IT IS ALLEGED THAT THE MINISTRY OF ENVIRONMENT AND ENERGY FAILED TO APPOINT THE NEW MEMBERS OF THE SCIENTIFIC COUNCIL ON CLIMATE CHANGE (4C), DESPITE THE EXPIRATION OF ITS MEMBERS’ APPOINTMENTS. THE APPOINTMENT OF SUITABLE PERSONS TO THIS ADVISORY BODY IS CONSIDERED ESSENTIAL TO THE PERFORMANCE OF ITS SCIENTIFIC ADVISORY FUNCTIONS AND TO THE INSTITUTIONAL RESPONSE TO CLIMATE CHANGE. THE MINAE’S PROLONGED OMISSION THEREFORE UNDERMINES THE PROTECTION OF THE RIGHT TO A HEALTHY ENVIRONMENT. THE AMPARO APPLICATION IS GRANTED. THE MEMBERS OF THE SCIENTIFIC COUNCIL ON CLIMATE CHANGE MUST BE APPOINTED WITHIN TWO MONTHS. RGS09/2026\n\n“(…) The amparo application is granted. She is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they must comply with or enforce and fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty daily units, provided the offense is not more severely punished. The State is ordered to pay the costs, damages, and losses caused by the events underlying this ruling; those amounts shall be assessed in enforcement proceedings in the administrative-litigation jurisdiction. Justice Rueda Leal partially dissents only as to the period for appointing the members of the Scientific Council on Climate Change, taking the view that the appointments must be made within one month at most.
