  "body_es_text": "ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA\n\n“(…) V.- SOBRE EL DERECHO A UN AMBIENTE SANO Y\nECOLÓGICAMENTE EQUILIBRADO. En reiteradas ocasiones, la jurisprudencia de esta\nSala ha reconocido que la salud pública y el derecho a un ambiente sano y\necológicamente equilibrado se encuentran reconocidos tanto a nivel\nconstitucional como a través de la normativa internacional. Se ha indicado que\nel ejercicio legítimo de ese derecho requiere que los recursos sean utilizados\nde manera racional, y que corresponde al Estado la protección del ambiente,\nsegún el principio precautorio que rige en materia ambiental. Este principio\nobliga al Estado a disponer todo lo que sea necesario, dentro del ámbito\npermitido por la ley, a efectos de impedir que se produzcan daños irreversibles\nal ambiente, para cuyo efecto es responsable de lograr las condiciones sociales\npropicias a fin de que cada persona pueda disfrutar de su salud, entendido este\nderecho como una situación de bienestar físico, psíquico (o mental) y social\n(véase Sentencia Nº 1998-180 de las 16:24 horas del 13 de enero de 1998). La\nobligación objetiva del Estado en materia de protección ambiental no apareja,\nineludiblemente, un derecho subjetivo de las personas a exigir, a través de los\norganismos judiciales, que se tome una medida determinada, pero sí a que se adopten\nlas que sean idóneas en tutela de ese derecho, ante actitudes abiertamente\nnegligentes de las autoridades públicas, o bien, de personas físicas y\njurídicas.   "body_en_text": "ARTICLE 50 OF THE POLITICAL CONSTITUTION\n\n“(…) V.—ON THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. On repeated occasions, the case law of this Constitutional Chamber has recognized that public health and the right to a healthy and ecologically balanced environment are recognized both at the constitutional level and under international law. It has stated that the legitimate exercise of this right requires resources to be used rationally, and that the State is responsible for protecting the environment under the precautionary principle that governs environmental matters. This principle requires the State to take all measures necessary, within the limits permitted by law, to prevent irreversible environmental damage. To that end, the State is responsible for creating favorable social conditions so that everyone can enjoy health, understood as a state of physical, psychological (or mental), and social well-being (see Judgment Nº 1998-180, issued at 16:24 on 13 January 1998). The State’s objective duty to protect the environment does not necessarily entail an individual right to demand, through the judicial authorities, that a particular measure be taken; it does, however, entail a right to have measures suited to protecting that right adopted in the face of openly negligent conduct by public authorities or by natural or legal persons. Accordingly, the State has an obligation to regulate areas of social life that may give rise to dangers to the physical existence of the inhabitants of its territory, as well as areas that may harm the environment. It may do so through laws, regulations, agreements, or other measures relating to administrative organization and procedures. Consequently, the possibility of demanding through an amparo proceeding that the State provide a specific type of service in fulfillment of its duty to protect the life, health, or environmental rights of its inhabitants is limited to cases where an imminent danger to those rights is clearly established. It follows that intervention by the constitutional jurisdiction is appropriate only when the inaction of the State, through its competent bodies, in addressing demands made by the country’s inhabitants in the exercise of their rights has been established (see Judgment N° 2014-002127).
