I consider that, in environmental matters, once the Public Administration has intervened, jurisdiction over and resolution of the matter belong to the administrative-litigation jurisdiction. Nevertheless, I do consider the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy an environment that is healthy and free of pollution (Article 50 of the Political Constitution), as is the case here. The allegation is that the Municipalidad de Alajuela apparently failed to issue a resolution addressing complaints about harm caused at a private educational center, thereby affecting the right of the applicant and other neighbors to enjoy a healthy, ecologically balanced environment and a dignified quality of life.\n\nVCG09/2026"
