THE PROLONGED\nOMISSION BY MINAE THEREFORE UNDERMINES THE PROTECTION OF THE RIGHT TO A\nHEALTHY ENVIRONMENT. THE AMPARO APPLICATION IS GRANTED. THE MEMBERS OF THE\nSCIENTIFIC COUNCIL ON CLIMATE CHANGE MUST BE APPOINTED WITHIN TWO MONTHS.\nRGS09/2026\n\n“(…) PARTIALLY DISSENTING OPINION\nOF JUSTICE RUEDA LEAL.\n\nIn this case, I note that,\nsince March 2021, the Ministry of Environment and Energy has failed to appoint\nthe members of the Scientific Council on Climate Change.
