Las sentencias favorables al recurrente se ejecutarán en la vía\ncontencioso-administrativa por el procedimiento de ejecución de\nsentencia previsto en la ley Reguladora de esa Jurisdicción.” (Lo\ndestacado no corresponde al original).\n\nSin\nembargo, el texto fue modificado vía moción para que la norma fuera\ncoincidente con lo regulado en el art. 153 de la Constitución\nPolítica, pero se realizó la siguiente explicación:\n\n“EL\nSECRETARIO:\n\n Moción\nNo. 68 (32-19) del diputado Chacón Jiménez:\n\n“artículo\n57 (antes 56): para que el texto se lea así: “la ejecución de las\nsentencias corresponde a la Sala Constitucional, salvo en lo relativo\na la liquidación y cumplimiento de indemnizaciones o\nresponsabilidades pecuniarias en otros aspectos que la propia Sala\nconsidere del caso, en que se hará en la vía contencioso\nadministrativa por el procedimiento de ejecución de sentencia\nprevisto en la ley reguladora de esa jurisdicción”.\n\nEL\nPRESIDENTE:\n\n En\ndiscusión la moción leída?\n\n \n\nDoctor\nPiza Escalante:\n\n Aquí\nhabía una contradicción con la tesis genérica de que son los\nTribunales los que ejecutan sus sentencias y enviaba la Jurisdicción\nContencioso Administrativo toda la ejecución; entonces quedaban al\naire los otros artículos que le permitían a la Sala ejecutarlos.\n\nDiputado\nCorrales Bolaños:\n\n En\nesa parte dice: “o en otros aspectos que la propia Sala considere\ndel aso…”, a qué se está refiriendo?\n\nDoctor\nPiza Escalante:\n\n La\nidea es que la Sala, en la vía de ejecución de sentencia, resuelva\nlo que ella considere que le corresponde. Lo que demás, lo envía a\nla vía Contencioso Administrativa.\n\n EL\nSECRETARIO:\n\n Se\nconsidera suficientemente discutida la moción?\n\n EL\nPRESIDENTE:\n\n Discutida.\nAprobada (unanimidad, cinco señores diputados presentes).” (sic).\nVer actas de aprobación de la LJC. Lo destacado no corresponde al\noriginal).\n\n A\npartir de lo anterior, está claro que la propia LJC autoriza a esta\nSala para que valore y decida si es preciso derivar a la jurisdicción\ncontencioso-administrativa todos o algunos los aspectos relativos a\nla ejecución de la sentencia.\n\nEn\neste caso concreto, en virtud de la entidad de la orden para que se\nrealicen las acciones y obras necesarias de infraestructura vial para\nsolucionar los problemas de inundaciones en la zona referida por la\nrecurrente, estimo que lo procedente es residenciar la fase de\nejecución del asunto en la jurisdicción contencioso-administrativa.\nLo anterior, debido a la inexistencia de mecanismos idóneos\nprevistos por la normativa que rige a esta jurisdicción\nconstitucional para dar seguimiento a las órdenes consignadas en\nesta sentencia que revisten aspectos técnicos de gran complejidad.\n\nEn\ncambio, lo dispuesto por el Código Procesal\nContencioso-Administrativo en materia de ejecución (art. 155 y\nsiguientes) tiene evidentes ventajas, como la posibilidad de pedir\ncronogramas, imponer multas, sentar responsabilidades, fiscalizar\netapas de cumplimiento, etc. Por ello, de conformidad con lo\ndispuesto por el art. 56 de LJC, considero que la fase de ejecución\ndebe realizarse ante el Área de Ejecución del Tribunal Contencioso\nAdministrativo y Civil de Hacienda, bajo las reglas de ejecución de\nsentencia de dicho Código. Emphasis not in the original.)\n\nOn the basis of the foregoing, it is clear that the LJC itself authorizes this Chamber to assess and decide whether it is necessary to refer all or some aspects relating to enforcement of the judgment to the administrative litigation jurisdiction.\n\nIn this specific case, given the scope of the order to carry out the actions and works necessary for road infrastructure to solve the flooding problems in the area identified by the applicant, I consider that the appropriate course is to assign the enforcement phase of the matter to the administrative litigation jurisdiction. This is because the rules governing this constitutional jurisdiction provide no suitable mechanisms for monitoring the orders set out in this judgment, which involve highly complex technical aspects.\n\nBy contrast, the provisions of the Administrative Litigation Procedure Code on enforcement (art. 155 et seq.) offer clear advantages, such as the possibility of requesting schedules, imposing fines, establishing liability, monitoring stages of compliance, etc. Therefore, pursuant to art. 56 of the LJC, I consider that the enforcement phase should take place before the Enforcement Area of the Administrative Litigation and Civil Treasury Court, under the judgment enforcement rules of that Code. (…)”"
