SE RECLAMA QUE LA MUNICIPALIDAD NO HA SOLUCIONADO LOS PROBLEMAS AMBIENTALES Y DE AGUAS PLUVIALES GENERADOS POR LAS OBRAS DEL CENTRO EDUCATIVO FINLAND SCHOOL. LA SALA DETERMINA QUE, PESE A CONOCER LA SITUACIÓN DESDE HACE AÑOS, LA MUNICIPALIDAD NO ADOPTÓ UNA SOLUCIÓN INTEGRAL Y DEFINITIVA, EN DETRIMENTO DEL DERECHO A UN AMBIENTE SANO Y DE LOS PRINCIPIOS DE EFICACIA, CONTINUIDAD Y COORDINACIÓN ADMINISTRATIVA. SE DECLARA CON LUGAR Y SE ORDENA EJECUTAR LAS OBRAS NECESARIAS EN EL PLAZO DE SEIS MESES. VCG09/2026\n\n“(…) IV.- Sobre el caso concreto. En el sub lite, la\nrecurrente alega que ha interpuesto múltiples denuncias ante la Municipalidad\nde Alajuela relacionadas con las construcciones, movimientos de tierra, obras\nde alcantarillado pluvial, inundaciones por el alcantarillado, ampliaciones,\noperación, contaminación sónica, colapsos viales, actividades privadas los\nfines de semana y otras, en relación con el centro educativo denominado Finland\nSchool, ubicado en La Guácima de Alajuela. Aduce que los hechos denunciados\ninvolucran posibles construcciones sin permiso, movimientos de tierra, obras de\ndesfogue pluvial, ausencia de aprobación técnica para descarga de aguas\npluviales, operación ilegitima de un centro educativo y posibles afectaciones a\nvecinos, vía pública, drenajes, cauces, seguridad comunal y hasta a los mismos\nestudiantes y personal del centro. Menciona que, pese a la existencia de\ninformes técnicos, actas de clausura, proyectos constructivos rechazados,\nausencia de aprobación de descarga pluvial y acuerdos firmes del Concejo\nMunicipal, no ha ejecutado de forma efectiva, oportuna e integral las acciones\nnecesarias para tutelar los derechos fundamentales de los vecinos. Considera\nque la omisión administrativa prolongada, las respuestas contradictorias, los\nerrores reconocidos por la propia Administración y la falta de ejecución\nefectiva de las medidas correctivas vulneran sus derechos fundamentales.\n\nAl respecto, de la relación de hechos probados se\ndesprende que el 11 de febrero de 2025, la recurrente remitió un escrito\ndirigido al Concejo Municipal de Alajuela en el que indicó lo siguiente: “Quien\nsuscribe [Nombre 001] en mi condición de Abogada y Notaría, procedo a denunciar\ny hacer de su conocimiento sobre las irregularidades que se nos ha informado,\ntanto legales como de permisos de construcción, patente y de sanidad que\npresenta el kínder, escuela y colegio FINLAND SCHOOL, ubicado en La Guácima de\nAlajuela. Primero: Se nos indica por parte de la Municipalidad que la misma no\ntiene ni ha tenido permiso de construcción para la edificación que hoy día\nalberga estudiantes de los diferentes niveles académicos. Segundo, que la\npatente que autoriza la actividad educativa es únicamente para un de las fincas\nocupadas por la escuela, y no de las otras 2 fincas en las que se encuentra la\nedificación. Tercero: Existen los tramites de consulta ante la Municipalidad de\nAlajuela N° 56801 2024 y 55180-2024 y o 58290-2024 ante el Proceso de Control\nFiscal y Urbano. La finca N.° 0189094, con identificador catastral 20105001626,\nforma parte del Centro Educativo Finland School, y la finca N.° 0189094, con\nidentificador catastral 20105001626, también forma parte del Centro Educativo\nFinland School, lugar donde se está realizando la construcción ilegal, de la\ncual indica el Ingeniero Emerson Bone Moya que no han tenido, ni tienen\npermisos de construcción, según oficio MA-PCFU 067-2025 (MA-A-56- 2025) La\nfotografía que rola a folio 2, del oficio MA-PCFU-067-2025 (MA-A-56-2025)\ndemuestra la construcción de una tubería de alcantarillado que es ilegal, no\nmuestra la construcción que se está llevando a cabo de forma ilegal. Cuarto:\nCon las fotografías y videos que aportamos, se logra determinar claramente; que\nen el lugar donde en sendas visitas que han realizado funcionarios de la\nMunicipalidad, y han redactado diferentes informes, algunos en los cuales\nindican que, si hay movimiento de tierra pero que se debe a un cumplimiento de\norden constitucional, que están construyendo una cancha la cual fue destruida\npor una construcción de alcantarillado; que están otros indican que no se logra\nver nada, otros indican que si tienen permiso para ampliación de aulas. Todo lo\nanterior a pesar de indicar que no ha sido posible ingresar, no es de recibo.\nEs evidente, publico y a plena luz del día, tanto para vecinos como para mi\npersona como abogada y notaría, que he sido testigo durante la toma de\nfotografías y videos, muchos de los cuales fueron tomados por mi persona, que\nse está dando una construcción de aulas, canchas e infraestructura para ser\nutilizada por la escuela Finland SIN PERMISOS. Quinto: A todo esto, se debe\nagregar que en uno de los inmuebles utilizados por esta escuela hay un kínder\nde perros llamado ANIMAL FANTASY mismo que no cuenta con manejo de desechos\norgánicos, y está a vista y paciencia de la Municipalidad, y es por donde\ningresa maquinaria para sacar tierra, meter material como cemento, vidrios y\notros. También hay un proceso administrativo por ampliación de aulas en actas\nde obra concluida sin licencia # 855- 2021 Esto nos deja la duda de si el\nobjetivo del propietario del inmueble en construcción de manera ilegal está en\nespera de hacer el mismo procedimiento, construir y que sea declarado (obra\nconcluida sin licencia # 855-2021) de manera que la Municipalidad no pueda\nhacer nada, o sea pedir perdón y no pedir permiso. Sexto: El día de hoy,\nmediante oficio N°MA-A-517-2025, y posterior a enviar sendos oficios solicitando\nderecho de respuesta del Recurso Revocatoria con Apelación, dan respuesta\nmediante oficio MA-PCFU-177-2025 y en el mismo aluden a que por error se\ncontestó en otro machote, oficio MA-PCFU-055-2025; y lo declaran con lugar\nmediante oficio N° MA-PCFU-157-2025. Séptimo: Aún más preocupante nunca\nrecibimos el oficio MA-PCFU-157-2025 y mucho menos el oficio MA-PCFU-158-2025\n(CON LA INFORMACION CORRECTA), y este oficio no puede ser respuesta al recurso\npor cuanto nótese la fecha, 18 de diciembre del 2024 la supuesta clausura se\ndio el 23 de enero 2025. en el cual, supuestamente dan respuesta a cada uno de\nlos fundamentos del recurso, en el trámite N°58290-2024. Octavo: Este caso es\ngrave por cuanto COMO PUEDE EL MUNICIPIO ASEGURAR QUE LA CONSTRUCCION DEL KINDER,\nESCUELA Y COLEGIO FINLAND SCHOOL es segura, y de cuanto caudal va a aumentar el\nalcantarillado Ilegal, al Rio Segundo Noveno: Ya el Ministerio de Educación\ntiene conocimiento de estas denuncias. Exigimos respuesta tanto del recurso\ncomo de los puntos que se tocaron en la reunión con Gleen Rojas y Luis Alonso\nVillalobos, según consta en oficio MA-A-332-2025. Décimo: Solicitamos que se\nrealice una inspección seria, para la cual la señora Paula Cambronera pone a su\ndisposición su Inmueble mismo que colinda con la construcción Ilegal, para que\npuedan acceder y corroborar todo lo denunciado. Se exija cumplimiento del\nReglamento para el control constructivo de obras civiles imputación de\nsanciones del cantón Central de Alajuela. Recuento de los hechos ilícitos: 1.Construcción\nsin permisos de construcción 2.Construcción de Alcantarillado sin permiso del\nConcejo Municipal 3.No tienen USO DE SUELOS para desfogue pluvial y\nconstrucción de semejante edificación (Finca 2-155617-000 y 2-414982-000,\n2-155615-002, 4727361447935 2010) 4.No cuentan con estudios de SETENA para\ndesfogue pluvial, (Finca 2-155617-000 y 2414982-000, 2- 155615-002,\n4727361447935-2010) 5.Patente Municipal dada, no es la de la actividad que\nrealizan. 6.Posible contaminación y o peligro, kínder de perros al lado de\nFINLAND SCHOOL. Para notificaciones al correo alvesa06@yahoo.com”. En sesión\nordinaria nro. 07-2025 del 18 de febrero de 2026, el Concejo Municipal de\nAlajuela confirió audiencia a la recurrente para que expusiera su denuncia.\nPosterior a su intervención, se determinó: “SE RESUELVE TRASLADAR A LA\nADMINISTRACIÓN MUNICIPAL, EL DOCUMENTO SUSCRITO POR LA LICDA. [Nombre 001] PARA\nQUE EN UN PLAZO DE 10 DÍAS BRINDE UN INFORME DE LO ACTUADO Y DE LAS ACCIONES A\nSEGUIR”. Por oficio MA-SCM-04632-2025 del 28 de octubre de 2025, la Alcaldía\nMunicipal se refirió a la situación y circunstancias del centro educativo, a\nsaber: “(…) Como se desprende de los reportes actualizados citados, en resumen\na la fecha: 1- Se ratifican les dificultades objetivas enfrentadas por la\ndependencia específica (PCFU) para poder notificar -como requiere la normativa\nde la materia- a todos los propietarios actuales las distintas actas por la\nfalta de permisos de construcción, siendo que -además- han sido impugnados\nalgunos actos de control que sí pudieron ser realizados y deben resolverse a la\nbrevedad los recursos ulteriores de apelación. Lo (sic) aspectos referidos\ndeben ser superados incluso recurriendo acciones alternativas o supletorias que\nsean factibles -como la notificación por edicto- para poder continuar con los\nprocedimientos sancionatorios que correspondan, incluyendo el de mayor alcance\nde demolición. 2- Las solicitudes de permisos de construcción presentadas por\nlos propietarios de las fincas ante Control Constructivo a inicios de año se\nencuentran en estado de rechazadas. 3- Las instalaciones del centro educativo\nde interés (en la finca 2-189094) no cuentan con aprobación de descarga de\naguas pluviales por parte de la dependencia competente. 4- En la Actividad de Patentes consta la\nexistencia de las licencias comerciales relacionadas: número 27952 para\nactividad de centra educativo preescolar primaria colegio, en la finca\n414982-000; y la licencia 40552 para la actividad de centro educativo en la\nfinca 189094-000. Por lo que, bajo lo descrito, la Administración procederá de\ninmediato a la aplicación que resulte factible de mecanismos alternos\nautorizados -como la publicación de edictos- para la notificación a la\ntotalidad de los propietarios infractores de construcciones sin permiso. Así\ncomo verificará el estado de las licencias comerciales frente a los\nantecedentes, situación y condiciones actuales de operación de las actividades,\npara la eventual suspensión o cancelación de dichas licencias; y procederá a la\nrespectiva resolución a la brevedad de los recursos administrativos por\nconstrucciones y actividad comercial en curso. Siendo que en cuanto a las\nfacultades propias del Concejo se estima que, por medio de un acuerdo, puede\ncomunicar -o ratificar- ante el Ministerio de Educación Pública toda la\nsituación de irregularidad actual integral existente de este centro educativo,\npara que dentro de sus competencias adopte las acciones que correspondan según\nel marco legal y administrativo de la materia y las facultades de supervisión\npropias de este Ministerio”. Mediante el acuerdo nro. 6, capítulo IV de la\nsesión ordinaria nro. 46-2025, celebrada el 18 de noviembre de 2025, el Concejo\nMunicipal de Alajuela conoció el informe de la alcaldía y determinó: “(…) SE\nRESUELVE DEVOLVER EL OFICIO N.° MA-A-4632-2025 DE LA ALCALDÍA MUNICIPAL PARA\nQUE SE CUMPLA CON LO ESTABLECIDO EN EL ARTÍCULO 90 BIS DEL CÓDIGO MUNICIPAL”.\nLa resolución de curso del amparo fue notificada a las partes el 24 de junio de\n2026. La alcaldía de Alajuela informó que el Proceso de Control Fiscal y Urbano\nha realizado inspecciones en el sitio, con el objetivo de realizar la\nverificación respectiva de la existencia de obras constructivas ejecutadas sin\nlicencia municipal, y se realizaron distintas actas en la finca matrícula\n2-189094-000, a saber: “?\nActa de Información de Obra\nConcluida sin Licencia N°\n855-2021, que se refiere a la ampliación\nde unas aulas. Se emitió el\nActa de Obra Concluida sin Licencia N°\n1732-2026, encontrándose\nactualmente el procedimiento administrativo en trámite conforme a los artículos\n93 y siguientes de la Ley de Construcciones. ? Acta de Clausura de Construcción N° 1390-2025, por la construcción de una caja pluvial dentro de las instalaciones del centro\neducativo. Se emitió el Acta\nde Obra Concluida sin Licencia N° 1730-2026, encontrándose el procedimiento\nadministrativo en trámite conforme a la normativa aplicable. ?\nActa de Clausura de Construcción\nN° 1391-2025, por la\nremodelación de una vivienda\nubicada dentro de la misma finca. Se emitió el Acta de Obra Concluida sin Licencia N° 1731-2026, encontrándose el procedimiento\nadministrativo en trámite. ?\nActa de Clausura de Construcción\nN° 1096-2025, por la colocación de postes y material pétreo. Contra dicho acto\nadministrativo fueron interpuestos los recursos ordinarios correspondientes,\nlos cuales fueron debidamente atendidos, resueltos y notificados. La última\nnotificación relacionada con dichos recursos fue realizada el 28 de abril de\n2026, encontrándose actualmente el expediente en seguimiento administrativo”.\n\nAsí las cosas, las autoridades recurridas aceptan que\nno se ha solucionado la situación denunciada por la parte amparada. Al\nrespecto, en el informe rendido por el alcalde municipal se indica que: “Siendo\nque bajo los reportes más recientes sobre los extremos reseñados, en el tanto\nse mantengan las infracciones e incumplimientos reseñados, a la fecha la\nAdministración se encuentra realizando la valoración final de los antecedentes\ny coordinación con las dependencias relacionadas para poder previo cumplimiento\nde los requerimientos legales como las debidas notificaciones a los\ncopropietarios de las fincas relacionadas, así como a los patentados según\ncorresponda- realizar lo siguiente: 1- Instaurar los procedimientos\nadministrativos de demolición de las obras construidas sin permisos de\nconstrucción (bajo cumplimiento de la notificación ordinaria o subsidaria de\nlos actos previos requeridos por la Ley de Construcciones de clausura formal,\nverificación de obra concluida sin licencia y renuencia; así como la resolución\nde todos los recursos administrativos interpuestos). 2- Realizar las gestiones\nfinales y procedimiento para la eventual suspensión de las licencias\ncomerciales referidas a fincas con construcciones sin permiso municipal; todo\nsegún el reglamento general de patentes de la Municipalidad. 3- Atender la\nsituación de impacto ambiental de manera coordinada con las dependencias\ninternas y entidades como el Ministerio de Salud. 4- Medidas correctivas sobre\nimpactos a los vecinos y la relación con servicios públicos”.\n\nAsí las cosas, se constata que el reclamo de la\nrecurrente obedece a una problemática conocida por años y vinculada con\ncuestiones ambientales y aguas pluviales que no ha sido resuelta de forma\ndefinitiva, omisión que resulta incompatible con los principios de eficacia,\ncontinuidad y coordinación administrativa. Además, no se observa que a la\nrecurrente se le haya mantenido actualizada de las acciones realizadas por el\nmunicipio a fin de resolver lo reclamado desde el 11 de febrero de 2025.\n\nEn consecuencia, procede declarar con lugar este\nextremo contra la Municipalidad de Alajuela, a fin de que se adopte la solución\ntécnica integral y se ejecuten las obras necesarias para solucionar de manera\ndefinitiva la problemática denunciada por la recurrente, y se le comunique lo\nque corresponda, según se indicará en la parte dispositiva de esta sentencia. (…)”",

THE CHAMBER FINDS THAT, DESPITE HAVING KNOWN OF THE SITUATION FOR YEARS, THE MUNICIPALITY DID NOT ADOPT A COMPREHENSIVE AND DEFINITIVE SOLUTION, TO THE DETRIMENT OF THE RIGHT TO A HEALTHY ENVIRONMENT AND THE PRINCIPLES OF ADMINISTRATIVE EFFECTIVENESS, CONTINUITY, AND COORDINATION. THE AMPARO APPLICATION IS GRANTED, AND THE NECESSARY WORKS ARE ORDERED TO BE CARRIED OUT WITHIN SIX MONTHS. VCG09/2026\n\n“(…) IV.—The specific case. In this case, the applicant alleges that she has filed multiple complaints with the Municipality of Alajuela concerning construction, earthworks (movimientos de tierra), storm sewer works, flooding caused by the sewer system, expansions, operation, noise pollution, road collapses, private activities on weekends, and other matters relating to the educational center known as Finland School, located in La Guácima de Alajuela. She states that the reported events involve possible construction without a permit, earthworks, stormwater discharge works, lack of technical approval for stormwater discharge, unauthorized operation of an educational center, and possible effects on neighbors, public roads, drains, waterways, community safety, and even the center’s students and staff. She notes that, despite technical reports, closure notices, rejected construction projects, lack of stormwater discharge approval, and final resolutions of the Municipal Council, the Municipality has not effectively, promptly, and comprehensively carried out the measures necessary to protect the neighbors’ fundamental rights. She considers that the prolonged administrative omission, contradictory responses, errors acknowledged by the Administration itself, and failure to effectively implement corrective measures violate her fundamental rights.\n\nIn this regard, it follows from the proven facts that, on 11 February 2025, the applicant sent a written submission addressed to the Municipal Council of Alajuela, stating the following: “I, the undersigned [Name 001], in my capacity as an attorney and notary, hereby report and bring to your attention the irregularities that have been reported to us, both legal and concerning construction permits, business licenses, and health permits, at the FINLAND SCHOOL kindergarten, school, and high school, located in La Guácima de Alajuela. First: The Municipality has informed us that it does not have and has never had a construction permit for the building that today houses students at different academic levels. Second: The license authorizing the educational activity applies only to one of the properties occupied by the school, and not to the other 2 properties on which the building stands. Third: There are consultation requests before the Municipality of Alajuela, Nos. 56801 2024 and 55180-2024 and/or 58290-2024, before the Fiscal and Urban Control Process. Property No. 0189094, cadastral identifier 20105001626, forms part of the Finland School Educational Center, and property No. 0189094, cadastral identifier 20105001626, also forms part of the Finland School Educational Center, where the illegal construction is taking place. Engineer Emerson Bone Moya states that they have not had, and do not have, construction permits, according to letter MA-PCFU 067-2025 (MA-A-56- 2025). The photograph on folio 2 of letter MA-PCFU-067-2025 (MA-A-56-2025) shows the construction of an illegal sewer pipe; it does not show the construction being carried out illegally. Fourth: The photographs and videos we submit clearly establish that at the site where Municipality officials have made several visits and prepared various reports, some reports state that there is earth movement but that it is due to compliance with a constitutional order, and that they are building a sports court that was destroyed by sewer construction; others state that nothing can be seen; and others state that they do have a permit to expand classrooms. None of this is acceptable, despite the claim that entry has not been possible. It is evident, public, and in broad daylight, both to the neighbors and to me as an attorney and notary, who witnessed the taking of photographs and videos, many of which I took myself, that classrooms, sports courts, and infrastructure are being built for use by Finland School WITHOUT PERMITS. Fifth: It must also be added that one of the properties used by this school has a dog kindergarten called ANIMAL FANTASY, which has no organic waste management, and this occurs in plain sight of the Municipality. It is also the point through which machinery enters to remove soil and bring in materials such as cement, glass, and others. There is also an administrative proceeding concerning classroom expansions recorded in notices of completed work without a license # 855- 2021. This leaves us wondering whether the owner of the property under illegal construction is waiting to follow the same procedure—to build and then have it declared ‘completed work without a license # 855-2021’—so that the Municipality cannot do anything; in other words, to ask forgiveness rather than permission. Sixth: Today, by letter No. MA-A-517-2025, after we sent several letters requesting a response to the motion for reconsideration with appeal, they responded by letter MA-PCFU-177-2025, stating in it that, by mistake, a different template, letter MA-PCFU-055-2025, had been answered, and they granted the motion by letter No. MA-PCFU-157-2025. Seventh: Even more concerning, we never received letter MA-PCFU-157-2025, much less letter MA-PCFU-158-2025 (WITH THE CORRECT INFORMATION). This letter cannot be a response to the motion because, note the date: 18 December 2024; the alleged closure occurred on 23 January 2025. In that letter, they supposedly respond to each of the grounds of the motion in proceeding No. 58290-2024. Eighth: This case is serious because HOW CAN THE MUNICIPALITY ASSURE US THAT THE FINLAND SCHOOL KINDERGARTEN, SCHOOL, AND HIGH SCHOOL CONSTRUCTION IS SAFE, and by how much will the illegal sewer system’s flow to the Rio Segundo increase? Ninth: The Ministry of Education already knows about these complaints. We demand a response both to the motion and to the points discussed at the meeting with Gleen Rojas and Luis Alonso Villalobos, as recorded in letter MA-A-332-2025. Tenth: We request a serious inspection, for which Ms. Paula Cambronera offers her property, which adjoins the illegal construction, so that officials can enter and verify everything reported. Compliance with the Regulation for Construction Control of Civil Works and Imposition of Sanctions in the Central Canton of Alajuela must be required. Summary of the unlawful acts: 1. Construction without construction permits. 2. Sewer construction without authorization from the Municipal Council. 3. They do not have LAND USE authorization for stormwater discharge and construction of such a large building (Property 2-155617-000 and 2-414982-000, 2-155615-002, 4727361447935 2010). 4. They do not have SETENA studies for stormwater discharge (Property 2-155617-000 and 2414982-000, 2- 155615-002, 4727361447935-2010). 5. The municipal business license issued is not for the activity they carry out. 6. Possible pollution and/or danger: a dog kindergarten beside FINLAND SCHOOL. For notices, send them to alvesa06@yahoo.com.” At ordinary session No. 07-2025 of 18 February 2026, the Municipal Council of Alajuela granted the applicant a hearing so that she could present her complaint. After her statement, it determined: “IT IS RESOLVED TO REFER THE DOCUMENT SIGNED BY ATTORNEY [Name 001] TO THE MUNICIPAL ADMINISTRATION SO THAT, WITHIN 10 DAYS, IT PROVIDES A REPORT ON THE ACTIONS TAKEN AND THE ACTIONS TO BE FOLLOWED.” By letter MA-SCM-04632-2025 of 28 October 2025, the Municipal Mayor’s Office addressed the situation and circumstances of the educational center, as follows: “(…) As follows from the cited updated reports, in summary, as of this date: 1- The objective difficulties faced by the specific unit (PCFU) in notifying all current owners of the various notices concerning the lack of construction permits, as required by the applicable regulations, are confirmed. In addition, some control measures that could be carried out have been challenged, and the subsequent appeals must be resolved promptly. These matters must be addressed, including by resorting to feasible alternative or substitute measures—such as notice by publication—to continue the applicable sanctioning proceedings, including the broader proceeding for demolition. 2- The construction permit applications submitted by the property owners to Construction Control at the beginning of the year have been rejected. 3- The facilities of the educational center at issue (on property 2-189094) do not have approval for stormwater discharge from the competent unit. 4- The Business Licenses Activity records the following related commercial licenses: number 27952 for a preschool, primary school, and high school educational center on property 414982-000; and license 40552 for an educational center on property 189094-000. Accordingly, based on the foregoing, the Administration will immediately proceed to apply feasible authorized alternative mechanisms—such as publication of notices—to notify all owners responsible for construction without a permit. It will also verify the status of the commercial licenses against the history, situation, and current operating conditions of the activities, with a view to possible suspension or cancellation of those licenses; and will promptly issue decisions on the pending administrative proceedings concerning construction and commercial activity. As for the powers of the Council itself, it is considered that, by means of a resolution, it may communicate—or reaffirm—the full current situation of irregularity at this educational center to the Ministry of Public Education, so that, within its powers, it may adopt the measures that correspond under the applicable legal and administrative framework and the Ministry’s own supervisory authority.” By resolution No. 6, Chapter IV, at ordinary session No. 46-2025, held on 18 November 2025, the Municipal Council of Alajuela considered the Mayor’s report and determined: “(…) IT IS RESOLVED TO RETURN LETTER No. MA-A-4632-2025 FROM THE MUNICIPAL MAYOR’S OFFICE SO THAT THE REQUIREMENTS OF ARTICLE 90 BIS OF THE MUNICIPAL CODE ARE COMPLIED WITH.” The order instituting the amparo proceeding was notified to the parties on 24 June 2026. The Mayor’s Office of Alajuela reported that the Fiscal and Urban Control Process had conducted site inspections to verify whether construction work had been carried out without a municipal license, and that various notices had been issued for property registration 2-189094-000, as follows: “?\nNotice of Completed Work without a License No. 855-2021, concerning the expansion of some classrooms. Notice of Completed Work without a License No. 1732-2026 was issued, and the administrative proceeding is currently pending in accordance with Articles 93 et seq. of the Construction Law. ? Construction Closure Notice No. 1390-2025, for the construction of a stormwater catch basin inside the educational center’s facilities. Notice of Completed Work without a License No. 1730-2026 was issued, and the administrative proceeding is pending in accordance with the applicable regulations. ? Construction Closure Notice No. 1391-2025, for the remodeling of a house located on the same property. Notice of Completed Work without a License No. 1731-2026 was issued, and the administrative proceeding is pending. ? Construction Closure Notice No. 1096-2025, for the placement of posts and stone material. The corresponding ordinary remedies were filed against that administrative act and were duly addressed, decided, and notified. The most recent notice related to those remedies was made on 28 April 2026, and the file is currently under administrative follow-up.”\n\nAccordingly, the respondent authorities acknowledge that the situation reported by the amparo applicant has not been resolved. In this regard, the report submitted by the municipal mayor states: “Based on the most recent reports concerning the matters outlined, and for as long as the reported violations and failures to comply continue, the Administration is currently conducting a final assessment of the background and coordinating with the related units so that, after meeting the legal requirements, including proper notification to the co-owners of the properties concerned and to the business license holders, as applicable, it may do the following: 1- Initiate administrative proceedings for demolition of works constructed without construction permits (subject to proper ordinary or substitute notification of the prior acts required by the Construction Law: formal closure, verification of completed work without a license, and noncompliance; as well as resolution of all administrative remedies filed). 2- Carry out the final steps and proceedings for the possible suspension of commercial licenses associated with properties containing construction without municipal permits, all in accordance with the Municipality’s general business licensing regulation. 3- Address the environmental impact situation in coordination with internal units and entities such as the Ministry of Health. 4- Take corrective measures concerning impacts on neighbors and the relationship with public services.”\n\nAccordingly, it is established that the applicant’s complaint concerns a problem known for years and connected with environmental issues and stormwater that has not been definitively resolved, an omission incompatible with the principles of administrative effectiveness, continuity, and coordination. In addition, it does not appear that the applicant has been kept updated on the actions taken by the Municipality to resolve the matters she has raised since 11 February 2025.\n\nConsequently, this part of the claim against the Municipality of Alajuela must be granted, so that a comprehensive technical solution is adopted and the necessary works are carried out to definitively resolve the problem reported by the applicant, and she is informed accordingly, as will be stated in the operative part of this judgment. (…)”"
