"summary_en": "In a separate note, Justice Salazar Alvarado states that environmental matters in which the Public Administration has already intervened belong to the administrative-litigation jurisdiction for consideration and resolution. He says he addresses the merits when other rights of affected people are also at stake, including health, quality of life, and the Article 50 constitutional right to a healthy environment free from pollution. He applies that position to allegations that, after a tree fell in Santa Ana’s central park due to adverse weather, the mayor ordered the remaining trees felled without a technical assessment, causing serious and irreversible environmental consequences. The supplied text does not include the majority’s operative disposition, so this note does not establish the outcome of the amparo proceeding or report any repeal, annulment, or transitional effects.",

In environmental matters, it is also my view that, if the Public Administration has already intervened, the matter falls within the jurisdiction of the administrative-litigation jurisdiction. Nevertheless, I do consider the merits when other rights of the affected persons are at stake, including health, quality of life, and the right to enjoy an environment that is healthy and free from contamination (Article 50 of the Political Constitution), as is the case here. It is alleged that on 24 June 2026, a tree in the central park of the canton of Santa Ana fell due to adverse weather conditions. It is alleged that the mayor of the local government ordered the felling of the remaining trees despite lacking a technical opinion to support it, causing serious and irreversible environmental consequences and thereby violating the right to enjoy a healthy and ecologically balanced environment and a decent quality of life.\n\nVCG09/2026"
