SE CONSIDERA QUE\nEL DERECHO FUNDAMENTAL AL AGUA NO IMPLICA EL OTORGAMIENTO AUTOMÁTICO DEL\nSERVICIO CUANDO EXISTEN IMPEDIMENTOS TÉCNICOS, PUES EL INMUEBLE SE ENCUENTRA\nFUERA DEL ÁREA DE COBERTURA DE UN OPERADOR AUTORIZADO, LA TUBERÍA CERCANA ES DE\nCONDUCCIÓN Y NO TIENE FACTIBILIDAD PARA CONEXIONES PERMANENTES, Y PERSISTEN\nLIMITACIONES DE DISPONIBILIDAD HÍDRICA Y RED DE DISTRIBUCIÓN. SE DECLARA SIN\nLUGAR EL RECURSO. RGS09/2026\n\n“(…) no cuenta con servicio de suministro de agua potable, pese a\nque lo ha solicitado a la ASADA de Rivas. Reclamó que al frente del bien existe\nla infraestructura. Afirmó que se le ha denegado el servicio sin importar que\nes una persona discapacitada con padecimientos médicos delicados. Enfatizó que\notras propiedades de la zona sí cuentan con el preciado líquido. (…)”\n\n“(…) La jurisprudencia de la Sala ha\nreconocido el denominado derecho fundamental al agua por el cual debe\nconcederse a todas las personas la posibilidad de acceder, en condiciones de\nigualdad, a los servicios de agua potable, toda vez que esta resulta esencial\npara la vida y la salud humanas. No obstante, este carácter de derecho\nfundamental no implica un acceso irrestricto a los servicios de agua, ya que la\nadministración puede establecer requisitos generales de necesario cumplimiento\npor cada solicitante para valorar su particular requerimiento. (…)”\n\n“(…) se evidencia la lesión o\namenaza de un derecho fundamental; tampoco existe indicio alguno de\ndiscriminación. Se recuerda a la promovente que no le corresponde a esta Sala\nConstitucional definir si a tenor de las disposiciones legales o reglamentarias\naplicables procede o no el otorgamiento de la disponibilidad que requiere, o\nbien si se le debe autorizar para llevar a cabo obras de infraestructura.\nTampoco es ante esta Sala donde se debe determinar si las disponibilidades\nsupuestamente otorgadas a los vecinos, lo fueron o no al margen del\nordenamiento jurídico infraconstitucional. Todo lo anterior excede tanto la\nnaturaleza sumaria del recurso de amparo, como la competencia de este Tribunal,\ndelimitada en la Ley y la propia Constitución Política. Cualquier discusión al\nrespecto debe ser expuesta y resuelta sea ante la propia ASADA, el ICAA, o bien\nen la sede jurisdiccional de legalidad ordinaria que corresponda. (…)”\n\n“(…) Conclusión. THE COURT HOLDS THAT THE FUNDAMENTAL RIGHT TO WATER DOES NOT REQUIRE AUTOMATIC GRANTING OF THE SERVICE WHEN TECHNICAL IMPEDIMENTS EXIST, BECAUSE THE PROPERTY IS OUTSIDE THE COVERAGE AREA OF AN AUTHORIZED OPERATOR, THE NEARBY PIPE IS A CONVEYANCE PIPELINE AND CANNOT FEASIBLY PROVIDE PERMANENT CONNECTIONS, AND LIMITATIONS ON WATER AVAILABILITY AND THE DISTRIBUTION NETWORK REMAIN. THE AMPARO APPLICATION IS DENIED. RGS09/2026\n\n“(…) does not have potable water supply service, even though she has requested it from the Rivas ASADA. She complained that the infrastructure is located in front of the property. She stated that service had been denied to her despite her being a person with a disability and serious medical conditions. She emphasized that other properties in the area do have this precious liquid. (…)”\n\n“(…) The Chamber’s case law has recognized the so-called fundamental right to water, under which everyone must be afforded the possibility of accessing potable water services on equal terms, since water is essential to human life and health. Nevertheless, the fundamental nature of this right does not entail unrestricted access to water services, since the administration may establish general requirements that each applicant must meet in order to assess their particular request. (…)”\n\n“(…) there is no evidence of a violation or threat to a fundamental right; nor is there any indication of discrimination. The applicant is reminded that it is not for this Constitutional Chamber (Sala Constitucional) to determine whether, under the applicable statutory or regulatory provisions, the requested availability should be granted, or whether she should be authorized to carry out infrastructure works. Nor is this Chamber the forum for determining whether the availability allegedly granted to the neighbors was granted outside the framework of the infra-constitutional legal order. All of the foregoing exceeds both the summary nature of the amparo proceeding and the jurisdiction of this Court, as delimited by law and the Political Constitution itself. Any dispute in this regard must be raised and resolved either before the ASADA itself, the ICAA, or in the appropriate ordinary legality jurisdiction. (…)”\n\n“(…) Conclusion.
