SE DECLARA CON LUGAR, ORDENA GARANTIZAR DE INMEDIATO EL SUMINISTRO DIARIO MEDIANTE RED O MEDIOS ALTERNATIVOS, REALIZAR INSPECCIÓN TÉCNICA EN UN MES Y EJECUTAR LAS OBRAS ESTRUCTURALES NECESARIAS EN DIECIOCHO MESES. VCG09/2026\n\n“(…) III.- Sobre la admisibilidad del amparo. De\nconformidad con los artículos 48, de la Constitución Política, y 29, de la Ley\nde la Jurisdicción Constitucional, el recurso de amparo tutela los derechos y\nlibertades fundamentales frente a acciones, omisiones o actuaciones materiales\nde los órganos y servidores públicos que los violen o amenacen. La controversia\nplanteada no exige definir derechos patrimoniales ni sustituir a la\nAdministración en decisiones técnicas de detalle; corresponde determinar si la\nforma en que se presta un servicio público esencial satisface el contenido\nmínimo del derecho fundamental reconocido expresamente en el artículo 50,\nConstitucional. Por ello, el asunto es susceptible de conocimiento en esta vía\nsumaria.\n\nIV.- Sobre el derecho humano de acceso al agua potable.\nEl artículo 50, de la Constitución Política, reconoce a toda persona el derecho\nhumano, básico e irrenunciable de acceso al agua potable como bien esencial\npara la vida y dispone que el abastecimiento para consumo humano y de las\npoblaciones tiene prioridad. Este Tribunal ha sostenido reiteradamente que ese\nderecho se vincula de manera inmediata con la vida, la salud, la dignidad, la\nvivienda y el ambiente sano, y que, por tratarse de un servicio público\nesencial, su prestación está sujeta con especial intensidad a los principios de\ncontinuidad, eficiencia, eficacia, regularidad y adaptación. Entre otras, así\nse desprende de las Sentencias N° 2010-015448, N° 2014-004918, N° 2017-006082,\nN° 2019-007183 y N° 2020-007754. La disponibilidad constitucionalmente exigible\nno se satisface con la mera presencia temporal de presión en algún punto de la\nred: el agua debe ser materialmente accesible, suficiente y continua para\natender los usos personales y domésticos básicos.\n\n \n\nV.- Sobre las limitaciones técnicas, el caso fortuito y\nla obligación de mitigación. La jurisprudencia constitucional también ha\nreconocido que el derecho al agua no elimina las restricciones técnicas\nobjetivas y que no toda fluctuación de caudal u horario constituye, por sí\nsola, una lesión constitucional cuando el prestador (ICAA, ASADA, etc.)\ndemuestra haber actuado diligentemente dentro de sus posibilidades materiales.\nEse criterio fue recogido, entre otras, en la Sentencia N° 2019-008193,\ninvocada por la autoridad recurrida. Sin embargo, esa doctrina no exonera al\nprestador de prevenir riesgos previsibles, planificar la infraestructura,\ncomunicar y ordenar los racionamientos, ni suministrar alternativas suficientes\ndurante la contingencia. El artículo 9 del Reglamento para la Prestación de los\nServicios de AyA exige parámetros óptimos de calidad, cantidad, continuidad,\nconfiabilidad, igualdad, acceso universal, eficiencia, oportunidad y\nsostenibilidad, aun cuando admite excepciones por fuerza mayor, caso fortuito o\nmantenimiento. Tales excepciones son de interpretación restrictiva y únicamente\njustifican la interrupción inevitable, no la falta de medidas razonables de\nmitigación ni la persistencia de deficiencias estructurales conocidas.\n\n \n\nVI.- Sobre la jurisprudencia reciente relativa a\nracionamientos prolongados. En las Sentencias N° 2024-019544, N° 2024-019561,\nN° 2024-019565, N° 2024-019597, N° 2024-019602, N° 2024-019612 y N°\n2024-019651, esta Sala examinó racionamientos prolongados y problemas\nestructurales de abastecimiento. En lo que interesa, ordenó garantizar de\nmanera inmediata agua potable diaria y suficiente cuando la interrupción\nsuperara seis horas, y concedió un plazo máximo de dieciocho meses para\nimplementar las medidas necesarias a fin de prestar el servicio de manera\neficiente, eficaz y continua. Ese estándar resulta pertinente para valorar el\npresente asunto, sin desconocer sus particularidades probatorias.\n\n \n\nVI.- Sobre el caso concreto. Está acreditado que la\nobstrucción causada por la boya entre el tres y el cinco de julio fue\nidentificada y reparada. Considerada aisladamente, esa avería sobrevenida\npodría constituir un evento fortuito atendido en un lapso razonable. No\nobstante, el objeto del amparo no se agota en dicho episodio. Los informes\nrendidos bajo juramento reconocen un problema actual y de mayor alcance: la\nproducción del sistema disminuyó aproximadamente un setenta por ciento, hasta\ncerca de tres litros por segundo; esa capacidad no permite satisfacer la\ndemanda; existen discontinuidades, pérdidas, infraestructura vulnerable,\ntanques inoperativos y desbalances de presión; y permanecen pendientes obras de\nregulación, sustitución de tubería, almacenamiento y aprovechamiento de fuentes\nadicionales. Por ende, la propia prueba de la autoridad recurrida corrobora que\nel suministro no reúne las condiciones constitucionales de suficiencia,\ncontinuidad y regularidad.\n\n \n\nVII.- Sobre la presión en la vivienda de la recurrente.\nLa diferencia de elevación entre el medidor y la casa de la amparada puede\nexplicar técnicamente una pérdida de presión dentro de la propiedad y delimitar\nqué obras internas corresponden a su titular. Sin embargo, ese dato no\ndesvirtúa la lesión denunciada. El reclamo es comunitario y se encuentra\nrespaldado por veinte habitantes; el AyA admite que la red no satisface la\ndemanda y que faltan válvulas reguladoras de presión; y no aportó una medición\nindividual contemporánea que demuestre que, durante los períodos cuestionados,\nen el punto de conexión de la recurrente existieran presión, duración y caudal\nsuficientes. La mera referencia a presión diaria en un registrador\nrepresentativo del sector tampoco acredita acceso material durante un tiempo\nrazonable en la calle afectada. Por ello, la topografía interna no puede operar\ncomo explicación total de un desabastecimiento sistémico.\n\n \n\nVIII.- Sobre las medidas alternativas y la suficiencia\nde la respuesta institucional. El suministro por camiones cisterna es una\nmedida idónea de emergencia, pero la mención de una boleta del veintidós de\njunio no demuestra una cobertura diaria, suficiente y accesible durante los más\nde diez días denunciados en julio, ni acredita el llenado oportuno de los\ntanques comunales. Asimismo, la ejecución de la primera etapa del proyecto y\nlas reparaciones efectuadas son actuaciones relevantes, pero no neutralizan una\nvulneración que subsiste mientras las personas usuarias carezcan del líquido en\ncantidad y periodicidad aptas para sus necesidades básicas. Resulta\nparticularmente relevante la presencia de personas adultas mayores, respecto de\nquienes la respuesta alternativa debe ser accesible y no depender del traslado\nde recipientes pesados.\n\n \n\nVIII.- Conclusión. Por las razones expuestas, se\nconcluye que el AyA vulneró el artículo 50, de la Constitución Política.   "body_en_text": "031061-26. PUBLIC SERVICES. THE COMPLAINT CONCERNS THE PROLONGED WATER SHORTAGE AND INSUFFICIENT WATER PRESSURE IN THE SERVICE IN JERICÓ DE DESAMPARADOS. THE AMPARO APPLICATION IS GRANTED; THE AUTHORITIES ARE ORDERED TO ENSURE AN IMMEDIATE DAILY SUPPLY THROUGH THE NETWORK OR ALTERNATIVE MEANS, CONDUCT A TECHNICAL INSPECTION WITHIN ONE MONTH, AND CARRY OUT THE NECESSARY STRUCTURAL WORKS WITHIN EIGHTEEN MONTHS. VCG09/2026\n\n“(…) III.- Admissibility of the amparo application. Under Articles 48 of the Political Constitution and 29 of the Ley de la Jurisdicción Constitucional, the amparo proceeding protects fundamental rights and freedoms against actions, omissions, or material conduct by public agencies and officials that violate or threaten them. Resolving the dispute does not require determining property rights or substituting the Administration’s judgment on detailed technical decisions; it requires determining whether the manner in which an essential public service is provided meets the minimum content of the fundamental right expressly recognized in Article 50 of the Constitution. The matter may therefore be heard through this summary procedure.\n\nIV.- The human right of access to drinking water. Article 50 of the Political Constitution recognizes every person’s basic and inalienable human right of access to drinking water as an essential resource for life, and provides that water supply for human consumption and for communities takes priority. This Court has repeatedly held that this right is immediately connected with life, health, dignity, housing, and a healthy environment, and that, because it concerns an essential public service, its provision is subject with particular rigor to the principles of continuity, efficiency, effectiveness, regularity, and adaptability. This follows, among others, from Decisions No. 2010-015448, No. 2014-004918, No. 2017-006082, No. 2019-007183, and No. 2020-007754. Constitutionally required availability is not satisfied by the mere temporary presence of pressure at some point in the network: water must be materially accessible, sufficient, and continuous to meet basic personal and domestic needs.\n\nV.- Technical limitations, fortuitous events, and the duty to mitigate. Constitutional case law has also recognized that the right to water does not eliminate objective technical constraints, and that not every fluctuation in flow or service hours constitutes, by itself, a constitutional violation when the provider (ICAA, ASADA, etc.) demonstrates that it acted diligently within its material capabilities. This standard was adopted, among others, in Decision No. 2019-008193, cited by the respondent authority. However, that doctrine does not exempt the provider from preventing foreseeable risks, planning infrastructure, communicating and organizing rationing, or supplying sufficient alternatives during the contingency. Article 9 of the Reglamento para la Prestación de los Servicios de AyA requires optimal standards of quality, quantity, continuity, reliability, equality, universal access, efficiency, timeliness, and sustainability, although it allows exceptions for force majeure, fortuitous events, or maintenance. Those exceptions must be construed narrowly and justify only unavoidable interruptions, not the failure to take reasonable mitigation measures or the persistence of known structural deficiencies.\n\nVI.- Recent case law concerning prolonged rationing. In Decisions No. 2024-019544, No. 2024-019561, No. 2024-019565, No. 2024-019597, No. 2024-019602, No. 2024-019612, and No. 2024-019651, this Chamber examined prolonged rationing and structural water-supply problems. As relevant here, it ordered that daily, sufficient drinking water be guaranteed immediately whenever an interruption exceeded six hours, and set a maximum period of eighteen months to implement the measures necessary to provide the service efficiently, effectively, and continuously. That standard is relevant to assessing this case, without disregarding its particular evidentiary circumstances.\n\nVI.- The specific case. It is established that the obstruction caused by the float between the third and fifth of July was identified and repaired. Considered in isolation, that unexpected breakdown could constitute a fortuitous event addressed within a reasonable period. However, the subject of the amparo is not limited to that incident. The reports submitted under oath acknowledge a current and broader problem: system output fell by approximately seventy percent, to nearly three liters per second; that capacity is insufficient to meet demand; there are service interruptions, losses, vulnerable infrastructure, inoperative tanks, and pressure imbalances; and works to regulate the system, replace pipes, increase storage, and tap additional sources remain pending. Accordingly, the respondent authority’s own evidence confirms that the supply does not meet the constitutional requirements of sufficiency, continuity, and regularity.\n\nVII.- Water pressure at the amparo applicant’s home. The difference in elevation between the meter and the amparo applicant’s house may technically explain a loss of pressure within the property and delimit which internal works are the responsibility of its owner. However, that fact does not refute the alleged violation. The complaint concerns the community and is supported by twenty residents; AyA acknowledges that the network does not meet demand and that pressure-regulating valves are lacking; and it provided no contemporaneous individual measurement demonstrating that, during the periods at issue, pressure, duration, and flow at the applicant’s connection point were sufficient. Merely referring to daily pressure recorded by a logger representative of the area also does not establish material access for a reasonable period on the affected street. The property’s internal topography therefore cannot serve as a complete explanation for a systemic water shortage.\n\nVIII.- Alternative measures and the adequacy of the institutional response. Supply by tanker trucks is a suitable emergency measure, but reference to a service slip dated 22 June does not demonstrate daily, sufficient, and accessible coverage during the more than ten days of shortages reported in July, nor does it establish that the community tanks were filled in a timely manner. Likewise, carrying out the first stage of the project and making repairs are relevant actions, but they do not remedy a violation that continues while users lack water in quantities and at intervals adequate to meet their basic needs. The presence of older adults is particularly relevant; any alternative response for them must be accessible and must not depend on their carrying heavy containers.\n\nVIII.- Conclusion. For the reasons stated, it is concluded that AyA violated Article 50 of the Political Constitution. The seasonal decline in water sources and the isolated breakdown explain part of the contingency, but do not justify service being available for periods that are materially insufficient or the lack of a verified alternative supply during prolonged interruptions. The Chamber cannot prescribe a particular engineering project or grant literally the request to set eight hours of service per day, since it is for the technical entity to choose appropriate solutions and give reasons for them. It is appropriate, however, to order a verifiable constitutional outcome: the immediate provision of daily, sufficient drinking water whenever an interruption exceeds six hours; a specific inspection and measurement at the amparo applicant’s connection point; technical information about any internal measures for which she may be responsible; and completion, within a maximum period of eighteen months, of the actions necessary for the Sistema Jericó to provide an efficient, effective, continuous service with regulatory pressure at the connection points. The plan must take account of the needs of vulnerable residents and the works that the institution’s own assessment identifies as pending. (…)”"
