SUMMARY DISMISSAL BECAUSE A COMPLAINT WAS FILED WITH THE\nCHAMBER INSTEAD OF FIRST BEING SUBMITTED TO THE COMPETENT AUTHORITIES;\nFURTHERMORE, THE CHAMBER HAS NO AUTHORITY TO DETERMINE OWNERSHIP AND\nPOSSESSION OF THE PROPERTY. SUMMARY DISMISSAL. RGS09/2026\n\n“(…) The\napplicant states that he is Indigenous and belongs to the Maleku\nethnic group. He asserts that he is the registered owner of property\nnumber [Valor 003], located within Maleku Indigenous Territory, with\na consolidated registry history dating from 1974, that is, before\nthe promulgation of Indigenous Law No. 6172 of 1977. (…)”\n\n“(…) . The\npurpose of an amparo proceeding is to provide timely protection\nagainst direct violations or threats to fundamental rights and\nfreedoms, not to serve as a general instrument for channeling other\ntypes of requests. Accordingly, the Constitutional Chamber (Sala Constitucional)\ncannot be expected to act, through amparo, as a mere processing\nbody for complaints or reports, since doing so would not only require\nthe taking of complex evidence, which is incompatible with the\nsummary nature of this forum, but would also directly replace\nadministrative discretion and usurp the role of public offices in\nhandling matters within their jurisdiction. For this reason, the\nChamber has declined to hear environmental complaints directly.
