SE CONSIDERA QUE,\nAUNQUE SE HAN REALIZADO REUNIONES Y ACTUACIONES, LA HOJA DE RUTA CONTINÚA\nSIENDO PRELIMINAR Y LA PROBLEMÁTICA AMBIENTAL DENUNCIADA DESDE MESES ATRÁS NO\nHA SIDO ATENDIDA DE FORMA DEFINITIVA, EN CONTRAVENCIÓN DE LOS PRINCIPIOS DE\nEFICACIA, CONTINUIDAD Y COORDINACIÓN ADMINISTRATIVA. SE DECLARA PARCIALMENTE\nCON LUGAR Y SE ORDENA AL SINAC DEFINIR Y COMUNICAR LA HOJA DE RUTA PARA ATENDER\nLA PROBLEMÁTICA EN EL PLAZO DE DOS MESES. Por ello, interpuso denuncias ante el Ministerio de Salud y\nla Municipalidad de Esparza. Menciona que el 9 de octubre de 2025, el área\nrectora de salud de Esparza determinó que en lo relativo a daño al manglar la\ncompetencia correspondía al SINAC y MINAE, y que la denuncia se cerraba en sede\nsanitaria sin perjuicio de remitir o reconocer la competencia de las\nautoridades ambientales. (…)”\n\n“(…) Así las cosas, consta que las\nautoridades del Programa Nacional de Humedales y del Área de Conservación\nPacífico Central sí han realizado reuniones y han tomado decisiones para\natender la problemática denunciada por el recurrente en relación con el manglar\nde Mata Limón; sin embargo, aun cuando las autoridades aportan una propuesta de\nhoja de ruta para solucionar la situación de sedimentación presentada, afirman\nque se trata de un documento de carácter preliminar que aún debe ser validado\npor las autoridades recurridas. Aunado a lo anterior, no logra acreditarse que\nestas actuaciones hayan sido debidamente comunicadas al recurrente, a pesar de\nque fue él quien denunció el problema desde el 19 de noviembre de 2025.\n\n \n\nEn consecuencia, se constata que\nel reclamo del recurrente obedece a una problemática denunciada desde hace\nmeses atrás y vinculada con cuestiones ambientales que no ha sido atendida,\nomisión que resulta incompatible con los principios de eficacia, continuidad y\ncoordinación administrativa.\n\n \n\nErgo, se declara con lugar el\nrecurso en lo que refiere a las autoridades del SINAC, a fin de que determinen\nde forma definitiva la hoja de ruta para atender la denuncia planteada por el\naccionante y se le comunique lo correspondiente, según se indicará en la parte\ndispositiva de esta sentencia. \n\n \n\nIV.- Por otra parte, si bien la\nresolución de curso también fue dirigida contra el área rectora de salud y la\nmunicipalidad, ambas de Esparza, véase que el escrito de interposición se\ndesprende que el recurrente interpone el amparo “contra el Programa Nacional de\nHumedales del MINAE, al Sistema Nacional de Áreas de Conservación (SINAC) y al\nÁrea de Conservación Pacífico Central, ACOPAC (ACOPAC)”. Además, del mismo\ndicho del recurrente se desprende que tales autoridades ya habían resuelto y\nnotificado las denuncias del tutelado, toda vez que el mismo recurrente afirma\nque 9 de octubre de 2025, el área rectora de salud de Esparza determinó que en\nlo relativo a daño al manglar la competencia correspondía al SINAC y MINAE, y\nque la denuncia se cerraba en sede sanitaria sin perjuicio de remitir o\nreconocer la competencia de las autoridades ambientales, así como que el\nmunicipio determinó mediante acta de inspección nro. 0014-2025 del 10 de\nnoviembre de 2025 que no observó una acción directa de la empresa [Nombre 003]\nS.A. que estuviera ocasionando la sedimentación y se emitieron una serie de\nrecomendaciones.\n\n \n\nEn consecuencia, en los términos\nen que fue interpuesto el recurso, se descarta alguna lesión de raigambre\nconstitucional que amerite la intervención de la Sala en este momento, en lo\nque refiere al Ministerio de Salud y la Municipalidad de Esparza, por lo que se\ndesestima el recurso de amparo en cuanto a estas autoridades. (…)”",

IT IS ALLEGED THAT, DESPITE THE STEPS TAKEN IN RESPONSE TO POSSIBLE IMPACTS AND SEDIMENTATION IN THE MATA DE LIMÓN MANGROVE, SINAC HAS NOT DEFINED OR COMMUNICATED A FINAL COURSE OF ACTION. IT IS CONSIDERED THAT, ALTHOUGH MEETINGS HAVE BEEN HELD AND ACTIONS TAKEN, THE ROADMAP REMAINS PRELIMINARY AND THE ENVIRONMENTAL PROBLEM REPORTED MONTHS AGO HAS NOT BEEN FINALLY ADDRESSED, CONTRARY TO THE PRINCIPLES OF EFFECTIVENESS, CONTINUITY, AND ADMINISTRATIVE COORDINATION. THE AMPARO APPLICATION IS DECLARED PARTIALLY WITH MERIT, AND SINAC IS ORDERED TO DEFINE AND COMMUNICATE THE ROADMAP FOR ADDRESSING THE PROBLEM WITHIN TWO MONTHS. RGS09/2026\n\n“(…) The applicant alleges that, in his work as a geologist, he identified possible environmental impacts in the Mata de Limón estuary sector, Salinas de Esparza, Puntarenas. He therefore filed complaints with the Ministry of Health and the Esparza Municipality. He states that on 9 October 2025, the Esparza health administrative area determined that SINAC and MINAE had jurisdiction over matters concerning damage to the mangrove, and that the complaint was closed at the health authorities’ level, without prejudice to referring the matter to, or recognizing the jurisdiction of, the environmental authorities. (…)”\n\n“(…) Accordingly, the record shows that the authorities of the National Wetlands Program and the Área de Conservación Pacífico Central have held meetings and made decisions to address the problem reported by the applicant concerning the Mata Limón mangrove. However, although the authorities submitted a proposed roadmap to resolve the sedimentation situation, they state that it is a preliminary document that must still be validated by the respondent authorities. In addition, it has not been established that these actions were duly communicated to the applicant, even though he reported the problem on 19 November 2025.\n\nConsequently, it is established that the applicant’s claim concerns a problem reported months ago and related to environmental matters that have not been addressed, an omission that is incompatible with the principles of effectiveness, continuity, and administrative coordination.\n\nTherefore, the amparo application is granted with respect to the SINAC authorities, so that they may definitively establish the roadmap for addressing the complaint filed by the claimant and communicate the relevant information to him, as will be specified in the operative part of this judgment.\n\nIV.- On the other hand, although the order admitting the application was also directed against the Esparza health administrative area and municipality, the application shows that the applicant brought the amparo “against the MINAE National Wetlands Program, the National System of Conservation Areas (SINAC), and the Área de Conservación Pacífico Central, ACOPAC (ACOPAC).” Moreover, the applicant’s own statements show that those authorities had already ruled on and notified the protected party of the complaints, since the applicant himself states that on 9 October 2025, the Esparza health administrative area determined that SINAC and MINAE had jurisdiction over matters concerning damage to the mangrove, and that the complaint was closed at the health authorities’ level, without prejudice to referring the matter to, or recognizing the jurisdiction of, the environmental authorities. He also states that the municipality determined, in inspection report no. 0014-2025 of 10 November 2025, that it had not observed any direct action by company [Nombre 003] S.A. causing the sedimentation, and issued a series of recommendations.\n\nConsequently, given the terms in which the application was brought, no violation of constitutional significance warranting the Chamber’s intervention at this time is found with respect to the Ministry of Health and the Esparza Municipality. The amparo application is therefore dismissed as to those authorities. (…)”"
