"summary_en": "The Constitutional Chamber (Sala Constitucional) partially granted an amparo application concerning the lack of a definitive, communicated roadmap for addressing alleged impacts and sedimentation at the Mata de Limón mangrove in Esparza. It ordered the coordinator of SINAC’s National Wetlands Program and the regional director of SINAC’s Central Pacific Conservation Area, or whoever holds those positions, to take the necessary steps to define and communicate the roadmap within two months of notification. The order applies only to SINAC; the application was denied in all other respects. The Chamber warned of the consequences under Article 71 of the Constitutional Jurisdiction Act for failing to comply with an order issued in an amparo proceeding, and ordered the State to pay costs, damages, and losses, to be assessed during enforcement of the judgment before the administrative-litigation jurisdiction. Justice Salazar Alvarado dissented, proposing that the application be denied because he considered the matter one for the ordinary courts.",

IT IS ALLEGED THAT, DESPITE THE STEPS TAKEN IN RESPONSE TO POSSIBLE IMPACTS AND SEDIMENTATION IN THE MATA DE LIMÓN MANGROVE, SINAC HAS NEITHER DEFINED NOR COMMUNICATED A FINAL RESPONSE PLAN. IT IS CONSIDERED THAT, ALTHOUGH MEETINGS AND ACTIONS HAVE TAKEN PLACE, THE ROADMAP REMAINS PRELIMINARY AND THE ENVIRONMENTAL PROBLEM REPORTED MONTHS AGO HAS NOT BEEN DEFINITIVELY ADDRESSED, IN CONTRAVENTION OF THE PRINCIPLES OF ADMINISTRATIVE EFFECTIVENESS, CONTINUITY, AND COORDINATION. THE AMPARO APPLICATION IS PARTIALLY GRANTED, AND SINAC IS ORDERED TO DEFINE AND COMMUNICATE THE ROADMAP FOR ADDRESSING THE PROBLEM WITHIN TWO MONTHS. RGS09/2026\n\n“(…) The amparo application is partially granted, solely with respect to SINAC. Rotney Piedra Chacón and Carlos Vinicio Cordero are ordered, each in their respective capacity as coordinator of the SINAC National Wetlands Program and regional director of SINAC’s Central Pacific Conservation Area, both within the Ministry of Environment and Energy, or whoever holds those positions, to issue the appropriate orders and take the necessary measures within their respective areas of authority, to ensure that, within a maximum period of TWO MONTHS from notification of this judgment, a definitive roadmap is established for addressing the problem reported by the applicant in the Mata de Limón mangrove in Esparza, and that the corresponding information is communicated to the applicant. The respondent authorities are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, a person who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, which shall be quantified in enforcement of judgment before the administrative-litigation jurisdiction.
