Joinder (coadyuvancia) is a form of ancillary intervention that occurs when a person participates in proceedings by supporting the claims of one of the principal parties. Consequently, a person with a direct interest in the outcome of the application has standing to act as an intervening supporter (coadyuvante). However, because that person is not a principal party, the intervening supporter is not directly affected by the judgment; that is, the judgment’s effects cannot reach that person directly and immediately, nor is that person bound by the res judicata effect of the ruling. In amparo matters, however, the effects of the ruling may benefit that person because the jurisprudence and precedents of the constitutional jurisdiction have “erga omnes” effect (Article 13 of the Law on Constitutional Jurisdiction).\n\nHaving clarified the foregoing, in this case the Chamber proceeds to admit the active joinder application filed by Shirley Jara Vásquez, since she has a clear interest in the outcome of these proceedings: the violation of the right to a healthy environment is conduct that harms the community.
