SE ACUSA LA FALTA DE RESTITUCIÓN DE LA VÍA PÚBLICA, TRAS OBRAS DE ALCANTARILLADO EN BARRIO EL CARMEN DE PUNTARENAS, LO QUE GENERA POLVO Y PARTÍCULAS EN SUSPENSIÓN QUE AFECTAN A LOS VECINOS. SE DECLARA PARCIALMENTE CON LUGAR Y SE ORDENA AL AYA CUMPLIR LA ORDEN SANITARIA EMITIDA POR EL MINISTERIO DE SALUD. VCG09/2026\n\n“(…) IV.-\nSobre el caso concreto. En el sub lite, la Sala comprueba que, el 26 de febrero\nde 2026, el ICAA inició trabajos en el Barrio El Carmen, producto de los cuales\nse efectuó una excavación y sustitución de una tubería, así como un relleno de\nla zanja intervenida. Tales labores finalizaron el 5 de marzo de 2026. El 31 de\nmarzo de 2026, el ICAA inspeccionó el lugar y levantó las medidas necesarias\npara las labores de reposición de la superficie intervenida. El 27 de julio de\n2026, el Ministerio de Salud inspeccionó en dos ocasiones el lugar denunciado y\nseñaló:\n\n“Con base en\nlo expuesto en el presente informe técnico, se concluye que actualmente existe\nuna afectación en la capa asfáltica de la vía pública en un tramo aproximado de\n75 metros, situación que, según lo indicado por residentes del sector, se\nencuentra asociada a trabajos de intervención del alcantarillado sanitario\nefectuados previamente por el Instituto Costarricense de Acueductos y\nAlcantarillados. La falta de restitución de la superficie de rodamiento\nfavorece la generación de polvo y partículas en suspensión producto del\ntránsito vehicular y de la acción del viento. Asimismo, pese a las\nverificaciones efectuadas en dos momentos distintos y bajo diferentes\ncondiciones de marea, no fue posible constatar la presencia de olores\nofensivos, desbordamientos de aguas residuales u otra evidencia que permitiera\nconfirmar la existencia de una afectación sanitaria derivada del sistema de\nalcantarillado o de las obras ejecutadas en el sitio”.\n\nEl 27\nMinisterio de Salud giró la orden sanitaria nro.\nMS-DRRSPC-DARSPC-OS-136-2026-MCP a la presidenta ejecutiva del ICAA, mediante\nla cual “se solicitó elaborar y remitir al Área Rectora de Salud Puntarenas\nChacarita un plan de acciones correctivas orientado a la atención y resolución\ndefinitiva de la problemática identificada, relacionada con la presencia de\npartículas en suspensión”.\n\nAhora bien,\nrecuérdese que lo acusado por el accionante es que, con ocasión de las labores\nefectuadas en el Barrio El Carmen, el instituto recurrido rellenó de forma\ndeficiente la excavación con arena extraída, sin contemplar cuestiones como la\nadecuada compactación, sellado o asfaltado. Además, se reclama que esa\nsituación ha provocado un foco de contaminación e insalubridad, debido a que\ncuando la marea sube se desprenden olores intensos y nauseabundos del sitio\nintervenido por el ICAA.\n\nAl respecto,\nlleva razón la parte tutelada, toda vez que, pese a que las labores en cuestión\nfinalizaron el 5 de marzo de 2026, no se verifica que el ICAA haya concluido la\ntotalidad de la intervención del sitio. Lo anterior queda en evidencia con la\ninspección que llevó a cabo el Ministerio de Salud el 27 de julio de 2026, a\nsaber, más de cuatro meses después de la culminación de las labores de\nsustitución de la tubería en cuestión, momento en que se verificó que “La falta\nde restitución de la superficie de rodamiento favorece la generación de polvo y\npartículas en suspensión producto del tránsito vehicular y de la acción del\nviento”.\n\nDe ahí que\nproceda acoger el recurso en cuanto a la demora para efectuar los trabajos de\nrestitución de la superficie de rodamiento lo que favorece la generación de\npolvo y partículas de suspensión, de acuerdo con lo establecido en la parte\ndispositiva de este asunto.\n\nPor su\nparte, pese a que el accionante sostiene que la situación denunciada genera\nmalos olores y desbordamientos de aguas residuales, no menos cierto es que tal\nsituación no fue corroborada por el Ministerio de Salud en la inspección\nsupramencionada, sino que esa cartera ministerial indicó que “no fue posible\nconstatar la presencia de olores ofensivos, desbordamientos de aguas residuales\nu otra evidencia que permitiera confirmar la existencia de una afectación\nsanitaria derivada del sistema de alcantarillado o de las obras ejecutadas en\nel sitio”. Por ende, no se estima el amparado respecto a este extremo. (…)”",

FAILURE TO RESTORE THE PUBLIC ROAD AFTER SEWER WORK IN BARRIO EL CARMEN, PUNTARENAS, IS ALLEGED; THE FAILURE GENERATES DUST AND AIRBORNE PARTICLES THAT AFFECT RESIDENTS. THE AMPARO APPLICATION IS PARTIALLY UPHELD, AND THE ICAA IS ORDERED TO COMPLY WITH THE HEALTH ORDER ISSUED BY THE MINISTRY OF HEALTH. VCG09/2026\n\n“(…) IV.-\nThe specific case. In the present case, the Chamber finds that on 26 February\n2026, the ICAA began work in Barrio El Carmen, which involved excavating and\nreplacing a pipe, as well as filling in the trench. That work ended on 5 March\n2026. On 31 March 2026, the ICAA inspected the site and took the necessary\nmeasurements for work to restore the affected surface. On 27 July 2026, the\nMinistry of Health inspected the reported site twice and stated:\n\n“Based on\nthe information set out in this technical report, it is concluded that there is\ncurrently damage to the asphalt layer of the public road along an\napproximately 75-meter stretch. According to residents of the area, this\nsituation is associated with sewer-system work previously carried out by the\nInstituto Costarricense de Acueductos y Alcantarillados. The failure to restore\nthe road surface contributes to the generation of dust and airborne particles\nas a result of vehicular traffic and wind. Furthermore, despite inspections\nconducted on two separate occasions and under different tidal conditions, it\nwas not possible to confirm the presence of offensive odors, wastewater\noverflow, or other evidence that would confirm a health impact arising from\nthe sewer system or the work carried out at the site.”\n\nOn 27 July,\nthe Ministry of Health issued health order no.\nMS-DRRSPC-DARSPC-OS-136-2026-MCP to the executive president of the ICAA, by\nwhich it “requested the preparation and submission to the Puntarenas Chacarita\nHealth Area of a corrective action plan aimed at addressing and definitively\nresolving the identified problem relating to the presence of airborne\nparticles.”\n\nNow,\nrecall that the applicant alleges that, in connection with the work carried out\nin Barrio El Carmen, the respondent institute inadequately filled the\nexcavation with the sand that had been removed, without taking into account\nmatters such as proper compaction, sealing, or paving. The applicant further\nclaims that this situation has caused pollution and unsanitary conditions\nbecause, when the tide rises, intense and nauseating odors emanate from the\nsite where the ICAA performed the work.\n\nIn this\nregard, the protected party is correct, since, although the work in question\nended on 5 March 2026, there is no evidence that the ICAA has completed all the\nwork at the site. This is evident from the inspection conducted by the Ministry\nof Health on 27 July 2026—that is, more than four months after completion of\nthe pipe replacement work in question—when it confirmed that “The failure to\nrestore the road surface contributes to the generation of dust and airborne\nparticles as a result of vehicular traffic and wind.”\n\nAccordingly,\nthe amparo application should be granted with respect to the delay in carrying\nout the work to restore the road surface, which contributes to the generation\nof dust and airborne particles, in accordance with the provisions of the\noperative part of this matter.\n\nFor its\npart, although the applicant maintains that the reported situation causes bad\nodors and wastewater overflows, it is also true that the Ministry of Health did\nnot corroborate this during the aforementioned inspection. Rather, the Ministry\nstated that “it was not possible to confirm the presence of offensive odors,\nwastewater overflow, or other evidence that would confirm a health impact\narising from the sewer system or the work carried out at the site.” Therefore,\nthe amparo application is denied as to this aspect.
