SE RECLAMA QUE EL AYA NO HA CONSTRUIDO LA RED NECESARIA PARA ABASTECER DE AGUA POTABLE A BARRIO JUAN VIÑAS DE TEMPATE, PESE A QUE DESDE 2022 EXISTE FACTIBILIDAD TÉCNICA. LA FALTA DE PRESUPUESTO DURANTE DOS AÑOS NO JUSTIFICA LA PARALIZACIÓN DEL PROYECTO NI LA LIMITACIÓN DEL DERECHO FUNDAMENTAL AL AGUA, VINCULADO CON LA VIDA, LA SALUD Y EL AMBIENTE SANO. SE DECLARA CON LUGAR Y SE ORDENA DETERMINAR, CONCRETAR Y EJECUTAR UN PLAN DE ABASTECIMIENTO, EN EL PLAZO DE DOCE MESES. VCG09/2026\n\n“(…) III.-\nSOBRE EL SUMINISTRO DE AGUA POTABLE COMO SERVICIO PÚBLICO. Reiteradamente este\nTribunal ha sostenido que el suministro de agua potable constituye un servicio\npúblico esencial y oneroso. En este sentido, la jurisprudencia de la Sala, en\nmateria de suministro de agua potable, ha apuntado fundamentalmente a la\nprotección del derecho a la vida y a la salud de las personas físicas. Esos\nderechos implican la posibilidad de exigir ciertas prestaciones del Estado,\námbito en el cual el Estado se ve obligado a proporcionar algunos servicios\npúblicos, sobre todo los que resultan esenciales para mantener condiciones\nsanitarias favorables a la preservación de la vida y la salud de las personas.\nDe este modo, garantizar la pureza del líquido para consumo humano, así como la\ncontinuidad en el suministro de éste, forman parte de un debido y eficiente\nservicio al abonado, y a su vez garantiza sus derechos fundamentales más\nelementales (véase entre otras, la sentencia No. 2024021577 de las 14:00 horas\nde 30 de julio de 2024).\n\nIV.- SOBRE\nLAS IMPOSIBILIDADES TÉCNICAS QUE OBSTACULIZAN EL ABASTECIMIENTO DE AGUA\nPOTABLE. Por otra parte, entre otras en la sentencia No. 07779-2019 de las\n09:15 de 3 de mayo de 2019, esta Sala señaló que la imposibilidad técnica,\njurídica o formal para dotar el servicio de agua potable no es violatorio de\nderechos fundamentales; y que resulta razonable no atender las solicitudes de\nservicio o solicitar que el interesado asuma los costos de instalación cuando\nno exista red de distribución de agua potable y se necesite la construcción de\ninfraestructura. Así, en estos casos se ha tenido claro que no es que se trate\nde una negativa al acceso al servicio de agua potable, sino de la imposibilidad\npara brindarlo o de la necesaria participación del interesado en el\nlevantamiento de una imposibilidad técnica, cual es, la falta de\ninfraestructura. Por supuesto, las autoridades encargadas tienen la obligación\nde ir expandiendo su infraestructura para garantizar a la población el acceso\nal servicio, pero mientras queden vacíos resulta indispensable la colaboración\nde los interesados. En otras palabras, siempre que la falta de dotación del\nservicio de agua potable no sea una actuación antojadiza, arbitraria o sin\nfundamento, sino que esté justificada en una imposibilidad jurídica o material;\nse descarta la violación de derechos fundamentales.\n\nV.- CASO\nCONCRETO. Se comprobó que, desde el 2022, el Instituto Costarricense de\nAcueductos y Alcantarillados ha venido impulsando un proyecto para dotar de\nagua potable al Barrio Juan Viñas de Tempate, Santa Cruz, Guanacaste, pues, esa\ncomunidad no cuenta con ese servicio público. \nAunque la autoridad recurrida reconoció que el Acueducto de Cartagena\ncuenta con capacidad hídrica para suministrar el recurso requerido, reconoció\nque el AYA se encuentra materialmente imposibilitado para concluir el proyecto,\nen vista de que durante los últimos dos ejercicios fiscales no ha dispuesto el\npresupuesto necesario a esos efectos. De ahí que, se acepta que no existe una\nsolución en el corto plazo. En este sentido, en la sentencia No. 2024021577 de\nlas 14:00 horas de 30 de julio de 2024, esta Sala sostuvo en lo que interesa,\nlo siguiente\n\n“… V.- CASO\nCONCRETO. Del informe rendido bajo juramento por la autoridad recurridas, con\nlas consecuencias incluso penales que prevé el numeral 44 de la Ley de la\nJurisdicción Constitucional se descarta una infracción a los derechos\nfundamentales de la parte recurrente, con fundamento en las consideraciones que\na continuación se exponen. Al respecto, se acredita que en oficio\nGSP-RCHO-2024-01980 del 27 de junio de 2024, el funcionario Alejandro Contreras\nLópez de la Región Chorotega del Instituto recurrido le comunicó al recurrente\nen relación al abastecimiento a comunidades el Jobo de Cartagena y Juan Viñas\nde Tempate: “(…) Efectivamente se han realizado un par de reuniones con la\ncomunidad en busca de soluciones que permitan el abastecimiento del caserío\ndenominado Juan Viñas de Tempate, en dichas reuniones se acordó con los\nrepresentantes y orden de actividades: 1. Determinar la factibilidad técnica\npara abastecer al poblado de Juan Viñas a partir de Sistema AyA de Tempate o\nCartagena. Del análisis realizado se determinó que hidráulicamente se tenía la\nposibilidad de conectarlos desde el acueducto de Cartagena. 2. Una vez superado\nlo indicado en el punto 1, correspondía realizar el levantamiento de las\nposibles coberturas del caserío de Juan Viñas junto con estimación de costos de\nmateriales. 3. Siguiendo el mismo orden, se informa en las reuniones que debido\nal balance hídrico operativo del sistema de Cartagena, se debía esperar el\nequipamiento del pozo 4, para poder continuar con la factibilidad técnica de la\nampliación del acueducto de Cartagena para el abastecimiento del poblado de\nJuan Viñas. Esto se logró concretar y finalizar el pasado año 2023. Así las\ncosas, se va a trabajar en la posible compra de materiales (tuberías y\naccesorios) para el 2025 y luego articular fuerzas para la construcción de la\ninstalación del ramal hacia el poblado de Juan Viñas, cabe señalar que la\ncobertura es sobre ruta nacional y ruta cantonal. Por otra parte, se constata\nque en informe elaborado el 12 de julio de 2024 por personal de la Región\nChorotega del AyA se determinó: “Análisis. En el año 2022 según informe técnico\nGSP-RCHO-2022-00420, se valoran las condiciones en sitio y requerimientos\ntécnicos para el abastecimiento de las 30 unidades habitacionales en el sector\nllamado Juan Viñas, se determinan y describen los materiales requeridos con un\ncosto de ¢ 60 millones de colones aproximadamente. Según lo indicado en el\noficio GSP-RCHO-2024-01980 de la Dirección de Ingeniería de la Región Chorotega\nen el año 2023, se confirma el equipamiento y puesta en marcha del pozo 4 del\nacueducto de Cartagena con el cual se aumenta la oferta hídrica del acueducto y\nse concluye que existe capacidad hídrica en el acueducto de Cartagena para\nabastecer el caserío llamado Juan Viñas. A su vez se comunica que en el\npresente año se encuentra en proceso la posible compra de materiales (tuberías\ny accesorios) para el año 2025 para posteriormente articular fuerzas para la\nconstrucción de la instalación del ramal hacia el poblado de Juan Viñas, lo anterior\ncon recursos de operación y mantenimiento de la oficina cantonal de Santa Cruz.\nV. Conclusiones. El caserío Juan Viñas es un caserío que se construye sin el\nservicio de agua potable y por el contrario se auto abastece desde sus inicios.\nDe forma similar existen muchos caseríos y viviendas en la Región Chorotega que\ncarecen del servicio. Actualmente el acueducto de Cartagena cuenta con\ncapacidad hídrica para abastecer el caserío de Juan Viñas sin embargo para\npoder brindar el servicio se requiere de la construcción de un proyecto de\nampliación del acueducto con un costo de ¢ 60 millones de colones\naproximadamente. Al existir capacidad hídrica en el acueducto de Cartagena para\nabastecer el caserío Juan Viñas, conforme al Reglamento de Prestación de los\nServicios de AYA, los interesados pueden optar por solicitar una constancia de\ncapacidad hídrica, tramitar y construir las obras primarias requeridas para que\nAyA les pueda brindar el servicio, de forma similar se les responde y resuelve\na muchos interesados que no cuentan con tubería de agua potable frente a sus\npropiedades y solicitan el servicio. Según lo indicado en el oficio\nGSP-RCHO-2024-01980 de la Dirección de Ingeniería de la Región Chorotega en el\npresente año se encuentra en proceso la posible compra de materiales (tuberías\ny accesorios) para el año 2025 para posteriormente articular fuerzas para la\nconstrucción de la instalación del ramal hacia el poblado de Juan Viñas, lo\nanterior con recursos de operación y mantenimiento de la oficina cantonal de\nSanta Cruz …”\n\nAhora bien,\naunque la autoridad recurrida sostiene que no existe abandono institucional del\nproyecto, sino un proceso continuo de planificación, seguimiento y gestión para\nsu futura ejecución, lo cierto es que más de dos años después de dictada esa\nsentencia, el proyecto en cuestión no ha concluido, a pesar de que según se\ncolige del informe, existe factibilidad técnica, pues el ente recurrido no se\nha dispuesto del contenido presupuestario requerido (¢ 60.000.000) durante los\núltimos ejercicios fiscales para adquirir los materiales que se requieren para\ncontinuar la obra aquí reclamada. En este sentido, aunque se informa que\nexisten actuaciones técnicas y administrativas y se ha dado seguimiento al\nproyecto, así como que la construcción del proyecto requiere una inversión\nextraordinaria y una contratación especializada, que excede la capacidad\noperativa y presupuestaria que conllevan a una ejecución en que va por etapas,\nlo cierto es las circunstancias que dieron mérito a la interposición de aquel\nasunto no han cambiado, pues no se han hecho las reservas presupuestarias\nnecesarias para que el proyecto que se echa de menos avance, a pesar de que así\nse recomendó en el INFORME\nGSP-RCHO-2022-00420 de 3 de febrero de 2022, limitando el acceso de los\namparados al agua potable. Sobre ese derecho fundamental, conviene reiterar lo\nexpuesto por esta Sala en la sentencia No. 2018-015965 de las 09:20 horas de 28\nde setiembre de 2018, que en lo que interesa, señala lo siguiente:\n\n“(…) La\njurisprudencia de la Sala es reiterada en reconocer el denominado derecho\nfundamental al agua, por el cual debe concederse a todas las personas la\nposibilidad de acceder en condiciones de igualdad a los servicios de agua\npotable, toda vez que la misma resulta esencial para la vida y la salud\nhumanas. En efecto, como parte del Derecho de la Constitución, la Sala reconoce\nun derecho fundamental al agua potable, derivado de los derechos fundamentales\na la salud, la vida, al ambiente sano, a la alimentación y la vivienda digna,\nentre otros, tal como ha sido reconocido también en instrumentos\ninternacionales sobre derechos humanos aplicables en Costa Rica; así figura\nexplícitamente en el artículo catorce de la Convención sobre la Eliminación de\ntodas las formas de Discriminación contra la Mujer, y en el artículo\nveinticuatro de la Convención sobre los Derechos del Niño; además, se enuncia\nen el segundo principio de la Conferencia Internacional sobre Población y el\nDesarrollo de El Cairo, mientras que en el sistema interamericano, el primer\ninciso del artículo once del Protocolo Adicional a la Convención Americana\nsobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales\n-Protocolo de San Salvador-, dispone que «Toda persona tiene derecho a vivir en\nun medio ambiente sano y a contar con servicios públicos básicos”. Del mismo\nmodo, el entonces Comité de Derechos Económicos, Culturales y Sociales de la\nONU reiteró que disponer de agua es un derecho humano que, además de ser\nimprescindible para llevar una vida saludable, es un requisito para la\nrealización de todos los demás derechos humanos. De esta referencia normativa\nse deriva una serie de derechos fundamentales ligados a la obligación del\nEstado de brindar los servicios públicos básicos, que implican, por una parte,\nque no puede privarse ilegítimamente de ellos a las personas, pero que, como en\nel caso del agua potable, no puede sostenerse la titularidad de un derecho\nexigible por cualquier individuo para que el Estado le suministre el servicio\npúblico de agua potable, en forma inmediata y dondequiera que sea, sino que, en\nla forma prevista en el mismo Protocolo de San Salvador, esta clase de derechos\nobliga a los Estados a adoptar medidas para su prestación y suministro, sin que\nello pueda interpretarse en el sentido que ese derecho fundamental a los\nservicios públicos carezca de exigibilidad concreta; por el contrario, cuando\nrazonablemente el Estado deba brindarlos, los titulares del derecho pueden\nexigirlo y no pueden las administraciones públicas o, en su caso, los\nparticulares que los presten en su lugar, escudarse en presuntas carencias de\nrecursos, que ha sido la secular excusa pública para justificar el\nincumplimiento de sus cometidos –ver, entre otras, sentencias números 2002-10776,\nde las catorce horas cuarenta y un minutos del catorce de noviembre de dos mil\ndos, y 2008-10326-, de las dieciséis horas cincuenta y un minutos del\ndiecinueve de julio de dos mil ocho- (…)”\n\nAsí las\ncosas, el Instituto Costarricense de Acueductos y Alcantarillados ha omitido su\ndeber constitucional de garantizar un buen funcionamiento de los servicios\npúblicos (véase en similar sentido, la sentencia No. 2025021402 de las 9:20\nhoras de 11 de julio de 2025). Bajo esta inteligencia, se impone acoger el\nrecurso, conforme se dirá. (…)”",

It is alleged that AyA has not built the network needed to supply drinking water to Barrio Juan Viñas de Tempate, despite technical feasibility having existed since 2022. The lack of a budget for two years does not justify halting the project or limiting the fundamental right to water, which is linked to life, health, and a healthy environment. The amparo application is granted, and AyA is ordered to determine, finalize, and carry out a supply plan within twelve months. VCG09/2026\n\n“(…) III.-\nON THE SUPPLY OF DRINKING WATER AS A PUBLIC SERVICE. This Court has repeatedly held that the supply of drinking water constitutes an essential public service for which a charge is made. In this regard, the Chamber’s case law on the supply of drinking water has focused primarily on protecting the rights to life and health of natural persons. Those rights entail the possibility of demanding certain benefits from the State, in which sphere the State is obliged to provide some public services, especially those essential to maintaining sanitary conditions favorable to the preservation of people’s lives and health. Thus, guaranteeing the purity of water for human consumption, as well as continuity in its supply, forms part of a proper and efficient service to the customer and, in turn, guarantees their most basic fundamental rights (see, among others, judgment No. 2024021577, at 14:00 on 30 July 2024).\n\nIV.- ON TECHNICAL IMPOSSIBILITIES THAT HINDER THE SUPPLY OF DRINKING WATER. In addition, this Chamber stated, among others, in judgment No. 07779-2019, at 09:15 on 3 May 2019, that a technical, legal, or formal impossibility of providing drinking-water service does not violate fundamental rights; and that it is reasonable not to grant service requests, or to ask the interested party to bear installation costs, when no drinking-water distribution network exists and infrastructure must be built. Accordingly, in these cases it has been clear that this is not a denial of access to drinking-water service, but rather an inability to provide it or the interested party’s necessary participation in overcoming a technical impossibility, namely, the lack of infrastructure. The responsible authorities are, of course, obliged to expand their infrastructure in order to guarantee the population access to the service, but while gaps remain, the cooperation of interested parties is essential. In other words, where the failure to provide drinking-water service is not capricious, arbitrary, or unfounded, but is justified by a legal or material impossibility, a violation of fundamental rights is ruled out.\n\nV.- THE SPECIFIC CASE. It was established that, since 2022, the Instituto Costarricense de Acueductos y Alcantarillados has been advancing a project to provide drinking water to Barrio Juan Viñas de Tempate, Santa Cruz, Guanacaste, since that community does not have this public service.\n\nAlthough the respondent authority acknowledged that the Cartagena water system has sufficient water capacity to supply the required resource, it acknowledged that AyA is materially unable to complete the project because it has not had the necessary budget for that purpose during the last two fiscal years. It is therefore accepted that there is no short-term solution. In this regard, in judgment No. 2024021577, at 14:00 on 30 July 2024, this Chamber held, insofar as relevant, as follows:\n\n“… V.- THE SPECIFIC CASE. Based on the report submitted under oath by the respondent authority, and taking into account even the criminal consequences provided for in section 44 of the Ley de la Jurisdicción Constitucional, an infringement of the fundamental rights of the amparo applicant is ruled out for the reasons set out below. In this regard, it is established that, in letter GSP-RCHO-2024-01980 of 27 June 2024, Alejandro Contreras López, an official of the respondent Institute’s Chorotega Region, informed the applicant, in relation to supplying the communities of El Jobo de Cartagena and Juan Viñas de Tempate, as follows: ‘(…) A couple of meetings have indeed been held with the community to seek solutions that would enable supply to the settlement known as Juan Viñas de Tempate. At those meetings, the representatives agreed on the following order of activities: 1. Determine the technical feasibility of supplying the settlement of Juan Viñas from the AyA system in Tempate or Cartagena. The analysis determined that it was hydraulically possible to connect them from the Cartagena water system. 2. Once the matter indicated in point 1 had been resolved, the possible service coverage for the Juan Viñas settlement was to be surveyed, together with an estimate of material costs. 3. In the same order, the meetings were informed that, owing to the operational water balance of the Cartagena system, it was necessary to await the equipping of well 4 before proceeding with the technical feasibility assessment for expanding the Cartagena water system to supply the settlement of Juan Viñas. This was completed and finalized last year, 2023. Accordingly, work will be done on the possible purchase of materials (pipes and fittings) for 2025, and then efforts will be coordinated to build and install the branch line to the settlement of Juan Viñas. It should be noted that coverage is along a national route and a cantonal route.’ Further, it is established that a report prepared on 12 July 2024 by staff of AyA’s Chorotega Region determined: ‘Analysis. In 2022, according to technical report GSP-RCHO-2022-00420, the site conditions and technical requirements for supplying the 30 housing units in the area known as Juan Viñas were assessed, and the required materials were identified and described, at an estimated cost of approximately ¢ 60 million colones. As indicated in letter GSP-RCHO-2024-01980 from the Engineering Directorate of the Chorotega Region in 2023, the equipping and commissioning of well 4 in the Cartagena water system was confirmed, increasing the system’s water supply capacity. It was concluded that the Cartagena water system has sufficient water capacity to supply the settlement known as Juan Viñas. It was also reported that this year the possible purchase of materials (pipes and fittings) for 2025 is in process, to be followed by coordinated efforts to build and install the branch line to the settlement of Juan Viñas, using the operating and maintenance resources of the Santa Cruz cantonal office. V. Conclusions. The Juan Viñas settlement was built without drinking-water service and, instead, has supplied itself from the outset. Similarly, there are many settlements and homes in the Chorotega Region that lack the service. The Cartagena water system currently has sufficient water capacity to supply the Juan Viñas settlement; however, providing the service requires construction of a water-system expansion project costing approximately ¢ 60 million colones. Since the Cartagena water system has sufficient water capacity to supply the Juan Viñas settlement, the interested parties may, under the Reglamento de Prestación de los Servicios de AYA, request a statement of water capacity, process and build the required primary works so that AyA can provide them with service. Interested parties who have no drinking-water pipe in front of their properties and request service are given a similar response and resolution. As indicated in letter GSP-RCHO-2024-01980 from the Engineering Directorate of the Chorotega Region, this year the possible purchase of materials (pipes and fittings) for 2025 is in process, to be followed by coordinated efforts to build and install the branch line to the settlement of Juan Viñas, using the operating and maintenance resources of the Santa Cruz cantonal office …’\n\nNow, although the respondent authority maintains that the project has not been institutionally abandoned and is instead undergoing ongoing planning, monitoring, and management for future implementation, the fact is that more than two years after that judgment was issued, the project in question remains incomplete, even though, as can be inferred from the report, it is technically feasible. The respondent entity has not had the required budget allocation (¢ 60.000.000) during the last fiscal years to purchase the materials needed to continue the work at issue here. In this regard, although it is reported that technical and administrative actions have been taken and the project has been monitored, and that construction requires an extraordinary investment and specialized procurement, exceeding operational and budgetary capacity and thus requiring phased execution, the fact remains that the circumstances that gave rise to the filing of that case have not changed: the necessary budget allocations have not been set aside for the project whose progress is sought, despite the recommendation to do so in report GSP-RCHO-2022-00420 of 3 February 2022, thereby limiting the amparo applicants’ access to drinking water. As to that fundamental right, it is appropriate to reiterate what this Chamber stated in judgment No. 2018-015965, at 09:20 on 28 September 2018, which provides, insofar as relevant, as follows:\n\n“(…) The Chamber’s case law has repeatedly recognized the so-called fundamental right to water, under which all persons must be afforded the possibility of equal access to drinking-water services, since water is essential to human life and health. Indeed, as part of the Derecho de la Constitución, the Chamber recognizes a fundamental right to drinking water, derived from the fundamental rights to health, life, a healthy environment, food, and decent housing, among others, as has also been recognized in international human rights instruments applicable in Costa Rica. This is expressly stated in Article 14 of the Convention on the Elimination of All Forms of Discrimination against Women and Article 24 of the Convention on the Rights of the Child. It is also set out in the second principle of the International Conference on Population and Development in Cairo, while, in the inter-American system, Article 11(1) of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights—the Protocol of San Salvador—provides that ‘Everyone has the right to live in a healthy environment and to have access to basic public services.’ Likewise, the then United Nations Committee on Economic, Cultural and Social Rights reiterated that access to water is a human right which, besides being indispensable to leading a healthy life, is a prerequisite for the realization of all other human rights. This normative reference gives rise to a series of fundamental rights linked to the State’s obligation to provide basic public services. These mean, on the one hand, that people may not be unlawfully deprived of those services, but, as in the case of drinking water, they do not mean that any individual holds a right enforceable against the State to have drinking-water service supplied immediately and everywhere. Rather, as provided for in the Protocol of San Salvador itself, this class of rights obliges States to adopt measures for their provision and supply. That cannot be interpreted to mean that the fundamental right to public services lacks concrete enforceability. On the contrary, where the State should reasonably provide them, the holders of that right may demand them, and public administrations or, where applicable, private parties providing them in their place may not shield themselves behind alleged resource shortages, the longstanding public excuse for justifying failure to carry out their duties—see, among others, judgments Nos. 2002-10776, at 14:41 on 14 November 2002, and 2008-10326-, at 16:51 on 19 July 2008—(…)”\n\nAccordingly, the Instituto Costarricense de Acueductos y Alcantarillados has failed to fulfill its constitutional duty to ensure the proper functioning of public services (see, in a similar vein, judgment No. 2025021402, at 9:20 on 11 July 2025). On this basis, the amparo application must be granted, as will be stated. (…)”"
