SE ACREDITA QUE LA RED SANITARIA NUNCA FUE HABILITADA, QUE LAS CONEXIONES ERAN ILEGALES Y GENERABAN REBALSES, MALOS OLORES Y RIESGOS PARA LA SALUD Y EL AMBIENTE, Y QUE LOS SISTEMAS INDIVIDUALES DE TANQUES SÉPTICOS Y DRENAJES FUERON LA SOLUCIÓN TÉCNICA ORIGINALMENTE APROBADA PARA LA URBANIZACIÓN. SE DECLARA SIN LUGAR EL RECURSO. VCG09/2026\n\n “(…) VI.- SOBRE\nEL CASO CONCRETO. En el sub examine, la parte recurrente aduce que es residente\nde una vivienda ubicada en Urbanización Brisas de Salitrillos, Mata de Plátano\nde Goicoechea. Acusa que existen conexiones ilegales de aguas residuales y,\nademás, el alcantarillado sanitario existente en el sector no se encuentra en\noperación, lo cual produce contaminación ambiental. Alega que las autoridades\naccionadas no han atendido adecuadamente la problemática. Reclama que las\ninstituciones recurridas pretenden que los vecinos de su comunidad,\nincluyéndolo, construyan tanques sépticos en sus hogares, lo cual no es la\nsolución adecuada, pues se produce contaminación de mantos acuíferos y\nafectaciones ambientales. Al respecto, en relación con el municipio accionado,\nla Sala tiene por demostrado que en el sector de Las Brisas de Salitrillo,\nexiste infraestructura de alcantarillado sanitario, perteneciente al ICAA, la\ncual fue construida como previsión para un futuro sistema de alcantarillado\nsanitario. Varios propietarios realizaron conexiones directas y sin\nautorización a dicha red sanitaria. Lo anterior ocasionó problemas de\nfuncionamiento, malos olores y afectaciones de carácter sanitario. El ICAA\ncomunicó a los propietarios que debían desconectarse de la red sanitaria, que\naún no se encontraba habilitada. Las personas que habían realizado conexiones\nirregulares procedieron a efectuar la desconexión correspondiente, dando\ncumplimiento a las disposiciones emitidas por las autoridades. Actualmente los\ninmuebles cuentan con sistemas individuales de tratamiento de aguas residuales.\nLas conexiones ilegales se dieron inclusive a pozos destinados para la\nrecepción de aguas pluviales, lo que representa un impacto ambiental negativo\nimportante: olores, taponamientos y posible afectación de la salud de los\nhabitantes del lugar. Por otro lado, en relación en el Ministerio de Salud, se\ntiene por acreditado que, efectivamente, existen conexiones ilícitas que\nestarían generando malos olores en el pozo y rebalses temporales. En fecha 14\nde enero de 2026, el Ministerio de Salud comunicó que la situación estaba\nsiendo atendida mediante coordinación interinstitucional entre el ICAA, la\nMunicipalidad de Goicoechea y el Ministerio de Salud. En fecha 14 de enero de\n2026, se realizó una inspección conjunta entre el Ministerio de Salud y el\nICAA, en la cual se corroboraron los afloramientos de aguas residuales en\nBarrio Las Brisas. El ICAA informó que la limpieza del pozo afectado se había\nprogramado para el 5 de febrero de 2026. El 17 de marzo de 2026, se ordenó\nemitir un comunicado oficial dirigido a la comunidad de Mata de Plátano de\nGoicoechea, mediante el cual se informó que, durante las inspecciones\nrealizadas, se identificaron conexiones ilegales de aguas residuales hacia\nsistemas pluviales administrados por el gobierno local, así como hacia el\nalcantarillado sanitario no operativo, con descarga directa en los pozos\nsanitarios N°160A-059, 160A-0152 y 1060A-051. En dicho comunicado se informó\nque, en un plazo máximo de TRES MESES, se procedería con la clausura de esos\npozos, en atención a la afectación que la situación generaba a los vecinos\nubicados aguas abajo. En fecha 3 de julio de 2026, se realizaron los primeros\ncierres de las entradas y salidas de los pozos de registro sanitario. Al vencer\nel plazo otorgado a las personas propietarias mediante el comunicado, se habían\nejecutado las medidas correctivas y se habían sellado las entradas y salidas de\nlos pozos de registro sanitario involucrados. El ICAA selló las entradas y\nsalidas de los pozos de registro sanitario involucrados entre el 3 y el 11 de\njulio de 2026. Finalmente, en cuanto al ICAA, esta Sala logra acreditar que en\nla zona donde habita el tutelado no se encuentra habilitado ningún sistema\ncolectivo de recolección y tratamiento de las aguas residuales. Las aguas\nresiduales de las viviendas en Barrio Las Brisas deben ser tratadas con\nsistemas individuales de tanques sépticos. En el año 2000 se presentó el diseño\nsanitario por parte de la empresa desarrolladora de la Urbanización Las Brisas\nante las autoridades competentes, estableciéndose como solución técnica la\nutilización de tanques sépticos y campos de infiltración individuales. Como\nparte del procedimiento habitual para los respectivos permisos para urbanizar\nla finca en la que se asienta actualmente la Urbanización Brisas de\nSalitrillos, el ICAA, a través del oficio N°152 del 22 de abril de 1998, aprobó\nla solicitud de dotación para el servicio de agua potable y denegó la\ndisponibilidad en la disponibilidad del servicio de alcantarillado sanitario.\nEl desarrollador de la urbanización llevó a cabo estudios de infiltración en\nvarios puntos de la propiedad, los cuales son consistentes con el hecho de que\nel uso de tanque séptico y drenajes resultaba factible como medio de disposición\nindividual para las aguas residuales domiciliares. No todos los sectores de la\nGAM pueden conectarse al sistema de alcantarillado pluvial, pues existen\nrazones técnicas como por ejemplo la topografía de los terrenos, que impiden\nque puedan ser conectados a dicha red, a pesar de estar dentro del área de\ncobertura. Existe contaminación de aguas residuales en la Urbanización Las\nBrisas de Salitrillos, donde se han identificado interconexiones ilícitas a la\nred prevista del sistema sanitario que no se encuentra en uso. El proyecto de\nalcantarillado sanitario de la GAM se denomina: “Proyecto Mejoramiento del\nAmbiental del Área Metropolitana” que está realizando el ICAA de acuerdo con el\nmandato dado por la Ley Nº 8559 denominada \"Aprobación del Contrato de\nPréstamo Externo N° CRP4, suscrito por el Gobierno de la República de Costa\nRica y el Banco Japonés para la Cooperación Internacional (JBIC), para\nFinanciar Proyecto Mejoramiento del Medio Ambiente del área\nMetropolitana.\" A pesar de incluirse a varios cantones de la GAM, entre\nellos Goicoechea, no todos los sectores podrán ser interconectados al sistema,\npor lo que muchas personas o empresas que tienen sistemas de tratamiento por\nmedio de tanques sépticos, deben seguir tratando sus aguas por estos medios que\nson sistemas de tratamiento válidos y que funcionan adecuadamente si se\nejecutan de manera correcta y se les da el mantenimiento requerido por parte\ndel propietario. Ante este panorama, estima la Sala que se debe declarar sin\nlugar el recurso. Como puede constatarse del elenco de hechos probados,\nciertamente se han detectado problemas de contaminación por la inadecuada\ndisposición final de aguas residuales de algunas viviendas de la Urbanización\nLas Brisas, en Salitrillo de Goicoechea. Sin embargo, la situación ha sido\natendida de manera satisfactoria por las autoridades involucradas en este\namparo, especialmente por el Ministerio de Salud y el ICAA. De conformidad con\nlos informes emitidos por dichas instancias públicas, durante este año 2026 se\natendió la situación de contaminación generada debido a la conexión ilegal de\nalgunos vecinos al sistema de alcantarillado pública que todavía no está en\noperación por parte del ICAA. Se desprende de los autos que se identificaron\nconexiones ilegales de aguas residuales hacia sistemas pluviales existentes,\ntanto los administrados por el gobierno local, así como hacia el alcantarillado\nsanitario no operativo del ICAA, con descarga directa en los pozos sanitarios\nN°160A-059, 160A-0152 y 1060A-051. En virtud de ello, se concedió un plazo\nmáximo de TRES MESES a los vecinos responsables para corregir la situación,\npues se procedería con la clausura de esos pozos, en atención a la afectación\nque la situación generaba al medio ambiente. Justamente el pasado 3 de julio de\n2026, se realizaron los primeros cierres de las entradas y salidas de los pozos\nde registro sanitario. A partir de lo informado por el Ministerio de Salud en\neste amparo, al vencer el plazo otorgado a las personas propietarias, se habían\nejecutado las medidas correctivas y se habían sellado las entradas y salidas de\nlos pozos de registro sanitario involucrados, siendo que el ICAA selló las\nentradas y salidas de los pozos de registro sanitario involucrados entre el 3 y\nel 11 de julio de 2026. El presente recurso de amparo fue interpuesto el 15 de\njulio de 2026, de manera que, a criterio de este Tribunal, la situación\nambiental denunciada fue atendida con anterioridad a la presentación del\npresente proceso. Ergo, por las razones expuestas, procede la desestimatoria\ndel amparo.\n\nVII.- TOME NOTA. Estima la Sala que es necesario\nrecordarle a las autoridades accionadas, especialmente al Ministerio de Salud y\nal ICAA, su responsabilidad en la supervisión y vigilancia del adecuado uso que\nhacen los vecinos de la Urbanización Las Brisas al sistema de alcantarillado\nsanitario existente, así como la revisión periódica de las condiciones\nambientales en dicho sector, debido a los antecedentes irregulares detectados\nen este amparo. En consideración de la Sala, es lógico pensar que dichas conductas\ntan reprochables podrían repetirse por parte de los vecinos de dicho sector,\ngenerando con ello nuevamente una afectación grave al medio ambiente, a la\ninfraestructura pública y, por consiguiente, al adecuado uso de los fondos\npúblicos. De ahí la preocupación de este Tribunal para que los accionados\nmantengan una vigilancia periódica de los hechos denunciados en este amparo. (…)”",

IT IS ALLEGED THAT, BECAUSE THE SANITARY SEWER SYSTEM IN URBANIZACIÓN BRISAS DE SALITRILLOS, MATA DE PLÁTANO DE GOICOECHEA, IS NOT OPERATING, RESIDENTS ARE BEING REQUIRED TO DISCONNECT FROM THE NETWORK AND RESTORE SEPTIC TANKS, SHIFTING THE CONSEQUENCES OF PUBLIC INFRASTRUCTURE DEFICIENCIES ONTO THEM. IT IS ESTABLISHED THAT THE SANITARY SEWER NETWORK WAS NEVER PUT INTO OPERATION, THAT THE CONNECTIONS WERE ILLEGAL AND CAUSED OVERFLOWS, BAD ODORS, AND RISKS TO HEALTH AND THE ENVIRONMENT, AND THAT INDIVIDUAL SEPTIC TANK AND DRAINAGE SYSTEMS WERE THE TECHNICAL SOLUTION ORIGINALLY APPROVED FOR THE DEVELOPMENT. THE AMPARO APPLICATION IS DECLARED WITHOUT MERIT. VCG09/2026\n\n“(…) VI.- THE SPECIFIC CASE. In the case under review, the applicant alleges that they reside in a home located in Urbanización Brisas de Salitrillos, Mata de Plátano de Goicoechea. They complain that there are illegal wastewater connections and that the existing sanitary sewer system in the area is not operating, which causes environmental pollution. They allege that the respondent authorities have not adequately addressed the problem. They complain that the respondent institutions intend for residents of their community, including the applicant, to build septic tanks in their homes, which is not an appropriate solution because it causes contamination of aquifers and environmental harm. In this regard, as to the respondent municipality, the Chamber finds it established that in the Las Brisas area there is sanitary sewer infrastructure belonging to ICAA, which was built in anticipation of a future sanitary sewer system. Several property owners made direct, unauthorized connections to that sanitary network. This caused operational problems, bad odors, and sanitary impacts. ICAA informed the property owners that they had to disconnect from the sanitary network, which had not yet been put into operation. Those who had made irregular connections proceeded to disconnect, complying with the directives issued by the authorities. The properties currently have individual wastewater treatment systems. Illegal connections were even made to wells intended to receive stormwater, representing a significant negative environmental impact: odors, blockages, and possible harm to the health of local residents. On the other hand, as to the Ministerio de Salud, it is established that illicit connections do exist and were causing bad odors at the well and temporary overflows. On 14 January 2026, the Ministerio de Salud reported that the matter was being addressed through interinstitutional coordination among ICAA, the Municipalidad de Goicoechea, and the Ministerio de Salud. On 14 January 2026, the Ministerio de Salud and ICAA conducted a joint inspection, during which wastewater surfacing was confirmed in Barrio Las Brisas. ICAA reported that cleaning of the affected well had been scheduled for 5 February 2026. On 17 March 2026, it was ordered that an official notice be issued to the community of Mata de Plátano de Goicoechea, reporting that inspections had identified illegal wastewater connections to stormwater systems administered by the local government, as well as to the non-operational sanitary sewer system, with direct discharge into sanitary wells N°160A-059, 160A-0152 and 1060A-051. The notice stated that those wells would be closed within a maximum period of THREE MONTHS, in view of the harm the situation was causing to residents downstream. On 3 July 2026, the first closures of the inlets and outlets of the sanitary manholes were carried out. By the time the period granted to property owners in the notice expired, corrective measures had been implemented and the inlets and outlets of the sanitary manholes concerned had been sealed. ICAA sealed the inlets and outlets of the sanitary manholes concerned between 3 and 11 July 2026. Finally, as to ICAA, this Chamber establishes that no collective wastewater collection and treatment system has been put into operation in the area where the protected party lives. Wastewater from homes in Barrio Las Brisas must be treated using individual septic tank systems. In 2000, the developer of Urbanización Las Brisas submitted the sanitary design to the competent authorities, establishing individual septic tanks and infiltration fields as the technical solution. As part of the usual procedure for obtaining the respective permits to develop the property on which Urbanización Brisas de Salitrillos now stands, ICAA, by means of official letter N°152 of 22 April 1998, approved the application for provision of drinking water service and denied availability of sanitary sewer service. The developer conducted infiltration studies at several points on the property, which are consistent with the fact that septic tanks and drainage were feasible as an individual means of disposing of domestic wastewater. Not all areas of the GAM can connect to the stormwater sewer system; technical reasons, such as the topography of the land, can prevent connection to that network, despite being within its coverage area. Wastewater pollution exists in Urbanización Las Brisas de Salitrillos, where illicit interconnections have been identified to the planned sanitary system network, which is not in use. The GAM sanitary sewer project is called “Proyecto Mejoramiento del Ambiental del Área Metropolitana,” which ICAA is carrying out pursuant to the mandate in Ley Nº 8559, entitled “Aprobación del Contrato de Préstamo Externo N° CRP4, suscrito por el Gobierno de la República de Costa Rica y el Banco Japonés para la Cooperación Internacional (JBIC), para Financiar Proyecto Mejoramiento del Medio Ambiente del área Metropolitana.” Although several cantons in the GAM, including Goicoechea, are included, not all areas can be interconnected to the system. Therefore, many people or businesses with treatment systems using septic tanks must continue treating their wastewater through those means, which are valid treatment systems and function properly when correctly implemented and maintained by the owner. In light of this, the Chamber finds that the amparo should be declared without merit. As can be seen from the established facts, pollution problems have indeed been detected as a result of inadequate final disposal of wastewater from some homes in Urbanización Las Brisas, in Salitrillo de Goicoechea. However, the authorities involved in this amparo, especially the Ministerio de Salud and ICAA, have addressed the situation satisfactorily. According to the reports issued by those public bodies, during 2026 the pollution caused by some residents’ illegal connection to the public sewer system, which ICAA has not yet put into operation, was addressed. The record shows that illegal wastewater connections were identified to existing stormwater systems, both those administered by the local government and the non-operational sanitary sewer system belonging to ICAA, with direct discharge into sanitary wells N°160A-059, 160A-0152 and 1060A-051. As a result, the responsible residents were granted a maximum period of THREE MONTHS to correct the situation, since the wells would be closed because of the harm the situation was causing to the environment. Indeed, on 3 July 2026, the first closures of the inlets and outlets of the sanitary manholes were carried out. Based on the information provided by the Ministerio de Salud in this amparo, by the time the period granted to the property owners expired, corrective measures had been implemented and the inlets and outlets of the sanitary manholes concerned had been sealed, with ICAA sealing those inlets and outlets between 3 and 11 July 2026. This amparo application was filed on 15 July 2026; accordingly, in this Tribunal’s view, the reported environmental situation had been addressed before this proceeding was filed. Therefore, for the reasons set out, the amparo must be dismissed.\n\nVII.- NOTE. The Chamber finds it necessary to remind the respondent authorities, especially the Ministerio de Salud and ICAA, of their responsibility to supervise and monitor the proper use by residents of Urbanización Las Brisas of the existing sanitary sewer system, as well as to periodically review environmental conditions in that area, given the irregularities identified in this amparo. In the Chamber’s view, it is reasonable to think that such reprehensible conduct could recur among residents of the area, again causing serious harm to the environment and public infrastructure, and consequently impairing the proper use of public funds. Hence this Tribunal’s concern that the respondents maintain periodic monitoring of the events reported in this amparo. (…)”"
