamente equilibrado, consagrado en el artículo 50\nconstitucional, son derechos que guardan una relación inescindible por cuanto,\nel segundo es presupuesto necesario para que el primero pueda hacerse efectivo.\nAsí, la efectividad del derecho a la salud de las personas, en buena medida, de \nlas condiciones medio ambientales existentes, razón por la\ncual el Estado está obligado a tomar las medidas necesarias para proteger el ambiente y evitar grados de contaminación que\npotencien el deterioro de la salud de las personas y su calidad de vida. \n\nEn\nel sub lite, todas las autoridades recurridas (MINAE, Municipalidad de Alajuela\ny Misterio de Salud) son coincidentes en la problemática de la existente\ncontaminación e invasión de la zona protegida del río Ciruelas en que han\nincurrido los habitantes del precario. Primeramente, se acepta que en ese\nsector desde hace más de tres décadas se produjo la invasión de una parte de\nlos terrenos del proyecto residencial del mismo nombre que fuera desarrollado\nen su momento por parte del INVU. Dicha invasión, a su vez, puede estar\nabarcando a la fecha también parte de la zona de protección del cauce del río\nCiruelas. Situación que fue corroborada el 15 de abril pasado cuando dos\nfuncionarios de la Oficina Subregional de Alajuela del MINAE ingresaron al\nsitio y de dicha visita preliminar se logró advertir, a primera vista, la\nposible existencia de ocupaciones o estructuras que podrían estar invadiendo,\ntotal o parcialmente, el área de protección del río Ciruelas. También el 28 de\nabril de 2026, previa conformación por parte de la Dirección del Área Rectora\nde Salud de Alajuela 1 de un equipo de intervención integrado por el Dr. Víctor\nGonzález Jiménez, Director y Médico, Ing. Jorge González Calvo Gestor\nAmbiental, ambos del Ministerio de Salud, así como personeros de la Fuerza\nPública, de la Policía Municipal de Alajuela y funcionarios de Áreas de\nConservación del SINAC, se realizó una visita al lugar y se confirmó la\npresencia de residuos sólidos, vertido de aguas servidas, viviendas en zona de\nprotección y riesgos estructurales que comprometen la salud y seguridad de los\nhabitantes. Sin embargo, ninguna ha tomado medidas eficaces que permitan\nsolucionar tal problemática. En virtud\nde lo expuesto, este Tribunal verifica la lesión a los derechos fundamentales\nde los recurrentes. En ese sentido, se comprueba que las acciones de las\nautoridades recurridas han sido insuficientes, pues no han procedido a dictar\nmedidas preventivas o precautorias tendientes a que el daño ambiental existente\npor más de diecinueve años, pues ya esta Sala lo conoció y tuteló en el año\n2007, sea solventado o disminuya.\n\nAsí\nlas cosas, por imperativo constitucional, las autoridades estatales están en la\nobligación de preservar y defender al medio ambiente, pero evidentemente ante\nuna situación social tan compleja como es el caso de El Erizo las soluciones\ndeben ser integrales y respetuosas de los derechos fundamentales de su\npoblación que se encuentran en un estado de exclusión y vulnerabilidad. La\nproblemática medioambiental y la falta de acción efectiva para mitigar la\ncontaminación en la zona de El Erizo ha sido en gran parte generada por un mal\nfuncionamiento del Estado en la preservación del ambiente y ante la\npermisividad y tolerancia estatal frente al establecimiento de un asentamiento\nhumano informal en dominio público con características tan sensibles para la\nprotección del agua y el cauce de un río. Aunado a ello, a una serie de causas\nestructurales que han generado el establecimiento de asentamientos humanos,\ndonde lastimosamente las personas no pueden desarrollarse de una forma sana y\ndigna. Por ende, ante situaciones sociales y de exclusión tan complejas, la\nsolución debe ser integral y coordinada entre todas las instituciones estatales\nque tengan competencia.\n\nVIII.-\nConclusión. Por consiguiente, lo que procede es declarar con lugar el recurso\ncon las consideraciones que se dirán en la parte dispositiva de esta sentencia.\n(…)",

FAILURE TO ACT BY PUBLIC AUTHORITIES IS ALLEGED IN RESPONSE TO THE POLLUTION OF THE CIRUELAS RIVER AND THE ILLEGAL OCCUPATION OF THE EL ERIZO INFORMAL SETTLEMENT IN A PROTECTED AREA. THE AMPARO APPLICATION IS GRANTED, AND MINAE, THE MUNICIPALITY OF ALAJUELA, AND THE MINISTRY OF HEALTH ARE ORDERED TO DELIMIT THE PROTECTED AREA WITHIN SIX MONTHS AND ADOPT A DEFINITIVE, COMPREHENSIVE SOLUTION WITHIN TWELVE MONTHS. NQC08/2026\n\n(…) V.—\n\nCoordination among public institutions in the comprehensive protection of the environment. The State—as a whole—is obligated to take the measures necessary to protect the environment and thereby prevent levels of pollution, deforestation, extinction of flora and fauna, or excessive or inappropriate use of natural resources that endanger the health of those subject to the administration. For this purpose, a public institution includes both the Central Administration—ministries such as the Ministry of Environment and Energy and the Ministry of Health—which, by virtue of their subject-matter responsibilities, have broad participation and responsibility with respect to environmental conservation and preservation, and which act, in most cases, through their specialized departments. Municipalities likewise have considerable responsibility in this task within their territorial jurisdiction. Given the variety of actors that may be involved, one might think that this shared responsibility would cause chaos in administrative management. Therefore, to avoid the simultaneous coexistence of spheres of power with different origins and natures, the duplication of national and local efforts, and confusion about the rights and obligations of the various parties involved, it is necessary to establish a series of coordination relationships among the various departments of the Executive Branch and decentralized institutions, and between those entities and the municipalities, so they can carry out the functions entrusted to them. This Chamber has already addressed the principle of coordination between public departments and municipalities in pursuing common purposes, stating in Judgment No. 1999-005445, issued at 14:30 on 14 July 1999, that:\n\n“Coordination is the arrangement of relationships among these various independent activities. It addresses their concurrence in relation to the same object or entity, so as to make that concurrence useful to an overall public plan, without suppressing the reciprocal independence of the actors. Because there is no hierarchical relationship between decentralized institutions, or between the State itself and the municipalities, it is not possible to impose particular conduct on the municipalities. This gives rise to the indispensable interinstitutional ‘concert,’ in the strict sense: autonomous and independent centers of action agree on that preventive and comprehensive arrangement, in which each fulfills a role in view of a mission entrusted to the others. Thus, the relationships between municipalities and other public entities can take place only on an equal footing, resulting in agreed forms of coordination and excluding any mandatory form that would impair municipal autonomy by subjecting corporate entities to a coordination arrangement without or against their will. This does, however, allow for the necessary subordination of those entities to the State and in the State’s interest (through the State’s ‘administrative oversight,’ and specifically, through the legality-control function for which the State is responsible, with general powers of supervision over the entire sector).”\n\nVI.—\n\nBackground. In Judgment No. 2007-010251, issued at 13:15 on 20 July 2007, this Court ruled on the problem of pollution of the Ciruelas River by the El Erizo informal settlement. On that occasion, the following was stated:\n\n“IV.—\n\nIt follows from the proven facts that, since 2005, the applicant had filed a complaint with the Municipality of Alajuela and the Ministry of Environment and Energy concerning deforestation and pollution caused by an informal settlement on the banks of the Ciruelas River in Alajuela. In response to that complaint, the respondent Ministry conducted inspections to verify the reported violations. Those inspections recommended coordinating with the Municipality of Alajuela to intervene jointly—a recommendation that was never acted upon. In addition, in connection with the amparo application and the interim measure ordered, the respondent Ministry again conducted an inspection on 21 June of this year. The report from this new inspection does not verify all the facts alleged by the complainant, except for the waste found on the left bank of the Ciruelas River, adjacent to the informal settlement called El Erizo. The respondent Minister, in turn, decided to coordinate with the Municipality of Alajuela, the Ministry of Housing and Human Settlements, and the Ministry of Health to intervene jointly to resolve the situation. In light of these circumstances, the Chamber considers that the actions of the respondent authorities have continued for an excessive period without sufficiently effective measures being adopted to put an end to the reported problem before the amparo application was filed. The respondent authorities did take certain steps in response to the complaint filed by the applicant; however, those steps were not sufficient to resolve the problem, since its resolution has been delayed for many years, with the same problem recurring again and again. This shows that the Ministry of Environment and Energy and the Municipality of Alajuela did not act with the rigor necessary to resolve the problem affecting the applicant in a timely manner. Moreover, it was only after this application was filed, and after many [steps], that the authorities of the Ministry of Environment and Energy and the Municipality of Alajuela proceeded to order the interinstitutional coordination required to resolve the matter raised in this amparo proceeding. Accordingly, the Chamber considers that the application must be granted, since the actions of the respondent authorities were not sufficiently diligent.”\n\nVII.—\n\nThe specific case. On numerous occasions, this Chamber has held that the right to health—derived from the right to life—and the right to an ecologically balanced environment, enshrined in Article 50 of the Constitution, are inseparably related because the latter is a necessary precondition for the former to be effective. Thus, the effectiveness of people’s right to health depends to a large extent on existing environmental conditions. For that reason, the State is obligated to take the measures necessary to protect the environment and prevent levels of pollution that could worsen people’s health and quality of life.\n\nIn the case at hand, all the respondent authorities (MINAE, the Municipality of Alajuela, and the Ministry of Health) agree that there is a problem involving pollution and the invasion of the Ciruelas River protected area by the inhabitants of the informal settlement. First, it is acknowledged that more than three decades ago, part of the land belonging to the residential project of the same name, developed at the time by INVU, was invaded in that area. That invasion may also now extend into part of the protection area along the Ciruelas River channel. This situation was confirmed on 15 April of this year, when two officials from MINAE’s Alajuela Subregional Office entered the site. During that preliminary visit, they observed, at first glance, the possible existence of occupations or structures that could be encroaching, wholly or partly, on the Ciruelas River protection area. Also, on 28 April 2026, following the formation by the Directorate of the Alajuela 1 Health Area of an intervention team comprising Dr. Víctor González Jiménez, Director and Physician, and Environmental Manager Eng. Jorge González Calvo, both from the Ministry of Health, as well as members of the Fuerza Pública, the Municipal Police of Alajuela, and officials from SINAC Conservation Areas, a site visit was conducted. It confirmed the presence of solid waste, discharge of wastewater, homes in the protection area, and structural risks that endanger the health and safety of the inhabitants. However, none of the authorities has taken effective measures to resolve this problem. In view of the foregoing, this Court finds that the applicants’ fundamental rights have been violated. In that regard, it is established that the actions of the respondent authorities have been insufficient, since they have not issued preventive or precautionary measures aimed at remedying or reducing the existing environmental harm, which has persisted for more than nineteen years and which this Chamber had already considered and protected against in 2007.\n\nAccordingly, the Constitution requires state authorities to preserve and defend the environment. However, in an extremely complex social situation such as the one in El Erizo, solutions must be comprehensive and respect the fundamental rights of its population, which is in a state of exclusion and vulnerability. The environmental problem and the lack of effective action to mitigate pollution in the El Erizo area have been caused in large part by the State’s failure to protect the environment, as well as by the State’s permissiveness and tolerance toward the establishment of an informal human settlement on public property in an area so sensitive to the protection of water and a river channel. This is compounded by a series of structural causes that have led to the establishment of human settlements, where, regrettably, people cannot develop in a healthy and dignified manner. Therefore, given such complex social circumstances and exclusion, the solution must be comprehensive and coordinated among all state institutions with relevant authority.\n\nVIII.—\n\nConclusion. Consequently, the amparo application must be granted, subject to the considerations set out in the operative part of this judgment.\n\n(…)"
