Esta Sala se ha pronunciado de manera reiterada en\ncuanto al derecho de gozar de un ambiente sano y ecológicamente equilibrado en\nlos diferentes centros educativos. De esta forma, en la sentencia No. 2019-3032\nde las 9:45 horas de 22 de febrero de 2019, indicó lo siguiente: “III.- Sobre\nel derecho a gozar de un ambiente sano y ecológicamente equilibrado en los\nCentros de Educación- El derecho a la\nsalud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la\nDeclaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención\nAmericana sobre Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos\nen Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en\nun ambiente sano y equilibrado, consagrado en el artículo 50 constitucional. La\ncalidad ambiental es un parámetro fundamental de la calidad de vida; al igual\nque la salud, alimentación, trabajo, vivienda, educación, entre otros. This Chamber has repeatedly ruled on the right to enjoy a healthy and ecologically balanced environment in different educational institutions. Accordingly, in judgment No. 2019-3032, issued at 9:45 on 22 February 2019, it stated the following: “III.- On the right to enjoy a healthy and ecologically balanced environment in Educational Institutions—The right to health, recognized in Articles 21 of the Political Constitution, 1 and 11 of the American Declaration of the Rights and Duties of Man, 4 of the American Convention on Human Rights, and 10 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights, is closely linked to the right to live in a healthy and balanced environment, enshrined in Article 50 of the Constitution. Environmental quality is a fundamental measure of quality of life, as are health, food, work, housing, education, and others. Consequently, the State has an obligation to ensure adequate protection of the environment. To that end, it must take the necessary measures to keep the environment free from contamination and to ensure that changes caused by humans or by nature, in the immediate or wider surroundings, do not harm the environment or the health of the people who live there. This right is recognized in particular when it is associated with other fundamental rights, such as the right to education. The latter is a fundamental right, which takes the form of the public service provided by the State in the country’s various educational institutions.
