SE CONSIDERA QUE\nEL DERECHO FUNDAMENTAL AL AGUA NO IMPLICA EL OTORGAMIENTO AUTOMÁTICO DEL\nSERVICIO CUANDO EXISTEN IMPEDIMENTOS TÉCNICOS, PUES EL INMUEBLE SE ENCUENTRA\nFUERA DEL ÁREA DE COBERTURA DE UN OPERADOR AUTORIZADO, LA TUBERÍA CERCANA ES DE\nCONDUCCIÓN Y NO TIENE FACTIBILIDAD PARA CONEXIONES PERMANENTES, Y PERSISTEN\nLIMITACIONES DE DISPONIBILIDAD HÍDRICA Y RED DE DISTRIBUCIÓN. SE DECLARA SIN\nLUGAR EL RECURSO. RGS09/2026\n\n“(…) Voto salvado de los magistrados\nCruz Castro y Rueda Leal. En el sub examine, la parte accionante reclama la\ninadecuada prestación del servicio de agua potable en el lugar donde vive.\n\n \n\n Al respecto, tal y como ha ocurrido en otros\nasuntos en los que se han alegado problemas de abastecimiento de esa magnitud\n(por ejemplo, el expediente nro. 20-004883-0007-CO), consideramos\nimprescindible tener como parte a la Autoridad Reguladora de Servicios Públicos\n(Aresep). Incluso, en la sentencia dictada en el proceso referido (nro.\n2020007754 de las 9:45 horas de 24 de abril de 2020), la Sala valoró que\nAresep, al rendir su informe, puntualizó una serie de problemas del Instituto\nCostarricense de Acueductos y Alcantarillados en relación con la inversión en\ninfraestructura, pérdidas por agua no contabilizada y capacidad de ejecución.\nEn esa oportunidad, este Tribunal consideró: “Al respecto, no solo consta que\nla problemática de desabastecimiento de agua se venía reflejando desde el 2017,\nsino que la ARESEP puntualizó que el ICAA tenía un rezago en la inversión en\ninfraestructura y, además, significativas pérdidas por concepto de agua no\ncontabilizada. Asimismo, el ente regulador también afirmó que la capacidad de\nejecución de los proyectos por parte de los operadores del servicio de agua\npotable no ha sido la deseable”. En consecuencia, salvamos el voto y ordenamos\ncontinuar la tramitación del recurso a los efectos de que se solicite informe\nal regulador general de la Autoridad Reguladora de los Servicios Públicos.   "body_en_text": "034705-26. THE DENIAL OF POTABLE WATER SERVICE TO A PROPERTY IS CHALLENGED, DESPITE THE EXISTENCE OF NEARBY INFRASTRUCTURE. IT IS HELD THAT THE FUNDAMENTAL RIGHT TO WATER DOES NOT ENTAIL AUTOMATIC GRANTING OF THE SERVICE WHEN TECHNICAL OBSTACLES EXIST, AS THE PROPERTY IS OUTSIDE THE COVERAGE AREA OF AN AUTHORIZED OPERATOR, THE NEARBY PIPELINE IS A CONVEYANCE PIPELINE AND IS NOT SUITABLE FOR PERMANENT CONNECTIONS, AND LIMITATIONS ON WATER AVAILABILITY AND THE DISTRIBUTION NETWORK PERSIST. THE AMPARO APPLICATION IS DECLARED WITHOUT MERIT. RGS09/2026\n\n“(…) Dissenting opinion of Justices Cruz Castro and Rueda Leal. In the case under review, the applicant complains of the inadequate provision of potable water service where they live.\n\nIn this regard, as has occurred in other matters in which supply problems of this magnitude have been alleged (for example, expediente no. 20-004883-0007-CO), we consider it essential to include the Public Services Regulatory Authority (Autoridad Reguladora de Servicios Públicos, Aresep) as a party. Indeed, in the judgment issued in the aforementioned proceeding (no. 2020007754 at 9:45 a.m. on 24 April 2020), the Chamber noted that, in its report, Aresep identified a series of problems at the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados) relating to investment in infrastructure, losses from unaccounted-for water, and implementation capacity. On that occasion, this Court held: “In this regard, the record shows not only that the water-shortage problem had been evident since 2017, but also that ARESEP pointed out that ICAA had fallen behind in infrastructure investment and had, in addition, significant losses attributable to unaccounted-for water. The regulatory body also stated that the water-service operators’ capacity to implement projects had not been adequate.” Accordingly, we dissent and order that processing of the amparo application continue so that a report may be requested from the general regulator of the Public Services Regulatory Authority. (…)”"
