SALA DECLARA SIN LUGAR PORQUE EL AYA ACREDITÓ MEDIDAS DE CONTINGENCIA, EJECUCIÓN DE OBRAS DE MEJORA Y QUE LA AFECTACIÓN DEL SERVICIO RESPONDÍA A CONDICIONES TÉCNICAS Y OPERATIVAS DEL ACUEDUCTO, SIN CONFIGURARSE UNA OMISIÓN ARBITRARIA EN EL ACCESO AL AGUA POTABLE. VCG09/2026\n\n“(…) III.- SOBRE EL CASO CONCRETO. La recurrente acusa\nque, desde hace más de un año, su vivienda ubicada en La Guácima de Alajuela\ncarece de suministro de agua potable por medio de tubería y que el\nabastecimiento mediante camiones cisterna se presta de forma irregular. Añade\nque, pese a los reportes formulados ante el Instituto Costarricense de\nAcueductos y Alcantarillados y a la solicitud de revisión del medidor, la\nsituación no ha mejorado, lo que a su criterio, pone en riesgo la salud y las\ncondiciones de higiene de su hogar. En particular, reclama que, entre el 07 y\nel 12 de julio de 2026, únicamente recibió agua mediante camión cisterna el 11\nde julio de ese año.\n\nEl acceso al agua potable constituye un presupuesto\nindispensable para el disfrute de la vida, la salud y la dignidad humana. De\nahí que las autoridades encargadas de su prestación deban adoptar las medidas\nnecesarias para garantizar que la población disponga de agua apta para el\nconsumo humano en condiciones razonables de cantidad, calidad, continuidad y\naccesibilidad. Sin embargo, la tutela constitucional no implica que el\nsuministro deba prestarse, en toda circunstancia, exclusivamente por medio de la\nred de tuberías ni que cualquier disminución temporal de la presión,\ninterrupción o irregularidad técnica configure, por sí misma, una lesión de\nderechos fundamentales. Lo determinante es establecer si la Administración ha\nincurrido en una negativa arbitraria, una omisión injustificada o una\ndesatención absoluta de la problemática, o si, por el contrario, ha\nimplementado medios alternativos y acciones razonables para garantizar el\nacceso al líquido mientras se solventan las limitaciones que afectan el sistema.\n\nEn tal sentido, la jurisprudencia de esta Sala ha\nreconocido el reparto de agua potable mediante camiones cisterna u otros\nmecanismos alternativos como una medida idónea de contingencia frente a\ninterrupciones prolongadas del servicio ordinario. Por ello, la utilización de\nese mecanismo no constituye, en sí misma, una infracción constitucional; la\nvulneración surgiría cuando, pese a la suspensión o insuficiencia del servicio\npor tubería, la autoridad omita adoptar medidas alternativas razonables para\ndisminuir al máximo la carencia del recurso.\n\nEn este asunto, de los hechos acreditados y de los\ninformes rendidos bajo juramento no se desprende una ausencia absoluta del\nsuministro de agua potable ni una actitud indiferente u omisiva de las\nautoridades recurridas. Por el contrario, se comprobó que el sector donde se\nlocaliza el inmueble de la recurrente forma parte de las zonas abastecidas por\nel Acueducto El Pasito que, por encontrarse en una posición topográfica elevada\nrespecto de la cota del tanque y por las condiciones hidráulicas del sistema, presentan\nbaja presión y dificultades de abastecimiento durante las horas de mayor\nconsumo. Ante esa situación, el Instituto recurrido dispuso, como medida\ncomplementaria, la distribución programada de agua potable mediante camiones\ncisterna los lunes, miércoles y viernes, con el fin de llenar los tanques de\nalmacenamiento de las personas usuarias afectadas. De esta manera, aun cuando\nel suministro por tubería no se presta con la continuidad deseable, la\ninstitución no ha dejado a la comunidad desprovista de mecanismos de\nabastecimiento.\n\nTampoco pasa inadvertido que, entre el 07 y el 12 de\njulio de 2026, el camión cisterna únicamente pudo abastecer el sector el 11 de\njulio. No obstante, esa disminución temporal en la frecuencia fue explicada por\nuna contingencia operativa concreta: la salida de servicio de un pozo ubicado\nen el Plantel El Cacique, en Alajuela, que afectó las partes altas del\nAcueducto El Pasito y obligó a redistribuir los dos camiones cisterna\ndisponibles entre un número mayor de comunidades. Así, no se trató de la supresión\ndeliberada o injustificada del abastecimiento alternativo, sino de una\nsituación extraordinaria que incidió temporalmente en la capacidad operativa\ndel Instituto y frente a la cual la Administración efectuó una redistribución\nde sus recursos disponibles. Tal circunstancia, considerada aisladamente y\ndentro del contexto descrito, no permite concluir que se haya producido una\ndesatención arbitraria de las necesidades de la recurrente.\n\nAdemás, las autoridades recurridas no se limitaron a\nimplementar medidas de contingencia. El 05 de julio de 2026 concluyó el proceso\nde recepción definitiva del Proyecto de Mejoras del Acueducto El Pasito,\nconcebido como una solución estructural destinada a fortalecer la capacidad\nhidráulica del sistema y mejorar progresivamente el abastecimiento de las\ncomunidades ubicadas en las zonas de mayor elevación. Si bien al momento de\nrendirse el informe se encontraba pendiente el llenado y la entrada en operación\ndel tanque de acero vitrificado denominado “Tanque La Amistad” la ejecución y\nconclusión de las obras evidencia que el Instituto ha desplegado actuaciones\ndirigidas a solucionar de manera permanente la problemática, y no únicamente a\nmitigar sus efectos inmediatos.\n\nA lo anterior se suma una circunstancia particular y\ndeterminante relacionada con el inmueble de la recurrente. El servicio\nidentificado con el NIS No. 2010024 fue instalado y autorizado para abastecer\nuna sola unidad habitacional; sin embargo, durante la inspección realizada en\nabril de 2024 se constató que suministraba agua a una vivienda y nueve\napartamentos adicionales, mediante varios tanques de almacenamiento. Esa\nmultiplicación de las unidades abastecidas incrementa significativamente la\ndemanda sobre una conexión dimensionada para una única vivienda y disminuye la\ncapacidad de reserva del agua almacenada. En consecuencia, la insuficiencia\nadvertida en el inmueble no puede atribuirse exclusivamente a una conducta de\nla Administración, pues concurre un uso del servicio distinto y\nconsiderablemente superior al originalmente autorizado.\n\nDe especial relevancia resulta, además, que el 21 de\njulio de 2026, al atenderse el reporte No. 54670936, el personal operativo del\nInstituto inspeccionó el servicio y comprobó que la llave Ford ubicada en el\nconjunto del hidrómetro se encontraba cerrada. Tal condición impedía\nfísicamente el ingreso del agua desde la red pública hacia la propiedad,\nincluso durante las horas de la noche y la madrugada, cuando la disminución del\nconsumo general permite un aumento de la presión y del caudal en el Acueducto El\nPasito. El personal procedió de inmediato a abrir la llave, con lo cual se\nrestableció la posibilidad de que el agua proveniente de la red ingresara al\ninmueble y llenara sus tanques de almacenamiento durante esos períodos. Este\nelemento objetivo desvirtúa la afirmación de que la falta de ingreso de agua\npor tubería obedeciera únicamente a una omisión del Instituto recurrido, pues\nuna de sus causas inmediatas era el cierre de la llave de paso del propio\nservicio.\n\nAsí las cosas, el cuadro fáctico acreditado no revela\nuna negativa institucional a brindar agua potable ni una suspensión absoluta y\narbitraria del servicio. Se ha mantenido un programa de abastecimiento mediante\ncamiones cisterna; se atendió el reporte formulado por la interesada; se\ninspeccionó la conexión; se corrigió la posición de la llave Ford que impedía\nel ingreso del líquido; y se ejecutó un proyecto de infraestructura destinado a\nmejorar de manera permanente las condiciones hidráulicas del Acueducto El\nPasito. Además, se comprobó que el servicio autorizado para una vivienda se\nutiliza para abastecer diez unidades habitacionales, circunstancia que incide\ndirectamente en la disponibilidad y duración del agua almacenada. Las\nautoridades recurridas explicaron tales circunstancias de manera concordante en\nsus informes.\n\nLa Sala no desconoce las molestias y dificultades que\npuede provocar la baja presión o la imposibilidad de recibir agua por tubería\ndurante determinadas horas. No obstante, el recurso de amparo no tiene por\nobjeto garantizar a las personas usuarias una modalidad específica de\nprestación del servicio, sustituir a la Administración en la gestión técnica\ndel acueducto o exigir la eliminación inmediata de toda limitación hidráulica,\nsino tutelar frente a actuaciones u omisiones arbitrarias que impidan el acceso\nal agua potable. En este caso, no se ha demostrado que la recurrente se\nencuentre privada absolutamente del líquido ni que el Instituto haya dejado de\nadoptar medidas razonables para asegurar su abastecimiento. Tampoco se acredita\nque la programación mediante camiones cisterna, valorada junto con la\nposibilidad de recibir agua por tubería durante las horas de mayor presión,\nresulte manifiestamente inexistente o ineficaz respecto de la unidad\nhabitacional para la cual fue autorizado el servicio.\n\nPor consiguiente, a partir de una valoración integral\nde la situación denunciada, de las condiciones técnicas del Acueducto El\nPasito, de las medidas de contingencia adoptadas, de la solución estructural\nejecutada y de las circunstancias particulares comprobadas en el inmueble, no\nse acredita una actuación u omisión arbitraria atribuible al Instituto\nCostarricense de Acueductos y Alcantarillados que lesione el derecho\nfundamental de la recurrente al acceso al agua potable.\n\nIV.- En consecuencia, procede declarar sin lugar el\nrecurso, sin perjuicio del deber de la institución recurrida de mantener las\nmedidas alternativas de abastecimiento y continuar las actuaciones necesarias\npara lograr la plena operación de las mejoras efectuadas en el acueducto.   "body_en_text": "031081-26. PUBLIC SERVICES. THE IRREGULAR SUPPLY OF WATER BY WATER TANKER TRUCKS IN LA GUÁCIMA DE ALAJUELA IS CHALLENGED. THE CHAMBER DENIES THE AMPARO APPLICATION BECAUSE AYA ESTABLISHED THAT IT HAD TAKEN CONTINGENCY MEASURES, CARRIED OUT IMPROVEMENT WORKS, AND THAT THE SERVICE DISRUPTION RESULTED FROM TECHNICAL AND OPERATIONAL CONDITIONS OF THE WATER SYSTEM, WITH NO ARBITRARY OMISSION IN ACCESS TO DRINKING WATER. VCG09/2026\n\n“(…) III.- THE SPECIFIC CASE. The applicant alleges that, for more than a year, her home in La Guácima de Alajuela has lacked a piped supply of drinking water and that water tanker deliveries have been irregular. She adds that, despite reports submitted to the Costa Rican Institute of Aqueducts and Sewers and a request to inspect the meter, the situation has not improved, which, in her view, places her household’s health and hygiene at risk. In particular, she complains that between 07 and 12 July 2026, she received water by tanker truck only on 11 July of that year.\n\nAccess to drinking water is essential for the enjoyment of life, health, and human dignity. Accordingly, the authorities responsible for providing it must take the measures necessary to ensure that the population has water fit for human consumption in reasonable quantities and with reasonable quality, continuity, and accessibility. However, constitutional protection does not mean that the supply must, in every circumstance, be provided exclusively through the pipe network, or that every temporary decrease in pressure, interruption, or technical irregularity, by itself, constitutes a violation of fundamental rights. What matters is whether the Administration has acted arbitrarily in refusing service, unjustifiably failed to act, or wholly neglected the problem, or whether, on the contrary, it has implemented alternative means and taken reasonable steps to ensure access to water while addressing the limitations affecting the system.\n\nIn this regard, the case law of this Chamber has recognized the distribution of drinking water by tanker trucks or other alternative means as a suitable contingency measure in response to prolonged interruptions in regular service. Therefore, use of that measure does not, in itself, constitute a constitutional violation; a violation would arise if, despite the suspension or insufficiency of the piped service, the authority failed to take reasonable alternative measures to reduce the shortage as much as possible.\n\nIn this matter, the established facts and the reports submitted under oath do not show a total absence of drinking water or an indifferent or inactive attitude on the part of the respondent authorities. On the contrary, it was established that the area where the applicant’s property is located is among those served by the El Pasito Water System, which, because of its elevated topographic position relative to the tank’s elevation and the system’s hydraulic conditions, experiences low pressure and supply difficulties during peak consumption hours. In response, the respondent Institute arranged, as a supplementary measure, for scheduled drinking-water deliveries by tanker truck on Mondays, Wednesdays, and Fridays, to fill the storage tanks of affected users. Thus, although piped supply is not provided with the desired continuity, the institution has not left the community without means of obtaining water.\n\nIt also bears noting that, between 07 and 12 July 2026, the tanker truck was able to serve the area only on 11 July. However, this temporary reduction in frequency was explained by a specific operational contingency: a well at the El Cacique Facility in Alajuela went out of service, affecting the higher parts of the El Pasito Water System and requiring the two available tanker trucks to be redistributed among a larger number of communities. Thus, this was not a deliberate or unjustified discontinuation of alternative supply, but an extraordinary situation that temporarily affected the Institute’s operational capacity and in response to which the Administration redistributed its available resources. Considered in isolation and in the context described, this circumstance does not support the conclusion that the applicant’s needs were arbitrarily neglected.\n\nMoreover, the respondent authorities did not limit themselves to implementing contingency measures. On 05 July 2026, the final acceptance process for the El Pasito Water System Improvement Project was completed. The project was conceived as a structural solution to strengthen the system’s hydraulic capacity and progressively improve supply to communities in the higher-elevation areas. Although, when the report was submitted, filling the vitrified-steel tank known as “Tanque La Amistad” and placing it into operation were still pending, the execution and completion of the works show that the Institute has taken steps aimed at permanently resolving the problem, rather than merely mitigating its immediate effects.\n\nA further particular and decisive circumstance concerns the applicant’s property. The service identified by NIS No. 2010024 was installed and authorized to supply a single dwelling; however, during an inspection in April 2024, it was found to supply one house and nine additional apartments through several storage tanks. This increase in the number of units served significantly raises demand on a connection sized for one dwelling and reduces the reserve capacity of the stored water. Consequently, the insufficiency observed at the property cannot be attributed exclusively to the Administration’s conduct, since the service is being used in a manner different from, and considerably exceeding, what was originally authorized.\n\nAlso of particular relevance is that, on 21 July 2026, when report No. 54670936 was addressed, the Institute’s operations staff inspected the service and found that the Ford valve located in the water-meter assembly was closed. This condition physically prevented water from entering the property from the public network, even during the evening and early morning hours, when reduced general consumption allows pressure and flow in the El Pasito Water System to increase. Staff promptly opened the valve, making it possible for water from the network to enter the property and fill its storage tanks during those periods. This objective fact refutes the claim that the failure of piped water to enter the property was due solely to an omission by the respondent Institute, since one immediate cause was the closure of the service’s own shutoff valve.\n\nIn these circumstances, the established facts do not reveal an institutional refusal to provide drinking water or an absolute and arbitrary suspension of service. A tanker-truck supply program has been maintained; the report submitted by the interested party was addressed; the connection was inspected; the position of the Ford valve that prevented water from entering was corrected; and an infrastructure project intended to permanently improve the hydraulic conditions of the El Pasito Water System was carried out. It was also established that the service authorized for one dwelling is used to supply ten dwelling units, a circumstance that directly affects the availability and duration of stored water. The respondent authorities explained these circumstances consistently in their reports.\n\nThe Chamber does not disregard the inconvenience and difficulties that low pressure or the inability to receive piped water at certain times may cause. Nevertheless, an amparo proceeding is not intended to guarantee users a particular method of service delivery, to replace the Administration in the technical management of the water system, or to require the immediate elimination of every hydraulic limitation. Its purpose is to protect against arbitrary actions or omissions that prevent access to drinking water. In this case, it has not been shown that the applicant is wholly deprived of water or that the Institute has failed to take reasonable measures to ensure her supply. Nor has it been established that the scheduled tanker-truck deliveries, considered together with the possibility of receiving piped water during hours of higher pressure, are manifestly unavailable or ineffective for the dwelling unit for which the service was authorized.\n\nAccordingly, based on an overall assessment of the reported situation, the technical conditions of the El Pasito Water System, the contingency measures taken, the structural solution carried out, and the particular circumstances established at the property, no arbitrary action or omission attributable to the Costa Rican Institute of Aqueducts and Sewers that violates the applicant’s fundamental right of access to drinking water has been established.\n\nIV.- Accordingly, the amparo application must be denied, without prejudice to the respondent institution’s duty to maintain alternative supply measures and continue the steps necessary to achieve full operation of the improvements made to the water system.
