In environmental matters, it is my view that, once the Public Administration has intervened, jurisdiction over the matter and its resolution belong to the administrative-litigation jurisdiction. Nevertheless, I do consider the merits when other rights of the people affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (Article 50 of the Political Constitution). That is the case here: the applicant states that they filed a complaint about noise pollution against the establishment known as Salón Italia, located in Santa Lucía de Barva; however, they allege that, as of the date this amparo application was filed, although some steps have been taken to address their complaint, the authorities of the San Rafael-Barva Health Area have not resolved the reported problem.\n\nVCG09/2026"
