LA GESTIÓN FUE PRESENTADA EN UN CORREO INSTITUCIONAL Y LA DEPENDENCIA RECEPTORA DEBÍA TRASLADARLA INTERNAMENTE, SIN EXIGIR AL INTERESADO QUE LA PRESENTARA NUEVAMENTE. SE DECLARA CON LUGAR Y SE ORDENA BRINDAR RESPUESTA EN CINCO DÍAS. VCG09/2026\n\n“(…) V.-\nSobre el caso en concreto. Del análisis de los elementos incorporados a los\nautos se tiene por acreditado que, el 22 de junio de 2026, el recurrente\nremitió a la dirección electrónica ymenocal@municipalidadtalamanca.go.cr una\nsolicitud de información. Asimismo, en virtud de lo dispuesto en el artículo 45\nde la Ley de la Jurisdicción Constitucional y ante la omisión de la autoridad\nrecurrida de rendir el informe solicitado, se tiene por cierto que dicha\ndirección electrónica está prevista por la Municipalidad de Talamanca como\nmecanismo oficial para la recepción de gestiones de los usuarios.\n\nAhora bien,\nde la propia prueba aportada por el recurrente se desprende que, ese mismo 22\nde junio de 2026 recibió una comunicación mediante la cual se le indicó que lo\nsolicitado excedía el ámbito de competencias de la Administración Tributaria y\nse le recomendó remitir su consulta al despacho del alcalde municipal, mediante\nla dirección electrónica alcaldia@municipalidadtalamanca.go.cr, desde donde se\nrealizaría la asignación al departamento correspondiente.\n\nTal\ncomunicación, sin embargo, no resulta suficiente para tener por satisfechos los\nderechos fundamentales invocados. En efecto, no se está ante una gestión\nremitida a una dirección ajena a los mecanismos dispuestos por la Municipalidad\npara recibir solicitudes de los administrados. Por el contrario, conforme se\nindicó, se tiene por cierto que el recurrente presentó su requerimiento por\nmedio de una dirección electrónica oficialmente prevista para la recepción de\ngestiones. Por ello, una vez recibida válidamente la solicitud por la\nAdministración municipal, la circunstancia de que la dependencia receptora\ncareciera de competencia para atenderla no justificaba que se trasladara al\nadministrado la carga de presentar nuevamente su requerimiento ante otra dependencia\nde la misma municipalidad.\n\nEn ese\nsentido, la comunicación acreditada en el hecho probado b) únicamente informó\nal recurrente acerca de la falta de competencia de la dependencia que recibió\ninicialmente su solicitud y le indicó otra dirección electrónica a la cual\npodía remitirla. Sin embargo, no consta que la gestión fuera canalizada\ninternamente hacia el despacho o departamento competente, ni que posteriormente\nse brindara al interesado la información solicitada o una respuesta de fondo\nacerca de su requerimiento.\n\nAsí las\ncosas, debe distinguirse entre la comunicación efectuada el 22 de junio de 2026\ny la efectiva atención de la solicitud formulada por el recurrente. La primera\nimpide afirmar que existió una ausencia absoluta de actuación por parte de la\nMunicipalidad; no obstante, no satisface por sí misma los derechos tutelados en\nlos artículos 27 y 30 de la Constitución Política, pues el requerimiento había\ningresado por un mecanismo oficial para la recepción de gestiones y, pese a\nello, no fue atendido por la dependencia competente ni consta que hubiera sido\ntrasladado internamente para ese efecto.\n\nPor\nconsiguiente, al haber transcurrido el plazo establecido en el artículo 32 de\nla Ley de la Jurisdicción Constitucional sin que la solicitud de información\nfuera efectivamente atendida, esta Sala estima vulnerados los derechos de\npetición y de acceso a la información pública del recurrente. En consecuencia,\nlo procedente es la estimatoria del recurso. (…)”",

IT IS ALLEGED THAT THE MUNICIPALITY OF TALAMANCA DID NOT RESPOND TO A REQUEST ABOUT THE RULES AND PROCEDURES APPLICABLE TO BUILDING PERMITS IN THE GANDOCA-MANZANILLO WILDLIFE REFUGE. THE REQUEST WAS SUBMITTED TO AN OFFICIAL EMAIL ADDRESS, AND THE RECEIVING DEPARTMENT WAS REQUIRED TO ROUTE IT INTERNALLY, WITHOUT REQUIRING THE INTERESTED PARTY TO SUBMIT IT AGAIN. THE AMPARO APPLICATION IS GRANTED, AND THE MUNICIPALITY IS ORDERED TO RESPOND WITHIN FIVE DAYS. VCG09/2026\n\n“(…) V.-\nThe specific case. From the analysis of the evidence in the case file, it is established that, on 22 June 2026, the applicant sent a request for information to the email address ymenocal@municipalidadtalamanca.go.cr. Furthermore, pursuant to Article 45 of the Constitutional Jurisdiction Act and because the respondent authority failed to submit the requested report, it is taken as established that the Municipality of Talamanca provides for that email address as an official means for receiving requests from users.\n\nThe evidence submitted by the applicant also shows that, on that same 22 June 2026, the applicant received a communication stating that the request fell outside the scope of the Tax Administration’s powers and recommending that the inquiry be sent to the office of the municipal mayor at alcaldia@municipalidadtalamanca.go.cr, from which it would be assigned to the appropriate department.\n\nThat communication, however, is insufficient to establish that the fundamental rights invoked have been respected. This was not a request sent to an address outside the means provided by the Municipality for receiving requests from members of the public. On the contrary, as stated above, it is taken as established that the applicant submitted the request through an email address officially provided for receiving such requests. Accordingly, once the request had been validly received by the municipal administration, the fact that the receiving department lacked authority to address it did not justify shifting to the member of the public the burden of submitting the request again to another department of the same municipality.\n\nIn that regard, the communication established as proven fact b) only informed the applicant that the department that initially received the request lacked authority and gave the applicant another email address to which it could be sent. However, the record does not show that the request was routed internally to the mayor’s office or the competent department, or that the requested information or a substantive response to the request was subsequently provided to the interested party.\n\nAccordingly, a distinction must be drawn between the communication made on 22 June 2026 and the actual handling of the applicant’s request. The former precludes a finding that the Municipality took no action at all; nevertheless, it does not by itself satisfy the rights protected by Articles 27 and 30 of the Political Constitution, because the request had been received through an official means for receiving requests and, despite that, was not handled by the competent department, nor does the record show that it was routed internally for that purpose.\n\nConsequently, because the period established in Article 32 of the Constitutional Jurisdiction Act elapsed without the request for information being effectively handled, this Chamber finds that the applicant’s rights of petition and access to public information were violated. Accordingly, the appropriate disposition is to grant the amparo application. (…)”"
