La ejecución de las\nsentencias corresponde a la Sala Constitucional, salvo en lo relativo a la\nliquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias,\no en otros aspectos que la propia Sala considere del caso, en que se hará en la\nvía contencioso administrativa por el procedimiento de ejecución de sentencia\nprevisto en la ley reguladora de esa jurisdicción.” (Lo destacado no\ncorresponde al original).\n\nRecuérdese que en el proyecto de\nley de discusión de la LJC se preveía originalmente lo siguiente:\n\n“Art. 56. Las sentencias\nfavorables al recurrente se ejecutarán en la vía contencioso-administrativa por\nel procedimiento de ejecución de sentencia previsto en la ley Reguladora de esa\nJurisdicción.” (Lo destacado no corresponde al original).\n\n \n\nSin embargo, el texto fue\nmodificado vía moción para que la norma fuera coincidente con lo regulado en el\nart. 153 de la Constitución Política, pero se realizó la siguiente explicación:\n\n“EL SECRETARIO:\n\n Moción No. 68 (32-19) del\ndiputado Chacón Jiménez:\n\n“artículo 57 (antes 56): para que\nel texto se lea así: “la ejecución de las sentencias corresponde a la Sala\nConstitucional, salvo en lo relativo a la liquidación y cumplimiento de\nindemnizaciones o responsabilidades pecuniarias en otros aspectos que la propia\nSala considere del caso, en que se hará en la vía contencioso administrativa\npor el procedimiento de ejecución de sentencia previsto en la ley reguladora de\nesa jurisdicción”.\n\nEL PRESIDENTE:\n\n En discusión la moción leída?\n\n \n\nDoctor Piza Escalante:\n\n Aquí había una contradicción\ncon la tesis genérica de que son los Tribunales los que ejecutan sus sentencias\ny enviaba la Jurisdicción Contencioso Administrativo toda la ejecución;\nentonces quedaban al aire los otros artículos que le permitían a la Sala\nejecutarlos.\n\nDiputado Corrales Bolaños:\n\n En esa parte dice: “o en\notros aspectos que la propia Sala considere del aso…”, a qué se está\nrefiriendo?\n\nDoctor Piza Escalante:\n\n La idea es que la Sala, en la\nvía de ejecución de sentencia, resuelva lo que ella considere que le\ncorresponde. Lo que demás, lo envía a la vía Contencioso Administrativa.\n\n \n\n EL SECRETARIO:\n\n Se considera suficientemente\ndiscutida la moción?\n\n \n\nEL PRESIDENTE:\n\n Discutida. Aprobada (unanimidad,\ncinco señores diputados presentes).” (sic). Ver actas de aprobación de la LJC.\nLo destacado no corresponde al original).\n\n \n\nA partir de lo anterior, está\nclaro que la propia LJC autoriza a esta Sala para que valore y decida si es\npreciso derivar a la jurisdicción contencioso-administrativa todos o algunos\nlos aspectos relativos a la ejecución de la sentencia.\n\n \n\nEn este caso concreto, en virtud\nde la entidad de las órdenes que está girando este Tribunal, estimo que lo\nprocedente es residenciar la fase de ejecución del asunto en la jurisdicción\ncontencioso-administrativa. Lo anterior, debido a la inexistencia de mecanismos\nidóneos previstos por la normativa que rige a esta jurisdicción constitucional\npara dar seguimiento a las órdenes consignadas en esta sentencia que revisten\naspectos técnicos de gran complejidad.\n\n \n\nEn cambio, lo dispuesto por el\nCódigo Procesal Contencioso-Administrativo en materia de ejecución (art. 155 y\nsiguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas,\nimponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento,\netc. Por ello, de conformidad con lo dispuesto por el art. 56 de LJC, considero\nque la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal\nContencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de\nsentencia de dicho Código.(…)”",

Judgments favorable\nto the applicant shall be enforced through the administrative-litigation\nprocedure for enforcement of judgments provided for in the law governing that\njurisdiction.” (Emphasis not in the original.)\n\n \n\nHowever, the text was amended\nby motion so that the provision would be consistent with the regulations in\nArt. 153 of the Political Constitution, but the following explanation was given:\n\n“THE SECRETARY:\n\n Motion No. 68 (32-19) by\nDeputy Chacón Jiménez:\n\n“Article 57 (formerly 56): so\nthat the text reads as follows: ‘enforcement of judgments is the responsibility\nof the Constitutional Chamber, except with respect to the calculation and\npayment of compensation or pecuniary liabilities, in other matters that the\nChamber considers appropriate, in which case it shall be carried out through\nthe administrative-litigation procedure for enforcement of judgments provided\nfor in the law governing that jurisdiction.’\n\nTHE PRESIDENT:\n\n Is the motion just read under\ndiscussion?\n\n \n\nDoctor Piza Escalante:\n\n There was a contradiction here\nwith the general principle that it is the Courts that enforce their own\njudgments, and it sent all enforcement to the Administrative Litigation\nJurisdiction; then the other articles that allowed the Chamber to enforce them\nwere left up in the air.\n\nDeputy Corrales Bolaños:\n\n In that part it says: ‘or in\nother matters that the Chamber considers appropriate…,’ what is it referring\nto?\n\nDoctor Piza Escalante:\n\n The idea is that the Chamber,\nin the judgment-enforcement procedure, resolves what it considers to be within\nits remit. The rest is sent to the Administrative Litigation Jurisdiction.\n\n \n\n THE SECRETARY:\n\n Is the motion sufficiently\ndiscussed?\n\n \n\nTHE PRESIDENT:\n\n Discussed. Approved (unanimously,\nfive deputies present).” (sic). See the minutes approving the LJC.\nEmphasis not in the original.)\n\n \n\nOn the basis of the foregoing,\nit is clear that the LJC itself authorizes this Chamber to assess and decide\nwhether it is necessary to refer all or some aspects relating to enforcement\nof the judgment to the administrative-litigation jurisdiction.\n\n \n\nIn this specific case, given\nthe nature of the orders being issued by this Court, I consider it appropriate\nto assign the enforcement phase of the matter to the administrative-litigation\njurisdiction. This is because the regulations governing this constitutional\njurisdiction provide no suitable mechanisms for following up on the orders set\nout in this judgment, which involve highly complex technical matters.\n\n \n\nBy contrast, the provisions of\nthe Administrative Litigation Procedure Code concerning enforcement (Art. 155\net seq.) offer clear advantages, such as the possibility of requesting\nschedules, imposing fines, establishing liability, supervising stages of\ncompliance, etc. Therefore, pursuant to Art. 56 of the LJC, I consider that the\nenforcement phase should take place before the Enforcement Area of the\nAdministrative Litigation and Civil Treasury Court, under the judgment\nenforcement rules of that Code.(…)”"
