Although I agree with the majority of the Constitutional Chamber (Sala Constitucional) that the amparo application should be granted, I disagree about where the enforcement phase of the matter should be conducted, because the rules governing this constitutional jurisdiction provide no suitable mechanisms for monitoring a judgment that involves technical matters of some complexity. In this case, within six months and twelve months, MINAE, the Municipalidad de Alajuela, and the Ministerio de Salud must first delimit the protection area of the río Ciruelas and determine whether the protected strip defined by the applicable forestry regulations has been affected; second, they must provide a definitive solution to all the environmental problems alleged by the applicants in this amparo. By contrast, the provisions of the Código Procesal Contencioso-Administrativo on enforcement (Article 155 and following) offer clear advantages, such as the possibility of requesting schedules, imposing fines, assigning responsibility, and monitoring stages of compliance. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should take place before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
