SE DECLARA PARCIALMENTE CON LUGAR POR DILACIÓN INDEBIDA DEL TRIBUNAL AMBIENTAL ADMINISTRATIVO Y LE ORDENA RESOLVER LA DENUNCIA EN TRES MESES. VCG09/2026\n\n“(…) IV.-\nSobre el caso concreto. En el sub lite, el recurrente alega que es propietario\nde la finca matricula nro. 2-360333-000, ubicada en Canalete de Upala,\nAlajuela, destinada a actividades agrícolas y pecuarias, localizada en una zona\ninfluenciada por el río Zapote. Indica que en el año 2019 la empresa\nCoopeguanacaste realizó diversas obras para proteger infraestructura propia\ncercana al río, incluyendo movimientos de tierra, tala de árboles, apertura de\naccesos, construcción de cunetas, colocación de concreto y construcción de\ndiques, lo cual generó alteraciones en el cauce y comportamiento natural del\nrío. Señala que dichas intervenciones provocaron modificaciones importantes\nsobre la dinámica y dirección de la fuerza del rio Zapote. Manifiesta que, ante\nla gravedad de los hechos interpuso denuncia ante el MINAE bajo el expediente\nSITADA N.º 16-362-2019, lo que permitió a las autoridades conocer las\nintervenciones y sus posibles efectos ambientales. Menciona que esa denuncia\nfue remitida del SINAC de Upala a la dirección de Aguas del Ministerio de\nAmbiente y Energía, donde se realizaron inspecciones de campo, emitieron\ninformes y trasladaron el caso al Tribunal Ambiental Administrativo. Sostiene\nque, a la fecha en la que acude en amparo, no se han adoptado medidas efectivas\npara detener el daño ni se ha brindado una respuesta oportuna, lo que ha\ngenerado una situación continua de afectación a su propiedad, así como\nincertidumbre y preocupación para su núcleo familiar. Solicita la intervención\nde la Sala.\n\nAl respecto,\nde la relación de hechos probados se desprende que el 6 de agosto de 2019, el\nrecurrente interpuso una denuncia ante la subregión Upala-Guatuso del SINAC,\npor los siguientes hechos: “Según indica el informe la empresa Coope Guanacaste\ndesvía el río Zapote y construye un dique con materiales del mismo río\n(piedras) al desviar el cause provoca impacto directo del agua en propiedad del\nRecurrente”. El 8 de agosto de 2019, la denuncia del recurrente fue trasladada\na la dirección de Aguas del Ministerio de Ambiente y Energía. Por oficio\nDA-UHSAN-0539-2020 del 10 de agosto de 2020, emitido por la dirección de Aguas\ndel MINAE dirigido al denunciante, se indicó: “ (…) No se determinó permiso de\nobra en cauce otorgado por esta Dirección, para los puntos inspeccionados, por\nlo que se determina de esta forma que, la obra en cauce (dique identificado) no\nposee el respectivo permiso. - En inspección de campo, no se identificó ningún\ntipo de maquinaria realizando trabajos dentro del cauce del Río Zapote. -No fue\nposible identificar afectación a propiedades de terceros. -Al determinarse que\nno existe permiso otorgado por esta Dirección, para la obra en cauce\nidentificada (dique), es que se procederá a presentar la respectiva denuncia ante el Tribunal Ambiental Administrativo”.\nPor oficio DA-UHSAN-0540-2020 del 10 de agosto de 2020, emitido por la\ndirección de Aguas del MINAE y dirigido al Tribunal Ambiental Administrativo,\nse indicó: “En atención a denuncia SITADA 16362-2019, presentada por el señor\n[Nombre 001] cédula de identidad [Valor 003], donde indica como imputado a\nCoopeguanacaste, y denuncia sobre obras en cauce del río Zapote, es que se le\nindica: Se realizó inspección de campo por parte del suscrito el día 27 de\nagosto del 2019. Producto de dicha inspección se generó el informe\nDA-UHSAN-0539-2020, el cual se adjunta al presente informe. Se determina la\npresencia de obras en cauce de dominio público (dique descrito en oficio\nsupra). Para dicha obra no se registra permiso otorgado por esta Dirección, por\nlo que se determina afectación al recurso hídrico. Debido a lo anterior, es que\nse le traslada respetuosamente la presente denuncia para lo que corresponda. En\nrevisión de antecedentes relacionados al sitio de estudio, se identifica la\nresolución 1083-17-TAA relacionado al expediente 253-14-01-TAA con denunciado\nProyecto Hidroeléctrico Bijagua desarrollado por Cooperativa de Electrificación\nRural de Guanacaste R.L. COOPEGUANACASTE R.L. Al ubicarse los hechos\nidentificados en inspección de campo realizada por el suscrito, en el área del\nProyecto Hidroeléctrico Bijagua, es que se procede a trasladar de manera formal\nal Tribunal Ambiental Administrativo los respectivos informes generados por\nesta Dirección, para que se adjunten como insumo a la denuncia del expediente\n253-14-01-TAA, para que dicho Tribunal proceda según corresponda.\nAdicionalmente se presenta a continuación la valoración económica del daño\nambiental”. La resolución de curso del amparo fue notificada al presidente del\nTribunal Ambiental Administrativo el 12 de junio de 2026 y al director de la\ndirección de Aguas del MINAE el 16 de junio de 2026. Por resolución nro.\n629-2026-TAA de las 13:15 horas del 16 de junio de 2026, las autoridades del\nTribunal Ambiental Administrativo desacumularon los oficios DA-UHSAN-0539-2020,\nDA-UHSAN-0540-2020 y DA-USHAN-0541-2020 del expediente nro. 253-14-01-TA para\nabrir un nuevo expediente, con el objetivo de iniciar la investigación de los\nhechos alegados por la Dirección de Agua.\n\nAsí las\ncosas, en cuanto a la dirección de Aguas del MINAE no se observa acción u\nomisión que resulte lesiva de los derechos fundamentales del recurrente, en\ntanto dieron trámite y respuesta a la denuncia del tutelado desde 2020,\nmediante oficio DA-UHSAN-0539-2020 del 10 de agosto de 2020. Además,\ntrasladaron el caso del amparado al Tribunal Ambiental Administrativo mediante\noficio DA-UHSAN-0540-2020 del 10 de agosto de 2020 para lo correspondiente.\n\nAhora bien,\nen cuanto al Tribunal Ambiental Administrativo, consta que desde el 10 de\nagosto de 2020 les fue trasladada la denuncia del tutelado; sin embargo, según\nse desprende del informe rendido bajo juramento, fue por resolución nro.\n629-2026-TAA de las 13:15 horas del 16 de junio de 2026 -casi seis años después\ny con posterioridad a la notificación del curso de este amparo- que las\nautoridades del Tribunal Ambiental Administrativo desacumularon los oficios\nDA-UHSAN-0539-2020, DA-UHSAN-0540-2020 y DA-USHAN-0541-2020 del expediente nro.\n253-14-01-TA para abrir un nuevo expediente, con el objetivo de iniciar la\ninvestigación de los hechos alegados por la Dirección de Agua en relación con\nla denuncia del tutelado.\n\nEn mérito de\nlo expuesto, estima esta Sala que se ha producido una dilación indebida y un\nretardo injustificado que vulnera el derecho fundamental a un procedimiento\nadministrativo pronto y cumplido de la parte amparada, consagrado en el\nartículo 41 de la Constitución Política.   "body_en_text": "030964-26. ENVIRONMENT. SUMMARY DISPOSITION. THE COMPLAINT CONCERNS THE FAILURE TO RESOLVE AN ENVIRONMENTAL COMPLAINT ABOUT INTERVENTIONS IN THE RÍO ZAPOTE AND THEIR EFFECTS ON PRIVATE PROPERTY. THE AMPARO APPLICATION IS DECLARED PARTIALLY WITH MERIT ON THE GROUND OF UNDUE DELAY BY THE TRIBUNAL AMBIENTAL ADMINISTRATIVO, WHICH IS ORDERED TO RESOLVE THE COMPLAINT WITHIN THREE MONTHS. VCG09/2026\n\n“(…) IV.-\nThe specific case. In the present case, the applicant alleges that he owns property registered under folio no. 2-360333-000, located in Canalete de Upala, Alajuela, used for agricultural and livestock activities and situated in an area influenced by the Río Zapote. He states that in 2019 the company Coopeguanacaste carried out various works to protect its own infrastructure near the river, including earthworks (movimientos de tierra), tree felling, opening access routes, construction of drainage ditches, placement of concrete, and construction of dikes, which altered the riverbed and the river’s natural behavior. He says those interventions substantially changed the dynamics of the Río Zapote and the direction of the force of its waters. He states that, given the seriousness of the events, he filed a complaint with MINAE under case file SITADA N.º 16-362-2019, which enabled the authorities to learn of the interventions and their possible environmental effects. He notes that the complaint was forwarded from SINAC in Upala to the Water Directorate of the Ministry of Environment and Energy, where field inspections were carried out, reports were issued, and the case was referred to the Tribunal Ambiental Administrativo. He maintains that, as of the date he filed this amparo application, no effective measures had been adopted to stop the damage and no timely response had been provided, creating an ongoing impact on his property as well as uncertainty and concern for his family. He requests the Chamber’s intervention.\n\nIn this regard, the account of proven facts shows that on 6 August 2019, the applicant filed a complaint with the Upala-Guatuso subregion of SINAC concerning the following events: “According to the report, the company Coope Guanacaste diverts the Río Zapote and builds a dike with material from the river itself (stones); by diverting the riverbed, it causes the water to impact the Applicant’s property directly.” On 8 August 2019, the applicant’s complaint was forwarded to the Water Directorate of the Ministry of Environment and Energy. In official letter DA-UHSAN-0539-2020 of 10 August 2020, issued by MINAE’s Water Directorate and addressed to the complainant, it stated: “(…) No permit for works in the riverbed was found to have been issued by this Directorate for the inspected locations; it is therefore determined that the works in the riverbed (the identified dike) lack the required permit. - During the field inspection, no machinery carrying out work within the Río Zapote riverbed was identified. - It was not possible to identify any impact on third-party properties. - Since no permit was found to have been issued by this Directorate for the identified works in the riverbed (the dike), the corresponding complaint will be filed with the Tribunal Ambiental Administrativo.”\nIn official letter DA-UHSAN-0540-2020 of 10 August 2020, issued by MINAE’s Water Directorate and addressed to the Tribunal Ambiental Administrativo, it stated: “In response to complaint SITADA 16362-2019, filed by Mr. [Name 001], identity card [Value 003], naming Coopeguanacaste as the accused party and concerning works in the Río Zapote riverbed, the following is reported: The undersigned conducted a field inspection on 27 August 2019. That inspection resulted in report DA-UHSAN-0539-2020, attached to this report. Works in the riverbed on public domain land were identified (the dike described in the above-referenced official letter). No permit for those works is recorded as having been issued by this Directorate; it is therefore determined that the water resource has been affected. Accordingly, this complaint is respectfully referred to you for appropriate action. A review of records relating to the site under study identified resolution 1083-17-TAA, relating to case file 253-14-01-TAA, in which the reported party is the Bijagua Hydroelectric Project, developed by Cooperativa de Electrificación Rural de Guanacaste R.L. COOPEGUANACASTE R.L. Since the events identified during the field inspection conducted by the undersigned occurred in the Bijagua Hydroelectric Project area, the reports prepared by this Directorate are formally referred to the Tribunal Ambiental Administrativo so that they may be added as supporting material to the complaint in case file 253-14-01-TAA, and that Tribunal may proceed as appropriate. In addition, the following is an economic valuation of the environmental damage.” The order admitting the amparo application was notified to the president of the Tribunal Ambiental Administrativo on 12 June 2026 and to the director of the Water Directorate of MINAE on 16 June 2026. By resolution no. 629-2026-TAA, issued at 13:15 on 16 June 2026, the authorities of the Tribunal Ambiental Administrativo detached official letters DA-UHSAN-0539-2020, DA-UHSAN-0540-2020, and DA-USHAN-0541-2020 from case file no. 253-14-01-TA in order to open a new case file and begin investigating the events alleged by the Water Directorate.\n\nAccordingly, as to MINAE’s Water Directorate, no action or omission that would violate the applicant’s fundamental rights is apparent, since it processed and responded to the protected party’s complaint in 2020 by official letter DA-UHSAN-0539-2020 of 10 August 2020. It also referred the applicant’s case to the Tribunal Ambiental Administrativo by official letter DA-UHSAN-0540-2020 of 10 August 2020 for appropriate action.\n\nAs for the Tribunal Ambiental Administrativo, the record shows that the protected party’s complaint was referred to it on 10 August 2020. However, as appears from the report submitted under oath, it was only by resolution no. 629-2026-TAA, issued at 13:15 on 16 June 2026—nearly six years later and after notice that this amparo application had been admitted—that the authorities of the Tribunal Ambiental Administrativo detached official letters DA-UHSAN-0539-2020, DA-UHSAN-0540-2020, and DA-USHAN-0541-2020 from case file no. 253-14-01-TA in order to open a new case file and begin investigating the events alleged by the Water Directorate in connection with the protected party’s complaint.\n\nIn light of the foregoing, this Chamber considers that undue delay and unjustified postponement have occurred, violating the protected party’s fundamental right to prompt and duly completed administrative proceedings, enshrined in Article 41 of the Political Constitution. Accordingly, since the proceeding in question had not yet been resolved by the respondent Tribunal Ambiental Administrativo as of the date this amparo application was filed, the application must be granted, with the consequences specified in the operative part of this judgment.
