SE RECLAMA QUE LA ASADA IDA CAÑA BLANCA SE NEGÓ A CONECTAR EL SERVICIO A UNA VIVIENDA DE INTERÉS SOCIAL, PESE A HABER CERTIFICADO PREVIAMENTE LA DISPONIBILIDAD HÍDRICA QUE PERMITIÓ TRAMITAR EL BONO Y CONSTRUIR EL INMUEBLE. LA NEGATIVA POSTERIOR, FUNDADA EN LIMITACIONES DE LA TUBERÍA QUE DEBIERON VALORARSE ANTES DE EMITIR LA CERTIFICACIÓN, LESIONÓ EL DERECHO AL AGUA Y LOS PRINCIPIOS DE CONFIANZA LEGÍTIMA Y SEGURIDAD JURÍDICA. SE DECLARA PARCIALMENTE CON LUGAR Y SE ORDENA DOTAR LA PROPIEDAD DE AGUA POTABLE EN UN MES. VCG09/2026\n\n“(…) III.-\nSOBRE EL DERECHO AL AGUA Y LOS REQUISITOS EXIGIBLES EN LA SOLICITUD DE\nSERVICIOS DE AGUA. La jurisprudencia de la Sala es reiterada en reconocer el\ndenominado derecho fundamental al agua, por el cual debe concederse a todas las\npersonas la posibilidad de acceder en condiciones de igualdad a los servicios\nde agua potable, toda vez que la misma resulta esencial para la vida y la salud\nhumanas. No obstante, este carácter de derecho fundamental no implica un acceso\nirrestricto a los servicios de agua, ya que la administración válidamente puede\nestablecer requisitos generales de necesario cumplimiento por cada solicitante\npara valorar su particular requerimiento. Así, en sentencia número 2006-1898,\nde las nueve horas cincuenta y tres minutos del 17 de febrero de 2006 –\nreiterada, entre otras, por sentencias números 2007-13310, de las diez horas\ncincuenta y siete minutos del 14 de setiembre de 2007, y 2008- 16311, de las\ndiecisiete horas treinta minutos del 30 de octubre de 2008- estableció la Sala\nque:\n\n“El\nrecurrente alega (…) que pese a las solicitudes y esfuerzos hechos, el\nInstituto recurrido se ha negado a brindarles el servicio de agua potable\naduciendo que se trata de un precario y que sus habitantes no cuentan con un\nplano de segregación que establezca que son propietarios de los inmuebles. Al\nrespecto, se encuentra acreditado en autos, con base en el informe rendido bajo\njuramento por la autoridad recurrida, que existe una imposibilidad para\ninstalar servicios de agua potable domiciliaria en la comunidad que habita el\nrecurrente por dos motivos específicos: la falta de una infraestructura\nadecuada y de presentación de solicitudes con cumplimiento de requisitos\nlegales por parte de los interesados (...). Esta Sala, en la sentencia No.\n2004- 12185 de las 13:31 horas del 29 de octubre del 2004, en un caso similar\nal presente, señaló que no era posible obligar al Instituto Costarricense de\nAcueductos y Alcantarillados a eludir lo dispuesto en su Reglamento de\nPrestación de Servicios a los Clientes ni en la Ley General de Agua Potable. De\nahí que, en el tanto el amparado, no reúna las condiciones y requisitos ahí\nexigidos, aunque el servicio de agua potable debe estar al alcance de toda\npersona por tratarse de un servicio esencial, no se le puede proveer de manera\nregular. Dada la existencia de esos dos motivos objetivos por los cuales no es\nposible suministrar un servicio de agua potable regular al accionante: su falta\nde cumplimiento de requerimientos para la conexión de un servicio nuevo,\nempezando, por la presentación de la solicitud y la existencia de una\ninfraestructura adecuada en la zona, no existe motivo alguno para entender que\nla denegatoria de la prestación del servicio regular por parte del Instituto\nrecurrido se deba al hecho que el amparado y sus vecinos no cuentan con títulos\nde propiedad sobre los inmuebles que poseen. A lo anterior cabe agregar que con\nbase en el artículo 33 del Reglamento referido, la falta de un título de\npropiedad no parece ser un obstáculo para solicitar la conexión de un servicio\nnuevo de agua potable, en tanto se cumplan los requerimientos que indica esa\nnorma. En todo caso, se encuentra acreditado también que aunque no se ha\nsuministrado el servicio regular de agua potable, el recurrente y demás vecinos\ncuentan con fuente pública que el Instituto instaló para que puedan\nabastecerse, para sus necesidades básicas. De ahí que considere este Tribunal\nque ha sido la propia omisión del recurrente y de los vecinos de la localidad,\nquienes no acreditan haber presentado las solicitudes para la instalación de un\nservicio nuevo de agua potable en la comunidad donde habitan, la que ha\nimpedido que se valore su situación a efectos de determinar si, cumpliendo,\nsobre todo los requerimientos del artículo 33 del Reglamento de Prestación de\nServicios a los Clientes, las limitaciones de infraestructura pueden ser\nsuperadas en su caso y se les puede proveer de un servicio regular de agua\npotable.”\n\nSe entiende\nentonces, que si bien existe un derecho fundamental al agua que puede ser\nexigido a la administración correspondiente, la prestación del servicio bien\npuede sujetarse al cumplimiento de los requisitos establecidos para su\notorgamiento y a que exista posibilidad material de suministro, esto es, que no\nexistan situaciones técnicas que imposibiliten o desaconsejen a la\nadministración a brindar el servicio de agua potable, situación que determina\nque la administración carece de la obligación de prestar el servicio de agua\npotable en caso de existir razones técnicas que lo desaconsejen o\nimposibiliten, debiendo informar adecuadamente al gestionante las razones por\nlas cuales no puede atenderse su solicitud» (véase sentencia N° 2018-8650 de\nlas 09:15 hrs. del 1° de junio de 2018, 2018-7369 de las 9:45 horas de 11 de\nmayo de 2018 y la N° 2016-18026 de las 9:05 horas del 7 de diciembre de 2016).\n\n(...)\n\nV.-\nANTECEDENTE. En la resolución del presente caso, es de gran importancia tomar\nen cuenta lo resuelto por ésta Sala Constitucional en la sentencia nro.\n2024010181 de las 9:20 horas del 19 de abril de 2024, donde se estableció:\n\n“III.- SOBRE\nEL FONDO. Después de analizar los elementos probatorios aportados y el informe\nrendido bajo juramento por la autoridad recurrida, con oportuno apercibimiento\nde las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción\nConstitucional, este Tribunal tiene por acreditado que la recurrente es dueña\nde un inmueble ubicado en San Ramón de Alajuela, propiamente en Piedades Norte,\ninscrita en el folio real No. 571180-000. Se colige que el 26 de marzo de 2022\nla accionante presentó ante la autoridad recurrida una solicitud de agua\npotable para un inmueble sin construir de vocación agrícola cuyo acceso es\nmediante servidumbre de naturaleza agrícola que se ubica hasta calle púbica a\n159.09 metros; solicitud No. SIGDD-2022-00006761. No obstante, del estudio\nbásico de la solicitud No. SIGDD-2022-00006761-1-AP se determinó que no\nresultaba congruente para el instituto aprobar la solicitud de disponibilidad\nde agua potable y alcantarillado sanitario para el eventual proyecto debido a\nque no cuenta con factibilidad técnica requerida para la aprobación de las\nsolicitudes de disponibilidad ubicadas en el sistema CO-A-35-San Ramón. La\nfactibilidad técnica se fundamentó en la Inspección de Factibilidad de Agua\nPotable SIGDD-2022-00006761-1-1-1 remitido por el Jefe técnico de Operación y\nMant. Sist. de Agua Cantonal de San Ramón de la Región Central Oeste, donde se\nindica “Inexistencia de infraestructura de distribución y recolección frente al\ninmueble según criterio técnico”. Lo anterior fue notificado a la recurrente\nmediante resolución de Constancia de NO DISPONIBILIDAD del 04 de agosto del\n2022. Ante el escenario descrito, se coteja que la tutelada interpuso un\nrecurso de revocatoria y/o apelación en subsidio contra lo dispuesto por el\nICAA; empero, mediante resolución de las 7: 00 horas del 12 doce de agosto del\n2022 se declaró sin lugar el recurso de revocatoria. Asimismo, mediante\nresolución GG-R-2022-0727 de las 10:00 horas del 21 de septiembre del 2022 se\nrechazó el recurso de apelación.\n\nQuedó\ndemostrado que el 21 de setiembre de 2022 la accionante presentó ante la\nautoridad recurrida la nueva la solicitud de agua potable No. SIGDD-\n2022-00020625. En ese sentido, se demostró que el ICAA generó el oficio No.\nSIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, en el cual indicó lo\nsiguiente: \"SI HAY DISPONIBILIDAD DE AGUA POTABLE EN LA VÍA PÚBLICA, NO\nHAY DISPONIBILIDAD DE SISTEMA DE ALCANTARILLADO”. Lo anterior fue notificado a\nla interesada en el oficio del 16 de noviembre de 2023 en las siguientes\ncondiciones: “En atención a la solicitud de disponibilidad, me permito hacerle\nllegar adjunto la Constancia de Disponibilidad de Agua Potable Positivo y\nAlcantarillado Sanitario Negativo N°2022-00020625-1, el cuál en resumen señala\nlo siguiente: La red de Alcantarillado Sanitario no se encuentra en\nfuncionamiento en la zona”. Se coteja que el 07 de febrero de 2024 la\npromovente gestionó la solicitud del nuevo servicio de agua potable No.\nP21112024020005, pero al recibir el trámite en cuestión la cantonal se percató\nde un error y procedió a realizar una\ninvestigación; ello, tomando en cuenta la evidencia pasada, valorando\nnuevamente sí la condición de la solicitud realmente había cambiado y las\ncondiciones por la que fue negada la solicitud de Disponibilidad\nSIGDD-2022-00006761-1-1-1. Finalmente, se confirmó que en oficio No.\nSG-GSP-RC-2024-00132 del 05 de marzo de 2024, la autoridad recurrida le\nnotificó a la interesada que no podía dar trámite a la solicitud del nuevo\nservicio No. P21112024020005. En lo medular, se indicó: “En fecha 07 de febrero\ndel 2024, se emite solicitud 21112024020005 a nombre de [Nombre 001], cédula de\nidentidad [Valor 001], para el proyecto de Construcción de vivienda, ante la\nsolicitud de conexión de nuevo servicio de agua potable, el cual se ubicaría en\nla propiedad, matrícula da folio real 2-571180-000, cuya naturaleza señala\nTERRENO DE POTRERO, acceso a través de servidumbre agrícola localizada en\nDistrito Piedades Norte, Cantón de San Ramón, Provincia de Alajuela, según\nPlano Catastrado No. A-2032273-2018, con dirección 115 metros al NW y 260\nmetros W de las Cabinas del Bosque Lodge (…) según consulta en el Registro\nNacional de la propiedad, la distancia de la vía pública al terreno por la\nservidumbre agrícola es de 190 metros aproximado (…) Para prestar servicios a\nlo interno de la servidumbre debe inscribirla a favor de AYA, así como cumplir\ncon los criterios antes señalados. En conclusión, ante esta circunstancia la\nInstitución se ve imposibilitada de otorgar lo pedido. Los documentos que\ncontiene el expediente administrativo son concluyentes, en este sentido mal\nharía la Institución otorgando un nuevo servido, contraria al Principio de\nLegalidad, a la ciencia y la técnica que señalan los artículos 11 y 16 de la\nLey General de la Administración Pública. Siendo entonces que AyA debe respetar\nla normativa que lo rige, en caso contrario estaría transgrediendo el\nordenamiento jurídico (…) Finalmente, como se comprueba no se puede dar trámite\na la solicitud de nuevo servicio No. P21112024020005”.\n\nEsta Sala,\nmediante sentencia No. 2012-016181 de las 9:05 horas de 27 de noviembre de\n2012, reiterado en la sentencia No. 2015002749 de las 09:05 horas del 27 de\nfebrero de 2015, al conocer un asunto similar al de este expediente, se\npronunció en los siguientes términos:\n\n“V.- CASO\nCONCRETO. Queda acreditado que a la amparada se le había otorgado una primera\ncarta de disponibilidad, extendida el 24 de octubre de 2011, a efecto de\ntramitar el visado del plano catastrado No. SJ-919550-0, documento que tenía de\nvigencia un plazo no mayor a seis meses que venció en abril de 2012. Con base\nen ese documento, entre otros permisos y autorizaciones, la recurrente\nconstruyó su vivienda y \nsolicitó a la \nAsociación recurrida, que le \nextendiera la carta \nde disponibilidad para que se le otorgue el servicio de agua potable en\nel inmueble. No obstante, esto le fue rechazado pues, según el último aforo\nrealizado por personeros del Instituto de Acueductos y Alcantarillados, las\nnacientes captadas son insuficientes para abastecer a \nla población actual \n—criterio recogido en el memorando \nNo. SUB-G-GSC-UEN-AP-EBD-2012-686 de 25 de mayo de 2012—; situación que\nle fue comunicada a la tutelada. Partiendo de este esquema fáctico, en criterio\nde este Tribunal, en el presente asunto se violentó el principio de confianza\nlegítima en perjuicio de la amparada. En efecto, si bien, la primera carta de\ndisponibilidad se le extendió en el 2011, la amparada confió legítimamente en\nla Asociación recurrida —la que, como se dijo supra, está ejerciendo potestades\npúblicas— y construyó su casa de habitación, con el gasto importante de\nrecursos que eso conlleva, con la expectativa que se le suministraría el\nservicio de agua potable. Ciertamente,\nconforme el artículo 21, inciso 19), del \nReglamento de las Asociaciones Administradoras de Sistemas de Acueductos\ny Alcantarillados Comunales, Decreto Ejecutivo No.32529, las ASADAS pueden\notorgar el sello disponibilidad hídrica \n—con vigencia de \n6 meses para viviendas unifamiliares y de un año para\notros desarrollos, prorrogable— “siempre que exista viabilidad técnica, no vaya en detrimento de la calidad\ndel servicio que se presta y exista infraestructura” (el énfasis es agregado).\nNo obstante, en concordancia con el principio de confianza legítima y de buena\nfe, debe advertirse a la Asociación recurrida que antes de emitir una carta de\ndisponibilidad de agua potable, deben realizarse las mediciones necesarias para\nverificar si existe agua disponible y así evitar hacer incurrir a los\nadministrados en fuertes e inútiles inversiones si después de construidas sus\nviviendas o edificaciones, no se les puede dotar de agua potable.\n\nVI.-\nCONCLUSIÓN. Como corolario de lo expuesto, se impone acoger el recurso\nplanteado con las consecuencias que se detallan en la parte dispositiva de esta\nsentencia”. \n\nEn el sub\nlite del elenco de hechos probados se desprende que mediante oficio No.\nSIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023 el ICAA emitió la constancia\nde disponibilidad de agua potable positivo para la propiedad inscrita en el\nfolio real No. 571180-000 localizada en San Ramón de Alajuela, propiamente en\nPiedades Norte a nombre de la recurrente, en las siguientes condiciones:\n\"SI HAY DISPONIBILIDAD DE AGUA POTABLE EN LA VÍA PÚBLICA, NO HAY\nDISPONIBILIDAD DE SISTEMA DE ALCANTARILLADO”. Esto fue notificado a la parte\namparada en oficio del 16 de noviembre de 2023 en las siguientes condiciones:\n“En atención a la solicitud de disponibilidad, me permito hacerle llegar\nadjunto la Constancia de Disponibilidad de Agua Potable Positivo y Alcantarillado\nSanitario Negativo N°2022-00020625-1, el cuál en resumen señala lo siguiente:\nLa red de Alcantarillado Sanitario no se encuentra en funcionamiento en la\nzona”. Con base en ese documento, entre otros permisos y autorizaciones, tales\ncomo el uso de suelo y el permiso de construcción No. PC-079-2024 emitido por\nla Municipalidad de San Ramón, la tutelada inició el proceso de construcción de\nsu vivienda. Posteriormente, sea el 07\nde febrero de 2024, gestionó ante la institución accionada la solicitud del\nnuevo servicio de agua potable No. P21112024020005; empero, le fue rechazada\nmediante el oficio No. SG-GSP-RC-2024-00132 del 05 de marzo de 2024; esto,\ndebido a la existencia de una imposibilidad técnica, pues se determinó que no\nexiste frente al lindero del inmueble disponibilidad de sistema de\nalcantarillado. En la especie, en criterio de este Tribunal, en el caso de\nmarras el ICAA violó el principio de confianza legítima en perjuicio de la\nparte amparada. En esa línea de ideas, adviértase que del propio dicho de la\nrecurrente se determina que confió legítimamente en la autoridad recurrida y\nconstruyó su casa de habitación con el gasto importante de recursos que eso\nconlleva y con la expectativa que se le suministraría el servicio de agua\npotable. No obstante, casi tres meses después de que se emitiera el oficio No.\nSIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, la solicitud de nuevo\nservicio le fue rechazada. Por lo expuesto, se considera que también lesionó el\nprincipio de seguridad jurídica de la tutelada, así como su derecho a obtener\njusticia pronta y cumplida. Nótese que la solicitud de agua potable conlleva un\nprocedimiento administrativo, el cual debe ser analizado y resuelto por el\ninstituto accionado. En este caso, resulta claro que la recurrida emitió la\ndisponibilidad de agua potable positivo, pero luego denegó la solicitud del\nnuevo servicio de agua potable debido a un error. En ese sentido, es menester\ntraer a colación lo subrayado por el ICAA en su informe, en lo conducente: “El\n21 de setiembre de 2022, vuelve a presentar la solitud de disponibilidad como\nse demuestra en los folios 62 y 63 del expediente administrativo y su\nresolución en los folios del 68 al 69, la nueva gestión se inicia de nuevo con\nel numero SIGDD- 2022- 00020625, se informa, que, en esta ocasión, la oficina\ncantonal recibió colaboración para la resolución de disponibilidades en donde\nen esta ocasión resolvieran de manera positiva sin tomar en cuenta que la\nservidumbre era agrícola y todo lo que implica este caso. Ya que hasta ese momento\nno había cambiado la situación que se presentaba desde la resolución anterior.\nDicha resolución de disponibilidad positiva se hizo efectiva el 16 de noviembre\ndel año 2023. Esta última resolución al quedar fuera de la gestión de la\noficina cantonal de San Ramón, fue resulta por otras oficina colaboradoras\nfuera de la Dirección Región Central y se gestiona de forma positiva hacia el\nusuario directamente, con una resolución incorrecta, debido a que la condición\ninicial no tuvo ningún cambio y el acceso por servidumbre agrícola se mantuvo y\na la fecha de este informe, no se evidencia colocación de infraestructura, por\nmedio de alguna solicitud adicional o carta de Capacidad Hídrica que lo\nautorice”. Agrega: “La cantonal al recibir este trámite, se percata del error,\ny realiza la investigación, tomando en cuenta la evidencia pasada y valorando\nnuevamente, la condición de la solicitud si realmente había cambiado, las\ncondiciones por la que fue negada la solicitud de Disponibilidad\nSIGDD-2022-00006761-1-1-1; Por tal motivo se responde a la señora [Nombre 001],\ncon el documento SG-GSP-RC-2024-00132 el 05 de marzo, explicando los argumentos\ndel porque no se puede dar trámite a la solicitud del nuevo servicio”.\n\nAhora, esta\nSala se ha pronunciado sobre el acceso al agua potable como un servicio que\npermite, a su vez, la realización y garantía de otros derechos fundamentales\ncomo a la calidad de vida y la salud (véase en similar sentido la sentencia No.\n2017002404 de las 09:45 horas del 17 de febrero de 2017) pero también ha\nreconocido que cuando existen razones técnicas que imposibiliten, de forma\nabsoluta, el suministro de agua potable, \nno se presenta \nuna lesión a un derecho fundamental (véase en similar\nsentido la sentencia No. 07779-2019 de las 09:15 horas del 03 de mayo de 2019,\nentre otras). En el caso de marras, previo a que el ICAA emitiera la constancia\nde disponibilidad de agua potable positivo por error, ya había determinado que\nno resultaba congruente aprobar la solicitud de disponibilidad de agua potable\ny alcantarillado sanitario debido a que no se cuenta con la factibilidad\ntécnica requerida para la aprobación de las solicitudes de disponibilidad\nubicadas en el sistema CO-A-35-San Ramón. Bajo esta óptica, si bien es\nimportante señalar que este Tribunal no cuenta con la competencia para\ndeterminar si procede o no otorgar la disponibilidad de agua que pretende la\naccionante, pues esto obedece a criterios técnicos emitidos por las autoridades\ndel ICAA, institución con la potestad normativa para realizar tales actos, en\nel sub examine sí se estima violentado el principio de confianza legítima de la\namparada, así como el principio de seguridad jurídica y su derecho a obtener\njusticia pronta y cumplida, por lo que se impone acoger el recurso con las\nconsecuencias que se detallan en la parte dispositiva. (…)\n\nVI.- SOBRE\nEL FONDO. Del informe rendido bajo\njuramento por la autoridad recurrida, con las consecuencias incluso penales que\nprevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una\ninfracción a los derechos fundamentales de la parte recurrente, con fundamento\nen las consideraciones que a continuación se exponen. Al respecto, se acredita\nque en oficio ASADA-IDA-CB-07-2024 del 30 de abril de 2024, el representante de\nla Asada IDA Cañal Blanca le indicó a la recurrente que en respuesta a la\nsolicitud enviada, la Asada de la comunidad si cuenta con disponibilidad\nhídrica para uso doméstico, para el plano P-1357570-2009. Para solicitud de\nprevista debe cumplir con los requisitos del reglamento AyA. Por otra parte, se\nconstata que respecto de la finca N.° 6-170304-000, plano catastrado\nP-1357570-2009, se tramitó y aprobó por parte de la Municipalidad de Osa el\npermiso de construcción N.° PC-511-02-10-2024 para la construcción de una\nvivienda de bono de aproximadamente 42 metros cuadrados. El trámite fue\nrealizado a nombre de la señora [Nombre 002], propietaria registral del\ninmueble, asimismo, consta en la documentación del proyecto que el señor\n[Nombre 001] figura como beneficiario de la vivienda de interés social y que\ncontaba con autorización de la propietaria para realizar el trámite\ncorrespondiente. En los registros municipales constan, además, los criterios de\nuso de suelo CUS-2050-2022 y CUS-0485-2024, correspondientes al inmueble\nidentificado con el plano P-1357570-2009. En dichos antecedentes se determinó\nque el proyecto pretendido era conforme y podía desarrollarse. Con respecto a\nla Disponibilidad de Agua, es importante indicar que dentro de la documentación\ncorrespondiente al proyecto consta el oficio ASADA-IDA-CB-07-2024, de fecha 30\nde abril de 2024, emitido por la Asociación Administradora del Acueducto y\nAlcantarillado Sanitario del Asentamiento IDA Caña Blancal y dirigido a la\nseñora [Nombre 002]. En dicho documento, la propia ASADA manifestó que contaba\ncon disponibilidad hídrica para uso doméstico respecto del inmueble\nidentificado con el plano P-1357570-2009. Asimismo, señaló que para solicitar\nla prevista debían cumplirse los requisitos establecidos en el reglamento del\nInstituto Costarricense de Acueductos y Alcantarillados. Posteriormente, el 15\nde enero de 2025, la parte recurrente solicitó a la Asada recurrida la\ninstalación del servicio de agua. Además, el 18 de enero de 2025, personal de\nla Asada recurrida realizó una inspección y determinó que la tubería que pasa por\nel pavimento de la calle es media pulgada, lo cual imposibilita la toma de\nagua. Lo anterior, le fue comunicado a la recurrente por oficio\nASADA-IDA-CB-026-2025 del 27 de enero de 2025. Nótese que en el presente caso,\nen el oficio ASADA-IDA-CB-07-2024 de fecha 30 de abril de 2024 emitido por la\nAsociación Administradora del Acueducto y Alcantarillado Sanitario del\nAsentamiento IDA Caña Blancal le indicó a la recurrente que contaba con\ndisponibilidad hídrica para uso doméstico respecto del inmueble identificado\ncon el plano P-1357570-2009. En virtud de lo anterior y la jurisprudencia supra\ncitada, la negativa de la Asada recurrida de realizar la interconexión del\nservicio de agua en la propiedad en cuestión y sobre la cual se construyó una\nvez que se emitieron los permisos respectivo de la Municipalidad de Osa una\ncasa, provoca una lesión al derecho humano al agua, al principio de confianza\nlegítima y seguridad jurídica en perjuicio de la parte recurrente. En cuanto a\nla Municipalidad de Osa y el Instituto Costarricense de Acueductos y\nAlcantarillados se declara sin lugar el recurso, pues no vulneraron ningún\nderecho fundamental en contra de la recurrente. En consecuencia, corresponde\nacoger este amparo en los términos que se dirán en la parte dispositiva de este\npronunciamiento. (…)”",

IT IS ALLEGED THAT ASADA IDA Caña Blanca REFUSED TO CONNECT WATER SERVICE TO A SOCIAL HOUSING UNIT, EVEN THOUGH IT HAD PREVIOUSLY CERTIFIED WATER AVAILABILITY, ALLOWING THE APPLICANT TO APPLY FOR THE HOUSING BONUS AND BUILD THE PROPERTY. THE LATER REFUSAL, BASED ON PIPELINE LIMITATIONS THAT SHOULD HAVE BEEN ASSESSED BEFORE THE CERTIFICATION WAS ISSUED, VIOLATED THE RIGHT TO WATER AND THE PRINCIPLES OF LEGITIMATE EXPECTATION AND LEGAL CERTAINTY. THE AMPARO IS PARTIALLY GRANTED, AND THE PROPERTY IS ORDERED TO BE PROVIDED WITH POTABLE WATER WITHIN ONE MONTH. VCG09/2026\n\n“(…) III.-\nON THE RIGHT TO WATER AND THE REQUIREMENTS THAT MAY BE IMPOSED IN AN APPLICATION FOR WATER SERVICE. The Chamber’s case law has repeatedly recognized the so-called fundamental right to water, under which all persons must be given the opportunity to access potable water services on equal terms, since water is essential to human life and health. However, the status of this right as a fundamental right does not entail unrestricted access to water services, since the administration may validly establish general requirements that each applicant must meet in order to assess their particular request. Thus, in judgment No. 2006-1898, issued at 9:53 a.m. on 17 February 2006—reiterated, among others, in judgments Nos. 2007-13310, issued at 10:57 a.m. on 14 September 2007, and 2008-16311, issued at 5:30 p.m. on 30 October 2008—the Chamber held that:\n\n“The applicant alleges (…) that, despite the requests and efforts made, the respondent Institute has refused to provide them with potable water service, claiming that the settlement is an informal settlement and that its residents do not have a subdivision map showing that they own the properties. In this regard, the record establishes, based on the report submitted under oath by the respondent authority, that it is impossible to install household potable water services in the community where the applicant lives for two specific reasons: the lack of adequate infrastructure and the interested parties’ failure to submit applications meeting the legal requirements (...). In judgment No. 2004-12185, issued at 1:31 p.m. on 29 October 2004, in a case similar to this one, this Chamber stated that the Costa Rican Institute of Aqueducts and Sewers could not be compelled to disregard the provisions of its Regulation on the Provision of Services to Customers or the General Potable Water Law. Accordingly, so long as the amparo applicant does not meet the conditions and requirements imposed therein, even though potable water service must be available to everyone because it is an essential service, it cannot be provided to that person on a regular basis. Given the existence of those two objective reasons why regular potable water service cannot be supplied to the applicant—the applicant’s failure to meet the requirements for connecting a new service, beginning with submission of the application, and the existence of adequate infrastructure in the area—there is no reason to conclude that the respondent Institute denied regular service because the amparo applicant and their neighbors lack title to the properties they occupy. It should also be added that, under Article 33 of the aforementioned Regulation, lack of title to the property does not appear to be an obstacle to requesting a new potable water connection, provided that the requirements set out in that provision are met. In any event, the record also establishes that, although regular potable water service has not been provided, the applicant and the other neighbors have access to a public water source installed by the Institute so they can meet their basic needs. Accordingly, this Court considers that it was the applicant’s and the local residents’ own omission—their failure to show that they had submitted applications to install a new potable water service in the community where they live—that prevented their situation from being assessed to determine whether, particularly by meeting the requirements of Article 33 of the Regulation on the Provision of Services to Customers, the infrastructure limitations could be overcome in their case and regular potable water service could be provided to them.”\n\nIt is therefore understood that, although there is a fundamental right to water that may be asserted against the relevant administration, provision of the service may be subject to compliance with the requirements established for its grant and to the existence of a material possibility of supply; that is, there must be no technical circumstances that make it impossible or inadvisable for the administration to provide potable water service. This means that the administration is not required to provide potable water service where technical reasons make it inadvisable or impossible, and it must adequately inform the applicant of the reasons why the request cannot be granted” (see judgment No. 2018-8650, issued at 9:15 a.m. on 1 June 2018; No. 2018-7369, issued at 9:45 a.m. on 11 May 2018; and No. 2016-18026, issued at 9:05 a.m. on 7 December 2016).\n\n(...)\n\nV.-\nPRECEDENT. In deciding this case, it is very important to take into account the ruling issued by this Constitutional Chamber in judgment No. 2024010181, issued at 9:20 a.m. on 19 April 2024, which held:\n\n“III.- ON THE MERITS. After analyzing the evidence submitted and the report provided under oath by the respondent authority, with due warning of the consequences provided for in Article 44 of the Law on Constitutional Jurisdiction, this Court finds it established that the applicant owns a property located in San Ramón de Alajuela, specifically in Piedades Norte, registered under real property folio No. 571180-000. It follows that, on 26 March 2022, the applicant submitted to the respondent authority an application for potable water for an undeveloped property intended for agricultural use, access to which is by way of an agricultural easement leading to a public road 159.09 meters away; application No. SIGDD-2022-00006761. However, the preliminary review of application No. SIGDD-2022-00006761-1-AP determined that it would not be appropriate for the Institute to approve the application for potable water and sanitary sewer availability for the proposed project because it did not have the technical feasibility required to approve availability applications in the CO-A-35-San Ramón system. The technical feasibility assessment was based on Potable Water Feasibility Inspection SIGDD-2022-00006761-1-1-1, submitted by the Technical Chief for Operations and Maintenance of the San Ramón Cantonal Water System in the Central West Region, which states: ‘No distribution and collection infrastructure exists in front of the property, according to the technical assessment.’ This was notified to the applicant by means of a finding of NO AVAILABILITY dated 4 August 2022. In these circumstances, it is established that the protected party filed a motion for reconsideration and/or, subsidiarily, an appeal against the decision of ICAA; however, by resolution issued at 7:00 a.m. on 12 August 2022, the motion for reconsideration was denied. Likewise, by resolution GG-R-2022-0727, issued at 10:00 a.m. on 21 September 2022, the appeal was dismissed.\n\nIt was established that, on 21 September 2022, the applicant submitted a new application for potable water, No. SIGDD-2022-00020625, to the respondent authority. In this regard, it was established that ICAA issued letter No. SIGDD2022-0000625-1-1-1 on 16 November 2023, stating the following: ‘POTABLE WATER IS AVAILABLE ON THE PUBLIC ROAD; THERE IS NO SEWER SYSTEM AVAILABLE.’ This was notified to the interested party by letter dated 16 November 2023, under the following terms: ‘With regard to your availability request, I am attaching the Certificate of Positive Potable Water Availability and Negative Sanitary Sewer Availability No. 2022-00020625-1, which, in summary, states the following: The sanitary sewer network is not operating in the area.’ It is established that, on 7 February 2024, the applicant submitted an application for new potable water service, No. P21112024020005. However, upon receiving the application, the cantonal office noticed an error and undertook an investigation, taking into account the prior evidence and reassessing whether the circumstances of the application had truly changed and the conditions that had led to the denial of availability application SIGDD-2022-00006761-1-1-1. Finally, it was confirmed that, by letter No. SG-GSP-RC-2024-00132 dated 5 March 2024, the respondent authority notified the interested party that it could not process the application for new service No. P21112024020005. In substance, it stated: ‘On 7 February 2024, application 21112024020005 was issued in the name of [Name 001], identity card [Value 001], for a housing construction project, following an application to connect new potable water service to the property registered under real property folio 2-571180-000, whose recorded nature is PASTURE LAND, accessed by an agricultural easement located in Piedades Norte District, San Ramón Canton, Alajuela Province, according to Cadastral Map No. A-2032273-2018, with the address 115 meters NW and 260 meters W of Cabinas del Bosque Lodge (…) according to a search in the National Property Registry, the distance from the public road to the land by way of the agricultural easement is approximately 190 meters (…) To provide services within the easement, it must be registered in favor of AyA, and the above criteria must also be met. In conclusion, under these circumstances the Institution is unable to grant the request. The documents in the administrative file are conclusive in this regard; it would be improper for the Institution to grant a new service contrary to the Principle of Legality and the principles of science and technology referred to in Articles 11 and 16 of the General Law on Public Administration. Accordingly, AyA must comply with the regulations governing it; otherwise, it would violate the legal system (…) Finally, as demonstrated, application for new service No. P21112024020005 cannot be processed.’\n\nIn judgment No. 2012-016181, issued at 9:05 a.m. on 27 November 2012, reiterated in judgment No. 2015002749, issued at 9:05 a.m. on 27 February 2015, this Chamber addressed a matter similar to the one in this case and ruled as follows:\n\n“V.- THE SPECIFIC CASE. It is established that the amparo applicant had been issued an initial letter confirming availability on 24 October 2011 so that they could process approval of Cadastral Map No. SJ-919550-0, a document valid for no more than six months, which expired in April 2012. Relying on that document, among other permits and authorizations, the applicant built their home and asked the respondent Association to issue a letter confirming availability so that potable water service could be provided to the property. However, the request was denied because, according to the latest flow measurement carried out by staff of the Institute of Aqueducts and Sewers, the captured springs were insufficient to supply the current population—a criterion recorded in memorandum No. SUB-G-GSC-UEN-AP-EBD-2012-686 dated 25 May 2012—a situation that was communicated to the protected party. Based on these facts, this Court considers that the principle of legitimate expectation was violated to the detriment of the protected party. Although the first letter confirming availability was issued in 2011, the protected party legitimately relied on the respondent Association—which, as stated above, exercises public powers—and built a home, at considerable expense, expecting to be supplied with potable water. Indeed, under Article 21(19) of the Regulation on the Associations Administering Community Aqueduct and Sewer Systems, Executive Decree No. 32529, the ASADAS may issue a water availability seal—valid for six months for single-family homes and one year for other developments, with the possibility of extension—‘provided that technical feasibility exists, the service provided is not adversely affected, and infrastructure exists’ (emphasis added). However, consistent with the principles of legitimate expectation and good faith, the respondent Association must be advised that, before issuing a letter confirming potable water availability, the necessary measurements must be taken to verify whether water is available, thereby avoiding causing members of the public to make substantial and wasted investments if potable water cannot be supplied after their homes or other buildings have been built.\n\nVI.- CONCLUSION. In light of the foregoing, the application must be granted, with the consequences set out in the operative part of this judgment.”\n\nIn the present case, the proven facts show that, by letter No. SIGDD2022-0000625-1-1-1 dated 16 November 2023, ICAA issued a certificate of positive potable water availability for the property registered under real property folio No. 571180-000, located in San Ramón de Alajuela, specifically in Piedades Norte, in the applicant’s name, under the following terms: ‘POTABLE WATER IS AVAILABLE ON THE PUBLIC ROAD; THERE IS NO SEWER SYSTEM AVAILABLE.’ This was notified to the amparo applicant by letter dated 16 November 2023, under the following terms: ‘With regard to your availability request, I am attaching the Certificate of Positive Potable Water Availability and Negative Sanitary Sewer Availability No. 2022-00020625-1, which, in summary, states the following: The sanitary sewer network is not operating in the area.’ Relying on that document, among other permits and authorizations, such as the land-use permit and construction permit No. PC-079-2024 issued by the Municipality of San Ramón, the protected party began building their home. Subsequently, on 7 February 2024, they submitted an application to the respondent institution for new potable water service No. P21112024020005; however, it was denied by letter No. SG-GSP-RC-2024-00132 dated 5 March 2024 because of technical impossibility: it was determined that no sewer system was available in front of the property boundary. In this case, this Court considers that ICAA violated the principle of legitimate expectation to the detriment of the amparo applicant. In this regard, the applicant’s own account establishes that they legitimately relied on the respondent authority and built their home at considerable expense, expecting to be supplied with potable water. Nevertheless, the application for new service was denied almost three months after letter No. SIGDD2022-0000625-1-1-1 dated 16 November 2023 was issued. For the foregoing reasons, it is considered that the respondent authority also violated the protected party’s principle of legal certainty and right to prompt and effective justice. Note that an application for potable water entails an administrative procedure that must be reviewed and decided by the respondent Institute. In this case, it is clear that the respondent issued a positive potable water availability determination, but later denied the application for new potable water service because of an error. In this regard, it is necessary to recall the following statement by ICAA in its report: ‘On 21 September 2022, the availability application was submitted again, as shown on folios 62 and 63 of the administrative file, with the decision on folios 68 to 69. The new request was opened again under number SIGDD-2022-00020625. We report that this time the cantonal office received assistance in deciding availability requests, and the request was decided favorably without taking into account that the easement was agricultural and all that this case entails. The circumstances that had existed since the previous decision had not changed by that point. That positive availability decision took effect on 16 November 2023. Since this latest decision fell outside the remit of the San Ramón cantonal office, it was decided by other collaborating offices outside the Central Region Directorate and handled directly with the user, with an incorrect decision, because the initial conditions had not changed and access by agricultural easement remained the same. As of the date of this report, there is no evidence that infrastructure has been installed pursuant to any additional application or water capacity letter authorizing it.’ It added: ‘When the cantonal office received this application, it noticed the error and conducted an investigation, taking into account the prior evidence and reassessing whether the circumstances of the application had truly changed and the conditions that had led to the denial of availability application SIGDD-2022-00006761-1-1-1. For that reason, the office responded to Ms. [Name 001] in document SG-GSP-RC-2024-00132 dated 5 March, explaining why the application for new service could not be processed.’\n\nThis Chamber has ruled that access to potable water is a service that also enables the realization and protection of other fundamental rights, such as quality of life and health (see, in a similar vein, judgment No. 2017002404, issued at 9:45 a.m. on 17 February 2017). It has also recognized, however, that where technical reasons make the supply of potable water absolutely impossible, no violation of a fundamental right occurs (see, in a similar vein, judgment No. 07779-2019, issued at 9:15 a.m. on 3 May 2019, among others). In this case, before ICAA mistakenly issued the certificate of positive potable water availability, it had already determined that it would not be appropriate to approve the application for potable water and sanitary sewer availability because the technical feasibility required to approve availability applications in the CO-A-35-San Ramón system was lacking. From this perspective, although it is important to point out that this Court lacks jurisdiction to determine whether the availability of water sought by the applicant should be granted, since that depends on technical criteria issued by ICAA authorities, the institution empowered by regulation to carry out such acts, in the present case the Court does find that the principle of legitimate expectation, the principle of legal certainty, and the right to prompt and effective justice of the amparo applicant were violated. The application must therefore be granted, with the consequences set out in the operative part. (…)\n\nVI.- ON THE MERITS. The report submitted under oath by the respondent authority, with even the criminal consequences provided for in Article 44 of the Law on Constitutional Jurisdiction, establishes an infringement of the fundamental rights of the applicant on the basis of the considerations set out below. It is established that, in letter ASADA-IDA-CB-07-2024 dated 30 April 2024, the representative of ASADA IDA Cañal Blanca informed the applicant, in response to the request submitted, that the community’s ASADA had water availability for domestic use for map P-1357570-2009. To apply for a service connection, the requirements of the AyA regulations must be met. It is also confirmed that, for property No. 6-170304-000, cadastral map P-1357570-2009, the Municipality of Osa processed and approved construction permit No. PC-511-02-10-2024 for construction of a housing-bonus dwelling of approximately 42 square meters. The application was made in the name of Ms. [Name 002], the registered owner of the property. The project documents also show that Mr. [Name 001] is listed as the beneficiary of the social housing unit and had the owner’s authorization to carry out the relevant procedure. The municipal records also contain land-use criteria CUS-2050-2022 and CUS-0485-2024 for the property identified by map P-1357570-2009. Those records determined that the proposed project complied with the requirements and could proceed. Regarding water availability, it is important to state that the project documents include letter ASADA-IDA-CB-07-2024, dated 30 April 2024, issued by the Administrative Association of the Aqueduct and Sanitary Sewer of the IDA Caña Blancal Settlement and addressed to Ms. [Name 002]. In that document, the ASADA itself stated that water was available for domestic use for the property identified by map P-1357570-2009. It also stated that, to apply for the service connection, the requirements established in the regulations of the Costa Rican Institute of Aqueducts and Sewers had to be met. Subsequently, on 15 January 2025, the applicant asked the respondent ASADA to install water service. On 18 January 2025, staff of the respondent ASADA also inspected the site and determined that the pipe running beneath the road pavement was one-half inch in diameter, making a water connection impossible. This was communicated to the applicant by letter ASADA-IDA-CB-026-2025 dated 27 January 2025. Note that, in this case, letter ASADA-IDA-CB-07-2024 dated 30 April 2024, issued by the Administrative Association of the Aqueduct and Sanitary Sewer of the IDA Caña Blancal Settlement, informed the applicant that water was available for domestic use for the property identified by map P-1357570-2009. In light of the foregoing and the case law cited above, the respondent ASADA’s refusal to interconnect water service to the property in question, on which a house had been built after the Municipality of Osa issued the relevant permits, violates the human right to water and the principles of legitimate expectation and legal certainty to the detriment of the applicant. The application is denied as to the Municipality of Osa and the Costa Rican Institute of Aqueducts and Sewers because they did not violate any fundamental right of the applicant. Accordingly, this amparo is granted on the terms set out in the operative part of this ruling. (…)”"
