Considera que esta inacción configura una violación de los\nderechos constitucionales y convencionales de las generaciones presentes y\nfuturas a un ambiente sano y ecológicamente equilibrado. (…)”\n\n“(…) En suma, la aplicación del\nprincipio precautorio implica que cuando existan indicadores de que cierta\nactividad plausiblemente podría ocasionar daños graves e irreversibles al\nambiente, la falta de certeza o evidencia científica absoluta al respecto no exime\nde la obligación de adoptar todas aquellas medidas eficientes y eficaces para\nimpedir una vulneración al ambiente. Por\nsu parte, la aplicación del principio de no regresión consiste en una garantía\nque constriñe al Estado a abstenerse de adoptar medidas, políticas o normas que\nempeoren, sin una justificación razonable y proporcionada, el grado de\nprotección a los derechos fundamentales ya alcanzado…(…)”\n\n“(…) …sobre cambio climático\ny derechos humanos, consolidó una interpretación evolutiva de la\nConvención Americana sobre Derechos Humanos, conforme a la cual la crisis\nclimática constituye una amenaza real, actual y creciente para el ejercicio\nefectivo de múltiples derechos fundamentales, entre ellos la vida, la salud, la\nintegridad personal, el acceso al agua, la alimentación, la vivienda digna y el\nderecho a un ambiente sano. (…)”\n\n“(…) … el Estado y, este\ncaso en particular, el Consejo Nacional Ambiental, debió constituirse en\ngarante en la protección y tutela del medio ambiente y los recursos naturales,\npor medio de la designación pronta de las personas idóneas, para que el Tribunal\nAmbiental Administrativo pueda ejecutar las labores que le han sido\nencomendadas.(…)”\n\n“(…) …se acredita que, de\nconformidad con los registros correspondientes, el Consejo Científico de Cambio\nClimático desarrolló su actividad hasta marzo de 2021 -ocasión en que\ncesó el nombramiento de su integración anterior- y que, a la fecha de interposición\ndel presente recurso, el MINAE no ha efectuado la designación de nuevos\nmiembros para el período que correspondía una vez finalizado el ciclo que le\nantecede.\n\nEn ese sentido, el artículo\n9 del Decreto Ejecutivo No. 40615-MINAE define con claridad que una competencia\ndel Ministerio accionado es, precisamente, nombrar a quienes integren el\nConsejo indicado, detallando que “El Ministro de Ambiente y Energía designará mediante\noficio a los miembros del consejo científico en virtud de sus\nméritos (sic) y atestados por un plazo de tres años, prorrogables por\nigual plazo. (…)”\n\n“(…) Como producto de lo\nanterior, este Tribunal estima que el hecho de que haya transcurrido\naproximadamente 5 años y 4 meses desde el vencimiento del nombramiento de la\nintegración anterior, resulta un plazo desproporcionado y violatorio de los\nderechos fundamentales de la parte tutelada. Esta omisión se reviste una mayor\ngravedad, tomando en consideración que el derecho fundamental a un medio\nambiente sano y ecológicamente equilibrado ha sido protegido por la\njurisprudencia de esta Sala como un interés difuso, es decir, cuya protección\natañe a la colectividad. (…)”\n\n“(…) En el caso del Consejo\nCientífico de Cambio Climático, el artículo 1 del Decreto Ejecutivo No.\n40615-MINAE define con gran claridad que este es un órgano integrado por\npersonal técnico experto cuya finalidad es asesorar al gobierno en materia de\ninvestigación científica y desarrollo tecnológico en el área del cambio\nclimático, de manera que se trata de un organismo de control y fiscalización\npara la toma de decisiones basadas en ciencia y técnica en materia de políticas\npúblicas ambientales. (…)”\n\n“(…) De igual manera, la\njurisprudencia constitucional fue enfática al definir que, como Costa Rica es\nun Estado signatario de instrumentos internacionales que han considerado al\ncambio climático como una problemática que afecta los derechos humanos\n-situación que refuerza la obligatoriedad de aplicar los principios de equidad\nintergeneracional, de la debida diligencia reforzada de los Estados y de la\nprotección diferenciada de las poblaciones vulnerables frente al cambio\nclimático, todos vinculados al amparo del derecho a un medio ambiente sano-;\nentonces debe existir una adecuada fiscalización ambiental por parte de las\nautoridades públicas para constatar la salvaguarda de la población frente a la\nemergencia climática. Bajo esta tesitura, el criterio de este Tribunal es que\nestos pronunciamientos de Tribunales internacionales, que son un sustento para\nla definición de una línea jurisprudencial en defensa de los derechos\nfundamentales de las personas de cara al cambio climático, representan\ninstrumentos de aplicación vinculante para el Estado costarricense, por formar\nparte de los sistemas universal y regional de protección de los derechos\nhumanos. Como resultado de lo anterior, esta Sala estima que la omisión de las\nautoridades del MINAE en cuanto a efectuar el nombramiento de los integrantes\ndel Consejo, tiene como resultado un menoscabo en la respuesta institucional\nque la institucionalidad costarricense brinda en su obligación para mitigar el\nfenómeno climático, en los términos recién expuestos.\n\nPor ello, procede la\nestimatoria del recurso en los términos expuestos en la parte dispositiva de\nesta sentencia. IT IS ALLEGED THAT THE\nMINISTRY OF ENVIRONMENT AND ENERGY FAILED TO APPOINT THE NEW MEMBERS OF THE\nSCIENTIFIC COUNCIL ON CLIMATE CHANGE (4C), DESPITE THE EXPIRATION OF ITS\nMEMBERS’ APPOINTMENTS. IT IS CONSIDERED THAT APPOINTING SUITABLE PERSONS TO\nCOMPRISE THIS ADVISORY BODY IS ESSENTIAL TO THE PERFORMANCE OF ITS SCIENTIFIC\nADVISORY FUNCTIONS AND TO THE INSTITUTIONAL RESPONSE TO CLIMATE CHANGE. THE\nMINAE’S PROLONGED FAILURE THEREFORE UNDERMINES THE PROTECTION OF THE RIGHT TO A\nHEALTHY ENVIRONMENT. THE AMPARO APPLICATION IS GRANTED. THE MINAE IS ORDERED TO\nAPPOINT THE MEMBERS OF THE SCIENTIFIC COUNCIL ON CLIMATE CHANGE WITHIN TWO\nMONTHS. RGS09/2026\n\n“(…) The applicant alleges that, as of the date the amparo application was\nfiled, the MINAE had not issued the official letter appointing a new group of\nmembers, as required by Article 9 of the aforementioned Decree. This constitutes\na failure to perform the duties assigned to the person heading that Ministry.\nThe applicant considers that this inaction violates the constitutional and\nconventional rights of present and future generations to a healthy and\necologically balanced environment. (…)”\n\n“(…) In short, applying the precautionary principle (principio precautorio)\nmeans that when there are indicators that a certain activity could plausibly\ncause serious and irreversible harm to the environment, a lack of certainty or\nabsolute scientific evidence in that regard does not relieve the authorities of\nthe obligation to adopt all efficient and effective measures to prevent harm to\nthe environment. (…)”\n\n“(…) Thus, under the principle of progressivity (principio de\nprogresividad), the State undertakes to increase, as far as possible, the levels\nof protection of human rights, including the right to a healthy and\necologically balanced environment. For its part, applying the principle of\nnon-regression (principio de no regresión) guarantees that the State must\nrefrain from adopting measures, policies, or rules that worsen the level of\nprotection of fundamental rights already attained, without reasonable and\nproportionate justification…(…)”\n\n“(…) …on climate change and human rights, established an evolving\ninterpretation of the American Convention on Human Rights (Convención Americana\nsobre Derechos Humanos), under which the climate crisis constitutes a real,\npresent, and growing threat to the effective exercise of multiple fundamental\nrights, including life, health, personal integrity, access to water, food,\ndecent housing, and the right to a healthy environment. (…)”\n\n“(…) …the State and, in this particular case, the National Environmental\nCouncil (Consejo Nacional Ambiental), should have acted as guarantor of the\nprotection and safeguarding of the environment and natural resources by\npromptly appointing suitable persons, so that the Administrative Environmental\nTribunal (Tribunal Ambiental Administrativo) could carry out the tasks\nentrusted to it. (…)”\n\n“(…) …the relevant records show that the Scientific Council on Climate\nChange (Consejo Científico de Cambio Climático) carried out its work until\nMarch 2021, when the appointments of its previous members expired, and that, as\nof the date this amparo application was filed, the MINAE had not appointed new\nmembers for the term that should have begun once the preceding term ended.\n\nIn this regard, Article 9 of Decreto Ejecutivo No. 40615-MINAE clearly\ndefines one of the powers of the respondent Ministry as precisely the\nappointment of members of the Council in question, specifying that ‘The\nMinister of Environment and Energy shall appoint the members of the scientific\ncouncil by official letter, on the basis of their merits (sic) and credentials,\nfor a three-year term, renewable for an equal term. (…)’”\n\n“(…) As a result of the foregoing, this Court considers that the passage of\napproximately 5 years and 4 months since the previous members’ appointments\nexpired constitutes a disproportionate period and violates the fundamental\nrights of the party whose rights are being protected. This omission is\nparticularly serious, given that this Chamber’s case law has protected the\nfundamental right to a healthy and ecologically balanced environment as a\ndiffuse interest, that is, one whose protection concerns the community. (…)”\n\n“(…) Article 1 of Decreto Ejecutivo No. 40615-MINAE clearly defines the\nScientific Council on Climate Change as a body composed of expert technical\npersonnel whose purpose is to advise the government on scientific research and\ntechnological development in the area of climate change. It is therefore an\noversight and supervisory body for making science- and technology-based\ndecisions on environmental public policy. (…)”\n\n“(…) Likewise, constitutional case law has emphatically held that, because\nCosta Rica is a State party to international instruments that have recognized\nclimate change as an issue affecting human rights—a circumstance that\nreinforces the obligation to apply the principles of intergenerational equity,\nheightened due diligence by States, and differentiated protection of\npopulations vulnerable to climate change, all linked to the protection of the\nright to a healthy environment—public authorities must provide adequate\nenvironmental oversight to ensure that the population is safeguarded in the\nface of the climate emergency. In this vein, this Court considers that\npronouncements by international courts, which support the development of a\nline of case law defending people’s fundamental rights in the face of climate\nchange, are binding instruments for the Costa Rican State because they form\npart of the universal and regional systems for the protection of human rights.\nAs a result, this Chamber considers that the MINAE authorities’ failure to\nappoint the Council’s members undermines the institutional response provided\nby Costa Rican institutions in fulfilling their obligation to mitigate the\nclimate phenomenon, in the terms set out above.\n\nTherefore, the amparo application must be granted on the terms set out in\nthe operative part of this judgment.
