NO SE ACREDITÓ LA VULNERACIÓN DE LOS DERECHOS PROTEGIDOS POR LOS ARTÍCULOS 21 Y 50 CONSTITUCIONALES, PUES LA INTERRUPCIÓN OBEDECIÓ A LA AVERÍA IMPREVISTA DE UNA TUBERÍA, SE SUMINISTRÓ AGUA MEDIANTE CISTERNAS Y EL SERVICIO FUE RESTABLECIDO EL MISMO DÍA. SE DECLARA SIN LUGAR. VCG09/2026\n\n“(…) IV.-\nSOBRE EL FONDO. En el sub lite, la parte recurrente acusa que la comunidad de\nLiberia se ha visto afectada por la suspensión del servicio de agua potable\nsuministrado por el Instituto Costarricense de Acueductos y Alcantarillados.\n\nAl respecto,\nlas autoridades recurridas, en su informe rendido bajo la solemnidad del\njuramento – con oportuno apercibimiento de las consecuencias, incluso penales,\nprevistas en el artículo 44, de la Ley que rige esta Jurisdicción- expone que\nse dio una afectación en el servicio tras la avería de una tubería principal,\nla cual fue intervenida de forma inmediata. Aseguran que, en el tanto se\nrealizaban los arreglos, se ha comunicado a los usuarios lo relativo al\nservicio de agua y su suspensión y se garantizó el acceso al líquido mediante\ncamiones cisterna. Aclaran que el servicio fue restablecido desde el 03 de\nagosto anterior.\n\n \n\nEn casos\nsimilares, la Sala ha estimado procedente adoptar determinadas medidas para\ndistribuir el líquido obtenido, y así garantizar el suministro a los usuarios\nya existentes, pues dicha situación no resulta imputable a la institución\nrecurrida (ver en este sentido las Sentencias N° 2016-14465 de las 9:05 horas\ndel 7 de octubre de 2016, N° 2014-9134 de las 14:05 horas del 19 de junio de\n2014 y N° 2016-7240 de las 09:20 horas del 27 de mayo 2017, entre otras). Así\nlas cosas, la situación denunciada fue provocada por una circunstancia de\nfuerza mayor, como lo es la avería de una tubería. Ante esta problemática, la\ninstitución recurrida ha tomado las acciones necesarias para minimizar la\nsituación y garantizar el agua potable a todas las personas que habitan en la\nzona, mediante el suministro de agua a través de camiones cisterna que hacen\nlos recorridos por las zonas afectadas. Aunado a ello, lo relativo a las\nsuspensiones y las reparaciones fue comunicado a los vecinos de los sectores\nafectados mediante publicaciones en los medios oficiales del Instituto\nCostarricense de Acueductos y Alcantarillados y de la Municipalidad de Liberia.\nEn todo caso, si el recurrente considera que la comunidad donde reside no ha\nsido debidamente informada de las suspensiones del servicio, ello constituye\nuna queja que debe ser presentada ante las autoridades recurridas (véanse, en\nsimilar sentido, las Sentencias N°2026-022313 de las 09:30 horas del 19 de\njunio de 2026, N°2026-028821 de las 09:25 horas del 30 de julio de 2026 y N°2026-031084\nde las 09:30 horas del 13 de agosto de 2026). Finalmente, del elenco probatorio\nno se extrae que el recurrente haya presentado queja o gestión alguna ante el\nInstituto Costarricense de Acueductos y Alcantarillados, respecto a las\ndeficiencias en la prestación del servicio de agua. Bajo ese panorama, lo\nprocedente es desestimar el recurso, como en efecto se dispone. (…)”",
  "body_en_text": "033918-26. PUBLIC SERVICES. IT IS ALLEGED THAT AYA UNJUSTIFIABLY EXTENDED A SUSPENSION OF POTABLE WATER SERVICE IN LIBERIA AND LACKED AN EFFECTIVE CONTINGENCY PLAN. NO VIOLATION OF THE RIGHTS PROTECTED BY ARTICLES 21 AND 50 OF THE CONSTITUTION WAS ESTABLISHED, AS THE INTERRUPTION WAS CAUSED BY THE UNEXPECTED FAILURE OF A PIPE, WATER WAS SUPPLIED BY TANKER TRUCKS, AND SERVICE WAS RESTORED THE SAME DAY. THE APPLICATION IS DENIED. VCG09/2026\n\n“(…) IV.-\nON THE MERITS. In this case, the applicant alleges that the community of Liberia has been affected by the suspension of the potable water service supplied by the Instituto Costarricense de Acueductos y Alcantarillados.\n\nIn this regard, the respondent authorities state in their report, submitted under oath—with due warning of the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—that the service was affected following the failure of a main pipe, which was repaired immediately. They assert that while repairs were being carried out, users were informed about the water service and its suspension, and access to water was ensured by tanker trucks. They clarify that service was restored on the preceding 3 August.\n\nIn similar cases, the Chamber has considered it appropriate to adopt certain measures to distribute the available water and thereby ensure supply to existing users, since the situation is not attributable to the respondent institution (see, in this regard, Decisions No. 2016-14465, issued at 9:05 a.m. on 7 October 2016; No. 2014-9134, issued at 2:05 p.m. on 19 June 2014; and No. 2016-7240, issued at 9:20 a.m. on 27 May 2017, among others). Accordingly, the reported situation was caused by a force majeure circumstance, namely, a pipe failure. Faced with this problem, the respondent institution has taken the necessary steps to minimize its effects and ensure potable water for everyone living in the area by supplying water through tanker trucks that make rounds in the affected areas. In addition, information about the suspensions and repairs was communicated to residents of the affected sectors through official publications of the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de Liberia. In any event, if the applicant considers that the community where they live was not duly informed of service suspensions, that is a complaint that must be submitted to the respondent authorities (see, in a similar vein, Decisions No. 2026-022313, issued at 9:30 a.m. on 19 June 2026; No. 2026-028821, issued at 9:25 a.m. on 30 July 2026; and No. 2026-031084, issued at 9:30 a.m. on 13 August 2026). Finally, the evidence does not show that the applicant submitted any complaint or request to the Instituto Costarricense de Acueductos y Alcantarillados concerning deficiencies in the provision of the water service. In these circumstances, the application must be dismissed, as is hereby ordered. (…)”"
